Abstract:
Even when it comes to investment, despite appearances to the contrary, it does not seem to me that there is a shift to the non-discrimination principle. First, there is no doubt that absolute standards such as fair and equitable treatment or the provision on expropriation have by far overshadowed the relative standards, in particular national treatment. Second, while the MFN standard has, on the other hand, been a key provision in investment treaty arbitration, particularly as an instrument to expand the scope of the ISDS system (based on more favorable provisions found in third-party treaties), there are clear signs in recent investment treaties of the willingness to curtail the use of the MFN provision as a way to extend the procedural and substantive protections of investors. This seems to be the current position, for example, of both the United States and the European Union (EU). Third, when it comes to the apparent disappearance of the absolute standards of treatment in some of the treaties being negotiated by the European Union (such as with Japan), this is more simply due to a question of the nature of the EU external competence in commercial matters. In its recent opinion on the EU-Singapore FTA, the Court of Justice of the EU has determined that the EU does not have exclusive competence to conclude agreements covering non-FDI and ISDS. The EU has thus responded to such opinion by splitting investment protection (with ISDS) from the rest of the trade agreement, thus keeping investment liberalization (including market access and national treatment) in the latter. In this way, while the trade agreement will fall under the exclusive competence of the EU, the former will still require ratification by each member state. While it is not clear whether the backlash vis-à-vis investment protection and ISDS in some quarters within some of the member states will eventually lead to the end of EU investment treaties, a decision in this sense has not yet been taken by EU institutions.

When it comes to trade law, it is true that there appear to be certain signs that we are moving back to non-discrimination and away from deeper forms of integration. However, this is possibly (and hopefully) only a limited and temporary shift. The strongest evidence of such a shift regards the apparent interpretation by the WTO Appellate Body (AB) of the key provisions in the TBT Agreement in such a way as to give prevalence to the national treatment standard in Article 2.1 over the necessity requirements in Article 2.2. For example, in US – Tuna II (Mexico) the AB found the U.S. dolphin-safe regulations under review inconsistent with Article 2.1, while also reversing the panel finding that the U.S. dolphin-safe regulations were inconsistent with Article 2.2. Such a result is surprising if one considers the general agreement among commentators that the disciplines embodied in the TBT Agreement (as well as in the SPS Agreement) went beyond the non-discrimination obligation of the GATT.

Riassunto Il contributo esamina la tesi di Olaf Rader, secondo cui l’imperatore Federico II, nato in Italia e cresciuto in Sicilia, sarebbe stato „durch und durch Sizilianer“ (del tutto siciliano), come aveva sostenuto nella seconda meta del sec. XIX Leopold von Ranke e di conseguenza „il primo straniero sul trono tedesco“, come scrisse poi Johannes Haller nella prima meta del Novecento. Secondo tale interpretazione, egli avrebbe dato priorita al regno di Sicilia, ereditato dalla madre Costanza d’Altavilla, e trascurato invece l’impero romano-tedesco, diversamente da suo nonno Federico I Barbarossa. Questa tesi risulta poco convincente perche attribuendo a Federico II una chiara identita siciliana si trascura il fatto che egli, trasferitosi in Germania all’eta di 17 anni e rimanendovi per otto, si immerse in un contesto del tutto tedesco, riappropriandosi delle sue radici sveve. Inoltre Federico II difese accanitamente gli interessi dell’impero romano-tedesco contro il papato e i comuni settentrionali, mettendo le ingenti risorse economiche del regno di Sicilia al servizio delle sue azioni militari. Essendo a quell’epoca particolarmente importante la presenza fisica del sovrano per l’azione di governo, Federico ovvio alla sua assenza nelle zone d’oltralpe, prive di strutture amministrative paragonabili a quelle italiane, delegando i suoi figli - Enrico (VII) prima e Corrado IV poi - a rappresentarlo in Germania. La obra dramática de Federico García Lorca logra capturar el conflicto moral y las implicaciones sexuales del baile con personajes femeninos que luchan entre el deseo y sus instintos. En el presente trabajo, analizo algunos de los valores sociales y morales del baile en el teatro de Lorca. Palabras clave: Federico García Lorca, Danza, trangresión, cuerpo, estigma social. Abstract: Dance over time has been perceived as an activity threatening certain moral and religious values. The female body is the expressive instrument in dancing, as a mean to incite sinful behavior. The dramatic work of Federico García Lorca capture the moral conflict and the sexual implications of the dance with female characters who struggle between desire and their instincts. Abstract:
El 4 de febrero de 2021 falleció en Zaragoza, Federico Rafael Aznar Gil, a la edad de 67 años, siendo enterrado al día siguiente en su localidad natal de La Almunia de Doña Godina (Zaragoza). Desde hacía algo más de tres años su salud se había resentido y, ya jubilado a finales de 2018 como catedrático en la Facultad de Derecho canónico de la Universidad Pontificia de Salamanca, se encontraba residiendo en la casa sacerdotal de su diócesis, Zaragoza, donde seguía colaborando pastoralmente en la parroquia de Nuestra Señora del Portillo y manteniendo los cargos de Promotor de justicia y Defensor del vínculo del Tribunal Interdiocesano de Segunda Instancia de Zaragoza, a la vez que preparando algún trabajo histórico, pues su intención era la de seguir siendo útil a la Iglesia. Culminaba así una vida plena de actividad en el ámbito del Derecho canónico que desarrolló durante cuatro décadas de un modo muy intenso.
