Business Administration/Interdisciplinary<br>D.B.A.<br>The following research builds on the existing project management success and critical success factor research by focusing on the social mechanisms used by project managers and project teams to achieve success. Through analysis of previous literature five criteria for success are determined and the critical success factor themes of personnel and communication emerge. Study One uses semi-structured interviews with ten current or former construction project managers to develop a conceptual model of six antecedents to the previously identified critical success factor themes. The unit of measure is the project and not the project manager which allowed for ten interviews to provide insights into twenty projects, the ten most successful and the ten least successful of the interviewees careers. Those interviews provided six constructs or antecedents that lead to effective communication and project personnel. The personnel constructs are; planning, choosing, and retaining. The communication constructs are frequency, understanding, and inclusivity. Study Two uses semi-structured interviews with twenty current or former construction project managers to determine the causal social mechanisms that lead from the antecedents to the critical success factor themes. Through recording, transcribing, coding, and analyzing the interviewee’s responses project managers and project teams use similar mechanisms to achieve the critical success factor themes. Knowing those mechanisms will benefit practicing project managers.<br>Temple University--Theses

Abstract:
This capstone examines how a newly formed senior-level team worked together to complete a complex task, while driving towards a larger goal of becoming a learning organization. For the 2014-2015 academic year, central office leaders in the San Francisco Unified School District (SFUSD) worked to develop a new approach to the execution of their strategic plan, “Impact Learning. Impact Lives.” In a continued attempt to decrease SFUSD’s persistent achievement gap and to increase academic performance of all students, district leaders renewed their commitment to deeper levels of implementation for the strategic plan. During a series of senior-level team meetings in the spring of 2014, central office leaders realized that a number of district departments were inadvertently working at cross-purposes or duplicating efforts. Likely reinforced, in part, by previous and current SFUSD organizational systems and structures, district departments had become accustomed to working in silos, which, in turn, required limited system-level interdependence. Given the SFUSD senior leadership’s desire to shift their organizational culture to one of learning together, this capstone explores the district’s transition from silo driven work to cross-departmental teaming. The research section of this capstone outlines the principles of effective strategy execution and teaming. The analysis section describes the impact of the district’s organizational culture on the application of these principles. The implications section identifies important components - communication plans, cycles of inquiry, teacher and leader voice that are needed to ensure effective strategy execution in large, urban school systems. This capstone concludes with an acknowledgement of the challenges associated with organizational change and calls for continuous reexamination of strategy execution guided by research and reflection.

Abstract:
Background: As the world is moving from an industrial to a digital one an increasingly important factor for companies has become their digital transformation. This, Industry 4.0, has brought forward a new set of challenges but conventional strategy-making has not been able to keep up with them, whilst considering that change, in practice, is difficult to implement. The strategy execution for digital transformation has therefore become increasingly important but the challenges faced has not been researched to a sufficient degree. Research question: What are the main challenges with strategy execution during a digital transformation process and how can they be managed? Purpose: The purpose of this thesis is to find and describe the main challenges with strategy execution for digital transformation that has been experienced and or perceived by practitioners working in companies that are a part of a concern. These findings will be conceptualised out of which guiding principles will be created and presented.    Method: In this study a qualitative method has been used together with an abductive approach to reasoning. Semi-structured interviews have been performed with eight respondents chosen by a strategic selection for their knowledge about the studied field. Theoretical frame of reference: Theories about strategy execution, change-management, what a digital transformation is, and how it evolves as well as the activity-based process model have been put forward. Within digital transformation some earlier seen challenges that has been a basis for this research are discussed. Conclusions: An overall conclusion that can be drawn from the analysis is that the primary areas that have been looked at, i.e. strategy development; strategy execution and digital transformation, in themselves create challenges. Whether they are correlated with each other or would exist no matter the other factors cannot be discerned from the findings of this thesis, resulting in the fact that the results of the analysis while able to give a foundation and interpretive thoughts, are, in their nature, uncertain. This would mean that albeit an answer to the research question can be presented by the conceptualisation and guiding principles they should not be seen as general for any given population but rather as a description and analysis of the studied population.

Inspiré par une croyance fondée sur l’inégalité des parties, le droit del’exécution poursuit le dessein d’un recouvrement rapide, sûr et peu coûteux descréances. Afin de relever ce défi, le droit OHADA a fait de la sécurité juridique uneexigence fondamentale devant démontrer son aptitude à répondre aux attentes desdifférentes parties. Cependant, la pratique du recouvrement permet d’identifier dessources d’insécurité juridique préjudiciable au climat de confiance voulu par lelégilateur communautaire. Ainsi, le caractère quasi-informel du recouvrementamiable, la résistance des juridictions nationales ou l’ineffectivité de certainesdécisions judiciaires perturbent la prévisibilité inhérente à l’exigence de sécuritéjuridique. Conçu comme un système cohérent, le droit de l’exécution OHADA offredes ressources interprétatives propices à la correction des lacunes observées. Dansces conditions, le juge occupe un rôle central dans la promotion de la sécuritéjuridique. D’une part, il assure le contrôle des prérogatives individuelles des partiesdans le sens de réguler les conflits d’intérêts induits par des attentes souventcontradictoires. Dans cette optique, l’une des finalités de l’intervention du juge estd’assurer le respect du recours à la contrainte dans l’exécution. D’autre part,l’exigence de sécurité juridique servira au juge à établir une meilleure corrélationentre toutes les techniques garantissant le paiement du créancier dans un souciconstant d’efficacité. En l’absence d’une consécration explicite de la sécuritéjuridique, la proposition d’une relecture de la théorie de l’exécution en droit privé offrel’opportunité de voir tous les mécanismes de son intégration dans le recouvrementdes créances en tenant compte de la réalité juridico-économique de la créance<br>Inspired by the belief grounded on inequalities between parties, theenforcement law continues to design a fast, safe and inexpensive debt recovery. Tomeet this challenge, the OHADA law made legal certainty requirement which mustshow its ability to live up to the expectations of the different parties. However, therecovery practice identifies sources of legal uncertainty detrimental to the climate oftrust advocated by the Community legislature. Thus, the quasi-informal nature of debtcollection, the resistance of national courts or the ineffectiveness of certain judicialdecisions disrupt the predictability pertaining to the requirement of legal certainty.Designed as a coherent system, The OHADA enforcement law affords interpretativeresources conducive to the rectification of the flaws spotted. In these circumstances,the judge plays a central role in promoting legal certainty. On the one hand, hemonitors the individual prerogatives of the parties in the direction of regulatingconflicts of interest arising from the often conflicting expectations. In this context, oneof the purposes of the intervention of the judge is to ensure compliance of coercion inthe execution. On the other hand, the demand of legal certainty will allow the judge toestablish a better correlation between all techniques guaranteeing the payment of thecreditor for the constant sake of efficacy. In the absence of an explicit consecration oflegal certainty, the proposal for a reinterpretation of the theory of enforcement lawprovides the opportunity to see all the mechanisms of its integration in debt recovery,taking into account the legal and economic substance of the claim

Abstract:
Multinational corporate leaders acknowledge that a lack of business direction by senior leadership results in a 68% failure in the execution of organizational strategies. The purpose of this qualitative study was to explore what best practice solutions automotive manufacturing senior leaders created to help front-line managers execute organizational strategies. The population consisted of 20 automotive manufacturing senior leaders located in Michigan with significant years of automotive experience and at least a year of experience employed as an automotive manufacturing senior leader. Vroom's expectancy theory served as the conceptual framework for the study describing the enhancement of employee performance related to their skills, knowledge, abilities, and workplace expectations. Data were collected through semistructured interviews using open-ended questions. Methodological triangulation and a modified van Kaam data analysis approach were used with field notes and interview data to guide the coding process, theoretical saturation, and trustworthiness of interpretations. Five themes emerged that senior leaders identified important for creating best practice solutions: benchmarking, training, communication strategies, organizational change, and integrity. These findings may influence positive social change by offering management strategies, objectives, and actions that help to promote the development of employees and collaboration between individuals, government institutions, local businesses, and communities.

Abstract:
For over 30 years, organizations have engaged in programs to address the growing presence of diverse populations in their ranks, and researchers have attempted to identify and quantify a link between diversity and enterprise performance. The problem was a lack of understanding of how organizations benefit from increased diversity and the role of frontline managers in that process. The purpose of this phenomenological study was to address the research question aimed at the perceptions and lived experiences of frontline managers and to gain insights about how they are navigating the challenges of increased diversity to enhance their ability to produce high-performance outcomes. The three conceptual frames used were (a) diversity management, (b) managing people, and (c) team performance. The data collection process involved interviewing 12 frontline managers from a variety of industry sectors using a semistructured, conversational interviewing protocol. The open hand-coded analysis revealed patterns of thought and behaviors relating to managing individuals, managing the complexity of diversity, and managing diverse teams for high performance. The original concept of diversity management was in response to the growing diversity in the workplace and was intended to develop the capacity among managers to manage the resulting diversity mix. The study findings indicated that a common definition of diversity management is possible, that managing diversity requires a competence with all dimensions of diversity, and that there are a set of management skills that can yield better performance with teams of diverse composition. The results of my study can have positive impact on theory, practice, and general social acceptance of diversity.

The issue is addressed by approaching the principles and fundamentals of contract procedure, flowing into its applicability in the executive order, especially in the amount execution. The limits of the contract procedures authorized by article 190 of the Civil Procedure Code are concatenated against procedural publicism and privatism, as well as presented in the bias of a corporative model of process from its insertion in the procedural panorama in the light of formalism-value. It is suggested the correct interpretation of the requirements established in the infraconstitucional scope with a view to the validity in the formation of contract procedure. Transposing the fundamental rights to freedom, legal certainty and effectiveness of the process, negotiation on procedural matters is justified and inserted in the environment of executive process. The impact of formation and application of contract procedure on executive expropriatory measures and on procedural rules is analyzed. It is defended the validity of atypical contract procedure that may imply justified restrictions to the fundamental rights of the parties in the executive process, such as the limitation to the double degree of jurisdiction and the renunciation of unenforceability, based on the correct application of proportionality.<br>O presente trabalho prop?e-se a aprofundar o tema dos neg?cios jur?dicos processuais na perspectiva dos direitos fundamentais das partes. Enfrenta-se a referida tem?tica, abordando a principiologia e os fundamentos da negocia??o processual a desaguar na sua aplicabilidade na tutela executiva, em especial na execu??o de quantia. Os limites dos neg?cios processuais autorizados pelo art. 190 do C?digo de Processo Civil s?o concatenados frente ao publicismo e privatismo processual, bem como apresentados no vi?s de um modelo cooperativo de processo a partir de sua inser??o no panorama processual ? luz do formalismo-valorativo. Companies that execute a strategy change are facing major challenges. Business strategy studies have shown that companies do not achieve their full potential and that there are a number of difficulties in strategy execution. Purpose: The purpose of the essay is to test the model of strategy execution that Kaplan and Norton have created and how it’s followed in an active strategy change. The essay will provide insight into the pitfalls and obstacles of the strategy implementation. Method: The study that has been conducted is a case study of a qualitative nature. The empirical material has been collected by means of semi-structured interviews. Conclusion: Visma Spcs is in the middle of the Vision 2020 process, a strategy change started in 2016. During these years, they have been working hard to formulate, implement, communicate, and get employees to understand Vision 2020 in order for the entire organization to work towards the common goals. The study highlights a number of problems Visma Spcs has with the strategy change, some are part of communication and knowledge about the strategy others are how to work with the process. Kaplan and Norton have created a process in six steps for strategy implementation, a process that, according to the purpose of the paper, is tested in this study. There have been identified some similarities with Visma Spcs strategy implementation and the theory, but also a number of deviations. De viktigaste punkterna i uppsatsens slutsats är att Visma Spcs behöver arbeta mer med kommunikation och återkoppling kring Vision 2020.

Thesis (MBA (Business Management))--University of Stellenbosch, 2009.<br>ENGLISH ABSTRACT: Successful strategy execution remains critical for any organisation. Yet many organisations seem to have difficulties in implementing their strategies, especially in the public sector. This study explores the role of middle managers in executing organisational strategies in the local government sector. The study adopted a qualitative research method and followed a case study strategy, using a local authority council (LAC) in Namibia. Using semi-structured individual interviews, I interviewed 10 middle managers, selected through applying purposive sampling and representing diverse characteristics of the target group. I introduced a theoretical framework consisting of four research focus areas to guide the study: the value-adding role of middle managers, the key enablers for middle managers to execute strategies successfully, the key processes they follow and the key tools they use to implement corporate strategies. I also conducted a critical literature review on the above focus areas. The findings suggest that middle managers interpret, communicate and translate organisational strategic goals into actions in their value-adding role as champions, synthesisers, facilitators and implementers. The results of the research study also indicates that communication and the availability of resources are key enabling factors, whereas systems, structures, policies and communication channels are key processes impacting on the middle managers' effective implementation of corporate strategies in this LAC. In the same vein, resources – information technology (IT) in particular, performance management systems and laws – were found to be the key tools. Some disconfirming evidence also emerged from the study, suggesting that some middle managers play a value-subtracting role, characterised by disruptive behaviour and being bogged down in routine duties. This research study is, at best, an explorative one, as it used a limited sample. Further research is necessary to gain more in-depth insights about the different roles of middle managers and their influence on strategy generation and implementation versus the role of top/senior managers. As the study employed a case study design, the generalisability of the findings is also limited to this LAC. Further, while I aimed to give a trustworthy account of the experiences of the research participants, many factors may have interfered with the processes of fair collection and interpretation of data, including personal emotional involvement with the topic, presuppositions formed from reading the literature, and various aspects of the interaction with the research participants. Further research is therefore needed to validate the assumed relationships that are expressed in the thematic map. This study is of value to the LAC in that, in the present context of this organisation, top management formulate the organisational strategic goals (vision, mission, strategic thrusts and objectives), with little involvement of middle managers. The study records the views of middle managers, indicating that there is a gap between the agenda setting and leadership of top managers and the observed roles of middle managers. Yet, effective strategy execution requires constant feedback, commenting on and questioning the strategy in order to facilitate understanding. Middle managers thus correctly argue that continuous dialogue and interaction with senior managers increases the alignment of their tactical initiatives with top management's conception of corporate strategy.<br>AFRIKAANSE OPSOMMING: Suksesvolle strategieuitvoering bly van deurslaggewende belang vir enige organisasie. Tog is dit oënskynlik vir menige instansie moeilik om hulle strategieë ten uitvoer te bring, veral in die openbare sektor. Hierdie studie ondersoek die rol van middelvlakbestuurders in die toepassing van organisatoriese strategieë in die plaaslike regeringsektor. Met behulp van ʼn kwalitatiewe navorsingsmetode en ʼn gevallestudieontwerp, is ʼn Namibiese plaaslike regeringsraad ('n sogenaamde LAC) onder die loep geneem. Semi-gestruktureerde afsonderlike onderhoude is met tien middelvlakbestuurders gevoer, welke tiental deur doelgerigte steekproefneming gekies is en die diverse kenmerke van die teikengroep verteenwoordig. Die studie word gerig deur ʼn teoretiese raamwerk met vier navorsingsfokusgebiede, naamlik die waardetoevoegingsrol van middelvlakbestuurders; die kerninstaatstellers vir middelvlakbestuurders om strategieë suksesvol in werking te stel; en die kernprosesse wat middelvlakbestuurders volg, sowel as die kerninstrumente wat hulle gebruik om korporatiewe strategieë uit te voer. ʼn Oorsig van kritieke literatuur is ook op elk van voormelde fokusgebiede onderneem. Die navorsing bevind ook dat kommunikasie en die beskikbaarheid van hulpbronne kerninstaatstellers is, terwyl stelsels, struktuur, beleid en kommunikasiekanale die kernprosesse is wat middelvlakbestuurders se doeltreffende inwerkingstelling van korporatiewe strategieë in die LAC onder beskouing beïnvloed. In dieselfde trant blyk hulpbronne – veral inligtingstegnologie, ʼn prestasiebestuurstelsel en wette – die kerninstrumente te wees. Die studie lewer egter ook teenstellende bewyse op dat sommige middelvlakbestuurders inderwaarheid ʼn waardeverminderingsrol speel, omdat hulle ontwrigtend optree en in roetinetake vasval. Hierdie navorsingstudie is hoogstens ondersoekend, met ʼn beperkte steekproef. Verdere navorsing is dus nodig om ʼn dieper insig in die verskillende rolle van middelvlakbestuurders en hulle invloed op die formulering en inwerkingstelling van strategie teenoor dié van top-/senior bestuurders te verkry. Aangesien die studie van ʼn gevallestudieontwerp gebruik maak, is die veralgemeenbaarheid van die bevindinge ook beperk tot die onderhawige LAC. Voorts, hoewel die studie 'n betroubare weergawe van die navorsingsdeelnemers se ervaringe probeer gee, kon verskeie faktore met die prosesse van billike datainsameling en datavertolking ingemeng het, wat persoonlike betrokkenheid by die onderwerp, vooronderstellings uit die literatuur, en vele aspekte met betrekking tot wisselwerking met navorsingsdeelnemers insluit. Die aangenome verhoudinge in die tematiese kaart moet dus deur middel van verdere navorsing bekragtig word. Die studie is van waarde vir die betrokke LAC, aangesien die topbestuur van die organisasie tans die organisatoriese strategiese doelwitte (visie, misie, strategiese fokuspunte en oogmerke) sonder veel oorleg met middelvlakbestuurders bepaal. Middelvlakbestuurders kon dus deur hierdie studie ook húlle menings lug, waaruit duidelik blyk dat daar ʼn gaping is tussen topbestuurders se agendabepaling en leierskap, en die waargenome rolle van middelvlakbestuurders. Doeltreffende strategieuitvoering verg egter deurlopende terugvoering oor, kommentaar op, en bevraagtekening van die strategie ten einde werklike begrip in die hand te werk. Middelvlakbestuurders het dus gelyk dat voortdurende gesprekvoering en wisselwerking met senior bestuurders nodig is om te verseker dat taktiese projekte op middelvlak in pas is met die topbestuur se gedagtes oor korporatiewe strategie.

Actualmente la economía del Perú está estrechamente vinculada con el sector construcción, existen diversos factores por qué este sector no ha crecido, específicamente en el sector público. Durante el 2018 el estado peruano contó con más de 49 (cuarenta y nueve) mil millones de soles programados para ejecución de Obras (Según Consulta Amigable del Portal del Ministerio de Economía y Finanzas), sin embargo, solo se han gastado treinta y dos mil millones de soles en inversiones de obras lo que hace que existe diversos factores que influyen que este dinero programado no se pueda gastar. De estos cuarenta y nueve mil millones de soles en proyectos para ejecución están incluidos la construcción de obras por administración directa el cual por los problemas que existe en el sector construcción siendo el desconocimiento acerca de la ejecución de obras por administración directa hace que este monto programado no supere 65% de ejecución presupuestaria. El sector Educación durante el año 2018 ha contado con más de 1,500 millones de soles en gastos programados para la ejecución del año fiscal 2018, siendo ejecutados alrededor de un 71% lo que significa que no existe éxito en la ejecución de gasto presupuestal en este sector, La UNDAC para el 2018 ha programado más de 18 millones de soles en ejecución de obras por administración directa e indirecta ejecutando solo un 27.7% lo que significa un bajo nivel de gasto presupuestal y un problema para solucionar esta brecha. Este trabajo de investigación desarrollará una propuesta de directiva para ejecución de obra por la modalidad de administración directa ya que la UNDAC no cuenta a la fecha con una directiva eficaz para esta modalidad de ejecución de obras. En el capítulo I de este Proyecto de Investigación se planteará el problema de investigación evidenciando los objetivos y la justificación de nuestro trabajo de investigación. En el Capítulo II presentaremos el marco teórico en relación a la ejecución de obras por la modalidad de administración directa, indicando los antecedentes, palabras claves, definición de conceptos básicos y la hipótesis de nuestro trabajo de investigación. En el Capítulo III presentaremos la metodología de investigación indicando el tipo, diseño y metodología de investigación como también el procesamiento y análisis de datos de los proyectos evaluados y de la directiva planteada. En el Capítulo IV explicaremos todos los resultados que emanan de nuestro trabajo de investigación en base a índices, montos, y acciones que resulta de la implementación de la directiva y por último se discutirá en el Capítulo V las conclusiones y recomendaciones que derivan de la investigación.<br>Currently the economy of Peru is closely linked to the construction sector, there are currently several factors why this sector has not grown specifically in the public sector. This research work will develop a proposal for a directive for the execution of work by the direct administration modality since UNDAC does not have an effective directive for this type of execution of works. In Chapter I of this Research Project, the research problem will be presented, evidencing the objectives and justification of our research work. In Chapter II we will present the theoretical framework in relation to the execution of works by the direct administration modality, indicating the background, keywords, definition of basic concepts and the hypothesis of our research work. In Chapter III we will present the research methodology indicating the type, design and research methodology as well as the data processing and analysis of the projects evaluated and the proposed directive. Den kvalitativa studien har syftat till att undersöka handläggningen och verkställigheten av parboendegarantin i det svenska välfärdssystemet ur biståndshandläggare och enhetschefers perspektiv inom äldreomsorgen. Studien har givit en inblick i hur de yrkesverksamma med erfarenhet av parboendegarantin beskrivit samspelet mellan organisation, professionsetik och professionellt handlingsutrymme i etiska utmaningar som kan uppstå under handläggningen och verkställigheten. För att erhålla en fördjupad och nyanserad kunskap kring parboendegarantins process har åtta professionella från fem olika kommuner deltagit i intervjuer där resultatet visade att alla informanter uppfattade parboendegarantin som en mänsklig rättighet för äldre. I övrigt framkom likheter i hur etiska utmaningar hanterades gällande exempelvis besittningsrätt. Studien visade även på framträdande skillnader i verkställandet av parboendegarantin vilket gav slutsatsen att riktlinjer behövs.<br>The qualitative study aimed to explore the administration and execution of the cohabitation guarantee (parboendegaranti) in the Swedish welfare system through the perspective of the caseworkers and the branch heads within elderly care. The study provided the professionals perception of the interaction between organization, professional ethics and professional capacity for action regarding the ethical challenges that can occur processing the cohabitation guarantee. Acquiring the insight of the professional perspective the study was based on eight qualitative interviews with professionals from five Swedish municipalities that have experience with the cohabitation guarantee. The results showed that the professionals perceived the cohabitation guarantee as a human right for the elderly and similarities were found in methods to cope with ethical dilemmas such as the right to tenency after the death of a spouse. Significant differences in how the cohabitation guarantee was executed were found which led to the conclusion that guidelines are needed.

Initially the exercise of sanctioning powers is contextualized in the field of government procurement in Colombia, regulatory and jurisprudential development of this power and the procedure envisaged by the legislature for the imposition of sanctions is exposed when a violation or breach of it becomes apparent the contractor’s obligations, specifying the scope and gaps that the process involves. Then the consecration of the sanctioning power of the administration is presented in the Peruvian law, marking the differences with the model adopted by the Colombian law, to conclude with some perspectives on the subject.<br>Inicialmente se contextualiza el ejercicio de la potestad sancionadora en el ámbito de la contratación estatal en Colombia. Se expone el desarrollo normativo y jurisprudencial de esta facultad y el procedimiento que ha previsto el legislador para la imposición de sanciones cuando se evidencie una infracción o incumplimiento de las obligaciones del contratista, precisándose el alcance y los vacíos que el procedimiento comporta. Jusqu’à l’ordonnance du 23 mars 2006 relative aux sûretés, le créancier désireux de réaliser sa sûreté était tenu d’emprunter les procédures octroyées à tout créancier pour mettre en œuvre son droit de gage général. Les effets de la sûreté réelle ne se manifestaient qu’après la vente forcée du bien grevé, par le désintéressement préférentiel du créancier au cours de la procédure de distribution du prix. La réforme du droit des sûretés opérée en 2006 a modifié cette situation en généralisant l’attribution judiciaire et en légalisant l’attribution conventionnelle du bien grevé. Ces modes de réalisation sont réputés plus simples et rapides que les voies d’exécution traditionnelles, mais également plus efficaces pour écarter les créanciers concurrents. Le créancier titulaire d’une sûreté réelle est désormais avantagé dès l’exercice de ses prérogatives à l’encontre du débiteur défaillant. Pour exercer son pouvoir de contrainte, il bénéficie de voies d’exécution qui lui sont spécifiques. Le législateur a pris soin d’encadrer ces techniques d’attribution afin de protéger les intérêts du débiteur. Toutefois, le régime de ces modes de réalisation mérite d’être aménagé afin d’en améliorer la sécurité juridique, l’efficacité, et par conséquent, l’attractivité. Les effets des ces modes de réalisation à l’égard des créanciers concurrents de l’attributaire sont moins clairs. L’attribution est régulièrement présentée comme une technique garantissant au poursuivant un désintéressement exclusif, les prétentions des autres créanciers inscrits étant reléguées sur l’éventuel reliquat consigné. Il importe donc de déterminer comment concilier la faculté d’attribution du bien grevé avec les droits des créanciers concurrents<br>Up until the order of 23 March 2006 on security rights, a creditor aiming at realizing his surety had to resort to the procedures of execution available to any creditor in order to implement his general right of pledge. The effects of the real surety would manifest only after the execution sale of the encumbered property, through the preferential satisfaction of the creditor during the proceedings of the price distribution. The 2006 reform of the law of security rights has altered this situation by generalizing the judicial attribution and by legalizing the conventional attribution of the encumbered property. These modes of realization are deemed to be simpler and faster than the traditional enforcement proceedings, but also more efficient to shut out the other competing secured creditors. From now on, the creditor benefiting from a real surety is favoured as soon as he exercises his rights against the defaulting debtor. In order to exercise his power of constraint, he may rely on all the enforcement proceedings that are specific to the real surety. The legislator has carefully provided guidelines to use these attribution techniques to protect the interests of the debtor. However, the legal framework applicable to these modes of realization deserves to be adjusted in order to improve their legal certainty, their efficiency, and therefore their attractiveness. The effects of these modes of realization against the competing secured creditors of the recipient are not completely clear. Attribution is often presented as a technique that ensures the plaintiff an exclusive satisfaction, while the competing creditors’ claims are redirected on a hypothetical consigned remainder. Although the other creditors cannot take part in the procedure, nothing justifies that their rights be undermined. It is therefore important to determine how to reconcile the optional attribution of the encumbered property and the rights of the competing secured creditors

Those challenges should be regarded as opportunities for transformation and not as threats. It is a fact that information and communication technology (ICT) per se cannot solve all current challenges; however, it can offer solutions to the many problems that confront the judiciary. In that sense, ICT development becomes the best ally of Justice. The Information, Technology, Processes, Objectives and values, Staff and skills, Management systems and structures, and Other resources (ITPOSMO) dimensions described by Heeks (2006) are applied as the basis for evaluating ICT in the judicial sphere. This research validates the opinion of the users with regard to ICT projects. Judges, court and administrative officials, managers and lawyers constitute the unit of analysis of this study. These stakeholders were interviewed and requested to complete a survey. The study reveals the high level of relevance that ICT holds for the judiciary, in the sense of providing information and tools for interacting with different users. The objective of ICT is to act as support for improving court and administrative performance through the different ICT systems. Nonetheless, this research has also uncovered limitations and flaws in the current information systems. These flaws tend to turn the benefits that ICT systems can bring into constraints. This study makes various suggestions on how to overcome those flaws. The most important suggestion is the development of a holistic approach when ICT projects are conceived. Likewise, the early involvement of stakeholders who will be influenced by any ICT initiative should be encouraged.<br>AFRIKAANSE OPSOMMING: Paraquay se Justisie het deur ‘n moeilike transformasie tydperk gegaan. Abstract Immigration courts in the United Sates are struggling to resolve 610,524 removal proceedings cases with approximately 330 judges located in 58 immigration courts nationwide. Due to the limited number of judges, case backlogs have increased steadily, with the wait time being 854 days in 2017 for the first hearing and much longer for case resolution. The purpose of this case study was to explore the perceptions and attitudes of immigration attorneys about delays in removal proceeding hearings in an immigration court in the southwest. Kettl's transformation of governance theory served as the theoretical foundation for this study, which explored immigration attorneys' perceptions about the effects of delays on the welfare of immigrant clients, the effects of delays on client-attorney relationships, and potential solutions to the delay crisis. Data were collected through semistructured interviews with a snowball sample of 10 participants as well as deportation hearing observations and court document reviews. Data were analyzed using the open coding technique. Findings indicated that legal representation was challenging for undocumented immigrants as the lack of proper documents often dissuaded immigrants from seeking legal guidance and they experienced challenges in navigating workplaces, schools, and society. Findings also indicated inadequacies in immigration courts and the need for more funding and resources such as judges, staff training, online application submission system, and judicial system restructuring. The implications for positive social change are directed at immigration policymakers and decision makers as a better understanding of the delay crisis may help them to focus attention and resources in helping to reduce the backlog and improve the judicial process.

But beyond to validate administrative act, the author argues that the main benefit of meeting the proper motivation lies in the improvement of the interaction between the taxpayers and the Public Administration, generating greater confidence in state activity and promoting the development of economic activities with increasing levels of formality.<br>En el presente artículo, el autor destaca la importancia del principio-derecho a la debida motivación en el marco de los procedimientos administrativos. En esa línea, afirma que todas las entidades públicas están obligadas a expedir actos administrativos debidamente fundamentados, pues este constituye un requisito de validez que, de ser inobservado, acarrea la nulidad del acto. Pero más allá de validar al acto administrativo, el autor sostiene que el principal beneficio de que se cumpla con la debida motivación radica en la mejora de la interacción entre los administrados y la Administración Pública, generando mayor confianza en la actividad estatal y propiciando el desarrollo de actividades económicas con cada vez mayores niveles de formalidad.

L’étude des interventions judiciaires spécifiques au droit des sociétés in bonis permet de souligner le rôle majeur désormais tenu par les juges. L’analyse des pouvoirs judiciaires de régulation de la vie sociétaire et de sanction des obligations civiles en droit des sociétés met en évidence l’impact des interventions judiciaires sur le fonctionnement des sociétés. Il existe de nombreuses procédures spécifiques au droit des sociétés, mais la richesse des solutions et des innovations jurisprudentielles caractérise également le recours nécessaire au droit civil et au droit processuel afin de répondre aux exigences de l’environnement sociétaire. Fort de ce constat, différentes pistes peuvent être proposées dans le but de renforcer l’efficacité et l’utilité de ces interventions judiciaires qui permettent de garantir l’efficience et l’attractivité du droit des sociétés français<br>Judges have become ubiquitous stakeholders within companies. As guardians of law, they play a real role in the well being of companies. The study of legal interventions, specific to corporate law, applied to “in bonis” companies clearly highlights the major role played by judges today. Analysis of the judiciary powers regulating companies lives and of the sanctions surrounding liabilities in corporate law puts emphasis on the impact of judicial involvement on company functioning. Many specific corporate law proceedings exist, however, the rich range in solutions and case-law innovations accentuates the need to resort to civil and procedural law in response to the business world’s requirements and expectations. In this article, the author highlights the benefits of incorporating the concepts “concession contract” and “long term contract” within the new Civil and Commercial Code of the Nation in Argentina. For the author, these contractual arrangements are fundamental in Administrative Law to understand the scope of the concession of public services, specifically in regard to the introduction of changes in the contract. This also means that foreign police concepts or theories as ius variandi, which only add authoritarian elements under the contract, are not longer required.<br>En el presente artículo, el autor resalta los beneficios de la incorporación de los conceptos “contrato de concesión” y “contrato de larga duración” dentro del nuevo Código Civil y Comercial de la Nación argentina. Así, para el autor, estas figuras contractuales son fundamentales en el Derecho Administrativo para poder comprender los alcances del contrato de concesión de servicios públicos, específicamente, en cuanto a la introducción de variaciones en la ejecución del contrato. The objective of the research is to propose a control instrument applicable to the budgetary and financial execution of an IFES, considering the legislation applicable to the public budget, that assists the manager in controlling and reducing the effects of expenses classified as carryovers. Descriptive analysis and application of Pearson's correlation index were carried out on data taken from the Federal Government's Portal, referring to the five universities in the Center-West region between 2008 and 2016. It is concluded that: carryovers are present in all universities evaluated; on average, more than a quarter of the budget started is not finalized in the same year; unprocessed leftovers account for more than 90% of the total unpaid debts of universities. Furthermore, it is found that: there is a moderate negative correlation to budget execution and unbundling of UNB; there is a moderate positive correlation between the remainders to be paid and the financial execution of the budget in the UFGD and the UNB, and negative correlation in the UFG. The intervention proposal has two stages: the first one is the collection of information on the budgetary and financial situation of IFES, through a control sheet, and the second step is the application of the GUT matrix in the budget balances of the carryovers, to prioritize the closure of such expenses.<br>O objeto desta pesquisa são as despesas classificadas como restos a pagar, que fazem parte da execução do orçamento público, e se apresentam como um desafio para os gestores públicos. O objetivo da pesquisa é propor um instrumento de controle aplicável à execução orçamentária e financeira de uma IFES, considerando a legislação aplicável ao orçamento público, que auxilie o gestor no controle e na redução dos efeitos das despesas classificadas como restos a pagar. Por meio da análise descritiva e aplicação do índice de correlação de Pearson de dados retirados do Portal Siga Brasil referentes às cinco universidades da região Centro-Oeste, entre os anos de 2008 e 2016, conclui-se que: os restos a pagar estão presentes em todas as universidades avaliadas; em média, mais de um quarto do orçamento iniciado não é finalizado no mesmo exercício; os restos a pagar não processados representam, em média, mais de 90% dos restos a pagar total das universidades, e constatou-se que: há correlação moderada negativa em relação à execução orçamentária e inscrição de restos a pagar na UNB; há correlação moderada positiva entre os restos a pagar e a execução financeira do orçamento na UFGD e na UNB, e correlação negativa na UFG. Apresenta-se a proposta de intervenção por meio de duas etapas: a primeira é o levantamento das informações a respeito da situação orçamentária e financeira da IFES, através de uma planilha de controle, e a segunda etapa é a aplicação da matriz GUT nos saldos orçamentários dos restos a pagar, para priorização de encerramento de tais despesas.

Now a day, petroleum companies are looking for a way to calculate the best economic and time consuming alternative to move a group of ships between platforms, refineries and consuming centers. In the following research is introduced a solution to this problem through a system which optimize the main variables involved. Variables such as scheduling and road have been taken into account. The variable scheduling defines the road that each ship must follow. Meanwhile, the optimization of the route is based on traveling time between each points, uploaded and downloaded time, storing capacity at each point, etc. The following system has been tested in two real cases showing a good performance.<br>Coordenação de Aperfeiçoamento de Pessoal de Nível Superior<br>Hoje em dia, as empresas petroleiras enfrentam o desafio de conhecer qual é a melhor forma de movimentar uma frota de navios cargueiros sem que isso signifique um aumento de custo, entre outras. Neste trabalho será apresentada uma solução para este, mediante o desenvolvimento de um sistema que permita calcular as rotas para transporte de petróleo bruto de plataformas marítimas a refinarias, bem como transporte dos derivados do petróleo de refinarias a centros consumidores. Para a solução do sistema, foi realizado um scheduling no qual determina-se a rota que cada navio deve realizar para que o petróleo sea entregue, buscando a rota que conduza ao melhor caminho, sendo considerado o tempo de deslocamento, carga e descarga do produto, além do limite de armazenamento de produto em cada plataforma, entre outros parâmetros.

In the nursing, to plan and to execute activities are essential to guarantee assistance with quality. Descriptive study, with qualitative boarding, carried through in a hospital of great size, it had as general purpose to analyze the perceptions of the managers about the planning and execution of the nursing activities in a hospital of the public net of assistance and education of Goiânia - Goiás. The study considered as individuals 17 (seventeen) nursing managers of the ambulatorial units and internment units. The data had been collected using half-structuralized interviews and they were analyzed as what Bardin praises (1979). The results had shown that the managers elaborate the planning better than they execute and there are factors that interfere with the planning and execution of the activities. It was concluded that the managers adopt the participative planning, indicating change of paradigm in the administration. Between the factors that make things easier, they are the adoption of the work in team, the proximity between management and servers, incentive to the creativity and interest in the execution of the planned actions. The factors that make things difficult include the scarcity of human, material and financial resources; factors related to the components of the team, such as: motivation, lack of time, absence of training, difficulties in managing; insufficiency of support of the institution and of the other services of the hospital; inadequate physical structure; and the unexpected of everyday. The origin of these factors was attributed to the proper people, to the fact that the hospital belongs to the public net, the institution and the system used for the management of the support services.<br>O planejamento é uma importante função administrativa e sua execução possibilita o alcance dos objetivos estabelecidos na organização. Na enfermagem, planejar e executar atividades são imprescindíveis para garantir assistência com qualidade. Estudo descritivo, com abordagem qualitativa, realizado em um hospital de grande porte, teve como objetivo geral analisar as percepções dos gerentes quanto ao planejamento e execução de atividades de enfermagem em hospital da rede pública de assistência e ensino de Goiânia - Goiás. Participaram como sujeitos, 17 (dezessete) gerentes de enfermagem das unidades ambulatoriais e de internação. Os dados foram coletados por meio de entrevistas semi-estruturadas e analisados conforme o que preconiza Bardin (1979). Os resultados mostraram que os gerentes elaboram o planejamento melhor do que o conceituam e que existem fatores que interferem no planejamento e execução das atividades. Concluiu-se que os gerentes adotam o planejamento participativo, indicando mudança de paradigma na administração. Entre os fatores facilitadores, estão a adoção do trabalho em equipe, a proximidade entre gerência e servidores, incentivo à criatividade e interesse na execução das ações planejadas. Os fatores dificultadores incluem a escassez de recursos humanos, materiais e financeiros; fatores relacionados aos componentes da equipe, tais como: motivação, falta de tempo, ausência de treinamento, dificuldades em gerenciar; insuficiência de apoio da instituição e de outros serviços do hospital; estrutura física inadequada; e as intercorrências do cotidiano. A origem destes fatores foi atribuída às próprias pessoas, ao fato do hospital pertencer à rede pública, à instituição e ao sistema utilizado para o gerenciamento dos serviços de apoio.

L’objectif de cette recherche est de comparer les jurys criminels français et italien à travers une étude socio-anthropologique de la pratique judiciaire observable dans les cours d’assises. Il s’agit de rendre compte des différents aspects de l’expérience vécue par les jurés en étudiant minutieusement le rituel judiciaire ainsi que les interactions et relations qui se jouent entre les profanes et les professionnels de la justice le temps d’une session. Quels sont les résultats principaux qui émergent de la comparaison des jurys populaires français et italien ? Ils sont essentiellement de trois ordres. Premièrement, l’observation du « droit en mouvement » révèle que, malgré les similitudes des deux systèmes étudiés sur le plan théorique, la mise en œuvre pratique de la participation des citoyens au jugement des crimes est différente entre la France et l’Italie. Il est alors possible d’en détailler les mécanismes de fonctionnement au regard de la culture juridique de chacun des pays étudiés et en retour, les caractéristiques de chacun des jurys nous apportent des informations sur les mœurs démocratiques française et italienne. Deuxièmement, le jury populaire apparaît comme une « institution de sociabilité » pour les individus appelés à siéger temporairement à la cour d’assises. Cette dimension socialisante influence de manière décisive l’« expérience authentique » vécue par les jurés, et en fait une « expérience directe » de la souffrance d’autrui et du fonctionnement de la démocratie. Troisièmement, la comparaison des jurys criminels français et italien permet de rappeler la modernité et les enjeux actuels liés à la présence des profanes au sein de l’institution judiciaire. Le jury populaire peut être considéré comme une « institution bonne » capable à la fois de redonner de la crédibilité à l’institution judiciaire, de fournir aux acteurs professionnels la possibilité de « ré enchanter » leur quotidien, et enfin d’orchestrer une prise de conscience individuelle pour les jurés sur l’importance de leur participation pour le maintien du lien social<br>The purpose of the research is to compare French and Italian juries through a socio-anthropological study of judicial practice in criminal courts. It reports on the different experiences of jurors by carefully studying court procedure, as well as the interactions and relations between laymen and legal professionals within a session.What are the main findings that emerge from comparing French and Italian juries? They can broadly be divided into three parts. Firstly, observation of "the law in motion" reveals that, despite the theoretical similarities between the two systems, the practicalities of involving citizens in judging crimes are different in France and Italy. It is then possible to examine the mechanics in view of the legal culture in both countries and, in return, the characteristics of their juries give us an insight into France and Italy’s democratic values. Secondly, juries appear to be a "socializing institution" for individuals who are required to attend court. This element of socialization has a decisive influence on the "authentic experience" of jurors, making it a "direct experience" of the suffering of others and the functioning of democracy. Thirdly, comparing French and Italian juries provides an opportunity to reflect on modern times and the current issues surrounding the presence of laymen within the judiciary. Juries may be seen as a "worthy" institution able to restore the credibility of the judicial system, stimulate legal professionals and raise individual awareness amongst jurors of the importance of their participation in maintaining social cohesion<br>L’obiettivo di questa ricerca è di mettere a confronto la giuria popolare francese con quella italiana sviluppando uno studio socio-antropologico basato sulla pratica giudiziaria osservabile nelle corte d’assise. Si è cercato di mostrare le differenze nel modo di vivere l’esperienza di giurato osservando accuratamente, per ciascuno dei due contesti, il rituale giudiziario, le interazioni e le relazioni tra componenti laici e togati presenti durante una sessione. Quali sono i principali risultati che emergono del paragone delle giurie popolari francesi e italiane? Ne emergono soprattutto tre. Primo, sebbene ci siano delle somiglianze dell’impianto teorico su cui si fondano i due sistemi della giuria popolare, l’osservazione del “diritto in movimento” rivela quanto il loro funzionamento pratico sia diverso. Si descrivono nei dettagli i meccanismi del funzionamento della giuria popolare mettendoli in rapporto con la cultura giuridica di ogni paese mostrandoci, allo specchio, le caratteristiche dei loro costumi democratici. Secondo, la giuria popolare appare come un’“istituzione di sociabilità” per chi vi prende parte. La dimensione sociale influisce sull’“esperienza autentica” vissuta dai giurati agendo direttamente sul modo di percepire la sofferenza altrui e del funzionamento dei processi democratici. Terzo, il confronto tra giuria francese e italiana ci permette di porre l’accento sull’attuale modernità di questa istituzione e sulle sue implicazioni nella procedura penale. La justice rendue aux colonies n’est pas une excroissance de la justice française métropolitaine. Faisant fi de la séparation de pouvoirs, autoritaire et racialisée, elle est une manière singulière d’organiser le droit de punir et le droit de tuer. Celle-ci n’a généré dans l’historiographie que peu d’analyses et reste marginale dans les réflexions sur le maintien de l’ordre colonial. Elle est pourtant l’aboutissement d’un processus central à l’établissement et au maintien de la domination coloniale : celui de la séparation d’un pouvoir de mort légitime, d’autres formes de violences meurtrières, illégitimes. Ce travail cherche à saisir les usages de la peine de mort, dans le contexte colonial de l’Afrique occidentale française entre 1900 et 1950. Nous proposons d’analyser la peine de mort comme un lieu du déploiement des fondamentaux de la politique coloniale. Les condamnations et les exécutions génèrent et font circuler des discours sur les comportements africains, créent des figures criminelles, voire ennemies, à éliminer. Ainsi, la mise en scène de la violence légitime, dans les tribunaux et aux pelotons d’exécutions, institue et rejoue sans cesse les divisions de pouvoirs, de statuts (sujet/citoyen), de races et des cultures si centrales à l’ordre colonial<br>The justice handed out in the French colonies of West Africa is not a by-product of French metropolitan justice. Oblivious to the separation of power, while being authoritarian and racialized, it is a distinctive way of organizing the right to punish and the right to kill. The death penalty has a scarce historiography in the French empire. It is also marginal in studies pertaining to colonial tools of power, law and order. Yet, it is the culmination of a process central to the establishment and maintenance of colonial domination: the separation between a legitimate right to kill and other types of illegitimate lethal violence. This dissertation explores the role played by the death penalty in the context of French West Africa between 1900 and 1950.The death penalty is analysed as a space where the fundamentals of colonial policies are deployed. Condemnation and executions generate and circulate colonial discourses about African behaviour, giving rise to criminal and enemy figures that ought to be eliminated. The staging of legitimate violence, within courts and by firing squads, continuously re-enacts divisions of power, of status (citizen/subject), of race and culture—the very pillars of the colonial order

Thesis I worked on a project basis provided the building permit for an office complex of two identical fourth storey buildings which from the first storey intersects the inner atrium. The buildings are located within the CTZone Brno in the street Masna. The buildings are designed so that the ground floor is a garage for cars and retail space for rent and above-ground floors are reserved for office space lease. Objects are based on a floating pile conducted by the CFA, which builds prefabricated concrete skeleton. The cladding is formed by a combined system of aluminum windows, masonry face and sheet plotted on a system of stainless steel brackets. Roofing of buildings is done running flat roofs, the roofing of the atrium serves as a walkable roof. The garage is designed bearing slab plate fitted topping for added durability. Internal Partition Walls and walls are made of aerated concrete blocks. Thesis deals with construction technological preparations for the construction and contains a technical report, coordinating the situation buildings with wider relationships routes, time and financial plan, study the implementation of the main stages, the project site equipment, design tools, technological regulation, inspection and test plan, itemized budget, comparing two designs rough superstructure and appropriate drawings.

Le procès civil est le cadre traditionnel de réalisation de la justice des particuliers, et les règles qui le gouvernent se trouvent synthétisées dans les 24 premiers articles du CPC qui en énoncent les principes directeurs. Ces derniers organisent la répartition des charges processuelles entre les différents acteurs du procès, et déterminent ainsi l’essentiel de l’office du juge qui est construit autour du modèle contentieux du procès civil, taillé pour le juge du fond. Cependant, ce modèle subit des atténuations pour des raisons principalement d’équité ou de diligence, alors même que l’affaire qui est soumise au juge relève de la matière contentieuse. Dans la procédure gracieuse et dans celle de cassation, c’est la nature de la mission confiée au juge qui justifie parfois les atténuations apportées à ces principes, et parfois même leur effacement. Par ailleurs, l’action du juge à l’égard de ces principes directeurs va aussi dans le sens de leur adaptation aux évolutions juridiques et socio-économiques. Elle se traduit essentiellement d’une part, par une recherche d’effectivité de ces principes que le juge civil français n’hésite plus à rattacher à des normes supérieures, et d’autre part, par une recherche de leur efficience par le biais des techniques d’interprétation. Si dans le premier cas les phénomènes d’internationalisation et de constitutionnalisation du droit permettent d’expliquer une telle action, dans le second, se pose la question de la légitimité de la démarche. Notre pensée est que le juge d’aujourd’hui est aussi un juge gestionnaire dans un contexte d’accroissement de la demande de justice et de raréfaction des ressources allouées à la justice<br>Civil trial is the traditional framework where justice of individuals is usually delivered, and the rules which govern it are synthesized in the first 24 articles of the code of civil procedure which set out the guiding principles. The latter organize the sharing of procedural responsibilities between the different actors of the lawsuit, and determine the main part of the office of the judge built around the contentious model of the civil proceedings, cut for the ruling on the judges of the affairs. This model undergoes legal mitigations, mainly for reasons of equity or diligence, even though the case which is submitted to the judge is a matter of the contentious material. In the submission for an out-of-court settlement and that of the appeal to the supreme court, it is the nature of the mission entrusted to the judge who sometimes justifies the mitigations brought to these guiding principles, and sometimes even their disappearance. The action of the judge towards these principles also goes to the direction of their adaptation to evolutions so legal as Socio-Economic. It is essentially translated on the one hand, by a research for effectiveness of these principles which the judge does not hesitate to connect with superior standards, and on the other hand, by a research for their efficiency by means of the technique of interpretation. If in the first case the internationalization and constitutionnalisation explain such an action, the second case raises itself the question of the legitimacy of such an approach. Sont analysés ainsi, dans un premier temps, l’applicabilité directe de l’article 6 et la subsidiarité de la Convention par rapport au droit national et de la Cour Européenne des Droits de l’Homme par rapport aux juridictions nationales. Le droit à un procès équitable étant un droit jurisprudentiel, l’étude se focalise, dans un second temps, sur l’invocabilité des arrêts de la Cour Européenne et plus précisément sur l’invocabilité directe de l’arrêt qui constate une violation du droit à un procès équitable dans une affaire mettant en cause l’Etat et l’invocabilité de l’interprétation conforme à l’arrêt qui interprète l’article 6 dans une affaire mettant en cause un Etat tiers. L’introduction dans l’ordre juridique français et hellénique de la possibilité de réexamen de la décision pénale définitive rendue en violation de la Convention a fait naitre un nouveau droit d’accès à la Cour de cassation lequel trouve son terrain de prédilection aux violations de l’article 6 et constitue peut-être le pas le plus important pour le respect du droit à un procès équitable après l’acceptation (par la France et la Grèce) du droit de recours individuel. Quant au faible fondement de l’autorité de la chose interprétée par la Cour Européenne, qui est d’ailleurs un concept d’origine communautaire, cela explique pourquoi un dialogue indirect entre la Cour Européenne et la Cour de cassation est possible sans pour autant changer en rien l’invocabilité de l’interprétation conforme et le fait que l’existence d’un précédent oblige la Cour de cassation à motiver l’interprétation divergente qu’elle a adoptée.La seconde partie de l’étude, qui est plus volumineuse, est consacrée aux garanties de bonne administration de la justice (article 6§1), à la présomption d’innocence (article 6§2), aux droits qui trouvent leur fondement conventionnel dans l’article 6§1 mais leur fondement logique dans la présomption d’innocence et aux droits de la défense (article 6§3). Because of the fact that the right to a fair trial is a ‘‘judge-made law’’, the study also focuses on the invocability of the judgments of the European Court and more precisely on the direct invocability of the European Court’s judgment finding that there has been a violation of the Convention and on the request for an interpretation in accordance with the European Court’s decisions. The possibility of reviewing the criminal judgment made in violation of the Convention has generated a new right of access to the Court of cassation which particularly concerns the violations of the right to a fair trial and is probably the most important step for the respect of the right to a fair trial after enabling the right of individual petition. As for the weak conventional basis of the authority of res interpretata (“autorité de la chose interprétée”), this fact explains why an indirect dialogue between the ECHR and the Court of cassation is possible but doesn’t affect the applicant’s right to request an interpretation in accordance with the Court’s decisions and the duty of the Court of cassation to explain why it has decided to depart from the (non-binding) precedent.The second party of the study is bigger than the first one and is dedicated to the guarantees of the proper administration of justice (Article 6§1), the presumption of innocence (Article 6§2), the rights which find their conventional basis on the Article 6§1 but their logical explanation to the presumption of innocence and the rights of defence (Article 6§3). More precisely, the second party of the study is analyzing the right to an independent and impartial tribunal established by law, the right to a hearing within a reasonable time, the principle of equality of arms, the right to adversarial proceedings, the right of the defence to the last word, the right to a public hearing and a public pronouncement of the judgement, the judge’s duty to state the reasons for his decision, the presumption of innocence, in both its procedural and personal dimensions, the accused’s right to lie, his right to remain silent, his right against self-incrimination, his right to be informed of the nature and the cause of the accusation and the potential re-characterisation of the facts, his right to have adequate time and facilities for the preparation of the defence, including in particular the access to the case-file and the free and confidential communication with his lawyer, his right to appear in person at the trial, his right to defend either in person or through legal assistance, his right to be represented by his counsel, his right to free legal aid if he hasn’t sufficient means to pay for legal assistance but the interests of justice so require, his right to examine or have examined witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him and his right to the free assistance of an interpreter and to the translation of the key documents. The purpose of this document is to contextualize, both theoretically and at a practical level, the experience acquired during the Curricular Internship developed in the Commission for the Monitoring of the Assistants of Justice (from now on CAAJ), specifically in the discipline committee, through the existing protocol between the Faculty of Law of the Nova University of Lisbon, under the guidance of the most prestigious Professor Frederico da Costa Pinto and the supervision of Inês Caeiros, director of the disciplinary committee of the CAAJ during the period, corresponding to six months - September 2016 to March 2017. The curricular internship, in question, is inserted in the last semester of the Master's program in Forensic Law and Arbitration, being necessary the elaboration of a report of the acquired experience and its defense, to obtain the Master Degree. Firstly, we will start with a historical contextualization, characterization, functioning, organization, and attributions of the entity in question. And then, the evolution of processes performed by the CAAJ, through the presentation of graphs, to verify the evolution and for which there is a quality control of the same. The first part of the thesis deals with executions generally and the execution proceedings with particular principles of the execution proceedings and the particular ways of distrain. Extensive attention has been given to how the right to legal representation has been interpreted under the common law. Reference has been made to the united States 6f America's approach to the due process and equal protection clauses in shaping the substantive and procedural content of the right to counsel in criminal proceedings. The importance of legal representation is examined during the pre-trial, trial and sentencing stages of criminal proceedings. A brief comparative examination has been made of the right to legal representation in other foreign jurisdictions, and how the courts have dealt with indigent accused persons facing criminal charges. Proposals from different quarters in South Africa have been discussed in the hope that these proposals may still find a place in the country's final constitution. Finally, the practical implications of a qualified right to free legal representation as provided by the Interim South African Constitution is discussed. Based on the organic acts and enforcement acts, the two offices are mandated to exercise the judicial police officers’ power to maintain the public order, safeguard the society, and to prevent any dangers from occurrences. To refrain from any dangers or maintain the public order, the prior inspections therefore bear a necessary mean.   According to Article 4 of “Coast Guard Act,” the coastal patrol office is authorized the power to interdict the smuggling and prevent illicit entry or exit. In order to achieve this executive mission, the officers may conduct necessary inspections, according to the “Coast Guard Act,” on travelers, vessels, vehicles, or any other transportations carrying members or goods arriving at, or departing from, trading ports or non-trading ports, on suspicion of their violation of law, when such suspicion is justified, and if necessary, the officers of the Coast Guard may conduct searches on the nearest roads leading to the Coast. The nature of these powers is similar to “the right to visit and search” described in Paragraph 3, Article 11 of “The Statue Governing Duties of the Police”, together with the measures to restrain personal freedom, such as “right to stop and frisk” as well as “identity verification” stated in “Act Governing the Police Power.” In administrative law, these powers are discussed under the concept of administrative investigations. This study, mainly based on the Judicial Yuan Interpretation No. 535, inquires the types of coastal patrol offices conducting administrative inspections in coastal area from the “coast and harbour zones” and discusses the relative legal issues of administrative inspections, and analyzes the level of importance of rights infringement, and the “Administrative Procedure Law” (which follows and adopts German Laws), which provides the applicable laws when finding the evidence to prove the facts but without any procedures regulated to conduct the facts-finding to consider if administrative inspections should adopt the criminal investigation principles. Besides, according to the Ubi jus ibi remedium principle, if people are dissatisfied with the administrative acts done by governments, the law shall render the opportunity to remedy and compensate the damages; also, by following the procedures of criminal investigations to codify the administrative inspection procedures will make no distinctions of human-rights in administrative and criminal laws.

The primary objective of this research was to evaluate the effectiveness of a checklist, compared to a smart pump and bar-code verification system, at detecting different categories of errors in intravenous medication administration. To address this objective, a medication administration safety checklist was first developed in an iterative user-centered design process. The resulting checklist design was then used in a high-fidelity simulation experiment comparing the effectiveness of interventions towards two classifications of error: execution and planning errors. Results showed the checklist provided no additional benefit for error detection over the control condition of current nursing practice. Relative to the checklist group, the smart pump and bar-coding intervention demonstrated increased effectiveness at detecting planning errors. Results of this work will this work will help guide the selection, implementation and design of appropriate interventions for error mitigation in medication administration.

The conclusions were that the execution was predicted by the awareness of organizational justice, the awareness of organizational justice had some significant difference in different individual variables of the staff, and the execution had some significant difference in different individual variables of the staff. Finally, based on the results from this paper, the suggestions are made for administration and the following related researches.

博士<br>國立臺北教育大學<br>教育經營與管理學系<br>100<br>This study was based on the policy of "positive discipline on campus," which seeks to understand the status and issues of the implementation of the policy in middle schools, and explore their relationship with the executive capacity of administration from the teacher's knowledge and belief, the power relationship in school and the organizational culture in school. Through in-depth interviews with principals, directors, section chiefs and leading teachers from four middle schools of New Taipei City, 33 interviewees in all, this qualitative study comes to a conclusion as follows by analyzing and comparison the data and interpreting what it means: I. The status and issues of the implementation of the policy of "positive discipline on campus" are: (i) since the disagreement of the training and certification system for the advocates and the attitude of the teachers toward the seminars, the publicizing of the policy achieved little, (ii) corporal punishment still exists in the campus, and when the teachers couldn’t handle the situation, they often ask the administrative staff to discipline the students, and (iii) school authority usually excuses the misconduct teachers and offers them a second chance to make up for what they have done. II. The advantages of the teachers’ knowledge and belief on administrative execution are: (i) teachers are aware of the high expectations and requirements from the society; (ii) teachers stress the autonomy, and most of them agree to take the responsibility to discipline their students; (iii) consenting to "law," the administration support the teachers who should have complied with the policy regulations; (iv) school administration agree with and promotes the policy of "positive discipline on campus" accordingly. Its disadvantages are: (i) most teachers still believe that corporal punishment is the most effective way to discipline students; (ii) teachers commonly just focus on the regulations of "prohibition of corporal punishment," but never improve their professional knowledge on “positive discipline;" (iii) teachers emphasized heavily on academic achievement and ignored the discipline policy; (iv) school administration and teachers misunderstood that good relationship between teachers and students which assured them using corporal punishment at ease. III. The influences of the power relationship in school on the principals’ leaders execution are: (i) instable school administrative personnel is detrimental to the operation of the principals’ administrative authority; (ii) principals are able to execute the policy effectively, but difficult to ask the teachers to perform as well, and (iii) principals have clear goals and strategies, but still need members of consensus to improve executive capacity. IV. The advantages of the power relationship in school on the administrative execution are: (i) the executive keeps abreast of new development of resources, policy and leadership; (ii) if the outstanding executive were selected, middle-level leadership can be strengthened; (iii) the leading teachers can give full scope to their responsibilities, and support the implementation of the policy, and (iv) part of school teachers’ associations have positive traits. However, its disadvantages are: (i) teachers act on their own so it’s difficult to change their thinking and ways to do things; (ii) the departments of the executive are too busy to cooperate and communicate; (iii) part of the school teacher’s associations are personal interest-oriented, which mislead the concept and behavior of the teachers; (iv) the proportion of school teachers as the members of School Teacher Achievement Assessment Committee are high, which affects the objectivity of the resolution, and (v) the responsibility of disciplining the students between the school administration and the teachers are ill-defined. V. The advantages of school organizational culture on administrative execution are: (i) teachers agree with schools, unite with schools, and maintain schools’ good image conscientiously, (ii) most teachers comply with the law and are afraid of breaking the law, and (iii) teachers are able to set up an independent support system and reconcile different ideas. Its disadvantages are: (i) teachers are not easy to change their concept from their experiences, and they just cooperate to implement the policy negatively; (ii) members of the school tend to solve the problems with “appeasement" and "reconciliation," and (iii) teachers lack for professional consciousness, reflection, and specific and individual expression. According to the conclusions, following recommendations are made for educational authority: (i) the viewpoints of grass-root education personnel should be involved during the development of the policy, and keep the track of the effectiveness of execution; (ii) establish the training and certification system for the policy advocate personnel to improve the effectiveness of advocating the policy; (iii) institutionalize "Teacher Evaluation for Professional Development" and "Teacher Classification System" as soon as possible, which ensure that teachers equip with quality and professional ability and educational output; (iv) establish a specific accountability for teachers and supervise its implementation; (v) revise the member structure of School Teacher Achievement Assessment Committee in order to evaluate the teachers objectively, and (vi) understand the workload of school administration, and examine if the terms of employment is reasonable and adjust it accordingly. In addition, there are six recommendations for the school, four for the teachers and two for the future study.

NÁZEV DIPLOMOVÉ PRÁCE V ANGLICKÉM JAZYCE Development of system and administration of tax duties in the Czech lands ABSTRACT The diploma thesis concerns the analysis of the evolution of the legal regulation of taxes and administrative fees, especially with their administration within the territory of the Czech Republic Selected few most important obligations, which the ruling class imposed on the population, are described. The evolution of taxes is mapped beginning with the 11th century, when the first states in the region of the current Czech Republic were forming (however, even earlier mentions can be found), and concluding with World War One, i.e. the end of the reign of the Hapsburg monarchy. The main focus of the thesis is to provide the analysis of tax obligations and their administration in the 19th century. The object of the research is the taxation system itself as a collection of individual taxes imposed on the population of a certain region, focusing only on certain taxes. Those were chosen using a criteria defined in the next part of the text. The first and most important criterion is the importance attached to the selected tax at the time of its creation and during the time it was in use, which usually equalled the size of the income the tax was able to bring to the royal budget. Whenever legal disciplines overlap interesting scenarios occur and differences in opinions create intellectual tension. One such interesting scenario occurs when employees’ rights are affected during a company’s liquidation or business rescue. The employees of a company are normally the last persons to find out that a company is struggling financially. They are also the only stakeholders who are in no position to negotiate their risk should the company be liquidated. It is therefore necessary to evaluate the rights given to employees during a company’s liquidation and business rescue. The fundamental ideologies of company law, insolvency law and labour law are challenged and examined to attempt a harmonizing result that respects the core of each discipline. It is crucial to determine whether an appropriate balance is struck between the interests of all the stakeholders of the company during these procedures. The aim of this thesis is to evaluate whether South Africa manages to strike this balance. If employee rights are protected whilst a company is restructured back to solvency and success, this balance will be struck. An evaluation will also be made whether employees are always better protected during business rescue than in liquidation. The study analyses employee rights in a company’s liquidation and during a company’s restructuring process. The comparative study of employee rights in liquidation and rescue is done with the jurisdictions of Australia and England – countries with similar procedures. Important conclusions show that South Africa protects employee rights during business rescue procedures the best. An appropriate balance is indeed struck between the interests of all stakeholders of a company during business rescue procedures and employees are most of the time better off after a restructuring than in a liquidation. Should the recommendations for law reform be implemented in our legislation, South Africa will overcome the few obstacles currently in its way to be seen as a world leader where employee rights are concerned in liquidation proceedings as well as business rescue.<br>Mercantile Law<br>LL.
