Abstract:
This chapter raises the question of whether expert witnesses are necessary or indeed appropriate in international arbitration. The expert’s role in arbitration proceedings is to testify and assist the tribunal. The expert is also a witness, but, in contrast to the legal framework for experts in court proceedings, in international arbitration they do not have to be independent of the parties. The majority of experts appearing before arbitral tribunals are employees or habitual sub-contractors of one of the parties. Regardless of an arbitrator’s background, they will require the support of an expert as they increasingly come into contact with sectors such as construction, energy, telecommunications, and concessions. However, the proliferation of expert witnesses in arbitration proceedings, and above all the phenomenon of the team of experts, have become the cause of confusion and delays.

Abstract:
This chapter discusses the role of expert witnesses in international arbitration, as well as the responsibilities of that role. The roles, functions, and ethical obligations of expert witnesses are still tentatively defined within the realm of international arbitration, but there have been some important regulations and procedures imposed already — the International Bar Association (IBA) Rules of Evidence, for example. This is a significant attempt in regulating the conduct of experts, as well as in laying down the distinctions between party-selected and party-anointed experts, among other innovations. But of course, the legal system employed within the sphere of international arbitration will continue to change in response to unforeseen flaws in entrenched practice — as will be the case for expert witnessing. Perhaps, in order to address one of the possible abuses of the latter, ethical reforms might also be applied to the structure of roles in the courtroom.

Abstract:
This chapter comments on Article 100 of the Rome Statute of the International Criminal Court. Article 100 deals with costs involved in surrender and other aspects of legal assistance. The general rule set out in the provision is that ‘ordinary costs’ respecting execution of requests in the territory of the requested State are to be borne by the State. It is based on accepted models in other international legal instruments. There are, however, exceptions, i.e. travel of witnesses, experts, and persons in custody is the responsibility of the Court, not the State Party. The same applies to costs of translation, interpretation, and transcription, which may be especially significant if a State opts for communication in a language other than one of the working languages of the Court, in accordance with article 87(2) of the Statute. Other costs to be borne by the Court are those of expert opinions or reports requested by the Court and transport of a person being surrendered to the Court by a custodial State.
