Abstract: In spite of the fact that almost all the European Union member States have similar princi­ples of tax justice, there is not an express specification about them in the Primary Law of the Union. The institutions of the European Union have some tax competences given by their member States, specially highlighting fiscal harmonization of certain state taxes. The tax harmonization directives, despite this lack of express specification, cannot forget these principles of tax justice. The argument of the environmental taxation of hydrocarbons has been used to increase the fiscal pressure over the gasoline until a point where its legitimacy should be discussed, not only from the constitutional point of view, but also from the Euro­pean Union Treaties. Individual States are not the only ones responsible for this situation but also European Union institutions are, since the tax on mineral oils has been harmonized by European Union directives.Keywords: environmental taxation, European Union, limits.Resumen: A pesar del hecho de que en la mayoría de los Estados miembros de la Unión Europea existen unos principios de justicia tributaria similares, no existe una especificación expresa de éstos en el Derecho Originario de la Unión. Las instituciones de ésta tienen determinadas competencias en materia tributaria atribuidas por sus Estados miembros, especialmente en relación a la armonización fiscal de ciertos impuestos estatales. Las directivas de armonización fiscal, a pesar de esta falta de especificación expresa, no pueden olvidar estos principios de justicia tributaria. El argumento de la fiscalidad ambiental de los hidrocarburos ha sido utilizado para incrementar la presión fiscal sobre los carburantes hasta un nivel con respecto al cual sería discutible su legitimidad, no sólo desde el punto de vista constitucional, sino también desde la perspectiva de los Tratados de la Unión Europea. Los Estados individualmente considerados no son los únicos responsables de esta situación, sino que también lo son las instituciones de la Unión Europea, desde el momento en que la imposición sobre hidrocarburos se encuentra armoni­zada conforme a directivas de la Unión.Palabras clave: fiscalidad ambiental, Unión Europea, límites.

Since the 1972 Stockholm UN-Conference, a dynamic and creative development of international environmental law has brought about many important achievements. However, major shortcomings remain to be tackled, and a further globalization of the environmental law with massive impacts on the European and national legal orders is imperative. The European Union can play a leading role in the swift and effective implementation of international law. Today, many EU environmental acts are, in fact, already implementing international stipulations. For an effective future development of international environmental law, a special UN environmental organization appears urgently needed.

Abstract:
Over the past thirty years European Union environmental policy has greatly expanded. Overall, more than three hundred pieces of environmental legislation have been adopted. For many years the European Commission was primarily preoccupied with the introduction of new legislative initiatives. However, progressively inadequate implementation and enforcement became the greatest challenge of European Union environmental policy. Following the final assessment of the Sixth Environmental Action Programme, which concluded that the enforcement of EU environmental law is insufficient, the problem remains as pertinent as ever. This study critically analyzes the institutional, procedural and remedial framework provided for by the European Union Institutions to safeguard the effective enforcement of Union environmental legislation at national level. It focuses on the role of three European Institutions, namely the European Commission, the Court of Justice of the European Union and the European Union legislature in the enforcement of EU environmental legislation. The thesis identifies relevant areas of concern in the exercise of the Institutions’ role pertaining to enforcement. Despite certain limitations to which the doctrines of direct effect, consistent interpretation and State liability in damages have been made subject, their utility as enforcement mechanisms has overall been safeguarded by the Court of Justice of the European Union, which has granted national courts the necessary tools to advance the effectiveness of private enforcement of EU environmental legislation. The thesis criticises the Commission’s new enforcement strategy for focusing on formal implementation of EU environmental law, while neglecting the monitoring of application on the ground. Regarding the legislative intervention of the Union, notably in the areas of environmental liability and criminal enforcement, the thesis argues that proper justification for EU action has not been provided and that the stated purpose of the established regimes has not been attained.

Abstract:
The thesis is a comparative legal analysis of environmental principles in environmental law. Environmental principles are novel concepts in environmental law and they have a high profile in environmental law scholarship. This high profile is promoted by two factors – the high hopes that environmental law scholars have for environmental principles, and the increasing prevalence of environmental principles in legal systems, particularly in case law. This thesis analyses the latter, mapping doctrinal developments involving environmental principles in two jurisdictions and court systems – the courts of the European Union and the New South Wales Land and Environment Court. This doctrinal mapping has both narrow and broad aims. Narrowly, it identifies the legal roles in fact taken on by environmental principles within legal systems. Broadly, and building on this assessment, it responds to scholarly hopes that environmental principles (can) perform a range of significant roles in environmental law, including solving both environmental problems and legal problems in environmental law scholarship. These hopes are based on assumptions about environmental principles that have methodological weaknesses, including that environmental principles are universal and that they fit pre-existing models of ‘legal principles’ drawn from other areas of legal scholarship. The thesis exposes these methodological problems and concludes that environmental principles are not panaceas for pressing and perceived problems in environmental law. It does this by showing that the legal roles of environmental principles, which are significant in environmental law and its current evolution, can only be understood by closely analysing the legal cultures in which they feature. This is a conclusion for environmental law scholarship generally – while environmental issues and problems may be urgent and often global, legal analysis of the law that applies to those problems requires close engagement with legal systems and cultures, as they are and as they develop.

Term energy efficient building is well know from year 1991, when Austrian physicist Dr. Feist designed and built first passive house, using current physical and practical knowledge. In the next 25 years buildings using principles of energy efficient design have changed dramatically. In a good way. It is mandatory for Slovak Republic as a part of European Union to act according European parliament directives. One of directives concerns lowering total energy consumption and emissions in the building sector – Directive 2010/31/EU on Energy performance of buildings, also known as Directive “20-20-20”. According to this directive, Slovak Republic has agreed to lower total energy consumption in building industry by 20% until year 2020. Plan on lowering total energy consumption has affected creation of new – technical and energy efficient building materials with emphasis on environmental load. It this paper, ultra-low-energy family house located in Košice, Slovakia was assessed from environmental and energy point of view. With help on modern diagnostic methods and thermo- physical simulation software DesignBuilder, we will virtually evaluate energy need of house throughout the reference year, and indoor quality from the environmental point of view, such as CO2 levels and bounded energy using LCA method.

The growing importance of finding shared solutions for countries with small arisings of long-lived wastes from nuclear power generation has been increasingly recognised over the last few years. In this paper, we take a systematic look at recent developments focusing in turn on: • international initiatives (IAEA); • regional initiatives the European Union (EU); • national positions for in 3 categories of countries: • those participating in the Arius association that was founded explicitly to promote the multinational concept; • those with specific interests in shared solutions; • those that might consider hosting a repository; • those with laws or policies requiring national disposal. Multinational concepts continue to face challenges that are more difficult than for national programmes. Nevertheless, progress to date indicates that the nuclear communities of the world may well be on the way to optimising radioactive waste management on a global scale.

Discarded electrical and electronic equipment contains valuable materials, low value parts, and hazardous substances. There is a growing concern regarding the management of end-of-use equipment owing to the environmental concerns associated with discarding used devices. Electronic waste or scrap consumes valuable landfill space and may ultimately contaminate groundwater sources. In addition, replacing discarded components with new components typically consumes valuable virgin material resources. With the advent of the WEEE (Waste Electrical and Electronic Equipment) Directive, used electrical and electronic products are now being recovered in Turkey as a European Union (EU) candidate country, and several companies in Turkey have begun to recover latent value through disassembly and reuse/recycling of materials and components. To remain competitive, these companies must implement economical and environmentally responsible recovery processes. There are a number of research challenges associated with product recovery. This paper describes the current product recovery infrastructure in Turkey, and discusses future trends and drivers for successful product take-back.

Abstract:
In 2007, spent nuclear fuel (SNF) from the Nuclear Research Institute Rˇezˇ plc (NRI) was shipped to the Russian Federation for reprocessing. A large amount of SNF of Russian origin has been accumulated after 50 years of research reactor operation. The shipment was realized in the frame of the Russian Research Reactor Fuel Return (RRRFR) program under the US-Russian Global Threat Reduction Initiative (GTRI). SNF shipment from NRI to the Russian Federation represented a very complex and complicated technical, legal and contractual scope of work. The SNF shipment has been realized under specific conditions: 1. High capacity SˇKODA VPVR/M casks were used for transportation for the first time. 2. For the first time, high enriched uranium SNF from a research reactor has been sent to the Russian Federation from a European Union country under the appropriate intergovernmental agreements, legal regulations and conditions. NRI also participates in shipments of SNF from other countries within the framework of the RRRFR program. NRI participated in shipments of SNF from Bulgaria and Hungary in 2008, from Poland in 2009 and 2010, from Ukraine in 2010. Shipments from Belarus and Serbia are planned in 2010. The second shipment of the residue of high enriched SNF from NRI after changeover of the reactor operation to low enriched fuel will be implemented in 2013. The experiences gained during the SNF transportation are described in the paper together with the present and future NRI activities in support of the SNF shipment from other countries.

Abstract:
In the European Union, the potential for recycling technological and post-consumer polymeric waste is untapped. Their recycling and reuse are very low, compared to other types of waste such as glass, paper, etc., and the rates of storage, even of incineration, is very high in terms of percentage. Therefore, by reusing them, but also making use of new advanced technologies, we can contribute to improving the quality of products, and to environmental protection by recycling waste, protecting human health by eliminating toxins during their incineration, but also increasing turnover for global economic agents. Thus, this paper presents the obtaining and characterization of an antibacterial compound based on EPDM elastomer and wood waste (sawdust). The antibacterial compound is characterized from a physical-mechanical and structural point of view (FT-IR), all according to standards in force.

Abstract:
The present research aims to understand the current situation of strategic communication and public relations applied in the professional field of fundraising in the cultural heritage environment. It observes the current patterns used in the sector to obtain and generate long-term sustainable funding, through the stimulation of investors and International Cooperation projects from the European Union in line with UNESCO. Two international case studies are compared: Spain and Mexico, through the selection of territorial samples in Malaga and San Luis Potosi. The methodology used is based on a combination of in-depth interviews with key informants and content analysis. In the first instance, the degree of application of communication and public relations tools for strategic purposes to directly attract economic resources to the management of cultural heritage (tangible and intangible) in the region is studied. In line with the results obtained, the current parameters and key indicators of the profile of the fundraising professional in public and private cultural management are presented.

Short-term rentals mediated by digital platforms have positive and negative impacts that are unevenly distributed among socio-economic groups and places. Detrimental impacts on the housing market and quality of life of long-term residents have been particular contentious in some cities. • In the 12 cities studied in the report (Amsterdam, Barcelona, Berlin, Brussels, Lisbon, London, Madrid, Milan, Paris, Prague, Rome and Vienna), city governments have responded differently to the growth of short-term rentals. • The emerging local regulations of short-term rentals take multiple forms and exhibit various degrees of stringency, ranging from rare cases of laissez-faire to a few cases of partial prohibition or strict quantitative control. Most city governments have sought to find a middle-ground approach that differentiates between the professional rental of whole units and the occasional rental of one’s home/ primary residence. • The regulation of short-term rentals is contentious and highly politicised. Six broad categories of interest groups and non-state actors actively participate in the debates with contrasting positions: advocates of the ‘sharing’ or ‘collaborative’ economy; corporate platforms; professional organisatons of short-term rental operators; new associations of hosts or ‘home-sharers’; the hotel and hospitality industry; and residents’ associations/citizens’ movements. • All city governments face difficulties in implementing and enforcing the regulations, due to a lack of sufficient resources and to the absence of accurate and comprehensive data on individual hosts. That data is held by corporate platforms, which have generally not accepted to release it (with a few exceptions) nor to monitor the content of their listings against local rules. • The relationships between platforms and city governments have oscillated between collaboration and conflict. Effective implementation is impossible without the cooperation of platforms. • In the context of the European Union, the debate has taken a supranational dimension, as two pieces of EU law frame the possibility — and acceptable forms — of regulation of online platforms and of short-term rentals in EU member states: the 2000 E-Commerce Directive and the 2006 Services Directive. • For regulation to be effective, the EU legal framework should be revised to ensure platform account- ability and data disclosure. This would allow city (and other ti ers of) governments to effectively enforce the regulations that they deem appropriate. • Besides, national and regional governments, who often control the legislative framework that defines particular types of short-term rentals, need to give local governments the necessary tools to be able to exercise their ‘right to regulate’ in the name of public interest objectives.
