O fenómeno da criminalidade feminina, tanto em Portugal como um pouco por todo o mundo, tem sido esquecido, nomeadamente no que diz respeito á ciência social e humana que deverá ter o maior interesse em estudá-lo – a Criminologia. São várias as temáticas que deverão ser abordadas, não só pela Criminologia mas também pelas demais ciências sociais e humanas, numa tentativa de troca de perspetivas e experiências para que a criminalidade e a reclusão feminina não seja de todo esquecida. Dentro destas temáticas, as questões de género são muito importantes, pois, ao longo dos séculos, a mulher tem vindo a ser considerada inferior em relação ao homem, e por tal, merecedora de um tratamento diferenciado. Desta forma, as perspeticas feministas têm contribuído imenso para a desmistificação de algumas crenças sobre a mulher, querendo por isso mudar atitudes e, neste caso em concreto, sobre a mulher que comete crimes. Posto isto, este projeto destina-se à melhor compreensão destas perspetivas, de forma a serem melhor estudadas e aplicadas no contexto Português, através de estudos/investigações, artigos, congressos, e outras formas de transmissão de conhecimento sobre este fenómeno que é o da criminalidade no feminino. Não obstante, sendo este projeto de graduação uma proposta de realização de uma investigação, de cariz qualitativa, a mesma terá como instrumento a realização de entrevistas a serem realizadas a uma amostra de vinte indivíduos/as, em que dez serão mulheres e outos dez serão homens, metade em prisão privativa da liberdade, e a outra metade em liberdade e sem envolvimento com o sistema de justiça.
The phenomenon of female crime, both in Portugal and throughout the world, has been forgotten, especially with regard to social and human science that should have the greatest interest in studying it - Criminology. There are several themes that should be addressed, not only by Criminology but also by the other social and human sciences, in an attempt to exchange perspectives and experiences so that female crime and incarceration are not forgotten at all. Within these themes, gender issues are very important because, over the centuries, women have been considered inferior to men, and for that, deserve a differential treatment. In this way, feminist perspectives have contributed immensely to the demystification of some beliefs, thereby wanting to change attitudes and, in this case, about the women who commits crimes. Therefore, this project aims to understand better these perspectives, so that they can be better studied and applied in the Portuguese context, through studies / investigations, articles, congresses, and other ways of transmitting knowledge about this phenomenon, which is the women’s crime. Nevertheless, being this graduate project a proposal for a conducting research, with qualitative nature, will have as instrument the conducting of interviews to be carried out on a sample of twenty individuals, in which ten will be women and some ten will be men, half in prison, and the other half in freedom and without involvement with the justice system.

Women in rural and severely underprivileged areas remain one of the most vulnerable groups in South Africa to violence in their communities and in their homes. To date, information on rural women, their experiences with domestic violence and social development is both fragmented and inconsistent. The issue of access to justice for rural women presented in this thesis is based on the premise that violence against women keeps women in conditions of poverty, and fear of poverty keeps women trapped in violent situations. It is also based on feminist theory that argues that historical, legal, cultural and political factors contribute to domestic violence and even with emerging policy and legislation promoting wo1nen's safety and freedom from violence, the criminal justice system has not shed it's predilection of institutionalised sexism. It will be argued that systemic discrimination against rural women has lead to the inadequate implementation of legislation and policy relating to women's fundamental rights to safety and freedom from violence. This research, therefore, takes the challenge of constructing an appropriate framework for an integrated analysis of law, gender, and social development. It does so through a feminist jurisprudence framework. The central aims of the research are to: (i) examine the nature or profile of domestic violence in rural areas; (ii) identify the obstacles which prevent women from accessing justice in the face of domestic violence; (iii) identify support mechanisms within rural communities for victims of domestic violence; (iv) explore current policing, justice and health care responses to rural women who experience domestic violence; (v) examine the nature of secondary victimisation of these women by their communities and the relevant criminal justice departments; (vi) examine the nature of current policy and legislation in relation to violence against women and establish the extent to which they have impact on rural women; (vii) to identify gaps in service delivery in rural areas and (viii) to highlight the unique barriers to justice that rural women face. The issues of access to justice for rural women is introduced in this thesis through a study undertaken in rural areas in the Southern Cape. Access was facilitated to 15 different communities in the Southern Cape and 168 women in total were interviewed on issues of violence against women and access to justice. Another 28 women were interviewed on issues relating to maintenance. The primary data collection technique of this research in the Southern Cape took the form of 19 focus-group interviews through a cross section of community structures. These interviews took the form of 'workshops', in which an active exchange of information between the researcher and the researched took place. The focus-group interviews were held in communities in Knysna, Rheenandal, Kurland Dorp, Plettenberg Bay, Sedgefield, Mossel Bay and George. The results indicate that access to justice for rural women is limited for the following reasons: (i) women in rural areas lack nearby services and the cost of transportation decreases a won1an's ability to leave violent situations or even seek information or assistance to deal with the problem; (ii) Women in small rural communities articulate fears of community gossip or alienation from their communities if they seek assistance; (iii) women in rural areas have little option but to remain in the home with the offender because there are no accessible safe houses or shelters; (iv) women remain powerless over alcoholism within their communities; (v) rural women remain in abusive relationships because they have little access to economic resources; (vi) limited access to state and private health, welfare and justice services results in systemic discrimination by the state in almost every area of rural w0men's lives; (vii) distances to basic public services are great and child care is a problem if travel is necessary; (viii) very few development services exist in rural communities; (ix) there are no or limited taxi and bus services and if they do exist they are expensive; and (x) the combined effects of poverty and violence for rural women in the Southern Cape creates formidable barriers to women's equality, mental and physical health, and their full participation in civil society. In light of these results current South African policy and legislation relating to domestic violence and crime prevention are discussed. The thesis concludes that current law contains systemic inequalities, that state legal structures are inherently discriminatory against women and, more specifically, do not meet the needs of rural women.

As part of an overall move towards protecting the public (especially those felt to be most vulnerable, e.g. women and children), legislation has recently been tabled which would forbid the use of a defence based on self-induced extreme intoxication producing a state akin to automatism (the drunkenness defence) in trials of general intent offences. This legislation (Bill C-72, s. 33.1), is in direct conflict with the 1994 ruling of the Supreme Court of Canada in Daviault in which the majority found that to deny such a defence in general intent cases was in violation of the principles of fundamental justice enshrined in our Charter of Rights and Freedoms. The Supreme Court of Canada decided that the common-law precedents set by cases such as Beard, Majewski, and Leary, which did not allow evidence of extreme intoxication in general intent cases, had the effect of convicting individuals for crimes in which they were lacking the necessary mens rea or voluntariness. It is proposed that Bill C-72 was tabled in response to feminist claims-making, in addition to the public, and media outcry raised by the Daviault case. (Abstract shortened by UMI.)

Abstract:
Runaway youth often face a multitude of negative experiences during their childhood, which often leads to trajectories of psychological disorder/distress, victimization, and offending. This propensity for negative life trajectories may be exacerbated by repetitive runaway behavior. Additionally, these negatives experiences may be further shaped by the gender of the youth, thus creating distinct gendered pathways to chronic runaway behavior, victimization, and offending. This study utilized a sample of youth runaways in the state of Florida (N=295) to build upon the classification/typology research on juvenile runaways by assessing the presence of latent groups of youth based on runaway frequency. In addition, this study utilized classical and modern criminology theories to influence the assessment of the relationship between known runaway risk factors and chronic runaway status. Group-based trajectory modeling was performed and two distinct groups of youth runaways were identified for both full and gender-exclusive models. Chronic runaway analyses indicated both unique and similar gender-based relationships between chronic runaway status and relevant risk factors, suggesting partial support for a gender specific theoretical perspective. Results provide additional insight into youth runaway behavior while also suggesting the need for further exploration of chronic runaway status within the youth runaway population.

Abstract:
Juvenile delinquency continues to be a major social problem in the United States. One of the more salient problems with the juvenile justice system in the United States is its staggering incarceration rate, which poses a significant problem for youth exposed to the juvenile justice system, and the community as a whole. The purpose of this qualitative case study was to understand the perspective of the program facilitators about the effectiveness of the restorative justice program in reducing recidivism for African American males aged 12 to 17 in Baltimore City's urban community. This study relied upon restorative justice theory as conceptualized by Braithwaite as the theoretical framework. Using intrinsic case study design, data were collected from 7 restorative justice facilitators, who participated in face-to-face interviews using semistructured, open-ended questions. Miles and Huberman's qualitative content analysis was used to analyze the data and to record emerging themes and patterns. The key finding of this study indicates that facilitators believe restorative justice results in a reduction of the recidivism rate specifically through the conferencing program when Braithwaite's reintegrative shaming is incorporated into the process. According to the program facilitators, the conferencing program is effective in reducing juvenile recidivism as it promotes transparency and openness to all stakeholders through being very clear and upfront on all levels with the juveniles, parents, and volunteers. As such, there are implications for positive social change by involving all the stakeholders---family, community, policy makers, and juvenile justice practitioners---that may result in reduced incidences of juvenile offending, thereby promoting safer communities.

This thesis uses approaches adapted from narrative analysis to provide a detailed examination of the two CBC Fifth Estate documentaries on the case of Ashley Smith (Behind the Wall, 2010; Out of Control, 2010). In particular, it considers how different voices and pieces of evidence are brought together to construct coherent documentary narratives and contextualizes these narratives within broader feminist criminological discourse. This project develops the concepts of ‘internal’ and ‘external’ coherence and considers how attempts to maintain coherence influence the way the Smith case is presented in the documentaries. Drawing on Foucault’s (1976) discussion of subjugated knowledge, this project explores how the process of creating a coherent narrative necessitates the subjugation of controversial knowledge. By juxtaposing the arguments in the documentaries against those of feminist criminology, the findings reveal how attempts to formulate a critique of Canadian prisons that appeals to a national audience subjugates feminist critique.

Routine Activities Theory (RAT) is one of the most widely used theories to explain victimization. It has been applied to a wide range of criminal victimizations, such as property crimes (Miethe, Stafford, & Long, 1987) and urban murder (Messner & Tardiff, 1985). While traditional RAT has been used to explain violence against women, the feminist perspective of RAT developed by Schwartz and Pitts (1995) provides a better explanation by incorporating cultural factors that shape the conditions that give rise to offending. The current study draws on feminist RAT in order to explore three different types of victimization involving women: stalking, dating violence and sexual violence. In doing so, the current study extends the RAT and feminist RAT literature by more thoroughly exploring what it means to be a capable guardian and by incorporating literature on bystander intervention. Though bystander intervention literature and feminist RAT literature are similar in that they view people as having the ability to prevent violence and crime, the two areas have developed relatively separately and have rarely been integrated together. In addition to expanding the literature on RAT, this study also contributes to the bystander intervention literature by analyzing willingness to intervene in three types of cyber violence against women. Though bystander intervention research has greatly expanded throughout the years, research involving intervention into cyber stalking, cyber dating violence, and cyber sexual violence/harassment are greatly lacking. The current study employed a web based survey to assess bystander intervention in cyber violence and expand feminist and cyber RAT by analyzing victimization. College students were asked to judge their likelihood of intervention in situations involving potential dating violence, sexual harassment, and stalking. In addition, they were asked about their routine activities and components related to the theory, as well as dating violence, sexual violence and stalking victimization. Unsurprisingly, students preferred to intervene in a direct manner. In addition, there were inconsistent findings regarding victimization and routine activities theory. The results of the study are discussed in terms of implications for the development of bystander intervention programs and will expand the feminist RAT literature.

Diante da intensificação do processo de encarceramento feminino verificada na última década e das nefastas consequências que decorrem da prisionalização, a presente pesquisa voltar-se-á para a análise da criminalidade feminina a partir de uma perspectiva de gênero, a fim de identificar as especificidades do comportamento feminino e revelar como o gênero e as relações de poder dele decorrentes estão essencialmente entrelaçados na construção da realidade criminal. Para tanto, será adotada uma abordagem histórica sobre o conceito de gênero e da sua introdução analítica nas ciências jurídicas, a fim de compreender de que forma o paradigma de gênero colabora para a transformação do discurso jurídico. Em seguida, será exposta a trajetória das teorias criminológicas, passando pelos caminhos das teorias demonológicas até as feministas, com a finalidade de investigar as diversas abordagens da criminalidade feminina. Por fim, a partir da análise de processos criminais que tramitaram perante o Superior Tribunal de Justiça e abordaram o crime de tráfico de drogas para dentro dos presídios, serão investigados concretamente os diferentes aspectos que as questões de gênero podem relacionar-se com o fenômeno criminal.
In view of the intensification of female incarceration verified on the past decade and the nefarious consequences that follows the imprisonment, the following research will focus on the analysis of the female criminality from a gender perspective, willing to identify the female behavior specificities and reveal how the gender and the following power relations are essentially associated in the framing of the criminal reality. For this purpose, will be taken a historical approach about the concept of gender and its analytical introduction on the legal sciences, in order to understand how the gender paradigm collaborates for the legal discourse transformation. Afterwards, it will be established the criminological theories path, through the demonological theories up to the feminist theories, to investigate the various approaches about feminine criminality. Finally, from the analysis of processes that were processed before the Superior Tribunal de Justiça and addressed drug dealing into prisons, will be investigated truly the different aspects in with gender issues can relate with the criminal phenomenon.

Abstract:
This research examines the effect of gender on perpetration characteristics and empathy in a sample of juvenile sex offenders in Massachusetts using feminist criminological and gendered theory perspectives. Through the use of ordered logistic regression, I evaluate whether or not a perpetrator’s gender has an impact on the characteristics of the offense (such as the use of penetration, fellatio, genital touching, or masturbation) or the levels of empathy and remorse experienced by the offender. The results show that gender only has a significant effect on penetrative acts and remains non-significant for the remaining variables. I have concluded that the non-significance of gender lessens the dissimilarities between juvenile male and female offenders, suggesting that the female offenders are less influenced by gendered socialization. Future research should focus less on the differences between boys and girls and more on those variables that are significant: prior victimization, behavior problems, and problems in school.

The United States has the largest population of imprisoned persons in the world. The vast majority of these individuals eventually leave prison and re-enter society, facing a number of challenges in the process. Those who are unable to successfully re-enter society run the risk of recidivating back into the prison system. Mentoring has the potential to promote successful re-entry and help offenders to get their lives back on track. Pathfinders of Tarrant County is a unique organization. Its historical position as one of the foremost "welfare to work" programs gives it unique insight into the economic struggles of at-risk individuals and families, and its existing relationships with mentors and other community organizations gives it a rich pool of resources to draw from. By helping to connect participants with community resources, Pathfinders removes quite a bit of the complexity from seeking help at a time when vulnerable people need it most. This thesis presents an overview of how Pathfinders conducts mentoring and its unique brand of social service advocacy, including the unique and not-so unique challenges that a re-entry population may have to offer.

Abstract:
The present study proposes to analyze a conception of gender justice in Brazil, that is, the introduction of a gender perspective at the center of the criminal normative system and in the structures resulting from criminal policy, both preventive and repressive spheres, especially based on the Maria da Penha Law (2006) and the Law on Feminicide (2015). Therefore, the contextualization of the theme initially took place within the discussions brought by feminist criminology, that is, a criminology that encompasses the gender element in its studies, prioritizing the experiences of women in the face of crime, in their various intersectionalities, and uses epistemologies and feminist methods to formulate a critique of the sciences and criminal law, proposing substantial reforms in the legal treatment of women in situations of gender-based violence in the case of victimization. The research works with a theoretical, philosophical and political model, capable of sustaining the feasibility of a gender justice, especially in the scope of the theory of recognition, theoretical framework used as starting point for the understanding of law and public policies as instruments of recognition of the specificities and differences of women, a substantial part of society, systematically subjugated in the sociocultural context of patriarchy, thereby seeking to prevent oppression, injustice and social inequalities continuity.The research uses the theoretical and critical perspectives of feminist criminology on two important aspects: the first refers to the femicide indices in Brazil and the state of Alagoas, including variables on the sociocultural characterization of the victims and the circumstancs of the crimes, beyond the intersectionalities inherent in lethal violence against women, such as vulnerabilities of gender, race, class and sexuality; and the second regarding the historical relationship between Brazilian criminal law and the legal protection of women in situations of violence, demonstrating the predominantly androcentric character of the law and the gradual reformulations of the penal code in recent decades. Finally, we sought to carry out a dogmatic and criminological analysis of the Maria da Penha Law and the Feminicide Law as normative frameworks for thinking about gender justice in the terms initially proposed, that is, legislation whose main purpose is the recognition and guarantee of the fundamental right of women to live a life without violence.
O presente estudo tem como objetivo analisar uma concepção de justiça de gênero no Brasil, isto é, a introdução de uma perspectiva de gênero no centro do sistema normativo penal e nas estruturas resultantes da política criminal, tanto na esfera preventiva, como na repressiva, sobretudo a partir da Lei Maria da Penha (2006) e da Lei do Feminicídio (2015). Para tanto, a contextualização do tema se deu, inicialmente, sob o espeque das discussões trazidas pela criminologia feminista, isto é, uma criminologia que abarca o elemento gênero em seus estudos, priorizando as experiências das mulheres diante da criminalidade, em suas diversas interseccionalidades, e se utiliza das epistemologias e dos métodos feministas para formular sua crítica às ciências e ao direito penal, propondo, no caso da vitimização, reformas substanciais no tratamento jurídico-legal dispensado às mulheres em situação de violência de gênero. A pesquisa trabalha com um modelo teórico, filosófico e político, capaz de sustentar a viabilidade de uma justiça de gênero, sobretudo no âmbito da teoria do reconhecimento, marco teórico utilizado como ponto de partida para a compreensão do direito e das políticas públicas como instrumentos de reconhecimento das especificidades e das diferenças das mulheres, parte substancial da sociedade, sistematicamente subjugadas no contexto sociocultural do patriarcado, buscando, com isso, impedir que opressões, injustiças e desigualdades sociais continuem acontecendo. A pesquisa se utiliza das perspectivas teóricas e críticas da criminologia feminista sobre dois importantes aspectos: o primeiro refere-se aos índices de feminicídios no Brasil e no estado de Alagoas, incluindo variáveis sobre a caracterização sociocultural das vítimas e as circunstâncias dos crimes, além das interseccionalidades inerentes à violência letal contra as mulheres, como as vulnerabilidades de gênero, raça, classe e sexualidade; e o segundo, quanto à relação histórica entre o direito penal brasileiro e à proteção legal às mulheres em situação de violência, demonstrando o caráter predominantemente androcêntrico do direito e as paulatinas reformulações do código penal nas últimas décadas. O estudo apresenta uma análise dogmática e criminológica da Lei Maria da Penha e da Lei do feminicídio como marcos normativos para pensar uma justiça de gênero nos termos inicialmente propostos, isto é, uma legislação que tem como principal escopo o reconhecimento e a garantia do direito fundamental das mulheres a viver uma vida sem violência.

Scholars have studied incarceration among women in the United States of America for more than a decade, but few studies have explored the influence of repeated incarcerations among African American women and their family relationships. The research question for this study examined how African American women describe the effects of multiple incarcerations on family trust relationships and their ability to reintegrate into the family system and society. This multiple case study was conducted in Chicago, Illinois, and drew a sample of 4 African American women released from prison with histories of multiple incarcerations. The study explored their perspectives through a series of semistructured, in-depth interviews. Data consisted of narrative interview transcripts and artifacts collected and analyzed using a framework of feminist theory and critical criminology. Findings from the analysis indicated these African American women experienced profound and long-term devastation to relationships with family and friends following periods of multiple incarcerations. Repeated periods of imprisonment negatively altered their perceptions of themselves and reduced their social engagement with others. Results of repeated incarcerations included (a) broken trust with loved ones; (b) resentment, anger, and blame; and (c) permanent damage to social and family networks. This study contributes to social change by increasing understanding of the repercussions and effects of multiple incarcerations on African American women and family continuity, and the study offers insight into guiding program development to help families rebuild and stabilize.

Critical criminology and feminism in Brazil have, in the struggle for human rights and democratization of the country, from the sixties, their common root. Paradoxically, this political proximity has not resulted into an academic approach, despite the fruitful scientific developement made by both critical criminology and feminist theory. The resistance of criminology to include gender as a new theoretical paradigm, which would allow the second criminological turn – gender turn – (beside to the labeling approach), makes critical criminology antifeminist. This finding in Brazil raises questions about possibility of a feminist criminology. In turn, the new subjects of feminism – women slum, black, lesbians – whose specific vulnerabilities also determine specific violence – require inclusion and recognition. Development of a feminist criminology claims to incorporate gender to the malestream, and the inclusion of new subjects of feminism, ie, populations historically erased from the view of both feminism and criminology, providing a multi-dimensional perspective and a new aesthetic for a feminist perspective in criminology in Brazil.
A criminologia crítica e o feminismo no Brasil têm na luta pelos direitos humanos e redemocratização do país, a partir dos anos sessenta, sua raiz comum. Paradoxalmente, essa proximidade política não se traduziu inicialmente em uma aproximação acadêmica ou teórica, apesar da profícua produção científica desenvolvida tanto pela criminologia quanto pela teoria feminista. A resistência da criminologia de incluir o gênero como um novo paradigma teórico, permitindo a segunda virada criminológica – virada de gênero (ao lado do labelling approach), torna a criminologia quase antifeminista. Essa constatação no Brasil levanta questionamentos sobre a possibilidade de uma criminologia feminista. Por sua vez, os novos sujeitos do feminismo – mulheres faveladas negras, lésbicas – cujas vulnerabilidades específicas determinam violências também especificas – requerem inclusão e reconhecimento. O desenvolvimento de uma criminologia feminista requer a incorporação do gênero no malestream criminológico, e a inclusão dos novos sujeitos do feminismo, isto é, das populações historicamente ‘apagadas da vista’ tanto da criminologia quanto do feminismo, constituindo uma perspectiva de múltiplas dimensões e uma nova estética para uma criminologia feminista no Brasil.

This three-paper dissertation quantitatively identifies and examines three different substantive areas using data from the American College Health Association’s Fall of 2016 National College Health Assessment (ACHA-NCHA). Specific areas of inquiry include, marginalized populations and college campus sexual assault, intersectional analyses of risk factors for college campus sexual assault, and drinking protective behavioral strategies as prevention tools for college campus sexual assault. Paper one, titled, “College Campus Sexual Assault and Students with Disabilities,” explores a particular marginalized group of students that have been largely left out of college campus sexual assault studies: female college students with disabilities. The logistic regression analyses find that having any disability increases risk for any type of college campus sexual assault more than other commonly cited risk factors such as binge drinking, or Greek affiliation. Moreover, the study indicates that odds for female students with disabilities are varied depending on the type of assault, completed, attempted, or relationship, as well as the specific type of disability. Results are discussed, and policy implications, limitations, and opportunities for future research are delineated. Paper two, titled, “College Campus Sexual Assault: Moving Toward a More Intersectional Quantitative Analysis,” is guided by an intersectional theoretical framework. The study employs classification and regression tree analyses (CART) to identify more specific groups of students that are at disproportionate risk for sexual assault beyond singular variables or even interaction effects. Unlike traditional regression techniques, CART does not assume a linear relationship, and can simultaneously account for independent variables relationship to one another while determining which variables have the most explanatory power for the dependent variable and for which unique groups of students. The study discusses results of analyses in relationship to intersectional research both theoretically and methodologically, as well as future research, and policy implications. Alcohol consumption, particularly binge drinking, has been consistently linked to greater risk for college campus sexual assault victimization. However, there is a lack of college campus violence prevention and intervention programming that addresses alcohol consumption in relation to campus sexual assault. As such, paper three, titled, “Drinking Protective Behavioral Strategies and College Campus Sexual Assault,” uses logistic regression to explore whether or not the use of drinking protective behavioral strategies (PBS) lowers risk for sexual assault in female college students that drink alcohol. The study examines both the main effects of drinking PBS on sexual assault risk, as well as whether or not the use of drinking PBS moderates the risk of frequent alcohol consumption, and binge drinking on college campus sexual assault. The paper discusses findings, limitations, policy implications, and avenues for future research.

Seventy-five percent of women offenders confined to prison, jails, or residential treatment programs are custodial parents of minor children at the time of their separation. Little is known, though, about how prosocial networks are used to address the effects of separation from children. Using Bui and Morash's conceptualization of the theory of gendered pathways, the purpose of this phenomenological study was to better understand, from the perspective of incarcerated women, the experience of using prosocial networks to cope with the effects of separation. Data were collected through interviews with 10 mothers from 2 residential treatment programs in Michigan. Interview data were inductively coded, then subjected to a thematic analysis procedure. A key finding of this study was that women experience remorse, embarrassment, helplessness, and a sense of failure with respect to providing adequate care for their children and rely on their mothers or other female family members as the primary prosocial influence. Findings also suggest that Child Protective Services (CPS) is viewed by participants as intrusive and outside the prosocial network, yet significant to family reunification and permanency planning for children. Implications for positive social change include recommendations to criminal justice policymakers and Child Protective Services to consider provisions for supportive services for gender-specific programs that build on the influence of other, prosocial, female family members and promote a clear pathway to permanency planning for families, particularly where minor children are involved.

Abstract:
The purpose of the study was to identify the risk factors most prominent in women suspected of crimes. For this, a quantitative method was used in which data obtained from personal investigations carried out by the Swedish correctional facility, Kriminalvården, were compared to public statistics of the normal population. In addition, a research overview was made on the subject, where the presence of the selected investigative variables was controlled. The study also highlights the presence of multiple risk factors within the group of women suspected of crime. Most of the risk factors investigated had pronounced stronger outcomes in the group of suspected women, which were also found as strong predictors in the comparative research. The factors mental illness and family dysfunction were the most prominent risk factors in the review of previous research. In the statistical comparison between the group of women suspected for crime and the normal population, the factors mental health, alcohol presence and drug presence were the most prominent differentiated factors. Furthermore the study indicates that the presence of multiple risk factors is common. Based on this, it is possible to discuss how girls can be protected from vulnerability in society as well as how to handle treatment care for offending women. Syftet med studien var att identifiera de riskfaktorer vilka var mest framträdande hos kvinnor som misstänks för brott. För detta användes en kvantitativ metod där data inhämtat från Kriminalvårdens personutredningar jämfördes mot offentlig statistik av normalpopulationen. I tillägg till detta gjordes en forskningsöversikt på ämnet, där de utvalda undersökande variablernas förekomst kontrollerades för. Vidare belystes även närvaron av multipla riskfaktorer inom gruppen brottsmisstänkta kvinnor. Flertalet av de undersökta riskfaktorerna gav markant starkare utslag i gruppen för brottsmisstänkta kvinnor, vilka också återfanns som starka prediktorer den jämförda forskningen. Faktorerna psykisk ohälsa samt familjär dysfunktion var de mest framträdande riskfaktorerna i genomgången av tidigare forskning, medan psykisk ohälsa, förekomst av alkohol samt förekomst av narkotika var de faktorer som gav tydligast utslag i en statistisk jämförelse mot normalpopulationen. Studiens resultat tyder även på att förekomsten av multipla riskfaktorer är vanligt. Med utgångspunkt i detta kan diskuteras hur flickor kan skyddas från utsatthet i samhället samt hur brottsbelastade kvinnors behandlingsvård ska genomföras.

Human trafficking is a criminal act that occurs globally. It affects both women and men, but most studies have focused on female victims; few have explored trafficked men or their related health issues. Though there are many forms of trafficking, it is believed that most male victims are trafficked as forced labor. Using gender schema theory as a framework, this quantitative study examined archival data to identify the types of trafficking men are subjected to, their health ailments, and how these differ from the health ailments of trafficked women. Archival data from 124 individuals subjected to human trafficking in Florida were analyzed using the Kruskal-Wallis, one-way ANOVA, Mann Whitney U, and Fisher's exact tests. Findings indicated that males were more likely to have been labor trafficked compared to other forms of trafficking, and that labor trafficked persons were not more susceptible to health ailments than were sex trafficked persons. Also, there was a significant difference in health conditions between male and female victims, with females reporting more issues such as malnourishment, skin rash, and anxiety. These findings help to alter the misperception that men are traffickers only by recognizing them to be victims as well. Implications for social change include increased awareness of male trafficking in health care policies and human trafficking prevention efforts.

En España se identifica un déficit significativo de estudios que aborden el encarcelamiento, y particularmente el encarcelamiento femenino, desde una perspectiva crítica y feminista. Esta tesis busca ofrecer evidencias empíricas y herramientas conceptuales que contribuyan a cubrir ese vacío y, asimismo, pretende alimentar los debates internacionales actuales en la materia. Con este fin, el objeto de estudio elegido es la política penitenciara dirigida a las mujeres presas en el marco de las iniciativas en materia de igualdad impulsadas en España desde finales de la primera década del siglo XXI. En particular, la tesis analiza la implementación de un nuevo programa de intervención, denominado Módulo de Respeto (en adelante, MdR), en los centros y departamentos con presencia de mujeres. Respecto al marco teórico, la investigación se enmarca, en primer lugar, en los campos de estudio de la sociología jurídica y la criminología y, específicamente, se sitúa en el ámbito de los estudios en criminología feminista, sociología jurídica, sociología del castigo o sociología de las prisiones con enfoque de género, tanto a nivel internacional como en el ámbito español. Dentro de los estudios de la criminología feminista a nivel internacional, la tesis parte del enfoque feminista en el análisis del encarcelamiento femenino que concibe el género como un principio articulador de las formas institucionales de control social y castigo. A la vez, se enmarca en la promoción de un análisis interseccional que reconozca y examine las formas que adoptan diferentes ejes de discriminación como el género, la clase, la raza, la sexualidad, la edad, la religión, la discapacidad, entre otras, cuando operan simultáneamente sobre ciertos grupos y en contextos específicos, particularmente, su concreción en el caso del encarcelamiento femenino. La metodología de investigación utilizada es el estudio de caso múltiple (Yin, 1994). En concreto, se han seleccionado tres centros penitenciarios con MdR de mujeres en los que se han realizado observación directa no participante y entrevistas en profundidad semiestructuradas con profesionales y mujeres presas. La metodología de los estudios de caso se ha visto acompañada de un abordaje más general de la situación del encarcelamiento femenino, las políticas de igualdad y la incorporación de los programas de intervención. Esta se ha realizado mediante la utilización de fuentes de información secundaria y la recogida de datos cuantitativos y cualitativos a través de fuentes de información primaria. La tesis ha permitido corroborar que el sistema penitenciario sigue atravesado por los principales rasgos de una cultura patriarcal y androcéntrica que permea sus prácticas, discursos y dinámicas a todos los niveles y que las medidas impulsadas en materia de igualdad no consiguen eliminar. Así, la investigación ha desvelado cómo el fomento de programas neutros en cuanto al género, como los MdR, lleva a una disciplina cada vez más severa y a una atención inadecuada de las necesidades de las mujeres encarceladas. Asimismo, en los valores, discursos y prácticas de los MdR también se han podido identificar rasgos de las nuevas formas de castigo identificadas en la línea teórica del análisis del neoliberalismo penal. Estas nuevas formas, en su interacción con las prácticas tradicionales del castigo de las mujeres, refuerzan la disciplina, el control y la obediencia, al tiempo que se apoyan en estereotipos de género, raza y nacionalidad. Ahora bien, a pesar de las desigualdades de poder entre la institución penitenciaria y las mujeres presas, estas siguen ejerciendo prácticas de resistencia que frecuentemente descansan en una relectura de los rasgos asociados con la feminidad normativa impuesta.

In this thesis, I use feminist ethnography at a nonprofit organization to analyze the racialized gender in (re)integration of victim-survivors of commercial sexual exploitation of children (CSEC). Critical race feminism and intersectionality are the theoretical frameworks to guide the analysis of community advocacy. The analysis considers two themes with various subsections that capture CSEC at the site. The first theme analyzes the definition, challenges, coordination and rhetoric of reintegration at the site. The second theme highlights the site’s racial identity, Black victimhood of victim-survivors of CSEC in the context of community, and racialized gender within reintegration. I discuss the strategic use of colorblindness within reintegration at the NGO and the child/adult dichotomy that shapes the organization’s understanding of CSEC.

This academic work is a critical review of studies on violence against women undertaken by the american radical feminism and the approaches influenced by this. The research aims to analyze the theoretical framework used on the interpretation about violence in heterosexual relationships, considering the hypothesis that some of its assumptions are wrong. Problem areas found in American traditional theory revolved mainly around three issues. First, its simplistic and reductionist analysis, which summarizes the explanation of violence to gender. Second, its essentialist and deterministic conception of attributes related to men and to their sexuality, which gives them an insurmountable violent nature. Third, the strategy to struggle against violence lately reduced to criminalization and punishment. Such misconceptions reflect their adoption of the old etiological paradigm in criminological considerations made by this current, which has reverberated in different feminist theories and in political activism. In contrast, this work proposes a feminist approach to compose a unit with the critical criminology, that is, to make an interpretation of violence contextualized historically free of essentialism and committed to human emancipation forward to the various mechanisms of oppression.
Este trabalho constitui uma revisão crítica dos estudos sobre a violência contra a mulher empreendidos pelo feminismo radical estadunidense e pelas abordagens por este influenciadas. A pesquisa tem como objetivo analisar a fundamentação teórica implementada nas interpretações sobre a violência nas relações heterossexuais, considerando a hipótese de que alguns de seus pressupostos estejam equivocados. Principalmente três aspectos são problematizados nas interpretações da corrente norte-americana. Primeiro, sua análise simplista e reducionista, que resume a explicação da violência contra a mulher à questão de gênero. Segundo, sua concepção essencialista e determinista dos atributos referentes aos homens e a sua sexualidade, que lhes atribui uma natureza violenta insuperável. Terceiro, a estratégia de combate à violência, ultimamente reduzida à criminalização e à penalização de condutas. Tais perspectivas refletem a adoção do antigo paradigma etiológico nas reflexões criminológicas realizadas por essa corrente, que tem reverberado nas diversas teorias feministas e na militância política. Em contraponto, este trabalho propõe uma abordagem feminista que componha uma unidade com a criminologia crítica, isto é, que faça uma interpretação da violência contextualizada historicamente, livre de essencialismos e comprometida com a emancipação humana frente aos diversos mecanismos de opressão.

This thesis uses feminist critical discourse analysis to find and understand the discourses embedded in the mission statements and program documents of three domestic violence and/or rape crisis centers that primarily serve Black/African American populations in three distinct geographic locations in the United States. Existing literature addresses the discourses present in domestic violence and sexual assault service provision, but no literature addresses the discourses present in the mission statements of domestic violence and rape crisis centers, leaving a considerable gap in the literature. This project uses frameworks of feminist understandings of Foucauldian discursive patriarchal power, intersectionality and material feminism to analyze the mission statements and put them in conversation with each other. The three organizations chosen, Our House, Jenesse Center and Black Women’s Blueprint, each are 2015 award grantees of one of two federal Office of Violence Against Women’s grants to provide services to culturally specific populations. I argue the mission statements of Our House, Jenesse Center, and Black Women’s Blueprint have a discourse of resistance articulated through embedded discourses of Black feminism, neoliberalism, community and cultural competency, and storytelling. This larger discourse of resistance draws on Black/African American historical structures of resistance. Understanding Black/African American serving domestic violence and rape crisis centers as sites of resistance allows for a deeper understanding of Black/African American women’s unique expression of power and domination.

A mola propulsora desta investigação científica é a constatação de que a maioria dos trabalhos encontrados no Brasil sobre a condição feminina, seja como autora de crimes, seja como vítima, encontra-se referenciada em paradigmas criminológicos conformadores de categorias totalizantes. Paradigmas estes que, muito pouco, ou nada, se aproximam do que já produziu a teoria feminista. Assim, o problema está em saber qual a condição de possibilidade de existência de um referencial criminológico feminista autônomo. A hipótese formulada é a de que se faz necessário um giro epistemológico e a adoção de um novo paradigma oferecido pela teoria crítica feminista. O objetivo principal desta tese é, em consequência, a construção deste referencial epistemológico que, sem abrir mão da crítica ao direito penal, compreenda os processos de criminalização e vitimização das mulheres sob a perspectiva de gênero. Para chegar a tal nível de construção teórica, busca-se na análise bibliográfica no campo da história, da sociologia, da filosofia, do direito e, claro, da teoria feminista, o material necessário para o trabalho artesanal de coser elementos para uma criminologia feminista. Trata-se neste trabalho, enfim, da apresentação de uma criminologia que não pretende ser a “única” criminologia feminista. Mas “uma”, dentre as várias possibilidades de construção do conhecimento, que a diversidade de feminismos, e suas correspondentes epistemologias, apresentam. ______________________________________________________________________________ ABSTRACT
The driving force of this research is the finding that most of works found in Brazil on the status of women, either as perpetrators or victims, are cited in criminological paradigms of conformable totalized categories. These paradigms have little or nothing to do with what the Feminist Theory has already created. Thus, the problem is how to know the condition of possibility of existence of an autonomous feminist criminological reference. The hypothesis formulated herein is the need for an epistemological shift and the adoption of a new paradigm provided by the feminist critical theory. The main goal of this thesis is the creation of this epistemological reference which, without giving up on the criminal law criticism, understands the women criminalization and victimization processes from the gender perspective. In order to reach such level of theoretical creation, the material needed for a feminist criminology is found on the literature review in the fields of History, Sociology, Philosophy, Law, and of course, Feminist Theory. This work is, indeed, the presentation of a criminology that does not intend to be the “only” feminist criminology, but “another one”, among many possibilities of building knowledge that the diversity of feminisms and their corresponding epistemologies present.

Em vista disto, interessa-nos analisar de que forma se forjaram os discursos presentes na imprensa recifense a respeito da criminalidade feminina, entendendo o papel nisso desempenhado pelas formulações do campo jurídico acadêmico e da criminologia. Portanto, nossa análise busca entender como os bacharéis da Faculdade de Direito do Recife no início da República tentaram estabelecer, por meio de seus discursos definições da mulher criminosa, do papel social da mulher e do estatuto jurídico dado às mulheres no Recife daquele período.

O panorama criminal em Portugal tem sofrido muitas mudanças, decorrente tanto da transnacionalização do crime no contexto das sociedades globalizadas, como do aumento da participação de estrangeiras em práticas delituosas, sobretudo, as que envolvem tráfico de estupefacientes. Dentre estas, destacam-se as brasileiras, de cuja comunidade decorre tanto o maior contingente populacional estrangeiro em território português, e, extensivamente, o maior contingente carcerário. As razões de tal aumento levam-nos a uma reflexão, numa perspectiva abrangente, capaz de inserir tanto o tópico da criminalidade feminina, bem como uma análise de género que, tomando tais brasileiras por referência, avalie os seus respectivos papéis numa panorâmica ampla, voltada desde o passado até as perspectivas pósconfinamento. Tendo por base esses pressupostos, a presente dissertação tem como objetivo investigar as razões que levaram essas mulheres à consecução do ato delituoso, buscando compreender o crime desde a versão de suas respectivas protagonistas. Concomitantemente, ambicionou-se – a partir da escuta dessas mulheres – compreender as assimilações de papéis e os efeitos do encarceramento, para assim dimensionar os eventuais desdobramentos em âmbito familiar. Para isso, optou-se pela pesquisa de terreno no Estabelecimento Prisional de Tires, de maneira que os dados foram recolhidos através de entrevistas semiestruturadas com 20 mulheres de nacionalidade brasileira. Ademais, questões como o da sobrecarga de papéis assumidos por mulheres que, vindas de relacionamentos conflituosos e abusivos, dobram a sua carga de trabalho para suprir a respectiva ausência paterna (o que as levam à sujeição aos maiores riscos); além da paulatina mudança na estrutura familiar desde o encarceramento, resultando assim na modalidade de novos arranjos familiares, na qual os avós eventualmente ocupam e suprem a ausência das mães, eis, com efeito, o que subjaz nos relatos das reclusas brasileiras, encarceradas no Estabelecimento Prisional de Tires.
The criminal landscape in Portugal has undergone many changes, as a result of both the transnationalization of crime in the context of globalized societies and the increased participation of foreigners in criminal practices, especially those involving drug trafficking. Among these are the Brazilian ones, from whose community both the largest foreign population contingent in Portuguese territory derives, and, extensively, the largest prison contingent. The reasons for this increase lead us to a reflection, in a comprehensive perspective, capable of inserting both the topic of female crime, as well as a gender analysis that, taking such brazilian women by reference, evaluates their respective roles in a broad, focused overview. from the past to the post-confinement perspective. Based on these assumptions, this dissertation aims to investigate the reasons that led these women to commit the criminal act, seeking to understand the crime since the version of their respective protagonists. At the same time, it was intended - from listening to these women - to understand the assimilation of roles and the effects of incarceration, so as to measure the possible unfolding in the family. For this, we opted for the land survey in the Prison of Tires, so that the data were collected through semi-structured interviews with 20 women of brazilian nationality. Moreover, issues such as the overload of roles assumed by women who, coming from conflicting and abusive relationships, double their workload to compensate for their paternal absence (which leads them to be subjected to greater risks); in addition to the gradual change in family structure since incarceration, resulting in the modality of new family arrangements, in which grandparents eventually occupy and supply the absence of mothers, this, in fact, underlies the reports of Brazilian prisoners, incarcerated in the establishment Prison of Tires.

Within feminist scholarship advertising – representing women as wives, mothers and sexual objects – has long been regarded as patriarchal, blocking women's liberation (Talbot 2000) and thus an impossible practice for progressive activism. More recently, however, approaches acknowledge advertising as a ‘tool' deployed for a range of ‘political' ends, encouraging changes in values, understandings and behaviors. Such advertising is often referred to as ‘social marketing'. This thesis focuses on one such campaign in Ghana between 2007 and 2009 attempting to raise awareness about gender violence. This campaign is considered in the context of the position of women in post-colonial Ghana and tracked across the different processes of a ‘circuit of culture' (including production, representation, consumption) through which meanings are made (du Gay et al 1997). The thesis explores the campaign's inception, production, mobilization within educational and ‘consciousness-raising' endeavors, the form and textual construction of the ads (largely posters), women's (and some men's) understanding of the posters and gender violence. Methodologically, the project involved interviewing twelve individuals in key organizations working with the public, victims, and on the campaign. It also involved collecting a sample of ten ad posters and conducting eight ‘focus group' discussions with women and some men. Findings suggest that the campaign did lead to increased awareness of gender violence across gender, generations and literacy levels. Nevertheless, audiences/consumers interpreted the campaign posters in very distinctive ways, depending on the resonance with their own lives. Further, constraints on reporting abuse still held, not least on account of the embarrassment and shame of admission. Overall the thesis contributes to scholarship on social marketing but more particularly to debates about improving women's position in Ghana.

Este Relatório Técnico tem por objetivo analisar as condições de encarceramento de mulheres na Unidade de Prisão Feminina de Palmas (UPF), retratar o perfil feminino e os tipos penais que levaram a prisão. Trata-se de uma pesquisa empírica cuja coleta de dados sistemática foi realizada diretamente no prontuário físico das 62 presas, mediante visitas in loco à UPF. Como suporte teórico-metodológico para a análise dos dados foi utilizado o enfoque da Teoria do Etiquetamento, da Criminologia Crítica. Os resultados da pesquisa evidenciam traços da criminalização da pobreza e a rotulagem por classe social, cor da pele, escolaridade, etc. Ao contrário da Criminologia Crítica, a microssociologia criminal positivista trabalha com o paradigma da reação social, que rotula o criminoso pelas características do meio em que está inserido e pelo tipo penal, produzindo o fenômeno do superencarceramento, desconsiderando os fatores macrossociais que produzem o fenômeno da criminalidade e permitem uma compreensão do crime para além da mera causalidade. Na UPF, as condições de encarceramento violam os Direitos Humanos, considerando o quadro de superlotação e a estrutura da UPF, que é uma residência adaptada aos fins que se propõe.
This Technical Report aims to analyze the conditions of imprisonment of women in the Prision Unit Women (UPF) in Palmas, portraying the female profile and the criminal types that led to the arrest. This is an empirical research whose systematic data collection was performed directly on the physical records of the 62 prey, through on-site visits to UPF. As a theoretical and methodological support for the analysis of the data was used the approach of the Theory of Labeling from Critical Criminology. The results of the research show traces of the criminalization of poverty and labeling by social class, skin color, schooling, etc. Unlike Critical Criminology, positivist criminal micro-sociology works with the paradigm of social reaction, which labels the criminal by the characteristics of the environment in which he is inserted and by the criminal type, producing the phenomenon of overincarceration, disregarding the macro-social factors that produce the phenomenon of criminality and allow an understanding of crime beyond causality. At UPF, the conditions of incarceration violate Human Rights, considering the overcrowding and UPF structure, which is a residence adapted to the purposes of it.

Le but de cette étude est d'évaluer l'évolution de la présence des caractéristiques de la pornographie tant revendiqueés par les féministes radicales, caractéristiques fondées sur la prémisse que la pornographie est le moyen fondamental de subordination des femmes. Une analyse quantitative du contenu manifeste nous a permis de constater que Hustler présente une plus grande diversité de photographies au fil des ans. Le nombre de modèles et de scènes présentées augmente de façon significative dans les années '90, offrant ainsi plus de diversité aux lecteurs. Une analyse qualitative du contenu latent nous a aidées à identifier et définir les caractéristiques principales du matériel suite à l'étude de six numéros de la revue. Ces dernières ne sont pas celles qu'avaient dénoncé les féministes concevant la pornographie comme violence. Certains éléments de leur définition de la pornographie s'y retrouvent, mais ont en effet une infime présence dans la revue Hustler, elle qui à l'époque avait tant été critiquée par les féministes. Nous avons développé sur les thèmes suivant: le caractère explicite de Hustler, la réification, la subordination, la violence, les femmes présentées comme des "prostituées", Hustler et les féministes face à face et le lecteur de Hustler. Une étude de quatre numéros supplémentaires nous a permis de confirmer les résultats trouvés dans notre première analyse. Nous avons pu conclure que la dénonciation féministe radicale était peu justifiée en ce qui a trait à la revue Hustler. De plus, nous avons noté que le contenu de ce dernier changeait peu à travers le temps et qu'il ciblait un public spécifique est principalement masculin. D'un autre côte, la revue Hustler ouvre le discours sur la sexualité. (Abstract shortened by UMI.)

Between April 1997 and November 1999, I followed eight socially excluded female drug users in an attempt to describe their lives and living conditions. The study employs an ethnographic approach with the focus being directed at the specific woman and her life in relation to the social context where this life is lived.

The study’s objective has been to describe the lives and living conditions of the eight drug-using women, as well as the extent of the opportunities available to them, as being determined by mechanisms of social exclusion. Their lives are understood on the basis of a feminist and social constructionist perspective where perceptions of ‘the drug-abusing woman’ are regarded as the result of constructions of gender and deviance. The theoretical perspectives proceeds from the idea that one is not born a woman but rather becomes one. The fundamental idea is that women become women by means of processes of femininisation, in the context of which certain ways of interpreting and presenting oneself as a woman are regarded as good and others as bad. Our images of ‘the female drug addict’ are based on how we define and interpret deviance and on the cultural and social thought and behaviour patterns we ascribe to people on the basis of bodily differences. It is images of ‘the good woman’ that defines what we regard as characteristic of ‘the bad woman’ and vice versa.

The findings are organised into three main topics: femininity, living conditions and social control. The main findings are: The women described themselves as women by relating to normative messages about how women “are and should be”, and their drug use constituted a means of coping with life from their social position. Their life revolved to a large extent around money via a constant struggle to find enough to cover the rent, food and other basic necessities. And finally, how the women’s relations to societal institutions were formed by their social position as ‘female drug addicts’ and how the asymmetry of these relations produced certain fixed patterns of action for the parties involved.

This thesis seeks to reorient the ideological foundations of restorative justice through feminist epistemologies to explore possibilities of how the movement might more fully actualize its values. The Three Pillars of Restorative Justice, conceptualized by Howard Zehr, offer an alternative process to the punitive recourse of the criminal justice system and serve as the foundation of mainstream restorative practices. However, the praxis and analytical discourse have stalled due to the limited binary of criminal and restorative justice frameworks. My thesis uses methodologies prominent in Black and Native feminisms-- such as critical thinking, contextual intelligence, and imagining futurity-- to complicate assumptions embedded in the criminal/restorative justice relationship. I establish the framework of restorative justice and briefly summarize the essential paradoxes to make clear the parallels and limits of the relationship. I then use feminist methodologies to reinterpret the pillars' values and introduce how some activists have begun to reimagine justice.

Many people today believe the concept of gender inequality is outmoded, irrelevant and unnecessary in Western societies that are deemed egalitarian. As a consequence, feminism as a movement with gender equality at its core has often been proclaimed ‘dead’,a relic of the past. Feminist perspectives, nevertheless, have produced differing points of view about the sources of gender inequality affecting crime rates and criminal behaviour. For the last 50 years or so, women and girls have been the subject of criminological research that has largely evolved from sociological perspectives and specifically from feminism. Although gender intersects with other social realities and disadvantages, it is a crucial factor in relation to offending behaviour. A substantial body of feminist literature confirmed that marginality and poverty are factors leading to female criminality. Using a sequential explanatory mixed methods design, this research explores the consequences of gender inequalities affecting older indigent Australian women convicted of acquisitive crimes. This thesis argues that the term ‘feminism’, and feminist discourse and communications, ought to be abandoned in favour of advancing the human rights framework in the 21st century. Stigma associated with the feminist label has been detrimental. The most significant finding in this research is that financial need rather than greed was a precursor to older women’s involvement in acquisitive crimes. Having primary custody of children after divorce and relying on welfare support were factors contributing to their impoverished status. The feminisation of poverty, the segregation of women into low-paid feminine occupations and an accumulation of disadvantages over the life course often contribute to women’s impoverishment in their later years. Potentially, law-abiding older women are put at risk of transgressing the law for the first time later in their lives to alleviate their poverty. From a human rights perspective, violations of the women’s rights were factors contributing to their offending behaviour. Gender inequality, a condition that disadvantages women, however, is alive and well in Australia as confirmed here and is an unrelenting feature of many male-dominated social structures throughout the world today. Since a great deal of negativity surrounds the feminist label, it would be more pragmatic to abandon the feminist label and adopt a human rights approach.

A presente dissertação, realizada junto a linha de pesquisa Sociedade, Controle Social e Sistema de Justiça, do Programa de Pós Graduação em Direito da Universidade Federal de Santa Catarina, pretende compreender como funciona o trabalho realizado pelas mulheres presas no presídio feminino de Florianópolis, o referencial teórico de análise é a criminologia crítica e a antropologia. Parte-se da hipótese central de que o trabalho realizado na prisão, não apenas cumpre função diversa, mas inversa daquela apresentada no discurso declarado da função da prisão. Desta forma a prisão não combate, e sim constrói o criminoso, para assim reproduzir a estrutura social correspondente.Para tanto se utiliza a pesquisa de campo com o método de procedimento antropológico etnográfico através da observação participante, em que a pesquisadora domestica seu olhar, seu ouvir e teoriza seu escrever, e assim comprova qual o sentido do trabalho na prisão, justificada pela possibilidade em dar voz àquelas mulheres e conhecer a realidade sem disfarces.A partir do discurso declarado que tenta legitimar a prisão, encontrados nos instrumentos jurídicos internacionais e nacionais, e especificamente na Lei de Execução Penal, confrontados com a operacionalização observada in loco, confirma que a prisão funciona com uma eficácia invertida, o trabalho não somente contraria o discurso da ressocialização, como confirma a laborterapia.

Resumen: Este trabajo, llevado a cabo en la línea de investigación Sociedad, Control Social y el Sistema de Justicia, del Programa de Posgrado en Derecho de la Universidad Federal de Santa Catarina, tiene por intención entender cómo se constituye el trabajo realizado por las mujeres atrapadas en la prisión femenina de Florianópolis. El marco teórico de análisis fue pautado por los fundamentos teóricos ofrecidos por la criminología crítica y la antropología. Como hipótesis central, se sostiene que el trabajo realizado en la cárcel, no sólo cumple funciones diferentes, sino inversas a las presentadas en el discurso declarado como función de la prisión. Así, la prisión no lucha contra el crimen, sino que construye y refuerza la clientela habitual de las instituciones de confinamiento penitenciario, a fin de reproducir la estructura social correspondiente. Por lo tanto se optó por la investigación de campo a través del procedimiento antropológico y del método etnográfico a través de la observación participante, en la que se domestica la mirada investigadora, lo que se escucha y teoriza su escritura, para buscar comprobar el(los) sentidos del trabajo en la prisión, e que se justifica por la posibilidad de dar voz a las mujeres y conocer la realidad sin disfraz. Del discurso declarado que intenta legitimar la prisión y que se encuentra en los instrumentos jurídicos internacionales y nacionales, específicamente en la Ley de Prisiones, confrontado con la realidad observada in situ, se llega a la confirmación de que la cárcel funciona con una eficacia invertida: trabajar no sólo contradice el discurso de la rehabilitación, sino que por lo contrario fue confirmado que su sentido principal se constituye como terapia laboral.

La criminalité féminine est une question complexe et pertinente puisqu'il n'y a encore très peu d'études sur le sujet. Le présent travail vise à analyser et décrire comment le parcours de femmes déviations par les trajectoires de vie des femmes emprisonnées dans la prison pour femmes de Nossa Senhora Socorro/SE (PREFEM). Il cherche également à comprendre la relation entre la femme et la pratique criminelle tout au long du temps et introduire le PREFEM de sa structure physique et le contrôle social des femmes à l'intérieur de la prison, instituant et légitimer les rôles sexuels. En ce sens, il révèle comment la déviation se passe dès le moment où la femme est confrontée à réglementation et coexistence avec vivant avec tout ce qu'ils sont insérés dans l'unité de la prison. La recherche a analysé 40 cartes leurs proies alors que 13 ont été sélectionnés Répétez les délinquants et primaire 01 (était en prison pour la première fois). Comme critères pour la sélection de ces femmes sont les crimes de trafic de drogue, vol, meurtre, armés vol augmenté étant donné que les crimes qui sont censés être pratiqués par les femmes (il y avait seulement l'inclusion d’une femme pour vol à l'étalage). J’ai choisi la perspective ethnographique pour une observation directe du contexte institutionnel dans son ensemble, y compris avec l'utilisation de l'enregistrement photographique et l'analyse des entrevues en profondeur de l'enregistrement des récits de vie et l'analyse des documents fournis par l'institution. Ce travail se compose de quatre chapitres discuter: la criminalité féminine, associant la discussion sur le genre porte sur la prison, par le biais de l'approche théorique de Goffman et Foucault et d'autres chercheurs sur les prisons féminins; et presènt les données extraites de l'analyse des entrevues caractérisée par quatre types d'itinéraire de contournement dont chacune a ses particularités liées à trajectoire de vie, les motivations pratiques déviantes, insertion dans le monde du crime, ainsi que les possibilités de détournement au sein de la prison. Un des chemins trouvés sont: 1) associées à des besoins de survie en raison de la situation socio-économique précaire ; 2) liées à l'ascension sociale résultant de l'ambition et le désir d'enrichissement ; 3) incorporée à l'état de dégradation de la vie par les conséquences de la jouissance effrénée par le sexe, alcool et drogues et 4) ajouté à la révolte contre les normes établies par le contrôle exercé par le giron familial et par la société. J'ai utilisé l'approche de Howard Becker, obéir à des préceptes de la rédaction proposée par l'ethnographie anthropologique, à l'analyse des entrevues. Je pourrais souligner que ces femmes confronter les caractéristiques considérées comme stéréotypes féminins ainsi que sont semblables aux mâles de pratiquer les mêmes types de crimes.
A criminalidade feminina é um tema complexo e relevante visto que ainda há poucos estudos sobre a temática. O presente trabalho visa analisar e descrever como se dá o percurso dos desvios femininos a partir das trajetórias de vida das mulheres presas no Presídio Feminino de Nossa Senhora do Socorro/SE (PREFEM). Ele busca também compreender a relação entre a mulher e a prática criminosa ao longo do tempo e apresentar o PREFEM a partir de sua estrutura física e controle social sobre as mulheres dentro da prisão, instituindo e legitimando papeis sexuais. Nesse sentido, ele revela como o desvio acontece a partir do momento em que a mulher se depara com a convivência normativa da instituição e com a convivência com todos que estão inseridos na unidade prisional. Para a realização da pesquisa analisei 40 prontuários das presas de modo que foram selecionadas 13 reincidentes e 01 primária (estava na prisão pela primeira vez). Como critérios para a seleção dessas mulheres estão os crimes de tráfico de drogas, roubo majorado, homicídio, latrocínio visto que não são crimes que se esperam que sejam praticados pela mulher (só houve a inclusão de apenas 01 mulher por furto). Privilegiei a perspectiva etnográfica para a realização da observação direta do contexto institucional como um todo, inclusive com o uso do registro fotográfico, e análise das entrevistas aprofundadas a partir da gravação das trajtórias de vida e análise documental disponibilizada pela instituição. Este trabalho consiste em quatro capítulos que tem a finalidade de: discutir a criminalidade feminina, associando à discussão sobre gênero e sobre a prisão através da abordagem teórica de Goffman e Foucault e demais pesquisadores que tratam sobre as prisões femininas; de apresentar o campo da pesquisa no PREFEM; e de apresentar os dados extraídos da análise das entrevistas caracterizados por 4 tipos de percurso do desvio no qual cada um possui suas particularidades relacionadas à trajetória de vida, motivações para as práticas desviantes, inserção no mundo do crime, bem como possibilidades de desvio dentro da prisão. Dentre os percursos encontrados estão: 1) associado às necessidades de sobrevivência decorrente das precárias condições socioeconômicas; 2) relacionado à ascensão social resultante da ambição e do desejo de enriquecimento; 3) incorporado ao estado de degradação da vida em virtude das consequências provocadas pela curtição desenfreada através de sexo, álcool e drogas e 4) agregado à revolta contra as normas estabelecidas pelo controle exercido pelo seio familiar e pela sociedade. Utilizei a abordagem do desvio de Howard Becker, obedecendo aos preceitos da escrita proposta pela etnografia antropológica, para a análise das entrevistas. Ressalto que essas mulheres confrontam as características consideradas como esterótipos femininos bem como são semelhantes ao gênero masculino ao praticarem os mesmos tipos de crimes.

This dissertation aspire to bring feminism and criminology closer together, recognizing it’s limitations on time and how those concepts are always changing but, at the same time, renewing itself by returning to it’s origins. This paper also seek to point out the difficult relation between the feministic perspective and criminology, by pointing out where they meet and where they disagree, doing that by field research in a place where feminism and criminology often meet.
Esta dissertação busca inserir-se numa atitude coletiva, considerando a multiplicidade inapreensível das culturas e imaginários. Adverte-se: assume-se a (im)possibilidade de ser mais que uma tentativa do impossível. O estudo simboliza o desenrolar leituras e impressões, especialmente sobre a experiência de uma pesquisa empírica em um Juizado de Violência Doméstica, local onde Criminologia e feminismos obrigatoriamente imbricam-se. A vivência etnográfica permeia todo o texto, o estar-junto na sala de audiências é inseparável das teorias. Aproxima-se feminismos e Criminologias, assumindo sua temporalidade, olhando-os na limitação de seu tempo e, simultaneamente, num constante retorno e re-significação. A totalização é impossibilitada: o retorno sempre é diferente.

This dissertation intended to investigate how the members of two Non-governmental Organizations existing in Porto Alegre – Themis and JusMulher – deal verbally with home violence against the woman, showing the contradictions between emancipation/overcoming and criminalization in the area of the Criminal Laws, being centered on the discussion about Law 11. 340/06 (Law Maria da Penha). It is a work attached to the Criminology and Social Control research field of PPG in Criminal Sciences of PUCRS which focuses on a qualitative research whose corpus was built upon partially structured individual interviews (deep) and documental ones. This kind of interview was chosen as there was interest in emphasizing the absorption of cultural aspects and the different outlines of the studied NGOs. The specific aim of the qualitative research was to analyze critically the role of these two organizations within the development of Lei 11. 340/06 portraying the punishment searching discourse as a way of defending the women’s rights and the attempt to diminishing the violence against woman. The interviewed recognize there are limits in the Criminal Laws to reach the desired results, and their option for punishing alternatives prevented from finding other possibilities to face the gender conflicts and improve the path open by the “Criminal Especial Courts. ”
A presente dissertação, vinculada à linha de pesquisa em Criminologia e Controle Social do PPG em Ciências Criminais da PUCRS, pretendeu investigar como as integrantes de duas Organizações Não Governamentais com sede em Porto Alegre – Themis e JusMulher – lidam discursivamente com o problema da violência conjugal contra a mulher, explicitando as contradições entre emancipação/superação e criminalização no campo do Direito Penal, tendo como foco o debate sobre a Lei 11. 340/06 (Lei Maria da Penha). Trata-se de uma pesquisa qualitativa, cujo corpus foi construído utilizando-se das técnicas de entrevistas individuais semi-estruturadas (em profundidade) e do tipo documental. Esse tipo de entrevistas foi escolhido pelo interesse em enfatizar a absorção de aspectos culturais e as diferentes perspectivas que integram as ONG’s estudadas. O objetivo específico da pesquisa foi analisar, de forma crítica, a atuação destas entidades no processo de elaboração da Lei 11. 340/2006, evidenciando a recorrência ao discurso punitivo como forma de defesa dos direitos das mulheres e a tentativa de, com isto, diminuir a violência contra a mulher. Embora haja, por parte das entrevistadas, o reconhecimento dos limites do Direito Penal para alcançar resultados efetivos, o fato é que a adesão a alternativas punitivas acabou inviabilizando a construção de novas possibilidades de enfretamento dos conflitos de gênero, aperfeiçoando o caminho aberto pelos Juizados Especiais Criminais.
