Les articles 318 et 319 du Code criminel sont destinés à protéger les groupes identifiables de personnes contre la propagande haineuse. Toutefois, l’article 318 (4) limite cette protection aux seuls groupes identifiables par la couleur, la race, la religion, l’origine ethnique et l’orientation sexuelle. Le sexe est exclu des motifs de différenciation énumérés dans ce paragraphe. Après un bref examen de l’historique législatif de ces dispositions, de même que de l’évolution récente du droit canadien et international, l’auteur note que l’exclusion du sexe comme motif de différenciation est pour le moment dépassée. Il en vient alors à la conclusion que l’article 318 (4) du Code criminel mériterait d’être extensivement reformulé en vue d’accorder une protection efficace aux victimes des discours haineux basés sur le sexe.

Abstract:
The application of criminalism in investigating obscene crimes against speech impaired victims by the PPA Unit of the Satreskrim Polres Agam is a science to help strategies in making light of cases. Criminal science is used to obtain information from victims as crown witnesses or victim witnesses, which is rather difficult to do. This is because the daily conditions of the victim cannot hear (deaf), do not speak (mute), so they cannot communicate properly like normal people, and never go to school. In this regard, investigators use criminalistic science with forensic psychology aids, forensic medicine aids and body language or sign science for the deaf. In forensic medicine, it is used by doing visum et repertum as evidence of violence against the reproductive organs. Forensic Psychology is used to examine the victim's psyche and his honesty about what he is going through. During the investigation into the investigation, the victim was also accompanied by a teacher from the Lubuk Basung Special Elementary School (SDLB). Victims are also examined using props or pictures to make it easier for victims to remember what happened to them, because the victim's memory as a person with a mute disability has limitations.

PurposeVictim resistance has been shown to have an important impact on the outcome of sexual assaults. Thus, the factors that affect a victim’s likelihood of various levels of resistance are relevant to consider, given the possibly detrimental effect these actions can have on crime outcome. While not intended to blame the victim in any way, it is important to examine the role the victim plays within a sexually coercive interchange in order to completely understand the sex crime event and, thus, be able to inform potential victims as to the patterns that increase resistance and, potentially, overall violence. The paper aims to discuss this issue.Design/methodology/approachSequential logistic regression analyses were conducted on a sample of 613 sex offenses (incorporating both adult and child victims) to examine the individual and combined effects of offender lifestyle, disinhibitors, victim vulnerability, situational impediments and offender modus operandi on victim resistance levels.FindingsResults suggest that indicators of offender mindset are significant, particularly the use of pornography prior to the crime, and affect victim interpretation and response to the offender’s actions during the course of the assault. Other relevant factors include the victim’s age and the degree of violence present in the offender’s approach and subsequent offending strategies.Originality/valueThis information would be helpful to incorporate into victim education programs so that past and future potential victims can better understand the criminal event and the causes and effects of their own actions within that event.

Résumé Dans cet article, les auteures font une analyse de l'Examen de la légitime défense (ELD) mené par la juge Ratushny relativement aux dossiers de femmes condamnées pour homicide tant avant qu'après Lavallée. Il sera découpé en deux parties. La première sera consacrée à faire un bilan de la situation de l'homicide conjugal et un portrait des femmes coupables d'homicide au Canada de même qu'à exposer brièvement la décision charnière en matière de légitime défense, l'arrêt Lavallée, sans lequel l'ELD n'aurait jamais eu lieu. Cette première partie sera suivie d'une analyse descriptive de l'ELD. Une attention particulière sera accordée aux résultats de l'examen effectué par la juge Ratushny dans une perspective socio-juridique. L'arrêt Lavallée a remis en question l'approche juridique en matière de légitime défense, approche qui dans le passé ne reconnaissait pas la réalité des femmes homicidaires, dont certaines avaient fait l'objet d'abus et de violence antérieures. Dans cet arrêt, la Cour reconnaît la pertinence d'une preuve d'expert sur le syndrome de la femme battue. C'est ce contexte juridique nouveau qui a amené la Société Elizabeth Fry à entreprendre des démarches auprès des autorités et à faire des pressions afin d'obtenir la révision des dossiers des femmes justiciables condamnées pour homicide et qui n'auraient pas bénéficié du contexte plus favorable découlant de l'arrêt Lavallée. Tel était le contexte à l'origine du mandat confié à la juge Ratushny. En octobre 1995, suite à la décision Lavallée (1990) et aux pressions exercées par la Société Elizabeth Fry du Canada afin que l'on réexamine les dossiers de femmes ayant commis un homicide, l'examen des cas des femmes condamnées au Canada pour homicide dans un contexte de violence (L'examen de la légitime défense, ELD) est enclenché. Dans le cadre de son mandat, la juge devait examiner les dispositions législatives concernant la légitime défense, faire des recommandations sur les possibilités de réforme et sur les recours possibles des requérantes. À partir d'une liste fournie par le Service correctionnel du Canada, deux cent trente-six (236) femmes ont été contactées et quatre-vingt-dix-huit (98) femmes ont fait une demande de révision. L'analyse des cas s'est d'abord faite à partir des dossiers des tribunaux et des services correctionnels (transcriptions de procès, histoire sociale de la femme, renseignements sur son passé de victimisation dans certains cas). Des entrevues ont aussi eu lieu avec les femmes rencontrant les critères de révision tels qu'élaborés par la juge Ratushny, avec les avocats de la défense et les procureurs de la couronne. Des archives d'institutions ont aussi été consultées et les personnes suggérées par les requérantes ont été contactées. Il se dégage de l'ELD deux types de recommandations, les premières susceptibles d'avoir un impact direct sur la situation des justiciables ayant soumis leur cas à la juge Ratushny, les secondes susceptibles de modifier à l'avenir la donne en matière de légitime défense si le gouvernement devait donner suite à ses propositions de réforme. L'examen de 98 dossiers n'a amené que sept recommandations. Un nombre aussi restreint de recommandations a-t-il de quoi surprendre? Il est manifeste que l'ELD a suscité des attentes démesurées. Devant un si maigre résultat, devrait-on conclure qu'il fut inutile? L'examen des propositions de réforme contenues dans l'ELD s'impose avant de tenter de répondre à cette question. La juge Ratushny a aussi fait porter ses commentaires et recommandations de réforme non seulement sur la définition de la légi- time défense mais aussi sur les règles de droit et les pratiques de poursuite en matière de meurtre. Malgré les limites de l'ELD et les critiques dont il peut faire l'objet, nous considérons que l'exercice n'aura pas été vain puisqu'il aura permis de corriger certaines injustices dont des femmes étaient victimes. Ce qui est plus troublant cependant, c'est de constater qu'en dépit des changements juridiques amorcés par l'arrêt Lavallée, l'ELD fait ressortir des problèmes systémiques qui persistent encore aujourd'hui. Ne serait-ce que pour avoir soulevé ce problème d'ordre systémique, l'ELD devrait retenir l'attention. La richesse des informations contenues dans les 98 dossiers examinés dans le cadre de l'ELD mériterait également que l'on s'y attarde dans une perspective de recherche universitaire socio-juridique plus large sur le maricide, en le comparant aux autres formes d'homicide commis par des femmes.

In this paper I shall try to do two things: first, for those who do not have a detailed knowledge of criminal procedure in England, I shall give a bird's-eye view of what the victim's legal position is today. Secondly, I shall examine the difficulties, theoretical and practical, which make it hard to give the victim the deal which many of those who claim to speak for victims believe they ought to have.In the last twenty years the victim, for long the “forgotten man” in the criminal justice system, has been rediscovered. Politicians of all parties have learnt that victims, and those who identify with them, have votes, and therefore need to be placated. Up to now, however, this has mainly been done by words rather than deeds.An example is the document rather grandly entitled “The Victim's Charter”, which the Government issued in 1990 (with a revised version in 1996). Contrary to what the title “Charter” might lead one to suppose, this document confers no rights or privileges, but merely lists the ways in which the various parts of the machinery of criminal justice ‘ought’ to be sensitive to the position of the victim.

Since the 1980s, victims’ voices have been increasingly heard and have been influential in policy debates. Since that time, the nature and presence of those voices has changed shape and form from the influence and presence of victim centred organizations to the rise of the high profile individual victim. The purpose of this article is to explore the presence of one victim’s story, Rosie Batty, and to examine her influence on the rise of the policy agenda on family violence in Australia. This article considers the ways in which this story gained traction and influenced the reform of family violence policy in Australia, and considers the extent to which an understanding of this process contributes to an (emergent) narrative victimology.

Abstract Elder neglect is common and can have catastrophic consequences. Cases may benefit from integrated responses from multiple sectors. Little research exists describing prosecutorial involvement and its impact, but existing evidence suggests neglect is seldom criminally prosecuted. Our goal was to closely examine neglect prosecution in a jurisdiction that has been a leader in using prosecution to attempt to address it. We quantitatively and qualitatively analyzed legal case files of felony elder neglect prosecuted in King County, Washington from 2008-2011. 13 cases were prosecuted, with a total of 10 victims. 90% of victims were female, with a median age of 88. 90% were unable to ambulate, and 90% had dementia. Defendants were commonly the victim’s adult child (38%). 23% had previous criminal citations/convictions. 46% of cases occurred in an Adult Family Home. 15% of cases went to trial, and all trial cases ended in conviction of some charge. Themes identified included: (1) perpetrators were either professional caregivers receiving compensation or non-professional caregivers financially dependent on the victim, (2) victims were malnourished and severely injured at time of reporting, and (3) medical expert contribution is imperative given complexity of these cases. Victims were unable to participate in prosecution in any case. This research shows that these cases are seldom prosecuted, even in a jurisdiction focusing on this phenomenon, but highlights characteristics of cases and demonstrates they may be prosecuted without victim participation. Future research is needed to examine prosecution’s impact on elder neglect to better understand how it may be optimally used.

Ce mémoire porte sur l'intimidation subie (IS) et ses effets associés sur l'adaptation psychosociale et scolaire d'élèves d'écoles primaires défavorisées. Trois objectifs sont étudiés, soit a) déterminer si FIS prédit une augmentation des problèmes de comportement intériorisés et extériorisés et une diminution de l'adaptation scolaire, b) déterminer si l'appartenance à un groupe de victimes (V ou V-A) a un effet modérateur sur ces liens et c) déterminer si la PAPS a un effet modérateur sur ces liens. L'échantillon (T1 : printemps 2009 T2 : printemps 2010) est composé de 444 élèves québécois âgés entre 6 et 9 ans d'écoles défavorisées (IMSE, 2007-2008). Les résultats révèlent que a) l'IS prédit une augmentation des problèmes intériorisés et extériorisés au T2, b) l'appartenance au groupe de victimes n'intervient pas comme variable modératrice et c) l'IS prédit une augmentation des problèmes intériorisés seulement chez les élèves qui ne participent pas à des activités parascolaires.

Researchers have found that youths react in a variety of ways when faced with a bullying incident in their schools (Kochenderfer-Ladd, 2004). Despite being aware of the negative consequences of being victimized and holding generally negative attitudes towards bullying, youths tend to show reluctance to seek help from an adult or to intervene in defense of their victimized peer (Hawkins, Pepler, & Craig, 2001; Newman, Murray, & Lussier, 2001). Given the importance of the aforementioned behaviours in reducing bullying in schools, two studies were designed to examine the determinants of victim help seeking and bystander intervening behaviours in young people using Ajzen’s Theory of Planned Behaviour (TPB: Ajzen, 1991). In Study 1, I examined the full TPB model using short-term longitudinal data collected from a sample of 609 secondary school students. To further examine the utility of the TPB model and to determine the impact of school climate on the model, in Study 2 I examined cross-sectional data collected from 113 middle school students. In Study 1, multiple regression analyses and path analyses indicated that the TPB model significantly predicted student’s intentions to intervene on behalf a bullied peer and their actual self-reported intervention behaviour. The results for help seeking intentions and behaviours were mixed, with the TPB variables significantly predicting victim help seeking intentions but not self-reported behaviour. In Study 2, the TPB model significantly predicted both help seeking and intervention intentions. Additionally, the TPB variables of attitude, subjective norms, and perceived behavioural control significantly mediated the relationship between school climate and victim help seeking and bystander intervention intentions. The results are discussed in terms of their implications for methodology, theory, and policy.

The role of medical social worker in the case of sexual assault is to bridge and communicate within doctors and victims during the forensic medical exam. There are two main tasks for being a medical social worker, internally, it must be familiar with the procedures of forensic medical exam in a hospital. Externally, it is the media between different units, however, such an important role has been often neglected. Therefore, the study focuses on the experiences of medical companion, especially upon those medical social workers who have been experienced the forensic medical exam in the case of sexual assault. From the aspect of medical social worker, the methodological method will base on constructivism, inviting and having a semi-structured interview with six medical social workers who are mainly responsible for emergency room at a hospital recently. According to the grounded theory, a co-analyst has also been invited to encode and analyze data information. From the result of study, it has been divided into four subjects: the genre and attitude of sexual victim, the procedure of forensic medical exam, the responsibility and value of medical social worker while accompanying with sexual victims, as well as the potential dilemma and consideration of being a medical social worker. On the basis of result and current literature, there are four main aspects during the discussion: the redefinition of victim genre, the review in the procedure of forensic medical exam as well as the professional value and ethics of medical social worker, accompanying with results and advices of research.

O abuso sexual infantil constitui-se com um problema de saúde pública global, transversal a diferentes idades, culturas, sociedades e estratos socioeconómicos, responsável por múltiplas e nefastas consequências para a vítima, a curto e longo prazo.Este estudo objetiva caracterizar o perfil da vítima e do agressor, a agressão sexual e a perícia médico-legal realizada, com a finalidade de contribuir para uma melhor compreensão do fenómeno e qualidade das práticas profissionais de diagnóstico e intervenção.Trata-se de um estudo de carácter descritivo e retrospetivo, baseado na análise de relatórios de exames médico-legais de alegados casos de abuso sexual de menores, realizados nas instalações do Gabinete Médico Legal e Forense do Cávado, entre 2007 e 2016.Incluídos 189 relatórios forenses. Os resultados demonstram uma inequívoca prevalência de abuso sexual no sexo feminino (85.2%) e uma média de idade das vítimas de 9.97 anos. Os agressores são adultos jovens, entre os 18 e os 30 anos de idade (18%), maioritariamente do sexo masculino (92.6%) e com relações de proximidade à vítima (89.9%). Aproximadamente 43% das agressões sexuais envolvem penetração e a maioria sucede em casa da vítima e/ou agressor (59.8%). As perícias médico-legais são realizadas com um atraso superior a 72 horas (67.2%), não encontram quaisquer lesões em cerca de 42% das situações e a maioria resulta na conclusão “possível mas não demonstrável” (75.7%).Em conclusão, enfatiza-se a importância do preenchimento completo e rigoroso dos relatórios forenses, essenciais para promover um diagnóstico, acompanhamento e proteção da vítima eficazes. Os nossos resultados poderão ancorar práticas integradas de prevenção primária deste fenómeno, com vista à redução da sua prevalência e impacto.
Child sexual abuse is a global healthcare problem, universal to every age group, culture, society and socioeconomic stratum, responsible for multiple, both short and long term, nefarious consequences to the victim.This study aims to characterize the victim and perpetrator’s profiles, the sexual assault and the forensic examination performed, in an attempt to contribute to a better comprehension of this phenomenon and quality of professional diagnostic and interventive practices.It is presented as a descriptive and retrospective study, based on the analysis of forensic reports of alleged cases of minor sexual assault performed at the Cávado department of National Institute of Forensic Medicine, between 2007 and 2016. One hundred eighty nine reports were included. The results show an unmistakable prevalence of sexual abuse in females (85.2%) and an average victim age of 9.97 years old. The perpetrators are young adults, between the ages of 18 and 30 years old (18%), mostly men (92.6%) and of close relation to the victim (89.9%). Approximately 43% of sexual assaults involve penetration and the majority takes place at the victim and/or perpetrator’s home (59.8%). Forensic examinations are performed with a delay of over 72 hours (67.2%), 42% of them do not reveal any lesions and mostly result in the conclusion “possible but not demonstrable” (75.7%).In closing, we emphasize the importance of a full and rigorous filling of forensic reports, essential in promoting effective diagnosis, management and protection for the victim. Our results could anchor integrated practices of primary prevention for this phenomenon, with the goal to reduce its prevalence and impact.

The book enriches our understanding of international human rights by using intersectionality theory, the concept that aspects of identity, such as race and gender, are mutually constitutive and intersect to create unique experiences of discrimination and subordination, to examine contemporary human rights issues. Perpetrators of sexual violence in armed conflict, for example, often target victims based on both gender and ethnicity. Human rights remedies that fail to capture the intersectional nature of human rights violations do not offer comprehensive redress to victims. The book explores the influence of intersectionality theory on human rights in the modern era and traces the evolution of intersectionality as a theoretical framework in the United States and around the world. The book draws upon critical race feminism and human rights jurisprudence to argue that scholars and activists have under-utilized intersectionality theory in the global discourse of human rights. As the central intergovernmental organization charged with the protection of human rights, the United Nations has been slow to embrace the insights gained from intersectionality theory. Global Intersectionality argues that the United Nations and other human rights organizations must more actively embrace intersectionality as an analytical framework in order to fully address the complexity of human rights violations around the world.

Mechanism, patient presentation, and physical exam are key elements to accurate and prompt diagnosis of thoracic injury. A high proportion of poly-trauma victims suffer thoracic injury which is associated with mortality of with 25-50%. Initial management is guided by ATLS principles of Airway, Breathing, and Circulation. The FAST (focused assessment with sonography for trauma) exam plays a key role in the initial evaluation of thoracic trauma. Most injuries to the thoracic cavity may be managed non-operatively or with bedside procedures with the caveat that patients with thoracic injury require close attention and monitoring in the ICU for potential deterioration. A high index of suspicion is paramount to successful patient care. When operative intervention is required it is often emergent.

AbstractSentenza 238/2014 can be criticized insofar as it seems to ground Italy’s refusal to comply with the Jurisdictional Immunities Judgment of the International Court of Justice on the basis of the right of access to a judge for the victims of the conduct of German armed forces during World War II. Indeed, the principle of state’s immunity to the civil jurisdiction of other states regarding the conduct of their own armed forces does not in itself breach a victim’s right of access to a judge, which theoretically in this case might also be granted by a German court. However, Sentenza 238/2014 has the merit of highlighting, in the specific case of the Italian Military Internees (IMIs), the violation of the victims’ right to an effective judicial protection of their fundamental rights, given that German jurisdictions excluded every reparation that favoured IMIs. Such fundamental rights must prevail over the international rules relating to state immunity because, according to the supreme principles of the Italian constitutional order and to international law itself, fundamental human rights violations related to crimes against humanity must benefit from an effective protection. The impasse between Italy and Germany should be solved through a new joint initiative between the two governments (carried out ideally under a common understanding of the two Presidents of the Republic), which should examine the applicants’ cases in order to grant them reparation. Though symbolic, such reparation will have an important moral dimension.

For centuries, rape and other forms of sexual violence have always been an integral aspect of warfare. Even so, it is rather recently that these practices have been recognized as crimes and prosecutions undertaken by international criminal tribunals. Whilst the ad hoc international tribunals for the former Yugoslavia and Rwanda did not take an integrative approach to victims in the criminal justice process, the Rome Statute of the International Criminal Court (ICC) took a victim-centred approach by setting out some provisions allowing victims to actively participate in proceedings beyond their traditional role of witnesses. This chapter sets out to critically examine the effectiveness of the ICC victims' rights framework in achieving this objective in sexual violence cases. Drawing on the complex nature of experiences of victims of such crimes, this chapter engages with the various aspects of the relatively recent approach of victims' participation in international criminal justice process to highlight prospects and challenges in facilitating the healing process of victims of such crimes.

Lynndie England’s conviction, and highly publicised dishonourable discharge from the United States military, for crimes that included photographically documented acts of sexual violence against male detainees in her care, finally succeeded in bringing female sexual offending against male victims to the fore, and served as a watershed moment that forever changed the discourse. Except it didn’t. This event did not disrupt orthodox discourse. It did not breach the gendered binary that casts men as offenders and women as victims. A decade later, it can instead be argued to have bolstered it – being pivotal in maintaining ‘discursive equilibrium’ in preservation of those gendered, normative, binaristic, subject positions that serve to cast men outside of legitimate victimhood; particularly men assaulted by women. This Foucauldian analysis of knowledge production in the academy will examine this stasis, and articulate the discursive mechanisms underlying it - arguing that the ideal victim binary, in the area of sexual violence, constitutes a gender-normative taxonomy that functions as a governmentalised ‘regime of truth’. Ironically, this influence is most stymieing amongst those best placed to resist it.This chapter complexifies Christie’s (1986) concept of the ideal victim through the lens of Foucauldian theory, presenting a clarion call to victimology.

Bad leadership and aggressive behavior in the workplace have been a recurring problem for most companies in the United States. With the rise in hostile work environment litigation, management has to address the problem of workplace bullying of employees. The purpose of this chapter is to examine the problem of workplace bullying and bad leadership behavioral traits on the victims and victims' actions to deal with bullying behavior. The researchers conducted a nationwide study with 327 participants that have experienced workplace bullying and bad leadership. The researchers used a first-generation, researcher-developed survey instrument to conduct this study. The results of the study show there is strong causal influence of workplace place bullying traits and victim behavior such as employee resignations and HR complaints. Management should carefully evaluate the effects of workplace bullying and bad leadership on its workforce.

This chapter studies the right to examine witnesses, which is fundamental to an effective defence. Allowing a prosecution witness to submit uncontested testimony, or depriving a defendant of the opportunity to call a witness who can provide exculpatory evidence, can lead to a serious miscarriage of justice. The right also protects the interests of victims, witnesses, and the broader public, because the questioning of witnesses can help to establish the truth and ensure the integrity of the judicial process. Under international human rights law, the right includes two components: the defendant’s right to examine witnesses testifying against them, and the right to call witnesses in their defence. But neither component of the right is absolute. This chapter addresses guidance from international bodies on acceptable limitations to the right, including areas of divergence relating to the use of anonymous witness testimony. It also highlights the challenge of obtaining remedies for such violations from international bodies given their deference to national courts on matters of evidence.

It discusses the adoption of the Palermo Protocol and explore the patterns of human trafficking dynamics across the region from Europe to Eurasia. Internal and external human trafficking constraints and different gendered and racialized approaches to trafficking policy that make ethnic minorities in the region more vulnerable to human trafficking are also discussed. Victim stereotypes perpetuated in the trafficking policies of Eurasia, have produced their own regional type of ideal victim ‘Natashas’ but increasingly men and children from this region are victims of labor exploitation suggesting that there are factors at play within these countries that encourage human trafficking.

Restorative justice serves to facilitate juvenile offenders in taking responsibility for their actions via dialogue with victim, victim's family, and community. In the PK12 setting, this model uses classroom circles to set academic goals, explore curriculum, develop core values, fairness communities, and peer juries to talk with students about causes and identify positive issues to repair the harm done. Kohlberg's theory informs the use and implementation of restorative justice with its six stages of moral development. This chapter will examine Kohlberg's theory coupled with restorative justice at the PK12 level. The application of these philosophies may lead to early development of positive decision making, value of self, good communication skills, and ethical problem solving. By establishing these psychological/sociological foundations in early childhood, children may be able to secure friendly relationships and orient more easily towards fixed rules.

Background: Depression is common among adolescents that have been victims of bullying at school or through social media. However, numerous cases of bullying are never reported. Several studies have shown that suicidal ideation is associated with depression in adolescents with bullying. The purpose of this study was to examine the effect of bullying on depression in adolescents in Surakarta using Health Belief Model. Subjects and Method: A cross sectional study was carried out in Surakarta, Central Java, in December 2019. A sample of 250 adolescents was selected for this study randomly. The dependent variable was depression. The independent variables were bullying, perceived susceptibility, perceived severity, and self-efficacy. The data were collected by questionnaire and analyzed by a multiple logistic regression. Results: Depression increased with bullying (OR= 3.5; 95% CI= 1.70 to 7.25; p= 0.001), strong perceived susceptibility (OR= 2.86; 95% CI= 1.32 to 6.19; p= 0.008), strong perceived severity (OR= 2.65; 95% CI= 1.20 to 5.88; p= 0.016), and weak self-efficacy (OR= 5.26; 95% CI= 2.49 to 11.09; p<0.001). Conclusion: Depression increases with bullying, strong perceived susceptibility, strong perceived severity, and weak self-efficacy. It is important to examine the behavior of forest fires and city fires to mitigate the property damages and victims by fires. There have been many previous studies on forest fires where the fire spreading patterns were investigated, utilizing artificial satellite pictures of forest fires, together with the use of corresponding weather data and GIS data. On the other hand, large area city fires are very scarce in the world, particularly in modern cities where high-rise concrete buildings are constructed with sufficient open spaces. Thus, the examples of city fires to be referred are few and detailed investigations of city fires are limited. However, there have still been existing old cities where traditional houses built with flammable material such as wood, maybe historically important, only separated with very small open spacing. Fires may freely spread in those cities, once a big earthquake happens there and then water supply for the fire brigade is damaged in the worst case along with the effect of strong wind. There are some fundamental differences between the forest fires and city fires, as the fuel may distribute either continuously or discretely. For instance, in forest fires, the dead fallen leaves, dry grasses and trees are distributed continuously on the ground, while the wooden houses in cities are discretely distributed with some separation of open spacing, such as roads and gardens. Therefore, the wooden houses neighboring the burning houses with some separation are heated by radiation and flames to elevate the temperatures, thus causing the ignition, and finally reaching a large city fire. The authors have studied the forest fire spread and are planning to start a laboratory experiment of city fire spreading. In the preliminary investigation, a numerical study is made to correlate with the laboratory experiment of city fire propagation, utilizing the three-dimensional CFD simulations. Based on the detailed experimental analysis, the authors are attempting to modify the three dimensional CFD code to predict the forest fires and city fires more precisely, taking into account the thermal heating and ignition processes. In this study, some fundamental information on the city fire propagation has been obtained, particularly to know the safe open spacing distances between the houses in the cities and also the wind speed.

Poisoning from household substances has been and continues to be a hazard to children under 5 years of age. In an effort to address this problem, the Poison Prevention Packaging Act (PPPA) of 1970 was enacted as of December 30, 1970. This act is a federally preemptive piece of legislation covering an ever expanding group of substances. The test methods used to establish compliance with the PPPA do not address the range of substances covered (e.g. liquids); the changing patterns of use of household substances such as increased use of liquid medications for children; or repeated access to and multiple reclosures of containers, as seen in the home situation. To examine the effectiveness of the PPPA in addressing actual poisonings in children under 5, national databases from 1980 through March 13, 2002 were examined. Reports mentioning the use of a CRC (child resistant container) were then analyzed. Assisted Access incidents involved an older child gaining access to the contents of a CRC and giving those contents to the younger victim. Transfer of Contents incidents involved ingestion of a substance that was originally packaged in a CRC and was transferred to a non-CRC The average age of children seen in hospitals is under 2, and fatalities due to Assisted Access and Transfer of Contents incidents were seen in children averaging under one year of age. These age ranges are below those of children used in CRC testing (3.5 to 4.25 years). More importantly, the average body weights — directly related to the susceptibility to poisoning injury — of children seen in hospitals is less than the 25 pound weight used to set toxicity thresholds by the PPPA. Training for children, the elderly, and parents would help increase awareness of Transfer of Contents and Assisted Access poisonings, which are disproportionately represented in fatal poisoning incidents of young children.
