Abstract:
The survival in published form of a range of sermons commemorating the execution of Charles I provides an opportunity to examine the character and limits of political debate within the Church of Ireland. After 1688 the task of condemning the regicide of 1649 without seeming to question the legitimacy of the Revolution presented serious difficulties. In the longer term the anniversary ceased to be contentious, as defenders of the Hanoverian establishment appropriated much of the traditional Anglican rhetoric of obedience to lawful authority. That appropriation provides the context for a significant 30 January sermon by Jonathan Swift.

Abstract:
This article investigates the development of the use of texts and images in commemorating the regicide of Charles I , from private commemoration among Royalists during the Republic, to its official institution after the Restoration. The article will argue that the Office gave official sanction to an image of the virtuous suffering king which had been in existence even before his execution. The Office also presented a particular view of the king's moral character, the causes of the Civil War and the Restoration which was to become the accepted account expounded in commemorative sermons for the next 150 years. Drawing on Old Testament themes, the Office also aimed to point a political moral used by successive governments, namely that attacks on the established order incurred divine punishment.

Abstract:
It is hard to know what to think about Kant's ‘passionate sermons’ on capital punishment. Kant clearly feels that it is one of the most important punishments in the state's arsenal. But his vehement insistence on the necessity of execution strikes many readers as philosophically suspect. Critics argue that Kant's embrace of the death penalty is incompatible with, or at least not required by, the fundamental tenets of his moral and legal philosophy (Schwarzschild 1985; Merle 2000; Potter 2002; Hill 2003). These arguments typically employ one of two strategies. The first is to deny that execution is required by retribution in even a prima facie sense; arguments along this line typically question the coherence of Kant's doctrine of the ius talionis (Sarver 1997). The second is to show that there are inviolable moral principles that render the death penalty illegitimate; this criticism typically appeals to the value of human dignity or the right to life (Radin 1980; Pugsley 1981; Schwarzschild 1985; Merle 2000; Potter 2002). There is a third strategy that could be used to criticize Kant, although it is not aimed at him specifcally. This strategy invokes legal principles of fairness or due process. It asserts that, regardless of capital punishment's moral appropriateness or legitimacy, capital punishment is unjust due to the fallibility of legal actors and institutions (Nathanson 2001). Someone adopting the third strategy might claim that, while Kant's justifcation may be acceptable in principle, it fails to justify the death penalty in the world we live in.

Abstract:
Before his execution in 1859, the radical abolitionist John Brown wrote a series of prison letters that – along with his death itself – helped to cement the abolitionist aesthetic of emancipatory martyrdom. This article charts the adaptation of that aesthetic in antilynching protest literature during the decades that followed. It reveals Brown's own presence in antilynching speeches, sermons, articles, and fiction, and the endurance of the emancipatory martyr symbol that he helped to inaugurate. Between the 1880s and the 1920s, black and white writers imagined lynching's ritual violence as a crucifixion and drew upon the John Brown aesthetic of emancipatory martyrdom, including Frederick Douglass, Stephen Graham, James Weldon Johnson, Walter White, black Baptist ministers, and black educators and journalists. Fusing martyrdom and messianism, these antilynching writers made the black Christ of their texts an avenging liberatory angel. The testamentary body of this messianic martyr figure marks the nation for violent retribution. Turning the black Christ into a Brown-like prophetic sign of God's vengeful judgment, antilynching writers of the late nineteenth and early twentieth centuries warned of disaster, demanded a change of course, challenged white southern notions of redemption, and insisted that African Americans must reemancipate themselves and redeem the nation.

The 1772 execution of the Mohegan sailor Moses Paul served as the occasion for Samson Occom's popular Sermon, reprinted in numerous editions. Recent work by Ava Chamberlain seeks to recover Paul's version of events from contemporary court records. This article argues that Paul's "firsthand" account of the case and autobiographical narrative submitted in his appeal illustrate the importance of approaching confessional texts such as Paul's as fundamentally coauthored documents. I argue that both Occom's Sermon and Paul's Petition, which was cowritten with his attorney William Samuel Johnson, construct mediated, communal definitions of "Indianness" and provide an unintentional space for individual narrative autonomy.

Abstract:
Social distancing measures have been a key component in government strategies to mitigate COVID-19 globally. Based on official documents, this study aimed to identify, compare and analyse public social distancing policy measures adopted in Denmark and Sweden regarding the coronavirus from 1 March 2020 until 1 October 2020. A key difference was the greater emphasis on laws and executive orders (sticks) in Denmark, which allowed the country to adopt many stricter policy measures than Sweden, which relied mostly on general guidelines and recommendations (sermons). The main policy adopters in Denmark were the government and the Danish Parliament, whereas the Public Health Agency issued most policies in Sweden, reflecting a difference in political governance and administrative structure in the two countries. During the study period, Sweden had noticeably higher rates of COVID-19 deaths and hospitalizations per 100,000 population than Denmark, yet it is difficult to determine the impact or relative effectiveness of sermons and sticks, particularly with regard to broader and longer-term health, economic and societal effects.

Derrida insists that any effort to think theological–political power “in its possibility” must begin with the death penalty. In this paper, I revisit the death of Moses Paul, “an Indian,” executed in New Haven in 1772 for the murder of Moses Cook, a white man. The Mohegan minister Samson Occom delivered Paul’s execution sermon and accompanied him to the gallows. Revised, Occom’s sermon was one of the first works published by a Native American author in English. Occom suggests there can be a theological–political power that signals itself not by decreeing the death penalty, but by opposing it. Hence sovereignty can be thought, with and against Derrida, as the theologico-political power to restore life. By opposing death to grace, moreover, Occom achieves a division of sovereignties, creating an opening for Indigenous nations within the scaffolding of the settler state. Working in collaboration, then, Occom and Paul produce a political theology.

Britain now wear's the sock; the Theater's clean Transplanted hither, both in Place and Scene.Martin Butler and Jonathan Dollimore have recently documented the importance of drama in English political life before 1642. Such scholarship, however, has stopped cold at the great divide of 1642. Except for Lois Potter in “‘True Tragicomedies’ of the Civil War and Interregnum,” no one has considered the relationship between politics and theater while the theaters were officially closed. Scholars have thereby missed a seminal question in understanding the discourse and complex political maneuvering enveloping the act of regicide in 1649. What is the relationship between the theatrical tradition and the execution of Charles I?Even though historians frequently comment on the “tragic” nature of the execution of Charles I, thus far neither historian nor literary person has bothered to examine the immediate and popular reactions to the act of regicide. This is understandable. An odd mix of imaginative projection and verifiable fact enshrines the execution of Charles, and documentation is admittedly difficult. The available assortment of primary literature, however, indicates that many Englishmen responded to the execution as theater, more specifically, the dramatic genre of tragedy. A 1649 sermon (attributed to the Royalist Robert Brown) exemplifies both the tragic response to the act of regicide and the mid-century employment of the theatrical tradition: Brown describes the execution as “the first act of that tragicall woe which is to be presented upon the Theater of this Kingdome, likely to continue longer then the now living Spectators.”

Engaging contemporaneous ideas about how environmental factors could alter the surface of the human body, Samson Occom and Phillis Wheatley use language emphasizing the ostensible malleability of physical characteristics—what I call a symbolics of metamorphosis—to depict the formation of racial identities. For Occom, the beliefs his Anglo- and Native American contemporaries held about the status of the “red” Indian enable him to challenge colonial society's contradictory Christian epistemology in his 1772 A Sermon, Preached at the Execution of Moses Paul, an Indian. In her 1773 Poems on Various Subjects, Religious and Moral, Wheatley fuses ancient mythological beliefs and natural-historical axioms about the production of poetic genius and dark skin to characterize the black poet as an inevitable outcome rather than an anomalous exception. Drawing on the late-eighteenth-century notion of transformable race, this essay posits a historically specific model of critical race theory for interpreting early American literatures.

Somos naturalmente privilegiados. Vivemos no Planeta Água, cantado nos versos de Guilherme Arantes. Mais: moramos no Brasil, que detém 12% da água potável disponível no mundo. Isso não nos impede de sermos diariamente confrontados com problemas humanos relacionados à água. Problemas que encontram gênese nas desigualdades regionais brasileiras, perpassando por problemas sistêmicos de captação e distribuição, tratamentos precários e desperdícios. Mas essa não é uma jabuticaba. A escassez de água no mundo e a falta de atenção a essa commodity fundamental à vida humana fizeram com que a Organização das Nações Unidas, em sua Assembleia Geral do dia 28 de julho de 2010, reconhecesse o acesso à água limpa e segura e ao saneamento básico, direitos humanos fundamentais (Resolução nº 64/292). Neste ano, o 8° Fórum Mundial da Água, realizado em Brasília, uma vez mais lançou luzes sobre a questão da crise hídrica mundial. O Conselho Nacional do Ministério Público, atento a todas essas questões, realizou o seminário “Água, Vida e Direitos Humanos”, debatendo com a sociedade civil, Poder Legislativo, Executivo, Judiciário e com o próprio Ministério Público problemas e soluções relacionados à água. Para manter a atenção da comunidade jurídica e acadêmica sobre o tema, a Revista do Conselho Nacional do Ministério Público do ano de 2018 tem como tema Água, Vida e Direitos Humanos à luz dos riscos socioambientais. Gdańsk hospitals of the 16th to 18th century and the protestant spirituality Hospitals of the Middle Ages and the Modern era adopted the rule of helping people in need as their basis of operations, especially in the scope of social care over orphans, the poor, widows, the crippled and the elderly. This article aims at sketching the phenomenon of changes undergoing in the sphere of spiritual life in protestant hospitals with the hospital foundations in Gdańsk of the 16th to the 18th century as example. In the Modern era, hospital foundations in Gdańsk constituted a continuation of basic moral values propagated in the hospitals of the 14th and the 15th centuries. Similarly to the Medieval period, the resident of a protestant hospital should be pious, humble and not incite strife. Basic instruments serving the creation of proper models included: community prayer and pastoral service. Providers managing the hospitals were depicted as persons looking after their mentees as well as executing obedience to the rules of hospital laws from the residents. Significant changes in the spiritual life comprised a withdrawal from the importance of prayers said by the poor hospital residents on behalf of the donors, following the notion of negating the participation of good deeds in the act of salvation of humans. It was accompanied by the phenomenon of desacralisation of poverty, which from then on did not constitute any value in itself. The effect of it was the sacralisation of work presented as one of the most important moral precepts. Preachers serving in hospitals did not occupy any prominent positions in the structures of protestant Gdańsk, although working in hospitals would sometimes become a starting point for further career. It seems that a person of beliefs guaranteeing the nurture of orthodox protestant teachings would rather be chosen for the position of a hospital priest. It may be indicated, for instance, by the opposition of a number of hospital preachers against pietistic novelties in the 18th century. It is also important to note the fact that in certain cases (the House of Charity and Orphans or the Institute of the Poor) both the protestant and catholic care existed there. The hospital community was characterised by certain conservatism, which indicated, among others, by preserving pre‑reformation relics in terms of hospital shrines decor. A new decorum, in the reformed spirit, would often be adopted by those churches only after significant devastation resulting from random events (wars, fires). In such cases, the iconography focused on the figure of Christ and biblical scenes known from the lecture of the Holy Script during church services. It indicates the role of paintings in hospital churches, which constituted a visual foundation for sermons enriching the residents spiritually. However, works thematically referring to the virtue of compassion were sparse. It probably resulted from the didactic functions of the art of hospital shrines, which was directed mostly towards the residents and not the potential donors. Influence of the reformation was also indicated by reorienting the shrine space, due to which the pulpit became the place focusing the attention of believers, just like in other protestant churches. Field pulpits established outside were distinctive elements of hospital shrines (at the churches of: the Lazaret, All God’s Angels and Corpus Christi). Intervention of the secular factor (the city council) in hospital life resulted from the sense of responsibility of the city authorities for propagating the model of a good Christian. More broadly speaking, the expectations of hospital community members were identical with those of the city council towards urban community members. The rhetoric used in hospital ordinances was therefore the same as the rhetoric of hospital ordinances issued for the whole of Gdańsk by the city council. Still, the need to constantly call for the authorities to participate in church services and the permanent detailed mentioning the forbidden acts in hospital ordinances constitutes the basis for the assumption that hospital communities did not fully follow the propagated moral precepts. Similarly, maintaining remuneration for as long as to the 19th century (admitting to hospitals for money), steeply criticised in the reformation period as a manifestation of particular pathology of hospital functions, demonstrates the discord between protestant ideals and the realistic possibility of implementing them.

ISBN: 9780830853243. *With a long career (of some 40 years) and even longer paper trail (approximately 94 books with all but one surviving, between 4,000-10,000 sermons with approximately 950 available still, and nearly 300 letters extant), Augustine holds a central position as one of the most influential of theologians. He is quoted often--and too often as an authoritative proof text for one's favored position. Yet he is not often well understood. Enigmatic and difficult to parse at times, he inhabited a different world than our own. He even inhabited a different world than his own contemporaries, offering innovative and profound challenges that many could not comprehend. This was clearly the case when his great and arduous work, The City of God, was appropriated by Charlemagne's court in the eighth century to defend the creation of the Holy Roman Empire. Augustine's counterintuitive position and his difficult and drawn-out argument made it difficult for them to comprehend how that work not only did not support their position, it profoundly challenged its very foundations. *In some ways, Augustine's reflections on Genesis 1-3 present a similar challenge. Arguably, they are even more difficult to understand and the potential for misunderstanding is indeed high. Augustine's doctrines of creation evolves over his forty-year career and is found in five works (or major sections of works) dedicated to the subject, with numerous comments critical to unravelling his views found in diverse other works (including sermons, rarely read). Translating Augustine is not just a linguistic activity, it is a wholesale, conceptual challenge. Yet as much as he is employed and has had major impact, it is a necessity! *Gavin Ortlund has commendably thrown himself into this challenge and provided a work that is, in many ways, admirable and important. We ought to split his work into two parts, which the table of contents does not make adequately clear. The first chapter, quite long, serves as a prolegomenon attempting a synthetic overview of Augustine's cosmology. Readers here should note that cosmology is a term that one finds regularly in discussions of ancient and medieval approaches to the cosmos, but the term does not signify its current meaning. Cosmology for ancients was a theological and philosophical activity which reasoned through the underlying metaphysics, driving and defining the cosmos. The subsequent chapters, two to five, focus rather on the book's main aim: offering lessons on impact and import for current concerns, as a form of "retrieval" per the title. The distinction between these two sections, that is, chapter 1 and chapters 2-5, is critical, though. For while I found multiple challenges and difficulties with the first section of the work, I would not want that to pre-empt the reader from looking closer as I have virtually nothing but commendation and praise for the major portion of the book, which I will address further down. *Chapter 1 seeks to outline Augustine's cosmology, which is complex, diffused, develops and alters over time, deeply embedded in the philosophical concerns and scientific views of his day without always self-evidently manifesting the views (for example, Stoic physics) and, as noted above, located across a vast corpus of writing and preaching. This is an ambitious task, and perhaps one that no single chapter can meet adequately. I suspect that Ortlund experienced distress over the magnitude of this challenge. However, the way in which he seeks to meet it belies a problem with the work. Who is it written for, the specialist or the student? If the latter, then why does this initial chapter use highly technical language and ideas that will not be readily accessible to those not trained in ancient metaphysics? Yet it is also not apparently written for the specialist, since it leaves out or fails to adequately emphasize core ideas that a specialist would expect to find. Specialists might also be frustrated by how his synthetic treatment relies in places on the work of other commentators and translators and, as a result, evinces some key misunderstandings. These include, for example, tying Augustine's doctrine of deification to immutability, misunderstanding some of the nuances of Augustine's Latin (such as temeritas on p. 88), depending on the translator's interpretive work (for example, presenting Augustine as naming the tree of knowledge of good and evil an apple tree, whereas the Latin is the generic "fruit tree"; it became an apple tree later in Medieval Europe), not sufficiently addressing ontology and privation--central to Augustine's theology--and thereby not appropriately addressing the building blocks of his cosmology, and not always accounting for forty years of personal development as if works from early in Augustine's career could readily be read beside those from late in his life, without sufficiently acknowledging Augustine's growth and development. *Yet, despite its technical shortcomings, the chapter also reads more like a doctoral dissertation written for a narrow committee of specialists, focused on minutiae and using untranslated terms (such as logos spermatikos) that only scholars would value and easily grasp. For a work written apparently as an undergraduate textbook and for informed lay readers, it presents highly technical topics and uses scholarly traditions which make it harder for the nontechnically trained reader to easily approach the subject (such as using the Latin titles of Augustine's works in the footnotes). It lacks tools that would help students: there is no bibliography of works cited or a list of Augustine's relevant works or a substantial index (the brief index does not do his work justice, causing me to think, after an initial cursory glance, that he failed to address key issues which he does, in fact, address). Ortlund clearly wants to make Augustine accessible, but I fear this initial chapter, navigating between technical approaches and synthetic overview, in combination with these other weaknesses, does not readily accomplish that goal. *In addressing questions of concern to modern readers throughout chapters 2-5, however, Ortlund hits his stride. These address valuable, appropriate matters critical to numerous communities: Augustine's (surprising) model of humility on how one interprets Genesis 1-3 (in chap. 2 of the book); Augustine's hermeneutical management of the introductory chapters of Genesis (in chap. 3); the epic challenge of animal death and predation (in chap. 4); and the truly knotty problem of a historic Adam and Eve (in chap. 5). All offer depth, thoughtful engagement, and enrichment and are critical companions to the discussions that preoccupy readers of this journal and dominate many pulpits, church pews, classrooms, youth groups, and the like. The section is capped off with a conclusion which I found to be winsome and profound. It reiterates the key lessons Ortlund finds: the wonder at sheer createdness; humility concerning the doctrine of creation encouraging irenic behavior; acknowledging the complexity involved in interpreting the opening chapters of Genesis; the existence of different, rational intuitions about key matters which we should ourselves note, including the example here of animal death; resisting a tendency to choose in absolute terms between history and symbol, and thereby allowing for ambiguity and incompleteness (the opening of Genesis does not seek to answer every question we wish to pose). While I have noted concerns about the first chapter adequately making Augustine accessible in this book, Ortlund has certainly succeeded at demonstrating topics for which Augustine's thought and model is applicable and important. *Meanwhile, it is also critical that one attempt to translate Augustine's thought for modern readers. Ortlund reminds us of the import of bringing an author as influential and seemingly familiar--but really rather distant and difficult--as Augustine to a modern audience and, moreover, doing so without falling into the trap of simply appropriating the audience's ideas. By engaging Augustine's core set of ideas with integrity and appropriate attention to context, Ortlund helps identify and clarify Augustine's contemporary significance. *Reviewed by Stanley P. Abstract:
Shainool Jiwa’s The Rise of a Muslim Empire is a two-volume historical work on the legacy of the Fatimid Empire. The first volume surveys the religious and sociopolitical underpinnings of Fatimid rule from its North African establishment in 909 to its transition to Egypt in 969. Jiwa’s second vol- ume focuses on the pinnacle of Fatimid society up until its decline from 969-1171. This review pertains to the first of the two volumes. Working within this phase, Jiwa details the reigns of the first four Imams: ‘Abd Allāh al-Mahdī, Abū’l-Qāsim Muḥammad, Ismāʿīl al-Manṣūr, and al-Muʿizz li- Dīn Allāh. The second book, which is titled The Fatimid Rule from Egypt, discusses the latter ten Imams (4). The first chapter covers the origins of the Fatimids in respect to both religious and geographical contexts. Jiwa starts by providing the historical background of Ismaili Shiism. Here, everything from the succession crisis of 632 CE to the emergence of the different strands of Shiism are discussed. Jiwa describes the Ismaili sect as having held Ismāʿīl, the eldest son of Jaʿfar al-Ṣādiq, to have been the chosen successor of his father, therefore mak- ing him Imam. Ismāʿīl’s ephemeral mortality caused for the Imamate to then pass over to his young son, Muḥammad b. Ismāʿīl, eponym of the sect (10). The Twelvers are described as having believed in the Imamate of Jaʿfar’s youngest son, Mūsā, whose lineage gives root to the Imams of Twelver Shiism. Jiwa characterizes Ismaili beliefs as having rested on dawr al-satr (period of concealment) and daʿwa (religio-political mission) (11). The dawr al-satr refers to the Imams going into hiding with only their most trusted followers knowing their true identities. Subsequently, these follow- ers promoted the recognition of these hidden Imams, which in large part refers to daʿwa (the act of inviting). Jiwa explains that during dawr al-satr (765–909 CE) Ismaili doctrine had spread as far as from Yemen to Ifriqiya (modern-day Tunisia and eastern Algeria) (12), with its most prominent adherents being the Kutama Berbers of North Africa. Under the teachings of Abū ‘Abd Allāh al-Shīʿī, a pronounced Ismaili dāʿī (inviter), the Kutama had aspired to establish the dawlat al-ḥaqq (the righteous state) (16). This aspiration materialized under the allegiance of ‘Abd Allāh al-Mahdī who had been pronounced as Imam by his predecessor and later recognized as the mahdī (messianic figure) (20). This belief, nonetheless, was not accepted by all Ismailis, particularly those following Ḥamdān Qarmaṭ, who later came to be known as the Qaramiṭa (21). Sa- lamiyya (a town located in Syria), the town where ‘Abd Allāh al-Mahdī had resided, became unsafe due to Abbasid persecution, causing the Imam to migrate to various locations and eventually Sijilmasa (22). Meanwhile, the Kutama had grown to such a force that they had been able to seize control over Qayrawān of North Africa under the leadership of al-Shīʿī (22). When al-Mahdī was later arrested in Sijilmasa and the news spread to the Kuta- ma, a campaign of soldiers marched to secure his release and bring him to Qayrawān. Having accomplished this, the Fatimid State came into fruition (22). Jiwa provides sources detailing the events which led up to the Fatim- id establishment, including eyewitness accounts from Jaʿfar al-Ḥājib’s Sīrat Jaʿfar al-Ḥājib, secondary sources such as Aḥmad b. Ibrāhīm al-Naysābūrī’s Istitār al-Imām (‘The Concealment of the Imam’), and other historical works such as the influential Iftitāh al-daʿwa wa-ibtidāʿ al-dawla (‘Com- mencement of the Mission and the Beginnings of the State’) authored by Abū Ḥanīfa al-Nuʿmān (29-30). These references help readers pinpoint who was instrumental in recording Fatimid history. In chapter two, Jiwa discusses the establishment of the Fatimid state, giving details of its institutions, processes, and hallmark locations. Al-Mah- dī is seen to have incorporated officials who had previously served the Aghlabids (the previous rulers of Qayrawān). In addition, institutions such as maẓālim (oppressive acts) courts are discussed as having been estab- lished to provide redress for ordinary civilians against abuses of power (35). During this time of development, dissension amongst the Kutama is seen to have imploded on the basis of marginalized sentiments. Once having been one of the most loyal dāʿīs to al-Mahdī, al-Shīʿī had led a rebellion against his former Imam on charges of being a false mahdī. Ultimately this campaign was pacified, resulting in the execution of al Shīʿī. This chapter also reveals new characters who later became prominent figures in Fatimid history. The heir apparent or Prince Abū’l-Qāsim Muḥammad, the eldest son of al-Mahdī, already took up much of his father’s duties while his own son, Ismāʿīl or al-Manṣūr bi’llāh (‘the One Who is Victorious by God’) was entrusted by the sitting Imam, al-Mahdī (his grandfather), as his most faithful confidant (39). The port city of al-Mahdiyya which had been con- structed by the Fatimids in 916 is described as having been unique in its architectural design and strategic in its location. Al-Mahdiyya served as the new Mediterranean capital and had secured the Fatimids a booming com mercial fabric. Similarly, the city of Palermo in Sicily had been occupied by the Fatimids and had also brought a great deal of cultural exchange and goods. Jiwa brings out images of palaces and charts out maps of the port city to provide visual comprehension of the architecture. Chapter three surveys the reign of al-Manṣūr, discussing his ascension to power under fraught circumstances and his construction of a new city. This chapter focuses attention on the reconstruction of Palermo in vivid archaeological detail. Readers are informed of the Khariji rebellion from Ifrīqiya spearheaded by Abū Yazīd al-Nukkarī. The Kharijis are described to have been insurmountable by the Fatimids, pushing their Empire as far back as to the Mediterranean coast of al-Mahdiyya (60). It was not until al-Ḥasan b. ‘Alī al-Kalbī, the governor of Tunis, and his army pushed back against the Kharijis that the North African coastland would be recaptured (61). Despite this, the Kharijis were too difficult to overcome and remained at conflict with the Fatimids up until the death of Abū’l-Qāsim. Fearful that news of Abū’l-Qāsim’s death would puncture the morale of the Fatimid war effort, al-Manṣūr had managed to keep the news of his father’s passing silent. After an eventful encounter, al-Manṣūr would eventually go on to defeat Abū Yazīd’s army and restore Fatimid rule. Following this victory, al-Manṣūr began taking restorative measures to recover the now war-torn society. Socially considerate policies such as charity stipends, the appoint- ment of a Sunni-based Maliki judge, and omission of taxes were all strides in this effort. But the most significant of his developments was the con- struction of a new capital called Manṣūriyya. Much of this city’s structural inspiration came from the North African ancient ruins al-Manṣūr had been enchanted by (68). Jiwa’s training as a historian is evident in how she cites primary sources every chance she gets, from sermons to testimonies. Clos- ing this chapter, Jiwa provides an anecdote recorded by al-Nuʿmān which romantically relays the moment al-Manṣūr knew that his son, al-Muʿizz li-Dīn Allāh, was ready to ascend to power (77). Jiwa’s anecdotes connect the reader to the ethos of Fatimid personalities. Chapter four delves into the reign of al-Manṣūr’s heir, al-Muʿizz (953- 75), who came into conflict with both the Umayyads and the Byzantines during his reign and would later live out his final days in his new capital, al-Qāhira al-Muʿizziya (‘the Victorious City of al-Muʿizz’)—modern-day Cairo (78). Beyond the royal family, Jiwa presents key stalwarts that the Em- pire was indebted to. Once servant to al-Mahdī, Jawhar, who was of Slavic origin, had risen through the ranks (serving both as scribe and commander in battle), eventually being entrusted with many honorable state positions. This chapter is the longest one of the book and attempts to accomplish many things. Along with discussing the battles which ensued during this juncture, Jiwa also fleshes out the theology of Ismaili beliefs. Al-Nuʿmān is said to have written extensively on the topic—including his text written between 958 and 960, Daʿā’im al-Islām (‘Pillars of Islam’), which delineates such fundamental concepts to Ismaili theology as walāya (allegiance and obedience), īmān (faith), ẓāhir (exoteric), and bāṭin (esoteric) (88-89). The early Fatimid age is described as having been a milieu of knowledge seek- ing, with debates and lectures taking place on a frequent basis. Through the majālis (teaching sessions) program, the Ismaili doctrine would proliferate to the broader society. Jiwa’s text is filled with firsthand accounts which describe Fatimid institutions, ceremonies, and events, providing vivid pic- tures of what is being described (e.g., al-Nuʿmān’s description of the grand circumcision ceremony hosted in 962 and Ibn Haytham’s description of the diversity of attendees and tailoring of lessons in the majālis by teach- ers such as Aflaḥ b. Hārūn al-Mālūsī, 95). The tension between the Uma- yyads in Spain and the Fatimids is also presented in this chapter, depicted as stemming from their varying loyalties in the rivalry between ‘Alī b. Abī Ṭālib and Muʿāwiya. The coastal regions of the Mediterranean and North Africa would see many conflicts between the Fatimids and Umayyads; the Umayyads and the Byzantines worked together to suppress their Fatimid adversary, with the Byzantines launching campaigns on the parts of the Empire closest to Sicily while the Umayyads attacked the most western part. After briefly losing parts of their North African territories, the Fatimids eventually reasserted their control over the Maghrib, leaving the Umayyads no choice but to resort to a peace treaty (103). The Ismaili daʿwā reached far and wide, with its message gaining adherents from the Gulf of Yemen to as far as Sind. Jiwa also describes the Kalbid dynasty of Fatimid Sicily, which had come under the governorship of al-Ḥasan al-Kalbī. During this period (960-65), Sicily had been the site of intense warfare between the Fatimids and the Byzantines, with two distinct battles resulting in the most pivotal outcomes for the region, namely the Pit and the Straits (119). Like the Umayyads, the Byzantines would also later come to negotiate terms of peace with the Fatimids in 958 (116). Chapter five speaks to the venture the Fatimids made into Egypt in 966. Here, readers are presented with the terms acknowledged by local nobles such as Sharīf Abū Jaʿfar Muslim al-Ḥusaynī and the Fatimids, the founding of the new capital (al-Qāhira), and the relocation of al-Muʿizz along with a significant portion of the Manṣūriyyan population in 972. The chapter serves as both a close to the book and a cliffhanger for the second volume of the series (which turns to Fatimid rule in Egypt under the son of al-Muʿizz, Niẓār b. al-Muʿizz). Capturing the cohesive religious fabric of Fatimid rule, Jiwa notes that al-Muʿizz pledged to maintain Sunni religious life while ruling over Egypt (126); she describes pillars of Sunni Islam that can serve as points of contrast to the Ismaili tradition (127). Individuals who can justly be seen as archetypes of the Fatimid intel- ligentsia are referenced both biographically and through their works. Jiwa introduces her readers to eminent characters including missionaries like Abū Yaʿqūb al-Sijistānī of Khurāsān (d. after 971); writers and thinkers who composed the Fatimid ideology such as Qāḍī al-Nuʿmān; poets who gave inspiration such as Muḥammad b. Hānī; and generals who rendered their lives for the Fatimid Empire such as al-Ḥasan b. ‘Ali al-Kalbī. Although some readers may be frustrated by the detail of jumping back and forth across names, dates, and events, those who are able to follow the work the- matically will certainly find this work to be nothing short of informative. Jiwa impressively condenses a rich and fluid history into few pages while including the most essential elements, people, and institutions making up this period. Readers are provided with visual aids (maps, family tree charts, and city maps) to help identify and locations and structures which would otherwise come off as abstract and jargon-heavy. Al-Nuʿmān is said to have written extensively on the topic—including his text written between 958 and 960, Daʿā’im al-Islām (‘Pillars of Islam’), which delineates such fundamental concepts to Ismaili theology as walāya (allegiance and obedience), īmān (faith), ẓāhir (exoteric), and bāṭin (esoteric) (88-89). The early Fatimid age is described as having been a milieu of knowledge seek- ing, with debates and lectures taking place on a frequent basis. Through the majālis (teaching sessions) program, the Ismaili doctrine would proliferate to the broader society. Jiwa’s text is filled with firsthand accounts which describe Fatimid institutions, ceremonies, and events, providing vivid pic- tures of what is being described (e.g., al-Nuʿmān’s description of the grand circumcision ceremony hosted in 962 and Ibn Haytham’s description of the diversity of attendees and tailoring of lessons in the majālis by teach- ers such as Aflaḥ b. Hārūn al-Mālūsī, 95). The tension between the Uma- yyads in Spain and the Fatimids is also presented in this chapter, depicted as stemming from their varying loyalties in the rivalry between ‘Alī b. Abī Ṭālib and Muʿāwiya. The coastal regions of the Mediterranean and North Africa would see many conflicts between the Fatimids and Umayyads; the Umayyads and the Byzantines worked together to suppress their Fatimid adversary, with the Byzantines launching campaigns on the parts of the Empire closest to Sicily while the Umayyads attacked the most western part. After briefly losing parts of their North African territories, the Fatimids eventually reasserted their control over the Maghrib, leaving the Umayyads no choice but to resort to a peace treaty (103). The Ismaili daʿwā reached far and wide, with its message gaining adherents from the Gulf of Yemen to as far as Sind. Jiwa also describes the Kalbid dynasty of Fatimid Sicily, which had come under the governorship of al-Ḥasan al-Kalbī. During this period (960-65), Sicily had been the site of intense warfare between the Fatimids and the Byzantines, with two distinct battles resulting in the most pivotal outcomes for the region, namely the Pit and the Straits (119). Like the Umayyads, the Byzantines would also later come to negotiate terms of peace with the Fatimids in 958 (116). Chapter five speaks to the venture the Fatimids made into Egypt in 966. Here, readers are presented with the terms acknowledged by local nobles such as Sharīf Abū Jaʿfar Muslim al-Ḥusaynī and the Fatimids, the founding of the new capital (al-Qāhira), and the relocation of al-Muʿizz along with a significant portion of the Manṣūriyyan population in 972. The chapter serves as both a close to the book and a cliffhanger for the second volume of the series (which turns to Fatimid rule in Egypt under the son of al-Muʿizz, Niẓār b. al-Muʿizz). Capturing the cohesive religious fabric of Fatimid rule, Jiwa notes that al-Muʿizz pledged to maintain Sunni religious life while ruling over Egypt (126); she describes pillars of Sunni Islam that can serve as points of contrast to the Ismaili tradition (127). Individuals who can justly be seen as archetypes of the Fatimid intel- ligentsia are referenced both biographically and through their works. Jiwa introduces her readers to eminent characters including missionaries like Abū Yaʿqūb al-Sijistānī of Khurāsān (d. after 971); writers and thinkers who composed the Fatimid ideology such as Qāḍī al-Nuʿmān; poets who gave inspiration such as Muḥammad b. Hānī; and generals who rendered their lives for the Fatimid Empire such as al-Ḥasan b. ‘Ali al-Kalbī. Although some readers may be frustrated by the detail of jumping back and forth across names, dates, and events, those who are able to follow the work the- matically will certainly find this work to be nothing short of informative. Jiwa impressively condenses a rich and fluid history into few pages while including the most essential elements, people, and institutions making up this period. Readers are provided with visual aids (maps, family tree charts, and city maps) to help identify and locations and structures which would otherwise come off as abstract and jargon-heavy. Abstract:
During the invasion of the Baltic provinces between 1915 and 1918, a large swathe of territory and its population fell under German control: this included Orthodox parishes and their priests. The clergy and laity thus had to face many new challenges: the behaviour of occupation forces, material deprivations, and the actions of Lutheran clerical and secular elites in the new context. This article focuses on the response to the advance of the German armies in 1915 and 1916 into the Baltic. On the one hand, the article addresses the preparation and execution of the evacuation of the clergy and the rhetoric that underpinned the process of evacuation. On the other hand, it examines the problem of the church life under occupation. As evident from the sermons and articles published in the ecclesiastical press, the Germans represented a major threat to the Orthodox faith, clergy, and church property. Thus most Orthodox institutions were evacuated from the Baltic in 1915. Finally, the article discusses the position of the Orthodox Church during German occupation of the Estonian islands seized by the imperial German navy on 3 November 1917 from the perspective of parish priests. The article is based on the letters written by priests to the bishop of Riga and provides a complex picture of the German occupation, much of which differs from the representation of Germans in Russian war propaganda. Most priests represented the German forces as being relatively respectful towards churches and the clergy: their main complaint against the soldiers was the seizure of food, horses, and property, with the concomitant disruptions and discomforts this caused. The more serious threat to Orthodoxy, according to this evidence, came not from Germans but from the Lutheran clergy, who allegedly used the opportunity afforded by the invasion to undermine the Orthodox Church’s position. This publication will provide a unique insight into religion under occupation during the First World War, revealing the difficulties of maintaining everyday religious life in a multiconfessional region during and after invasion.

The major square was based on a procession of the reprobates, led to a public square generally and on the pronunciation of a sermon, followed of the execution of the judgment, in which it could have condemned in the bonfire, function that realized the secular arm. These executions were realized both in the territories of Spain and Portugal and in his colonies.

Stuart Rosenberg, who served from 1956 to 1976 as rabbi of Beth Tzedec Synagogue in Toronto, enjoyed a meteoric rise and suffered as precipitate a fall. A charismatic speaker with a powerful personality, Rosenberg presided over Beth Tzedec as if he were the chief executive of a corporation. The activities he initiated in the synagogue and his high profile in the Jewish and general communities put Beth Tzedec “on the map,” making it, for a time at least, Canada’s premier Jewish religious institution. During his early years at Beth Tzedec, Rabbi Rosenberg published two books of sermons: Man Is Free: Sermons and Addresses and A Time to Speak: Of Man, Faith and Society. Both were widely distributed to colleagues and congregants. His only collections of sermons can be viewed as his written testament. Read from the perspective of a half-century later, the sermons are clearly documents of their time and place. They reflect the well-known, mostly sociological literature on religion, Toronto, and the Conservative Movement written during the 1950s and earlier, as well as the history and mood of the congregation itself. Read in the light of Rabbi Rosenberg’s rise and fall at Beth Tzedec, these sermons appear to be both his platform for early success and a prophecy of his sudden downfall.

IntroductionAccounts of criminals, their victims, and their pursuers have become entrenched within the sphere of popular culture; most obviously in the genres of true crime and crime fiction. The centrality of the pursuer in the form of the detective, within these stories, dates back to the nineteenth century. This, often highly-stylised and regularly humanised protagonist, is now a firm feature of both factual and fictional accounts of crime narratives that, today, regularly focus on the energies of the detective in solving a variety of cases. So familiar is the figure of the detective, it seems that these men and women—amateurs and professionals—have always had an important role to play in the pursuit and punishment of the wrongdoer. Yet, the first detectives were forced to overcome significant resistance from a suspicious public. Some early efforts to reimagine punishment and to laud the detective include articles written by Charles Dickens; pieces on public hangings and policing that reflect the great Victorian novelist’s commitment to shed light on, through written commentaries, a range of important social issues. This article explores some of Dickens’s lesser-known pieces, that—appearing in daily newspapers and in one of his own publications Household Words—helped to change some common perceptions of punishment and policing. A Reliance on the Scaffold: Early Law Enforcement in EnglandCrime control in 1720s England was dependent upon an inconsistent, and by extension ineffective, network of constables and night watchmen. It would be almost another three decades before Henry Fielding established the Bow Street Foot Patrol, or Bow Street Runners, in 1749, “six men in blue coats, patrolling the area within six miles of Charing Cross” (Worsley 35). A large-scale, formalised police force was attempted by Pitt the Younger in 1785 with his “Bill for the Further prevention of Crime and for the more Speedy Detection and Punishment of Offenders against the Peace” (Lyman 144). The proposed legislation was withdrawn due to fierce opposition that was underpinned by fears, held by officials, of a divestment of power to a new body of law enforcers (Lyman 144).The type of force offered in 1785 would not be realised until the next century, when the work of Robert Peel saw the passing of the Metropolitan Police Act 1829. The Police Act, which “constituted a revolution in traditional methods of law enforcement” (Lyman 141), was focused on the prevention of crime, “to reassure the lawful and discourage the wrongdoer” (Hitchens 51). Until these changes were implemented violent punishment, through the Waltham Black Act 1723, remained firmly in place (Cruickshanks and Erskine-Hill 359) as part of the state’s arsenal against crime (Pepper 473).The Black Act, legislation often referred to as the ‘Bloody Code’ as it took the number of capital felonies to over 350 (Pepper 473), served in lieu of consistency and cooperation, across the country, in relation to the safekeeping of the citizenry. This situation inevitably led to anxieties about crime and crime control. In 1797 Patrick Colquhoun, a magistrate, published A Treatise on the Police of the Metropolis in which he estimated that, out of a city population of just under 1 million, 115,000 men and women supported themselves “in and near the Metropolis by pursuits either criminal-illegal-or immoral” (Lyman 144). Andrew Pepper highlights tensions between “crime, governance and economics” as well as “rampant petty criminality [… and] widespread political corruption” (474). He also notes a range of critical responses to crime and how, “a particular kind of writing about crime in the 1720s demonstrated, perhaps for the first time, an awareness of, or self-consciousness about, this tension between competing visions of the state and state power” (Pepper 474), a tension that remains visible today in modern works of true crime and crime fiction. In Dickens’s day, crime and its consequences were serious legal, moral, and social issues (as, indeed, they are today). An increase in the crime rate, an aggressive state, the lack of formal policing, the growth of the printing industry, and writers offering diverse opinions—from the sympathetic to the retributive—on crime changed crime writing. The public wanted to know about the criminal who had disturbed society and wanted to engage with opinions on how the criminal should be stopped and punished. The public also wanted to be updated on changes to the judicial system such as the passing of the Judgement of Death Act 1823 which drastically reduced the number of capital crimes (Worsley 122) and how the Gaols Act, also of 1823, “moved tentatively towards national prison reform” (Gattrell 579). Crimes continued to be committed and alongside the wrongdoers were readers that wanted to be diverted from everyday events by, but also had a genuine need to be informed about, crime. A demand for true crime tales demonstrating a broader social need for crimes, even the most minor infractions, to be publicly punished: first on the scaffold and then in print. Some cases were presented as sensationalised true crime tales; others would be fictionalised in short stories and novels. Standing Witness: Dickens at the ScaffoldIt is interesting to note that Dickens witnessed at least four executions in his lifetime (Simpson 126). The first was the hanging of a counterfeiter, more specifically a coiner, which in the 1800s was still a form of high treason. The last person executed for coining in England was in early 1829; as Dickens arrived in London at the end of 1822, aged just 10-years-old (Simpson 126-27) he would have been a boy when he joined the crowds around the scaffold. Many journalists and writers who have documented executions have been “criticised for using this spectacle as a source for generating sensational copy” (Simpson 127). Dickens also wrote about public hangings. His most significant commentaries on the issue being two sets of letters: one set published in The Daily News (1846) and a second set published in The Times (1849) (Brandwood 3). Yet, he was immune from the criticism directed at so many other writers, in large part, due to his reputation as a liberal, “social reformer moved by compassion, but also by an antipathy toward waste, bureaucratic incompetence, and above all toward exploitation and injustice” (Simpson 127). As Anthony Simpson points out, Dickens did not sympathise with the condemned: “He wrote as a realist and not a moralist and his lack of sympathy for the criminal was clear, explicit and stated often” (128). Simpson also notes that Dickens’s letters on execution written in 1846 were “strongly supportive of total abolition” while later letters, written in 1849, presented arguments against public executions rather than the practice of execution. In 1859 Dickens argued against pardoning a poisoner. While in 1864 he supported the execution of the railway carriage murderer Franz Müller, explaining he would be glad to abolish both public executions and capital punishment, “if I knew what to do with the Savages of civilisation. As I do not, I would rid Society of them, when they shed blood, in a very solemn manner” (in Simpson 138-39) that is, executions should proceed but should take place in private.Importantly, Dickens was consistently concerned about society’s fascination with the scaffold. In his second letter to The Daily News, Dickens asks: round what other punishment does the like interest gather? We read of the trials of persons who have rendered themselves liable to transportation for life, and we read of their sentences, and, in some few notorious instances, of their departure from this country, and arrival beyond the sea; but they are never followed into their cells, and tracked from day to day, and night to night; they are never reproduced in their false letters, flippant conversations, theological disquisitions with visitors, lay and clerical […]. They are tried, found guilty, punished; and there an end. (“To the Editors of The Daily News” 6)In this passage, Dickens describes an overt curiosity with those criminals destined for the most awful of punishments. A curiosity that was put on vile display when a mob gathered on the concourse to watch a hanging; a sight which Dickens readily admitted “made [his] blood run cold” (“Letter to the Editor” 4).Dickens’s novels are grand stories, many of which feature criminals and criminal sub-plots. There are, for example, numerous criminals, including the infamous Fagin in Oliver Twist; or, The Parish Boy’s Progress (1838); several rioters are condemned to hang in Barnaby Rudge: A Tale of the Riots of Eighty (1841); there is murder in The Life and Adventures of Martin Chuzzlewit (1844); and murder, too, in Bleak House (1853). Yet, Dickens never wavered in his revulsion for the public display of the execution as revealed in his “refusal to portray the scene at the scaffold [which] was principled and heartfelt. He came, reluctantly to support capital punishment, but he would never use its application for dramatic effect” (Simpson 141).The Police Detective: A Public Relations ExerciseBy the mid-1700s the crime story was one of “sin to crime and then the gallows” (Rawlings online): “Crimes of every defcription (sic) have their origin in the vicious and immoral habits of the people” (Colquhoun 32). As Philip Rawlings notes, “once sin had been embarked upon, capture and punishment followed” (online). The origins of this can be found in the formula relied upon by Samuel Smith in the seventeenth century. Smith was the Ordinary of Newgate, or prison chaplain (1676–1698), who published Accounts of criminals and their gruesome ends. The outputs swelled the ranks of the already burgeoning market of broadsides, handbills and pamphlets. Accounts included: 1) the sermon delivered as the prisoner awaited execution; 2) a brief overview of the crimes for which the prisoner was being punished; and 3) a reporting of the events that surrounded the execution (Gladfelder 52–53), including the prisoner’s behaviour upon the scaffold and any last words spoken. For modern readers, the detective and the investigation is conspicuously absent. These popular Accounts (1676–1772)—over 400 editions offering over 2,500 criminal biographies—were only a few pence a copy. With print runs in the thousands, the Ordinary earnt up to £200 per year for his efforts (Emsley, Hitchcock, and Shoemaker online). For:penitence and profit made comfortable bedfellows, ensuring true crime writing became a firm feature of the business of publishing. That victims and villains suffered was regrettable but no horror was so terrible anyone forgot there was money to be made. (Franks, “Stealing Stories” 7)As the changes brought about by the Industrial Revolution were having their full impact, many were looking for answers, and certainty, in a period of radical social transformation. Sin as a central motif in crime stories was insufficient: the detective was becoming essential (Franks, “True Crime” 239). “In the nineteenth century, the role of the newly-fashioned detective as an agent of consolation or security is both commercially and ideologically central to the subsequent project of popular crime writing” (Bell 8). This was supported by an “increasing professionalism and proficiency of policemen, detectives, and prosecutors, new understandings about psychology, and advances in forensic science and detection techniques” (Murley 10). Elements now included in most crime narratives. Dickens insisted that the detective was a crucial component of the justice system—a figure to be celebrated, one to take centre stage in the crime story—reflecting his staunch support “of the London Metropolitan Police” (Simpson 140). Indeed, while Dickens is known principally for exposing wretched poverty, he was also interested in a range of legal issues as can be evinced from his writings for Household Words. Wills argued for the acceptance of the superiority of the detective when, in 1850, he outlined the “difference between a regular and a detective policeman” (368). The detective must, he wrote: “counteract every sort of rascal whose only means of existence it avowed rascality, but to clear up mysteries, the investigation of which demands the utmost delicacy and tact” (368). The detective is also extraordinarily efficient; cases are solved quickly, in one example a matter is settled in just “ten minutes” (369).Dickens’s pro-police pieces, included a blatantly promotional, two-part work “A Detective Police Party” (1850). The narrative begins with open criticism of the Bow Street Runners contrasting these “men of very indifferent character” to the Detective Force which is “so well chosen and trained, proceeds so systematically and quietly, does its business in such a workman-like manner, and is always so calmly and steadily engaged in the service of the public” (“Police Party, Part I” 409). The “party” is just that: a gathering of detectives and editorial staff. Men in a “magnificent chamber”, seated at “a round table […] with some glasses and cigars arranged upon it; and the editorial sofa elegantly hemmed in between that stately piece of furniture and the wall” (“Police Party, Part I” 409). Two inspectors and five sergeants are present. Each man prepared to share some of their experiences in the service of Londoners:they are, [Dickens tells us] one and all, respectable-looking men; of perfectly good deportment and unusual intelligence; with nothing lounging or slinking in their manners; with an air of keen observation, and quick perception when addressed; and generally presenting in their faces, traces more or less marked of habitually leading lives of strong mental excitement. (“Police Party, Part I” 410) Dickens goes to great lengths to reinforce the superiority of the police detective. These men, “in a glance, immediately takes an inventory of the furniture and an accurate sketch of the editorial presence” and speak “very concisely, and in well-chosen language” and who present as an “amicable brotherhood” (“Police Party, Part I” 410). They are also adaptable and constantly working to refine their craft, through apeculiar ability, always sharpening and being improved by practice, and always adapting itself to every variety of circumstances, and opposing itself to every new device that perverted ingenuity can invent, for which this important social branch of the public service is remarkable! (“Police Party, Part II” 459)These detectives are also, in some ways, familiar. Dickens’s offerings include: a “shrewd, hard-headed Scotchman – in appearance not at all unlike a very acute, thoroughly-trained schoolmaster”; a man “with a ruddy face and a high sun-burnt forehead, [who] has the air of one who has been a Sergeant in the army” (“Police Party, Part I” 409-10); and another man who slips easily into the role of the “greasy, sleepy, shy, good-natured, chuckle-headed, un-suspicious, and confiding young butcher” (“Police Party, Part II” 457). These descriptions are more than just attempts to flesh out a story; words on a page reminding us that the author is not just another journalist but one of the great voices of the Victorian era. These profiles are, it is argued here, a deliberate strategy to reassure readers.In summary, police detectives are only to be feared by those residing on the wrong side of the law. For those without criminal intent; detectives are, in some ways, like us. They are people we already know and trust. The stern but well-meaning, intelligent school teacher; the brave and loyal soldier defending the Empire; and the local merchant, a person we see every day. Dickens provides, too, concrete examples for how everyone can contribute to a safer society by assisting these detectives. This, is perfect public relations. Thus, almost singlehandedly, he builds a professional profile for a new type of police officer. The problem (crime) and its solution (the detective) neatly packaged, with step-by-step instructions for citizens to openly support this new-style of constabulary and so achieve a better, less crime-ridden community. This is a theme pursued in “Three Detective Anecdotes” (1850) where Dickens continued to successfully merge “solid lower-middle-class respectability with an intimate knowledge of the criminal world” (Priestman 177); so, proffering the ideal police detective. A threat to the criminal but not to the hard-working and honest men, women, and children of the city.The Detective: As Fact and as FictionThese writings are also a precursor to one of the greatest fictional detectives of the English-speaking world. Dickens observes that, for these new-style police detectives: “Nothing is so common or deceptive as such appearances at first” (“Police Party, Part I” 410). In 1891, Arthur Conan Doyle would write that: “There is nothing so deceptive as an obvious fact” (78). Dickens had prepared readers for the consulting detective Sherlock Holmes: who was smarter, more observant and who had more determination to take on criminals than the average person. The readers of Dickens were, in many respects, positioned as prototypes of Dr John Watson: a hardworking, loyal Englishman. Smart. But not as smart as those who would seek to do harm. Watson needed Holmes to make the world a better place; the subscriber to Household Words needed the police detective.Another article, “On Duty with Inspector Field” (1851), profiled the “well-known hand” responsible for bringing numerous offenders to justice and sending them, “inexorably, to New South Wales” (Dickens 266). Critically this true crime narrative would be converted into a crime fiction story as Inspector Field is transformed (it is widely believed) into the imagined Inspector Bucket. The 1860s have been identified as “a period of awakening for the detective novel” (Ashley x), a predictor of which is the significant sub-plot of murder in Dickens’s Bleak House. In this novel, a murder is committed with the case taken on, and competently solved by, Bucket who is a man of “skill and integrity” a man presented as an “ideal servant” though one working for a “flawed legal system” (Walton 458). Mr Snagsby, of Bleak House, observes Bucket as a man whoseems in some indefinable manner to lurk and lounge; also, that whenever he is going to turn to the right or left, he pretends to have a fixed purpose in his mind of going straight ahead, and wheels off, sharply at the very last moment [… He] notices things in general, with a face as unchanging as the great mourning ring on his little finger, or the brooch, composed of not much diamond and a good deal of setting, which he wears in his shirt. (278) This passage, it is argued here, places Bucket alongside the men at the detective police party in Household Words. He is simultaneously superhuman in mind and manner, though rather ordinary in dress. Like the real-life detectives of Dickens’s articles; he is a man committed to keeping the city safe while posing no threat to law-abiding citizens. ConclusionThis article has explored, briefly, the contributions of the highly-regarded Victorian author, Charles Dickens, to factual and fictional crime writing. The story of Dickens as a social commentator is one that is familiar to many; what is less well-known is the connection of Dickens to important conversations around capital punishment and the rise of the detective in crime-focused narratives; particularly how he assisted in building the professional profile of the police detective. In this way, through fact and fiction, Dickens performed great (if under-acknowledged) public services around punishment and law enforcement: he contributed to debates on the death penalty and he helped to build trust in the radical social project that established modern-day policing.AcknowledgementsThe author offers her sincere thanks to the New South Wales Dickens Society, Simon Dwyer, and Peter Kirkpatrick. Abstract:
This paper will discuss the way in which the creative component of my thesis Hannah’s Place uses a style of neo-historical fiction to find ‘good’ narratives in (once) ‘bad’ women, keeping with the theme, here paraphrased as: The work of any researcher in the humanities is to…challenge what is simply thought of as bad or good, to complicate essentialist categories and question passively accepted thinking. As a way of expanding this statement, I would like to begin by considering the following quote from Barthes on the nature of research. I believe he identifies the type of research that I have been involved with as a PhD candidate producing a ‘creative’ thesis in the field of Communications. What is a piece of research? To find out, we would need to have some idea of what a ‘result’ is. What is it that one finds? What is it one wants to find? What is missing? In what axiomatic field will the fact isolated, the meaning brought out, the statistical discovery be placed? No doubt it depends each time on the particular science approached, but from the moment a piece of research concerns the text (and the text extends very much further than the literary work) the research itself becomes text, production: to it, any ‘result’ is literally im-pertinent. Research is then the name which prudently, under the constraint of certain social conditions, we give to the activity of writing: research here moves on the side of writing, is an adventure of the signifier. (Barthes 198) My thesis sits within the theoretical framework of postmodern literature as a new form of the genre that has been termed ‘historical fiction’. Although the novel breaks away from and challenges the concept of the traditional ‘saga’ style of narrative, or ‘grand narrative’ within historical fiction, it is no less concerned with events of the past and the idea of past experience. It departs from traditional historical fiction in that it foregrounds not only an imagined fictional past world created when the novel is read, but also the actual archival documents, the pieces of text from the past from which traditional history is made, and which here have been used to create that world–‘sparking points’ for the fictional narrative. These archival documents are used within the work as intertextual elements that frame, and, in turn, are framed by the transworld characters’ homodiegetic narrations. The term ‘transworld character’ has been attributed to Umberto Eco and refers to any real world personages found within a fictional text. Eco defines it as the ‘identity of a given individual through worlds (transworld identity)…where the possible world is a possible state of affairs expressed by a set of relevant propositions [either true or untrue which] outlines a set of possible individuals along with their properties’ (219). Umberto Eco also considers that a problem of transworld identity is ‘to single out something as persistent through alternative states of affairs’ (230). In Postmodernist Fiction, Brian McHale also puts forward a number of definitions for ‘transworld identity’. For my purposes, I take it to mean both that defined by Eco but also the literary device, as defined by McHale, of ‘borrowing a character from another text’ (57). It is McHale who elaborates on the concept as it relates to historical fiction when he states: All historical novels, even the most traditional, typically involve some violation of ontological boundaries. For instance they often claim ‘transworld identity’ between characters in their projected worlds and real-world historical figures (16-17). Interestingly for the type of fiction that I am attempting to write, McHale also takes the idea into another area when he discusses the ontological levels of the historical dimension that transworld identities may undergo. Entities can change their ontological status in the course of history, in effect migrating from one ontological realm or level to another. For instance, real world entities and happenings can undergo ‘mythification’, moving from the profane realm to the realm of the sacred (36). For transworld identities, such as those within my novel, this may mean a change in status between the past, where they were stereotyped and categorised as ‘bad’ in contemporary newspapers (my intertext elements), to something in the present approaching ‘good’, or at least a more rounded female identity within a fictional world. The introduced textual elements which I foreground in my novel are those things most often hidden from view within the mimetic and hermeneutic worlds of traditional historical fiction. The sources re-textualised within my novel are both ‘real’ items from our past, and representations and interpretations of past events. The female transworld characters’ stories in this novel are imaginative re-interpretations. Therefore, both the fictional stories, as well as their sources, are textual interpretations of prior events. In this way, the novel plays with the idea of historical ‘fact’ and historical ‘fiction’. It blurs their boundaries. It gives textual equality to each in order to bring a form of textual agency to those marginalised groups defined by PF Bradley as the ‘host of jarring witnesses, [of history] a chaos of disjoined and discrepant narrations’ (Bradley in Holton 11): In the past in Australia these were lower class women, Aboriginals, the Irish, the illiterate, and poor agricultural immigrants whose labour was excess to Britain’s needs. Hannah’s Place – A Brief Synopsis Six individual women’s stories, embedded in or ‘framed’ by a fictional topographic artist’s journal, recount ‘real’ events from Australia’s colonial past. The journal is set in 1845; a few years after convict transportation to Australia’s eastern states ceased, and the year of the first art exhibition held in the colony. That same year, Leichhardt’s expedition arrived at Port Essington in Australia’s far north, after 12 months inland exploration, while in the far south the immigrant ship Cataraqui was wrecked one day short of arrival at Melbourne’s Port Phillip with the drowning of all but one of the 369 immigrants and 38 of the 46 sailors on board. Each chapter title takes the form of the title of a topographic sketch as a way of placing the text ‘visually’ within the artist’s journal narrative. The six women’s stories are: New South Wales at Last (Woman on a Boat): A woman arrives with a sick toddler to tent accommodation for poor immigrants in Sydney, after a three month sea voyage and the shipboard birth, death, and burial at sea of her baby daughter. Yarramundi Homestead, as Seen from the East: An ill-treated Irish servant girl on a squatter’s run awaits the arrival of her fiancée, travelling on board the immigrant ship Cataraqui. In the Vale of Hartley: In the Blue Mountains, an emancipist sawyer who previously murdered three people, violently beats to death his lover, Caroline Collitts, the seventeen-year-old sister of Maria, his fifteen-year-old wife. She Being Dead Yet Speaketh: In Goulburn, Annie Brownlow, a pretty 24-year-old mother of three is executed by a convict executioner for the accidental ‘murder’, while drunk, of her adulterous husband. The Eldest Daughter: The isolated wife of a small settler gives birth, assisted by Lottie, her eldest daughter, and Merrung, an Aboriginal midwife. On Wednesday Last, at Mr Ley’s Coach and Horses Hotel: In Bathurst, a vagrant alcoholic, Hannah Simpson, dies on the floor of a dodgy boarding house after a night and a day of falling into fits and ranting about her lifetime of 30 years migration. Historiographic Metafiction Has been defined by Linda Hutcheon as ‘Fiction which keeps distinct its formal auto-representation from its historical context and in so doing problematises the very possibility of historical knowledge… There is no reconciliation, no dialectic…just unresolved contradiction’ (106). Unresolved contradiction is one of the themes that surfaces in my novel because of the juxtaposition of archival documents (past text ‘facts’) alongside fictional narrative. Historiographic metafiction can usefully be employed as a means of challenging prior patriarchal narratives written about marginalised women. It allows the freedom to create a space for a new understanding of silenced women’s lives. My novel seeks to illuminate and problematise the previously ‘seamless’ genre of hical fiction by the use of (narrative) techniques such as: collage and juxtaposition, intertextuality, framing, embedded narrative, linked stories, and footnote intertext of archival material. Juxtaposition of the fiction against elements from prior non-fiction texts, clearly enunciated as being those same actual historical sources upon which the fiction is based, reinforces this novel as a work of fiction. Yet this strategy also reminds us that the historical narrative created is provisional, residing within the fictional text and in the gaps between the fictional text and the non-fictional intertext. At the same time, the clear narrativity, the suspenseful and sensationalised text of the archival non-fiction, brings them into question because of their place alongside the fiction. A reading of the novel questions the truthfulness or degree of reliability of past textual ‘facts’ as accurate records of real women’s life events. It does this by the use of a parallel narrative, which articulates characters whose moments of ‘breaking frame’ challenge those same past texts. Their ‘fiction’ as characters is reinforced by their existence as ‘objects’ of narration within the archival texts. Both the archival texts and the fiction can be seen as ‘unreliable’. The novel uses ex-centric transworld characters and embedded intertextual ‘fragments’ to create a covert self-reflexivity. It also confuses and disrupts narrative temporality and linearity of plot in two ways. It juxtaposes ‘real’ (intertextual element) dates alongside conflicting or unknown periods of time from the fictional narrative; and, within the artist’s journal, it has a minimal use of expected temporal ‘signposts’. These ‘signposts’ of year dates, months, or days of the week are those things that would be most expected in an authentic travel narrative. In this way, the women’s stories subvert the idea, inherent in previous forms of ‘historical’ fiction, of a single point of view or ‘take’ on history that one or two main characters may hold. The use of intertext results in a continued restating of multiple, conflicting (gender, race, and class) points of view. Ultimately no one ‘correct’ reading of the past gains in supremacy over any other. This narrative construct rearticulates the idea that the past, as does the present, comprises different points of view, not all of which conform to the ‘correct’ view created by the political, social and economic ‘factors’ dominant at the time those events happen. For colonial Australia, this single point of view gave us the myth of heroic (white male) pioneers and positioned women such as some of those within my fiction as ‘bad’. The fictional text challenges that of the male ‘gaze’, which constructed these women as ‘objects’. Examples of this from the newspaper articles are: A younger sister of Caroline Collit, married John Walsh, the convict at present under sentence of death in Bathurst gaol, and, it appears, continued to live with him up till the time of her sister’s murder; but she, as well as her sister Caroline, since the trial, have been ascertained to have borne very loose characters, which is fully established by the fact, that both before and after Walsh had married the younger sister, Caroline cohabited with him and had in fact been for a considerable time living with him, under the same roof with her sister, and in a state of separation from her own husband (Collit). Sydney Morning Herald, April 27, 1842, The Mount Victoria Murder. About twelve months after her marriage, her mother who was a notorious drunkard hanged herself in her own house… Sydney Morning Herald, April 27, 1842, The Mount Victoria Murder. And when we further reflect that the perpetrator of that deed of blood was a woman our horror is, if possible, much augmented. Yes! A woman and one who ought to have been in as much as the means were assuredly in the power of her family-an ornament to her sex and station. She has been cut off in the midst of her days by the hands of the common executioner. And to add to our distress at this sad event she to whose tragic end I am referring was a wife and a mother. It was her hand which struck the blow that rendered her children orphans and brought her to an ignominious end… The Goulburn Herald, October 20, 1855, Funeral sermon on Mary Ann Brownlow. His wife had been drinking and created an altercation on account of his having sold [her] lease; she asked him to drink, but he refused, when she replied “You can go and drink with your fancywoman”. She came after him as he was going away and stabbed him…..she did it from jealousy, although he had never given her any cause for jealousy. The Goulburn Herald, Saturday, September 15, 1855, Tuesday, September 11, Wilful Murder. She was always most obedient and quiet in her conduct, and her melancholy winning manners soon procured her the sympathy of all who came in contact with her. She became deeply impressed with the sinfulness of her previous life… The Goulburn Herald, October 13, 1855, Execution of Mary Ann Brownlow. [Police] had known the deceased who was a confirmed drunkard and an abandoned woman without any home or place of abode; did not believe she had any proper means of support…The Bathurst Times, November 1871. It is the oppositional and strong narrative ‘voice’ that elicits sympathies for and with the women’s situations. The fictional narratives were written to challenge unsympathetic pre-existing narratives found within the archival intertexts. This male ‘voice’ was one that narrated and positioned women such that they adhered to pre-existing notions of morality; what it meant to be a ‘good’ woman (like Mary Ann Brownlow, reformed in gaol but still sentenced to death) or a ‘bad’ woman (Mary Ann again as the murdering drunken vengeful wife, stabbing her husband in a jealous rage). ‘Reading between the lines’ of history in this way, creating fictional stories and juxtaposing them against the non-fiction prior articulations of those same events, is an opportunity to make use of narrative structure in order to destabilise established constructs of our colonial past. For example, the trope of Australia’s colonial settler women as exampled in the notion of Anne Summers of colonial women as either God’s police or damned whores. ‘A Particularly rigid dualistic notion of women’s function in colonial society was embodied in two stereotypes….that women are either good [God’s police] or evil [Damned whores]’ (67). With this dualism in mind, it is also useful here to consider the assumption made by Veeser in laying the ground work for New Historicism, that ‘no discourse imaginative or archival, gives access to unchanging truths or expresses unalterable human nature’ (2). In a discussion of the ideas of Brian McHale, Middleton and Woods acknowledge McHale’s point of view that readers do recognise the degree to which all knowledge of the past is a construction. They make the claim that ‘the postmodern novelist answers that sense of dislocation and loss…by wrapping ruins of earlier textualities around the narrative’ (66). This to my mind is a call for the type of intertextuality that I have attempted in my thesis. The senses of dislocation and loss found when we attempt to narrativise history are embodied in the structure of the creative component of my thesis. Yet it could also be argued that the cultural complexity of colonial Australia, with women as the subjugated ‘other’ of a disempowered voice has only been constructed by and from within the present. The ‘real’ women from whose lives these stories are imagined could not have perceived their lives within the frames (class, gender, post coloniality) that we now understand in the same way that we as educated westerners cannot totally perceive a tribal culture’s view of the cosmos as a real ‘fact’. However, a fictional re-articulation of historical ‘facts’, using a framework of postmodern neo-historical fiction, allows archival documents to be understood as the traces of women to whom those documented facts once referred. The archival record becomes once again a thing that describes a world of women. It is within these archival micro-histories of illiterate lower-class women that we find shards of our hidden past. By fictionally imagining a possible narrative of their lives we, as the author/reader nexus which creates the image of who these transworld characters were, allow for things that existed in the past as possibility. The fictionalised stories, based on fragments of ‘facts’ from the past, are a way of invoking what could have once existed. In this way the stories partake of the Bernstein and Morson concept of ‘sideshadowing’. Sideshadowing admits, in addition to actualities and impossibilities, a middle realm of real possibilities that could have happened even if they did not. Things could have been different from the way they were, there are real alternatives to the present we know, and the future admits of various possibilities… sideshadowing deepens our sense of the openness of time. It has profound implications for our understanding of history and of our own lives (Morson 6). The possibilities that sideshadowing their lives invokes in these stories ‘alters the way that we think about earlier events and the narrative models used to describe them’ (Morson 7). We alter our view of the women, as initially described in the archival record, because we now perceive the narrative through which these events and therefore ‘lives’ of the women were written, as merely ‘one possibility’ of many that may have occurred. Sideshadowing alternate possibilities gives us a way out of that patriarchal hegemony into a more multi-dimensional and non-linear view of female lives in 19th Century Australia. Sideshadowing allows for the ‘non-closure’ within female narratives that these fragments of women’s lives represent. It is this which is at the core of the novel—an historiographic metafictional challenging by the fictional ‘voices’ of female transworld characters. In this work, they narrate from a female perspective the might-have-been alternative of that previously considered as an historical, legitimate account of the past. Barthes and Bakhtin Readers of this type of historiographic metafiction have the freedom to recreate an historical fictional world. By virtue of the use of self-reflexivity and intertext they participate in a fictional world constructed by themselves from the author(s) of the text(s) and the intertext, and the original women’s voices used as quotations by the intertext’s (male) author. This world is based upon their construction of a past created from the author’s research, the author’s subjectivity (from within and by disciplinary discourse), by the author(s) choice of ‘signifiers’ and the meanings that these choices create within the reader’s subjectivity (itself formed out of their individual cultural and social milieu). This idea echoes Barthes concept of the ‘death of the author’, such that: As soon as a fact is narrated no longer with a view to acting directly on reality but intransitively, that is to say, finally outside of any function other than that of the very practice of the symbol itself; this disconnection occurs, the voice loses its origin, the author enters into his own death, writing begins. (142) When entering into the world created by this style of historical fiction the reader also enters into a world of previous ‘texts’ (or intertexts) and the multitude of voices inherent in them. This is the Bakhtinian concept of heteroglossia, that ‘every utterance contains within it the trace of other utterances, both in the past and in the future’ (263). The narrative formed thus becomes one of multiple ‘truths’ and therefore multiple histories. Once written as ‘bad’, the women are now perceived as ‘good’ characters and the ‘bad’ events that occurred around them and to them make up ‘good’ elements of plot, structure, characterisation and voice for a fictionalised version of a past possibility. Bad women make good reading. Conclusion This type of narrative structure allows for the limits of the silenced ‘voice’ of the past, and therefore an understanding of marginalised groups within hegemonic grand narratives, to be approached. It seems to me no surprise that neo-historical fiction is used more when the subjects written about are members of marginalised groups. Silenced voices need to be heard. Because these women left no written account of their experiences, and because we can never experience the society within which their identities were formed, we will never know their ‘identity’ as they experienced it. Fictional self-narrated stories of transworld characters allows for a transformation of the women away from an identity created by the moralising, stereotyped descriptions in the newspapers towards a more fully developed sense of female identity. Third-hand male accounts written for the (then) newspaper readers consumption (and for us as occupiers of the ‘future’) are a construct of one possible identity only. They do not reflect the women’s reality. Adding another fictional ‘identity’ through an imagined self-narrated account deconstructs that limited ‘identity’ formed through the male ‘gaze’. It does so because of the ability of fiction to allow the reader to create a fictional world which can be experienced imaginatively and from within their own subjectivity. Rather than something passively recorded, literature offers history as a permanent reactivation of the past in a critique of the present, and at the level of content offers a textual anamnesis for the hitherto ignored, unacknowledged or repressed pasts marginalised by the dominant histories. Abstract:
On the morning of Thursday, 4 May 2006, the United States House Permanent Select Committee on Intelligence held an open hearing entitled “Terrorist Use of the Internet.” The Intelligence committee meeting was scheduled to take place in Room 1302 of the Longworth Office Building, a Depression-era structure with a neoclassical façade. Because of a dysfunctional elevator, some of the congressional representatives were late to the meeting. During the testimony about the newest political applications for cutting-edge digital technology, the microphones periodically malfunctioned, and witnesses complained of “technical problems” several times. By the end of the day it seemed that what was to be remembered about the hearing was the shocking revelation that terrorists were using videogames to recruit young jihadists. The Associated Press wrote a short, restrained article about the hearing that only mentioned “computer games and recruitment videos” in passing. Eager to have their version of the news item picked up, Reuters made videogames the focus of their coverage with a headline that announced, “Islamists Using US Videogames in Youth Appeal.” Like a game of telephone, as the Reuters videogame story was quickly re-run by several Internet news services, each iteration of the title seemed less true to the exact language of the original. One Internet news service changed the headline to “Islamic militants recruit using U.S. video games.” Fox News re-titled the story again to emphasise that this alert about technological manipulation was coming from recognised specialists in the anti-terrorism surveillance field: “Experts: Islamic Militants Customizing Violent Video Games.” As the story circulated, the body of the article remained largely unchanged, in which the Reuters reporter described the digital materials from Islamic extremists that were shown at the congressional hearing. During the segment that apparently most captured the attention of the wire service reporters, eerie music played as an English-speaking narrator condemned the “infidel” and declared that he had “put a jihad” on them, as aerial shots moved over 3D computer-generated images of flaming oil facilities and mosques covered with geometric designs. Suddenly, this menacing voice-over was interrupted by an explosion, as a virtual rocket was launched into a simulated military helicopter. The Reuters reporter shared this dystopian vision from cyberspace with Western audiences by quoting directly from the chilling commentary and describing a dissonant montage of images and remixed sound. “I was just a boy when the infidels came to my village in Blackhawk helicopters,” a narrator’s voice said as the screen flashed between images of street-level gunfights, explosions and helicopter assaults. Then came a recording of President George W. Bush’s September 16, 2001, statement: “This crusade, this war on terrorism, is going to take a while.” It was edited to repeat the word “crusade,” which Muslims often define as an attack on Islam by Christianity. According to the news reports, the key piece of evidence before Congress seemed to be a film by “SonicJihad” of recorded videogame play, which – according to the experts – was widely distributed online. Much of the clip takes place from the point of view of a first-person shooter, seen as if through the eyes of an armed insurgent, but the viewer also periodically sees third-person action in which the player appears as a running figure wearing a red-and-white checked keffiyeh, who dashes toward the screen with a rocket launcher balanced on his shoulder. Significantly, another of the player’s hand-held weapons is a detonator that triggers remote blasts. As jaunty music plays, helicopters, tanks, and armoured vehicles burst into smoke and flame. Finally, at the triumphant ending of the video, a green and white flag bearing a crescent is hoisted aloft into the sky to signify victory by Islamic forces. To explain the existence of this digital alternative history in which jihadists could be conquerors, the Reuters story described the deviousness of the country’s terrorist opponents, who were now apparently modifying popular videogames through their wizardry and inserting anti-American, pro-insurgency content into U.S.-made consumer technology. One of the latest video games modified by militants is the popular “Battlefield 2” from leading video game publisher, Electronic Arts Inc of Redwood City, California. Jeff Brown, a spokesman for Electronic Arts, said enthusiasts often write software modifications, known as “mods,” to video games. “Millions of people create mods on games around the world,” he said. “We have absolutely no control over them. It’s like drawing a mustache on a picture.” Although the Electronic Arts executive dismissed the activities of modders as a “mustache on a picture” that could only be considered little more than childish vandalism of their off-the-shelf corporate product, others saw a more serious form of criminality at work. Testifying experts and the legislators listening on the committee used the video to call for greater Internet surveillance efforts and electronic counter-measures. Within twenty-four hours of the sensationalistic news breaking, however, a group of Battlefield 2 fans was crowing about the idiocy of reporters. The game play footage wasn’t from a high-tech modification of the software by Islamic extremists; it had been posted on a Planet Battlefield forum the previous December of 2005 by a game fan who had cut together regular game play with a Bush remix and a parody snippet of the soundtrack from the 2004 hit comedy film Team America. The voice describing the Black Hawk helicopters was the voice of Trey Parker of South Park cartoon fame, and – much to Parker’s amusement – even the mention of “goats screaming” did not clue spectators in to the fact of a comic source. Ironically, the moment in the movie from which the sound clip is excerpted is one about intelligence gathering. As an agent of Team America, a fictional elite U.S. commando squad, the hero of the film’s all-puppet cast, Gary Johnston, is impersonating a jihadist radical inside a hostile Egyptian tavern that is modelled on the cantina scene from Star Wars. Additional laughs come from the fact that agent Johnston is accepted by the menacing terrorist cell as “Hakmed,” despite the fact that he utters a series of improbable clichés made up of incoherent stereotypes about life in the Middle East while dressed up in a disguise made up of shoe polish and a turban from a bathroom towel. The man behind the “SonicJihad” pseudonym turned out to be a twenty-five-year-old hospital administrator named Samir, and what reporters and representatives saw was nothing more exotic than game play from an add-on expansion pack of Battlefield 2, which – like other versions of the game – allows first-person shooter play from the position of the opponent as a standard feature. While SonicJihad initially joined his fellow gamers in ridiculing the mainstream media, he also expressed astonishment and outrage about a larger politics of reception. In one interview he argued that the media illiteracy of Reuters potentially enabled a whole series of category errors, in which harmless gamers could be demonised as terrorists. It wasn’t intended for the purpose what it was portrayed to be by the media. So no I don’t regret making a funny video . . . why should I? The only thing I regret is thinking that news from Reuters was objective and always right. The least they could do is some online research before publishing this. If they label me al-Qaeda just for making this silly video, that makes you think, what is this al-Qaeda? And is everything al-Qaeda? Although Sonic Jihad dismissed his own work as “silly” or “funny,” he expected considerably more from a credible news agency like Reuters: “objective” reporting, “online research,” and fact-checking before “publishing.” Within the week, almost all of the salient details in the Reuters story were revealed to be incorrect. SonicJihad’s film was not made by terrorists or for terrorists: it was not created by “Islamic militants” for “Muslim youths.” The videogame it depicted had not been modified by a “tech-savvy militant” with advanced programming skills. Of course, what is most extraordinary about this story isn’t just that Reuters merely got its facts wrong; it is that a self-identified “parody” video was shown to the august House Intelligence Committee by a team of well-paid “experts” from the Science Applications International Corporation (SAIC), a major contractor with the federal government, as key evidence of terrorist recruitment techniques and abuse of digital networks. Moreover, this story of media illiteracy unfolded in the context of a fundamental Constitutional debate about domestic surveillance via communications technology and the further regulation of digital content by lawmakers. Furthermore, the transcripts of the actual hearing showed that much more than simple gullibility or technological ignorance was in play. Based on their exchanges in the public record, elected representatives and government experts appear to be keenly aware that the digital discourses of an emerging information culture might be challenging their authority and that of the longstanding institutions of knowledge and power with which they are affiliated. These hearings can be seen as representative of a larger historical moment in which emphatic declarations about prohibiting specific practices in digital culture have come to occupy a prominent place at the podium, news desk, or official Web portal. This environment of cultural reaction can be used to explain why policy makers’ reaction to terrorists’ use of networked communication and digital media actually tells us more about our own American ideologies about technology and rhetoric in a contemporary information environment. When the experts come forward at the Sonic Jihad hearing to “walk us through the media and some of the products,” they present digital artefacts of an information economy that mirrors many of the features of our own consumption of objects of electronic discourse, which seem dangerously easy to copy and distribute and thus also create confusion about their intended meanings, audiences, and purposes. From this one hearing we can see how the reception of many new digital genres plays out in the public sphere of legislative discourse. Web pages, videogames, and Weblogs are mentioned specifically in the transcript. The main architecture of the witnesses’ presentation to the committee is organised according to the rhetorical conventions of a PowerPoint presentation. Moreover, the arguments made by expert witnesses about the relationship of orality to literacy or of public to private communications in new media are highly relevant to how we might understand other important digital genres, such as electronic mail or text messaging. The hearing also invites consideration of privacy, intellectual property, and digital “rights,” because moral values about freedom and ownership are alluded to by many of the elected representatives present, albeit often through the looking glass of user behaviours imagined as radically Other. For example, terrorists are described as “modders” and “hackers” who subvert those who properly create, own, legitimate, and regulate intellectual property. To explain embarrassing leaks of infinitely replicable digital files, witness Ron Roughead says, “We’re not even sure that they don’t even hack into the kinds of spaces that hold photographs in order to get pictures that our forces have taken.” Another witness, Undersecretary of Defense for Policy and International Affairs, Peter Rodman claims that “any video game that comes out, as soon as the code is released, they will modify it and change the game for their needs.” Thus, the implication of these witnesses’ testimony is that the release of code into the public domain can contribute to political subversion, much as covert intrusion into computer networks by stealthy hackers can. However, the witnesses from the Pentagon and from the government contractor SAIC often present a contradictory image of the supposed terrorists in the hearing transcripts. Sometimes the enemy is depicted as an organisation of technological masterminds, capable of manipulating the computer code of unwitting Americans and snatching their rightful intellectual property away; sometimes those from the opposing forces are depicted as pre-modern and even sub-literate political innocents. In contrast, the congressional representatives seem to focus on similarities when comparing the work of “terrorists” to the everyday digital practices of their constituents and even of themselves. According to the transcripts of this open hearing, legislators on both sides of the aisle express anxiety about domestic patterns of Internet reception. Even the legislators’ own Web pages are potentially disruptive electronic artefacts, particularly when the demands of digital labour interfere with their duties as lawmakers. Although the subject of the hearing is ostensibly terrorist Websites, Representative Anna Eshoo (D-California) bemoans the difficulty of maintaining her own official congressional site. As she observes, “So we are – as members, I think we’re very sensitive about what’s on our Website, and if I retained what I had on my Website three years ago, I’d be out of business. So we know that they have to be renewed. They go up, they go down, they’re rebuilt, they’re – you know, the message is targeted to the future.” In their questions, lawmakers identify Weblogs (blogs) as a particular area of concern as a destabilising alternative to authoritative print sources of information from established institutions. Representative Alcee Hastings (D-Florida) compares the polluting power of insurgent bloggers to that of influential online muckrakers from the American political Right. Hastings complains of “garbage on our regular mainstream news that comes from blog sites.” Representative Heather Wilson (R-New Mexico) attempts to project a media-savvy persona by bringing up the “phenomenon of blogging” in conjunction with her questions about jihadist Websites in which she notes how Internet traffic can be magnified by cooperative ventures among groups of ideologically like-minded content-providers: “These Websites, and particularly the most active ones, are they cross-linked? And do they have kind of hot links to your other favorite sites on them?” At one point Representative Wilson asks witness Rodman if he knows “of your 100 hottest sites where the Webmasters are educated? What nationality they are? Where they’re getting their money from?” In her questions, Wilson implicitly acknowledges that Web work reflects influences from pedagogical communities, economic networks of the exchange of capital, and even potentially the specific ideologies of nation-states. It is perhaps indicative of the government contractors’ anachronistic worldview that the witness is unable to answer Wilson’s question. He explains that his agency focuses on the physical location of the server or ISP rather than the social backgrounds of the individuals who might be manufacturing objectionable digital texts. The premise behind the contractors’ working method – surveilling the technical apparatus not the social network – may be related to other beliefs expressed by government witnesses, such as the supposition that jihadist Websites are collectively produced and spontaneously emerge from the indigenous, traditional, tribal culture, instead of assuming that Iraqi insurgents have analogous beliefs, practices, and technological awareness to those in first-world countries. The residual subtexts in the witnesses’ conjectures about competing cultures of orality and literacy may tell us something about a reactionary rhetoric around videogames and digital culture more generally. According to the experts before Congress, the Middle Eastern audience for these videogames and Websites is limited by its membership in a pre-literate society that is only capable of abortive cultural production without access to knowledge that is archived in printed codices. Sometimes the witnesses before Congress seem to be unintentionally channelling the ideas of the late literacy theorist Walter Ong about the “secondary orality” associated with talky electronic media such as television, radio, audio recording, or telephone communication. Later followers of Ong extend this concept of secondary orality to hypertext, hypermedia, e-mail, and blogs, because they similarly share features of both speech and written discourse. Although Ong’s disciples celebrate this vibrant reconnection to a mythic, communal past of what Kathleen Welch calls “electric rhetoric,” the defence industry consultants express their profound state of alarm at the potentially dangerous and subversive character of this hybrid form of communication. The concept of an “oral tradition” is first introduced by the expert witnesses in the context of modern marketing and product distribution: “The Internet is used for a variety of things – command and control,” one witness states. “One of the things that’s missed frequently is how and – how effective the adversary is at using the Internet to distribute product. They’re using that distribution network as a modern form of oral tradition, if you will.” Thus, although the Internet can be deployed for hierarchical “command and control” activities, it also functions as a highly efficient peer-to-peer distributed network for disseminating the commodity of information. Throughout the hearings, the witnesses imply that unregulated lateral communication among social actors who are not authorised to speak for nation-states or to produce legitimated expert discourses is potentially destabilising to political order. Witness Eric Michael describes the “oral tradition” and the conventions of communal life in the Middle East to emphasise the primacy of speech in the collective discursive practices of this alien population: “I’d like to point your attention to the media types and the fact that the oral tradition is listed as most important. The other media listed support that. And the significance of the oral tradition is more than just – it’s the medium by which, once it comes off the Internet, it is transferred.” The experts go on to claim that this “oral tradition” can contaminate other media because it functions as “rumor,” the traditional bane of the stately discourse of military leaders since the classical era. The oral tradition now also has an aspect of rumor. A[n] event takes place. There is an explosion in a city. Rumor is that the United States Air Force dropped a bomb and is doing indiscriminate killing. This ends up being discussed on the street. It ends up showing up in a Friday sermon in a mosque or in another religious institution. It then gets recycled into written materials. Media picks up the story and broadcasts it, at which point it’s now a fact. In this particular case that we were telling you about, it showed up on a network television, and their propaganda continues to go back to this false initial report on network television and continue to reiterate that it’s a fact, even though the United States government has proven that it was not a fact, even though the network has since recanted the broadcast. In this example, many-to-many discussion on the “street” is formalised into a one-to many “sermon” and then further stylised using technology in a one-to-many broadcast on “network television” in which “propaganda” that is “false” can no longer be disputed. This “oral tradition” is like digital media, because elements of discourse can be infinitely copied or “recycled,” and it is designed to “reiterate” content. In this hearing, the word “rhetoric” is associated with destructive counter-cultural forces by the witnesses who reiterate cultural truisms dating back to Plato and the Gorgias. For example, witness Eric Michael initially presents “rhetoric” as the use of culturally specific and hence untranslatable figures of speech, but he quickly moves to an outright castigation of the entire communicative mode. “Rhetoric,” he tells us, is designed to “distort the truth,” because it is a “selective” assembly or a “distortion.” Rhetoric is also at odds with reason, because it appeals to “emotion” and a romanticised Weltanschauung oriented around discourses of “struggle.” The film by SonicJihad is chosen as the final clip by the witnesses before Congress, because it allegedly combines many different types of emotional appeal, and thus it conveniently ties together all of the themes that the witnesses present to the legislators about unreliable oral or rhetorical sources in the Middle East: And there you see how all these products are linked together. And you can see where the games are set to psychologically condition you to go kill coalition forces. You can see how they use humor. You can see how the entire campaign is carefully crafted to first evoke an emotion and then to evoke a response and to direct that response in the direction that they want. Jihadist digital products, especially videogames, are effective means of manipulation, the witnesses argue, because they employ multiple channels of persuasion and carefully sequenced and integrated subliminal messages. To understand the larger cultural conversation of the hearing, it is important to keep in mind that the related argument that “games” can “psychologically condition” players to be predisposed to violence is one that was important in other congressional hearings of the period, as well one that played a role in bills and resolutions that were passed by the full body of the legislative branch. In the witness’s testimony an appeal to anti-game sympathies at home is combined with a critique of a closed anti-democratic system abroad in which the circuits of rhetorical production and their composite metonymic chains are described as those that command specific, unvarying, robotic responses. This sharp criticism of the artful use of a presentation style that is “crafted” is ironic, given that the witnesses’ “compilation” of jihadist digital material is staged in the form of a carefully structured PowerPoint presentation, one that is paced to a well-rehearsed rhythm of “slide, please” or “next slide” in the transcript. The transcript also reveals that the members of the House Intelligence Committee were not the original audience for the witnesses’ PowerPoint presentation. Rather, when it was first created by SAIC, this “expert” presentation was designed for training purposes for the troops on the ground, who would be facing the challenges of deployment in hostile terrain. According to the witnesses, having the slide show showcased before Congress was something of an afterthought. Nonetheless, Congressman Tiahrt (R-KN) is so impressed with the rhetorical mastery of the consultants that he tries to appropriate it. As Tiarht puts it, “I’d like to get a copy of that slide sometime.” From the hearing we also learn that the terrorists’ Websites are threatening precisely because they manifest a polymorphously perverse geometry of expansion. For example, one SAIC witness before the House Committee compares the replication and elaboration of digital material online to a “spiderweb.” Like Representative Eshoo’s site, he also notes that the terrorists’ sites go “up” and “down,” but the consultant is left to speculate about whether or not there is any “central coordination” to serve as an organising principle and to explain the persistence and consistency of messages despite the apparent lack of a single authorial ethos to offer a stable, humanised, point of reference. In the hearing, the oft-cited solution to the problem created by the hybridity and iterability of digital rhetoric appears to be “public diplomacy.” Both consultants and lawmakers seem to agree that the damaging messages of the insurgents must be countered with U.S. sanctioned information, and thus the phrase “public diplomacy” appears in the hearing seven times. However, witness Roughhead complains that the protean “oral tradition” and what Henry Jenkins has called the “transmedia” character of digital culture, which often crosses several platforms of traditional print, projection, or broadcast media, stymies their best rhetorical efforts: “I think the point that we’ve tried to make in the briefing is that wherever there’s Internet availability at all, they can then download these – these programs and put them onto compact discs, DVDs, or post them into posters, and provide them to a greater range of people in the oral tradition that they’ve grown up in. And so they only need a few Internet sites in order to distribute and disseminate the message.” Of course, to maintain their share of the government market, the Science Applications International Corporation also employs practices of publicity and promotion through the Internet and digital media. They use HTML Web pages for these purposes, as well as PowerPoint presentations and online video. The rhetoric of the Website of SAIC emphasises their motto “From Science to Solutions.” After a short Flash film about how SAIC scientists and engineers solve “complex technical problems,” the visitor is taken to the home page of the firm that re-emphasises their central message about expertise. The maps, uniforms, and specialised tools and equipment that are depicted in these opening Web pages reinforce an ethos of professional specialisation that is able to respond to multiple threats posed by the “global war on terror.” By 26 June 2006, the incident finally was being described as a “Pentagon Snafu” by ABC News. From the opening of reporter Jake Tapper’s investigative Webcast, established government institutions were put on the spot: “So, how much does the Pentagon know about videogames? Well, when it came to a recent appearance before Congress, apparently not enough.” Indeed, the very language about “experts” that was highlighted in the earlier coverage is repeated by Tapper in mockery, with the significant exception of “independent expert” Ian Bogost of the Georgia Institute of Technology. If the Pentagon and SAIC deride the legitimacy of rhetoric as a cultural practice, Bogost occupies himself with its defence. In his recent book Persuasive Games: The Expressive Power of Videogames, Bogost draws upon the authority of the “2,500 year history of rhetoric” to argue that videogames represent a significant development in that cultural narrative. Given that Bogost and his Watercooler Games Weblog co-editor Gonzalo Frasca were actively involved in the detective work that exposed the depth of professional incompetence involved in the government’s line-up of witnesses, it is appropriate that Bogost is given the final words in the ABC exposé. As Bogost says, “We should be deeply bothered by this. We should really be questioning the kind of advice that Congress is getting.” Bogost may be right that Congress received terrible counsel on that day, but a close reading of the transcript reveals that elected officials were much more than passive listeners: in fact they were lively participants in a cultural conversation about regulating digital media. After looking at the actual language of these exchanges, it seems that the persuasiveness of the misinformation from the Pentagon and SAIC had as much to do with lawmakers’ preconceived anxieties about practices of computer-mediated communication close to home as it did with the contradictory stereotypes that were presented to them about Internet practices abroad. In other words, lawmakers found themselves looking into a fun house mirror that distorted what should have been familiar artefacts of American popular culture because it was precisely what they wanted to see.
