Abstract:
In federal systems public authority is established by the people and exercised for the people at two levels. The treaties establishing the European Union may be conceptualised as the constitution of a supranational public authority, part of a federal system. And what the European Convention has submitted to the European Council to agree upon is an attempt to give this constitution a more coherent, more complete and more appealing form. The new ‘Constitution for Europe’ will be concluded, formally, by an international treaty. But governments and national parliaments will do this on behalf of the citizens of the Union, and insofar as national Constitutions provide for a referendum, the citizens will directly be involved. This Constitution will, therefore, like national constitutions, draw its legitimacy from the people, citizens of the polity, through their constitutional representatives. Legitimacy obtained is similar to that sought for a regular treaty but specific due to the contents and the explicit constitutional claim of the instrument.

Abstract:
What were the effects of constitution-making procedures on the acceptance of the new “rules of the political game” in postcommunist Central Europe? This article sets out to scrutinise the increasingly popular claim among politicians and scholars of democratisation that inclusiveness and popular involvement in constitution-making processes enhance a constitution's legitimacy. The concept of constitutional conflict, referring to political contestation over the interpretation and application of constitutional relations among state institutions, is introduced as a way to assess constitutional acceptance among politicians. The investigation concentrates on constitutional conflict patterns during the five years following constitution-making in seven Central European countries: Bulgaria, the Czech Republic, Estonia, Hungary, Poland, Romania, and Slovakia. Constitution-making procedures varied substantially among the cases, as did the intensity and timing of constitutional conflict. The article finds that differences in constitution-making procedures do not necessarily determine the legitimacy of constitutions among political elites. Instead, ambiguity on the allocation of formal competencies among political actors and increasing political tensions between pro-reform and anti-reform parties during the early 1990s proved to be more important triggers of constitutional conflict. Accordingly, studies on constitution-making and democratisation should focus less on procedural aspects and take into account the fuzziness of important constitutional provisions and the extent to which constitutions can survive periods of intense political polarisation.

Abstract:
The aim of the study is to examine how animal protection, especially that of animal specimens, is included in the European constitutions. San Marino and the United Kingdom have no classical, written constitutions, hence, a total of 42 European constitutions were studied. Animals typically appear in the constitution as species that, as part of nature and the environment, must be conserved in order to preserve biodiversity. There are only a few constitutions in Europe that reflect a narrowly defined approach to animal protection. According to this, animals as individuals must be protected because of their intrinsic value. The research has shown that 14% (6 countries) of the European countries examined contain both species and specimen protection provisions in their constitutions. The vast majority, 69% (29 countries) included only animal species protection provisions in the constitution. 17% (7 countries) of the European constitutions do not contain a provision based on any of the criteria. Only Austria, Germany, Luxembourg, Slovenia, Sweden and Switzerland have provisions for individual protection of animals at constitutional level. In Switzerland, a unique legal institution, the “dignity of animals” was given constitutional protection.

Abstract:
Constitutional changes in a state with written constitution are carried out on the basis of a rule that has been set out by the constitution itself. In practice, many authors refers to articles that define the way of changing the constitution as "rules that define rules" (See for more Tracy Di Fillippo, How to Make Objections to Discovery under the Amended Rules, 25 Pretrial Prac. & Discovery 1, 2016.) Depending on the content of these rules, two sets of constitutions are generally formulated in the theory of constitutional right. The first are the flexible constitutions, which are amended in a simpler procedure, with a simple majority and in a shorter period of time. While in the second category there are the so-called rigid constitutions. Rigid are called the constitutions that have established a more extended or complicated procedure of amendment, with a qualified majority (more than just a simple majority) and a longer period of time.However, the procedure and the number of members of parliament differ. The main goal of this paper is to analyze those differencies, in oredr to find that how the procedure can affect on the constitutionality of the constittuion amendments. Is the rigid procedure a key for constitutional amendments or not? This is another question that is going to be analyzed by comparing different procedures of constitutional amendments in different countries.

On 29 May 2005 the French said no to the draft of a European Constitution. And frankly, the French should know about constitutions! One can differ whether the history of France should be considered a fruitful garden of constitutional thought, a graveyard of constitutional experiments, a ‘musée des constitutions’, or a minefield; in any case it is beyond doubt that the French are rather experienced in constitutions and constitutional changes. Since the French Revolution in 1789, France has been a monarchy, a republic more than once, an empire twice and a constitutional monarchy in between; the nineteenth century shows the pattern monarchy, republic, empire; since 1958 the French live in their Fifth Republic.There is a lot to learn from the constitutional history (perhaps struggle is a better word in this context) of this important European country for any political entity in search of a proper constitution. Which constitutional institutions were a success, which were not; why did it or did it not work out the way it was planned?

CONSTITUTIONS, CONSTITUTIONAL REFORM AND CONSTITUTIONAL conflict are once again commanding attention. The celebrations of the bicentennial of the American constitution, the implementation of constitutional reform in Canada, the Labour government's programme for constitutional change in the United Kingdom, the seemingly intractable conflict in Northern Ireland, and transfers of sovereignty to the European Union from its constituent states, testify to this. Equally, if not more challenging, have been the upheavals in Eastern Europe and the former Soviet Union and its reconstituted states, the ‘third’ wave of democratization across the developing world, the experiment in participatory constitutionalism in South Africa and the return of Hong Kong to China. Of the 179 countries that elect their governments out of a total of 192 countries in the world, 176 have codified constitutions. Constitutions, however, that are not fully mature or operative and are not based on the principles or drafted with the advice of those nations that have developed and entrenched their constitutions tend to be disregarded, or even dismissed. Moreover, writing a constitution is one exercise, implementing, and interpreting it is a far more complex and delicate undertaking. So how are social scientists to evaluate the process?

Since then, the text of the French Constitution has been repeatedly amended to respond to the quickening pace of European integration. Furthermore, the Conseil constitutionnel has totally transformed its control of the constitutionality of international treaties. An assessment of these constitutional changes seems opportune at this juncture. More specifically, an investigation into the manner in which the French constitution reacted to the changing European Union helps cast some light on the impact of European integration on national constitutions.

Abstract:
Preambles are parts of constitutions, which are visibly neglected in legal theory and constitutional law. They are defined as solemn introductions to constitutions, which indicate the sovereign, historical and political context of increasing the new constitutional order, main aims and principles – the foundation of constitution. Such elements are also commonly apparent in most of post communist constitutions of European states. The article shows the integrative function of these preambles, achieved by using clauses creating and maintaining the identity of political community. The clauses with this function are identified as: statements regarding national and cultural heritage, declaration of sovereign as people or nation, and expression of common aims and fundamental principles of community. The article investigates these elements in texts of preambles to post-communist constitutions and indicates their role as tending to create the national identity.

Abstract:
The constitutional basis for religious freedom in selected countries in Europe and Latin AmericaReligion helps man keep his own identity. It enables him to participate in a common heritage. The study provides the constitutional basis for religious freedom in the individual dimension in selected countries in Europe and Latin America. The authors discuss the provisions on religious freedom enshrined in the constitutions of Italy, Spain and Portugal, as well as Argentina, Chile and Colombia.The analysis leads to the conclusion that religious freedom is a human right protected both in the constitutions of European countries as well as in the constitutions of Latin American countries.The inclusion of the provisions on religious freedom in the individual dimension in the constitutions is due to certain similarities of the system of European and Latin American. Common features of both systems is that Europe and Latin America belong to the so-called Western civilization. The legal systems of Latin American countries formed primarily on the basis of Roman law.Although the wording of the provisions on religious freedom in the individual dimension in the constitutions of Latin American countries is similar to the editorial rules of the constitution states of Europe, in practice there are other ways to implement this freedom and guarantees its protection.

The primary focus of this work is Article 57 of the Draft European Constitution, concerning the constitutionalisation of a new aspect in EU external relations law, 'the European Neighbourhood Policy'. No comprehensive study of this constitutional article has yet been undertaken in EU legal research. Through the medium of the title of my thesis I wish to examine whether it amounts to an emergent jus gentium for the EU or its antithesis, the consolidation of jus civile. In parallel with the nature of the subject, this study is necessarily a legal-political one. Key points identified are the strategic use of human rights, extraterritoriality of law, foreign direct investment and legal imperialism. A number of recent developments, both judicial and legislative, have provoked this study.

Abstract:
This study examines the extent to which the transfer of legislative competence to polities above and below the state problematizes a national model of membership. The study first examines fragmentation of competences determinative of social membership across the polities of two ‘asymmetric constitutions’ (constitutional structures in which both the whole and the parts are distinct territorially-bounded political communities, and in which legislative competence is allocated unevenly across the constituent polities). Two case studies then explore how those polities exercise those competences so as to define the boundaries of equal social membership, and how these boundaries interact across the constitutional structure. The study highlights three observations in support of its conclusion that constitutional asymmetry presents a challenge to a national model of membership: constituent polities of the asymmetries under examination allocate social rights primarily by reference to residence, thus lending (qualified) support to transnational and a-national theories of membership; differentiated social rights enjoyed by a particular sub-set of nationals are incompatible with the presumed equality of nationals under a national model of membership, resulting in the perception of inequity and discrimination; and the interdependence of membership competences across the constitutional asymmetry means that it is no longer possible for a polity to exclusively determine the boundaries of social membership.

La Constitution, entendue dans son acception la plus générale comme La marque suprême de souveraineté nationale, ne cesse d'évoluer au fil de l'approfondissement de la construction européenne. Un tel constat se manifeste à la fois dans le contenu matériel et normatif de la norme première, dans son aspect purement formel et dans son essence même. Pour s'en convaincre, il suffit de se reporter aux nombreuses révisions constitutionnelles ayant été effectuées sous la pression de l'intégration européenne. La doctrine évoque une communautarisation des Constitutions nationales voire une constitutionnalisation du droit communautaire. Dans cette optique, il convient de s'interroger, par le biais d'une démarche comparatiste évolutive, sur la portée effective et sur les conséquences de ces évolutions sur les contours et l'acception de la Constitution française.Est­-il encore possible d'évoquer un monopole de souveraineté pour caractériser cette dernière, face à l'exercice par l'Union européenne de la souveraineté transférée ? Est-­il réellement légitime, et juridiquement juste, de continuer à appréhender la Constitution à partir de son cadre national d'origine ? En d'autres termes, et d'une manière plus radicale, le concept de Constitution peut‐il encore être rattaché à un sens traditionnel et exclusif, tel qu'issu du droit interne? Face aux incertitudes européennes dont la norme suprême fait désormais l'objet, force est de dépasser le cadre d'étude fondamental traditionnel par la construction d'un nouveau concept de "Constitution", supplantant les principales définitions jusqu'ici admises.

Abstract:
This thesis aims at furthering our understanding of the constitutional structures and processes of sui generic associations such as the European Union. The thesis argues that the problematical constitutionalisation of the European Union has highlighted the limitations of the political thought that has served as the basis of political associationalism since the Treaty ofWestphalia (1648) and the publication of Thomas Hobbes' Leviathan (1651). These limitations have resulted in the European Union being described, for want of a better expression, as sui generis. The thesis advances the argument that in order to be in a position to understand constitutional relations in a 'non-statal' setting, what is needed is an alternative variant of political thought that is not based in or dependent on the societas canon that originates with Hobbes. One source of such political thought can be located in the work of Johannes Althusius (1557-1638) who, writing in the city of Emden in the Holy Roman Empire in the early 17th Century, described a constitutional structure of a political association that differs in significant features to the centralised state theories of the societas canon. The thesis also argues that the traditional concepts of constitutionalism and political association applied to sui generic constitutionalism are hampered by the inherent weaknesses of modem political and legal vocabulary. Despite being used ad infinitum in the constitutional discussions on the European Union, there is not a precise definition of either the term 'constitution' or treaty' in political or legal theory. Althusius' work avoids this weakness, due to the fact that the centralised state does not enjoy the same position it does in the societas canon, and so the need to classify 'intra' or 'inter' state relationships does not exist to the same degree. While taking the European Union as a workable model of a sui generic association, this thesis does not aim at solving the European Union's constitutional problems or offering a more suitable term to describe its nature. Rather, based on an analysis of Althusius' work, the thesis aims to offer an alternative understanding of the problems that result from the constitutionalisation of sui generic associations.

La presente Tesis Doctoral realiza un estudio serio y riguroso de la Unión Europea concebida como entidad política sui generis, original, desde una perspectiva eminentemente jurídica a la que se suma también la visión histórica y la política.Tras poner de manifiesto en los capítulos introductorios que la vocación política de la Unión Europea se remonta incluso tiempo atrás al nacimiento de las primeras Comunidades, el núcleo de la investigación se prodiga a analizar la naturaleza política del edificio europeo. En particular, se sostiene la dimensión materialmente constitucional de la construcción europea, ya defendida por el Tribunal de Justicia de las Comunidades Europeas en reiterada jurisprudencia. La metodología que se sigue resulta de aplicar categorías y conceptos clásicos del Derecho constitucional a la Unión. A este respecto, se presta especial atención al reparto de poder, a la arquitectura institucional, a los derechos fundamentales, al funcionamiento democrático. Asimismo, el Tratado constitucional merece en nuestro trabajo una consideración especial y diferenciada toda vez que representa el paradigma de la profundización política pues toda Constitución, por definición, es el texto legitimador de una comunidad política. Entre las aportaciones más originales, cabe señalar un modelo de organización política bosquejado por nosotros al que denominamos Federalismo supranacional cooperativo, que reformula el Federalismo supranacional asociando al método comunitario los mecanismos cooperativos. Este modelo que acuñamos nos permite aproximarnos al sistema político europeo en nuestros días. Nuestras conclusiones subrayan que la UE, desde sus orígenes, ha aspirado a la construcción política; que las aspiraciones a la construcción política han cristalizado en un proyecto europeo singular que reproduce con matices las estructuras estatales tradicionales; que el Tratado constitucional encarna ese proyecto europeo singular. Representa un modelo de comunidad política europea de vocación democrática, que asocia elementos federales y con-federales, enraizado en valores compartidos, derechos fundamentales, principios y libertades; que el Tratado que establece una Constitución para Europa, comúnmente conocido como Constitución Europea, no puede ser calificado como un Tratado más. Tiene naturaleza materialmente constitucional, es una Constitución material de naturaleza singular para la Unión Europea; que el Tratado constitucional representa un peldaño más en el proceso de construcción europea, de carácter dinámico, evolutivo, no acabado. Los resultados de la Cumbre de junio de 2007 no colman las expectativas iniciales del periodo constituyente; que la unión política es indispensable para que Europa se convierta en un actor político mundial y pueda contribuir a la resolución de los retos a los que se enfrenta la sociedad internacional del siglo XXI. La adopción de un Tratado de reforma no es la más plausible a medio-largo plazo; que el éxito de la unión política reposa en la adhesión ciudadana al proyecto europeo. Es necesario promover entre los ciudadanos de la Unión el europeísmo, el sentimiento de unidad europea, la conciencia de compartir un destino común.Parece conveniente resaltar que el Tratado constitucional no ha entrado en vigor, de un lado, porque la aceptación del carácter federal de la UE, superador de las instancias estatales, exige un proceso de asimilación lento; de otro, porque la ciudadanía no lo ha respaldado, al estar todavía distanciada del proyecto europeo, de su magnitud y alcance, en suma, de los beneficios de la Unión Europea.En todo caso, la Constitución Europea no está muerta pues el Tratado de Lisboa, pese a desprenderse de los símbolos políticos, recoge las principales aportaciones de la Constitución Europea.La Relevancia y la Actualidad de nuestro trabajo son fruto de replantearse el papel de la Unión Europea en el siglo XXI y la viabilidad de realizar con éxito su cometido -afrontar los desafíos de la globalización-, para lo que resulta conveniente consumar la integración adoptando un modelo federativo. Ciertamente, la sociedad internacional del siglo XXI es extremadamente compleja y los desafíos exigen acciones en común, coordinadas. El Estado-nación se perfila como una estructura algo trasnochada y frágil. Tan sólo las asociaciones de Estados -en sus múltiples variantes- pueden dar respuesta a la globalización y encauzar problemas como la pobreza, el desarrollo sostenible, la energía, el terrorismo internacional, los flujos migratorios, el narcotráfico, las catástrofes naturales, etc.

La notion d’identité constitutionnelle occupe une place charnière dans les rapports entre les États membres et l’Union européenne. Il n’est donc pas étonnant que cette notion focalise l’intérêt. Toutefois, le choix de l’expression « identité constitutionnelle » soulève un paradoxe. La sémantique choisie pour exprimer cette contre-limite est, par essence, floue.Or, s’il y a déjà eu beaucoup d’écrits sur l’objet, la fonction et même la conceptualisation de cette notion, il y a peu d’écrits qui, au-delà de la notion même, portent sur les acteurs qui en sont à l’origine et sur ceux qui l’exploitent effectivement, la font vivre, l’interprètent, en un mot, qui l’utilisent.C’est donc le chemin qui souhaite être ici emprunté : celui consistant à rechercher l’utilisation concrète de la notion d’identité constitutionnelle nationale et, au-delà, les porteurs de cette notion
The notion of constitutional identity occupies a pivotal place in relations between the Member States and the European Union. It is therefore not surprising that this notion focuses interest. However, the choice of the term "constitutional identity" raises a paradox. The semantics chosen to express this counter-limit is, in essence, fuzzy.However, while there has already been a lot of literature on the subject, the function and even the conceptualization of this notion, there are few writings which, beyond the very notion, relate to the actors who are at the origin and on those who exploit it effectively, make it live, interpret it, in a word, who use it.It is therefore the path that wants to be taken here: that of seeking the concrete use of the notion of national constitutional identity and, beyond that, the bearers of this notion

Abstract:
Capillary burst valve (CBV), a counterpart to an elastomeric diaphragm microvalve, handles fluid in microchannels by capillarity. Thus, it avoids integration of mechanical components. We experimentally estimated the burst pressure, beyond which CBV cannot hold fluid, using fluids with distinct surface tensions in CBVs grafted with distinct surface constitutions in microchannels. We found that both the fluid surface tension and the solid surface constitution influence the burst pressure. The burst pressure reduces more significantly under the influence of the fluid surface tension.

Abstract:
The Charter of Fundamental Rights of the European Union has been applied directly by the Croatian Constitutional Court since the decision No. U-I-1397/2015 (Act on Elections of the Representatives to the Croatian Parliament) rendered in 2015. Ever since it can be observed that the Charter has been consistently applied both in the proceedings of constitutional review in abstracto and in the proceedings initiated by a constitutional complaint (constitutional review in concreto), however, in a limited number of cases mostly concerning migrations or asylum.Therefore, this paper analyses the application of the Charter in the case law of the Croatian Constitutional Court and the method of interpretation pursued, with special reference to both its shortcomings and benefits. The paper also investigates the reasons for limited application of the Charter, even in those cases which would normally fall under the scope of application of EU law. The analysis indicates two distinct methodological approaches adopted by the Constitutional Court. The first one, where the Charter has been regarded as an interpretative tool only; and the second one, where the Charter has been found to be directly applicable vis-à-vis individual rights inferred from the EU law. The latter approach, first followed in an asylum case No. U-III-424/2019 (X. Y.), had raised new questions on interpretation of the Charter (with respect to the Croatian constitutional framework) in the cases where the Charter's applicability ratione materiae overlaps with the Croatian Constitution and the (European) Convention for the Protection of Human Rights and Fundamental Freedoms, which to the day, in contrast to the Charter, has been consistently followed and therefore legally internalised by the Croatian Constitutional Court. Therefore, the paper also elaborates a new methodological approach adopted by the Croatian Constitutional Court in finding a way out of „limbo“ between the Charter, the ECHR, and the Croatian Constitution.

Abstract:
The COVID - 19 pandemic that swept the world in 2020 and the reactions of state authorities to it are unparalleled events in modern history. In order to protect public health, states have limited a number of fundamental human rights that individuals have in accordance with national constitutions and international conventions. The focus of this paper is the right of access to abortion in the Member States of the European Union. In Europe, the situation with regard to the recognition of women's right to abortion is quite clear. All member states of the European Union, with the exception of Poland and Malta, recognize the rather liberal right of a woman to have an abortion in a certain period of time after conception. However, Malta and Poland, as members of the European Union, since abortion is seen as a service, must not hinder the travel of women abroad to have an abortion, nor restrict information on the provision of abortion services in other countries. In 2020, a pandemic highlighted all the weaknesses of this regime by preventing women from traveling to more liberal countries to perform abortions, thus calling into question their right to choose and protect their sexual and reproductive rights. This is not only the case in Poland and Malta, but also in countries that recognize the right to abortion but make it conditional on certain non-medical conditions, such as compulsory counselling; and the mandatory time period between applying for and performing an abortion; in situations present in certain countries where the problem of a woman exercising the right to abortion is a large number of doctors who do not provide this service based on their right to conscience. The paper is divided into three parts. The aim of the first part of the paper is to consider all the legal difficulties that women face in accessing abortion during the COVID -19 pandemic, restrictions that affect the protection of their dignity, right to life, privacy and right to equality. In the second part of the paper particular attention will be paid to the illiberal tendencies present in this period in some countries of Central and Eastern Europe, especially Poland. In the third part of the paper, emphasis will be put on the situation in Malta where there is a complete ban on abortion even in the case when the life of a pregnant woman is in danger.

Immigration has presented itself in every chapter of the history with regards to its social, economic, political and legal aspects. However, with special regards to the global and regional instability which has come into focus and become chronic, it has gained vital importance for almost all developed and developing countries. Mentioned issue has transformed into a specific and extraordinary situation for Turkey which is situated at the intersection of the continents, Asia and Europe. Because Turkey has not only become a transit country for irregular migration but also it has turned into – if we may say so- the focus point of this vicious circle. The legislator who is aware of this situation, has brought upon essential amendments and innovations and also has concluded international, regional and bilateral agreements. We, within the scope and size of our study, shall examine certain issues which we deem important within the context of Foreigners and International Protection Law No. 6458 dated 04.04.2013 within the light of Constitution, European Convention on Human Rights and the jurisprudence of European Court of Human Rights and shall discuss some existing and potential problems in addition to suggestions for solution.

Undoubtedly, a war in a country is a great destruction for its citizens. The Syrians have had to take refuge in other countries because of their vital problems. European countries have adopted a rigid attitude towards refugees to protect themselves. How did the refugee mobility, arising from internal conflicts in Syria and embodying different qualities within its constitution, affect European countries due to global economic relations? Or did Europe continue its economic development without being negatively affected by the geographically distant war? On the other side, to what extent has Turkey been able to protect itself economically? Can Turkey continue their progress towards the EU? This work investigating answers to these questions is based on the Maastricht criteria set to ensure economic integration at an advanced level among EU countries. The data related to these criteria cover 6 annual data of pre and post of the war. In the analysis, countries are ranked and evaluated with the flows of criteria, using PROMETHEE method. The result of the analysis shows that generally there is a decrease, in comparison, in the net flows of the second period. This implies that countries are not in better situation compared to the first period which covered 2008 financial crisis. In other words, the EU may likely remain behind of its economic and fiscal targets.
