Full textA deontologia é uma disciplina da ética que estabelece o exercício de uma determinada profissão, através de tratados, princípios, deveres e normas adoptadas a um grupo específico de profissionais. A ética, por sua vez, é o domínio da filosofia que tem por objectivo o domínio do juízo de apreciação que distingue o bem e o mal, o comportamento correto do incorrecto. Nesses sentido, os códigos que normatizam a conduta de uma determinada profissão são dificilmente separáveis da deontologia profissional, pelo que não é pouco frequente os termos ética e deontologia serem utilizadas indiferentemente. O objectivo desse trabalho de pesquisa pretende abordar as principais semelhanças e diferenças dos diferentes códigos deontológicos dos países da União Europeia, nomeadamente, Portugal, Espanha, França e Reino Unido, bem como, demonstrar a influência do Council European Dentists sobre cada um dos países mencionados. Realizou-se revisão bibliográfica do Código de Ética do Médico Dentista da União Europeia, bem como dos Códigos Deontológicos Português, Espanhol, Britânica e Francês. Foram, entretanto, pesquisados livros do tema em questão. Relativamente às Normas Legais em geral, verificamos que apesar das diferenças tipicamente culturais, encontramos semelhanças, visto que todos os países respeitam a Lei Maior, sendo nesse caso, as Normas do Council European Dentists, que vigora como Lei Suprema. The ethics is a discipline of ethics establishing the pursuit of a given profession, through treaties, principles, duties and standards at a specific group of professionals. Ethics, in turn, is the domain of philosophy that seeks the domain judgment of discretion that distinguishes good and evil, the correct behavior incorrect. In that sense, codes of are hardly separable from the professional ethics, so it is not uncommon the terms ethics and deontology are used interchangeably. The purpose of this research work aims to address the main similarities and differences of the different ethical codes of EU countries, including Portugal, Spain, France and United Kingdom, as well as demonstrate the influence of the Council European Dentists on each of the mentioned countries. We conducted a literature review of the Code of Ethics of the European Union Dentists and the Portuguese, Spain, United Kingdom and France Codes of Ethics. They have now been research them books in question. With regard to Legal Standards in general, we find that despite some differences that will be presented throughout the presentation of the work, due to the typically cultural differences, we find many similitaries, since all countries respect the highest law, in which case, the Standards European Council of Dentists.

Full textETHICS WITH CODES: A PHILOSOPHIC AND JURIDICAL ANALYSIS OF DEONTOLOGICAL RULES IN MEDICINE AND HIS RELATIONS WITH THE LEGAL SYSTEM AND THE STATE This work constitutes an investigation about the reasons of the current tendency to an increasing ethic and deontological regulation in the specific field of medicine (through the proliferation of ethical -deontological- codes, the creation of (bio)ethics institutions of control in medicine issues, protocolized proceedings of taking decisions in clinical ethics, etcetera), in the line with a growing externalization by the State of the regulation function and authority decisions to private subjects, organizations and corporations. This analysis about the growth of bioethic rules and different shapes of ethic codification, focuses, on one side, on the called «risk sociology» -that studies the technological risks phenomenon and, among other things, the legal and political answers to it-, especially about the medical and biotechnological advances and clinical and pharmacological investigations. On the other side, this analysis is centered on the phenomenon of the penetration of the market logic and its decision power system on the medical and on the scientific and technical autonomous field. This work concludes that this phenomenon of ethic self-regulation of the medical profession and medical, technical and scientific corporations, growths at expense of an increasing evasion of a legal and public regulation of the technical and scientific activities in the sphere of medicine: it produces a minimum of public law in front of a maximum of ethic self-regulation with implications in the legal and public guaranties and in the democratization process of the states.

Full textThe main purpose of this study is to investigate the architect and urban planner\'s professional behavior, their values and intentions, confronting them with the existing standards of the current codes of professional conduct in Brazil, as well as to compare these codes with those from other countries. Initial focus is given to the history of professional development, the rise of professional institutions, the current organization of the profession and the codes of conduct that rules the profession at present and their disciplinary procedures in countries of Anglo-Saxon culture, specifically the United Kingdom and the United States. Subsequently, the study considers the reality of the architect and the urban planner in Brazil, through the history of their professional development, the rise of the institutions and organizations that govern the profession in the country and the codes of conduct in force. To carry out this research, a theoretical and documentary survey was undertaken, supported by field research regarding the institutions located in the city of São Paulo. The study concludes with a comparative analysis of the three countries, refering to the history of the professional development, the rise of their institutions and the current organization of the profession in each country. The analysis also compares the codes and disciplinary procedures that govern the behavior and the professional practice of the architect and the urban planner.

Full textA importância de um comportamento ético dos contabilistas é um pilar na sustentabilidade das empresas. Tal importância da ética e da deontologia nesta profissão justifica o presente trabalho, cujo objetivo passa por avaliar o comportamento ético dos Contabilistas Certificados(CC), a partir do quadro legal da Ordem profissional. Para o efeito, o estudo desenvolvido foi suportado numa metodologia de cariz qualitativa e quantitativa com recurso a um questionário dirigidos aos contabilistas certificados. Após a análise dos resultados, conclui-se que a maioria dos CC inquiridos são profissionais com um comportamento ético e deontológico adequados. Denota-se, que os profissionais, em geral têm um conhecimento do código deontológico na sua formação académica, bem como a sua relevância e agem de acordo com os princípios e valores morais e que alguns mostraram não valorizarem e não respeitam os princípios éticos e deontológicos, sendo os mais velhos e com menos habilitações literárias são aqueles que “não cumprem” o código.
The performance of companies and their businesses is a pillar in the sustainability of companies. The science is not found this is just present this work, your own passability annual certifications Certificates (CC), using the perpetitive of Professional Order. For this purpose, the design was supported in a qualitative and quantitative qualification methodology using a questionnaire addressed to certified accountants. After an analysis of the results, it is concluded that the respondents are professionals with an ethical and deontological behavior appropriate. It is also pointed out that professionals do not have a high degree of knowledge about their academic education, as well as their relevance and act according to their principles and values. On the other hand, there were also respondents who were not valued and did not respect the ethical and deontological principles, and the older and less literate are those who "do not comply" the code.

Full textThe dentistry ethics codes in Argentina, Colombia, Spain, Mexico, Portugal, Peru, Uruguay and Venezuela have been described and compared with the dentistry ethics code existing in Brazil. The referred comparison happened about the following aspects: rights and duties of the professional, relationship with the patient, professional secrecy, professional fees, advertising and dental specialties. Some advantages and disadvantanges, were observed in the foreign codes of ethics in relation to the brazilian dentistry ethics code. On that basis, some changes were proposed to the brazilian dentistry ethics code, such as the inclusion of items which discipline the conduct of the professional dealing with HIV positive patients, force the professional to the denunciation of violence suffered by patient, insure the professional the possession of dental records, establish professional secrecy exclusively as duty of the occupation, as well as the change of the text to better explain what are the facts and information that should be subject of the professional secrecy.

As condutas das classes trabalhadoras, pautadas pelos códigos de ética já não são capazes de prestigiar todos os conflitos enfrentados pelos profissionais, visto que foram concebidos em uma base deontológica. Fatores como o avanço tecnológico e genético, a medicalização na saúde, a deficiência na alocação de recursos, entre outros, alavancaram o surgimento da bioética, com princípios e conceitos que devem ser considerados na conduta e prática profissional. Recentemente o código de ética profissional para fisioterapeutas e terapeutas ocupacionais foi reformulado e novas versões em separado para cada profissional foram publicadas. Frente ao contexto histórico, o presente estudo teve por objetivo verificar a proporção de enfoque bioético presentes no antigo e novos códigos de ética destas profissões. Para isso, utilizou os conceitos de análise de conteúdo proposto por Bardin, porém para fonte documental. Foram fragmentadas unidades textuais em categorias do principialismo bioético (autonomia, beneficência, não maleficência e justiça), bem como nas categorias técnica e virtude consideradas de enfoque deontológico. Em seguida, as unidades textuais categorizadas foram quantificadas para as análises. Os resultados mostraram que o enfoque deontológico, estava mais presente no antigo código, representando 54,4% do total das unidades textuais. Entre as categorias do principialismo bioética a justiça era o mais presente (17,8%), seguido de autonomia profissional (11%), não maleficência (8,5%), autonomia do cliente (5,2%) e beneficência (3,4%). Nos textos com enfoque bioético, a autonomia do cliente apresentou resultado inverso, com 10,5% frente a 7,9% para autonomia profissional. Nos novos códigos, tanto da Fisioterapia como da Terapia Ocupacional, as unidades textuais com enfoque bioético prevaleceram, 53% e 53,6% respectivamente. Redução significativa (p<0,05) foi observada na proporção da autonomia profissional sobre a do cliente nos dois novos códigos, porém a autonomia do cliente passou a ser a unidade textual menos encontrada nos dois novos códigos, sendo constatados 5,7% para o código do fisioterapeuta e 5,1% para o do terapeuta ocupacional. A beneficência deixou de ser a menos citada, passou de 3,4% no antigo código para 6,6% e 6,3% nos novos códigos para o fisioterapeuta e o terapeuta ocupacional respectivamente. Apesar de discreta, houve aproximação aos referenciais bioéticos nos conteúdos dos novos códigos de ética quando comparado ao antigo, possivelmente, pelo aumento da categoria justiça e beneficência. As menores relações da autonomia do profissional sobre a autonomia do cliente evidenciada nos novos códigos, apesar de discreta, direcionam para um conteúdo mais voltado para as questões bioéticas. No entanto, essa relação ainda é contrária àquela apresentada nos textos de enfoque bioético, o que revela uma concepção ainda paternalista que poderá ser modificada com as novas discussões a partir dos novos códigos. _______________________________________________________________________________________ ABSTRACT
The conduct of the working classes, guided by codes of ethics are no able to prestige all the conflicts fronted by professionals, since they were made in a deontological basis. Technological and genetic progresses, medicalization in health, disability resource allocation, among others, have leveraged the emergence of bioethics, with principles and concepts that should be considered in the conduct and professional practice. Recently the professional ethics code for physiotherapists and occupational therapists was redesigned and new versions separately for each professional were published. Front of the historical context, the present study aimed to determine the proportion of bioethical approaches present in the old and new codes of ethics of these professions. For this, we used the concepts of content analysis proposed by Bardin, but for documentary source. Textual units were fragmented into categories of principlism bioethics (autonomy, beneficence, non-maleficence and justice), as well as in technical and virtue categories, considered of deontological approach. Then, the textual units categorized, were quantified for analysis. The results showed that the deontological approach was more prevalent in the old code, representing 54.4% of textual units. Among the categories of bioethical principlism the justice was more frequent (17.8%), followed by professional autonomy (11%), non-maleficence (8.5%), client autonomy (5.2%) and beneficence (3.4%). In the bioethics approaches texts, client autonomy showed opposite result, with 10.5% compared to 7.9% for professional autonomy. In the new codes of Physiotherapy and Occupational Therapy, textual units with bioethical approach prevailed, 53% and 53.6% respectively. Significant reduction (p<0.05) was observed in the proportion of professional autonomy over client autonomy in two new codes, but the client autonomy became the least textual unit found in the two new codes, being observed 5.7% for physiotherapist code and 5.1% for the occupational therapist code. The beneficence no longer is the least cited, increased from 3.4% in the old code to 6.6% and 6.3% in the new codes for the physiotherapist and occupational therapist respectively. Although slight, there approach to bioethical references in contents of the new codes when compared to the old, possibly by increasing the category justice and beneficence. The lowest ratios of professional autonomy over client autonomy in the new code, although slight, direct to content more focused on bioethical issues. However, this relationship is still contrary to that presented in the texts of bioethical approach, which reveals a conception still paternalist that could be modified with further discussion from the new codes.

Full textThe increase in the number of ethical infractions committed by dentists for not fulfilling the norms of the Code of Dental Ethics (CDE), suggests that these professionals are unprepared to face the ethical problems that appear in the daily of its profession. Ahead of this, it was considered to analyze the knowledge of dentists and dental students, related to this deontological code, searching still, to verify, if it has statistically significant difference, how much to the knowledge level, between the groups: of the academics of the last year of graduation in Dentistry (GROUP I), of the dentists who exclusively act in doctor\'s office or clinic (GROUP II), and of the clinical dentists of who attend a course specialization (GROUP III). For this, 150 questionnaires had been applied (50 for each group), with objective questions that turned on some of main articles of the CDE. The results had confirmed that really deficiency in the knowledge of some on ethical aspects attended with the Dentistry, where, of the 150 participants, n=90 (60%) don\'t know that, beyond the dentist, all the professionals of other recognized auxiliary categories for the Federal Advice of Dentistry, must follow the ethical norms of the CDE. Another interesting result, sample that 31% of the participants, not to know that, in some cases, the dentist has right to resign to the attendance of the patient during the treatment. The GROUP II, when compared with the other groups, it was what it demonstrated a bigger deficiency in the knowledge of the ethical questions that involve the Dentistry. One concluded that a bigger possible spreading of the CDE is necessary, mainly to those professionals exclusively physicians, with maximum persistence of the Advice of Dentistry, beyond the professors of the area and the entities of classroom, searching preventively to educate and to instruct, to prevent to condemn and to punish.
