Fiduciary is the transfer of ownership rights of an object on the basis of trust provided thatthe object whose ownership rights are transferred remains in the possession of the owner ofthe object. Whereas what is meant by Fiduciary Guarantee is the guarantee right for movableobjects both tangible and intangible and immovable objects, especially buildings that cannotbe burdened with mortgages, which remain in the control of the Fiduciary Giver, as certaindebt repayment collateral that gives priority position to Fiduciary Recipients against othercreditors. Items loaded with a Fiduciary Guarantee must be registered. Registration for aFiduciary Guarantee is carried out at the Fiduciary Registration Office. However, if theregistration of Fiduciary Guarantee to be registered with the Office of Fiduciary Registrationis a matter of property that has not been shared with the former creditor's wife against thevehicle due to divorce, it can be said that the agreement can be canceled, so there is no legalcertainty for the recipient of Fiduciary Guarantee. If the Fiduciary Registration Office issuesand submits a Fiduciary Guarantee Certificate to the Fiduciary Recipient on the date that isthe same as the date of receipt of the application for registration. This Fiduciary GuaranteeCertificate is a copy of the Fiduciary Register Book. By obtaining a Fiduciary Guaranteecertificate, the creditor or fiduciary guarantee recipient immediately has the right of directexecution (parate execution). One of the features of the fiduciary guarantee is the executorial nature of the fiduciary guarantee on the fiduciary guarantee certificate. To obtain these rights, the guarantee must be registered with the Fiduciary Guarantee Registration Office. But in its implementation, there are still many fiduciary guarantees that are not registered with the Fiduciary Registration Office. This study analyzes the legal consequences of fiduciary guarantees that are not registered and legal protection to creditors if the Fiduciary deed is not registered. The research method used is normative legal research, namely legal research conducted by examining library materials or secondary legal material while the problem approach is carried out using a legal approach and conceptual approach. The results of the study show that the legal consequences of fiduciary guarantee deeds, which have no legal force at all in carrying out executions and against objects of fiduciary guarantee do not give birth to material rights inherent in fiduciary guarantees. As a result of not registering a fiduciary deed, there is no legal protection at all for creditors

Abstract:
Fiduciary is the transfer of ownership rights of an object based on trust, where ownership right of the object is transferred remains under the control of the owner of the object. The subject of the research was how to bind the object of fiduciary guarantee according to Law Number 42 of 1999 on fiduciary? What are the consequences if the binding of fiduciary guarantee object is unfulfilled? This research was normative legal research which means that the objects are secondary data on library. The type of the research was descriptive. It can be concluded that the binding of fiduciary guarantee object according to Law Number 42 of 1999 on fiduciary guarantee is certificate of fiduciary guarantee as an evidence which is an authentic deed. It can be seen from the characteristics of certificate fiduciary guarantee, issued by an authorized official or public official who has authority for issuing certificate fiduciary guarantee in Fiduciary Registration Office under the supervision of the Ministry of Law and Human Rights. The consequences (the binding of fiduciary guarantee object is unfulfilled) are the default causes several legal consequences for debtors and creditors, especially for creditors who must loss. While for debtors, the legal consequence is the existence of a new status for which the debtor must responsible of. Fiduciary guarantee, mostly in form of movable objects, allows for a transfer of fiduciary guarantee; one example of the reason for the transfer is the debtor wants to transfer his credit to another creditor to seek for lower interest. Then, if a debtor has paid off the debt, it can cause the fiduciary guarantee to be canceled.

The result of the research is that the Government should immediately establish the Supervisory Agency and Execution of Fiduciary Guarantee Objects based on Government Regulation in Lieu of Law and other legislation.

Abstract:
As a result of a Fiduciary Guarantee that is not made a fiduciary certificate or in authentic form before a Notary Public, the Fiduciary Guarantee object has no immediate execution rights. When there is default or congestion from the consumer, the financial institution cannot execute the object of the guarantee. Financial institutions actually execute unilaterally without going through relevant government agencies and based on applicable laws. The making of a fiduciary deed by a notary is carried out through two stages in accordance with Law Number 42 of 1999 Concerning fiduciary guarantees, namely through the stages of loading and registration. Charges with fiduciary guarantees are made with a notarial deed, the notary is required to make a fiduciary guarantee deed by taking into account the procedure for loading, loading fees and the period of loading. After the fiduciary guarantee deed has been signed by the parties concerned, after that the registration of the fiduciary deed will be registered at the fiduciary registration office. As a result, the strength of the fiduciary deed made by a notary setting the position of the fiduciary deed and the role of the notary in making fiduciary deed. 1) Law Number 42 of 1999 concerning Fiduciary Guarantee states that the person authorized to make a Fiduciary Deed is a notary, while Article 17 of Law Number 2 of 2014 amendments to Law Number 30 of 2004 concerning Notary Position stipulates that the Notary Public is only authorized to make an authentic deed in the jurisdiction or jurisdiction.Obstacles in the settlement of bad debts, namely the existence of resistance by the debtor against the execution auction plan that does not have a clear legal basis, because it is only based on unilateral recognition without proof or acknowledgment from the Debtor. Because legally the position of the debtor as the creditor holding the Fiduciary Guarantee is already strong, because all the guarantee documents are notarized and based on the law, the document is an authentic deed that has perfect proofing power before the judge.

The result of the research showed that if not created by notariil and registered office at Fiduciary, then their execution procedures can only be done with the setting of the ruling of the District Court. Procedures and procedures binding guarantee of fiduciary fiduciary registration procedures on Fiduciary Office, are not set or are not found in detail in the Law Number 42 Year 1999.

Abstract:
The purpose of this article is to discuss the meaning of material rights in fiduciary security in the perspective of Law Number 42 of 1999 concerning Fiduciary Security. The research method used is document review with the Statute Approach approach to fiduciary legislation as primary legal material, as well as various secondary legal materials such as the results of fiduciary scientific studies and literature reference materials about fiduciary. The analysis used is Content Analysis of articles related to fiduciary law. The results showed that the meaning of property rights in nature is always attached to the owner. On the other hand, according to customary law, the meaning of property rights is essentially communal/collective (family/community) as the basis for their rights, both for movable or immovable objects in their possession. Essentially fiduciary property rights are handed over from the debtor's hands to the creditor, with a belief that the property rights will be handed over again if the debtor has paid off his debts, but in the process of surrender, control and his debts often cause legal problems, even though the Fiduciary Guarantee Institute has been formed. The conclusion that the meaning of material rights in fiduciary security lies in the matter of 'Delivery' and 'Mastery' of the items guaranteed.

Before the birth of the Fiduciary Guarantee Law (UUJF), the issue of fiduciary security registration was not an obligation, but with the birth of the UUJF, registration of fiduciary guarantees was a very crucial stage and had an impact on many aspects of the following law. Such explanation is also recognized in the General Elucidation of UUJF that one of the reasons fiduciary guarantees does not provide legal certainty, especially to fiduciary recipients, one of which is because the fiduciary guarantee is not registered. The fulfillment of the principle of publicity in fiduciary security is carried out by registering fiduciary security at the Fiduciary Registration Office. Regarding the request, the registration office will record the guarantee in the Fiduciary Register Book and will issue a Fiduciary Guarantee Certificate which has the order for Justice Based on Almighty God. The normalization of fiduciary security registration in UUJF is a legal norm that is compelling (dwingend recht). This can be seen through two aspects, namely the use of the word mandatory in UUJF as a command norm, and from the aspect of the legal principle of objects which are closed, so that the norm cannot be deviated. With regard to fiduciary security that is not registered, the creditor as the recipient of fiduciary does not receive the rights and benefits specified in the UUJF, including material rights, priority rights, executive rights, and application of criminal provisions.

The paper analyzes fiduciary alienation in Brazilian law and its mechanisms of enforcement at the disposal of the parties that conclude this type of contract. After passing through the definitions of fiduciary business, fiduciary property, and fiduciary alienation, the paper presents the current panorama of Brazilian legislation on the issue, briefly enunciating the statutes in effect and the type of fiduciary alienation each one of them covers. In the third and fourth chapters, one describes the possible reliefs to enforce the guarantee of movable assets and real property, whether judicial or extra-judicial, by the fiduciary-creditor or even by the fiduciary-debtor, which can also resort to reliefs to protect itself from wrongful use by the creditor or third parties. These two chapters conclude with a description of the general panorama of these reliefs for the fiduciary alienation of immovable assets and real property. In the fifth chapter, the thesis deals with a few current issues in which consensus cannot be found among authorities or in case law, to which one aims to suggest solutions appropriate to positive law and to its regulating principles. In the sixth and final chapter, one points to the difficulties in the interpretation and application of the fiduciary business due to a lack of homogeneous regulation, specific to this doctrine. Finally, the thesis draws a conclusion about the application of the current norms and, lastly, suggests regulation for the doctrine
O trabalho analisa a alienação fiduciária em garantia do direito brasileiro e os seus mecanismos de efetivação, postos à disposição das partes que celebram essa modalidade de contrato. Após passar pelas definições de negócio fiduciário, propriedade fiduciária e alienação fiduciária em garantia, o trabalho expõe a atual configuração da legislação brasileira sobre o tema, enunciando, de forma breve, as leis em vigor e a modalidade da alienação fiduciária de que cada uma se ocupa. No terceiro e quarto capítulos descrevem-se as medidas cabíveis para a efetivação da garantia de bens móveis e de bens imóveis, sejam extrajudiciais ou judiciais, pelo credor-fiduciário ou mesmo pelo devedor-fiduciante, que também pode se valer de medidas para tutelar-se de abusos, do credor ou de terceiros. Esses dois capítulos são encerrados com a descrição do panorama geral dessas medidas, para a alienação fiduciária de bens móveis e imóveis. No quinto capítulo, o trabalho aborda algumas questões correntes, que não encontram uniformidade de entendimento na doutrina ou na jurisprudência, para as quais se pretende apontar soluções adequadas ao direito positivo e aos princípios reguladores dele. This study has the purpose of analyzing the possibility of constituting fiduciary alienation over farming products as guarantee to the financing of the Brazilian agribusiness. For this purpose, we have divided this paper in three big parties. Firstly, in order to contextualize this study, we have mentioned brief considerations about the Brazilian agribusiness, its importance to the country and to the world, and indicated an overview about the public and private financing of the activities related to the agribusiness sector. Also as a background to reach the purpose of this study, we have established in the second chapter some notions about the historical origin of the fiduciary alienation and, further, we highlighted the types of fiduciary alienation as guarantee, its legal bases and requirements, as well as we pointed out the main advantages of the fiduciary alienation as guarantee before pledge and mortgage. After this important part of contextualization, the research follows in the last chapter with a detailed analysis of the doctrinaire and jurisprudential understandings consolidated in the 1990s and until today applicable, regarding the supposed impossibility of fiduciary alienation of fungible, consumable and alienable (in stock) movable goods, as it would be the case of the farming products. After that, we propose a reanalysis of such understanding, mainly based on the legislative evolution of the fiduciary alienation as guarantee in the Brazilian legal system in the last decades and on new jurisprudence about the issue, to then defend the possibility of the fiduciary alienation over fungible, consumable and alienable movable goods. Finally, we highlight existing peculiarities and special legislation about the fiduciary alienation of farming products and we conclude that is possible the constitution of fiduciary alienation as guarantee over farming products to the financing of the agribusiness, both when those products are fungible, consumable and alienable (in stock), and in case such farming products are duly individualized, thus, they have become not fungible products
O presente trabalho tem por objetivo analisar a possibilidade de constituição de alienação fiduciária sobre produtos agropecuários, como garantia para o financiamento do agronegócio brasileiro. Para tanto, dividimos a dissertação em três grandes partes. Primeiramente, de forma a contextualizar o estudo, tecemos breves considerações sobre o agronegócio brasileiro, sua importância para o país e para o mundo, e traçamos um panorama geral sobre o financiamento público e privado das atividades relacionadas ao agronegócio. Ainda como pano de fundo para se atingir o objetivo deste trabalho, trazemos, no segundo capítulo, noções sobre a origem histórica da alienação fiduciária, para depois destacar as modalidades de alienação fiduciária em garantia, suas bases e requisitos legais, bem como as principais vantagens da alienação fiduciária em garantia frente ao penhor e à hipoteca. Após esta importante fase de contextualização, a pesquisa segue, no último capítulo, com análise detalhada acerca dos entendimentos doutrinário e jurisprudencial consolidados em meados de 1990 e até hoje aplicados, quanto à suposta impossibilidade de garantia fiduciária de bens móveis fungíveis, consumíveis e comerciáveis ou de estoque, como seria o caso dos produtos agropecuários. Em seguida, propomos uma reanálise de tais entendimentos, principalmente com base na evolução legislativa da alienação fiduciária em garantia no ordenamento jurídico brasileiro nas últimas décadas e em nova jurisprudência sobre o assunto, para depois defender a possibilidade da alienação fiduciária sobre bens móveis fungíveis, consumíveis e comerciáveis. Por fim, destacamos peculiaridades e legislação especial existentes sobre alienação fiduciária de produtos agropecuários e concluímos pela possibilidade de constituição de garantia fiduciária de produtos agropecuários para financiamento do agronegócio, tanto quando tais produtos forem fungíveis, consumíveis e comerciáveis ou de estoque, quanto no caso em que os produtos agropecuários estiverem devidamente individualizados e, por isso, terem se tornado produtos infungíveis

O presente trabalho versa sobre os financiamentos imobiliários e os seus custos, tanto econômicos como transacionais, atrelados às espécies de garantias constituídas. O estudo fez uma análise econômica e jurídica sobre os negócios aquisitivos de domínio imobiliário e suas formalidades juntamente com o modo de aquisição e constituição dos direitos reais, com a particularidade do Sistema Notarial e Registral Brasileiro. Abordou-se o contrato em sua acepção mais ampla, em especial sob o enfoque dos custos atrelados aos financiamentos de imóveis. Fez-se uma revisão bibliográfica que apontou, segundo especialistas, que quanto maior a segurança jurídica dos negócios menores serão seus custos, tanto econômicos como de transação ou transacionais. A pesquisa empírica realizada coletou informações de matrículas que continham financiamentos imobiliários garantidos por hipoteca e alienação fiduciária, extraindo delas informações sobre o valor do crédito financiado, o prazo desse financiamento e o montante de juros fixados pela instituição financeira. Fazendo uma releitura da hipoteca e alienação fiduciária, garantias imobiliárias mais utilizadas no Brasil, buscou-se compatibilizar os custos associados a estas e a segurança que estaria atrelada, implicando custos maiores ou menores a depender da eficiência da garantia, já que a maior probabilidade do agente financeiro resgatar as quantias repassadas ao devedor indicaria menor taxa de juros associada. O plano de fundo do estudo associa o maior grau de segurança aos menores custos atrelados, buscando fomentar assim transações imobiliárias mais eficientes.
This paper reports on real estate financing and its costs, both economic and transactional, both economic as transactional, tied to the kinds of collateral security. The study made an economic and legal analysis on the purchasing of real estate business, its formalities and along with the acquisition and establishment of rights in rem, with the particularity of the Notary and Registry System. Addressed the contract in your broader meaning, in particular under the focus of the costs linked to financing of real estate. A literature review which aimed, according to experts, the greater the certainty of smaller business are its costs as much as economic transaction, transactional. The empirical research conducted collected information of license plates that contained mortgages secured by mortgage and chattel mortgage, extracting them information about the value of credit financed, the term of this funding and the amount fixed interest by the financial institution. Doing a rereading of the mortgage and chattel mortgage, real estate guarantees more used in Brazil, sought to reconcile the costs associated with these and that security would be tied, implying higher costs or smaller depending on the efficiency of the warranty, since the highest probability of financial agent rescue the amounts transferred to the debtor would indicate less interest rate. The background of the study combines the highest degree of security to lower costs, seeking to foment so real estate transactions more efficient.

After twelve years since the approval of the Law of Real Estate Financing System (9,514/97) many controversial issues remain, either in doctrine or in case law, regarding the contractual form that established the new in rem guarantee right, extending the fiduciary property to real estates. The purpose of this thesis is to examine the main aspects of the fiduciary assignment for the guarantee of real estates, in order to improve the understanding of the concept of such institute. The prospect adopted is the comparative law, analyzing the origin of fiduciary business by means of the fiducia of Roman law, the pledge of Germanic law, the trust of Anglo-Saxon law, the use of atypical fiduciary business in modern law by countries with Roman tradition and, finally, the institute as regulated in Brazilian law. The main conclusions appoint the unique character of the fiduciary assignment adopted by the Brazilian legislation, despite the undeniable influence of foreign law, indicating the solution for controversial questions regarding the institute, its finalities and consequences. It concludes for the constitutionality of the procedure for extrajudicial execution established by the law under discussion, its compability with standards of the Code of Consumer Protection, and the impossibility of determining the civil prision of fiduciant, because of the recent case-law in the Supreme Court Federal and Superior Court of Justice
Decorridos doze anos da aprovação da Lei do Sistema Financeiro Imobiliário (9.514/97) ainda há muitas controvérsias, tanto na doutrina como na jurisprudência, sobre a modalidade contratual instituidora do novo direito real de garantia, estendendo a propriedade fiduciária aos bens imóveis. Este trabalho pretende examinar os principais aspectos da alienação fiduciária em garantia de bem imóvel, com o objetivo de melhor compreender o conceito desse instituto. A perspectiva adotada é a do direito comparado, analisando-se a origem dos negócios fiduciários através da fidúcia do direito romano, do penhor do direito germânico, do trust no direito anglo-saxônico, da utilização de negócios fiduciários atípicos no direito moderno pelos países de tradição romanista e, por fim, o instituto positivado no direito brasileiro. As principais conclusões apontam para o caráter singular da alienação fiduciária adotada pela legislação brasileira, apesar das inegáveis influências do direito estrangeiro, indicando-se a solução para as questões controvertidas de maior relevância envolvendo o instituto, suas finalidades e consequências. Conclui-se pela constitucionalidade do procedimento de execução extrajudicial previsto na legislação em comento, sua compatibilidade com normas do Código de Defesa do Consumidor, e pela impossibilidade de se determinar a prisão civil do fiduciante, em razão da recente jurisprudência pacificada no âmbito do Supremo Tribunal Federal e do Superior Tribunal de Justiça

A utilização da propriedade com função garantística tem configurado, na sociedade moderna, um relevante mecanismo de concessão de crédito. Partindo desta premissa e da importância prática que assume no comércio jurídico atual, a presente dissertação versa sobre a alienação fiduciária em garantia enquanto figura geral, tendo em vista a análise da sua configuração nos termos do direito vigente, por forma a realizar um estudo suscetível de servir de base à sua positivação de iure condendo. Para tanto, procuramos demonstrar que se trata de um instituto lícito e idóneo para garantir um crédito, que assume contornos que se poderão afigurar favoráveis a ambos os contraentes. Não será, no entanto, de ignorar que se o negócio não respeitar determinados requisitos, designadamente formais, poderá contender com a segurança do tráfego jurídico e com a tutela do fiduciante. Concluímos pela admissibilidade desta figura à luz do direito português, na medida em que não fere princípios do Direito Civil. Assim, consideramos ser necessária uma regulamentação normativa que atenue o caráter fiduciário do negócio, por forma a diminuir os riscos ínsitos à prestação da garantia pelo devedor e que, do mesmo modo, seja apta a assegurar um dos princípios fundamentais de um sistema de Direito: a segurança do tráfego jurídico.
The use of the property with a guarantee function has, in modern society, configured a relevant mechanism for granting credit. Based on this premise and the practical importance it assumes in the current legal trade, this dissertation will adress the fiduciary alienation in guarantee as a general figure, in order to analyse of its configuration under the terms of the current civil law, so as to carry out a study susceptible of serve as the basis for its positivation de iure condendo. Thus, we seek to demonstrate that this is a lawful and suitable institute to ensure a credit, which takes on contours that may appear favorable to both parties. However, it should not be forgotten that if the legal business does not comply with certain requirements, specially formal requirements, it may have to contend with the security of the legal traffic and with the guardianship of the trustor. We conclude by the admissibility of this figure in the light of Portuguese law, insofar as it does not violate principles of Civil Law. Therefore, we consider that regulatory legislation is necessary to mitigate the fiduciary nature of the business, in order to reduce the risks related to the provision of the guarantee by the debtor, and, by the same token, is capable of ensuring one of the fundamental principles of a system of law: the safety of legal traffic.

Alienation Guarantee is a type of transferred secured right, and the propose of Alienation Guarantee is to secure the obligation between creditor and debtor. Besides, the rise of Alienation Guarantee is because the typical secured rights could not react the rapid demand of the market, and it has been admitted by German and Japan not only in theory but also in judicial practice.   In order to make up for the insufficiency of movable property function, practice of German mainly adopts Alienation Guarantee on movable property. However, judicial practice of Taiwan consider all transferable property could be the subject of Alienation Guarantee, its still mainly be adopted on the secured of real property.   Although Alienation Guarantee of real property is recognized by theory and judicial practice in Taiwan, there is no related regulation. Moreover, Alienation Guarantee of real property copies the concept of Trust Institution, which seems to be necessary. However, Trust Law only enacts managed trust and missed secured trust yet creates unnecessary concerns. As mentioned, the propose of Alienation Guarantee of real property is to secure the obligation, perhaps the best way is to enact related regulation. On the other hand, we could add secured trust to Trust Law. As a matter of fact, it could constitute a complete trust system and enhance legal basis through enact related regulation.   The exploration of Alienation Guarantee of movable property is much less than real property in Taiwan because of booming secured regulation for movable property. The current related regulation to secure transaction for movable property are Pledge of Personal Property in Civil Code, Personal Property Secured Transactions Act, and recently proposed Secured Enterprise Property Act (draft). The regulations not only improve previous regulations but also satisfy the needs of international commerce and modern enterprise. Furthermore, Secured Enterprise Property Act (draft) develops Floating Charge System, which is necessary and appropriate for nowadays. Although because of Rights In Rem Subject Specificity Doctrine, there have doubts on this issue. In conclusion, the proposed suggestion on the issue of this thesis is to refer classification and specificity of Alienation Guarantee of movable property from German, thus to make sure the scope of Floating Charge will still follow Rights In Rem Subject Specificity Doctrine.

Security trust, for the purpose to protect the rights of the Creditor, is widely used. Before our trust law has not yet developed, we depended on the judgment of judicial practice to establish a framework of security trust. However, it seems the concept of “security trust” described by our justice is the “alienation guarantee”. After the development of Trust Law, it is necessary to investigate the nature of the security trust. The real estate alienation guarantee is a type of security of real rights law, which has a long history in abroad and most scholars and practitioners recognize its existence. However, there is lack of law to expressly provide whether it is suitable for the national conditions and practice of Taiwan. Therefore, whether it is necessary to legislate shall be studied and discussed further, which is also the purpose of the paper. The paper starts from introducing the security trust and alienation guarantee. Since our trust law succeeds from Japan, the paper tries to analysis treaties and statistics to search our problems of the rule application of Taiwan. Wish that the conclusion provides foundation of the legislation of Taiwan.

Real rights for security have diversity in theory; Parties have a flexible space in the use of real rights for security. Alienation guarantee includes alienation guarantee for movable and immovable properties. For movables security, many scholars believe that the Personal Property Secured Transactions Act shall be applied for. Therefore, only the Real Estate alienation guarantee is discussed in this thesis. The real estate alienation guarantee is a type of security of real rights law, which has a long history in abroad and most scholars and practitioners recognize its existence.However, there is lack of law to expressly provide whether it is suitable for the national conditions and practice of the R.O.C.. Therefore, whether it is necessary to legislate shall be studied and discussed further, which is surely the purpose of the study. In real estate practice, there are some types of security similar to real estate alienation guarantee, such as traditional sale security, buy-back, as well as the newly emerging finance lease in recent years, trust to the same person after mortgage, warranty trust, mortgage guarantee, etc. However, the current laws of the R.O.C are too old to cope with the related problems. Thereby some scholars advocate the theory of alienation guarantee in order to apply and to solve legal problems. So the study and exploration of this thesis focus on real estate registration practice. The thesis is organized as follows: (a) the first chapter explains the motivation, purpose, scope and approach of the study on real estate alienation guarantee; (b) the second chapter introduces the origin, evolution and relevant theories of real estate alienation guarantee so as to learn the current development situation of traditional real estate alienation guarantee; (c) the third chapter sorts out the newly emerging types in real estate practice in recent years, elaborates their social situation, properties and theoretical disputes, analyzes their characteristics and compares with the real estate alienation guarantee mentioned in former chapter, in order to observe whether the real estate alienation guarantee can be referred in some aspects; (d) the fourth chapter firstly discusses the existing problems and the relevant expedient solving measures before the legislation of real estate alienation guarantee. Then it states the direction of legislation of real estate alienation guarantee which scholars planned. And for possible problems arising from real estate registration practice after legislation, it explores suitable supporting measures to facilitate the real estate registration practice; (e) the fifth chapter sums up experiences and ideas originating from the aforesaid comparison and application and puts forward suggestions, hoping to get effects of “throw out a brick to attract a jade” and facilitate the legislation and application of future real estate alienation guarantee.

Abstract:
This chapter describes how linguistic policies have led to the alienation and disenfranchisement of various groups or individuals restricted in their linguistic rights. It starts with a brief tour of linguistic challenges faced by mankind since what is known as the curse of the Tower of Babel. To guarantee cohesiveness and efficiency in a society, some compromising on language standardization, rooted in Max Weber's rationalization theory, becomes an essential part of public policies. Though standardization is appealing, it may have the undesirable consequence of disenfranchising various groups in a society. The chapter discusses both facets and describes various examples of standardization policies, as well as their intended and unintended consequences. It argues that economic advantages of standardization are important, but the threat of survival and the feeling of disenfranchisement by those who face restrictions of their linguistic privileges, deemed to be rights, have to be taken into account. Respecting the will of the people is a necessary condition for any sustainable success of long-range policies in a democratic setting.
