This article contains instructions in the form of a "user's manual" for the use of the "EUR-Lex" web site, which is the official European Union site for access to the European Union legislation. Anyone having access to the internet can conduct searches using the "EUR-Lex" website and retrieve results pertaining to the European Union legislation, such as Regulations, Decisions and Directives. This article contains descriptions of the different ways and approaches for conducting searches as well as descriptions and directions on evaluating and further handling the search results. The use of the "Eur-Lex" web site is free of charge (no subscription is necessary). The "Eur-Lex" site is undoubtedly the easiest and most direct tool for accessing the European Legislation in force and constitutes an invaluable resource for veterinarians, who wish to keep up to date with European Union legislation pertaining to all aspects of Veterinary Medicine.

EUR-Lex teisės srities dokumentų vertimų įtaka originaliai ir verstinei lietuvių administracinei teisės kalbai lėmė pastarojo dešimtmečio lingvistų ir vertimo tyrėjų susidomėjimą kintančia administracine lietuvių kalba. Šiame straipsnyje, kurio tyrimo objektu pasirinkti prancūzų kalbos teisės tekstams būdingi šalutiniai pažyminio sakiniai, papildantys pagrindinio sakinio referentą dalykine informacija ir einantys po pažymimojo žodžio, analizuojama teisės tekstų vertimo iš prancūzų kalbos į lietuviųkalbą tema. Straipsnio tikslas – ištirti ES Teisingumo Teismo generalinio advokato išvadų, rašytų prancūzų kalba, šalutinių pažyminio sakinių vartojimo ypatumus, jų semantinio turinio perteikimo lietuvių kalba sprendimus ir su tyrimo objektu susijusius žanrinius analizuojamų tekstų požymius.Atliktas daugiakalbės EUR-Lex dokumentų duomenų bazės generalinio advokato išvadų tyrimas leido pastebėti prancūzų kalbos teisės tekstams būdingų šalutinių pažyminio sakinių kiekybinio pasiskirstymo ir jungimo prie pagrindinio sakinio ypatumus, kurie patikslino mokslinėje literatūroje aprašytas jų vartojimo administracinėje kalboje tendencijas. Abstract Vocabulary is often considered one of the most difficult aspects of translating legal texts, and finding reliable textual supports is often a challenge too. This study presents the results of an experiment to use, as often as possible, multilingual EU resources with versions in Spanish and English as textual supports for a large sample of vocabulary that warranted research when the author was involved in translating into English a voluminous text of judgment summaries produced by the Supreme Court of Spain. In the majority of cases it was indeed possible to find high quality translations in EUR-Lex (Access to European Law) and IATE (InterActive Terminology for Europe), signaling, on the one hand, significant legal language overlap possibilities between the EU and Spain and, on the other, great potential for employing the former’s linguistic resources in the translation of the latter’s legal texts. Moreover, this study analyzes the results with an eye to linking the different types of vocabulary items that were searched to the different types of textual supports they were found in, to see how different kinds of supports (a collection of texts and their translations, such as EUR-Lex, or a multilingual terminological resource, such as IATE) might pair well with different kinds of vocabulary items. In this way the study also addresses some of the different opinions surrounding using online collections of texts and their translations (i.e. multilingual corpora) vs. multilingual terminological resources.

ABSTRACTObjectives: The aim of this study was to investigate the effects of fiber-reinforced resin burs on the surface roughness of a nanofilled composite.Methods: Average surface roughness values (Ra, �m) were measured using a surface profilometer and surface textures after finishing procedures were evaluated using a scanning electron microscope (SEM). Thirty cylindrical specimens were prepared using sectional teflon molds. A nanofilled composite was chosen. After the preparation specimens were divided into three subgroups randomly. After profilometric measurements, representative samples of the mentioned finishing procedures were selected and SEM analyses were carried out.Results: Mylar strip group was statistically different from the other two groups (P<.05). The smoothest surfaces occurred when composite resin samples were light cured against the strips. On the other hand there was no statistical difference between fiber-reinforced resin burs and Sof-Lex discs (P>.05). For fiber-reinforced resin burs scratches and pitting which may be due to plucking of the filler particles during finishing were observed on the surface topography of the composite resin material. On the other hand, for the Sof-Lex discs although scratches were noticed on the surface topography, no pitting was observed.Conclusions: Fiber-reinforced resin burs can be preferred for the grinding of composite surplus in interproximal surfaces, where the use of Sof-Lex discs can be harmful to soft tissues. Abstract:
Th is article investigates the genealogy of the concept of heritage in the European Commission’s (EC) policy discourse from 1973 to 2016. Based on conceptual analysis of 2,412 documents gathered from the EUR-Lex database, the uses of the concept in the EC’s policy discourse were categorized into seven thematic areas: nature, environment, and biodiversity; human habitats; economy and employment; agricultural products and foodstuffs; promotion of societal development and stability; audiovisuality and digitalization; and European identity and integration. In the EC’s discourse, heritage develops in the context of intertwined phases of EU integration and cultural Europeanization. The study indicates how the EC governs heritage mostly through implicit cultural policies included in diverse policy sectors other than culture.

Šiame straipsnyje aprašomas tarptautinių būdvardžių vartojimo prancūziškuose administracinio stiliaus tekstuose tyrimas ir šių leksikos vienetų vertimo į lietuvių kalbą ypatumai. Tiriamoji medžiaga – tarptautinių susitarimų tekstai iš „EUR-lex“ (Europos Sąjungos teisės aktų ir kitų viešų dokumentų duomenų bazė). Terms and Phrases of Latin origin have been incorporated into the contempo-rary Continental and Anglo-Saxon legal systems. Latin borrowings are a sign of the common cultural and social origin of European countries. Most of the bor-rowings have been adapted on the phonetic, morphological and grammatical level. Others, like Latin proverbs, terms and phrases retained their original pronunciation and orthography.The main goal of this article is to discuss the essence of Latinisms, in particular their place in the contemporary linguistics and their function in legal texts. In the second part the article presents the results of the analysis of the Latin struc-tures, used in Polish and German legal texts, available in the Eur-lex databases. The research is aimed not only at comparing the occurrence of Latin terms, phrases or proverbs in legal documents, but also at showing the way of their introducing to the text and discussing the consequences of their usage for the understanding of the law.

Abstract ‘Migration’ has recently become a single domain for specialized terminology in the European Union, linked to the crisis which has been rapidly unfolding in Europe since 2015. The migration crisis, with the dramatic increase in arrivals of migrants in Europe, has highlighted the uncertainty of institutional classifications used to describe and manage migration flows. What is a migrant in the EU Institutions and how is the term refugee or asylum seeker respectively classified? The present study delves into Migration from a terminological perspective and investigates how migrants have been mirrored through terminology in institutional texts from 1950 to 2016 by analyzing two sets of corpora: the European Migration Network glossaries (EMN) of the European Commission and the EU database of official legislative text, EUR-lex EN 2/16. This paper aims to show how migration phenomena can be narrated through the lens of terminology and how term choice plays a vital role in making an impact in the representation of migrants and refugees in political institutions and society.

This paper answers the following question: Do the uncertainty and salience of issues determine whether the European Commission will use an expert group to assist with policy formulation? Using rationalist theory, three hypotheses test whether transversality, the importance of standard-setting and the salience of a policy proposal determine whether a Commission DG will ask an expert group to assist in preparing that same proposal. Data was retrieved from official docu-ments via EUR-Lex. A binary logistic regression analysis has been conducted on a sample of 260 proposals that were drafted by DG Climate Action, DG Communications Networks, Content &amp; Technology, DG Environment and DG Internal Market and Services. All proposals were adopted between 2010 and 2013. The empirical analysis shows that expert group involvement in policy formulation is neither negligible nor ubiquitous in terms of frequency as expert groups as-sisted in preparing 33.5% of the proposals. DGs were significantly more likely to consult an expert group when the pro-posal under preparation was more transversal in nature and/or when that proposal treated standard-setting more pro-nouncedly. In contrast, the salience of a proposal was shown to be insignificantly related to the presence of an expert group during policy formulation.

AbstractThe Directive 2013/34/EU is a fundamental part of European Union (EU) legislation harmonising the regime of financial and non-financial reporting throughout the entire EU, including reporting about corporate social responsibility (CSR). Inasmuch as its transposition deadline expired in 2015, it is possible and also highly elucidating to holistically study its nature and actual transposition. A related literature summing up, accompanied with a legislation and transposition review compiled via the EUR-Lex database, makes for a solid foundation for a holistic and critical exploration of the related case law of the ultimate judicial authority for the interpretation and application of the Directive 2013/34/EU, namely the Court of Justice of the EU (CJ EU). Researching this case law within the Curia database brings forth an interesting meta-analysis, refreshed by Socratic questioning, which reveals the approach of the CJ EU to the Directive 2013/34/EU. The hypothesis suggests that this case law of the CJ EU offers valuable and as-yet hitherto-neglected indices, signifiers about the EU conforming to the perception of the nature and meaning of the Directive 2013/34/EU. These indices could be pivotal for further improvement of the harmonized regime of financial and non-financial reporting, for the boosting of CSR and also for supporting European integration and its legitimacy.

ABSTRACTObjectives: The purpose of this study was to evaluate the bleaching agent action on color stability, surface roughness and microhardness of composites (Charisma, Filtek Supreme and Heliomolar - A2) submitted to accelerated artificial aging (AAA). Methods: A Teflon matrix (12 x 2 mm) was used to fabricate 18 specimens (n=6) which, after polishing (Sof-Lex), were submitted to initial color reading (ΔE), Knoop microhardness (KHN) (50 g/15 s load) and roughness (Ra) (cut-off 0.25 mm) tests. Afterwards, the samples were submitted to AAA for 384 hours and new color, microhardness and roughness readings were performed. After this, the samples were submitted to daily application (4 weeks) of 16% Carbamide Peroxide (NiteWhite ACP) for 8 hours and kept in artificial saliva for 16 hours. New color, microhardness and roughness readings were made at the end of the cycle, and 15 days after bleaching. Results: Comparison of the ΔE means (2-way ANOVA, Bonferroni, P<.05) indicated clinically unacceptable color alteration for all composites after AAA, but without significant difference. Statistically significant increase in the KHN values after AAA was observed, but without significant alterations 15 days after bleaching. For Ra there was no statistically significant difference after AAA and 15 days after bleaching. Conclusions: The alterations promoted by the bleaching agent and AAA are material dependent. Abstract:
This contribution explores the application of data science and artificial intelligence to legal research, more specifically an element that has not received much attention: the research infrastructure required to make such analysis possible. In recent years, EU law has become increasingly digitised and published in online databases such as EUR-Lex and HUDOC. However, the main barrier inhibiting legal scholars from analysing this information is lack of training in data analytics. Legal analytics software can mitigate this problem to an extent. However, current systems are dominated by the commercial sector. In addition, most systems focus on search of legal information but do not facilitate advanced visualisation and analytics. Finally, free to use systems that do provide such features are either too complex to use for general legal scholars, or are not rich enough in their analytics tools. In this paper, we motivate the case for building a software platform that addresses these limitations. Such software can provide a powerful platform for visualising and exploring connections and correlations in EU case law, helping to unravel the “DNA” behind EU legal systems. It will also serve to train researchers and students in schools and universities to analyse legal information using state-of-the-art methods in data science, without requiring technical proficiency in the underlying methods. We also suggest that the software should be powered by a data infrastructure and management paradigm following the seminal FAIR (Findable, Accessible, Interoperable and Reusable) principles.

ABSTRACTObjectives: The aim of this study was to evaluate surface roughness and hardness of a nanofiller GIC, a resin-modified GIC, three conventional GICs, and a silver-reinforced GICMethods: For each material, 11 specimens were prepared and then stored in distilled water at 37 °C for 24 h. The surface roughness of 5 specimens was measured using a surface profilometer before polishing and after polishing with coarse, medium, fine, superfine aluminum oxide abrasive Sof-Lex discs respectively. The hardness of the upper surfaces of the remaining 6 specimens was measured with a Vickers microhardness measuring instrument.Results: All tested GICs showed lower surface roughness values after the polishing procedure. Surface finish of nanofiller GIC was smoother than the other tested GICs after polishing. This was followed by resin-modified GIC, Fuji II LC; then silver-reinforced GIC, Argion Molar, conventional GICs, Aqua Ionofil Plus, Fuji IX, and Ionofil Molar, respectively. The result of the hardness test indicated that the microhardness value of silver-reinforced GIC was greater than that of the other GICs. When the hardness values of all tested GICs were compared, the differences between materials (except Aqua Ionofil Plus with Ionofil Molar and Ketac N100 with Fuji II LC (P>.05)) were found statistically significant (P<.05).Conclusions: According to the results of this study, it can be concluded that the differences in the composition of GICs may affect their surface roughness and hardness. ABSTRACTObjectives: The objective of this in vitro study was to evaluate the surface roughness and microhardness of three novel resin composites containing nanoparticles after polishing with one-step and conventional multi-step polishing systems.Methods: A total of 126 specimens (10 X 2 mm) were prepared in a metal mold using three nanocomposites (Filtek Supreme XT, Ceram-X, and Grandio), 21 specimens of each resin composite for both tests (n=63 for each test). Following light curing, seven specimens from each group received no polishing treatment and served as controls for both tests. The specimens were randomly polished using PoGo and Sof-Lex systems for 30 seconds after being wet-ground with 1200-grit silicon carbide paper. The mean surface roughness of each polished specimen was determined with a profilometer. The microhardness was determined using a Vickers hardness measuring instrument with a 200-g load and 15 seconds dwell time. The data were analyzed using the Kruskal-Wallis test and the post hoc Dunn's multiple comparison tests at a significance level of .05.Results: Among all materials, the smoothest surfaces were obtained under a matrix strip (control) (P<.05). There were no statistically significant differences among polishing systems in the resin composites for surface roughness (P>.05). The lowest hardness values for the three resin composites were obtained with a matrix strip, and there was a statistically significant difference compared with other polishing systems (P<.05) whereas no statistically significant differences were observed between the polishing systems (P<.05).Conclusion: The current one-step polishing system appears to be as effective as multi-step systems and may be preferable for polishing resin composite restorations. Background: The General Data Protection Regulation (GDPR) was implemented to build an overarching framework for personal data protection across the European Union/Economic Area (EU/EEA). Linkage of data directly collected from cohort participants based on individual consent must respect data protection rules and privacy rights of data subjects. Our objective was to investigate possibilities of linking cohort data of minors with routinely collected education and health data comparing EU/EEA member states. Methods: A legal comparative analysis and scoping review was conducted of openly online accessible published laws and regulations in EUR-Lex and national law databases on GDPR’s implementation in Portugal, Finland, Norway, and the Netherlands and its connected national regulations purposing record linkage for health research that have been implemented up until April 30, 2021. Results: EU/EEA has limited legislative authority over member states. The GDPR offers flexibility for national legislation. Exceptions to process personal data, e.g., public interest and scientific research, must be laid down in EU/EEA or national law. Differences in national interpretation caused obstacles in cross-national research and record linkage: Portugal requires written consent and ethical approval; Finland allows linkage mostly without consent through the national Data Protection Supervisory Authority; Norway when based on regional ethics committee’s approval and adequate information technology safeguarding confidentiality; the Netherlands mainly bases linkage on the opt-out system and Data Protection Impact Assessment. Conclusions: Though the GDPR is the most important legal framework, national legislation execution matters most when linking cohort data with routinely collected health and education data. As national interpretation varies, legal intervention balancing individual right to informational self-determination and public good is gravely needed for scientific research. More harmonization across EU/EEA could be helpful but should not be detrimental in those member states which already opened a leeway for registries and research for the public good without explicit consent.

Abstract:
Background: The GDPR was implemented to build an overarching framework for personal data protection across the EU/EEA. Linkage of data directly collected from cohort participants, potentially serving as a prominent tool for health research, must respect data protection rules and privacy rights. Our objective was to investigate law possibilities of linking cohort data of minors with routinely collected education and health data comparing EU/EEA member states. Methods: A legal comparative analysis and scoping review was conducted of openly accessible published laws and regulations in EUR-Lex and national law databases on GDPR’s implementation in Portugal, Finland, Norway, and the Netherlands and its connected national regulations purposing record linkage for health research that have been implemented up until April 30, 2021. Results: The GDPR does not ensure total uniformity in data protection legislation across member states offering flexibility for national legislation. Exceptions to process personal data, e.g., public interest and scientific research, must be laid down in EU/EEA or national law. Differences in national interpretation caused obstacles in cross-national research and record linkage: Portugal requires written consent and ethical approval; Finland allows linkage mostly without consent through the national Social and Health Data Permit Authority; Norway when based on regional ethics committee’s approval and adequate information technology safeguarding confidentiality; the Netherlands mainly bases linkage on the opt-out system and Data Protection Impact Assessment. Conclusions: Though the GDPR is the most important legal framework, national legislation execution matters most when linking cohort data with routinely collected health and education data. As national interpretation varies, legal intervention balancing individual right to informational self-determination and public good is gravely needed for health research. More harmonization across EU/EEA could be helpful but should not be detrimental in those member states which already opened a leeway for registries and research for the public good without explicit consent.

Abstract:
On September 16, 2014, the Grand Chamber of the European Court of Human Rights (the Court) gave its judgment in the case of Hassan v. United Kingdom.This is the Court’s first explicit engagement with the co-applicability of international humanitarian law and international human rights law in relation to detention in international armed conflicts. The judgment is significant for its rejection of the government’s argument that international humanitarian law operates as lex specialis to displace international human rights law entirely during the “active hostilities phase of an international armed conflict.” It is also noteworthy for the majority’s ruling that provisions on detention of prisoners of war and the internment of protected persons in the Third and Fourth Geneva Conventions of 1949 could be read into Article 5 (right to liberty and security) of the European Convention on Human Rights (the European Convention), creating a new ground for detention under Article 5(1) in international armed conflicts and modifying the procedural guarantees in Article 5(4).

With the aim of understanding the insertion of higher education into a new context of organization of society and State, which is managed according to the New Public Management, this work presents a comparative historical study of the organization of French and Brazilian higher education. It is concluded that the French adherence to the New Public Management is based on the knowledge economy, while the Brazilian one is based on State size reduction along the lines of the Washington Consensus; in addition, higher education institutions in both countries are organized to participate in competitions: in France, the international competition promoted by rankings, and in Brazil, the market competition.ResumoCom o objetivo de compreender a inserção do ensino superior dentro de um novo contexto de organização da sociedade e do Estado, gerido pela Nova Gestão Pública, o trabalho apresenta um estudo histórico comparativo da organização do ensino superior brasileiro e o francês. For almost 10 years now, there has been close cooperation between the national structures responsible for infectious disease surveillance in the European Union (EU). This work was first formalised when the heads of EU surveillance units, with support from the European Commission, produced a charter for surveillance across the EU. This group has since continued a very fruitful exchange of ideas and initiatives under the slightly misleading name of the Charter Group. In April this year, the group decided to go one step further, and to set up a more formal Council of European State Epidemiologists for Communicable Disease (CESE). Led by the outgoing chairman, Professor Pauli Leinikki of KTL, the National Public Health Institute of Finland, the CESE group has developed a Strategy for Development of Surveillance and Control of Communicable Diseases in the European Union 2003-2008 (http://europa.eu.int/eur-lex/pri/en/lip/latest/doc/2002/com2002_0029en01.doc).

AbstractIn an era characterized by fast technological progress that introduces new unpredictable scenarios every day, working in the law field may appear very difficult, if not supported by the right tools. In this respect, some systems based on Artificial Intelligence methods have been proposed in the literature, to support several tasks in the legal sector. Following this line of research, in this paper we propose a novel method, called PRILJ, that identifies paragraph regularities in legal case judgments, to support legal experts during the redaction of legal documents. Methodologically, PRILJ adopts a two-step approach that first groups documents into clusters, according to their semantic content, and then identifies regularities in the paragraphs for each cluster. Embedding-based methods are adopted to properly represent documents and paragraphs into a semantic numerical feature space, and an Approximated Nearest Neighbor Search method is adopted to efficiently retrieve the most similar paragraphs with respect to the paragraphs of a document under preparation. Our extensive experimental evaluation, performed on a real-world dataset provided by EUR-Lex, proves the effectiveness and the efficiency of the proposed method. In particular, its ability of modeling different topics of legal documents, as well as of capturing the semantics of the textual content, appear very beneficial for the considered task, and make PRILJ very robust to the possible presence of noise in the data.

Abstract Background Social diversity can affect healthcare outcomes in situations when access to healthcare is limited for specific groups. Although the principle of equality is one of the central topics on the agenda of the European Union (EU), its scope in the field of healthcare, however, is relatively unexplored. The aim of this study is to identify and systematically analyze primary and secondary legislation of the EU Institutions that concern the issue of access to healthcare for various minority groups. In our research, we have concentrated on three features of diversity: a) gender identity and sexual orientation, b) race and ethnicity, and c) religion or belief. Method and materials For the purpose of this analysis, we conducted a search of database Eur-Lex, the official website of European Union law and other public documents of the European Union, based on specific keywords accompanied by review of secondary literature. Relevant documents were examined with regard to the research topic. Our search covered documents that were in force between 13 December 2007 and 31 July 2019. Results Generally, the EU legal system prohibits discrimination on grounds of religion or belief, racial or ethnic origin, sex, and sexual orientation. However, with regard to the issue of non-discrimination in access to healthcare EU secondary law provides protection against discrimination only on the grounds of racial or ethnic origin and sex. The issue of discrimination in healthcare on the grounds of religion or belief, gender identity and sexual orientation is not specifically addressed under EU secondary law. Discussion The absence of regulations regarding non-discrimination in the EU secondary law in the area of healthcare may result from the division of competences between the European Union and the Member States. Reluctance of the Member States to adopt comprehensive antidiscrimination regulations leads to a situation, in which protection in access to healthcare primarily depends on national regulations. Conclusions Our study shows that EU antidiscriminatory law with regard to access to healthcare is fragmentary. Prohibition of discrimination of the level of European binding law does not fully encompass all aspects of social diversity.

Abstract:
Abstract Background There is an alerting increase in the population affected by type 2 diabetes mellitus (T2DM) in the European Union (EU) with significant socioeconomic burden. According to an estimation by the International Diabetes Federation, by 2030, the total number of diabetic patients will be 38 million in EU. The “screen and treat” strategies that predominantly applied in policies to prevent T2DM have not achieved significant success, as reported by a large systematic review and meta-analysis published in 2017. Although the member states of the EU have almost full responsibilities for actions in the field of health, the EU has to tackle non-communicable diseases by targeting health determinants and lifestyle mostly through non-binding policies. The goal of this work is to review the T2DM prevention policies in the EU and compare with tobacco policies, from a legal perspective. Methods Following the systematic search and screening of policies from EUR-lex, a content analysis was carried out by using MonQcle as publicly available legal text document analysis platform, by two coders. The search was limited for regulations, directives and white papers. Results Our data collection consisted of 19 documents including 10 regulations, 6 directives and 3 white papers with relevance to T2DM, covering the following topics: health infrastructure and services, informational policies, economic policies, environmental policies, command and control and social policies. The identified policies covered the time frame of 1972 to 2020. Diabetes was targeted as part of non-communicable diseases. None of the policies was legally binding addressing T2DM directly which is in sharp contrast to the tobacco control policies in the EU. Conclusions T2DM, in fact, is largely preventable. EU institutions should consider to reframe T2DM prevention strategies and consider applying a wide range of population-level legislative and innovative actions to prevent T2DM e.g. taxes on unhealthy food products. Key messages T2DM is a largely preventable disease, effective legal tools should be created and applied matching the scale of such public health problem. T2DM policies of the EU may be subject to change due to additional value of actions taken by the EU compared to that could have been achieved by member states alone.
