Abstract:
Saat ini banyak proyek internasional dan pemerintah yang dikerjakan di Indonesia sebagai dampak dari perkembangan era globalisasi. Pihak internasional dan pihak pemerintah memberikan persyaratan untuk menggunakan model kontrak internasional. Salah satu model kontrak yang sering digunakan adalah FIDIC. Namun, pada kenyataannya banyak terjadi klaim konstruksi pada proyek-proyek yang menggunakan model kontrak FIDIC, khususnya FIDIC Design build (Yellow book). Berdasarkan hal itu, diperlukan penelitian untuk menemukan faktor-faktor yang menyebabkan klaim konstruksi dalam penggunaan FIDIC Design build tahun 1999. Temuan dari penelitian itu akan dijadikan referensi untuk menganalisis FIDIC Design Build tahun 2017. Kuesioner dalam penelitian ini terdiri dari 25 butir pertanyaan dan menggunakan skala Likert 6. Data diolah dengan menggunakan sostware SPSS 24.0 untuk menemukan faktor dominan penyebab klaim pada FIDIC Design build 1999. Penelitian ini menggunakan analisis faktor untuk mendapatkan faktor dominan penyebab klaim pada FIDIC Design build 1999, yang dilanjutkan dengan analisis kualitatif dengan FIDIC Design build 2017. Tujuannya adalah untuk menemukan isi dari klausula yang berhubungan untuk melihat apakah permasalahan pada faktor yang muncul tersebut sudah tercakup atau belum. Berdasarkan hasil analisis faktor ditemukan 3 faktor dominan penyebab klaim pada FIDIC Design build 1999 yaitu: 1) Inadequate Site Investigation; 2) Difference in Interpretation; dan 3) Over Inspection. Berdasarkan hasil analisis kualitatif ditemukan bahwa faktor-faktor tersebut sudah tercakup dalam FIDIC Design Build 2017. Di samping itu ditemukan pula perubahan nama pada klausula Force Majuere menjadi Excetional Event.

FIDIC (Fédération Internationale des Ingénieurs - Conseils) is an International body whose membership consists of National Associations of Consulting Engineers. It has in publication different suites of contracts used for international engineering projects, viz; FIDIC REDBOOK (Construction), FIDIC YELLOW BOOK (Plant& DB), SILVER BOOK (Turnkey/EPC) and FIDIC GREENBOOK (Short Form Contract). Generally, the FIDIC contract contains 20 Clauses but seventeen (17) of which have common clause names and the suitability of this FIDIC Suite is a measure of ‘Risk distribution’. Whereas there is an obvious similarity with regards to the number of clauses contained in each of the FIDIC Suites, but this paper limits attention only to General Provisions, Force Majeure, Claims, Disputes and Arbitration.

<strong>Abstract:</strong> Nowadays, strong organizations make efforts to ensure that successful relationships are keep up through terms that encourage collaboration and support manage risk. Despite the importance of the existence of several forms of construction contracts for standardization contractual clauses in Mega industrial projects, standardization inevitably reduces the flexibility of these documents and their ability to adapt to all possible circumstances and parties&#39; interests and needs. Contracts can function as an administrative tool for effective dispute control and project management by allocating each significant risk factor to the party who is capable to bear,&nbsp;manage, or mitigate it. The Conditions of Contract for Plant and Design Build {FIDIC form 2017 Yellow Book} were studied and examined to address the risky clauses. Some amendments were made to mitigate the project&#39;s significant risk factors and change the contract into a risk-balanced contract that could be used as a project management tool. These amendments focused on the specific requirements of Mega industrial projects, strive hard to address some problems such as the responsibility matrix between the Employer and the Contractor, limitation of liability, resolving procurements problems, Design errors, and contradiction in documents, the need for coordination between contractors and subcontractors, the importance of adhering to the project program, and linking delay damages with the project milestones. The aim of the research is to determine for a contract’s “Design and construction works of Vilnius city wastewater treatment plant” the most suitable variant of the combination of the FIDIC standard construction contract model and the purchase pricing of contract works using the SAW. Based on expert assessments, a matrix of possible solutions is formed by interviewing 8 experts (4 public procurement specialists and 4 civil engineers). Calculations have shown that the most appropriate combination of the FIDIC standard construction contract model and contract purchase pricing is the FIDIC Yellow Book and fixed price pricing. The obtained research results mainly reflect the essence of the FIDIC Yellow Book, assessing the specifics of the contract and the complexity of the planned works.

Occupational accidents in the construction sector have a very significant contribution. One of the constructive efforts that can be carried out is to apply the Occupational Health and Safety provisions as stated in the construction contract. Among the various construction contract formats, the FIDIC Red Book 2017 contains several Occupational Health and Safety provisions in its clauses which can be used as a reference for Employers and Contractors in terms of risk sharing and scope of responsibility. The research aims to describe the Occupational Health and Safety provisions in the 2017 Red Book FIDIC construction contract format and compare them with applicable national regulations. From an analysis of the contents of sub-clauses that are relevant to Occupational Health and Safety and a comparison with the regulation of the Minister of PUPR Number 10 of 2021 concerning guidelines for construction safety management systems, an insight into the contents of the 2017 Red Book FIDIC sub-clauses regarding Occupational Health and Safety, in general, has been included in the regulation of the Minister of PUPR Number 10 of 2021. FIDIC itself prioritizes Contractor compliance with applicable national regulations. Among the provisions of Occupational Health and Safety in the FIDIC Red Book 2017 and the regulation of the Minister of PUPR Number 10 of 2021 are compatible and mutually reinforcing.Keywords: Comparison of Clauses; FIDIC; Occupational Health and Safety

Abstract:
The aim of the paper is to present the subject matter related to the procedure of resolving disputes arising in connection with implementation of agreements concluded on the basis of contract models published by the international federation FIDIC in 1999 Red and Yellow Book. The intention of the authors of the FIDIC templates was to apply an autonomous multistage procedure (the so-called multi-step clause) for resolving disputes based on arbitration without taking the matter to court. However, the application of the procedure proposed by FIDIC raises controversies of legal and factual nature. The problems concern, in particular: the nature, immediate enforceability, contestability of decisions issued by the Dispute Adjudication Board (DAB) and methods of their reinforcement. Other issues concern the absence of ‘standing’ or ‘full-term’ Adjudication Board and the right to arbitration in case when a party violates the internal dispute resolution procedure described in the contract, both for reasons dependent on and beyond its control. The publication is of legal and comparative nature and contains the analysis of related jurisprudence of civil law systems of selected countries.

The contract is a very importand document in the project. Contract are seen as laws that must be obeyed, govern and control the rights and obligations between service users and service providers in the project. In world of construction in Indonesia, the standard used for contract documents must be based on Law No.2 of 2017 on construction services as a guide and guidance in constructions activities in Indonesia. In the international world, FIDIC documents has long been recognized, which is a contractual rule that has been used by many countries. FIDIC has also been widely adapted to government and private projects in Indonesia. The first analysis is to identify the contract documents used in several project in North Sumatera region. This analysis shows that the FIDIC red book document is the most suitable document to be used in several project in North Sumatera. The second analysis is comparing the FIDIC document and the analysis shows that the contract document that best matches the points in the questionnaired is Law No. 2 of 2017 on construction services. From the analysis of the previous discussion a conclusion was drawn regarding the philosophy of the work contract discussed was the type of unit price contract based on.

Sedangkan pada tahun 2022, pertumbuhan nya diprediksi di angka 8,4 persen. Perjanjian kontrak yang digunakan tentu berstandar internasional, salah satunya FIDIC. EOT atau Extension of Time adalah suatu hal yang hampir pasti dalam kontrak konstruksi. Penggunaan standar kontrak FIDIC sebagai model kontrak konstruksi di Indonesia semakin meningkat. Proyek-proyek konstruksi baik yang didanai oleh swasta, pemerintah maupun pinjaman luar negeri banyak menggunakan standar kontrak FIDIC, khususnya standar kontrak FIDIC Red Book dan Yellow Book. Namun dalam proses pelaksanaannya, meskipun secara kontrak dibuat sebaik mungkin, secara disain sudah dibuat sebaik mungkin, suatu keniscayaan dapat menghindari klaim dalam suatu proyek konstruksi. Penelitian ini bertujuan untuk memperoleh informasi variabel dominan kewajiban pengguna jasa yang tidak dipenuhi dan dampak yang dapat terjadi apabila tidak dipenuhi. Program penelitian ini menggunakan analisis faktor untuk mendapatkan variabel dominan kewajiban pengguna jasa yang tidak dipenuhi, dan selanjutnya dilakukan analisis data dengan menggunakan analisis kualitatif melalui penyebaran kuisioner kepada para responden. Hal ini dilakukan untuk mengetahui dampak yang akan terjadi apabila variabel tersebut tidak dipenuhi oleh pengguna jasa. Hasil analisis didapat 5 (lima) variabel dominan yaitu 1) Pengguna jasa memberikan ganti rugi atas setiap biaya ditambah dengan keuntungan, yang akan ditambahkan ke dalam harga kontrak jika pengujian ditunda oleh (atas nama) pengguna jasa dengan hasil extraction sebesar 0,913 atau 91,3%, 2) Pengguna jasa membayar jumlah yang disahkan dalam setiap Berita Acara Pembayaran Sementara (56 hari setelah menerima pernyataan tagihan dan dokumen pendukung) dengan hasil extraction sebesar 0,906 atau 90,6%, 3) Pengguna jasa memberikan perpanjangan waktu penyelesaian pekerjaan akibat dari penghentian pekerjaan oleh kontraktor yang dikarenakan pengguna jasa gagal untuk menerbitkan dan mensahkan Berita Acara Pembayaran Sementara, keterlambatan pembayaran progres pekerjaan dengan hasil extraction sebesar sebesar 0,894 atau 89,4%, 4) Pengguna jasa memberikan perpanjangan waktu jika pengujian ditunda oleh (atas nama) pengguna jasa dengan hasil extraction sebesar 0,862 atau 86,2%, 5) Pengguna jasa memberikan ganti rugi biaya bunga yang digabungkan secara bulanan pada pembayaran yang tertunda selama terjadinya keterlambatan pembayaran dengan hasil extraction sebesar 0,852 atau 85,2%. Selain itu dampak yang dapat terjadi apabila kewajiban pengguna jasa sesuai kontrak tidak dipenuhi adalah 1) Penyedia jasa akan mengeluarkan biaya yang tidak diperkirakan sebelumnya, 2) Gagal bayar kontraktor utama kepada sub-kontraktor, 3) Penyedia jasa berpotensi terkena denda yang di ajukan oleh pengguna jasa akibat mundurnya jadwal pelaksanaan proyek, 4) Berpotensi menimbulkan dispute.

This Diploma thesis follows up the award of public contracts using the Design-Build method. The first part focuses on the description of individual procurement methods and their advantages and disadvantages. In addition, the basic types of FIDIC terms and connditions are compared here. The second part describes and evaluates the terms of reference for specific projects commissioned by Design-Build in the Czech Republic. There is also a questionnaire survey that examines the viewpoints, knowledge and experience of contracting authorities with this method.

Infrastructure is a broad term encompassing a wide range of facilities from roads and railway lines to wind, waste and water projects, oil and gas facilities, pipelines and processing plants. Whilst infrastructure construction contracts have key provisions in common, there is no one standard form that fits all projects. Any standard form will need to be tailored to suit the demands of the projects, the risk profile of the parties and comply with the legal jurisdiction of the contract and project location. Increasingly contractors are enhancing their expertise and working on infrastructure projects internationally. As a result, the forms of construction contracts used are becoming more standardized. Nowadays, FIDIC forms of contract are intended to be suitable for projects carried out around the world by all types of employers with the extensive support of large investors such as the World Bank or the European Union. The terms of the Conditions of Contract for Construction have been prepared by the Fédération Internationale des Ingénieurs-Conseils (FIDIC). Two most frequently used FIDIC models of construction contracts are Conditions of Contract for Construction (known as Red Book) and Conditions of Contract for Plant and Design-Build (known as Yellow Book). These general conditions are also used as contract conditions in Croatia for public procurement of transport infrastructure projects. The use of FIDIC General Conditions of Contract in the realization of transport infrastructure construction works in Croatia is presented in the paper.

Today it is hard to imagine new things, inventions and any accomplishments without projects standing behind them. Projects of any kind are a crucial part of our world; they have become the way of thinking and inevitable foundation for successful businesses. In order to produce a desirable impact on the community, project goals must be achieved – in other words, projects must be successful. Nevertheless, it often seems that we live in a world of unsuccessful project endeavors. Many authors agree that problems occurring in implementation phase could have been foreseen in conceptualization and planning. Therefore, planning has been recognized as a critical phase for projects to succeed. High-quality plans enable easier procurement, contracting, monitoring and control – leading to a better project management and overall project success. One of the most popular project management tools for project planning, especially when it comes to budgets, is a well-known S-curve. S-curve is simple, clean, report and user-friendly. All the above is stressed on the special manner when it comes to the largest and most complex projects – infrastructure projects. In Croatia, as well as other EU members, infrastructure projects are mostly EU co-financed, and often contracted via FIDIC terms of contract, which makes planning phases even more important. This research was conducted in order to contribute to the improvement of baselines and projection of financial realization. Theoretical baseline and empirical S-curves on portfolio of FIDIC Red and Yellow Book contracted projects in water sector were analyzed and compared, with the aim of proposing adjusted prognostic S-curves of financial absorption and therefore contribute to more efficient planning and implementation of projects.

Abstract:
Contracts in the construction industry are structured in a manner that splits the risks between different contracting parties; hence risk allocations within the contract affect the price and operation. As most Construction Contracts are long-term contracts, therefore, it is essential to consider having provisions to mitigate foreseeable and unforeseeable risks which may reduce the positive economic prospects and gains, if not, properly evaluated, managed and considered under the contract. For those reasons and many others, the Force Majeure (FM) or the act of God clauses are included in almost all construction project contracts. This paper will provide an analysis of the FM clause in the Public Works Authority (PWA) General Conditions of Contracts (GCOC) for 2018 in terms of the meaning of FM, a list of examples, and the consequences of invoking the FM clause and others. Moreover, the FM clause in PWA GCOC 2018 will be compared with other drafts of the FM clause in other forms of contracts that are used internationally, such as the International Federation of Consulting Engineers General Conditions of (FIDIC) Red Book, 1999 and 2017, and others. This comparison was conducted by taking into consideration scholarly opinions and existing literature on the topic. Finally, the paper addresses the gaps in the existing PWA GCOC FM clause and the applicability of the FM clause in cases such as COVID-19 and then recommends some amendments that could be considered in future contracts.
