Abstract:
This article summarizes the provisions of the Family and Medical Leave Act, its possible effects on labor markets, and the resulting changes in the ability of workers to take leave. The author concludes that the actual provisions of the act are quite modest and have yielded neither large benefits to workers nor imposed significant costs on employers. One reason for this is that few workers gained significant new rights to time off work because the legislation contains many exemptions and employees often had other mechanisms for obtaining leave prior to its enactment.

In this article, we use feminist theories of the state to examine why the Family and Medical Leave Act (FMLA) has had relatively little impact on increasing men’s caregiving after the birth or adoption of a child. Applications (completed between 1995 and 2000) for leave by full-time staff employees working for a southeastern university of moderate size were examined by sex and age. Chi-square tests for frequencies of requests by reason (care for others vs own health condition) for taking leave were not associated with sex but were associated with age. The Family and Medical Leave Act may help both men and women assume dual roles of worker and family caregiver. Older workers were more likely to take leave to care for their own health condition than to care for others.

The implementation of the Family and Medical Leave Act of 1993 (FMLA), how employees use such leave, and its effect on pharmacy service provision were examined in a national survey of 494 hospital pharmacy directors (16.2% useable response rate). Although there is some discrepancy regarding how to calculate the 12 weeks of leave time, at least 18.7% of respondents were found to allow less time than allowed by law. Politicians, media, and the public use the term "gridlock" to refer to the crush of competing interests in the policy process. Gridlock, however, is not a phenomenon that can be objectively identified or addressed. Rather, it is a catch-phrase used by partisans and pundits.
