La relazione coniugale č una relazione speciale, anzi unica, che si sviluppa all'interno di un contesto culturale e sociale. Č un'impresa individuale e reciproca realizzata per soddisfare i bisogni biunivoci personali ed emozionali di una stretta intimitŕ e interdipendenza all'interno di un quadro istituzionale e sociale di cui gli sposi fanno parte. La ricerca di risposte emotive da parte dei partner con bisogni regressivi e con la gratificazione di fantasie infantili rimane profondamente radicata e costantemente presente nella sessualitŕ adulta. Naturalmente un compito speciale č stanziato nella forza dell'Io per maneggiare un'elevata regressione e dipendenza con meno ansie. Quindi nell'amore adulto il senso di fiducia e di affidabilitŕ reciproca possono produrre un gran senso di sicurezza, di autonomia, di libero desiderio e possono portare all'inevitabilitŕ della ricerca per regressione unita a livelli piů arcaici con il desiderio di realizzare un reciproco e soddisfacente orgasmo e una maggiore intimitŕ. Questo include l'elaborazione immaginativa di parti fisiche, di sensazioni e di funzioni del sé in relazione all'altro. Implicito, e spesso esplicito nelle menti dei partner, č anche l'obbiettivo di formare una nuova integrazione sociale, una nuova famiglia con la sua propria cultura interna distintiva, derivata e dipendente dalle varie referenze interne e dalle esperienze con significative figure dell'infanzia e dell'adolescenza. Le vicissitudini degli oggetti interni e dellei, all'interno dell'Io, del Super-Io e del sé, la loro, la liberazione di significative introiezioni sono state descritte molto abilmente da Bychowski, da Khan, dalla Milner, da Bion, da Kohut, da Bradley e da altri. Cosě, noi possiamo concepire la relazione coniugale come un'interazione di due persone con una lunga storia personale e di sviluppo e, a livello conscio ed inconscio, con conseguenze normali e patologiche. L'importanza di conflitti parentali collusivi come un fattore possibile dell'eziologia o del mantenimento della patologia di un bambino č stata esplorata come un'area da investigare da molti studiosi.

Viene sintetizzata la prassi di presa in carico derivante dall'esperienza trentennale condotta presso i Centri de "La Nostra Famiglia" su 1.730 bambini con pluridisabilitŕ, che rappresentano il 32% dei soggetti assistiti in quest'arco di tempo. La prassi comprende momenti diversi destinati ai singoli interlocutori: il bambino, la famiglia e gli operatori. Sulla scorta degli insegnamenti del prof. Giorgio Moretti, a ciascuno di questi interlocutori viene destinato un approccio "valorizzante": per il bambino si tratta di mettere in atto un processo conoscitivo riguardante le potenzialitŕ residue e i bisogni prevalenti; per i genitori si attuano interventi educativi destinati a far loro comprendere la realtŕ del figlio, superando gli atteggiamenti di negazione o iperprotezione a favore di un'accettazione rispettosa dei limiti esistenti; per gli operatori si organizza una costante attivitŕ formativa destinata a renderli capaci di formulare per i propri assistiti progetti esistenziali e di comunicare con i genitori in modo tale da stabilire con loro un rapporto di reciproca fiducia.

AbstractAlthough the use of telluric lines as wavelength fiducials to measure radial velocities does not achieve as high a precision as other fiducial-imposition techniques, this very convenient technique can be used concurrently with other observing programs to increase the temporal sampling of target stars. We have been carrying out a program to monitor the line-profile variations of early-type non-radial pulsators at the Hα and He I 667.8-nm region. With the rather modest reciprocal dispersion of 1nm/mm and the use of a 4096-element CCD, the telluric lines in the 630-nm region are also available in the observed spectra. We decided to use these telluric lines as wavelength fiducials to monitor bright, latetype stars for radial-velocity variations. As an experiment, we have also decided to reduce the spectra using available simple IRAF tasks to see how high a velocity precision can be achieved with only minor tweaking. The precision certainly would not rival other precise techniques, but the convenience in both the observing and reduction procedure may enable more target stars to be monitored by more observers. Moreover, interesting results can still be obtained with a mere 100 m/s precision. The result for a few late-type stars which also have prior HF velocities will be presented.

Abstract: The intention to communicate builds the architecture of intersubjectivity that involves the staging of the individualistic world of the subject. The mutual intentionality and awareness are present in the communication process in which the communicative intention of the broadcaster becomes mutual and shared knowledge. Trust is hardly declared; it is usually learned from the regularity of the communicative exchange actions that take place in the meetings. It can be distinguished between personal commitments and anonymous commitments. The former concern relationships of trust supported by or expressed in social ties established in circumstances of coexistence. The assumption of trust is also generalized for meetings with strangers in public places and also for virtual meetings on social networks. The predominant situation of modernity is the pluralist position: man as a social animal prefers to share agreement more than disagreement. Pluralism undermines false assurances in favour of uniform but also reasoned social consensus. We will focus on dialogue because trust is important in meeting people who have to decide and make agreements. Therefore, taking into account the generalization of the fiduciary relationship in dialogue, two ‘theories’ will be considered: that of Bohm (On dialogue) and that of Moscovici and Doise (on Consent and dissent). Dialogue, especially in business meetings, must be identified with the 'politics of dialogue'. Trust is assumed in every initial meeting in which a perception of "established trustworthiness" is implemented. We are in an era of democracy in which the need for choice and dialogue is strong: in Bohm's dialogue there are rules that serve to move forward by listening, discussing, deciding nothing, suspending judgment and for this very reason new ideas and hypotheses have always the chance to emerge. Il capitolo analizza come la collusione di un'impresa con la criminalità orga-nizzata comprometta il rapporto fiduciario tra datore di lavoro e lavoratore. Il tradimento della fiducia, causato dal vincolo mafioso, avviene sotto molteplici profili e con conseguenze differenti, anche a seconda del grado di consapevolezza e del ruolo del dipendente nell'organizzazione aziendale. Fin dall'origine della criminali-tà organizzata, la recluta di lavoratori e la loro gestione è stata alla base del consenso sociale che ha consentito alle organizzazioni mafiose di espandersi. Il rap-porto tra lavoratori e datori di lavoro è divenuto più articolato a seguito della costituzione di imprese a partecipazione mafiosa e con il coinvolgimento sistematico dei professionisti. Tali trasformazioni hanno rafforzato dei rapporti di apparente fiducia e reciproco interesse.

Centuries ago, when land represented the majority of wealth, the trust was used primarily for holding and transferring real property. As the dominant form of wealth moved away from family land, the trust evolved into a device for managing financial assets. With this transformation came the use of exculpatory clauses by both amateur and professional trustees, providing an avenue for these fiduciaries to escape liability for designated acts. With the use of exculpatory provisions, discussion abounded about whether fiduciary duties were mandatory or subject to modification. The latter view eventually prevailed, with the majority of jurisdictions viewing fiduciary duties as default rules; that is, part of a private agreement around which the parties are free to contract. Contracting around fiduciary duties is of particular concern when a lawyer suggests himself for a fiduciary role and inserts an exculpatory clause into the governing instrument. Although the lawyer is subject to applicable legal ethics rules, such as those which govern communications and conflicts of interest, this contractarian view of the attorney-client relationship is less than ideal, especially when lawyers and non-lawyer professionals are involved in a reciprocal referral agreement. During the recent revisions to the UPC, mandates relating to the default nature of fiduciary duties were not addressed. Perhaps this was because the matter was outside the scope of the revisionists' review, or perhaps the drafters of the revisions were comfortable with the recent position the Uniform Trust Code and the Restatement of Trusts have taken on exculpatory clauses. However the UPC revisions should have addressed this matter with specificity. Given public policy concerns, client protection, fiduciary responsibilities, and the professional responsibility of lawyers, it may be that the standard of prudence should not be abandoned so easily.

La comunicazione della verità al paziente assume il carattere di un caso paradigmatico per il coinvolgimento sia del teologo moralista sia del medico, a livello di riflessione teoretica e di prassi. Nella prospettiva di un possibile dialogo interdisciplinare, l'autore, in questa seconda parte, traccia le linee per una miglior comprensione del rapporto tra medico e paziente in termini di alleanza, basata sulla fiducia e il rispetto reciproci. Tale contesto di fedeltà rende possibile una relazione e comunicazione autentiche, seguendo un cammino di gradualità che conduce il malato verso la piena verità sulla sua condizione. La veracità del medico saprà assumersi tale responsabilità valutando il senso delle singole affermazioni e dei silenzi, nelle diverse circostanze e situazioni, per il rispetto della dignità del paziente e della stessa professione medica.

Lacewings exist in insecticide-dominant cropping systems. They are prime biological control agents due to outstanding ability of insecticide resistance development. This study examines occurrence of methoxyfenozide resistance and its subsequent effects on cross-resistance to other insecticides, inheritance and mechanism of resistance in C. carnea. Methoxy-SEL strain of C. carnea selected for 15 generations developed 3531.67-fold resistance to methoxyfenozide. Overlapping fiducial limits of LC50s of F1 and F1’ (reciprocal crosses) suggested an autosomal and incompletely dominant mode of inheritance. Resistance to methoxyfenozide was polygenic and its realized heritability value was high (h2 = 0.62). Both PBO and DEF significantly changed LC50s indicating cytochrome P450-dependent monooxygenases and esterases detoxifying the resistance in Methoxy-SEL strain. Resistance to all tested insecticide was unstable but decrease rate was very negligible. These results have implications forpreservation of biological control and effective use in insecticide-dominant cropping systems.

En este artículo propongo una justificación de la democracia, y de la autoridad política derivada de ella, a partir del ideal republicano de libertad como no-dominación. Argumento que los procedimientos democráticos tienen valor por sí mismos porque son mecanismos de decisión donde hay libertad de forma recíproca. Después muestro que la autoridad debe ser adecuadamente controlada para evitar que exista dominación, razón por la cual tiene que concebirse como una relación fiduciaria, en la que los gobernantes actúan como agentes de la ciudadanía. Finalmente, establezco la necesidad de que los gobernantes cumplan con deberes fiduciarios y que los ciudadanos desarrollen virtudes cívicas. In this article I propose a justification of democracy, and of the political authority derived from it, based on the republican ideal of freedom as non-domination. I argue that democratic procedures have value in themselves because they are decision-making mechanisms where there is freedom on a reciprocal basis. I then show that political authority must be adequately controlled in order to avoid the existence of domination. This is why it must be conceived as a fiduciary relationship, in which the rulers act as agents of the citizenry. Finally, I establish the need for rulers to comply with fiduciary duties and for citizens to develop civic virtues.

In una società dove, da più parti, la famiglia è sotto attacco, occorre creare una cultura della famiglia che sia anche per la famiglia. La tendenza a identificare con la famiglia qualsiasi aggregazione di individui, a prescindere dal sesso o dal vincolo che li tiene uniti, produce uno scossone semantico destinato a danneggiare non soltanto la famiglia ma l’intera società. Nonostante i cambiamenti che abbiamo registrato in questi ultimi anni, la famiglia tradizionale continua a essere l’istituzione sociale che più di altre incide sulla formazione delle persone e che più di altre è capace di generare quei capitali individuali e sociali —la fiducia reciproca, il senso del bene comune, la speranza nel futuro, il senso di appartenenza a una catena generazionale, quindi a una tradizione, lo sviluppo di una vera democrazia—, senza i quali è assai difficile immaginare una società degna del nome.In a society where the family suffers attacks from many different sides, a culture of the family is needed that will be also for the family. The tendency of identifying as a family any aggregate of individuals regardless of their sex or of the link that joins them, gives rise to a semantic chaos, which not only hurts the family but society also. In spite of the changes of the last few years, traditional family is still the social institution with more influence on the formation of persons, and the most able to generate individual and social capitals –mutual trust, a shared understanding of common good, hope for the future, the sense of belonging to a generational line or tradition, the development of a true democracy– the lack of which makes it very hard to conceive (the idea of) a society worthy of that name.

The European Arrest Warrant (EAW) represents the first instrument based on the principle of mutual recognition in criminal matters. Its approval aimed expressly at replacing the lengthy extradition procedures that existed among European countries, in order to achieve a more effective cross-border judicial surrender procedure. According to the statistics concerning the use of the EAW, this goal has been accomplished. Anyway, its great success has risen many issues concerning the correct balance between freedom and security. From this perspective, this PhD Thesis analyses the Framework Decision 2002/584/GAI, the Italian implementation law, as well as the most significant judgments of the Italian Supreme Court and of the European Court of Justice. In the last chapter, the Author focuses on the related problem consisting in the excessive use of the EAW, suggesting the introduction of a proportionality test – led by the issuing judicial authority as well as by the executing one – which could represent a suitable path to reach a balance between repressive needs and protection of fundamental rights.

L’ordine europeo di indagine penale, introdotto dalla direttiva 2014/41/UE, è uno strumento di cooperazione giudiziaria nel settore delle prove divenuto imprescindibile a fronte della crescente dimensione transnazionale assunta dalla criminalità, quale conseguenza dell’evaporazione dei confini geografici nello Spazio di libertà, sicurezza e giustizia dell’Unione europea. La direttiva sovranazionale, recepita nell’ordinamento italiano attraverso il d.lgs. n. 108 del 2017, ha dato vita a un istituto avente natura ibrida, animato dal principio del reciproco riconoscimento, che conserva, al contempo, alcuni tratti tipici della mutua assistenza giudiziaria tradizionale, nel tentativo di coniugare l’efficienza investigativa e la tutela delle garanzie fondamentali. Sullo sfondo di un contesto caratterizzato dall’assenza di armonizzazione tra le regole processuali e probatorie nazionali, il meccanismo di acquisizione della prova all’estero ruota attorno al principio di proporzionalità, che prende forma nel giudizio di bilanciamento, da condursi in concreto tenendo conto delle peculiarità del caso, tra le esigenze connesse all’accertamento del reato e il sacrificio imposto ai diritti delle persone a vario titolo coinvolte nelle procedure di emissione ed esecuzione dell’ordine. La presente tesi di dottorato intende fornire un’analisi a trecentosessanta gradi dell’ordine europeo d’indagine, prendendo le mosse dalla disciplina normativa, con l’obiettivo di mettere in luce le principali problematiche emerse nelle sue prime esperienze applicative e individuare soluzioni in grado di accorciare le distanze che separano teoria e prassi. A tal fine, ampio spazio è dedicato alla ricostruzione delle prime pronunce giurisprudenziali rese sul tema dalla Corte di giustizia e dalla Corte di cassazione, che rivelano complessivamente la tendenza a prediligere le istanze di efficienza investigativa a scapito dei diritti della difesa, per poi esporre, in chiave critica, alcuni casi pratici selezionati presso le Procura della Repubblica di Milano e di Monza<br>The European criminal investigation order, introduced by Directive 2014/41/EU, is an instrument of judicial cooperation in the field of evidence, which has become necessary, given the growing transnational dimension of crime as a result of the sublimation of geographical boundaries in the European Union's Area of Freedom, Security and Justice. The supranational directive, implemented by Italian Legislative Decree no. 108 of 2017, has given rise to a construct of hybrid nature, inspired by the principle of mutual recognition, which maintains, at the same time, certain features typical of traditional mutual legal assistance, in an attempt to combine investigative efficiency and protection of fundamental guarantees. In an underlying backdrop still characterized by the absence of harmonization of national procedural and evidentiary rules, the mechanism for adducing evidence in a foreign country revolves around the principle of proportionality, which in turn takes shape in the context of a balancing judgement - to be conducted in the actual case and taking into consideration the specificities of such case - between the needs related to the detection of crime and the sacrifices imposed on the rights of the persons involved, for various reasons, in the procedures aimed at issuing and executing the relevant order. This doctoral thesis intends to provide a comprehensive analysis of the European Investigation Order, beginning with its legal framework, for the purposes of highlighting the main problems that have emerged in its early-stage enforcement and of identifying solutions capable of shorten the gap between theory and practice. To this end, a large space is firstly dedicated to the analysis of the early case-law rendered by the Court of Justice and by the Italian Court of Cassation on this theme, which reveals the overall tendency to prefer purposes of investigatory efficiency to the detriment of defense rights; secondly, this thesis critically evaluates some practical cases selected at the Public Prosecutor's Office of Milan and Monza.

Con riferimento ai temi della fiducia e della destinazione patrimoniale si avverte l’esigenza, sul piano scientifico, di una sistemazione idonea ad individuare i principi e gli elementi strutturali delle diverse fattispecie. Il sintagma “proprietà fiduciaria” evoca una pluralità di istituti che, ancorché in larga parte omogenei sul piano degli effetti economici e degli interessi concreti, risultano fortemente differenziati nella elaborazione dogmatica e in talune schematizzazioni teoriche. L’innegabile diversa origine degli istituti e la non totale omologazione sul piano effettuale non impediscono però di apprezzare un dato che è, al tempo stesso, sia storico sia evolutivo. Se le differenti culture hanno portato alla creazione di variegati modelli di proprietà nell’interesse altrui, occorre sottolineare come siano in parte comuni gli interessi protetti e gli ingredienti giuridici che ne costituiscono le basi concettuali. Ciò ha reso possibile la contaminazione degli istituti e la creazione di flussi giuridici, di fenomeni di metabolizzazione e reciproca integrazione delle soluzioni normative ed interpretative. Tali generali esigenze di sistemazione hanno portato ad elaborare e sviluppare, nell’ambito del Dipartimento di Scienze Giuridiche dell’Università di Bologna, il progetto di ricerca “Destinazione patrimoniale e causa fiduciaria: un approccio interdisciplinare per una prospettiva ricostruttiva unitaria” conclusosi con il Convegno “Fiducia e destinazione patrimoniale” (2 e 9 ottobre 2020). Nel volume sono raccolte le relazioni presentate al Convegno e rielaborate dagli Autori in forma di articoli.
