Rodrigo, Olivares-Caminal, Douglas John, Guynn Randall, Kornberg Alan, Paterson Sarah, and Singh Dalvinder. Part II Bank Resolution, 8 Resolution of US Banks and Other Financial Institutions. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780198725244.003.0008.

Full text
Abstract:
The chapter starts by looking at resolution as understood in the United States. ‘Resolution’ refers to the way bank failures are dealt with in the United States. Similar to the traditional bankruptcy model, the chapter explains, two of the main goals of resolution are to maximize the value and minimize the losses of an institution for the benefit of its depositors and other stakeholders and, at least in a receivership situation, to determine who receives the residual value of the institution in satisfaction of their claims. However, resolution is also aimed at promoting a third goal: to deal with a failed institution in a manner that reduces the risk of contagion, preserves or restores public confidence in the banking or wider financial system, and otherwise promotes financial stability. The chapter then describes the history of financial resolution in the United States and outlines the fundamentals of resolution authority.

Asadullah, M. Niaz, Nudrat Faria Shreya, and Zaki Wahhaj. Access to microfinance and female labour force participation. 30th ed. UNU-WIDER, 2021. http://dx.doi.org/10.35188/unu-wider/2021/968-6.

Full text
Abstract:
Although microfinance started as a movement to improve women’s economic well-being through increased female entrepreneurship in particular, its impact on women’s attitudes toward and participation in the labour market is not fully understood. We fill this gap by combining data on branch locations of the major microfinance institutions in Bangladesh with household survey data and implement a spatial regression discontinuity design. Our estimates suggest significant effects of access to credit on women’s work; attitudes towards gender, social and employment norms; and psychosocial well-being. Access to credit increases labour force participation in terms of paid employment and traditional economic participation. Relatedly, respondents are more likely to be prevented from working by their husbands or other household members. They are also more likely to express traditional beliefs in relation to gender, social, and employment norms. Finally, access to credit leads to a loss in life satisfaction, financial satisfaction, health satisfaction, and overall happiness.

Full text
Abstract:
Genetic counselors who are thinking about pursuing a laboratory position should consider multiple factors, including the work environment, the specific roles of the position, perceptions of possible conflict of interest, and other factors that may influence job satisfaction. Genetic counseling training programs provide the foundation for the necessary scientific knowledge and communication skills used in a laboratory setting. Opportunities exist for internships, additional training, and networking to help refine these skills. Genetic counselors who seek to establish a new position must be prepared to provide financial justification. They will likely be offered opportunities to expand the position’s roles and responsibilities over time.

Chabowski, Brian R., and G. Tomas M. Hult. A Study of the Long-Term Value of Capabilities-Based Resources, Intangible Strategic Assets, and Firm Performance. Edited by Michael A. Hitt, Susan E. Jackson, Salvador Carmona, Leonard Bierman, Christina E. Shalley, and Douglas Michael Wright. Oxford University Press, 2014. http://dx.doi.org/10.1093/oxfordhb/9780190650230.013.003.

Abstract:
How do capabilities-based resources focused on customers, supply chains, and how does innovation impact a firm’s strategic assets and performance? We develop a framework to (1) test strategic resource allocations as investments in future opportunities, (2) examine the influences of strategic resources on strategic assets, and (3) study the effects of strategic assets on performance. The model incorporates data from a 12-year period to examine the lagged effects over a “strategic” length period. The results show that the resources that affect assets include business-to-customer (B2C) marketing expenditures, sourcing attentiveness, inventory readiness, production capacity, and overall innovation creativity. Customer satisfaction and brand equity are two firm-level strategic assets that influence financial performance. The robustness of the overall results was also examined in two technological contexts (low/stable vs. high tech).

Full text
Abstract:
This chapter looks at how the structure of bank groups is factored into the resolution process. In analysing the resolution of banks and other legal entities, a focus on the legal entities alone is a form of false consciousness. Instead, the focus needs to be on resolving the overall financial enterprise of which the bank is a part. By focusing on resolving groups instead of individual legal entities, financial regulatory authorities around the world have developed the single-point-of-entry (SPE) resolution strategy, which has been widely accepted as the most promising solution to the too-big-to-fail problem. When applied to a banking group with a holding company at the top and operating subsidiaries at the bottom, only the top-tier holding company would be put into a bankruptcy or resolution proceeding. The holding company’s assets would then be used to recapitalize the operating subsidiaries, perhaps pursuant to secured capital contribution agreements, and keep them out of their own insolvency or resolution proceedings. The recapitalized group would then be stabilized and its residual value distributed to the failed holding company's stakeholders in satisfaction of their claims.

Kathleen, van der Linde, and Calitz Juanitta. 15 National Report for South Africa. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780198727293.003.0015.

Full text
Abstract:
This chapter discusses the law on creditor claims in South Africa, where bankruptcy proceedings in are governed by the Insolvency Act and the 1973 Companies Act, while reorganization in business rescue proceedings is regulated under the 2008 Companies Act. Liquidation and business rescue each has its own approach to the submission, verification, and admission of claims; the scope of creditor participation; the calculation of voting rights; the realization of secured assets; and the range of preferential creditors. So it is unsurprising that creditors may prefer one procedure over the other irrespective of the debtor’s financial prospects. South African law does not provide for super-priority claims. In both bankruptcy and reorganization proceedings, administration expenses always rank first. The chapter examines insolvency claims, administration claims, and non-enforceable claims in turn. Each section covers: the definition and scope of the claim; rules for submission, verification, and satisfaction or admission of claims; ranking of claims; and voting and other participation rights in insolvency proceedings.

Abstract:
POLISH-RUSSIAN ENCOUNTERS IN THE SPACE OF MUSICAL CULTURE: THE 19TH AND EARLY 20TH CENTURIES Musicians travel: in their youth, to learn and perfect their métier; later, to gain fame and recognition, secure artistic and financial satisfaction. Circulating music prints reach various recipients at home and abroad, while the production and distribution of such publications depend mainly on the needs and tastes of consumers. Musical instruments provided by the music industry also find their way to many customers. This industry is an integral part of culture as it provides the material basis for creating and performing music. Musical culture emerges ‘in movement’: through encounters and the exchange of people, compositions, ideas, and physical goods. It has its own dynamics and channels of expansion; it relies on extensive and ever changing networks on personal, professional, institutional, and commercial levels. This musical exchange happens across state borders; it is not blocked by geography or politics, although both may affect it to an extent. The present collective work Polsko-rosyjskie spotkania w przestrzeni kultury muzycznej (XIX wiek i początek XX stulecia) [Polish-Russian Encounters in the Space of Musical Culture: The 19th and Early 20th Centuries] attempts to show this exchange through the testimony of historical sources: autographs, music prints, records of social life (concert programmes), and press materials. The main focus of the articles is on the presence of Polish music and Polish musicians in Russian culture; however, there is also a discussion of the opposite perspective, of Russian music and musicians in Polish culture.
