Full textThe intimate connection between autonomy and decision-making in applied health care, especially in various kinds of consent and refusal has taken center stage in medical ethics since the Salgo decision in 1957. Prior to that time, the physician’s supposedly moral duty to provide appropriate medical care typically surpassed the legal obligation to respect patient’s autonomy. The Salgo decision concluded that physicians have a legal duty to provide facts necessary for the patient to make an informed decision. "The doctor knows best" long ago was replaced with "The doctor proposes; the patient disposes." There is no legal obligation for the patient’s choice to be palatable to anyone, other than that patient himself/herself. Although Beauchamp and Childress justified the obligation to solicit decisions from patients and potential research subjects by the principle of respect for autonomy, they however, acknowledged that the principle’s precise demands remain unsettled and open to interpretations and specification. This thesis addresses a current debate in the bioethical community on the four-principle approach. Using Tom Beauchamp and James Childress as case study, to discuss mainly the principle of respect for autonomy, I go on to explain their central arguments concerning this principle in relation to decision making in health care ethics. Rather than focus on their respective weaknesses, which many theorist and health care professionals do, I emphasis instead on the contribution the principle of respect for autonomy can make in the process of ethical decision making in health care situation.

Intimate partner violence (IPV) is a public health emergency and due to the often-hidden nature of IPV, it is not readily apparent who is a victim. However, a large proportion of victims are economically disadvantaged, and the emergency department is the first place where many patients present, whether it be for related or unrelated concerns. IPV is difficult to detect, and unfortunately, physicians are also notoriously poor at predicting who is a victim, especially in the emergency department. Because IPV is lethal, it is imperative to improve detection of victims and to intervene when they come forward. This paper seeks to elucidate future sustainable improvements in IPV detection and intervention in the emergency department. Findings indicate that universal computer screening in the emergency department followed by immediate intervention and contact with an IPV-specific advocate is a necessary step to start combating IPV.

Full textA problemática da invasão da privacidade do doente tem sido frequentemente descurada por parte dos profissionais de saúde, nomeadamente, por parte dos enfermeiros, que no seu dia-a-dia com as técnicas e intervenções no doente, frequentemente invadem a sua privacidade e intimidade. Ora, não obstante este problema ser uma realidade, infelizmente frequentemente vivenciada, verifica-se alguma dificuldade no acesso a literatura, o que não foi obstáculo para a selecção desta temática que nos preocupa e nos moveu para uma revisão teórica e uma reflexão da mesma. Ficará pois visível a importância que o conceito de Privacidade tem para o doente, bem como, a sua influência para uma melhor recuperação. Deste modo, considera-se importante a reflexão e discussão deste assunto, por forma a garantir uma melhor prática de enfermagem, vendo o doente não só no seu aspecto fisiológico, mas também, no seu aspecto psico-social. Assim, o enfermeiro desenvolve, não só os conhecimentos e competências técnicas e científicas, mas assegura ao doente, a protecção e o direito à privacidade e à sua intimidade.
The issue of invasion of patient's privacy has often been controversial speech on the part of health professionals, particularly from nurses, who in their day to day with their techniques and interventions in patients, often invade their privacy and intimacy. However, despite this problem being a reality, unfortunately often experienced, there is some difficulty in access to literature, which was not obstacle for the selection of this subject that concerns us and moved us to a theoretical review and a reflection of it. It will become visible as the importance that the concept of privacy has on the patient, as well as their influence to a better recover of him. Thus, it is important to reflect and discuss this matter in order to ensure better nursing practice, seeing the patient not only in its physiological aspect, but also on their psycho-social aspect, offering not only the their expertise, but also protection for their right to privacy and intimacy.

Full textThis research is articulated around a founding hypothesis: the feeling of nature that motivates the hikers is an urban feeling. Loving the nature, searching for a physical contact with it, spending energy and money to go through it and experience extraordinary feelings are all elements of the modern cultural weft. Tourists at the GR20 (Corsica) and at the Chapada Diamantina (Bahia, Brazil) inherited from the history of the idea of nature, from the history of the individual and from the history of free time in western civilization. They are moved by the desire of nature, which is worked out in the urban routine, and which emergence conditions are similar in both countries. However, the features of the « hiking ritual » in each of these places change according to their social structures and their « national myths ». In one hand, we can see how French tourists in Corsica experience and act the « myth of the individual » (Miguel Benasayag), fulfilled by equality and autonomy values. On the other hand, Brazilian tourists perform a hierarchical social scene, which places them between the guide who serves them and the natural divinity that overwhelms them. In both cases, a political question can be asked: does the feeling of nature hide and legitimate a « selective democracy » (Jessé Souza) that is connected to a depoliticization of nature as raw material ?

Full textFor this paper, emotional and socio-political questions lie at the heart of relationships in understanding intellectual disability and what it is to be a human. While the sexual and intimate is more often than not based on a private and personal relationship with the self and (an)other, the sexual and intimate life of intellectually disabled people is more often a ‘public’ affair governed by parents and/or carers, destabilizing what we might consider ethical and caring practices. In the socio-political sphere, as an all-encompassing ‘care space’, social intolerance and aversion to difficult differences are played out, impacting upon the intimate lives of intellectually disabled people. As co-researchers (one intellectually disabled and one ‘non-disabled’), we discuss narratives from a small scale research project and our personal reflections. In sociological research and more specifically within disability research it is clear that we need to keep sex and intimacy on the agenda, yet also find ways of doing research in a meaningful, caring and co-constructed way.

Full textDesde há muito tempo que a literatura investiga a temática da infidelidade (Prado, 2016). Este estudo pretende relacionar os filhos terem, ou não, conhecimento da infidelidade da mãe ou do pai, com a sua perceção sobre coesão familiar, atitudes acerca da infidelidade, ética relacional e intimidade. A amostra contabiliza 338 jovens-adultos, com idades entre os 18 e os 35 anos. Os instrumentos utilizados foram: Escala de Coesão, versão Portuguesa de Gomes, H. Peixoto, F., e Gouveia-Pereira, M. (2017); Escala de Atitudes de Infidelidade (Afonso, 2011); Questionário Multidimensional de Comportamentos Extra-relacionais (Viegas & Moreira, 2015); Relational Ethics Scale (Hargrave, Jennings & Anderson,1991); e Escala de Avaliação da Intimidade na Relação, versão Portuguesa de Moreira e Canavarro (2007). Os resultados demonstram que os filhos tendem a ter atitudes mais negativas quando o pai foi infiel. Mostram, igualmente, que não há diferenças entre homens e mulheres, terem sido infiéis, ou não, quanto às suas atitudes face à infidelidade. Filhos de pai infiel tendem a ter uma Ética Vertical de Justiça e de Direito mais baixa. Filhos de mãe infiel, tendem a ter uma Ética Vertical de Justiça, de Direito e Ética Horizontal de Justiça mais baixa. Quanto à Coesão Familiar, apresenta correlação positiva entre a infidelidade do pai e a coesão desagregada. Contudo, a coesão aglutinada tem maior impacto nas atitudes acerca da infidelidade dos filhos. Quanto à intimidade não difere entre os dois grupos. Assim, espera-se que novas investigações continuem a abordar a temática, reunindo as perceções de filhos, mães e pais.
For a long time literature has investigated the theme of infidelity (Prado, 2016). This study aims to relate the young-adults who had or not knowledge of the fidelity of the mother or the father, with a perception about family cohesion, attitudes about fidelity, relational ethics and intimacy. A sample of 338 young-adults, aged 18 to 35 years. The instruments used were: Cohesion Scale, Portuguese Version of Gomes, H. Peixoto, F., and Gouveia-Pereira, M. (2017); Infidelity Attitudes Scale (Afonso, 2011); Multidimensional Questionnaire of Extra-Related Behaviors (Viegas & Moreira, 2015); Relational Ethics Scale (Hargrave, Jennings & Anderson, 1991); and Relationship Intimacy Rating Scale, Portuguese Version by Moreira and Canavarro (2007). The results demonstrated that the children adopted more negative attitudes when the father was unfaithful. Equally shown that there are no differences between men and women, they were infected or not as to their attitudes towards infidelity. When the father was unfaithful young-adults tend to have a lower Vertical Ethics of Justice and Entiltle. When the mother was unfaithful young-adults tend to have a lower Vertical Ethics of Justice, Entiltle and Horizontal Ethics of Justice. As for Family Cohesion, it presents a positive correlation between father's infidelity and disengaged cohesion. However, enmeshed cohesion has a greater impact on attitudes about young-adults infidelity. As for intimacy does not differ between the two groups. Thus, it is expected that further investigations will continue addressing the theme, gathering as perceptions of children, mothers and fathers.

Full textThis dissertation analyzes how contemporary French artist Sophie Calle and contemporary French writer Annie Ernaux transgress the discursive, aesthetic, and social boundaries between public and private life. Taking a feminist perspective and drawing on theories of everyday life, this dissertation asks: what liberties are the female artist and writer permitted today? Where, how and by whom are the ethical limits of creative practice established? In light of often stereotypical literary and artistic representations of the female criminal, the first chapter examines the accusations of obscenity, shamelessness and indecency levelled against Calle and Ernaux by their critics. The following three chapters identify the diverse, innovative and subversive ways in which Calle and Ernaux question accepted perceptions of femininity in order to seize creative freedom: they assume the distinct and tactical positions of flâneuses, heart-broken women avenging their ex-lovers, and theorists manipulating the reception of their own works. Together, these four chapters trace the artwork’s resonance in the public sphere, insist on the fruitful relationship that exists between a work of art and its frame, and consider the ethos of the artist as well as that of art. Sophie Calle’s and Annie Ernaux’s practices suggest that in order to achieve creative autonomy, art and writing must function outside of the constraints of moral, ethical, social and even civil laws. By examining instances in which artists, writers, curators and publishing houses have been subject to lawsuits in France since 2010, the conclusion of this dissertation studies a recent increase in the litigation of art and outlines some of the limits of representation as defined by the law.
