Full textThe International Bank for Reconstruction and Development was founded in 1944 and began its operations in 1947. Among the first activities the Bank carried out in the 1940s, the missions and loans in Colombia represented a key moment in the evolution of this institution towards the form of organization, the articulation of procedures and the definition of the objectives that characterize the Bank still today. Our research focuses on this process, focusing in particular on the General Survey mission organized in 1949 and its implications for the evolution of the Bank, as well as Colombian economic policy. Through this mission, we examined the practices related to the evolution of the World Bank's policies during the first years of activity, highlighting in particular the emergent nature of this organization. These missions, analyzed as a moment of interaction between international experts and local experts, are fundamental to understanding the evolution of the World Bank's work. Based on this assumption, one of the main challenge of the research was to develop a method of analysis to capture the strategies and practices developed during the World Bank missions and to relate them to the results of these missions. In order to understand these strategies, we analyzed the links established among the actors, local and international, and observed their evolution over time. Crafting and studying these links allowed us to better understand the emergence of certain institutions related to the demand and management of the loans, as well as the criteria the Bank established for the evaluation and intervention of international experts in developing countries. This implied the study of a transnational phenomenon by a micro-historical approach

Full textThe analysis comprises the participant observation of two multilateral devlopment assistance projects. The first case study consists of an informal sector project, introducing new products and manufacturing processes to metal-working arti sans in westafrica. The second one concerns the introduction of power generation equipment in large-scale industry in mexico. The important difference in the sociocultural, political and technological contexts lead us to restrict the analysis to the internal logic of such development projects. First, the symbolic coherence of the communication between foreign experts and their counterparts is reconstructed, there by identifying the transformation of the nature of the technical know-how. The second step of the analysis shows how the communication dynamic determines the implementation of the technology and the degree of the transfer of know-how. The presence of the researcher is used by the participants to act upon the transfer and this utilisation allows in turn to identify their constraints on objectifying their relati onship. In both cases, the developmental content of these projects is effectively dematerialized in this relationship. This research proposes an alternative to the "intercultural situation" approach by demonstrating the hybrid nature of th e transactional relation in contemporary technical assistance

Full textIn the last decades, international expertise has been essential to put global environmental problems on the international agenda. These assessments are often contested, especially on issues where facts and values are profoundly entangled. This thesis investigates the case of the Intergovernmental Panel on Climate Change (IPCC), one of the most authoritative, albeit contested expert organisation. It is more generally interested in how these organisations construct and maintain their authority, drawing on insights from Science and Technology Studies and sociological approaches to international organisations. A central argument is that, partly as a result of the controversial universe in which it has evolved, the IPCC has grown into an international bureaucracy. The thesis identifies four institutional arrangements on which the organisation has relied to maintain its authority. First, it has strived for a balanced representation of all nations, and in particular between developed and developing countries. Second, it has put in place governing mechanisms that allow governments to play a central role in the assessment process, encouraging the ‘ownership’ of its conclusions. Third, it has increasingly proceduralised the assessment, to formalise the role of its different parts and protect the organisation against criticism. Four, it has been more attentive to the management of the information displayed about its work. These arrangements are regularly renegotiated in the context of new challenges and controversies. Beyond the IPCC, they provide relevant lenses to observe the intertwining of political and epistemic authority at the international level

Full textBased mainly on the exploitation of the ILO archives, this thesis analyzes the emergence of development discourses and practices at the international level between 1919 and 1949. This offers the opportunity to challenge several important presumptions of development historians with regard to the chronology of development and its ideological origins. This thesis focuses on the practical aspects of this emerging international technical cooperation. It analyzes in particular the technical assistance missions organized by the International Labour Office until the implementation of the United Nations’ Expanded Programme of Technical Assistance created in 1949, which was the first multilateral program of international development after World War II. This thesis pays special attention to the situations where ILO expertise played a role and to the international experts and ILO officials involved in the dissemination of technical knowledge. Full textFaced with the demands imposed by increasingly marked internationalization, service companies are banking on the enrichment of human capital they have. This research aims to provide an understanding of the learning process that promotes this enrichment. More specifically, we want to understand the impact of the culture of the individual on the skills that make up his human capital, and the evolution of intercultural competence which is the essential component of the latter in an international context. Based on the study of an international SME and, more precisely, of one of its business units in France which demonstrates an expertise in terms of service delivery, our thesis aims to highlight the constituent elements of a high level service relationship. For this, we have mobilized a review of the literature based on international management, intercultural management and human resources management. It is based on a unique case study in which we conducted 25 semi structured interviews and approximately 83 hours of observation (non participant and participant). The results obtained reveal that the expertise of the unit studied is based on the transcultural competence of the manager, who creates a managerial culture and lasting relationships with customers, which brings results for the company

Full textIn international arbitration, as in most legal systems, compensation of damage is a key part of dispute resolution. It is a threefold process: the arbitral tribunal decides on compensable damage, then on the extent of compensation, and finally, evaluates damage. Investment arbitration, which settles disputes between states and foreign investors - private entities - is at the crossroads between national and international law, between contractual liability and international state liability, between commercial and public law, thus covering the wide scope of issues raised by compensation of damage. The awards given in this field are often made public, allowing for an analysis of the – thoroughly consistent – solutions brought forward by arbitral tribunals. This study shows how, throughout the process of compensation of damage, questions of fact and law as well as legal and economic issues are raised. The legal requirements of certainty, foreseeability and remoteness of damage are significantly impacted by the economic context and by the notion of fairness. Conversely, the financial rules applied throughout the process of damage evaluation, without taking into account applicable law, are increasingly governed by law. Identifying the corpus of rules that are applied throughout the process of compensation of damage, and studying the way these rules are applied in investment arbitration therefore represents a useful tool for international bodies seeking to understand their own rights and duties

Full textThe evaluation of the international administrative cooperation (CAI) which is the subject of our research was selected by the Interministerial Committee of the Group of International Cooperation and Development (CICID), at the meeting of the Evaluation Committee, held in Paris on 21 June 2005. Ensured by the Directorate General of International cooperation for Development (DGCID), it is part of the evaluation-country, or strategic evaluation, which focused on the activities of bilateral cooperation between Morocco and France for the period (1995-2005).The research problematic is justified by the following observation: After two decades the evaluation of international public policy appears very contrasted. At least three reasons lead to establish this contrast. First, the evaluation remains largely a simple specialized expertise. The second reason follows moreover from this situation: The technical expertise is the quality that gives the right to conduct evaluation. Reflection on evaluation methods remains particularly poor in Morocco. The third reason is the result of the environment in which the evaluation practices. The culture of evaluation or its institutionalization does not yet exist in Morocco.The international public policy evaluation will stand out by: The establishment of a Moroccan-French Joint Evaluation Steering Committee (CMPE); the concern for capacity building in evaluation public policies in favor of the members of the CMPE; the opening to civil society, local authorities and other local development partners to participate to the evaluation; the respect of the principles and methodology of the recognized evaluation and considering those implemented by the European Commission; the follow-up of the recommendations of the Orientation of the Partnership Steering Board (COPP) to monitor the orientations of the High Level Meetings (RHN).The research question that faces us is to see how this evaluation could it be? Regardless of the positions and experiences of the parties involved and if it could induce and even suggests a compromise position?We adopted an ethnomethodological research approach based on the sociologist Harold Garfinkel Model (1917-2011), from an observation of the inside of the evaluation activity. This localized analysis of the policy has enabled us to work on locally observable a fact that is in our case: the practice of assessing cooperation. It came to know in other words, how this evaluation was made?We tried to demonstrate that the evaluation process, like expertise to which it relates faces two opposing conceptions: one by doing an objective work, the other by doing legitimating work. Hence it appears that it is in the detailed analysis of what happens there lays a better understanding of the role of the evaluation process.In conclusion, the thesis main objective was to conduct a localized analysis of international public policies evaluation based on facts locally observable. It is concluded by addressing successively its diagnosis, its contribution, the self-assessment of the research work carried out to get the answers to the research questions and checking the relevance and the effectiveness of the means (tools, approach and methodology) to address the problem, identify its limitations and the prospects and possible tracks of investigation

Full textHIV/AIDS’s framing as an exceptional epidemicled to the building of AIDS policies around theconcept of political urgency and enabled the implementationof antiretroviral treatment policiesin sub-Saharan Africa at the beginning of the2000s. Ten years later, however, increasinglymassive access to medical care has graduallyturned HIV/AIDS into a chronic disease whoselong term characteristics contribute to challengingthe concept of political urgency as the basisof these policies.Drawing on a case study of Benin, this thesisquestions the implications of AIDS’s “chronicization”and the emergence of long term issues inthe AIDS treatment policy process. Using thesociology of public action, in relation to the conceptof “institutional work”, this thesis analyzesthe processes and actors entailed in this work.Analyzing AIDS’s framing as an exceptionalpolitical problem and the institutionalization ofthis policy highlights the difficulties faced by nationaland international actors to grasp what isat stake when initial problem framing becomeschallenged. Such actors tend strongly to keep onacting within the original problem framing whilethe “objective” characteristics of the problem areconstantly evolving. At the center of the institutionalizingprocess under study here has beena network of biomedical actors organized arounda program by the French Cooperation. This policy’scharacteristics has led our research to underlinethe central role played by expertise in thedecision-making process and the actor interactionsthat have developed around its use. Full textEl análisis técnico es una forma sofisticada de técnica de predicción cuya popularidad ha ido variando en el mundo académico y de los negocios. En el pasado, los usuarios eran bastante escépticos respecto de las reglas técnicas de trading y su performance. Todo esto, se encuentra sustentado por la aceptación de la hipótesis del mercado eficiente y descubrimientos empíricos mixtos sobre el análisis técnico, que se mencionan en un número amplio de estudios. El patrón bandera es visto como uno de los patrones gráficos más significativo y difundido entre los analistas técnicos de mercado. El presente estudio valida una regla de trading basada en el desarrollo futuro del reconocimiento gráfico del patrón bandera. La pregunta de investigación se centra en si el análisis técnico basado en el patrón bandera puede batir los índices internacionales de mercado y probar, de esta manera, la ineficiencia de dichos mercados. Los mercados observados son representados por los correspondientes índices DAX (Alemania), DJIA (Estados Unidos) e IBEX (España). El diseño de la regla de trading presenta varios cambios y novedades con respecto a trabajos académicos previos. La amplia muestra usada al considerar los datos intradía, junto con la configuración de algunas variables y la consideración del riesgo, confirman que la regla de trading proporciona mejores, y más ajustadas al riesgo, rentabilidades positivas que la estrategia de buy-and-hold que se utiliza como referencia. Los resultados positivos corroboran la robustez de las conclusiones a las que también se llegan en otros trabajos.
L'anàlisi tècnica és una forma sofisticada de tècnica de predicció, la popularitat de la qual ha anat variant al món acadèmic i dels negocis. En el passat, els usuaris eren bastant escèptics respecte de les regles tècniques de trading i la seva performance. Tot això, es troba sustentat per l'acceptació de la hipòtesi del mercat eficient i descobriments empírics mixts sobre l'anàlisi tècnica, que s'esmenten en un nombre ampli d'estudis. El patró bandera és vist com un dels patrons gràfics més significatiu i difós entre els analistes tècnics de mercat. El present estudi valida una regla de trading basada en el desenvolupament futur del reconeixement gràfic del patró bandera. La pregunta de recerca se centra en si l'anàlisi tècnica basada en el patró bandera pot batre els índexs internacionals de mercat i provar, d'aquesta manera, la ineficiència d'aquests mercats. Els mercats observats són representats pels corresponents índexs DAX (Alemanya), *DJIA (Estats Units) i IBEX (Espanya). El disseny de la regla de trading presenta diversos canvis i novetats pel que fa a treballs acadèmics previs. L'àmplia mostra usada en considerar les dades intradia, juntament amb la configuració d'algunes variables i la consideració del risc, confirmen que la regla de trading proporciona millors, i més ajustades al risc, rendibilitats positives que l'estratègia de buy-and-hold que s'utilitza com a referència. Els resultats positius corroboren la robustesa de les conclusions a les quals també s'arriben en altres treballs.

Our approach consists, while going from the analysis of the World Bank as an institution (social category, culture, speech, approach, management of intercultural) towards the operation (the project "Trade reform and competitiveness" on the ground), progressively to draw up a cartography of the "locations" of production of the danger of loss which influence in the project. The loss, it is the mechanism by which the project tends towards a disconnection of its objectives in relation to the field reality. The cartography of the risk is based on two aspects of the production of the danger of loss. Initially, there are two "departures of fires" which combined lead to the loss. On a side there is the problem of the management of intercultural within a mixed team and other there are the reactions to the perceived risk/with the feeling of danger

Full textThe First World War was the catalyst for social and technical changes, which gave rise to new administrative needs, materialized by the emergence of a new social group: that of the experts. In modern German and Polish states, a particular group of experts stands out, specializing in a theme with deep cultural roots: eastern Europe.The changes of regime and territory between 1918 and 1972 destabilize the frame of reference of the German and Polish societies, particularly between 1939 and 1945. However, the historiography of Eastern German sciences (Ostforschung) emphasizes the personal, institutional and conceptual continuity in the expertise of the East from the "Third Reich" to West Germany. In East Germany and Poland, on the contrary, the change of regime after 1945 renders any continuity impossible, but the question of the evolution of the thought on the East in the circles of the expertise, which maintained, remains asked.By going beyond the analysis of expertise in terms of subordination to the various political regimes to which it is addressed, we highlight the specificities of Eastern expertise. It is characterized by a double anchoring in the collective imagination and in contemporary scientific practices, to express a political goal. This anchorage explains the inertia in the German and Polish conceptions of the East. The comparatist approach emphasizes both the diversity of Eastern conceptions and the comparable social functions of the East, particularly that of the enemy and the space of national projection, past and future

Full textThe role of the arbital tribunal in the establishment of the content of the applicable law on the merits is not envisaged in most of the arbitration statutes. This brings us to examine the principle ''jura novit curia" and the opportunity of its application to international arbitration. Applying this principle in the same way it is applied before state courts to international arbitration has led to several difficulties. However in order to encourage the parties to resort to arbitration and to increase their trust in this conflict resolution mechanism, the arbitrator must be actively involved in the establishment of the content of the applicable law. Moreover, the "ex officia" attributions of the arbitrator should always comply with the due process principles. The administration of the proof of the applicable law during an arbitration procedure is nowadays standardized in most of the different law systems, due to the continuous efforts of the arbitration institutions. However, and despite the numerous advantages of the current methods of establishment of the applicable law, many difficulties are still encountered, which is diminishing the efficiency and the celerity expected by the parties from the arbitration process. Therefore, news methods should be developed, without however compromising the quality of the justice rendered: a post arbitral control must be implemented in order to verify whether the arbitrator has correctly applied the law on the merits "as previously established" to the case at hand, while respecting the principle of non review of the award on the merits

Full textPierre Quesnay (1895-1935) is an important actor, although he’s not known for being part of the international financial life of the interwar period : « doctor of the money », first healing currencies in dissaray after the First World War, especially in Austria, then, at the SDN general secretariat. Acting in the shadows for the Poincaré’s stabilisation, as the general secretary of the Governor Moreau (between 1926 and 1928), brilliant Head of the Economic Analysis Department of the Banque of France, he is, starting from 1930, the first general manager of the BIS,originating from the Young plan, plan of which he was one of the main negociators. Edited from private familial archives which are totally unprecedented, including notebooks that Quesnay filled from 1912 to 1937, this work is an attempt of an intellectual biography of an international financial expert of the interwar period. By trying to understand what is his intellectual « tooling »(the evolution of his liberalism in view of the economical consequences of the First World War) as much as which are his networks (his proximity with Jean Monnet…), we come to the point, of the scales where he implements his intense activity, notably through his transnational dimension. Full textThis doctoral thesis studies the relationships between science and policy through the emergence of the new concept of “soft skills”. Examining how this cognitive motive is built and disseminated at a global level over the last decade, this research shows the essential roles played by experts and international organizations, as well as by entrepreneurs and private networks. These circulations lead to a gradual convergence of actors upon a shared reasoning in the field of education and employment policies. Conducted in France, the second part of the research shows how these dynamics fit in the context of public policies’ reconfigurations. New frames emerge, tightly linked to the growing influence of new actors coming from the fields of philanthropy and social entrepreneurship. Nested in the promotion of human capital and the knowledge economy, justified by the European strategy of lifelong learning and social investment, and by corporate social responsibility claimed by companies, soft skills are growingly promoted. This leads to a gradual hybridization of policies and their actors, studied in the last part of the research which based upon study cases of educational programs

Full textThis thesis analyses the invention, in the late 1970’s, of a « second generation problem » by a transnational network of experts, scholars and bureaucrats who gave increasing significance to a group which was still nowhere to be found, that is, not used as an ordinary self-identification category. It studies the borrowing of the “second generation” category form American sociology and the translation work conducted by experts to adapt it to the post-migratory European situation. It also investigates the appearance of a new knowledge adapted to the North African immigran children’s “specificities” and tries to understand the role of social sciences in the formation of an undefined social group. The research then focuses on the circulation of the “second generation” category between the public policy realm and the protests realm. We analyse the formation of protests behind closed doors which allowed claims on ethnic bases, and the emergence of spokespersons among the second generation. We seek to identify the emergence of new opportunities for a generation of immigrants’ children, by investigating simultaneously the activists’ careers in a diachronic perspective and the protests’ sequence of events in a pragmatic perspective. We finally address the biographical impact of a politics based on interpersonal bonds of recognition and disconnected from any measures against racial inequality. The troubles ex-activists had to recover from the end of protests and the confusion it generated are viewed as a consequence of a politics of compassion which nurtured hope but at the same time laid the foundation for its own failure

A temática da segurança tem ganhado cada vez mais importância no cenário global diante dos crescentes desafios abarcados pelas transformações econômicas, políticas, ambientais, humanitárias e culturais contemporâneas. Estes desafios contribuíram para alimentar o debate em torno de uma concepção mais ampla de segurança internacional, tensionando perspectivas mais tradicionais das relações internacionais juntamente com novas abordagens que priorizam os indivíduos como centro da análise e ampliam os estudos de segurança para áreas até então desconsideradas pelo viés mais estrutural e geopolítico. Paralelo a essa tensão, encontram-se os Estados Unidos e seu posicionamento na ordem internacional pós-1989, que apresentou e apresenta, por meio de sua estratégia de segurança nacional, uma política externa que tem fortes impactos no cenário internacional, destacando a contínua relevância deste país para o mundo em constante transformação. De modo a colocar essas diversas questões em diálogo, tanto no que diz respeito às muitas dimensões da segurança internacional como a posição dos Estados Unidos para uma arquitetura mundial (tendo em mente que sua posição é efeito de um aparato complexo que envolve não somente os EUA, mas sua interação com os demais atores no cenário global), este trabalho resgata a concepção foucaultiana de governamentalidade, extrapolando este conceito para a esfera internacional através das análises das relações entre saber/poder e discurso. A governamentalidade é definida por Michel Foucault como o “conjunto constituído pelas instituições, procedimentos, análises e reflexões, cálculos e táticas que permitem exercer esta forma bastante específica e complexa de poder, que tem por alvo a população, por forma principal de saber a economia política e por instrumentos técnicos essenciais os dispositivos de segurança”, tendo como fundamento de sua existência um regime de verdade que consiste basicamente no livre mercado. A ideia de governamentalidade da ordem internacional consiste essencialmente na percepção de que o regime de verdade em torno dos mercados aponta para uma série de práticas organizadas, as quais podem ser provenientes da ação de um ou mais atores internacionais, individualmente ou em conjunto, tendo como objeto de atuação as populações e repercutindo internacionalmente. Os Estados Unidos se encontram no cerne da discussão uma vez que suas estratégias de segurança internacional refletem uma razão de Estado que tem no regime liberal sua premissa maior, constituindo dispositivos de segurança em defesa de uma ordem internacional liberal. Esta relação não é construída unicamente pelo governo norte-americano, mas conta com o suporte de importantes atores de política externa nos Estados Unidos, as think tanks, organizações de pesquisa e advocacy promotoras e propagadoras de ideias. Estas possuem um importante papel na governamentalidade da ordem internacional não apenas pela influência que exercem junto ao governo na formulação de estratégias políticas e à opinião pública norte-americana, mas também porque compartilham do regime de verdade defendido pelo Estado norte-americano. Este trabalho traz o exemplo de três importantes think tanks norte-americanas (The Brookings Institution, Council on Foreign Relations e American Enterprise Institute) a fim de mostrar o papel que elas desempenharam na governamentalidade da ordem internacional pós-1989, tendo como foco o próprio campo da segurança internacional.

Full textThe goal of this work is to understand how deep the commercial war between North America and Europe regarding the use of growth hormones in food-producing animals impacted institutional history of global food trade regulation. Between 1980 and the contemporary period (2016), several crises revealed the atypical nature of the European Union ban. As a result, the European Union views legitimacy was contested in the globalization context. The conflict takes places in several arenas. First of all, it constitutes an issue for Europe, which strived to find an interinstitutional agreement on how to legislate on growth hormones at the European level during the 80ies. Then, it has been one of the most talked about disagreements of the General agreement on tariffs and trade (GATT) and the World trade organization (WTO) negotiations from 1987 onwards. Finally, it involves the CodexAlimentarius Commission, the international organization in charge of setting food standards. In each of these institutions, the beef-hormones conflict management goes with important institutional changes: new specific units, working principles and procedures were created. Thus, my work aimed to precisely describe what consequences the beef-hormones conflict might have had on any of these institutions. As a result, I show how this specific case contributed to the instauration of internationalfood trade regulation.My work relies on a socio-historical inquiry based on diverse and rich empirical data, in order to cover the three aforesaid institutions between 1980 and 2016. I constituted a documentary corpus from institutional archives, and I performed about thirty sociological interviews. I spent several hundreds of hours realizing ethnographing observation, most of which being facilitated by my belonging to the ministry of agriculture’s services. Analysis of this data emphasizes the transforming role of the beef-hormones conflict at an international scale. The conflict first convinced all the stakeholders that it was crucial to strengthen supranational institutions (be it at the European or at the global level). It also allowed to test newly created instruments in their practical functioning. From this prospective, the beef-hormones conflict management reveals the different actors’ internationalrelations perceptions and their evolution during the studied period. Finally, as the beef-hormones conflict has constituted a pattern to the establishment of negotiation strategies, it became a cultural reference structuring an international community. It is therefore a socializing factor.My inquiry also enables a better understanding of private actors’ expectations about international regulation. Veterinary drug industries are actively involved in the institutional discussions surrounding the beef-hormones case, requesting for binding international food trade standards. They are more particularly interested in the activity of standard-setting bodies like Codex. This attitude indicates that those actors use global regulation instruments to advocate for their preferred collective action principles

Full textThe analysis of interaction between science and international law in establishing facts is an ancient thematic and yet the societal technicization and the complexity of modern scientific knowledge lead us to study this question with a new and deeper reflection. The comparison of different practices revealed that interaction between scientists in fact-finding and the legal practitioners correspond to a model of co-establishment of the facts, and this, regardless of the form of the scientists’ participation. Their skills are combined to determine the existence of the fact in law. This cooperation is not limited to a fact-finding procedure. On the contrary, it goes beyond the borders of a procedure ; and their exchanges are reflected in procedures for establishing the facts thus creating a resonance of the co-established fact. Nonetheless, if the judicial system reveals itself to be a system open towards scientific knowledge, it organises its relationship with science so as to maintain its own identity. It is therefore up to the legal practitioner to verify the relevancy of the fact co-established before its integration into the establishment of facts

Full textAfter decades of growth, it is now crucial to ensure that International environmental law is efficient. This implies, among other things, to guarantee the flexibility and reactiveness of existing instruments. This thesis aims to develop an analysis of the different mechanisms and phenomenon that allow International environmental regimes to adapt to scientific, political and legal evolution. It does so by focusing on a specific case study: the influence of the Intergovernmental science-policy Platform on Biodiversity and Ecosystem Services (IPBES) in the Mediterranean. The IPBES was recently established in order to cope with the inefficiency of current measures for the conservation and sustainable use of biodiversity. By assuming the success of this platform, this thesis will explore the different legal means of influence the IPBES has in the region. In doing so, we will see that the institutionalized expertise of Mediterranean regimes allows for a direct influence of the platform, while norm diffusion in the region allows for an indirect influence. The Mediterranean holds within itself all of the stakes of International environmental law. By focusing on the region, this study hopes to shine light on aspects of International environmental law that are seldom studied

Full textDealing with scientific issues is nowadays a major concern in inter-state disputes : beyond the question of costs, these issues are often decisive for states in succeeding to defend their case and they are no less critical for international tribunals when it comes to promote their legitimacy and ultimately, their survival. Science is indeed perceived as possessing extraordinary qualities for the pursuit of the truth (in the widest sense of this word) and for this reason, it has traditionally been considered a very powerful and precious instrument, mostly in the international legal order which is naturally decentralized. Nevertheless, one cannot but notice the disenchantment science has given rise to over the last decades : the multiplication of expert battles in court has frequently induced an undesirable loss of time as well as a growing feeling of mistrust, both the litigants and the international judiciary finally doubting the power of science for ascertaining the real truth. However destabilizing this reality may be in the particular context of the maintenance of the peace, this study is dedicated to show that science is definitely relevant in the settling of inter-state disputes. Most often deprived nowadays of their alleged (and misleading) capacities for perfect objectivity and the search for truth, experts will be shown to be paradoxically useful and productive actors in the course of international judicial settlement ; moreover, they will be shown to possess, under certain circumstances, a real power for relieving pressure and promoting appeasement between the litigants, thus making it easier for them to reach an amicable settlement of their conflict

Full textResearches from different social science disciplines have brought to light the transnationalization of politics in southern countries, ie the participation of international actors in areas such as, for example, the organization and observation of elections. Based on these researches, in an approach of historical sociology, this thesis shows how international "experts", under the label of "governance", have managed to impose themselves in the national political spaces to carry out activities considered as pertaining to the internal affairs of states (elections, parliaments, constitutions, etc.). Based on a survey made of the study of archives, observations, and interviews among the three poles that structure this form of transnational public action (UN, World Bank, USAID), we look more specifically at the processes by which these activities led to the production and mobilization of government knowledge. In contrast to an approach that would focus on "democracy promotion", we show that this legal, administrative, economic and political knowledge, all mark different frontiers between "administration" and "politics". Taking an interest in professional and academic struggles as to the uses of this knowledge then makes it possible to show how the same object of transnational public action (for example parliaments) is the subject of different and sometimes quite opposite problematization. During the first period studied, from 1961 to 1989, these activities remain limited and confined to distinct social spaces. But from 1989, the collapse of the Soviet bloc, ending diplomatic competition towards “third world” countries, opens the possibility of carrying out large-scale activities aimed at reforming state institutions and gathers these social spaces. A transnational field of "governance" reforms then emerges between more stabilized transnational social spaces, such as human rights, development, and international economic cooperation. The rapid increase in funding in the 1990s has led this field of reforms to differentiate itself into sectors ("electoral assistance", "parliamentary strengthening", "public financial management", etc.) within which the professionals of the various organizations collaborate, despite different professional and disciplinary habitus that oppose them on the object and form of interventions. These different activities of "governance" are institutionalized internationally and are imposed within national spaces on a fuzzy border between "administration" and "politics". The thesis then shows how it is a logic of professionalization that brings "experts" from different sectors to produce knowledge, norms and models of public action with universal vocation, to reaffirm permanently their authority in the field of reforms as in national spaces. The thesis shows, finally, how this form of public action which consists in sending international "experts" within the States is devalued by the arrival in the years 2010 of activities based on organizations local non-governmental organizations that conduct campaigns for the "transparency" of state institutions

This research focuses on the identification process of the export market researcher, designated as information acquisition mode. We aim to demonstrate that this acquisition mode is part of a system whose objective is to reduce the perceived ambiguity of markets in a controlled fashion. We describe the emergence of the system, its functioning and the identification process of the information acquisition mode. Since the characteristics of the system vary according to the level of internationalization and learning of the organization, we show that the choice of the acquisition mode is also impacted by the international development stage of the company
