Among the puzzling aspects of the Breard episode was the Clinton administration’s claim that the decision whether or not to comply with the Order of the International Court of Justice requiring the postponement of Breard’s execution lay exclusively in the hands of the Governor of Virginia. The ICJ’s Order provided that “[t]he United States should take all measures at its disposal to ensure that Angel Francisco Breard is not executed pending the final decision in these proceedings.” The Clinton administration argued that the Order was not binding, but it also took the position that, even if the order were binding, there would be no authority in the federal Government to require a postponement of the execution. Alienation of a Movable Asset Encumbered with Tax Lien Summary The article deals with selected problems referring to executive proceedings in administration in case of alienation of a movable asset encumbered with tax lien. A tax lien is a lien imposed in order to secure public imposts on movables assets or property rights. According to the author, legal proceedings are acceptable in order to conclude whether a purchaser of a movable asset encumbered with a tax lien should abolish enforcement of administrative decision. The basis for execution is not an executory entitlement in the analyzed administrative case, but an appropriate provision of statutory law, which is the article 848 of Civil Procedure Rules, used by way of analogy.

Abstract:
The subject of the article is an analysis of the realisation of the right to access to administrative records in public administration authorities. This right is the most important manifestation of the right of access to the records, which a party to administrative proceedings is entitled to. The right to access the administrative records is limited by the fact that the party has access to incomplete, unstructured, unnumbered records or unavailable records without issuing a refusal of access to the records, as well as access to the records in places not adapted for that purpose. The right of access is also limited by the following restrictions which do not exist in the Code of Administrative Procedure but are applied by the authorities: the hours of visitors and the queuing system. A party should be able to review his or her personal records during the office’s working hours in a room adapted for that purpose. I propose that the party should be able to access the records in the body’s information and communication system at on-line remote.

Abstract:
The article examines administrative coercion in enforcement proceedings as a legal phenomenon. The author considers it, firstly, as one of the types of state coercion, and secondly, as a kind of administrative coercion, and comes to the conclusion that enforcement proceedings are inseparable from administrative coercion by their nature. Both elements that make up the general concept under study are generated by the state, are necessary for the exercise of state power, the achievement of a publicly significant goal. This goal is determined by the actual enforcement proceedings as a necessary specific type of activity aimed at completing the cycle of jurisdictional proceedings: in cases of administrative offenses, civil, arbitration, administrative proceedings, and others, to solve its tasks. In enforcement proceedings, only its combination with administrative coercion can achieve the goal of public authority, to achieve the real execution of the act of a jurisdictional body, an official. In addition, administrative coercion is a method of public administration, an effective tool with which enforcement proceedings are carried out. The article also presents the author’s classification of types of administrative coercion in enforcement proceedings, and raises the problem of improving the legislation on it.

<p class="Akapitzlist1">The amendment to the Act on Road Traffic Law introduced a new legal institution related to failure to register a vehicle consisting of an administrative fine in the amount of PLN 200 to 1,000. The penalty is imposed by means of an administrative decision issued by a competent starost. With the introduction of the above-mentioned institution in legal circulation, new problems will arise in connection with conducting administrative proceedings to impose a penalty, as well as determining its amount. In addition, a starost, as a creditor, is obliged to initiate enforcement proceedings in the absence of voluntary execution of the decision imposing the penalty. The established body aims to ensure the implementation of Directive 2000/53/EC of the European Parliament and of the Council of 18 September 2000 on end-of-life vehicles, concerning, i.a., the absence of sanctions for not registering an imported vehicle and not registering an end-of-life vehicle. The following article discusses the main problems related to the application of the institution introduced with regard to the administrative procedure, the nature of the penalty imposed, as well as its enforcement. The considerations were carried out on the basis of a dogmatic method.</p>

This Note recommends federal policy reform and local implementation in order to decrease the immigration backlog and protect the rights of non-citizens in immigration proceedings. Although non-citizens hold many of the fundamental rights and freedoms enumerated in the Constitution, several core rights— including due process and the right to counsel—are not rigorously upheld in the context of immigration proceeding. By carefully regulating expanded access to representation and ending unnecessary immigration detention, the Executive Office of Immigration Review and Congress will ensure the swift administration of justice and protect non-citizens under the federal government’s jurisdiction.

Abstract:
This article concerns enforcement proceedings in administration conducted from the debtor’s bank account. The article discusses the content of the applicable legal norms, the jurisprudence and the practice of applying the provisions. The article shows current solutions and points to emerging problems. There is emphasized that unauthorized executions, although not a common practice, may lead to a number of problems among citizens, negatively affecting their situation in many respects. The article also presents proposals for regulating a number of aspects. This is to improve the situation of people against whom enforcement is carried out, in particular when (regardless of the reasons) it is unjustified. A number of practical solutions are also proposed here, which, combined with appropriate legal norms, can lead to a significant improvement in the situation of debtors.

The subject. The article considers the legal basis for the execution of decisions on administrative penalties in the form of disqualification from driving, as well as the prospects for the development of new legislation in the field of road traffic. The article examines the social relations that develop in the process of implementing the jurisdictional powers of the Russian State Traffic Inspectorate in ensuring road safety, preventing and suppressing offenses related to encroachment on motor vehicles, transported goods, the life and health of drivers and pedestrians.The purpose of the article is to confirm or disprove hypothesis that there are defects in Russian legislative regulation that prevent the effective execution of decisions on the disqualification from driving. They are not eliminated in the draft of the new Russian Code of Administrative Offences.The methodology of research is the provisions of the general theory of law, the modern science of administrative law and the theory of public administration. The authors used a systematic approach and formal legal analysis. The legislation of the Russian Federation and the practice of its enforcement were studied also.The main results. In accordance with paragraph 5 of Article 2 of the Russian Federal Law "On the Police", the execution of administrative penalties is one of the main activities of the police. The effectiveness of the entire proceedings in cases of administrative offenses largely depends on the execution of the adopted resolutions. The leading role in the execution of decisions on administrative penalties, in particular, related to the disqualification from driving, belongs to the internal affairs bodies. It is important to note that the execution of administrative penalties in practice is associated with certain difficulties.Conclusions. The execution of decisions on the imposition of disqualification from driving as an administrative penalty causes difficulties due to defects in legislative regulation, which are not fully resolved in the draft of the new Russian Code of Administrative Offences.

Business Administration/Interdisciplinary<br>D.B.A.<br>The following research builds on the existing project management success and critical success factor research by focusing on the social mechanisms used by project managers and project teams to achieve success. Through analysis of previous literature five criteria for success are determined and the critical success factor themes of personnel and communication emerge. Study One uses semi-structured interviews with ten current or former construction project managers to develop a conceptual model of six antecedents to the previously identified critical success factor themes. The unit of measure is the project and not the project manager which allowed for ten interviews to provide insights into twenty projects, the ten most successful and the ten least successful of the interviewees careers. Those interviews provided six constructs or antecedents that lead to effective communication and project personnel. The personnel constructs are; planning, choosing, and retaining. The communication constructs are frequency, understanding, and inclusivity. Study Two uses semi-structured interviews with twenty current or former construction project managers to determine the causal social mechanisms that lead from the antecedents to the critical success factor themes. Through recording, transcribing, coding, and analyzing the interviewee’s responses project managers and project teams use similar mechanisms to achieve the critical success factor themes. This capstone examines how a newly formed senior-level team worked together to complete a complex task, while driving towards a larger goal of becoming a learning organization. For the 2014-2015 academic year, central office leaders in the San Francisco Unified School District (SFUSD) worked to develop a new approach to the execution of their strategic plan, “Impact Learning. Impact Lives.” In a continued attempt to decrease SFUSD’s persistent achievement gap and to increase academic performance of all students, district leaders renewed their commitment to deeper levels of implementation for the strategic plan. During a series of senior-level team meetings in the spring of 2014, central office leaders realized that a number of district departments were inadvertently working at cross-purposes or duplicating efforts. Likely reinforced, in part, by previous and current SFUSD organizational systems and structures, district departments had become accustomed to working in silos, which, in turn, required limited system-level interdependence. Given the SFUSD senior leadership’s desire to shift their organizational culture to one of learning together, this capstone explores the district’s transition from silo driven work to cross-departmental teaming. The research section of this capstone outlines the principles of effective strategy execution and teaming. The analysis section describes the impact of the district’s organizational culture on the application of these principles. The implications section identifies important components - communication plans, cycles of inquiry, teacher and leader voice that are needed to ensure effective strategy execution in large, urban school systems. This capstone concludes with an acknowledgement of the challenges associated with organizational change and calls for continuous reexamination of strategy execution guided by research and reflection.

Background: As the world is moving from an industrial to a digital one an increasingly important factor for companies has become their digital transformation. This, Industry 4.0, has brought forward a new set of challenges but conventional strategy-making has not been able to keep up with them, whilst considering that change, in practice, is difficult to implement. The strategy execution for digital transformation has therefore become increasingly important but the challenges faced has not been researched to a sufficient degree. Research question: What are the main challenges with strategy execution during a digital transformation process and how can they be managed? Purpose: The purpose of this thesis is to find and describe the main challenges with strategy execution for digital transformation that has been experienced and or perceived by practitioners working in companies that are a part of a concern. These findings will be conceptualised out of which guiding principles will be created and presented.    Method: In this study a qualitative method has been used together with an abductive approach to reasoning. Semi-structured interviews have been performed with eight respondents chosen by a strategic selection for their knowledge about the studied field. Theoretical frame of reference: Theories about strategy execution, change-management, what a digital transformation is, and how it evolves as well as the activity-based process model have been put forward. Within digital transformation some earlier seen challenges that has been a basis for this research are discussed. Conclusions: An overall conclusion that can be drawn from the analysis is that the primary areas that have been looked at, i.e. strategy development; strategy execution and digital transformation, in themselves create challenges. Whether they are correlated with each other or would exist no matter the other factors cannot be discerned from the findings of this thesis, resulting in the fact that the results of the analysis while able to give a foundation and interpretive thoughts, are, in their nature, uncertain. This would mean that albeit an answer to the research question can be presented by the conceptualisation and guiding principles they should not be seen as general for any given population but rather as a description and analysis of the studied population.

Inspiré par une croyance fondée sur l’inégalité des parties, le droit del’exécution poursuit le dessein d’un recouvrement rapide, sûr et peu coûteux descréances. Afin de relever ce défi, le droit OHADA a fait de la sécurité juridique uneexigence fondamentale devant démontrer son aptitude à répondre aux attentes desdifférentes parties. Cependant, la pratique du recouvrement permet d’identifier dessources d’insécurité juridique préjudiciable au climat de confiance voulu par lelégilateur communautaire. Ainsi, le caractère quasi-informel du recouvrementamiable, la résistance des juridictions nationales ou l’ineffectivité de certainesdécisions judiciaires perturbent la prévisibilité inhérente à l’exigence de sécuritéjuridique. Conçu comme un système cohérent, le droit de l’exécution OHADA offredes ressources interprétatives propices à la correction des lacunes observées. Dansces conditions, le juge occupe un rôle central dans la promotion de la sécuritéjuridique. D’une part, il assure le contrôle des prérogatives individuelles des partiesdans le sens de réguler les conflits d’intérêts induits par des attentes souventcontradictoires. Dans cette optique, l’une des finalités de l’intervention du juge estd’assurer le respect du recours à la contrainte dans l’exécution. D’autre part,l’exigence de sécurité juridique servira au juge à établir une meilleure corrélationentre toutes les techniques garantissant le paiement du créancier dans un souciconstant d’efficacité. Tomeet this challenge, the OHADA law made legal certainty requirement which mustshow its ability to live up to the expectations of the different parties. However, therecovery practice identifies sources of legal uncertainty detrimental to the climate oftrust advocated by the Community legislature. Thus, the quasi-informal nature of debtcollection, the resistance of national courts or the ineffectiveness of certain judicialdecisions disrupt the predictability pertaining to the requirement of legal certainty.Designed as a coherent system, The OHADA enforcement law affords interpretativeresources conducive to the rectification of the flaws spotted. In these circumstances,the judge plays a central role in promoting legal certainty. On the one hand, hemonitors the individual prerogatives of the parties in the direction of regulatingconflicts of interest arising from the often conflicting expectations. In this context, oneof the purposes of the intervention of the judge is to ensure compliance of coercion inthe execution. On the other hand, the demand of legal certainty will allow the judge toestablish a better correlation between all techniques guaranteeing the payment of thecreditor for the constant sake of efficacy. In the absence of an explicit consecration oflegal certainty, the proposal for a reinterpretation of the theory of enforcement lawprovides the opportunity to see all the mechanisms of its integration in debt recovery,taking into account the legal and economic substance of the claim

Multinational corporate leaders acknowledge that a lack of business direction by senior leadership results in a 68% failure in the execution of organizational strategies. The purpose of this qualitative study was to explore what best practice solutions automotive manufacturing senior leaders created to help front-line managers execute organizational strategies. The population consisted of 20 automotive manufacturing senior leaders located in Michigan with significant years of automotive experience and at least a year of experience employed as an automotive manufacturing senior leader. Vroom's expectancy theory served as the conceptual framework for the study describing the enhancement of employee performance related to their skills, knowledge, abilities, and workplace expectations. Data were collected through semistructured interviews using open-ended questions. Methodological triangulation and a modified van Kaam data analysis approach were used with field notes and interview data to guide the coding process, theoretical saturation, and trustworthiness of interpretations. Five themes emerged that senior leaders identified important for creating best practice solutions: benchmarking, training, communication strategies, organizational change, and integrity. These findings may influence positive social change by offering management strategies, objectives, and actions that help to promote the development of employees and collaboration between individuals, government institutions, local businesses, and communities.

For over 30 years, organizations have engaged in programs to address the growing presence of diverse populations in their ranks, and researchers have attempted to identify and quantify a link between diversity and enterprise performance. The problem was a lack of understanding of how organizations benefit from increased diversity and the role of frontline managers in that process. The purpose of this phenomenological study was to address the research question aimed at the perceptions and lived experiences of frontline managers and to gain insights about how they are navigating the challenges of increased diversity to enhance their ability to produce high-performance outcomes. The three conceptual frames used were (a) diversity management, (b) managing people, and (c) team performance. The data collection process involved interviewing 12 frontline managers from a variety of industry sectors using a semistructured, conversational interviewing protocol. The open hand-coded analysis revealed patterns of thought and behaviors relating to managing individuals, managing the complexity of diversity, and managing diverse teams for high performance. The original concept of diversity management was in response to the growing diversity in the workplace and was intended to develop the capacity among managers to manage the resulting diversity mix. The study findings indicated that a common definition of diversity management is possible, that managing diversity requires a competence with all dimensions of diversity, and that there are a set of management skills that can yield better performance with teams of diverse composition. The results of my study can have positive impact on theory, practice, and general social acceptance of diversity.

The issue is addressed by approaching the principles and fundamentals of contract procedure, flowing into its applicability in the executive order, especially in the amount execution. The limits of the contract procedures authorized by article 190 of the Civil Procedure Code are concatenated against procedural publicism and privatism, as well as presented in the bias of a corporative model of process from its insertion in the procedural panorama in the light of formalism-value. It is suggested the correct interpretation of the requirements established in the infraconstitucional scope with a view to the validity in the formation of contract procedure. Transposing the fundamental rights to freedom, legal certainty and effectiveness of the process, negotiation on procedural matters is justified and inserted in the environment of executive process. The impact of formation and application of contract procedure on executive expropriatory measures and on procedural rules is analyzed. It is defended the validity of atypical contract procedure that may imply justified restrictions to the fundamental rights of the parties in the executive process, such as the limitation to the double degree of jurisdiction and the renunciation of unenforceability, based on the correct application of proportionality.<br>O presente trabalho prop?e-se a aprofundar o tema dos neg?cios jur?dicos processuais na perspectiva dos direitos fundamentais das partes. Enfrenta-se a referida tem?tica, abordando a principiologia e os fundamentos da negocia??o processual a desaguar na sua aplicabilidade na tutela executiva, em especial na execu??o de quantia. Os limites dos neg?cios processuais autorizados pelo art. 190 do C?digo de Processo Civil s?o concatenados frente ao publicismo e privatismo processual, bem como apresentados no vi?s de um modelo cooperativo de processo a partir de sua inser??o no panorama processual ? luz do formalismo-valorativo. Companies that execute a strategy change are facing major challenges. Business strategy studies have shown that companies do not achieve their full potential and that there are a number of difficulties in strategy execution. Purpose: The purpose of the essay is to test the model of strategy execution that Kaplan and Norton have created and how it’s followed in an active strategy change. The essay will provide insight into the pitfalls and obstacles of the strategy implementation. Method: The study that has been conducted is a case study of a qualitative nature. The empirical material has been collected by means of semi-structured interviews. Conclusion: Visma Spcs is in the middle of the Vision 2020 process, a strategy change started in 2016. During these years, they have been working hard to formulate, implement, communicate, and get employees to understand Vision 2020 in order for the entire organization to work towards the common goals. The study highlights a number of problems Visma Spcs has with the strategy change, some are part of communication and knowledge about the strategy others are how to work with the process. Kaplan and Norton have created a process in six steps for strategy implementation, a process that, according to the purpose of the paper, is tested in this study. There have been identified some similarities with Visma Spcs strategy implementation and the theory, but also a number of deviations.
