Full textLa literatura ha tratado la recepción, en la filosofía de Hans Kelsen, de la idea de crear una lógica de las normas que pudiera dar cuenta apropiadamente del Derecho como objeto de estudio. Si bien el interés de Kelsen en la lógica es patente desde los 50‘, no se ha explorado la posibilidad de que él tuviese una aproximación previa. Así, con un estudio focalizado en su Habilitationsschrift (1911) y la primera edición de su Teoría Pura del Derecho (1934), esta Memoria sostiene la existencia de dicha aproximación. Para ello, se caracterizará a Kelsen como cercano al neokantismo del Baden, del cual se nutre para formular su dualismo trascendental (Simmel) y metodológico (Windelband y Rickert). Así y en el contexto de la lógica de la época moderna, la aproximación temprana de Kelsen a la lógica está vinculada a la psicología y se encuentra basada en la obra de Windelband y Sigwart. Se evidencia que Kelsen considera estos planteamientos para construir su distinción entre actos de pensamiento y actos de voluntad. Ello se vinculará a la propuesta kelseniana de estudiar el Derecho como un sistema normativo dinámico, especialmente en relación a la actividad judicial. Esto último centrará la investigación en la regla de inferencia deductiva. Esta lectura concluye dos claves interpretativas de la obra revisada de Kelsen, las cuales pueden, además, orientar la comprensión de su obra posterior. La primera es la pretensión de dar cuenta de la naturaleza de las reglas de la lógica dentro del dualismo metodológico sin comprometer la identidad de la ciencia jurídica como disciplina normativa autónoma. La segunda es la comprensión de la actividad judicial como una actividad política y no científica, pues las relaciones lógicas entre las normas jurídicas tendrían un carácter contingente y no necesario.

Full textThe subject of this doctoral thesis is the contemporary relevance of a philosophical model inspired in Kant’s transcendental philosophy. In Chapter 1 I identify two dominant models in the current theoretical landscape, scientific realism and social constructionism, and describe the conflict between them as sterile, in particular in cognitive science and ethics. I then argue for the opportunity of a transcendental model, as an alternative to both and a sound conceptual device for dealing with contemporary issues (technological divide, ecological crisis and globalization). In Chapter 2 I examine the concept of a model, with respect to our representation of the world and of ourselves. I point out the need for philosophy as a peculiar kind of work with models, focused in their representative nature and that challenges basic assumptions of intuitive and scientific models. From a certain level of generality and abstraction on, a philosophical macromodel is a paradigm in Thomas S. Kuhn’s sense. Then I define transcendental philosophy by its emphasis on the crucial link between the philosophical macromodel of reality and the philosophical model of the mind. Chapter 3 summarizes the evolution of Kant’s thought in its dialogical context, from his early works up to the Critique of Pure Reason. My discussion focuses on two crucial and closely related themes in that evolution: 1) the overcoming of the dilemma between Leibniz-Wolff metaphysics on the one hand and Empiricism on the other, that culminates in the Transcendental Deduction of the Categories and the System of Principles of the first Critique, and 2) the attempt to clarify the relation of logic and experience, of formal and transcendental logic, in the Metaphysical Deduction. I place the analysis of both questions in the wider context of two interpretative frameworks: 1) the construal of Kant’s development as the maturation of a Pre-critical Project, an attempt to combine a modified Leibnizian metaphysics with Newtonian science in a coherent worldview, and the departure from that Project leading to critical philosophy; 2) the conception of this critical turn as a philosophical modeling of mind and world, one that resulted in a radical revision of the dominant views on representation and consciousness. In Chapter 4 I describe Kant’s model of the mind in the first Critique as an epigenetic model, according to which cognition emerges from the interplay of two basic faculties, sensibility and understanding. Understanding is a capacity to judge, and includes concept formation and use, subsuming the objects of intuition under those concepts (Judgment) and combining the resulting judgements in syllogisms (Reason). Sensibility is the capacity of receiving sense impressions, which stimulate the understanding’s unifying activity, and of being affected by that activity. Transcendental imagination, the mediating faculty between understanding and sensibility, is the effect of the understanding’s activity on sensibility. It enables the logical forms adopted by this activity to guide the synthesis of the sensible manifold in a way that it can be further analyzed in concepts, and those concepts connected to other concepts in judgements and syllogisms in a system of knowledge. The modeling itself rests on the unique nature of the I of Transcendental Apperception, between phenomenon and noumenon, construed as a suitable object of a reflection on the conditions for the possibility of experience in subjectivity (a philosophical model of the mind), but not a materialist or functionalist model in the sense of contemporary AI. Finally, in Chapter 5 I compare the transcendental model of Chapter 4 with Ernst Cassirer’s Neokantianism, both as a philosophical proposition and an interpretation of Kant’s thought. I argue that the main advantage of the former in both counts is that it preserves Kant’s critical balance between sensibility and understanding, receptivity and activity, and his equally fundamental distinction of logic and experience, formal and transcendental logic. I present this argument against the background of recent discussions about the existence of non-conceptual mental content, and interpretative issues regarding Kant’s position on that matter.

Full textThis text aims to show some of the main issues involved in the Project of The Philosophy of the Symbolic Forms of Ernst Cassirer, name of the work which turns out to be considered as his major contribution to the history of Philosophy. We dealt with epistemological and contextual issues that motivate the elaboration of Cassirers work, its structure and its main methodological postulates to, eventually, understand the results of his proposal, that is, to transform Kants critic of reason in a critic of human culture, understanding by the latter the set of all manifestations of spiritual activity, characterized as a process of self-liberation from the immediacy of life. To do so, we point Cassirers main interlocutors throughout the development of his philosophical project, as well as the philosophical tendencies which the philosopher wants to differentiate his own work from.

O trabalho explica os fundamentos filosóficos do processo de autonomização da Ciência do Direito de Hans Kelsen. Os estudos estão focados no debate acerca da fundamentação epistemológica das Ciências Humanas e em como isto influenciou a Teoria pura do Direito. Os objetivos do trabalho são: a) investigar como o debate oitocentista acerca da fundamentação epistemológica das Ciências Humanas influenciou a formulação da Ciência do Direito kelseniana; b) estudar quais são os pressupostos filosóficos e jurídicos de sua doutrina pura do Direito; c) saber quais teriam sido as contribuições do Mestre de Viena nesta busca pela fundamentação de uma Ciência Direito metodologicamente autônoma das Ciências Naturais. Deste modo, o primeiro Capítulo aborda o Positivismo Filosófico de August Comte e de John Stuart Mill. O segundo Capítulo introduz o movimento do Neokantismo desde Adolf Trendelenburg até o Neokantismo da Escola de Marburg. O terceiro Capítulo trata da Filosofia de Wilhelm Dilthey e de como ele tentou fazer uma “crítica da razão histórica” e fundamentar as Ciências Humanas pelo método compreensivo. Já o quarto Capítulo fala sobre o Neokantismo da Escola de Baden, especialmente o de Heinrich Rickert, momento em que são explicadas a Tese dos mundos e o Princípio da formação de conceitos. O quinto Capítulo trata da formação da tradição do Positivismo Jurídico do século XIX, especialmente a do mundo germânico. E, por fim, o sexto e último Capítulo trata da refutação de Kelsen às Teoria de Gerber, Laband e Jellinek, e também trata dos “dois limites metodológicos” de sua doutrina pura do Direito para que, ao final, possa-se responder que, sim, Kelsen fez da Ciência do Direito uma Ciência Humana, mas não do mesmo modo que Rickert ou os demais filósofos que debateram sobre o tema desde o século XIX fizeram. Kelsen defendia a ideia de uma Ciência do Direito Normativa e Autônoma que pressupõe o postulado do Relativismo axiológico.
The paper explains the philosophical foundations of the process of autonomization of the Hans Kelsen‟s Legal Science. The studies are focused on the debate about the epistemological foundation of the Human Sciences and how this influenced the Pure Theory of Law. The objectives are: a) investigate how the nineteenth-century debate about the epistemological foundation of the Human Sciences influenced the formulation of the kelsenian Legal Science; b) to study what are the legal and philosophical assumptions of the Kelsen‟s Pure Doctrine of Law c) to know what would have been the contributions of the Master of Vienna in this quest for reasons for give autonomy to Legal Science from Natural Sciences. Thus, the first Chapter discusses the Philosophical Positivism of August Comte and John Stuart Mill. The second Chapter introduces the movement of Neo-kantianism since Adolf Trendelenburg until the Marburg School. The third Chapter wants to know about the Philosophy of Wilhelm Dilthey and how He tried to make a "Critique of Historical Reason", as well as reasons for the Human Science comprehensive method. The fourth Chapter talks about the Neo-kantianism of the School of Baden, especially the Heinrich Rickert‟s Philosophy, explaining mainly the Principle of the worlds and The Principle for the concept-formation. The fifth Chapter deals with the formation of the tradition of legal positivism of the nineteenth century, especially the Germanic world. And finally, the sixth and last Chapter deals with the refutation by Kelsen to the Thesis of Gerber, Laband and Jellinek, and also, this finally chapter talks about the "the two methodological limits" of his Pure Doctrine of Law that, in the end, it can respond: yes, Kelsen did the Science of Law as Human Science, but not the same way as Rickert and other philosophers who discussed this topic since the nineteenth century. Kelsen was defending the idea of a Normative and Autonomous Legal Science that presupposes the postulate of axiological Relativism.

The purpose of the present work is to introduce the object theory developed by Emil Lask in his Die Logik der Philosophie und die Kategorienlehre (1910). Even if such theory is not its goal, it works as auxiliary support in the attainment of book´s aim: to hold categorically the validity (Geltung) and save it from all hypostases forms, through that Lask deepens and transforms the value theory (Werttheorie) of Windelband and Rickert indeed under the critics of Husserl and the influence of the Lebensphilosophie. The present work will just expose and analyse the objectivity (Gegenständlichkeit) species developed by Lask, among which is included, for instance, objects as the tree, the green, the being, the beautiful, the ethical, the language and the numbers. In fact such objectivity is a sense theory completely independent of subjectivity
Este trabalho visa apresentar a teoria do objeto que Emil Lask desenvolve na sua obra Die Logik der Philosophie und die Kategorienlehre (1910). Apesar de não ser a meta de Lask, esta teoria do objeto se desenvolve como instrumento auxiliar na consecução do objetivo da obra: tratar categorialmente a validade (Geltung) e livra-la de todas as formas de hipóstase, através do que Lask aprofunda e transforma a teoria do valor (Werttheorie) de Windelband e Rickert em face das críticas de Husserl e da influência da Lebensphilosophie. O presente trabalho limita-se à exposição e análise das espécies de objetualidade (Gegenständlichkeit) desenvolvidas por Lask, dentro das quais se incluem, por exemplo, objetos como a árvore, o verde, o ser, o belo, o ético, a linguagem e os números. Objetualidade esta que em última instância se constitui numa teoria do sentido totalmente independente da subjetividade
