Full textThe author uses interractionism, sociolinguistic and phenomenology concepts to produce his research of ethnology in his own family. He tries to repear moments of trouble in this group. The object is revealing the actor's positions. Also, it's possible to understand ways of conservation in the family's discourse : intonative's keeping procceses, manners to keep secret or to hide some parts of discourse. What can we say and what must we hide to conserve our behaviours to not brea the family's rules. Thoses intentions or fictions in ordinary ways of speaking can explain this work

Full textThis research fits in the field of consumer socialization. Its aim is to define which are the family interactions - I. E. The family communication processes - the parents use to develop consumer learning for their children. A qualitative methodology built on case studies and content analysis was used and the contributions of the work are three fold. First, we describe and explain the family communication dynamics developed in the field of consumption in each family. The results point out that parental consumer learning can be conveyed through 4 different types of family communication processes : - family communication processes through mediation of external information - family communication in retail stores - informal family communication processes - family communication processes focused on the values of money or autonomy. In a second time, we gather families, according to their closeness of their communication processes. Thus we define 5 patterns of family communication, each caracterized by a special combinaison of family communication processes. Then, we attempt to see which particular family communication process tends to favour the acquisition of consumer knowledge. At last, we identify the most efficient patterns of family communication, according to consumer learning for children

Full textWhat's the nature of the tie between a guru and his group ? Is the " sect " a way to recovery or destruction ? Must we talk about " the sect " or about " groupe jeopardy " ?From the state authorities point of view as well as for the specialists and other field workers, sects are found guilty when they attempt against human rights and constitutionally granted liberties. Some people think that the sectarian machinery has to be clearly defined and examined so that a delict of mental mischief could be put forward. From this point of view, family stands in opposition to the sect. As far as family rights are concerned, some magistrats consider every case as particular, having regard to delictuous deeds on one hand and educative offences on the other. From this controverse emerges an anthropological question : whose rights are we defending ? In this perspcetive, the concept of subject forges ahead the question of the social tie and of the sectarian tie. Looking back on the notions of family, religion and sciences enables us to bring out several existential standpoints towards freedom. A " sect " may be dissident, " religionistic " or " spiritualistic ". Danger for anyone, subject and society, has to be evaluated with regard to its position, to the nature of the group tie and its rites ? No human community built on a manuchean digma is safe from totalitarian practices. Utopian sectarian sects are particurlarly destructive in the way they try to cancel incarnation. In their aim to mould a perfect human being into their own schemes, these challenging worlds, these sterilized bubbles succeed in reducing their followers into objects animated by an active passivity. Motionned by an ostensible hostility towards democratic institutions, their leaders are guilty of crime against humanity. Ideological pratices attack life with regard to filiation, family, subject and culture

Full textWe compare the communicative behaviour within the duos fathers-infant and mothers-infant within one culture (intracultural comparison) then those between France and the Czech Republic (intercultural comparison). Thus we examined the structural, functional and pragmatic aspects of the parents-child communication. To realise this approach we have chosen the situation of the reading of an illustrated book. We worked with middle-class families. The infants are first born, aged between 30 and 36 months, living with their two parents. The total number of subjects is 28. The children are divided in a balanced way: 14 French and 14 Czech, and in every sample 7 boys and 7 girls. Thus our results indicate, that indeed in the one hand, the culture plays the role of universal factor which determines the way of the communicating in the family and, in the other hand the culture seems to act as a factor of specification which is linked to the country of origin

Full textThe study of social representations in couples' relationship and in the marriage, has a primary objective to know which is the relation between the ideal image of the couples' relationship and the marriage, and the personal experience; as well as to know the semantic contents of the representations regarding the couple relationship and the marriage, and also the way those meanings act over the individual and social practices. The methodological procedures used were the semi-directive interview and the questionnaire. The interviews went through two types of analysis : thematic and sequential content and lexicographic Alcest's support, for the questionnaire, the statistical processor SPSS. The results' interpretation was made according to three analysis levels: cultural (institution and values), social (expectations and hapiness) and individual (sexuality, affectivity and communication). The conclusions were that the image of the couples' relationship and the marriage, for men as well as women, still remains in traditional terms. It is due to this focus, that a new problematic about the ideal image and the personal experience on the couples relationship and marriage is approached, and by shedding light on the interactions and correspondences between representations, practices and values

Full textThe study of the communicating characteristics in patients with Duchenne muscular dystrophy (DMD) is considered in this work with a developmental interactionist and pragmatic perspective. DMD and control participants underwent two communication situations : a dyadic interactive situation in a family setting (with the father and with a sibling) and a specific discursive situation, narration. The findings indicate that DMD modifies the communicational behavior of the child and that of family members. In the narrative situation, a difficulty in taking the communication context into account and in respecting conversational cooperation rules is observed. This results point out to the patient's adaptive discursive strategy that aims at maintaining efficient communication, yet modifying certain contribution and pragmatic characteristics : it allows patients and reveals a singular neuropsychological profile of these patients

Full textMany problematic situations can weaken the family functioning. The family situations involving a danger for the safety of the child or one of the parents are among the circumstances that increase the vulnerability of the family members. In these situations, the supervised child visitation services are an option which maintains parent-child contact when the absence of supervision could expose the child to problematic situations. Families can be referred to this type of service under an order from the Youth Division of the Court of Québec (children in care under the Youth Protection Act), an order from the Superior Court of Québec (disputes between separated parents) or under a voluntary agreement. Studies on the subject show that these services have positive effects, especially on the parent-child relationship. However, few studies have compared these two supervision contexts. This research, which is exploratory-descriptive and based on a secondary data analysis, tends to identify similarities and differences in the experience and family functioning of parents using supervised child visitation according to these contexts. Thirty-five interviews with parents involved in these services were analyzed using the McMaster family functioning model (2008). Parents from both supervision contexts emphases the ability of the services to foster the development of the parent-child relationship, in addition to supporting the development of positive parenting skills. Impacts related to the parent lack of attendance are also underlined (e.g. the child’s feeling of security decreases). As for the differences, parents referred by the Superior Court stand out because of their misunderstanding of the role of supervisors and the impact that this entails (e.g. feeling of discomfort in the child). In youth protection, parents experience less confusion about the role of supervisors.
Bisson, Sophie. "L'autorité dans la famille." Reims, 2004. http://www.theses.fr/2004REIMD001.
Full textThe notion of authority appears as one of pillars of family's law. The bases of the authority in the family have very evolved all long history period. At first, the authority was bound to the quality of man, then at the existence of marriage to be today based on the kinship. This evolution shows the way of an organization of patriarchal's type in which the power was the expression of a juridical authority on the wife and on the children to a familial organization of equalitarian type in the bosom on which the parental responsability takes its origin in the only one kinship. At the end of this evolution, the authority is above all that of parent's. The authority in the family expresses therefore today for the main point via the concept of parental responsability. Two elements render an account to this authority in the family : the legal power and the legal duty. Henceforth, the parental responsability surpasses all the law family and represents in that a new familial reference

Full textThe study probes into what makes children relate positively to school and into the development of literacy, envisaged as a multi-dimensional object, against a social backdrop of hierarchic multilingualism and in a school context where reading and writing are taught in foreign languages whereas the mothertongue is not taught. The compulsory languages taught at school are English, which is the quasi official language in the country, and French which enjoys a large social embeddment. The only endemic language in the island is Creole, which draws most of its lexicon from French. Interviews, assignment of tasks which look into the four dimensions of written language and post-task interviews give data which are ripe with hypotheses for further studies : 1) In bilingual learning contexts, acqusition of concepts of literacy takes place separately in each language. 2) The overlooking of the mothertongue in the curriculum breeds confusion in learners. 3) The conceptualisation of the working of literacy is done initially in one language. 4) The conceptualisation and the strategies resorted to are very similar in both languages but literacy in English comes significantly later. The study furthermore confirms the co-evolution between contextual and decoding strategies, this co-evolution being determined by the context

Full textWe took, as our point of departure, the idea that technical objects cannot be reduced by a material causality, determinant as such. The technical object is, before all else, a social object, that is to say its role in society is a function of the meaning that society assigns to it, based on its possible uses. It responds to latent or specific requests. But its integration into the social field does not transform it into pure passive reflection. Through a "feed-back" effect, the technical object imposes its own logic and indirectly produces certain social consequences. (. . . )

Full textLooking at families in greek cities from archaic to hellenistic times, i argue that they are based on integration mecanisms like sociability rituals. Daily little gestures as much as broad feasts build family life and introduce notions of 'familiarity'. They define the family identity and its inner and external limits, its boundaries. They contribute to place the family in its city, drawing relationships in between oikoi and city: family rituals of sociability provide families with a public and social display. Thus family and civic memories are complementary. Nevertheless, family, as a group of sociability, can be a place of 'counter-power' of the city cohesion; that explains wills expressed in some cities to reduce or supress expressions of family sociability

Full textIf in the popular spirit the family relationships are synonimous of understanding and benevolence, they can also be synonymous of conflicts exposed on the legal scene by means of a civil liability lawsuit. The appreciation of the incidence of the family relationships on the civil liability implies not only to detect possible changes or distortions of the responsibility in the considered domain, but also to estimate these changes or these absences of changes. The passage of the civil liability in the considered field can be then valued to decide on an adaptation or on a maladjustment of the civil liability in the family relationships. Confronted with the patrimonial aspects of the family links, the rules of the civil liability modulate in a satisfactory way by protecting management’s rules of the family patrimony and the individual nature of the responsibility despite the existence of a unified patrimony so that this rules are particularly adapted to these patrimonial aspects. But, the adaptation is invalidated when the civil liability is considered by the prism of the personal aspects of the family relationships. The appeal to the common law of the civil liability to regulate the extrapatrimonial relations within the family can weaken the idea of a specificity of the responsibility in the family reports. But this situation must be deplored when it leads to unsatisfactory solutions and conflicts between the rules of the civil liability and those of family law, knowing that the existence of specific texts can’t be perceived as a remedy

Full textThe specificity of family extrapatrimonial law led to wonder if the application of an original theory of the law of evidence was justifiable. But the particularism of the system has diminished in order to give free rein to the development of the right to evidence with a return to the principle of the freedom of evidence as regards judicial facts. The disappearance of legal specificity of the evidence, already carried out to a very large extent by the law of 11th july, 1975, as far as marriage and divorce are concerned, takes place today in the field of filiation. Indeed, since the law of 3d january, 1972, has been implemented, the evolution has carried on and has even increased-over the past years- in so far as civil courts have fully made use of the increased powers which had been given to them. The rapid improvements accomplished as far as scientific research is concerned have led to the upheaval of some traditional conceptions; they have made disappear the natural obstacles to the right to evidence, which were depending on the impossibility to substantiate. But still there is - in a standing and irreducible way- an originality in the facts : if the subject of the evidence is specific, the means of evidence -if they may as a whole be linked to the existing categories- are original in spite of everything

Full textObserving the notary's role in family law makes us wonder how his role defines itself in the XXIst century's law, and which role the legislator wanted to entrust the notary with ? Observing the notary's role in family law is also studying the rôle which the people has conferred him with. We should not only use the customers aspect, it seems that refering to the notary's professional fees bounds his role ; indeed, refering to a patient, even if it could be considered as an inappropriate shortcut, should be suitable : the notary is traditionally involved in family law because of longestablished competence in assistance and advice, consequently acting as a family lawyer in greater proximity with the clients. The notary's effective engagement frequently goes far beyond the assignment he has been given by the legislator : as a multi-knowledgeable lawyer, his skill is therefore more and more based on his great knowledge of contracts, as much as on his abilities of a judiciary agent, and sometimes even on his ombudsman role. Observing the notary's place in family law is also wondering about the future of the profession, and above all, about the future of the notary himself, about his sociological and legal roles. Which role will be given to him by the legislator ? Which role European or French citizens will expect from the notary ? And above all, which role the notary will want to give or will be abble to give to his profession ? The notary is indeed on people's service, but he remains his occupation primary source. The seriousness of the notary's task will be this thesic subject, that is to distinguish, in the family law policy, what could be the notary's tasks, and therefore how he could give his profession a national value as well as a European value, considering that the legal aspect cannot be dissociated from the economical and sociological trends, wich are both another aspect of the notary's role (which is consistency and complementarity) ; as a key instrument to determinate the extent of the notary's role, the law should however be observed in parallel with his customers' needs which are, due to their requests, more likely to develop his skills

Full textHow does the Conseil constitutionnel apprehend the family? This question leads to study the relationship between constitutional law and family, whose mutual igorance seems acquired. A positivist and analytic approach of the jurisprudence of the Conseil constitutionnel however illustrates that this apparent mutual disinterest is not grounded. Family is an institution protected and protective according to positive constitutional law; the latter prescribes to protect the family and also prescribes to the family to protect. Constitutionnal law prescribed after all to build family. This question leads to study the legislative concretizations of the constitutional norms concerning family. This study illustrates the techniques used by the Conseil constitutional in its judicial review. The study also emphasizes the fact that this concretization protects, but also sometimes threatens, the recognition, the development and the unity of the family. The realization of the constitutional law leads after all to a legislative construction of the family. This question leads finally to observe that family consists more in the legal construction of an object than in the construction of a legal object. The concretization of constitutional norms concerning family illustrates in effect a “familial pluralism”, which contributes to reveal the dynamics of the legal construction of the family

Full textThe Modiano protagonist is seeking to have both an ideal (perfect) and virtual (fantasy) family. Every scene not only represents the unconscious fantasies of the protagonist but also the major story for Modiano. We can see, on the path from research to mystification of the family, a typical dramatization. However, for the Modiano protagonist, the only family is the one of the novel. The family is impossible, but the novel is possible. Similarly, there is no new family, but only the New Family Novel : there is not only the novel but also the theatre (or circus). In reality, life is a circus both comical and grotesque at the same time. The family is lost, but for Modiano, it is impossible to find the thing that one once lost. It is better to re-create something new : instead of finding the family back, the protagonist writes something. In all the Modiano books, the question of identity begins and ends with that of writing. Our study aims to know how he establishes the link between identity and writing, how the process develops itself. The book is the golden key to enter the world of Modiano and the keyword to translate the mystery of life : literary creation is the only (re)solution for Modiano. The book is the free space that allows one to accomplish his mission which seems impossible : to live and re-live his life

The study of texts and jurisprudence show that grand-parents have still an important place in family law. The rights they are given are no longer justified by their authority on the family but both by child's interest and solidarity between generations. So, the rights they are given about the marriage or the filiation of their grand-children are obsolete. In the opposite, it's to be desired that law gives them other rights about adoption, for instance

The relations between family and urban life quality date from the 18th century when the family-feeling become to arouse. Before, other territorial, economical or religious groups were more important in the urban way of life. Since this time, the family's part is more and more important. There has been a lot of dispute against it, as an institution, but most of people still want to live in such a group in which they can satisfy their affective and territorial needs. As a complement of family-life, the quality of urban space is very important. The citizen needs to be able to meet others, to integrate a social group. The opportunities are becoming scarce for a lot of people in great cities. The family can become a retreat; people can try to live outside the city in periurban areas; they can try, also, to reach the numerous associations that try to iel, lonely people to meet one another. Urban-life quality is a result of these choices. Family-life quality too. The inhabitant of the city needs to appropriate is own life-area. His family-house is the symbol of this appropriation. But city-planners don't respect this aspiration. Urbanism is a specialist's affair. It shoudn't-helping people to share the decisions concerning their life-space could resolve the both problems of life quality in cities and family-life quality

Full textThe first part of this thesis describes the comparative unfolding of guanidino kinases with differing quaternary structure (monomer, dimer or octamer). These enzymes catalyze the reversible transfer of the ATP γ phosphate to a guanidylic acceptor (creatine, arginine). We have shown, that for dimer or octamer creatine kinases, association of subunits is required for expression of catalytic activity. However, a higher level of quaternary structure does not provide these enzymes an increased conformational stability as compared to a monomeric arginine kinase. In a second part, we describe the characterization of a new guanidino kinase displaying a duplicated structure and which is expressed in Schistosoma mansoni cercariae. We have developed expression and purification protocols for the untagged protein, identified its physiological substrates, defined its enzymatic parameters in the direction of phosphagene formation, crystallized this enzyme and determined its three-dimensional structure by X-ray diffraction
