Abstract:
V tomto textu nejprve vymezíme dilemata a popíšeme proces jejich vzniku. Budeme se věnovat popisu dilemat v historii a to prostřednictvím šesti hodnotových a etických směrů. Nastíníme etická dilemata neboli problémy sociálních pracovníků tak, jak jsou pojímány v Etickém kodexu Společnosti sociálních pracovníků České republiky. V další části se budeme věnovat dilematům současné sociální práce. Zvlášť pak ve zkratce popíšeme dilema mezi právem a etikou. Celkem vymezíme osmnáct dilemat a ke každému uvedeme, jak se eventuálně mohou promítnout do práce s romským etnikem. Jedná o osobní zkušenosti autora a také o zkušenosti sociálních pracovníků. Také zde navrhneme možnosti, jak s těmito dilematy pracovat. Dylematy pracowników socjalnych związane z pracą z romską grupą etniczną W tym tekście w pierwszej kolejności zdefiniujemy dylematy oraz opiszemy proces ich powstawania. Skoncentrujemy się na opisie dylematów w historii za pośrednictwem sześciu wartości i kierunków etycznych. Zarysujemy dylematy etyczne oraz problemy pracowników socjalnych tak jak są ujęte w Kodeksie Etyki Pracowników Socjalnych Republiki Czeskiej. W części dalszej zajmiemy się dylematem współczesnej pracy socjalnej. Zdefiniujemy osiemnaście dylematów i podamy jak każdy z nich może rzutować na pracę z romską grupą etniczną. Przedstawione zostaną osobiste doświadczenia Autora jak i doświadczenia pracowników socjalnych. W tej pracy sugerujemy różne możliwości radzenia sobie z dylematami. Dilemmas of social workers with regard to work with the Roma ethnic group In this paper we will first define the dilemmas and describe the process of their their formation. We will describe dilemmas in history through six ethical value and ethical orientations. We will outline the ethical problems of social workers as they are included in the Code of Ethics of the Society of Social Workers oft he Czech Republic. In the next part of we will deal with the dilemmas of contemporary social work. We will define eighteen dilemmas and statefore each of them how they may eventually be reflected in work with the Roma ethnic group. The author’s personal experiences as well as the experiences of social workers will be presented. In this paper we suggest different options for dealing with dilemmas.

Abstract Mostly overtime, ethical-theological discussion is also influenced by dilemmatic situations that cause doubts in making choices. In fact, the starting point of ethics is to consider an issue and take a stand on it without compromise with any situation in between. In this situation, questions arise about whether ethics has carried out its implementative function appropriately? With the growing firmness to making a choice, ethical-theological responsibility now requires its implementation under direction. Christian theologians notices their respective perspectives on highlighting the context of the times that creates moral dilemmas. This research seeks to offer ethical decision concepts and models when dealing with a dilemma problem in order to reawaken the firmness in ethically responding to the challenges of the times. Abstrak Dekade ini, diskusi etika teologis turut dipengaruhi oleh situasi dilematis yang menyebabkan keraguan dalam menentukan pilihan. Padahal, titik tolak etika adalah mempertimbangkan sebuah persoalan dan mengambil sikap atasnya tanpa kompromi dengan situasi apa pun. Di dalam keadaan ini, muncullah pertanyaan-pertanyaan tentang apakah etika telah menjalankan fungsi implementatifnya dengan tepat? Dengan berkembangnya ketegasan untuk menentukan pilihan, tanggung jawab etis-teologis kini memerlukan arah implementatifnya. Para teolog etika Kristen memiliki perspektifnya masing-masing menyoroti konteks zaman yang menciptakan dilema moral. Penelitian ini berupaya menawarkan konsep dan model pilihan etis ketika berhadapan dengan sebuah persoalan dilematis guna menyadarkan kembali ketegasan dalam beretika merespons tantangan zaman.

This study aims to examine 1) The effect of education level on ethical dilemmas in accounting students at Padang State University, 2) The effect of cumulative achievement index on ethical dilemmas in accounting students at Padang State University, and 3) The influence of gender on ethical dilemmas in accounting students at Padang State University. This research is a type of causative research. This research uses a research instrument in the form of an ethical dilemma scenario with 213 respondents of accounting students. Data analysis techniques using the chi square test. The results of the study found that 1) The level of education was proven to have a significant positive effect on ethical dilemmas with the sig value of questions 1, questions 2, questions 3, and questions 4 in the ethical dilemma scenario of 0.028; 0.026; 0.003; 0.004 which is smaller than 0.05. 2) The cumulative achievement index is proven to have a significant positive effect on ethical dilemmas with a sig in question 1, question 2, question 3, and question 4 of 0.001; 0,001; 0,000; 0,000 <0.05. 3) Gender was not proven to have a significant positive effect on ethical dilemmas with the value of question 1, question 2, question 3, and question 4 in the ethical dilemma scenario of 0.234; 0.288; 0.510; 0.444> 0.05.

Sve očigledniji raskorak između duhovnog razvoja čovjeka koji uglavnom stagnira, a nerijetko i nazaduje i tehnološkog razvoja društva koji intenzivno i nezaustavljivo raste, otvara brojne bioetičke teme u širokom rasponu od brige za čovjeka i njegovo zdravlje do brige za prirodu i opstanak života u cjelini. Brojne etičke rasprave koje su obilježile posljednja desetljeća rezultirale su općeprihvaćenim etičkim načelima, ali isto tako su mnoga etička pitanja ostala bez jasnih i nedvojbenih odgovora. U tom kontekstu pravna regulativa od koje se očekuje da zaštiti osobe od neprihvatljivih i štetnih postupaka, ali i da istovremeno ne bude prepreka znanstvenom i tehnološkom razvoju društva, dobiva posebno značenje. Riječ je o velikom izazovu jer kroz zakonske odredbe treba postići balans između slobode znanstvenog istraživanja i zaštite čovjeka. Iako etičke dvojbe prate gotovo svako područje ljudskoga djelovanja, bioetički sadržaji posebno su vezani uz neslućena tehnološka dostignuća u medicini. Pritom, jedna od najranjivijih skupina pacijenata, osobe s duševnim smetnjama zahtijeva naglašeni bioetički senzibilitet u smislu humanosti, razumijevanja i pojačane osjetljivosti kod primjene etički upitnih medicinskih postupaka prema njima i osobito kod njihovog uključivanja u, ponekad i rizična, biomedicinska istraživanja. Temeljni zaštitni mehanizam za ovu kategoriju osoba u Republici Hrvatskoj je Zakon o zaštiti osoba s duševnim smetnjama. Njime je uspostavljen jasni pravni okvir za postupanje prema osobama s duševnim smetnjama te se neke njegove odredbe mogu smatrati konkretnim odgovorom na brojne etičke dileme. Analiza tih odredbi koja je predmetom ovoga rada može poslužiti kao relevantan pokazatelj bioetičkog senzibiliteta Zakona o zaštiti osoba s duševnim smetnjama.

L’etica in ambito infermieristico riveste da sempre grande importanza per la peculiare natura disciplinare dell’infermieristica. Proprio per questo l’etica viene variamente interpretata e trattata all’interno del sapere infermeiristico in relazione ai diversi approcci disciplinari ed interpretazioni da parte dei docenti. In questo lavoro non si intende disquisire sulle diverse correnti etiche oggi variamente presenti nella comunità scientifica, bensì fare una panoramica sulle diverse concezioni con le quali si interpreta l’etica in campo infermieristico. Fondamentalmente esse si possono ricondurre a tre filoni principali: l’etica come filosofia, l’etica come norma e l’etica come assistenza, quest’ultima a sua volta articolata in due oreintamenti, l’etica in relazione a “teorie e modelli infermiersitici” e l’etica del “prendersi cura”. In realtà si evince che tutti gli orientamenti proposti hanno in sé dei limiti poiché sviluppare l’etica infermieristica secondo un orientamento significa tendere a sviluppare un atteggiamento categoriale, interpretato, con il rischio di non andare alla radice della questione etica nell’intento di riconoscere la peculiarità di ogni essere umano. Si conclude affermando la ricchezza e l’importanza delle diverse concezioni etiche per la professione infermieristica ma non senza aver sviluppato gli elementi che costituiscono la base della fenomenologia etica e cioè la Legge Morale Naturale, la Coscienza e la Moralità. Perché un infermiere possa esercitare con competenza la sua professione deve sviluppare gli elementi della moralità, in particolare la coscienza etica. Soltanto a queste condizioni egli potrà essere in grado di vivere pienamente la dimensione etica del suo servizio riconoscendo i problemi e dilemmi etici nella quotidianità del suo lavoro nel tentativo di rispondere secondo gli orientamenti che riterrà più conformi alla sua natura etica ma sempre nel rispetto della intrinseca “valorialità” della persona umana.

Cedera Otak Traumatik (COT) merupakan penyebab utama kematian dan kesakitan pada anak-anak dan dewasa muda di seluruh dunia. Dilaporkan sebuah kasus COT pada seorang pasien anak laki-laki berusia 5 tahun yang jatuh dari lantai 2. Pasien didiagnosis dengan cedera kepala berat dengan perdarahan epidural dan subdural dengan level ASA 3–4. Dilema etis yang dihadapi ahli anestesi adalah tindakan anestesi berisiko tinggi tetapi kemungkinan penyelamatan nyawa tidak berhasil, sehingga apakah masih tetap dilakukan operasi atau hanya diberikan terapi suportif?. Laporan ini membahas tentang pemecahan dilema etik dan medikolegal berdasarkan teori etika klinik. Hasil pertimbangan etika dan medikolegal pada kasus ini dilakukan secara komprehensif dengan menghasilkan keputusan bersama antara tim dokter dengan keluarga pasien. Dengan pemberian informasi yang adekuat mengenai indikasi medik dengan tetap memperhatikan sudut pandang permintaan (keinginan) pasien, kualitas hidup maupun fitur kontekstual maka meskipun pada akhirnya pasien ini tidak berhasil diselamatkan, paling tidak keluarga pasien puas atas pelayanan yang telah diberikan. Clinical Ethics and Medicolegal Considerations for Anesthesia Management in Cases of Traumatic Brain InjuryAbstractTraumatic Brain Injury (COT) is a leading cause of death and illness in children and young adults throughout the world. A case of COT was reported in a 5-year-old boy who fell from the 2nd floor. The patient was diagnosed with a severe head injury with epidural and subdural bleeding with ASA levels 3-4. The ethical dilemma faced by the anesthesiologist is the high-risk anesthetic procedure but the possibility of life saving is unsuccessful, so whether the surgery is still being performed or only given supportive therapy?. This report discusses solving ethics and medicolegal dilemmas based on clinical ethics theory. The results of ethical and medicolegal considerations in this case were carried out comprehensively by producing a joint decision between the team of doctors and the patient's family. By providing adequate information regarding medical indications while still giving attention to the patients' preferences, quality of life and contextual features, even though these patients were ultimately unsuccessful, at least the patient's family was satisfied with the services provided.

Contrary to the laws governing the legal duties of health workers and punish their violation of ethical norms are not clearly defined laws, but commonly prescribe appropriate codes. In the Federation B i H, as well as the Republiika Srpska formal codes of which were developed by the International Code of ethics of nurses. Negative trends in society have made to the medicine under the influence of various factors in the first place money, turned into a fertile ground for individuals to prove himself. Where we often neglect the true value of human achievement, but the stress and adopt values based on statistical results. In the race for the continuous improvement and studying health care workers, and everyone else, neglect respecting the needs and values of people. The position of nurses in relation to ethical issues is very ambiguous, located between opposing attitudes and expectations. Although required independent action and independent thinking, to once again request the cooperation and approval of others. Nurses are more and more considered as employees, rather than professionals with a clearly defined mission and professional activities. The official stance is sometimes more appreciated than ethically responsible execution of their duties. The task of every health care professional is to achieve the highest ethical standards of professional conduct and to motivate such behavior colleagues and associates.

Abstract:
Internal factors play an important role in decision making, especially under conditions of a dilemma. Therefore, we examined the internal factors of individuals consisting of gender, age, and level of education in the deliberations and decision-making when faced with ethical dilemmas. This study used a survey by Aluchna & Mikolajczyk (2013) and Eweje & Brunon (2010) to collect data. 106 students who were respondents in this study were divided into 87 undergraduate students and 19 postgraduate students. Hypothesis testing used was nonparametric chi-square test to see the differences in the perception of respondents. As a result, women were more often indicate or face the ethical dilemma rather than in men. Age did not affect the attitude when it was faced with moral dilemmas for the development of the higher age of respondents, where it is not necessarily better than the moral development of the respondents with a younger age. There was no different in perception between age and level of education to ethical dilemmas. Practical contribution of this research was taken into consideration by the personnel manager when recruiting human resources and become knowledgeable in instilling ethics education from an early age, so that the moral development of the individual can arrive at the highest stage.

Scopo del presente contributo è delineare il perimetro entro il quale articolare una riflessione critica relativa alla questione della responsabilità giuridica connessa all’attività di Consulenza Etica in Ambito Sanitario (CEAS). Innanzitutto, saranno illustrate le ragioni per le quali ritenere che, al momento attuale, in Italia, la CEAS resa da un Consulente Etico singolo rappresenti il modello che meglio risponde all’esigenza di garantire un servizio di qualità ai pazienti e agli operatori sanitari. In secondo luogo, saranno analizzati gli elementi in base ai quali possa considerarsi ascrivibile in capo al Consulente Etico una responsabilità giuridica per violazione di una norma civile o penale. Infine, a partire dall’analisi dell’evoluzione giurisprudenziale e degli interventi legislativi di riforma in ambito sanitario, verrà avanzata una proposta in ordine alla disciplina applicabile all’operato del Consulente Etico in caso di danno procurato al paziente. Alla luce di quanto esposto, si tenterà di sostenere come il formale riconoscimento, anche giuridico, della figura del Consulente Etico possa risultare funzionale sia a dare contenuto all’effettivo ruolo svolto dal consulente nel processo di cura, sia a incentivare la stessa diffusione della cultura della CEAS, intesa come processo dialogico che ha lo scopo di contribuire al miglioramento dell’assistenza sanitaria mediante l’individuazione, l’analisi e la risoluzione dei dilemmi etici riconducibili alla pratica clinica.

Educators are confronted by specific ethical issues in their everyday work. However, awareness of these issues, the search for answers to them and their consideration, demand due diligence and time. Thus, the importance of ethics and its impact may be downplayed. An educator aims to pay attention to the development of a child/student, especially with respect to the environment or social setting itself, and the responsibility toward society itself is evident from this. The educator's responsibility should also be related to the profession itself and the social perception of the teaching profession. The aim of the research was to examine whether a school's code of ethics and the training to use an Ethical Decision-making Model could be used to support teachers in solving ethical dilemmas. The research sample consisted of teaching staff working at a primary school in Prague. The teachers work in the first stage of primary school. The selected primary school has a code of ethics as an internal regulation. In total, five interviews with teachers were conducted. Respondents agreed that the Code of Ethics and Ethical Decision-making Model are good support for their professional practice. They are primarily useful in the communication process, especially when talking to children, colleagues and parents.

Seringkali dalam suatu pengelolaan perusahaan, terdapat dilema etis, dimana dilema etis tersebut dapat memaksa suatu entitas (individu/organisasi) untuk melakukan tindak kecurangan.oleh karenanya, dalam pencapaian tujuan perusahaan, sebaiknya bila perusahaan tidak terlalu memprioritaskan pencapaian laba semata. Mungkin perusahaan dapat mencapai tujuan tersebut dengan segala cara, namun jika permasalahan etis menjadi terbelengkalai akan berdampak pada perilaku individu maupun perilaku organisasi tersebut. Pengelolaan resiko etika yang buruk dapat menimbulkan tindak kecurangan yang tidak hanya dilakukan oleh individu semata, namun dilakukan oleh perusahaan sebagai suatu organisasi. Oleh karenanya, makalah ini mengungkap dan menggambarkan pengelolaan (tatakelola) resiko etika yang buruk pada PT.“G” di Di Jatim akan berakibat pada tindakan kecurangan yang dilakukan oleh tidak hanya pegawainya, namun juga oleh manajemen perusahaan. Přehledová studie shrnuje současné domácí i zahraniční poznatky o tom, co prožívá školní psycholog ve vztahové síti školy a jak reaguje na situace, kdy je vystaven sociálním tlakům ze strany vedení školy nebo učitelského sboru či nadřízených školských orgánů. Na psychologa bývá občas vyvíjen nátlak, aby ve „vyšším zájmu“ souhlasil s rozhodnutími, která se týkají žáků, kolegů, rodičů i školy, i když takové rozhodnutí není z etického hlediska v pořádku. Přehledová studie věnovaná tomuto tématu má pět částí. První část prezentuje názory odborníků a výsledky dílčích výzkumných sond o etických problémech, s nimiž se setkávají školní psychologové v České republice. Druhá část prezentuje výsledky výzkumů těch etických problémů a etických dilemat, s nimiž se potýkají školní psychologové v USA, Kanadě a ve vybraných evropských zemích. Ve třetí části je charakterizován důležitý pojem této studie – morální distres. Čtvrtá část studie popisuje kvalitativní, kvantitativní a smíšené diagnostické přístupy ke zkoumání eticky náročných situací, i zvláštnosti školních psychologů, kteří se v těchto situacích musí rozhodovat. Pátá část shrnuje doporučení o tom, jak morálnímu distresu u školních psychologů předcházet, a pokud už se distres vyskytne, jak v takových případech cíleně intervenovat, aby se jeho negativní dopady snížily.

Tujuan penelitian ini adalah memahami realitas dilema etis yang dihadapi oleh auditor internal pemerintah di Inspektorat Provinsi Kalimantan Barat serta tindakan yang ditempuh auditor untuk mengatasi dilema itu. Mayoritas penelitian-penelitian terdahulu mengkondisikan dilema etika dalam desain skenario. Oleh karena itu penelitian ini termotivasi untuk meneliti dilema etis yang lebih berbasiskan lapangan dengan paradigma interpretif. Dengan menggunakan pendekatan dan metode penelitian fenomenologi, dapat disimpulkan bahwa (1) auditor merasakan dilema saat mendapat intervensi dari obrik, (2) auditor mengalami perasaan tidak enak hati saat melaporkan kesalahan teman, (3) auditor harus menghadapi persepsi publik, (4) auditor merasa kecewa ketika Laporan Hasil Pemeriksaan tidak ditandatangani serta (5) keterbatasan jumlah auditor, waktu audit dan infrastruktur pendukung merupakan faktor penghambat audit. Dilema etis dalam berbagai macam situasi tersebut diatasi auditor dengan mewujudkan elemen kesatuan kesadaran. Dengan ber- landaskan pada kesadaran spiritual, kesadaran sosial, kesadaran profesi dan kesadaran hukum yang terinternalisasi dalam dirinya maka perilaku etis auditor dapat terwujud.

Bioetika telah berkembang di Indonesia sejak tahun 2000, namun sampai saat ini belum banyak rumah sakit di Indonesia yang menyediakan pelayanan etika klinis. Sebagai konsekuensinya, belum ada publikasi tentang etika klinis sampai saat ini di Indonesia. Sementara itu, kemajuan teknologi medis telah memicu timbulnya berbagai dilema etis yang harus diputuskan oleh para klinisi yang berpraktik di sarana pelayanan kesehatan. Idealnya, keputusan tersebut seharusnya didukung pendapat ahli etika. Oleh karena itu, makalah ini akan menelaah pentingnya pelayanan etika klinis di Indonesia dengan meninjau pengalaman pelayanan etika klinis yang terdapat di Inggris, Amerika Serikat, dan Australia. Meskipun terdapat beberapa kritik terhadap pelayanan etika klinis, temuan empiris telah menunjukkan manfaat dari pelayanan etika klinis. Tulisan ini mendukung pendapat bahwa pelayanan etika klinis harus dibentuk di seluruh sarana pelayanan kesehatan yang berada di Indonesia karena meningkatkan kualitas pelayanan kesehatan, mengurangi risiko tuntutan hukum, dan memenuhi kehendak masyarakat.

<p class="Style1">Penelitian ini bertujuan untuk menganalisa pengaruh pengalaman audit, komitmen profesional, orientasi etika, dan nilai etika organisasi terhadap pengambilan keputusan etis auditor dal= situasi dilema etika. Dalam sampel ini terdapat kriteria yang digunakan dalam pengambilan sampel, yaitu KAP yang termasuk <em>The Big Four </em>dan berlokasi di Jakarta dan responden dalam penelitian ini berjurnlah 80 orang. Dalam penelitian ini, penulis menggunakan uji kausalitas. Data diperoleh melalui penyebaran kuesioner dengan skala likert interval yang diadopsi dari Sasongko (2007). Alat analisis yang digunakan untuk pengujian hipotesa adalah uji parsial. Hasil penelitian menunjukkan bahwa pemaharnan etika (nilai etika organisasi dan orientasi etika), komitmen profesional, dan pengalaman audit mempunyai pengaruh yang signifikan terhadap keputusan etis auditor.</p>

Malformaţiile congenitale de cord, cu o incidenţă de 6-8/1.000 de nou-născuţi, reprezintă aproximativ 30% dintre cazurile de mortalitate infantilă determinate de anomalii congenitale. Dintre acestea, o mare parte necesită intervenţie chirurgicală corectoare imediat în perioada neonatală. Malformaţiile rinichilor şi tractului urinar au o incidenţă de aproximativ 1%. Dezvoltarea tehnicilor de ecografie fetală a permis diagnosticarea prenatală a multor malformaţii, unele cu risc vital. Astfel, apar probleme deosebite de etică privind întreruperea sarcinii sau îndrumarea gravidei către un centru unde nou-născutul va putea fi operat în primele ore de viaţă.

Prescripţia „off-label“ reprezintă administrarea medicamentelor pe o cale neaprobată, într-o formulare sau doză neaprobată la copii, sau sub intervalul de vârstă indicat pe prospectul aprobat al produsului. Cu toate acestea, tratamentul cu indicaţii off-label este un fenomen larg răspândit în clinicile de pediatrie. Deoarece multe dintre medicamentele prescrise nu au fost testate în mod adecvat la copii, această populaţie de pacienţi rămâne vulnerabilă. Pe de o parte, folosirea indicaţiilor off-label la copii determină o mulţime de controverse, pe de altă parte, fără această posibilitate, unii pacienţi ar putea fi lipsiţi de şansa de a fi trataţi. Lucrarea prezintă amplitudinea fenomenului de prescriere a medicamentelor cu indicaţii off-label la copii, evaluată în studii ştiinţifice din SUA şi Europa. În multitudinea de medicamente prescrise off-label la copii se înscrie şi Sildenafil. Autorii îşi propun prezentarea situaţiei din România cu privire la medicamentul Sildenafil şi utilizarea acestuia în unităţile de cardiologie pediatrică.

Perkembangan pesat di bidang hukum dan kedokteran di Indonesia menyebabkan wacana akan hukuman pidana berbasis medis tak dapat dikekang lagi. Misalnya injeksi letal, yang dinilai memiliki letalitas tinggi dan bahkan dianggap meminimalisasi penderitaan terpidana, dinilai lebih baik dan etis dibandingkan alternatif eksekusi konvensional seperti hukuman tembak mati. Namun, secara teknis pelaksanaan tindakan pro justitia ini memunculkan dilema etik bagi profesi kedokteran jika tindakan ini mencederai, membuat cacat baik permanen maupun sementara, ataupun menyebabkan kematian bagi terpidana. Di satu sisi, profesi kedokteran senantiasa harus setia pada karakternya yang mengedepankan kemanusiaan dan berorientasi menyembuhkan manusia. Di sisi lain, menyerahkan suatu tindakan kedokteran pro justitia kepada selain dokter, berpotensi merugikan terpidana karena tindakan tersebut tidak dilakukan secara profesional. Dilema etik ini secara umum perlu diatur dalam fatwa etik profesi kedokteran, yang mana merupakan wewenang Majelis Kehormatan Etik Kedokteran (MKEK). Dalam pelaksanaannya, hal ini perlu dimusyawarahkan seluruh pihak yang berkepentingan, termasuk eksekutif, legislatif, dan yudikatif yang akan menarasikan bentuk eksekusi hukuman tersebut.

Dewasa ini, kejahatan seksual sangat mudah ditemui, mulai dari kasus pelecehan seksual hingga pemerkosaan yang berujung pada tindakan pembunuhan. Kejahatan tersebut bahkan tidak memandang bulu, baik pria maupun wanita, dewasa hingga anak-anak dapat menjadi korban dari pelaku kejahatan seksual. Pedofil merupakan orang dengan gangguan dorongan seks berlebih dengan target anak-anak di bawah umur. Menanggapi peningkatan tren kejahatan pedofilia, pemerintah mengeluarkan UU No. 17 Tahun 2016 yang menetapkan hukuman kebiri kimia bagi para pelaku sebagai bentuk perlindungan terhadap anak. Dokter sebagai profesi yang memiliki kompetensi terbaik di bidang kesehatan (kemanusiaan) kemudian menghadapi dilema terkait tinjauan etik kedokteran yang ada terhadap kasus ini. Ikatan Dokter Indonesia (IDI) telah mengeluarkan fatwa penolakan dokter sebagai eksekutor kebiri yang dinilai dapat mencederai sumpah profesi, mengingat efektivitas kebiri yang masih dipertanyakan dan risiko komplikasi lain yang harus dihadapi terpidana dengan hukuman kebiri.

Berdasarkan Undang-Undang Republik Indonesia Nomor 15 Tahun 2006, BPK merupakan lembaga negara yang diamanatkan oleh UUD 1945 untuk melakukan pemeriksaan pengelolaan serta tanggung jawab atas keuangan negara. Agar tercipta kesuksesan pemeriksaan tersebut, pemeriksa BPK harus menegakkan etika profesional di setiap pemeriksaannya. Tujuan penelitian ini adalah menganalisis strategi untuk menegakkan etika profesional pemeriksa BPK. Penelitian ini adalah penelitian kualitatif dengan metode deskriptif dimana peneliti mendeskripsikan temuan dan melakukan analisa atas temuan tersebut. Berdasarkan documentary research diketahui bahwa kesadaran ketuhanan yang dibangun dari religiusitas membentuk moral dan kesadaran pemeriksa BPK untuk menegakkan kode etik sehingga menuntun pribadi pemeriksa BPK agar selalu memutuskan bersikap etis ketika dihadapakan pada dilema etis. Pada akhirnya, penelitian ini memberikan tujuh strategi atau rekomendasi sebagai upaya menegakkan etika profesional pemeriksa BPK yaitu, kemampuan manajemen moral, menjadi pemeriksa BPK yang amanah, memiliki pengetahuan hukum yang cukup, memiliki pemahaman kode etik profesi yang komprehensif, memiliki kecintaan pada alam, mengenali setiap praktik tidak etis dan tidak berusaha mencari-cari kesalahan.

This study aims to identify the reasons why individu wants or does not to manipulates the financial statements. The design of this study refer to ethical dilemma scenarios developed by Sofyani and Pramita (2014). The samples are students of accounting from one university in Yogyakarta, which has joined in financial accounting and taxation courses. Data was analyzed using thematic deductive analysis approach (Braun and Clarke, 2006). The study find that the majority of students who want to manipulate the financial statements due to the reason that the manipulation did not force the legislation. While the majority of students who refuse the manipulation of financial statements reasoned that it violates religion obligation, because there is an element of falsehood. The results of this study can be used as the basis to develop further study with a broader scope, such as with survey approach

Il complesso fenomeno del doping presenta notevoli problemi di definizione. Queste difficoltà, che hanno influenzato l’evoluzione delle politiche anti-doping, sono ulteriormente acuite dall’assenza di una cornice etica chiaramente definita, in grado di giustificare inequivocabilmente le azioni di contrasto intraprese dalle agenzie sportive a partire dalla seconda metà del XX secolo. Ai problemi di interpretazione del doping nelle sue forme tradizionali si sono aggiunte, da qualche decennio, le questioni relative al doping genetico. Il contributo analizza le diverse tipologie di tecnologia genetica, potenzialmente utilizzabili per un miglioramento della prestazione atletica, nella prospettiva di una valutazione etica. Oltre ai problemi medici, legali e morali del doping tradizionale, il doping genetico pone dilemmi etici inediti che rischiano di rendere le risposte dell’etica sportiva e delle politiche anti-doping, se non inefficaci, per lo meno inadeguate e anacronistiche. Nonostante la difficoltà di prevedere l’impatto che le tecnologie genetiche potranno avere sul mondo dello sport, la prospettiva del doping genetico, non diversamente da altre forme di doping, ma più radicalmente, pone due tipi di questioni. In primo luogo, costringe a ripensare alla natura e alle finalità dello sport e delle competizioni atletiche come espressioni dell’eccellenza umana. In secondo luogo, solleva questioni fondamentali circa la definizione dell’identità e della dignità umane nella civiltà tecnologica. ---------- Interpreting doping is fraught with difficulties at the very level of a comprehensive and consistent definition of the phenomenon. Such difficulties have influenced the evolution of anti-doping policies, that are further hindered by the lack of a clearly articulated ethical framework. Moreover, in the last few decades, a host of moral dilemmas has been arising in connection with gene doping. This article analyses different kinds of genetic technology that could enhance athletic performances in the light of their moral implications. In addition to the medical, legal, and ethical problems inherent in traditional doping, gene doping raises a whole range of new ethical issues that might render the current formulations of sport ethics and anti-doping policies, if not ineffectual, at least inadequate and anachronistic. Notwithstanding the difficulties in foreseeing how developments in genetic technology might impact the world of sport in the future, the perspective of gene doping radicalises two kinds of issues, that are not stranger to other forms of doping. Firstly, it leads to reconsider the nature and goals of sport as an expression of human excellency, and secondly, it raises fundamental questions about the definition of human identity and dignity in a technological civilization.

Come afferma I. M. Young, alcune concettualizzazioni e pratiche odierne della medicina sembrano alienare la donna incinta dalla sua esperienza corporea. Oggigiorno, il sottoporre la gestante a ripetuti esami ecografici è diventata pratica routinaria. D’altra parte, sembra ormai assodato che una visione precoce delle immagini fetali possa facilitare il sorgere di una relazione emozionale della madre al bambino. Lo scopo di questo articolo è, pertanto, quello di fornire un’analisi dei principali studi presenti in letteratura sull’argomento al fine di chiarire se davvero il mezzo ecografico favorisce lo sviluppo di una relazione materna al feto, quali sono le caratteristiche di tale relazione e, infine, di discutere le implicazioni che tale processo di ridefinizione della gravidanza come evento biomedico ha sulla donna. Nowadays the use of the ultrasound technique in pregnancy has become a routine practice, especially because early fetal images encourage the maternal emotional relationship to the fetus. Thus, the aim of this paper is to survey the extant literature in order to clarify whether ultrasounds actually encourage the maternal bond to the fetus, to make explicit what kind of bond ultrasounds are really able to produce, and finally to discuss the repercussion on the position of women in the process of redefinition of pregnancy as a biomedical event. Indeed, the boom of ultrasound in obstetric practice seems to have encouraged the spread of a vision of gestation as an event belonging only to the fetus. Thus, the center of the screen becomes the only center of the reproductive process and “foetality” becomes the real synonymous of procreation. In this light, ultrasound technology seems to implement an individualistic vision of the subject and its future, as it separates the fetus from its mother and to cooperate to create a disembodied culture of gestation and procreation where the “maternal fragility” is completely ignored.

Social work is as a help profession. It has a basic task in overcoming social problems, one of them is handling the beggars. The method used in this study was a qualitative method by describing the implementation of the value principles and ethics of social workers in handling the beggars through the Yogyakarta Society of Social Workers Association and the ethical dilemmas inside. The purpose of this study was expected to provide an overview of practices in the field as an effort to improve the quality of social work, increasingly to have adequate competence, both in terms of values and ethics in carrying out their profession. The results of this study indicated that in the implementation of the value principles and ethics of social workers with reviews of acceptance, individualization, disclosure of feelings, non-judgmental attitudes, objectivity, self determination, confidentiality and accountability. The whole principles had been practiced. However, during practicing in the field, there were ethic dilemmas in the application of the principles. They were dilemmas in client confidentiality, policy laws, management care and scarce and limited resources.

Abstract This study assessed the progress of Malaysian universities in producing morally upright accountants by evaluating the moral competencies of the third-year accounting students enrolled at the Universiti Sains Islam Malaysia (USIM). An instrument was developed through a collaboration with Islamic accounting scholars; 79 third-year students were surveyed. The survey revealed that the current crop of the third-year accounting students were not morally competent enough to deal with the inevitable moral dilemmas they would face in the work place. The implication of this result is that USIM’s accounting department has to re-examine its current curriculum as to its ethics coverage. Abstrak Penelitian ini bertujuan untuk menilai perkembangan universitas-universitas di Malaysia dalam hal menghasilkan para akuntan yang jujur. Penelitian ini dilakukan dengan langkah mengevaluasi kompetensi moral mahasiswa akuntansi tahun ketiga di Universiti Sains Islam Malaysia (USIM). Instrumen yang digunakan adalah survey, yang dikembangkan melalui kolaborasi para cendekiawan muslim dengan mensurvey 79 mahasiswa tahun ketiga. Hasil survey menunjukkan bahwa para siswa tahun ketiga akuntansi pada zaman sekarang ini belum memiliki kompetensi moral dalam hal dilemma moral pada bidang pekerjaan mereka. Surplus embrio dari proses simpan beku merupakan konsekuensi kemajuan teknologi ini sendiri. Dilema etika muncul tentang bagaimana sebaiknya mengelola surplus embrio. Di sisi lain, peraturan perundangan di Indonesia saat ini hanya memperbolehkan untuk memperpanjang masa penyimpanan atau membuang surplus embrio.Metode: Metode penelitian menggunakan Participant of observation dengan purposive sampling. Penelitian ini merupakan intisari pemikiran dari ilmuwan dan pegiat bioetika di Indonesia yang dikemukakan dalam Seminar dan Diskusi Bioetika dalam Pelayanan Teknologi Reproduksi Berbantu, Agustus 2016 di Yogyakarta.Hasil: Pertimbangan etika tentang bagaimana sebaiknya surplus embrio diperlakukan dibahas oleh tiga ilmuwan dengan latar belakang agamawan, Prof. Jenie dan Prof. Almirzanah beragama Islam sedangkan Dr. Kusmaryanto beragama Katolik. Ketiganya berpendapat bahwa solusi manajemen surplus embrio sangat erat kaitannya dengan diskursus agama. Ketiganya menyatakan bahwa status moral dari embrio penting dipahami sebagai landasan sikap terhadap surplus embrio. Pemusnahan embrio dianggap tidak etis oleh ketiga ilmuwan. Ketiganya menyetujui donasi embrio untuk pasangan infertil lain dengan penyesuaian aturan terhadap kearifan lokal Indonesia. Selanjutnya, Prof. Umar dan Prof. Almirzanah memandang penggunaan surplus embrio untuk penelitian masih kontroversial namun tidak menutup kemungkinan diperbolehkan dengan berbagai syarat dan memperhatikan konteks serta asas kemanfaatan. Sedangkan Dr. Kusmaryanto menyatakan ketidaksetujuan surplus embrio untuk penelitian atas dasar interpretasi bahwa embrio mempunyai makna intrinsik yang harus dilindungi.Kesimpulan: Latar belakang agama mempengaruhi persepektif ilmuwan tentang bagaimana memandang status embrio dan pilihan tindakan terhadap surplus embrio. Perlu dilakukan penelitian mendalam multidisipliner dari klinisi, agamawan, ilmuwan, pakar hukum dan pasien untuk mengakomodasi pilihan tindakan terhadap surplus embrio di Indonesia.

Rad razmatra odnos ustavnih orijentira s ugovorom države i vjerskih zajednica kroz tezu: država koja svojim ustavom štiti pluraln(ističn)ost društva, slobodu uvjerenja i savjesti građana i od svojih institucija i ingerencija odvaja vjerske zajednice, ne bi smjela s njima ugovarati model suradnje koji narušava ili podređuje dio ustavom jamčenih prava. Iniciranjem javne rasprave nastoji se pridonijeti razjašnjenju ne/utemeljenosti dileme o mogućem narušavanju prava čovjeka prouzročenog prekoračenjem ustava pravnim položajem vjerskih zajednica. Paradoks je ako ugovor države i vjerskih zajednica naruši humanističku etiku i laičku smjernicu jer se interpretaciji jedne etičke doktrine osobnosti čovjeka otvara više mogućnosti legalne involucije dijela temeljnih i građanskih prava. Takav ugovor ukazuje i na inkompatibilnost ustava s utilitarizmom suupravljačkog nezamjeranja.

Abstract:
<p>This article attempts to explain about the concept of Islamic ethics promulgated by Taqi Misbah Yazdi. Yazdi had placed himself as a proponent to the concept of rational ethics. To him, the propositions of ethics along with moral expressions have obviously explained a causality relation between an action and desired goals of ethics. Commands and prohibitions, in their prescriptive and descriptive forms, manifest the relation between actions and the objectives of ethics along with the legal consequences behind them. As a result, this matter deals with meaning, objective, the value of objectivity, and rationality. The extent of value and truth of certain action is determined by its objectives. Interestingly, this theory does not influence Yazdi to be trapped within utilitarianism materialist-positivist ethics nor it traps him into the dilemma of value relativity which occurs in the West’s theory of ethics. It can be obviously seen the originality and novelty of Yazdi’s thought; not in terms of the <em>content</em> of his theory, instead in his ability to use the ideas of the Western philosophy to clarify his opinions and concepts by combining Herbert Spencer’s evolutionism and Jeremy Bentham’s utilitarianism. Building his concepts on transcendental philosophy of Mulla Sadra, Yazdi’s moral causality has successfully preserve the transcendental logic and its esoteric dimensions; an achievement which could not even be attained by Muslim groups who reject the law of causality.</p>

Kaidah-kaidah fikih yang dibahas dalam artikel ini adalah niat syarat seluruh amal seorang auditor, hukum perantara sama dengan hukum tujuan seorang auditor, hukum asal muamalah adalah halal, kecuali ada dalil yang melarang, serta hukum mendahulukan menolak mafsadat daripada mengambil manfaat. Pendekatan dalam perumusan pemikiran ini menggunakan studi kepustakaan dengan membandingkan antara tokoh Islam yang menerapakan kaidah fikih muamalah dalam kehidupan sehari-harinya dengan kasus auditor yang kurang menerapkan kaidah fikih muamalah dalam pekerjaannya dan berfokus pada literatur primer. Dari perbandingan tersebut peneliti memberikan argument mengapa auditor harus menerapkan kaidah fikih muamalah dalam menjalankan tugasnya.
