Abstract:
The plea of applying the exhaustion doctrine to intangible copies of copyrighted artistic works has been extensively discussed within scholar circles. Although, the debate substantially concerns provisions of the international treaties and the explanation of the exhaustion doctrine under European Union copyright law, the subject brings more uncertainties. Under the European Union copyright law the distribution right is exhausted after the first sale with the consent of a right holder. However, there is neither explicit regulation nor decision in regard to the exhaustion doctrine to the online resale of digital goods. As the act of distribution is shifting and fulfilled through digital means these days, the application of the first sale doctrine is challenged. The given work provides with the legal, organizational and technological analysis of the exhaustion doctrine under European Union copyright law and possible scenarios in respect to digital secondary market.

Abstract:
This thesis investigates what it means to view disruptive innovation as a political problem. I take my point of departure in the tendency for controversial disruptions in heavily regulated sectors, such as electronic cigarettes or hydraulic fracturing, to open regulatory spaces by challenging established expectations about how they ought to be governed. In the wake of such disruption, policy actors with a stake in the matter engage in sensemaking and discursive contests to control the meaning of the innovations in order to close the regulatory spaces by aligning them with one set of laws instead of another. I study these contests in two recent legislative initiatives of the European Union to address the disruptive potential of e-cigarettes and fracking: the 2014 revision of the Tobacco Products Directive and the 2014 Commission recommendations on unconventional fossil fuels. The research draws on 51 interviews carried out with key policy actors during and after the policy debates. I bolster this with an analysis of policy documents, press releases and scientific studies, as well as a content and network analysis of position statements in newspaper articles. I find that the strategic use of rhetoric and framing plays an important part in creating, maintaining, and entrenching opposed coalitions in both policy debates. In both case studies, the policy solution is accompanied by deteriorating levels of trust among participants, leading coalitions to engage in strategies of venue-shopping to circumvent their opponents. This underscores the significant challenges there are for policymakers to address disruptions while maintaining legitimacy. The original contribution of the thesis lies in its novel conceptualization of disruptive innovation as a political problem, its application of micro-sociological approaches to the politics of expertise and European public policy, and its practical and theoretical suggestions for how to better study periods of disruption and govern through them.<br>Doctorat en Sciences politiques et sociales<br>info:eu-repo/semantics/nonPublished

Abstract:
This thesis analyses the evolution of the EU legal regulatory framework for electronic communications in light of the changes in the law's technological and business environment, namely the shift to Next Generation Networks (NGN). Using systems theory as its central research method, the thesis explores communications law as a self-referential phenomenon which, despite its internal attempts to promote itself by means of responding to the changing environment, remains locked-in by its own autopoietic structures. This is demonstrated by the law's traditional focus on voice telephony as the essential communications service provided in the public interest. Whereas the idea of 'technological neutrality' has enabled the law to embrace new applied technologies such as VoIP, it could not move its attention away from its autopoietic concepts to NGN-related issues such as net neutrality. Even though legal concepts without reference to any particular technology are increasingly used in regulation, as is the case with competition law images of 'relevant markets' and 'market power', the shift to NGN only remains visible to the law on its 'internal screen'. This becomes evident when the implementation of new technologies fails to achieve the results implied by the legal system, namely effective competition among different access infrastructures. Systems theory keeps a distance from both neo-liberal ideas that ideologically reject regulation, as well as from the autopoiesis of the NRAs' and the Commission's harmonising efforts, which inevitably result in more legal rules. Whereas the 'efficiency' of NGN investments cannot be implied based on the mere absence of ex ante regulation, the expected further proliferation of regulation based on the law's autopoietic programmes, although more cognitively open than before, will not be able to take on board all (possibly desirable) solutions that are not foreseen by the EU legal framework.

Abstract:
The perceived socio-economic significance of Information and Communication Technology (ICT) has dramatically expanded the domains in which this cluster of technologies is being discussed and acted upon. Action to promote the 'information society' has made its way into governmental policy. National technology policy and action cannot however be adequately understood solely as the calculation of needs according to the development aspirations of the country concerned. Instead it needs to be placed in the intersection of simultaneous efforts by national and international organisations to shape technological developments. This research examines the nature of efforts made to promote ICT innovation through national policies and programmes in the midst of international and regional influences. The thesis involves the historical analysis of the policies for ICT diffusion in Greece within the context of the European efforts to promote the information society. It examines how the Greek state undertook to implement a large-scale ICT programme, in the backdrop of hesitant attempts at modernisation and technological innovation. The research traces the emergence of the ICT programme and the European visions which framed it, and explores the discourses and practices through which it came to materialise. The research is theoretically infomred by Foucault's ideas on governmentality, focusing on the government and self-government of conduct. The study explores the discourses sustained through the European and Greek policies on the information society. Practices of funding, monitoring and reporting are also scrutinised to understand the forms of discipline and contestation they gave rise to. Through this theoretical analysis, the research engages in a context-sensitive examination of the taken-for-granted relationship between policies and their implementation. The main contribution of the thesis lies in illuminating the often neglected role of international and regional organisations in shaping technological agendas, and the material practices which allow them to operate effectively across distances.

<p>The European Union Member States has a common environmental policy. The intention of the environmental policy and the WEEE and RoHS directives are to preserve, protect and improve the quality of the environment, protect human health and make use of natural resources. The WEEE is abbreviation for “Waste Electrical and Electronic Equipment”. The WEEE directive purpose is to improve the reuse, recycling and recovery in order to reduce the amount of disposal of equipment and the contents going to landfill. The RoHS directive is abbreviation for “Restriction of the use of certain Hazardous Substances in electrical and electronic equipment”. The six restricted substances are lead, cadmium, mercury, hexavalent chromium and two brominated flame-retardants; PPB and PBDE. The purpose of the RoHS directive is to approximate the laws of the European Member States on the restrictions of the use of hazardous substances in EEE, “Electrical and Electronic Equipment”. The common legislation is needed because the companies shall have the same terms of concerns.</p><p>The amount of EEE that the European Member States generate is growing rapidly and that is why a common waste management is needed. The content of hazardous components in EEE is a major concern during the waste management phase and recycling of WEEE. The landfills do not have the possibility to handle the upcoming volumes of waste and the rubbish incineration creates high levels of heavy-alloy metal in our surroundings. The WEEE and RoHS directives covers ten categories of EEE and the producer responsibility shall encourage the design and production of EEE, which take into full account and facilitate their repair, possible upgrading, disassembly, reuse and recycling.</p><p>The Commission has not drawn up distinct guidelines and boundaries for the EEE within some of the categories in the WEEE and RoHS directives. This makes it difficult for the producers of EEE to determine if their products are within the scope of the directives. The definition of “large-scale stationary industrial tools” is one of the most difficult definitions to interpret. This definition includes four points that the EEE shall comply with to be allowed as an exemption.</p><p>Atlas Copco and CP are two of the concerned companies that have products within the scope of the WEEE and RoHS directives. In the Atlas Copco group there are two divisions; Atlas Copco and CP. Atlas Copco and CP develop, manufacture and market industrial tools, compressed air equipment, construction and mining equipment and assembly systems. It is Atlas Copco and CP’s industrial tools and assembly systems, which are affected by the WEEE and RoHS directives. Due to this Atlas Copco and CP needs to decide which of their products that is within the scope of the directives. Some of their industrial tools and assembly systems are in the grey-area of the legislation. The purpose of this thesis is to interpret the WEEE and RoHS directives and review Atlas Copco and CP’s industrial tools and assembly systems. The author believes that the majority of Atlas Copco and CP’s industrial tools and assembly systems are not “large-scale stationary industrial tools” because they sells as single units which the customers combine as they wish, to get the accurate performance. The tools are furthermore handhold and driven by electricity through a cable or battery and the industrial tools and assembly systems are not permanently fixed. The author’s decision which industrial tools and assembly systems are within the scope of the directives differentiates from Atlas Copco and CP’s decision.</p>

The European policy focus on smart grids implies their development as an indispensable part of the future power system. However, the definition of a smart grid is broad and vague, and the actual implementation of a smart grid can differ significantly, depending on the stakeholders involved.This work aims to inform policy makers, the electricity industry and researchers about stakeholder interests and the technical complexities involved by presenting smart grids via a techno-institutional framework. This framework takes account of the technical nature of the electricity transport and supply service as well as the institutional nature of electricity markets, stakeholder perspectives and sector regulation. La coopération entre les autorités de régulation en matière de communications électroniques et d’énergie s’inscrit dans le contexte de mutation de l’administration européenne qui est intervenue au fil des deux dernières décennies. Son architecture institutionnelle est marquée par la forte européanisation des autorités de régulation,laquelle est le résultat de l’harmonisation opérée par le droit de l’Union européenne et de la diffusion de meilleures pratiques. La coopération entre les autorités de régulation se fonde néanmoins sur des principes juridiques flous en droit primaire. Elle est de plus marquée par l’ambigüité de la délégation des pouvoirs à l’échelle de l’Union européenne. Dans les deux secteurs étudiés, elle traduit l’hybridation des modèles de gouvernance que sont les « agences de l’Union européenne » et les « réseaux d’autorités », car elle a donné naissance à une « agence en réseau » puissante dans le domaine de l’énergie - l’ACRE- et à un « réseau agenciarisé » faible en matière de communications électroniques– l’ORECE.Pour assurer l’effectivité de l’ « Union de droit », les actes de ces organismes de l’Unioneuropéenne sont contrôlés par le juge de l’Union européenne, dont la saisine par lesparticuliers reste malheureusement difficile. Dans ce contexte, le Médiateur européen présente un potentiel fort en tant qu’instance de contrôle complémentaire. Quant au prétendu déficit démocratique souligné par les détracteurs de l’Union européenne, il est ici démenti car le Parlement européen assure un contrôle démocratique efficace sur les organismes étudiés. Si ses moyens de contrôle politique sont largement informels et méritent d’être approfondis, le contrôle qu’il exerce dans le cadre de la procédure de décharge budgétaire peut, quant à lui, déboucher sur une transformation de l’architecture institutionnelle des organismes étudiés<br>The cooperation among regulatory authorities in the field of electronic communications and energy takes place against the background of the transformation of the european administration in the last two decades. Its institutional design bears the mark of the europeanisation of regulators through the harmonisation brought about by EU law and the diffusion of best practices. The cooperation among regulatory authorities is formalised on the basis of a primary law that is vague. It is also marked by ambiguity with regard to the delegation of pouvoirs on a European level. In the sectors of energy and electronic communications, it reflects the « hybrisation » of two models of governance, European agencies and networks, giving birth to a powerful « network agency » in the field of energy-the ACER- and a weak « agenciarised network » in the field of electronic communications- the BEREC. The control of the acts of these two organisms in a « Union of law » is ensured by the Cour of justice of the European Union which is, however, difficult to accessfor individuals. In this context, the European Ombudsman demonstrates a real potential as a complementary forum of control. Against a priori hypotheses with respect to the democratic deficit of the European Union, the European Parliament effectively ensures the democratic control of ACER and BEREC. Even if its means of political control are largelyinformal and should be better defined, the control it exercices in the context of the budgetary discharge procedure is capable of transforming the institutional design of the above mentioned organisms

Mestrado em Contabilidade, Fiscalidade e Finanças Empresariais<br>Esta investigação procura explorar a associação entre a Gestão de Resultados e a Gestão de Impressões. O estudo foi conduzido no contexto das empresas cotadas da União Europeia, entre 2012 e 2018, sobre uma amostra de 2.953 empresas. A prática de Gestão de Resultados foi medida através dos accruals discricionários, estimados pelo modelo de Jones (1991) modificado por Dechow et al. (1995) e Kothari et al. (2005), e a prática de Gestão de Impressões através da complexidade dos relatórios anuais foi medida pelo respetivo tamanho do ficheiro eletrónico. Os resultados mostram uma associação positiva e significativa entre a intensidade dos accruals discricionários e o tamanho do ficheiro eletrónico do relatório anual, ou seja, argumenta-se que os preparadores da informação procuram ofuscar as escolhas contabilísticas discricionárias tornando os relatórios anuais mais complexos. Mostra-se, ainda, que a prática de ofuscação é significativa quando praticada pelas Pequenas e Médias Empresas, embora as Grandes Empresas também apresentem tendência para tornar os seus relatórios anuais mais complexos à medida que gerem os resultados com maior intensidade.<br>This research attempts to explore the relationship between Earnings Management and Impression Management. The study was conducted in the context of European Union listed companies, between 2012 and 2018, using a sample of 2.953 firms. Earnings Management is measured by discretionary accruals estimated using the Jones model (1991) modified by Dechow et al. (1995) and Kothari et al. (2005), and Impression Management is measured by annual report electronic file size as proxy for annual report readability. The results show a positive and significant relationship between the level of discretionary accruals and the annual report electronic file size meaning that information preparers attempt to obfuscate their own discretionary accounting choices making annual report readability more complex. Yet, this study shows that the obfuscation practice is significant when carried out by Small and Medium Enterprises, although Big Enterprises also tend to make their annual report readability more complex as the level of earnings management gets higher.<br>info:eu-repo/semantics/publishedVersion

The object of study of this research is the right to Personal Data Protection within the framework of the EU-US E-Market legal regime. Its characteristics, as well as the features of the main actors participating into that E-Market, make possible to consider it as a proper basis for the development of an International/Universal legal system treaty-based. The Actors and Relations included by the research are the duty bearers of Personal Data Protection law, both State and Private Entity Activities. Nonetheless, the Informal Power Relation between State and Private organization is also taken into account since there are some informal agreements or coordination between State Agencies and IT Corporations on data sharing and processing. The time frame of the research is 2001-2016 (after the terrorist’s attack in USA on 9/11 until the most recent reform of the EU-US E-Market regime in 2016). The research’s point of departure is International Human Rights Law, as far as it recognizes a general framework to support and regulate personal data protection on cyberspace realm. Nonetheless, the distinctive characters of cyberspace demand a well designed, at universal level, specific regulation and mechanisms to guarantee such fundamental rights relating personal data protection internationally. Accordingly, Research Hypothesis is represented in double issues: first, effective personal data protection on cyberspace needs the establishment of an International/Universal legal system treaty-based; second, EU Regime on personal data protection in cyberspace and current EU-US agreements on this issue can be used as a model for initiating such International/Universal Treaty. The structure of the thesis is divided into six chapters, being Chapter 1 the research design and Chapter 6 the conclusions and recommendations coming from the research. So, Chapter 2 analyzes Universal Legal Instruments, EU Laws and EU-US Agreements in force before 5th June 2013 (critical turning point date because of the revelations of Mass Electronic Surveillance presented then on World Wide Web). Within this legal framework, Chapter 3 studies hard cases about personal data protection in US domestic courts and in the Court of Justice of European Union, in order to search for precise interpretation of the right to personal data protection in cyberspace that, later, had to be taken into account by US and EU in their further legal reforms. Chapter 4 analyses and reviews the legal instruments enacted through the reform of the EU personal data protection regime and the new EU-US Bilateral Agreements currently in force. Finally, Chapter 5 evaluates the possibility to initiate an International Treaty for regulating data using across borders. Considering the initiatives of either international governmental organizations or non-governmental movements in the field, the chapter shows how a set of principles can be extracted from the reforms in the EU and EU-US regime and how they can be used to create an International Regime for protection of personal data in cyberspace.<br>L'objecte d'estudi d'aquesta recerca és el dret a la protecció de les dades personals en el marc del règim jurídic aplicable al mercat electrònic UE-Estats Units. Les seves característiques, així com les dels principals actors que intervenen en aquest mercat, permeten considerar aquest règim jurídic com una base adequada per al possible desenvolupament d'un tractat internacional de vocació universal sobre protecció de dades personals en el ciberespai. Els actors i les relacions incloses en la recerca són els responsables de les obligacions jurídiques en matèria de protecció de dades personals, tant entitats públiques com a privades. Malgrat això, també es tenen en compte les ‘relacions informals de poder’ entre Estat i organitzacions privades, donada l'existència d'acords informals o coordinació entre tots dos per a l'intercanvi i processament de dades. El marc temporal de la recerca és 2001-2016 (després dels atemptats del 9/11 a Estats Units i fins a la més recent reforma del règim UE-EUA culminada en 2016). El punt de partida d’aquesta recerca és el Dret Internacional dels Drets Humans, que conté el marc general per al suport i regulació de la protecció de dades personals en el ciberespai. Ara bé, els caràcters distintius del ciberespai exigeixen una regulació i mecanismes específics ben dissenyats, a nivell universal, per garantir internacionalment els esmentats drets fonamentals relatius a la protecció de dades personals. Conseqüentment, la hipòtesi de recerca es formula de la següent manera: en primer lloc, la protecció eficaç de les dades personals en el ciberespai necessita l'establiment d'un sistema jurídic internacional d'abast universal basat en tractats; en segon lloc, el règim de la UE sobre protecció de dades personals en el ciberespai i els actuals acords UE- Estats Units sobre aquesta qüestió poden utilitzar-se com a model per a l'elaboració d'aquest Tractat Internacional. L'estructura de la tesi es divideix en sis capítols, essent el Capítol 1 el disseny de la recerca i el Capítol 6 les conclusions i recomanacions que es desprenen de la recerca. Així, el Capítol 2 analitza els Instruments Jurídics Universals, les normes de la UE i els acords UE-EUA vigents abans 5 de juny de 2013 (data crítica a causa de les revelacions sobre Vigilància Electrònica en massa, presentades mundialment aquest dia). Dins d'aquest marc jurídic, el Capítol 3 realitza una anàlisi jurisprudencial i analitza una selecció de casos sobre protecció de dades personals suscitades davant els tribunals interns d'Estats Units i davant el Tribunal de Justícia de la Unió Europea, amb l'objectiu d'identificar la interpretació precisa del dret a la protecció de dades personals en el ciberespai que, posteriorment, ha hagut de tenir en compte la reforma normativa a Estats Units i en la UE sobre aquesta matèria. El Capítol 4 analitza i revisa els instruments jurídics promulgats en virtut de la reforma del règim de protecció de dades personals de la UE i els nous acords bilaterals entre la UE i els Estats Units actualment en vigor. Finalment, el Capítol 5 avalua la possibilitat d'elaborar un Tractat Internacional d'abast universal que garanteixi el dret a la protecció de dades personals que ‘circulen’ pel ciberespai. Tenint en compte les iniciatives formulades per organitzacions governamentals internacionals i pels moviments no governamentals especialitzats, el capítol mostra com es poden extreure un conjunt de principis de les reformes de la UE i del règim aplicable a l'espai UE-EUA i com aquests principis poden utilitzar-se per a la creació d'un règim internacional de protecció de dades personals en el ciberespai.<br>El objeto de estudio de esta investigación es el derecho a la protección de los datos personales en el marco del régimen jurídico aplicable al mercado electrónico UE- Estados Unidos. Sus características, así como las de los principales actores que intervienen en este mercado, permiten considerar este régimen jurídico como una base adecuada para el posible desarrollo de un tratado internacional de vocación universal sobre protección de datos personales en el ciberespacio. Los actores y las relaciones incluidas en la investigación son los responsables de las obligaciones jurídicas en materia de protección de datos personales, tanto entidades públicas como privadas. No obstante, también se tienen en cuenta las ‘relaciones informales de poder’ entre Estado y organizaciones privadas, dada la existencia de acuerdos informales o coordinación entre ambos para el intercambio y procesamiento de datos. El marco temporal de la investigación es 2001-2016 (después de los atentados del 9/11 en Estados Unidos y hasta la más reciente reforma del régimen UE-EEUU culminada en 2016). El punto de partida de la investigación es el Derecho Internacional de los Derechos Humanos, que contiene el marco general para el apoyo y regulación de la protección de datos personales en el ciberespacio. Sin embargo, los caracteres distintivos del ciberespacio exigen una regulación y mecanismos específicos bien diseñados, a nivel universal, para garantizar internacionalmente tales derechos fundamentales relativos a la protección de datos personales. Consecuentemente, la hipótesis de investigación se formula del siguiente modo: en primer lugar, la protección eficaz de los datos personales en el ciberespacio necesita el establecimiento de un sistema jurídico internacional de alcance universal basado en tratados; en segundo lugar, el régimen de la UE sobre protección de datos personales en el ciberespacio y los actuales acuerdos UE-Estados Unidos sobre esta cuestión pueden utilizarse como modelo para la elaboración de dicho Tratado Internacional. La estructura de la tesis se divide en seis capítulos, siendo el Capítulo 1 el \diseño de la investigación y el Capítulo 6 las conclusiones y recomendaciones que se desprenden de la investigación. Así, el Capítulo 2 analiza los Instrumentos Jurídicos Universales, las normas de la UE y los acuerdos UE-EEUU vigentes antes del 5 de junio de 2013 (fecha crítica debido a las revelaciones sobre Vigilancia Electrónica en Masa presentadas mundialmente ese día). Dentro de ese marco jurídico, el Capítulo 3 realiza un análisis jurisprudencial y analiza una selección de casos sobre protección de datos personales suscitados ante los tribunales internos de Estados Unidos y ante el Tribunal de Justicia de la Unión Europea, con el objetivo de identificar la interpretación precisa del derecho a la protección de datos personales en el ciberespacio que, posteriormente, ha debido tener en cuenta la reforma normativa en Estados Unidos y en la UE sobre esta materia. El Capítulo 4 analiza y revisa los instrumentos jurídicos promulgados en virtud de la reforma del régimen de protección de datos personales de la UE y los nuevos acuerdos bilaterales entre la UE y los Estados Unidos actualmente en vigor. Por último, el Capítulo 5 evalúa la posibilidad de elaborar un Tratado Internacional de alcance universal que garantice el derecho a la protección de datos personales que ‘circulan’ en el ciberespacio. La metodologia es basa en una revisió bibliogràfica i hemerogràfica completada amb un conjunt d'entrevistes amb representants de diferents organismes de regulació del Regne Unit i Espanya, i de la mateixa Comissió Europea. En la primera part de la tesi es realitza una aproximació conceptual, des d'una vessant tècnica i jurídica, a la xarxa radioelèctrica i al dividend digital, espai alliberat una vegada completada la transició a la TDT. Seguidament, s'aborda la naturalesa, àmbits de regulació de la xarxa radioelèctrica, actors, models i evolució de les formes de gestió. El tercer capítol es centra en la Unió Europea com actor de la política de l'espectre radioelèctric des de mitjans de la dècada dels 80 fins a l'actualitat. En la última parte de la tesis se describen y analizan las actuaciones de la UE destinadas a armonizar el dividendo digital y se atiende especialmente a las consecuencias que esta armonización tiene sobre las estructuras nacionales y la planificación de la TDT en los dos países estudiados, el Reino Unido y España.<br>The object of study of this thesis focuses on the European radio spectrum policy in particular the harmonization of the digital dividend in the United Kingdom and Spain. The methodology is based on a multidisciplinary bibliographic review completed with an in-depth interviews with policy-makers from the national regulatory authorities and the European Commission. The first chapter of the dissertation consists of a conceptual approach of radio spectrum network and the digital dividend, the amount space released once the switch-over is completed. Afterwards, it deals with the nature of spectrum regulation, its actors, models and evolution of spectrum management. Its third chapter focuses on the European Union as a spectrum policy actor from the 80's onwards. Finally, this thesis analyses the EU actions oriented to the harmonisation of the digital dividend, and pays special attention to its consequences on national structures and DTT plans of the United Kingdom and Spain.

La digitalización de la información ha permitido comunicarse de un modo prácticamente instantáneo independientemente de la distancia. Este hecho, junto con el hundimiento de los sistemas económicos comunistas, ha sido el caldo de cultivo para el fenómeno conocido como globalización. La mezcla de ambos factores, que ha supuesto una eliminación física de las distancias geográficas y temporales, ha cambiado radicalmente el modo de comprender las relaciones personales y económicas en todos los niveles y ángulos comprensibles. Este cambio de paradigma también ha incidido, inevitablemente, sobre los sistemas fiscales. Los legisladores han tenido que modificar las normas clásicas de lucha contra el fraude y la evasión para hacer frente a los retos que plantea la nueva realidad digital en este ámbito. Así pues, esta tesis doctoral pretende abordar la evolución de los modelos de intercambio de información con fines tributarios y su encaje respecto a los derechos y garantías de los contribuyentes que pueden verse afectados en los procedimientos de intercambio de información.<br>The digitalization of information allowed the communication in a practically instantaneous way, regardless of distance. This fact, together with the collapse of the communist economic systems, has been the breeding ground of for the phenomenon known as Globalization. The mix of both factors, that supposed the erasure of geographical and temporary distances, has radically changed the way of understanding personal and economic relations in all comprehensible levels and angles. This change of paradigm has inevitably underscored the tax systems as well. Legislators have had to modify the classical norms to counteract tax fraud and evasion, in order to face the challenges posed by the new digital reality in this playing field. Therefore, this PhD Thesis expects to tackle the evolutions of the models to exchange information for tax purposes and how they fit regarding the rights and guarantees of the taxpayers that might be affected on the exchange of information procedures.<br>La digitalització de la informació ha permès comunicar-se d’una manera pràcticament instantània independentment de la distància. Aquest fet, juntament amb l’esfondrament dels sistemes econòmics comunistes, ha estat el caldo de cultiu per el fenomen conegut com a globalització. La barreja d’ambdós factors, que ha suposat una eliminació física de les distàncies geogràfiques i temporals, ha canviat radicalment el mode de comprendre les relacions personals i econòmiques en tots els nivells i angles comprensibles. Aquest canvi de paradigma també ha incidit, inevitablement, sobre els sistemes fiscals. Els legisladors han hagut de modificar les normes clàssiques de lluita contra el frau i l’evasió per fer front als reptes que planteja la nova realitat digital en aquest àmbit. Així, doncs, aquesta tesis doctoral pretén abordar l’evolució dels models d’intercanvi d’informació amb finalitats tributàries i el seu encaix respecte dels drets i garanties els contribuents que es poden veure afectats en els procediments d’intercanvi d’informació.

Every day the Federal government blatantly siphons data with programs from the original ECHELON to the new series like PRISM and Xkeyscore so they can keep their tabs on issues that are none of their business; namely, the personal lives of millions. Our allies are taking note; some are learning our bad habits, from Government Communications Headquarters’ (GCHQ) mass shadowing sharing plan to America’s Russian inspiration, SORM. Some countries are following the United States’ poster child pose of a Brave New World like order of global events. Others like Germany are showing their resolve in their disdain for the rise of tyranny. Soon, these new found surveillance troubles will test the resolve of the American Constitution and its nation’s strong love and tradition of liberty. Courts are currently at work to resolve how current concepts of liberty and privacy apply to the current conditions facing the privacy of society. La tesis se encarga de analizar, por un lado, la integración y el desarrollo de las nuevas tecnologías en la Administración de Justicia; y, por otro, los parámetros que constituyen la validez y eficacia del documento electrónico. <br/>La primera cuestión se centra en la configuración de los Sistemas de Información de la Oficina Judicial y del Ministerio Fiscal, así como de la informatización de los Registros Civiles, donde el art. 230 LOPJ es la pieza clave. Se estudian sus programas, aplicaciones, la videoconferencia, los ficheros judiciales y las redes de telecomunicaciones que poseen la cobertura de la firma electrónica reconocida, donde cobran gran relevancia los convenios de colaboración tecnológica. La digitalización de las vistas quizá sea una de las cuestiones con más trascendencia, teniendo en cuenta que el juicio es el acto que culmina el proceso. Aunque no todos los proyectos adoptados en el ámbito de la e.justicia se han desarrollado de forma integral, ni han llegado a la totalidad de los órganos judiciales. Their programmes, applications, the Video Conferencing, the judicial registers and the telecommunication networks which are covered by the recognised electronic signatures, are studied, where the agreements on technological collaboration gain great relevance. The digitalisation of evidence might perhaps be one of the questions with most consequence, bearing in mind that the judgment is the act by which the process is culminated. Although not all the projects adopted within the compass of e.justice have developed completely nor have reached all the judicial organs. The final objective is to achieve an agile, quality Justice, to which the recently approved Strategic Plan for the Modernisation of Justice aspires.<br/>With reference to the second perspective, there is no doubt that the juridical Ordinance and the tribunals within the compass of material justice grant full validity and efficacy to the electronic document. Our line of investigation is justified because there are more and more processes which are sustained by electronic supports of all kinds, whether it be at the establishment of the action or later, as a proof of it (art. 299.2 LEC). Amongst other things, we examine the computerised document, the problems which surround the fax, the systems for video recording and the electronic contract.

To achieve this objective we use multivariate statistical methods, more specifically factor and cluster analysis, to address the disparities in the digital development levels between EU countries. Our results lead to an identification of two latent dimensions and five groups of countries when it comes to the digital development. We conclude that a digital gap does, in fact, exist within the EU. Moreover our results suggest that there is a relation with the entrance year to the Union with the digital development stage, considering that newer member presents lower digital developments.

The EMC certification is a very important indicator of quality, it is not only related to the reliability of the product itself and the use of safety, but also may affect the normal operation of other equipment and systems related to the protection of the electromagnetic environment.   Taiwan's electronics industry in the EU EMC Directive under norms, how should develop partnerships with suppliers and customers, to maintain the competitiveness of Taiwanese manufacturers themselves. In order to meet requirements of miniaturization of products, electronic manfacturers begin to use certain of hazardous substances in electrical and electronic products. To limit the growth of e-waste and to protect human health, the European Union introduced a Directive on waste electrical and electronic equipment (WEEE) and a Diective on Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment (RoHS) in 2003. On a more tactical level, the European Union introduced a Diective on Ecodesign Requirements for Energy-using Products (EuP). The three environmental diectives establish the European Union e-waste management system. The European Union e-waste management system covers almost all areas of electrical and electronic products and has clear targets and implementation mesurses. As the three directives carry out, it will have a great effect on the global electronic and electrical industry. Taiwan is one of the large producers of electrical and electronic products in the world and exports 75% electronic products to the European Union each year. Therefore the electronic and electrical industry in Taiwan has to adapt the process of the manufacture and to integrate a variety of resources to face the challenge. The thesis starts with the global environmental issues. It firstly illustrates the major global environmental questions and then observes the development of the European Union e-waste management system. In the meantime, the thesis researches on the context of the three dirctives and assesses the effctiveness of the directives. Lastly, it focuses on how the directives affect the electronic industry in Taiwan. With data collection and analysis, I hope that people in the highly information society can have paid more attention to the E-waste management.

Digitisation had a profound impact on the creation, reproduction, and dissemination of works protected by copyright. Works in digital format are vulnerable to infringement, and technological protection measures are accordingly applied as protection. Technological protection measures can, however, easily be circumvented, and additional legal protection against circumvention was needed. Article 11 of the WIPO Copyright Treaty (the WCT) obliges Member States to provide adequate legal protection against the circumvention of technological measures applied to works protected by copyright. Contracting parties must refine the provisions of Article 11 and provide for exceptions on the prohibition. Article 11 does not specify whether it pertains to only certain types of technological measures, nor does it prohibit the trafficking in circumvention devices. The United States implemented the provisions of Article 11 of the WCT through the Digital Millennium Copyright Act of 1998 (the DMCA). Section 1201 of the DMCA prohibits the circumvention of technological measures. It is detailed and relates to two categories of technological measures - access control and copy control. It prohibits not only the act of circumvention, but also the trafficking in circumvention devices. Article 6 of the EC Directive on the Harmonisation of Certain Aspects of Copyright and Related Rights in the Information Society of 2001 implements Article 11 of the WCT. Article 6 seeks to protect Aeffective technological measures@. It prohibits both the act of circumvention and circumvention devices. Although Article 11 of the WCT is silent on the issue of access control, it seems as if the international trend is to provide legal protection to access controls, thus indirectly creating a right to control access. South Africa has not yet implemented Article 11 of the WCT. The South African Copyright Act of 1979 does not protect technological protection measures. The Electronic Communications and Transactions Act of 2002 (the ECT Act) provides protection against the circumvention of technological protection measures applied to digital data. The definition of Adata@ is such that it could include protected works. If applied to protected works, the anti-circumvention provisions of the ECT Act would be detrimental to user privileges. As developing country, it seems to be in South Africa's best interest to the implement the provisions of Article 11 in such a manner that it still allows users access to and legitimate use of works protected by copyright.<br>Jurisprudence<br>LL.D.

Abstract:
Information technology (IT) is one of the fastest growing product groups on the market today (Babu et al., 2006). This technology has become inexpensive to produce and continues to improve in the areas of memory, speed, operating systems, weight, and audio/visual capabilities (Envirosris, 2000). All of these factors have led to a decrease in product lifespan and an increase in the amount of IT-waste produced. IT-waste contains a number of hazardous materials. If this waste is not managed appropriately it can create serious environmental and human health problems. In Canada, there are no federal policies in place to manage IT-waste. Management of IT-waste has largely been the responsibility of local governments. Consequently, there is no uniformity. A wide spectrum of management approaches ranges from ‘do nothing’ to enacting bans to prohibit this waste from entering landfills. Recently (April 1, 2009), a program (Ontario Electronic Stewardship Waste Electronic and Electrical Equipment- OES WEEE) has been created at the provincial level to help with IT management. Residential participation in this program remains voluntary. This research is exploratory and aims at examining the potential for a sustainable integrated waste management (IWM) plan for residential IT-waste, using the Regional Municipality of Waterloo (RMoW) as a case study. A multiple methods approach was employed to gain an understanding of IT-waste issues and to develop a set of sustainable IWM criteria for evaluation of the OES program and RMoW. Methods used to collect data included: a literature review, surveys, plan analysis, direct observation, key informant interviews, and archival research. A number of recommendations apply specifically to Waterloo Region. Others more broadly address local governments across Ontario for better management of residential IT-waste and other e-waste products.

Technological advances have had a major impact on traditional retail shopping changing it from a physical undertaking to a completely digitised experience where consumers buy digital media online. VAT systems that do not specifically provide for, or which have not been adapted to cope with, technology-driven advances, generally do not provide for the adequate levying and collection of VAT on cross-border digital trade. The South African VAT system is no different. The taxation of e-commerce should not artificially advantage or disadvantage e-commerce over comparable traditional commerce, or unnecessarily hinder the development of e-commerce. This thesis determines whether the South African VAT Act 89 of 1991 in its current form, can be applied adequately to raise and collect VAT on cross-border digital transactions. Where shortcomings in the VAT Act are identified, the harmonised VAT rules of the European Union (EU), together with the Organisation for Economic Cooperation and Development (OECD) proposals on consumption taxes, are analysed and discussed to seek possible solutions and make recommendations.<br>Mercantile Law<br>LL.D.

A comunicação eletrónica tornou-se um meio prioritário, utilizado diariamente, muitas vezes sem a consciência de que os dados pessoais daí resultantes podem ser alvo de retenção. No contexto da UE, a proteção dos dados pessoais está devidamente consagrada, enquanto direito fundamental, mas vê-se ameaçada perante o sistema de vigilância que a União criou e regulou, essencialmente com fins de prevenção e repressão criminais. Levanta-se, assim, a questão de até que ponto poderemos estar perante uma violação do direito da UE. A complexidade e atualidade deste problema levou-nos a investigar, com base na jurisprudência do TJ, de que forma a União tem vindo a harmonizar estas duas realidades em constante confronto – a proteção dos direitos fundamentais dos cidadãos e a necessidade dos Estados de reter os seus dados de comunicação. Pretendemos, com esta investigação, clarificar os complicados contornos das vertentes em contraposição e explorar o debate em torno do caminho jurisprudencial que temos observado.<br>The fundamental rights to respect for privacy and protection of personal data, in an increasingly surrendered to electronic communication world, is a topic that has been the subject of daily dialogue and intense legal debate, both at internal and European level. Electronic communication has become a preferred medium, used daily, often without the awareness that the resulting personal data may be retained. In the context of the EU, the protection of personal data is properly enshrined as a fundamental right, but it is threatened by the surveillance system that the Union has set up and regulated, mainly for the purposes of criminal prevention and prosecution. Therefore, the question arises as to the extent to which we may be facing a violation of EU law. The complexity and presentness of this problem led us to investigate, based on the jurisprudence of the ECJ, how the EU has been harmonizing these two realities in constant confrontation – the protection of citizens’ fundamental rights and the need for States to retain their communication data. With this investigation, we intend to clarify the complicated traits of the opposing aspects and explore the debate around the jurisprudential path that we have been observing.

The thesis deals with the emergence of bank and non-bank entities that provide a range of unique transaction-based payment services broadly called Mobile Financial Services (MFS) to unbanked, underserved and underbanked persons via mobile phones. Models of MFS from Mobile Network Operators (MNOs), banks, combinations of MNOs and banks, and independent Mobile Financial Services Providers are covered. Provision by non-banks of ‘bank-type’ services via mobile phones has been termed ‘transformational banking’ versus the ‘additive banking’ services from banks. All involve the concept of ‘branchless banking’ whereby ‘cash-in/cash out’ services are provided through ‘agents.’ Funds for MFS payments may available through a Stored Value Product (SVP), particularly through a Stored Value Account SVP variant offered by MNOs where value is stored as a redeemable fiat- or mobile ‘airtime’-based Store of Value. The competitive, legal, technical and regulatory nature of non-bank versus bank MFS models is discussed, in particular the impact of banking, payments, money laundering, telecommunications, e-commerce and consumer protection laws. Whether funding mechanisms for SVPs may amount to deposit-taking such that entities could be engaged in the ‘business of banking’ is discussed. The continued use of ‘deposit’ as the traditional trigger for the ‘business of banking’ is investigated, alongside whether transaction and paymentcentric MFS rises to the ‘business of banking.’ An extensive evaluation of ‘money’ based on the Orthodox and Claim School economic theories is undertaken in relation to SVPs used in MFS, their legal associations and import, and whether they may be deemed ‘money’ in law. Consumer protection for MFS and payments generally through current statute, contract, and payment law and common law condictiones are found to be wanting. Possible regulatory arbitrage in relation to MFS in South African law is discussed. The legal and regulatory regimes in the European Union, Kenya and the United States of America are compared with South Africa. The need for a coordinated payments-specific law that has consumer protections, enables proportional risk-based licensing of new non-bank providers of MFS, and allows for a regulator for retail payments is recommended.
