Abstract:
Immigration crime in the form of providing false information in terms of efforts to apply for the manufacture of travel documents of the Republic of Indonesia (Passport). The formulation of the problem is how the occurrence of immigration crimes committed by foreign nationals from Myanmar in making Indonesian passports, and whether the Immigration Law Enforcement of Myanmar foreign nationals contained in Decision Number 361/Pid.Sus/2022/PN.Dum is in accordance with Law Number 6 of 2011 concerning Immigration. The type of research used in answering these problems uses normative juridical legal research, descriptive in nature, the data used is secondary data, and primary data as secondary data support which is analyzed qualitatively and how to draw conclusions using deductive logic. The result is the investigation process by the Immigration PPNS, and is subject to criminal sanctions by the Dumai District Court as contained in Article 126 letter C of Law Number 6 of 2011 concerning Immigration for 5 months imprisonment, and a fine of Rp 100,000,000.00 in lieu of imprisonment for 2 months. In conclusion, the occurrence of Immigration Crimes in the form of providing false data information. the acts committed have the content of imprisonment sanctions, and fines.

Abstract:
Regrettably, it is true in Bangladesh people are sentenced to imprisonment, even death penalty for crimes they have not engaged at all. But there is no specific provision of claiming compensation for false imprisonment in this country with a very few exceptions. Bangladesh, as a signatory country of ICCPR, requires taking the necessary step to compensate the victims of “wrongful imprisonment” and “wrongful detention”. This paper recommends Bangladesh to enact clearly expressed legislation elucidating this right and represent modelling reforms. In favour of this recommendation, this article makes a clear picture of the problems, reasons for it and its nature in Bangladesh, describing the consequence of individuals wrongfully detained and convicted by examining recent cases. This research paper then illustrates the Bangladeshi legal frame and international legislation which Bangladesh bound to compensate these victims. Finally, the article suggests how Bangladesh can adopt all-inclusive law to compensate the victims of wrongful imprisonment and detention.

A questão dos adolescentes em conflito com uma lei periodicamente é abordada pelos meios de comunicação após um a infração de grande repercussão. Após, seguem apelos por redução da maioridade penal e mais encarceramento e rigor nas punições. Esta pesquisa busca apontar a vulnerabilidade dos adolescentes aprisionados nas unidades da FASE de Porto Alegre. Para tanto, será observada a mortalidade desta população no período 2002-2012. Objetivo: Analisar as internações de adolescentes em conflito com a lei e sua mortalidade entre os anos de 2002 a 2012. Métodos: Estudo observacional de amostragem não probabilística de adolescentes privados de liberdade nas unidades da FASE de Porto Alegre-RS, desligados nos anos de 2002 a 2012 (n= 8290). Foram colhidas do banco de dados as seguintes informações: data de desligamento, ato infracional, cor da pele, gênero e tempo de internação. Esta seleção foi comparada com o banco de dados do Sistema de Informações sobre Mortalidade (SIM), disponibilizado pela Secretaria Estadual de Saúde do Rio Grande do Sul, a fim de identificar os adolescentes que tiveram seu óbito registrado no sistema estadual após o desligamento. As análises foram feitas através do programa Statistical Package for Social Sciences (versão 21.0). Resultados: Os adolescentes têm sido internados predominantemente por atos infracionais de cunho patrimonial. Internações ligadas à entorpecentes, majoritariamente o tráfico de drogas, sofreram um aumento de aproximadamente 700%, sendo que estes indivíduos também apresentaram sobrevida menor após o desligamento da instituição. A mortalidade e a vitimização dos egressos é superior à encontrada em estudos semelhantes de outros países. Conclusões: As informações trazidas evidenciam o alto grau de vulnerabilidade à que estão expostos os adolescentes egressos das unidades de internação de Porto Alegre-RS.
The issue of adolescents in conflict with a law periodically is addressed by the media after a high-profile infraction. Then there are appeals for reduction of the age of criminality and more imprisonment and punishment. This research seeks to point out the vulnerability of the imprisoned adolescents in the FASE units of Porto Alegre. For this, the mortality of this population will be observed in the period between 2002-2012. Objective: To analyze imprisonments of teenagers in conflict with the law and their mortality between the years of 2002 and 2012. Methods: Observational study of non-probabilistic sampling conducted with the database of adolescents released from prison units of FASE-RS in the city of Porto Alegre in the period from 2002 to 2012 (n = 8290). The following information was gathered: date of release, infraction, skin color, gender and prison term. This sample was compared with the database of the Mortality Verification System of the Health Department of Rio Grande do Sul, Brazil, in order to identify adolescents who died after being released from prison. Analyses were conducted through the Statistical Package for Social Sciences (version 21.0). Results: Adolescents were mainly imprisoned for property crimes. Imprisonment rates related to narcotics, mostly trafficking, raised approximately 700%. Individuals imprisoned for drug-related crimes also survived less after being released from prison. Conclusions: The evidence highlights the elevated vulnerability to which adolescents selected by the juvenile justice system are exposed.

This chapter begins with a discussion of the meaning of intentional interference. It then considers assault, battery, false imprisonment, and residuary trespass and harassment. Intentional physical interference with the person may occur by way of an act that threatens violence (assault), amounts to unlawful contact (battery), or constitutes the deprivation of liberty (false imprisonment). There is, in addition, a residuary and uncertain form of liability for the intentional infliction of physical harm, known as the rule in Wilkinson v. Downton. These torts are normally actionable without proof of damage and they also involve a sharp distinction being drawn between an act and an omission: the latter will not normally suffice to ground liability.

Abstract:
Property and casualty insurance as an umbrella term encompasses various insurance products that cover the risks of damage caused to the assets and provide the liability insurance. As insurance business is related with money people have always tried to perform illegal activities to earn extra income. Insurance fraud as a type of financial crime has existed since the origination of commercial business. Therefore, insurance fraud, its identification and prevention is one of the most topical and essential problems in the insurance industry. The research aim is to assess property and casualty insurance market trends in line with the insurance fraud. The research mainly applies the monographic descriptive method as well as the methods of analysis and synthesis. Content analysis is used to study case laws and analyse insurance fraud cases. The research results demonstrate that in Latvia, the annual amount of compensations paid by insurance companies due to fraudulent claims may range between EUR 7.55 million (in case of 5% fraud) and EUR 30.10 million (in case of 20% fraud). Yet, 20% of fraudulent cases might basically refer to the recent pandemic years like 2021 and 2022. The most popular and serious insurance fraud cases relate to a car theft, staged accidents, submission of false documents and hidden actual causes of the fire in property insurance. The analysed court cases report fine, forced labour and even imprisonment as penalty measures for the committed insurance fraud.
