Full textThe code napoleon enacted in 1804 a general prohibition of any convention pertaining to the devolution of a future succession. Said prohibition aimed at the protection of the "reserve hereditaire" and constituted with it the successional law and order. The courts and legal commentators thus had the duty to give a definition of the prohibited convention which came to many developments. Meanwhile and from 1960 onwards, the legislator enacted several exceptions to the prohibition. . . This subject matter is hence based in french law on a prohibitory principle and exceptions thereto, the latter being expressly stated and regulated by the law. This legal scheme proves nowadays to be dangerously obsolete : in the law itself since many conventions are extra-legally validated by the notarial practice and the courts (joint-ownership -"tontine"- clause, and inability of our legislation to solve conflicts of laws issues arising out of in- ternational successions). Hence it may be proposed to amend the current legislation so as to introduce the "pacte de famille" (family convention) which -coupled with fiscal incentives - would add to our law a legal means to dispose of one's succession by contract - akin to the system already in force in germany and switzerland - and would introduce a new juridical category purposedly aiming at solving conflicts of laws issues

Full textThis dissertation aims to make intelligible the powerful aesthetic experience called duende in flamenco. On the one hand, its irrational and idiosyncratic nature is viewed as an inexpressible reality designated by a term beyond translation. On the other hand, flamenco is a hybrid genre of art with ill-defined boundaries. It thrives on singing, instrumental music and dance, mixing popular and scholarly cultures spontaneously within a highly codified framework of communication. This triggers questions on the nature of flamenco as an art form, such as how it defines a cultural identity as well as the relations between representation, norms and practices that mutually influence each other. Since the beginning, flamenco has suffered from numerous myths and stereotypes originating from collective common thought, artistic practice or flamencology. The representation of an intense, instinctive and wild art defined by its excessiveness has long been stamped in the common knowledge as a proof of “purity”. This short-sighted and simplistic perception has thus imposed serious limitations on a rational analysis of the duende. It appears that the study of duende leads to flamenco and vice versa even if both are, so far, rather poorly defined concepts. How, then, to approach the study of flamenco through a seemingly elusive phenomenon, and how, in return, to approach the duende through art with indistinct contours? The necessary working hypothesis is then to use a flexible definition of the concept of duende, which allows for the possibility of a unifying concept for some of the majors' stakes of the flamenco

Full textThe author attempts to look at the question of the break or the continuity in the theatre of the French revolution (1789-1799), namely the works of the play wrights who were 20 years old in 1789, the generation which witnessed the transition from the enlightenment to romanticism. Their works belong to a period of transition in the theatre which claimed and transformed existing forms of drama which had not been autonomous (vaudeville, melodrama), developed new intermediate genres (drama), created "genres de circonstance" (based on historical and nationalistic events, a republican repertoire), which can be considered the precursors to certain theatrical movements which followed. Identifying a continuity in the theatre between the 18th and 19th centuries does not however hide the profound break with the existing theatrical tradition which the French revolution facilitated, a shift from the spoken word to the visual, a decreasing interest in the text as opposed to the performance, a break which makes theatre "l'art du spectacle" which we know today

A first book relates the different stages in the apprenticeship of his career as a composer. The influences which marked him and conditioned his thoughts prove the invaluable shave of the heritage such as Claude Ballif. Thus, we present Claude Ballif writer and teacher, a double activity which is both parallel and complementary and for which he reserves an important part of his time. The position of Claude Ballif in the musical circle and in society in general ends the first part of this book. The second part approaches the foundation of the compositional thought of Claude Ballif and his projections into the language of the sounds. Philosophical references ant technical realities are integrated; mind and subject are joined to bring to light the resounding quality of the thought. The technique of the musical language of Claude Ballif is redefined in all its wealth and shades though the analysis of some 50 opus of his work which has been considered up until 1980. This second book is completed by a third volume gathering all the examples on scores, musical illustrations which are indispensable and which will prolong our subject in the same way as the sonorous examples recorded on tape

Full textThe Arab-Andalusian music has been the object of an abundant literature from the second half of the 19th century: at first, through an Orientalist perspective fed by a spirit of curiosity in search of exoticism, then through transcription attempts and musicological research focused on the study and the classification of the corpuses. Fruit of a long common gestation, the Arab-Andalusian repertoires are influenced by exogenous and endogenous fluctuations. Unfortunately, the comparative approach of the variants from the Maghreb and the thorough analysis of musical scales remain little explored. This thesis proposes an analytical and comparative study of three North African ţubū, with equivalent scales: Tunisian Aşbaˁayn, Algerian Zīdāne and the Moroccan Hijāz al-Kabīr. The identification of melodic behaviors inherent to the three corpuses is reached by the combination of several analytical approaches. The statistical processing of melodies (occurrences, notes duration, internal finales, and fundamental degrees) will be followed by a paradigmatic analysis based on conclusive patterns. An empirical study, based on the interpretation of frequency measurements, will allow us to compare intervals ratios and the variation margin of note pitches. The first part deals with a diachronic approach demonstrating, on the one hand, the dynamic character of the studied directories and on the other side, justifying certain differences and convergences deduced from the various analysis

Full textThis thesis focuses on representations of human rights in Syrian religious textbooks. It analyzes the Islamic perception of human rights, particularly with regard to their secular origin. It also analyzes the role of religious education in the conception and promotion of fundamental freedoms, and the difficulties brought about by the conflict with issues of the political, philosophical, legal and theological order. To achieve this, there implemented a comparative approach to international instruments on human rights, specifically The Universal Declaration of Human Rights (UDHR) and Islamic conventions on the one hand, and the work carried out by the school of reform of Islamic thought on the other. Taking into account the fact that the content of textbooks is part of a time frame, it is important to discuss the somewhat paradoxical position of these structures in a religious education that is organized by a secular state. It appears that in spite of the existence of Islamic doctrines developed in accordance with the spirit of the UDHR insofar as these doctrines suggest a rereading of texts that are the subject of controversy, textbooks remain faithful to a traditional, not to say archaic, thinking. The most recent textbooks have not made any significant progress in this area, but are instead subject to the yoke of what proved to be more of an autocratic regime. To better integrate and enforce human rights, religious education in Syria faces several challenges, including the development of effective citizenship, respect for the heterogeneity of society and redefinition of the State

Full textIn order to explain Leibniz's theory of truth, the author chose to work according to a genealogical method. For each argument, even the most popular, the author tried to find the important moments of its creation, dating back to the texts of leibniz's youth. The genealogical method was also employed in an external way : the leibnizian fragments are confronted to older texts, the meaning of fundamental concepts is explained through the heritage of medieval and post-medieval scolastics. Throughout this approach, this work is the first ever devoted to leibniz logics in its integrality. It continuates what massimo mugnai already discovered about the logics of relations. The main arguments may be summarized this way : 1) Leibniz argues in favour of conceptualism. 2) This position implies a particular kind of ontologic engagement, in which consists mainly the suarezian heritage of leibnizian metaphysics. 3) One of the consequences of the conceptualism is the development of a intensional logics. This logics is not incompatible with the concept of class. 4) The intensional logics requires that an ontologic status be deserved to universals. 6) It has obliged leibniz to broaden the meaning of the fundamental logic relation, so that the inherence has become more and more a simple connexion. 7) The chapter 3 constitutes an attempt of evaluation of leibniz's ontology, which uses the tradition of the ontological square. It is demonstrated that leibniz meant to keep the two dimensions of ontology, while criticizing dramatically the notion of accident and profoundly modifying the fundamental relations of inherence and predication

Full textAt the end of the Ming Dynasty, Baoweng laoren has selected forty tales of the three collections of Feng Menglong and two collections of Ling Mengchu to compile another anthology entitled Jingu qiguan 今古奇觀 (curious spectacles of today and of the past). This anthology was a huge success at the time of its publication, and is constantly reprinted for centuries until today. Today it is considered as a main representative work of Chinese literature in vernacular language. The reputation of Jingu qiguan has already exceeded the Chinese border since a long time. Since the 18th century, three tales of the Jingu qiguan were translated for the first time in Europe by a French Jesuit. Therefore, throughout the centuries, the Jingu qiguan has experienced a lot of partial translations, retranslations and adaptation across Europe. Only in French, there are about thirty translations, retranslations and rewrite of Jingu qiguan. So that leads us to wonder why these stories have constantly been translated and retranslated, or even rewritten. Who have translated them and how they have been translated? How these translations did had some influence in the local literature? This study is intended to cover all these issues

Full textThe aim of this thesis is to reconstruct the set of theoretical questionings supposed by the authors who participate in Posterior Analytics’ reception during the 13th century. Considering that the doctrine contained in this Aristotle’s work is difficult to interpret in a systematical approach is inevitable that its progressive reception would have been guided by metaphysics and epistemological questionings, partially shared by these authors. The present research is an attempt to track down these questionings, with the objective of proposing a systematic reconstruction of the theory contained in the commentaries of the Posterior Analytics during that period. This systematic reconstruction offers a unified vision of the aspects assessed in this investigation. This due to the identification of a general question which would determine the orientation of specific ones. Thomas Aquinas is the author about whom most of the analyses are focused. But always considering the aim of comprehending questions which guide all this tradition of comments, two other comments have been studied: Robert Grosseteste and Alberto the Great. The thesis proposed is that the Posterior Analytics’ reception during the 13th century, reflects an attempt to answer the following question: which characteristics must a perfect knowledge possess? In accordance with this thesis, the doctrines developed in commentaries regarding this Aristotle’s work did not seek to propose a method of true knowledge of reality. The properties of a demonstration, regarding its shape and content of the propositions that compose it, would describe an ideal of perfect knowledge

Full textThe archaeological researches on the Arabian Peninsula in general and on the site of al-‘Ula in particular, focus in the first place on the inscriptions scattered all over the region, and in the second place on pottery. The architecture in general is not taken in account by archaeologists in the Arabian Peninsula; and researches on religious architecture, especially in the first millennium BC., are most rare. From this comes the importance of this study on the site of Dedan trying to shed light on the architecture and in order to be one of the references that are concerned with the religious architecture in the Arabian Peninsula. This thesis, based on the excavations carried out by the Department of archaeology of the King Saud University in Riyadh, consists of four chapters. The first one is a general geographical and historical introduction to the site of al-‘Ula. It also speaks about previous visits and studies at the site. The second chapter is a detailed descriptive study of the architecture of the site of Dedan. As for the third chapter, there is a comprehensive analytical study of all elements of the architecture of the site. As for the last chapter, it is a comparative study of all parts of the architecture of Dedan with other archaeological sites

Full textIn Mauritania decentralization has gone through several phases. The first that dates from the colonial period continued until after the country's independence in 1960. The second one, post colonial is that of the early eighties with the basic text in the matter, governing the organization and functioning of the municipalities, in this case Ordinance 87-289 of October 20, 1987, repealing and replacing Order No. 86-134 of August 13, 1986. During this period, the communal experience in Mauritania oscillates between, legal and institutional mimicry according to the French metropolitan model and a real desire of the state to initiate its own decentralization policy in line with the challenges of the development. It must be noted, however, that there are limits to the systems put in place (French model and model properly Mauritanian) because of the inadaptability for the first that is not made for Mauritania and therefore does not take into account the cultural social parameters of the people and for the second that sinned by lack of realism in the implementation of the decentralization policy. Nevertheless, hope that Mauritania will achieve true decentralization, with local authorities which are more or less freely administered with real autonomy of management to generate their own development, is allowed with the administrative reorganization that makesof the region a decentralized entity through the constitutional referendum law n ° 2017-021 of 15 August 2017 revising certain provisions of the Constitution of 20 July 1991 and its modifying texts

Full textIf Deleuze and Guattari partly proceeded with producing their Anti-Oedipus with Artaud (1972) from a recipitation of the essence of Lacan's work, it's aise in the wake of this book that Lacan, moving towards a psychoanalysis of the Real, reassessed the matter of psychosis with Joyce. Far from being an alleged epistemological caesura, insanity accounts for the unconscious. Clinical work with madness enables to further investigate the mechanisms of the unconscious in relationship to the other. Subsequently, in light of this clinical work, the psychoanalytic technique, its links with nosography, along with some classical metapsychological concepts, are bound to be re-evaluated and revised. But giving rise to this fresh praxis- based and epistemological thinking entails a materialist approach to the unconscious as a space of productior and reproduction and net merely a scene of intrapsychic representations always-already-there that the clinician would "discover". Considering the unconscious to its full extent as a paradigm that the clinical work demands and updates sheds a new light on the conditions of possibility of psychoanalytic technique. Psychoanalysis may thus recover the true reach of its impact, beyond the temptation of "psychoanalysis-as- an-ideology" that used it to extend the social forms of domination, hiding them in the shadow of its nosographic constructions supporting the psychoanalytic psychiatric operation Foucault revealed. Relieved of its ideological guidance and idealistic coating, the analytic act, far from remaining abstract, can be conceived and accepted as an operation of an ever and full clinical and political consistency

Full textFrom the most ancient times, resins have been used in religious rituals and for cosmetic purposes. Nowadays, they are extensively exploited by the flavour and fragrance industry. Benzoin gum belongs to this kind of natural products. Two types of this resin are found on the market, Slam benzoin gum produced in Laos, and Sumatra benzoin gum produced in Indonesia. The aim of this work was defined in agreement with the Charabot Company to proceed with analytical study of this raw material traditionally used to manufacture resinoids entering in flavour or fragrance compositions. As a first step, the overall chemical composition was investigated by considering the volatile compounds. Thus, several headspace sampling methods (S-HS, SPME, HSSE) have been applied to carry out the analysis of the chemical-sensor discriminating method based upon the use of electronic noses. Furthermore, owing to their high interest for the flavour and fragrance industry, some chemical constituents were investigated n order to understand their formation pathway in the resin. This work finally resulted in a better knowledge of benzoin gum through the study of the transformation processes leading to its manufactured derivatives. At last, the harvesting-byproduct of Siam benzoin gum was studied to establish its potential application as a valuable new grade of this basalmic resin

Full textThe modern philosophers rejected authority because it was judged to be incompatible with democratic values. Paradoxically, following the weakening of authority in the modern societies, we observe a growing number of people demanding for its "return". Following this situation, we decided to undertake, in the field of political philosophy, a study of the complex relationships that involve the concepts of authority and power, namely: What is authority and power ? How are they constituted ? What are the conditions or forces that create direct and use them? What are their modes of institutionalization in the political and legal structures that perpetuate domination and reproduce obedience ? Formulated in that way, these questions touch not only the assumption that this work tries to support, but also the problematic which our study seeks to provide an answer. It concerns the frequent confusion made by our contemporaries between, on one hand, the concepts of authority and power, and on the other, those of violence, force, domination and sovereignty often used as if they are mere synonyms. With H. Arendt we assume that since these notions "refer to different realities, the meaning of each one of them should be carefully examined and determined." We think that the correct use of these notions is "not just a matter of grammar, but also of a historical perspective," a return to the original meaning of auctoritas and potestas is necessary. This returning help us firstly, to measure the gap between what ought to be the notions of authority and power in the ancient world and what they have become today; secondly, to appreciate the inherited value that we probably do not fully make use of it today; and thirdly, the study helps us to have a better understanding of major concepts of political philosophy; and, in so doing, to be able to dispel the confusion often made between authority, power and other related concepts such as force, violence, domination and sovereignty

It consist in using various criteria to describe the different aural and musical units of the musical material once they have been separated into segments. These criteria can be classified in three groups : internal (spectrum, dynamic, gait, granularity and space), referential (causality, voice, effect and emotion) and structural (formal analysis). Graphical representation has become an essential tool for the analyst and it can take the form of icons - creating strong links between the sound, its analysing criteria and graphic symbolic forms - or symbols - representing sound and its criteria with extremely accurate symbols. Moreover, representation is also an ideal material for multimedia publication : the represented analysis is associated to sounds or even other media to create a very rich didactical document. Full textThe work presented in this thesis is a contribution to the comprehension of the discharge and the plasma used in radiofrequency optical emission spectroscopy at 13,56 MHz for the analysis of materials. The study is based on an experimental characterization of the discharge and the plasma. We have developed experimental diagnoses devices (electric and optical) allowing to measure the voltage, the discharge current, the power injected into the plasma in the case of conducting materials, and to measure the emission intensity of the argon line at 750,4 nm. We have developed a simple analytical model which starting from the electrical measurements gives access to informations on the fundamental properties of the plasma (maximum electric field, thickness of sheath, densities) and with which we also could determine an equivalent electric circuit of the discharge. This model enables us to characterize the evolution of the basic parameters of plasma according to the power, the pressure, the nature of material of cathode or anode. We have also used a hybrid digital model fluid Monte Carlo two-dimensional of the discharge which enabled us to validate the experimental and analytical results

Full textThe cogito yields the first certainty on my existence. This certainty is grounded in formal properties of the cartesian dictum, especially its inferential aspect and its performatoriness. A method to define those properties and envision their relation to the nature of my mind has to be sought for. An analytic reconstruction of the cogito must avoid the generalization of both its overt and its mental properties by showing how its epistemic value is articulated upon its semantical scope and content. Beside the meaningfulness of the terms it comprehends, the fact that the cogito is a first-person utterance in the present tense is particularly relevant to the understanding of an indexical or perspectival mode of identification involved in those semantic features. Their role is to make me conceive of an ineliminable subjective way of presenting an objective thought. The other way round, i can but admit that this thought is present to my mind because it is related to some objective trait of my environment. This individuating link bears a general and referential constraint upon the interpretation of the cogito as a singular thought within a mental context. Nonetheless, even though the cogito as a pure intellection is still countable among the particular modes of cogitation, it refers in a special way to the mind itself wherein those thoughts occur. New semantic paradoxes arise when self-identification of a mind has to be brought about by a self-referring procedure. If the cogito is such a procedure, then it definitely cannot allow for a comprehensive knowledge of my essence. This knowledge is only conceivable, and must be completed by a further elucidation of a referential content of my thought. The transition from + cogito, ergo sum ; to + ego sum res cogitans ; is then interpreted as a deduction of an objective guarantee from an irreducible first-person account of my essence

It was tried, in this work, to encircle the origine of the negative perception and representations about indians in Martinique and an historic reconstitution of their development has been made. It has been also tried to reconsider the classic post-plantocratic analysis which is normally used in the approach of the intergroups relations in Martinique and also tried to make an up-date by considering these relations not only in comparing the black mulattoes white behaviour, but also comparing the presence of the indians as social actors. Some psychosocial theories based on the intergroups relations pattern are reviewed in the purpose to serve for the formulation of the hypothesis which leads the empirical works of this study

The first one deal with a theoretical and numerical studie of the behavior of cylindrical shell submissive to combined symmetrical loading (horizontal pressure and wall friction silo type. A new analytical method described the linear elastic behavior of shell is developed by the equilibrium equations. In this way we have get the fonction of stress distribution and displacement of shell skin. Structure modeling by finite element using Abaqus software we are permit to validate the expressions obtained. The comparaison have shows a good concordance between results of numerical similuation and those obtained with our analytical approch. The analysis of shell behavior subjected to unsymmettrical loading complete these part. The effect of these load dues te eccentric discharge of the silo it self translated by a much importanted flexion moments. The second part concerns the warping analysis of imperfect cylindricals shells. Abaqus program was used again in study of the influence of the parameters (shell thiknesse, stiffner stiffness. . . ) affeting shell strength. About basis results obtained, a new semi-analytical method is developed for calculation of the ultimate stress resistance of the stiffened and isotropic shells. The differents comparaisons made between the results, of literature formulas, of EC3 and of our approach, with the numerical results, show a validity of the suggest method. However, this contribution present a improving for present formulas given by EC3

Full textThis work deals with the behaviour and the speciation of metalloïds and particularly arsenic in estuaries. In a first part, two stripping chronopotentiometric methods using a gold film electrode are developped for determining arsenic and selenium in seawater. With a detection limit of 0,29 nM for As (III) and 0,71 nM for total dissolved inorganic arsenic, this procedure exhibits a better sensitivity than others stripping methods developped hitherto. In a second part, the biogeochemical cycle of inorganic arsenic in a macrotidal estuary (Penzé-Britany) has been examined over a seasonal cycle. In the river end-member, the concentrations of dissolved arsenic are controled by water discharge and phytoplankton activity. The high levels of arsenic in suspended matter and their variations were related to the pig slurry manuring on the catchment. Within the estuary, two processes control the dissolved arsenic behaviour. First, an important input of As (III) and As (V) from the benthic compartment contributes to the enrichment of the water column, then the coprecipitation with iron oxides induces a redistribution of this metalloid to the particulate phase. Estimations of arsenic fluxes between the different compartments of the system illustrate the strong reactivity of this element. Arsenic which is imported mainly in particular form (73 %) is exported to the continental shelf in dissolved one (77 %). The proportion of As (III) exported is estimated to 14 % of the dissolved fluxes

Full textDuring titanium anodic oxidation in phosphoric acid solutions, phosphorus coming from the solution is embodied in the titanium oxide lattice. In order to determine the phosphorus concentration, Nuclear Reaction Analysis using charged particles was performed. This method was also used for oxygen analysis and so growth law characterisation. Furthermore, Secondary Ion Mass Spectrometry (SIMS) and Glow Discharge Optical Spectrometry (GDOS) were comparatively used in order to determine the depth profiles. Correlations of different analytical results enabled a quantitative approach of phosphorus analysis. Such analysis required reliable standards which were produced by 31p+ implantation into titanium. Otherwise, the effect of phosphorus incorporation on the oxide film structure was studied by means of electron diffraction (RHEED) and RAMAN spectrometry
