Full textA great deal of attention has been paid to the performance of business networks in supply chain management, firms are collaborating more to develop long term business relationships. However, limited empirical evidence exists to validate a plural management model as a key success factor in a strategic supplier relationship. The purpose of this research is to enrich our understanding about how to manage an external provider relationship in case of outsourcing strategic procurement by providing empirical evidence. Then this research draws a decision making process for the Make-or-Buy of procurement activities which includes: Analysis of the current situation, Preparation for the Make-or-Buy choice, Scope of Make-or-Buy, Make-or-Buy analysis and Make-or-Buy choice. This research examines an in-depth qualitative case and contributes to the literature by providing empirical evidence

Full textBacksourcing is not a mainstream research field because it is closely linked with vertical integration and outsourcing. Indeed it means putting an end to outsourcing contracts and returning to vertical integration. Studying backsourcing is worth of interest because it allows adopting a process approach of the classical make-or-buy dilemma. The objectives of the thesis are to study the reasons for deciding backsourcing and the processes followed by firms to implement backsourcing. Several theoretical approaches were used for that. Backsourcing can be viewed as a strategic withdrawal decision or as a strategic change process that brings flexibility to the firm. This process must also be able to deal with organizational inertia. In order to answer to our research questions, we have conceived a conceptual backsourcing process model. We have carried out two longitudinal and retrospective case studies on IT activity backsourcing. Results indicate the role of internal crises for backsourcing initialization and the impact of the first backsourcing decision on the following operations. The backsourcing process development is influenced by different strategic, organizational and people factors. The thesis results underline the fact that backsourcing and outsourcing are intertwined and that backsourcing development relies on learning processes

Full textThe application of the concept of sustainable development to urban planning raises many questions as the contours of "sustainable urbanism" and "sustainable neighborhoods" appear to be unclear. Many tools have been developed to help design "sustainable neighborhoods", often derived from building design tools (LEED, BREAAM, HQE etc ...); they remain largely proposed and led by the Project Managers (MOE) and the Assistants to Project Managers (AMO). In this context, a question arises, which is to know what may be the impact of these tools on the decisions and the conduct of the urban project by the Urban Contractor (MOU). In addition, the urban project, which aims to create a neighborhood or "piece of town", involves a wide range of actors and the questions raised by the Neighborhood Sustainable Assement (NSA) go well beyond the scope of action of the MOU. If the MOE and AMO couple can "be satisfied" using the existing tools regarding their respective missions; the MOU, because of its central role and driving force in the "sustainable neighborhood" is in need of new processes to meet the challenges of sustainability requested by these tools: how to work with the different actors aiming a shared vision with common and / or converging objectives? Then naturaly the problem of the evolution of the working methods of the MOU is posed: during the conduct of the neighborhood development, how not to have "losses online" and thus continue to progress between two neighborhood development: the capitalization of the know-how of the MOU starts to become the central question

Full textThis research is part of a study in design on the multiplicity of ways in project management. The word « manner », with its Greco-Latin origins from « mania » to « manuarius » inclines us to take it as « skilful folly ». This meaning allows us to question the various « manners to conduct the design project » as gap practices. Thus, we are invited to explore the field of divergent polarities in a discipline made of breaches and guidance. This aporia leads us to consider a necessary dogmatic passage. From singularities to unicity rather than from universality to unity, this research is constructed on the assumption of a common purpose: make the world through manners of making worlds. The analysis of a few projects related to multiplicity leads us to bring out the tension between design and the environment. Taking a critical stance toward projections evoking the idea of a « centering and separating » paradigm, this research questions afterwards its inversion through « de-centering and de-separating » values

Full textLike the obligation to provide assistance as well as the availability of distinctive marks, the know-how represents an essential component of the franchise agreement. Despite its importance, the legislator chooses not to define it. Thus, the constituent parts of the know-how had to be released by the jurisprudence and the doctrine. Furthermore, the importance of the know-how within the franchise agreement is reflected in all the obligations of both parties all along the contractual relationship. Because of its great heritage value, the franchisor will need to take all the necessary measures in order to preserve its know-how. The franchisor will be able to recourse to different actions, civil or criminal ones, in order to compensate, on the one hand, for the loss allegedly suffered, and on the other hand, that the know-how perpetrators conviction can take place

Full textMeasurement theory, based on projective measurements, is a fundamental aspect of quantum mechanics. Weak measurements differ from standard projective measurements on which the elementary axioms of quantum physics are built. Although weak measurement framework is defined within standard quantum mechanics, its implications are still poorly understood. The thesis work is part of a broad reflexion that aims to understand the conceptual and practical implications of such a measurement and to understand it in the context of quantum theory.Chapter 1 is a detailed introduction to weak measurements and weak values. Next, we will study the "weak trajectories" in a two slit interferometer. In Chapter 3, we discuss the implications of a cancellation of a weak value with respect to the observation of weak trajectories in nested Mach-Zender interferometers. Finally, Chapter 4 deals with the theoretical and experimental criticisms in the literature of the effect of the Cheshire Cat that is defined in the framework of weak measurement
GRANGET, NORBER. ""faire societe" en entreprise d'insertion ?" Paris 7, 1996. http://www.theses.fr/1996PA070106.
Full textThe "entreprises d'insertion" appeared in france in the end of the 1970's. They have been supported by a law since 1985. This sort of firms, that are non profit organisation too, don't exist out of france. They are included in what's called "initiatives for "insertion par l'economique"". This last concept has no sense in english, but could be translated into : "integration by economic means of the unemployed in their society". This doctoral thesis aims at demonstrating that the "entreprises d'insertion" were created by social workers to pursue their own political project of society, and also to contribute to go with the evolution of the institutional organisation of their society. It tries to explain how the people in charge of these firms help unemployed people to participate in their society, through the analysis of interviews with all the types of salaried employees of 21 firms. This research concludes in the description of several elements that are supposed to condition the participation of each person in his society. It insists on the importance of local partnerships that must be created by local economical, social and political decision makers, to help people make progress on the elements described before. These partnerships, if they respect the values and concepts defended by norbert elias in his sociological theory of "social interdependences", or by vincent de gaulejac and isabel taboada leonetti in their theory around "desinsertion sociale", can constitue the basis of new ways of social regulations

Full textThe traditional know-how were considered for a long time as having not much interest. Their international recognition was made at the Rio Conference of 1992, through the Convention on Biological Diversity. This recognition and the signing of the Agreement on the Aspects of Trade-Related Intellectual Property Rights of 1994 (TRIPS) have led the countries of the South mainly, to raise questions to which the law and, more particularly the law of the intellectual property (DPI) are struggling to answer. The main question is to know the nature of the legal protection given to traditional know-how and more particularly to those related to biodiversity. The DIP not only has difficulty in identifying the nature of the rights and benefits to be granted to the holders of this knowledge, but above all, in identifying this notion of traditional know-how. The DIP struggle to address the issues as legal débats are generally lead by political and economical interests where two very different conceptions of the legal protection of traditional know-how confront each other. The one of northern states that have a private and utilitarian conception. That of northern states that have a private and utilitarian conception. The aim is, with DPI, to control the scientific and commercial use of know-how. The one of southern states that have a collective or even community vision of the protection of their knowledge in order to protect the integrity - spiritual, cultural and social - of traditional knowledge. The main international answer today is the certificate. However, this one doesn’t fit well these traditional collective and ancestral know-how. In fact, behind this notion of traditional know-how, there is a key issue, that of access to genetic resources and traditional know-how. The ambition assigned to this thesis (PhD) is to explore new alternatives to intellectual property, in order to find a regime appropriate legal framework for traditional know-how

Full textOur subject is two-fold. The 1st aspect is about training : how have primary school-teachers been recruited and trained from the time of the first "écoles normales" to our current "teachers' training colleges" ? Who are they ? through what process do they become primary school teachers ? How did they use to be trained ? How are they trained nowadays ? The 2nd aspect is about being a teacher and deals with individual practices, what teachers actually do in their class and what representations they have of the pupils and of their profession. Our work is an endeavour to link the two. The creation of the IUFM (Teachers' Training Colleges) in 1991 could have occasioned a break because it created a new status among primary school teachers. This idea has been put forward by previous studies which mention a crisis or regret a "golden age". Since 1991, the former teachers who were recruited at an early age, just after the baccalaureate or after only a two-year course at university, have had to work with their new, highly educated, better paid colleagues who have been trained differently. No sign of a crisis has appeared yet. Our thesis is rather that of a continuity, a slow change of a professional body adjusting to new situations. It takes into account 3 variables deemed discriminatory : the length of services, the location and the teachers' professional and social background. It is a sketch of a very old and yet very modern profession

This thesis studies Fair Park, a 277 acre public park located in Dallas, Texas. Fair Park represents prevalent planning challenges - the repurposing of sites that have outlived their initial uses and the reintegration of such sites into their surrounding contexts. To better understand the site, a historical overview of the development of Fair Park from inception to its current condition is provided. Fair Park is looked at within the context of South Dallas in efforts to understand the past planning efforts and why they have succeeded/failed. A new framework for thinking about future planning efforts for Fair Park is proposed so that the site can catalyze the revitalization of South Dallas at large. Two alternative land use scenarios are provided to illustrate the site's development potential under the proposed framework. The thesis concludes with proposing a structure for moving forward with the planning and implementation of new development in Fair Park and summarizes some potential obstacles to implementation that must be carefully considered.

Full textRestoration ecology is a scientific discipline that has emerged forty years ago to try to compensate the negative impacts of society development on ecosystems. Today, following global meta-analyzes revealing the relative success of ecological restoration, a new question emerges: should we actively or passively restore degraded ecosystems? It is in this context that this thesis project took place with a multidisciplinary approach and focused on the study of quarrying impacts on the Mediterranean steppe of Crau (Bouches-du-Rhône, France). Two cases were taken into account: (i) old quarries operated in the 1970s and abandoned then, presenting a variety of exploitation types or rehabilitation modalities, and (ii) a quarry still in the process of exploitation, the legislation now requiring repairs. The aim is to better identify possible scientific obstacles in the field of knowledge for ecological restoration and better define societal expectations in order to finally propose a general strategy intended to serve the future management of these ecosystems. The research of this thesis was based on two major questions, reflections: (1) Do ecological restoration actions restore the reference ecosystem (= the pre-existing ecosystem)? By comparing different long-term restoration treatments (various types of soil transfers, anthropogenic deposits, lack of rehabilitation), we were able to show that soil transfer is still the best method, especially when the initial characteristics of the soil are respected. However, it still does not compensate in the medium term (35 years) for the destruction of the pre-existing ecosystem: the soil and the plant community of the reference steppe are not completely restored yet. A second soil mixing technique used when the original soil is no longer available has also been tested, but it is not very successful either in the short-term (3 years). A second question arose in parallel: (2) Without active restoration, what is the value of biodiversity generated by human activities? And more generally, what kind of nature do we want? Quarries have destroyed the pre-existing steppe ecosystem but have also created new conditions (soil, new habitats) that support the functioning and connectivity of pioneer species and shelter important heritage biodiversity that is absent from the pre-existing ecosystem. In addition, the comparison between the quarry landscapes and the reference ecosystem landscapes with different stakeholders and the general public has shown that the old quarries are perceived as being much more natural than the reference steppe and that they are also associated to an important biodiversity. These results could therefore reorient the choice of restoration or management, in order to choose between 1) what is currently recommended (active restoration applied after the end of quarry exploitation with the historical ecosystem as a reference) and 2) the free expression of feral nature also called passive restoration (with or without reclamation, i.e. where the reference ecosystem is different from the pre-existing ecosystem)

Full textThis thesis focuses on the social condition of seasonal workers in tourism from an ethnological point of view. These seasonal workers carry out their activities in tourist resorts in the South East of France and are subject to flexible and unsecure employment policies. This form of intermittent employment implies geographic and professional mobility which corresponds to the rhythms and requirements of the tourism sector. These workers question the dominant set of norms regarding employment, social rhythms and lifestyles. Their socially depreciated work is considered as transitional. Nevertheless, many of them “work the seasons” for many years, sometimes during their whole working life. How do they manage to “have a career” within a precarious employment system? The analysis looks at the position of the seasonal workers in the companies and within the tourist resort. This research shows that these workers are subject to a mechanism of social invisibilization. The study also encompasses work organization in the context of large variations in the amount of working hours. Finally, the analysis looks at the various ways of coping with intermittent revenues (during the between seasons periods as well). We will consider long term trajectories of seasonal workers. The relationship between work and non-work is at the center of this research. Being concerned with the living conditions of these tourism workers leads to a broader consideration of the position of work and leisure and the sense of norm and autonomy in our society
