Given the prominence accorded to doctrinal authority in the earlier canon law, it is natural that most famous canonists achieved their fame through their writings. Although the leading writers were often also judges and men of affairs, it was possible to lead an active life in the practice of the canon law without leaving any identifiable mark on history. To this general principle Bishop Bateman constitutes a remarkable exception: distinguished judge, leading figure in the Curia at Avignon, and patron of legal studies in Cambridge, he left several marks on history which entitle him, though not known as a writer, to be classed with the greatest English canon lawyers.

Under the federal trademark law, owners of famous sport trademarks may bring legal claims against unauthorized users of their marks under the infringement and dilution theory. Although the rationale of trademark infringement has been supported by various notions of consumer psychology and law and economics, the theory of dilution has been criticized for the lack of empirical support. This study investigated whether the junior use of major sport trademarks would have dilutive effects on the senior marks in financial terms. The study employed the contingent valuation method, a technique designed to estimate the economic values of nonpecuniary assets such as trademarks. A total of 140 subjects were exposed to dilutive information while they purchased sport brand merchandise. A series of pre- and posttests revealed that moderately famous sport trademarks suffered dilutive harm from junior use, whereas exceptionally famous marks were immune to the dilutive effects. Theoretical and practical implications were discussed.

Calls have been made to introduce trade mark dilution into New Zealand 's trade mark legislation. Currently trade mark protection is limited to the same or similar goods or services to those over which the trade mark is registered, and within this class only certain uses of that trade mark are protected. The positive associations the selling power of famous trade marks is such that their use on dissimilar goods or services can make those goods or services more attractive to consumers. Trade mark dilution recognises that such unauthorised use will weaken the famous trade mark's selling power and proscribes such use. Trade mark dilution, however, goes further and removes the distinction currently made between different uses of a trade mark. Infringement occurs if unauthorised use of the trade mark damages the positive associations the trade mark invokes. Unless exceptions are made to the latter aspect of trade mark dilution, the impact of trade mark dilution upon free speech will be significant.

For many years, the Rare Books Department (Book Museum) of the Russian State Library has been conducting up-to-date work on the description of ex-libris, which contributes to the disclosure of the Department’s collections. The main goal of this research is to identify, record, study, publish, and thereby show the variety and richness of the ownership marks found on books. This article is devoted to the book marks of the German bibliophile Prince George III of Anhalt (1507—1553) from the collection of the Russian State Library. In the Russian-language research literature, Prince George’s book marks have not been considered before. The highly valued private library, later named after the owner — “Georgs-Bibliothek”, used to be part of the Land Library in Dessau (Germany). A small part of this famous book collection came after World War II to the V.I. Lenin State Library of the USSR and is now stored in the Book Museum. On the example of the small fragment of Prince George’s famous library, the article traces the gradual appearance and development of the unique ex-libris of this collection, reveals the literary and bibliophile interests of the owner, and establishes the circle of his communication. In the course of the study, about a hundred owner’s marks were recorded, thanks to which there were identified more than 120 publications from the personal collection of Prince George of Anhalt. The article presents the main types of its ex-libris (handwritten, gift, and super-ex-libris), which are reproduced and described in detail.

With the current development, there are many well-known brands circulating in the market all over Indonesia, especially the ones that are deliberately counterfeited by business actors violating existing regulations for profit. The circulation of a well-known brand that is widely fabricated has spread to all levels of society. With the existence of various well-known brands, there will be a negative impact, such as the emergence of brand violations which is a form of unfair business competition. This study examines the regulation towards the well-known brands in Indonesia and the legal protection for well-known brands in relation to unfair business competition in Indonesia. To achieve these goals, this study was conducted using normative legal research method. Initially, the regulation of the famous brands is regulated in the Paris Convention for the Protection of Industrial Property (Paris Convention) and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement). At this time, Indonesia has made its own regulations regarding Famous Marks and most recently the Regulations regarding famous marks are regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. Preventive legal protection aims to provide a legal umbrella for entrepreneurs who have well-known brands to anticipate violations. Repressive legal protection provides the final legal umbrella for imposing sanctions on business actors who deliberately copy the famous brands that have been registered in Indonesia. Civil and criminal remedies are given when a dispute has occurred or a violation has been committed. The government should conduct socialization regarding the forms of violations. Entrepreneurs should be more creative and advertise their own brands more so that people can get clear information about well-known brands, both genuine and the counterfeited.

People in all societies have a tendency toward magical thinking. This human inclination is extensively exploited by modern advertising, which routinely suggests that consuming goods will make us successful, happy, and fulfilled. In this article, I suggest that such advertising creates a system of beliefs resembling a totemic religion. In this religion, brands perform the role of sacred objects. Trademark law initially aims at preventing consumer confusion. Yet, today, famous trademarks are extensively protected against nonconfusing associations. I argue in this article that this broad protection is based on magical thinking. Pointing out the parallels between the laws of magic and trademark doctrines, such as the doctrine of dilution, I suggest that famous marks are legally treated as magical, sacred objects. This legal approach amounts to endorsing the commercial religion of brands.

AbstractThis is a paper about mark making and human becoming. I will be asking what do marks do? How do they signify? What role do marks play in human becoming and the evolution of human intelligence? These questions cannot be pursued effectively from the perspective of any single discipline or ontology. Nonetheless, they are questions that archaeology has a great deal to contribute. They are also important questions, if not the least because evidence of early mark making constitutes the favoured archaeological mark of the ‘cognitive’ (in the ‘modern’ representational sense of the word). In this paper I want to argue that the archaeological predilection to see mark making as a potential index of symbolic representation often blind us to other, more basic dimensions of the cognitive life and agency of those marks as material signs. Drawing on enactive cognitive science and Material Engagement Theory I will show that early markings, such as the famous engravings from Blombos cave, are above all the products of kinesthetic dynamics of a non-representational sort that allow humans to engage and discover the semiotic affordances of mark making opening up new possibilities of enactive material signification. I will also indicate some common pitfalls in the way archaeology thinks about the ‘cognitive’ that needs overcome.

AbstractThe extended protection of trade marks with a reputation is losing its “exceptional” character, making way for an almost categorical bar to the registration of any competing sign; indeed, the “unfair advantage” requirement appears to have been confounded with that of similarity. Certainly, trade marks are recognized as a legitimate restriction of the freedom of commerce and, arguably, in principle, competitors can and should invest their own efforts into conceiving and promoting an original sign under which they can market their goods and services. Nevertheless, trade mark law, insofar as it protects the investment function of a reputed mark, does not for as much shield the proprietor from all competition, even if this means that he must work harder in order to preserve this reputation. Indeed, the use of a similar sign is sometimes deemed to be ineluctable, where the applicant demonstrates that he cannot reasonably be required to abstain from using such a sign as, for example, it would be made necessary for the marketing of his products. This is especially true where the sign makes use of descriptive terms or elements in order to indicate the type of goods or services offered by the applicant under the mark applied for. This paper aims to critically discuss the most recent EU and UK jurisprudence on “unfair advantage” in the context of trade mark registration and infringement, focussing primarily on the components of this EU creation and how they are interpreted by courts on both a national and EU level.

Banksy, the world’s most famous graffi ti artist, has never revealed his identity. He communicates with the public via his website and Instagram profi le. On Instagram the artist posts the pictures of his works. That’s his way to confi rm their authenticity, and sometimes, if there is a need, to comment on phenomena related to his work. Banksy’s Instagram account is an element of his artistic auto-creation. His posts are very rare and laconic, building up the vibe of secretiveness. Nevertheless his Instagram narrative can be analyzed as a personal journal; according to Philippe Lejeune, the structure of a personal diary is based on what is hidden and not written. The article treat Banksy’s posts on Instagram as a „cycle of dated marks”.

January 4th 2009 marks the 200th anniversary of the birth of Louis Braille. Braille became blind in one eye at the age of four while working at his father’s shop. Braille was sent to the Royal Institute for the Blind in Paris for his studies.In 1821 an officer in the French Army, Charles Barbier, shared with Braille a secret “night writing” code system the army had devised for communicating in the dark at night without speaking. It was this series of raised dots that Braille at the age of fifteen in 1824, that he turned into the now famous system of writing and reading. Braille taught his system at the Institute until his death from tuberculosis at the age of forty-three in 1852.

A trademark is considered to be one of the most important elements of intellectual property for its ability to distinguish goods and services from others, it is the fruit of the effort of the merchant who did the best he could to bring the product to its fame and gained the admiration of the public worldwide. The merchant aims to attract customers, control the market, compete legitimately and takes the trademark as a way to achieve it, the greater the fame of the brand, the greater its popularity and financial value. This leads others to try to take advantage of the reputation and popularity of this brand by simulating, copying or falsifying it, which harms the owners of trademarks and consumers and negatively affects the development of the national economy. The regulation of well-known trademarks is a national necessity and an international requirement, and therefore Arab laws and international conventions "The Paris Convention for the Protection of Industrial Property and the Agreement on the Aspects of Intellectual Property Rights from International Trade" (TRIPS) all implemented special regulations of well-known trademarks. In Palestine, the Jordanian Trademark Law No (33) of 1952 is applicable in the West Bank and the Regulator of Trademarks in general; It did not establish special rules for the protection of well-known trademarks, which imposes on the Palestinian judiciary and specialists the burden of searching for ways to protect these marks in accordance with the provisions of the Trademark Law and the general rules, judicial principles and practical familiarity with reality.

Předmostí is one of the most famous Gravettian sites in Central Europe. Its fame is based on a unique human assemblage, sadly largely destroyed during the Second World War, a huge mammoth assemblage and a very rich large canid assemblage. It has been shown previously that mammoth played an important role in the subsistence practices of the Gravettian inhabitants of Předmostí. Detailed analyses of the large canid postcranial material were carried out to investigate whether these canid remains can be assigned to different size groups and whether these remains show evidence of being butchered and consumed by humans. Based on defleshing marks and impact traces on the long bones, it is proposed here that large canids were consumed by the Gravettian inhabitants of Předmostí, thus further elucidating the specific human-large canid relationships that existed during the Upper Palaeolithic.

Brentano's originality does not lie in pointing out the existence of intentionality, or in inventing the terminology, which derives from scholastic discussions of concepts orintentiones. Rather, his originality consists in his claim that the concept of intentionality marks out the subject matter of psychology: the mental. His view was that intentionality ‘is characteristic exclusively of mental phenomena. <p><strong>Abstract.</strong> 2019 marks the 350th anniversary of the death of the famous seventeenth-century painter Rembrandt van Rijn. Rembrandt was born in 1606 in the city of Leiden, located in the Netherlands. Here he grew up, was educated and set up his early practice before moving to Amsterdam at age 31. He is the son of a miller's family, which lived and worked in the city at the dawn of the Dutch Golden Age – a period in which Leiden transformed from a medieval city to an early modern metropolis. Although the historical city fabric of Leiden is well preserved, the birthplace of the famous painter, unfortunately, has been demolished. Also, the surroundings are unrecognizable today. For this reason, the tourism and marketing department of the city asked Erfgoed Leiden, the regional heritage department, to make a 3D virtual reconstruction of Rembrandt's birthplace and its surrounding. It resulted in a multi-disciplinary collaboration between archivists, building archaeologist, and a 3D artist. This paper reflects this cooperation from historical research over aspects of the 3D modeling pipeline to the final products of the reconstruction. Following a <q>reliability</q> matrix, the data were categorized for their reliability after careful evaluation of their accuracy depending on the source.</p>

Coca Cola is frequently used to signal the large-scale transformation from socialism to capitalism in eastern and middle Europe, which began in East Germany in the autumn of 1989. In the famous German Wende-movie Goodbye Lenin, the caffeinated drink figures prominently. The main character in this movie is a middle-aged woman who has fallen into coma during one of the mass demonstrations in Berlin, in November 1989. When she finally wakes up, about one year later, her country no longer exists. Her children successfully hide this fact from her, surrounding her with the material remnants of the past. One day, when she gets out of bed, she sees people attaching a huge banner of Coca Cola to the large flat in front of her apartment bloc. The scene marks the beginning of her awareness that the world in which she used to live is definitively gone.

The keeping of pet birds in Japan is reviewed with emphasis on Cyanistes varius (varied tit). Traditionally, bird-keeping in Japan was mainly for the enjoyment of their songs. Songbird competitions were popular and training of birds to sing was common, especially in the Edo Era from the seventeenth to the nineteenth centuries, which meant that it was known that birds learn to sing and have dialects in their songs. There were districts famous for producing birds with beautiful voices. Within the bird-keeping culture of Japan, the varied tit had a specific image, which was different from other birds. They were trained to perform tricks and were used in street performances from the Edo Era until the middle of the twentieth century, when the tradition disappeared. The decline of the bird-keeping culture and the training of tricks may benefit the conservation of wild birds, but it also marks the loss of an ancient cultural tradition in Japan.

AbstractThis article focuses on a scandal surrounding the airing of an episode of Germany's most famous TV crime series, in which there occurred a murder in an Alevi immigrant family originally attributed to a Sunni Muslim who had just arrived from Turkey. The Alevi father and head of the family was then found out to have murdered his own daughter after she had threatened to reveal that he was sexually abusing her sister. The episode was met with an enormous outcry from Alevis based in Germany as well as in Turkey. This essay analyzes the protests for what they reveal about the trans-nationalization of stereotypes and immigrant demands for fair media representation in Germany. It is argued that it marks a new stage in the development of border-crossing public spheres in which the politics of cultural struggle in relation to ethnic and religious hierarchies lose some of their national moorings.

In his famous essay from 1784, Kant denied that we "live in an enlightened age"; yet he claimed that we "live in an age of enlightenment". If we should answer the question if we live in an enlightened age now, we could basically give the same answer. The enlightenment as an ongoing process can be found throughout Kant's whole work. This article focuses on how the concept of enlightenment can be applied to the Kantian psychology, which marks an important change of theory of the soul within modern western metaphysics. Kant's idea of enlightenment and 'critique' will be illustrated with reference to the "Paralogisms" of the Critique of Pure Reason. Finally, an analysis of some passages of the "Paralogisms" shall demonstrate that Kant's critique of the previous metaphysical doctrine of the human soul should not be understood as a complete rejection of this doctrine; rather, Kant's critique of what is called rational psychology should be understood as a critical transformation.

Abstract The staging of the Calderonian auto sacramental The Great Theatre of the World during the Salzburg Festival of 1922 marks the beginning of the discovery of this form of religious drama for the dramatic practice and theatre writing in the 20th century. The present paper aims to deal with the recuperation of this genre by well known Spanish, French and Mexican authors (Federico García Lorca and Rafael Alberti; Albert Camus and Emilio Carballido). They use this obsolescent genre, paradoxically, to renovate contemporary theatre. It is the allegorical structure of these plays that provides them with a pattern for the construction of an intentionally antinaturalistic theatre. The post-Tridentine obsession with the free will dogma is substituted by a more philosophical, non religious and, sometimes even irreverent, debate of human liberty. In the modern Mexican autos sacramentales the tendency to a syncretistic mixture of Christian and indigenous ideas and forms, inaugurated by Sor Juana Inés de la Cruz, the famous nun from New Spain, finds an ironic continuation.

Katharine Mansfield is a successful female writer in the literary history of the 20th century, who marks a new period of English short stories. She uses tremendous modernistic techniques and digs deep beneath the surface of life to show the causes of human happiness and despair in her works. “The Garden Party” is one of her most famous and representative short stories. Previous studies have mostly focused on its artistic methods, themes and characters, as well as the combination of all, but there are only few studies choosing its narrative perspectives as their study topic. This paper analyzed the narrative perspective in this story, focusing on the use of nonfocalization, internal focalization and covert progression and the effects they have. It is found that the change of ways of focalization combining with covert progression in this story forms a parallel of objective description and ironic description with the plot development, adds a new group to the relationship between the former implied author and target readers, and reveals two different ways (idealistic and realistic) of understanding this story, letting readers reflect on the behaviors of the upper-middle-class people and ironically pointing out their selfish nature.

Again and again he urged that the duet and sleepwalking scene be sung ‘sotto voce’, ‘with mutes’, that the singers should speak more than sing, that their voices should sound ‘harsh’, ‘stifled’, ‘hollow’, ‘veiled’. Verdi's wilful insistence that his singers not sing has been understood as part of the composer's struggle to curb the excesses of primo ottocento opera and invest it with a new psychological depth. Gilles de Van, for example, argues that the suppression of the voice in Macbeth creates a shadowy subjective interiority, and claims further that the decision represents a shift in Verdi's aesthetic orientation from ‘melodrama to music drama’. De Van understands Verdi's inward turn as a renunciation of the kind of extroverted display upon which melodrama relies, as a ‘turning point, the beginnings of a dramaturgy of interiority that does away with the superb transparency of traditional melodrama and marks Verdi’s new awareness of the aura of confusion and ambiguity that can inhabit the human soul'.

Abstract Act 2, scene 1 of Beethoven's 1814 version of Fidelio and the recitative and aria for Amenaïïde from Rossini's Tancredi are the only prison scenes from the period 1790–1815 that are still a part of the performing repertory, but prison scenes were a common feature in operas from these decades. The revolutionary and post-revolutionary period was also a time in which ideas about incarceration were undergoing profound changes—changes that are reflected on the operatic stage. This essay examines the political and aesthetic meanings of the operatic prison scene, providing a broader context for the revisions that Beethoven made to Florestan's recitative and aria. The famous oboe melody that introduces the final section of this scene marks both a turning point in the drama and a self-reflexive moment in the history of opera, in which the dramaturgy of the prison intersects with the philosophy of musical idealism. In this sense, the passage from terror to transcendence is not merely a common topos of prison scene plots; it is also a paradigm for composition, reception, and musico-dramatic meaning in early nineteenth-century opera.

AbstractThis contribution deals with the thinking of the Buddhist philosopher and Christian theologian Katsumi Takizawa (1909-1984) on incarnation. Firstly, it gives a short biographical and theological introduction to Takizawa, who was influenced not only by the "father" of the so-called dialectical theology, Karl Barth, but also by one of the famous figures of the Kyoto-school, the philosopher Kitaro Nishida.This contribution concentrates, secondly, on Takizawa's the-anthropological re-interpretation of the incarnation. It is argued that for Takizawa incarnation has to be seen as an awakening of the historical Jesus (or other historical phenomena) to what he calls the original fact: the eternal relationship between God and man.Thirdly, this contribution discusses the the-anthropological thinking of Takizawa about incarnation in five short points. Apart from the positive challenges of Takizawa's thinking especially for the theology of Karl Barth, it marks clearly the most thrilling point between Takizawa's thinking on the one side and that of scholars in Barthian theology on the other side. The open question that comes up is if incarnation really can be thought without a historical mediation or mediator, as Takizawa seems to claim.

The Aesthetic or “Patience” teapotis renowned as the ultimate parody of Aesthetic sensibilities. Composed of the head and torso of a male and female back-to-back dressed in the “greenery-yallery of the Grosvenor Gallery,” with puce hats and fashionable Pre-Raphaelite red hair, the teapot was designed by James Hadley (1838–1903) for the Royal Worcester manufactory following the success of W. S. Gilbert and Arthur Sullivan's operettaPatiencein 1881. Bearing on its base the inscription, “Fearful consequences through the laws of Natural Selection and Evolution of living up to one's teapot,” the vessel took a swipe at Darwin's theories of evolution, as well as Oscar Wilde's famous aphorism. This teapot is certainly not “fit for its purpose,” defying “form must follow function”; rather it is a whim of fashion, novel but transitory. Recognized as a “limited edition” and expensive, its function being primarily for show rather than use, it marks the appearance of the modern “collectable,” in effect a souvenir of Aestheticism and now seen to commemorate its apogee. Yet although loaded with aesthetic signifiers – sunflowers, lilies and gender-bending – no scholar has attempted to unwrap the teapot's meaning, in terms of the identification of china and tea with “life-style aestheticism” (Figure 15).

In the course of a field-survey of Paramāra sites in 2008–09, I was exploring locations with historic inscriptions, temples, memorial stones and medieval water systems. Of particular interest were places with antique statuary of Hanumān because he was a protector of the fields and thus played a role in agricultural production. Udaypur, a key Paramāra site with the well-known Śiva temple built by Udayāditya, naturally formed part of the study. When enquiries about Hanumān were made at Udaypur, local residents urged us to visit Muratpur, a village about 5 kilometres directly south. We set out in that direction, making a series of discoveries along the way. The various memorial pillars, ruins and other remains cannot be recorded here in detail. Perhaps the most startling discovery (more correctly a re-discovery) was a colossal figure of dancing Śiva, more that 2 metres high. The figure lies on its back and, to judge from the chisel marks on it, was never finished (Fig. 1). This joins the catalogue of monumental but unfinished work by the Paramāras. The temple of Bhojpur is the most famous example, but in this special issue attention has been drawn by O. P. Mishra to the fact that the Bijamaṇḍal at Vidiśā was also left unfinished by Naravarman.

Instead, if his reading of Van Gogh’s painting is “derisory and symptomatic,” it is nonetheless “significant,” if only insofar as it provides an indication of Heidegger’s underestimation of the plastic arts in favor of the elevation of poetry—an underestimation that may be corrected in light of what we might regard as his true philosophy of art. Our aim, then, is to see (with some help from Derrida) what Heidegger could have seen in looking at Van Gogh’s Old Shoes were the work not reduced to an illustration in a presentation whose destination is poetry, not painting. What, in other words, would Van Gogh’s painting look like were we to view it in light of “The Origin of the Work of Art,” assuming that the latter does not require insistence on the priority of linguistic work but on the creation of a truth that belongs to the Earth, in the case in point, as the ground of painting?
