Grandparents are important childcare providers, but grandparental relationship status matters. According to several studies, caregiving is reduced after grandparental divorce, but differential responses by grandmothers versus grandfathers have often been glossed over. To explore the effects of relationship status on grandparental care, we analysed data from the Survey of Health, Ageing and Retirement in Europe (SHARE) comparing four grandparental relationship statuses (original couple, widowed, divorced, and repartnered) with respect to grandmothers’ and grandfathers’ provision of care to thei

AbstractProtecting women and children is one of the core values of the Islamic legal tradition. In Muslim countries religious, constitutional, and legal frameworks obligate the state to take special measures to provide protection to women and children within families and in society. However, despite such provisions, post-divorce maintenance rights are not granted to women in Pakistan and Iran. Family law enacted in Pakistan and Iran still differs in form and substance from what has been mentioned in the primary sources of Islamic law and from the previous articulations of early Islamic law sch

The clamour of voices crying out for reform of the law relating to financial provision on divorce is regularly heard. The judiciary, the academic community, lawyers and prospective divorcees have all expressed concern about the problematic nature of the current law and the urgent need for change.1 Yet these same voices rarely draw attention to the major defects inherent in divorce law itself. The battle for divorce reform which dominated the family law debate during the latter part of the 20th century appears to have been abandoned, along with the decision in 2001 by Lord Irvine of Lairg, the

As courts increasingly endorse policies of a clean financial break between divorcing spouses and rehabilitative spousal support orders on the breakdown of marriage, the importance of the law respecting child maintenance on the dissolution of marriage is correspondingly increased. This article seeks to define the law in this context, without obfuscating those issues that remain controversial before the courts. The analysis defines which children are protected by the corollary financial provisions of the Divorce Act, R.C.S., 1980, c. D-8; the circumstances in which an application may be made; th

Divorce has become an established phenomenon in an "age of discontinuity."* Together with altered patterns of family behaviour, new forms of wealth and modes of consumption, and the apotheosis of the individual and his right of self-determination, it has focused the attention on the de iure sorting out of financial or property issues between autonomous ex-spouses. The law can do nothing to artificially sustain the marriage, but it can assist in the adjustment which individuals must face in the event of divorce.<br>This thesis is mainly concerned with the economic adjustment, which the spouses

Currently, a great schism exists in the way that the law of financial provision treats cohabiting and married couples on relationship breakdown. Given that research consistently demonstrates that women are predominantly responsible for carrying out homemaking activities regardless of employment status, at the heart of this divide is the way that the law attributes value to this traditionally female role. In the married context, on divorce, breadwinning and homemaking contributions have equal value, yet in the cohabitation context only financial contributions are recognised, with homemaking hav

Data from the National Survey of Households and Families were used to study the factors previous research identified as affecting post-divorce child adjustment. Responses from 358 divorced parents with custody of children under age 12 were analyzed. Special attention was paid to the effect of family financial status. The strongest predictor of problem behavior for both preschool children and school-aged boys was the amount of parent/child activity time.
