Abstract:
Abstract This paper presents the results of research on fiqh-oriented manhaj tafsir. This research uses literature review method to portray the methods of interpretation which produce legal consequences in Islamic society. Data collection was carried out by examining primary and secondary sources in support of this study. The results of the study and research found the background for the emergence and development of fiqh interpretation styles and the methods used in fiqh-style interpretation. The fiqh-style interpretation is a fairly old one, considering that this style of interpretation has existed along with the growth of the interpretation itself. Fiqh interpretation is an interpretation that is oriented to the understanding of legal verses in the Koran. This interpretation was born from the understanding of the jurists' fiqhiyah when they interpreted the Koran using the fiqh approach, so that the nuances of fiqh were felt in it. Keyword: Kitab, Manhaj, Tafseer, anda Fiqh Abstrak Tulisan ini menyajikan hasil penelitian tentang manhaj tafsir yang berorientasi fiqh. Penelitian ini menggunakan metode kajian pustaka untuk memotret metode-metode tafsir yang menghasilkan konsekuensi hukum dalam masyarakat Islam. Pengumpulan data dilakukan dengan menelaah sumber primer dan sekunder dalam mendukung kajian tersebut. Hasil telaah dan penelitian menemukan latar belakang muncul dan berkembangnya corak penafsiran fiqih serta metode yang digunakan dalam penafsiran yang bercorak fiqih. Tafsir yang bercorak fiqih adalah tafsir yang terbilang tua, mengingat corak tafsir ini telah ada seiring dengan pertumbuhan tafsir itu sendiri. Tafsir fiqih adalah tafsir yang berorientasi pada pemahaman ayat-ayat hukum dalam Alquran. Tafsir ini lahir dari pemahaman fiqhiyah para fuqaha ketika mereka menafsirkan Alquran dengan menggunakan pendekatan fiqih, sehingga nuansa fiqih sangat terasa di dalamnya. Application concept in fiqh-tasawwuf that level of social reality. There is a serious controversian between fiqh and tasawwuf at stage of practitioner. Not infrequently, fiqh doctrine is always clashing with teachings of tasawwuf. From the assumption that fiqh is consider nuance legal-formal, rather than tasawwuf which is ethical value. Therefore, the law is binding and forcing while tasawwuf flexible. Then, that make fiqih rigid, stiff and inflexible. So often, fiqih does not seem to care about wishes of tasawwuf. On the contrary, at a further stage, some people who have reached the top of tasawwuf, feel unnecessary to formal rules of fiqh.

Salah satu norma yang diatur di dalam hukum positif dan figh syafi’iyah adalah penetapan hukum talak, dalam penelitian ini penulis menjelaskan pandangan riil dari hukum positif Indonesia serti pandanga fiqih syafi’iyah dengan menganalisa beberapa dokumen dasar pijakan hukum dari hukum positif serta fiqh syafi’iyah terhadap keabsahan hukum talak tiga.Metode yang digunakan dalam penelitian ini adalah penelitian komparatif bersifat deskriptif, yaitu penelitian yang membandingkan dua atau lebih kejadian dengan melihat penyebabnya. Hasil analsis dapat diketahui bahwa penetapan talak berpedoman kepada kompilasi hukum islam dimana talak baru diangggap sah apabila dilakukan di depan majlis hakim sesudah melalui proses pedamaian, sedangkan dalam fiqh syafi’iyah bahwa talak jatuh dimana dan kapan suami mengucapkannya. Dapat penulis simpulkan bahwa terdapat perbedaan pada penetapan hukum tentang keabsahan talak yang diatur dalam hukum positif dengan hukum yang diatur dalam figh syafi’iyah.

In general, the Malaysian Qualification Agency (MQA) (2015) reported that the curriculum of Islamic Education PISMP has weaknesses and needs to be improved and corrective action is taken. While the elements of fiqh ikhtilaf is an important current need that should be applied in the fiqh curriculum at IPGM. However, so far, no specific study has been conducted to study the scope of the elements of fiqh ikhtilaf in this fiqh curriculum. This article will discuss the initial overview of the perception of students of Islamic Education in the Institute of Teacher Education (IPG) Tun Abdul Razak Campus on the elements of fiqh ikhtilaf found in the fiqh curriculum. This study is a survey study. Questionnaires were used to see the perceptions of students on the elements of fiqh ikhtilaf found in fiqh courses. The findings of the study found that the elements of fiqh ikhtilaf are less applied in the fiqh curriculum. Students also expressed their views on their inability to interact with the issues of disagreement in fiqh that arose. They also agreed to say the importance of the element of fiqh ikhtilaf applied in the curriculum of fiqh studies at IPGM. To further strengthen this fiqh curriculum, this study suggests that the IPGM fiqh curriculum be re-examined. The elements of fiqh ikhtilaf should also be applied better and more organized.

Kajian ini memaparkan peran u??l fiqh dalam penemuan dan pembentukan hukum Islam. Melalui tulisan ini dipaparkan mulai dari definisi, sejarah perkembangan, objek kajian dan sekilas tentang aliran u??l fiqh. Selain itu, penelitian ini juga memaparkan tentang model dan tipologi penelitian u??l fiqh. Pendekatan yang digunakan dalam pembahasan penelitian ini adalah pendekatan historis, dengan memaparkan perkembangan u??l fiqh berdasarkan kurun waktu. Berdasarkan kajian ini dapat diketahui bahwa sebagai metode penemuan hukum, u??l fiqh merupakan bagian dari metode penelitian hukum Islam secara umum. Penelitian hukum Islam secara keseluruhan dibedakan ke dalam dua bidang besar, yaitu penelitian hukum Islam deskriptif dan penelitian hukum Islam preskriptif. Abstract: This study investigate the problem in the utilization of classic book in fiqh learning in Islamic Junior High School based boarding school in Pamekasan. It deals with how tradition in fiqh learning related to the type of classic book, learning method, book selection, and learning achievement. The teaching and learning of fiqh in Islamic Junior High School based boarding school generally used classic book fiqih from Shafi'i madzhab. The reason for employing the classic book is to preserve the scientific tradition that is occured in the boarding schoool. The method used in fiqh learning is a combination between classic book methods that exists in boarding school, such as bandongan, sorogan, and memorization. The achievement of the fiqih curriculum standard which has been determined by Kemenag is pursued through three approaches, namely (1) integrating fiqh curriculum stipulated by Ministry of Religious Affairs and classic book; (2) khushûshiyah class; and (3) not using specific books from Kemenag.Abstrak: Penelitian ini membahas tentang permasalahan penggunaan kitab kuning dalam pembelajaran fiqih pada Madrasah Tsanawiyah berbasis pesantren di Kabupaten Pamekasan. Bagaimana tradisi pemakaian kitab kuning dalam pembelajaran fiqih kaitannya dengan jenis kitab kuning yang digunakan, metode pembelajaran, latarbelakang pemilihan kitab, dan capaian pembelajarannya. Pemakaian kitab kuning dalam pembelajaran fiqih di MTs berbasis pesantren pada umumnya menggunakan kitab adalah kitab kuning fiqih bermadzhab Syafi’i. Motif pemakaian kitab kuning adalah untuk melestarikan tradisi keilmuan yang sudah establish di pesantren dan pengenalan kitab kuning pada para santri. Metode yang dipakai dalam pembelajaran fiqih adalah penggabungan antar metode pembelajaran kitab kuning yang ada di pesantren yaitu bandongan, sorogan, dan hafalan. Pencapaian standar kurikulum fiqih yang telah ditentukan oleh Kemenag, ditempuh melalui tiga pendekatan: (1) memadukan antara fiqih kurikulum Kemenag dan fiqih kitab; (2) kelas khushûshiyah; dan (3) tidak memakai buku Kemenag secara khusus.

Welfare is a basic guarantee in the constitution. Therefore, the State must realize it. Indonesia is doing all its power and effort by implementing the principle of decentralization so that each region is managed by a regional government. This is intended for economic equality, so that welfare is realized for the community. The purpose of this study is to find out how the conception of prosperity in the theory of State Administration and Fiqh Siyasah. In addition to knowing how the urgency of implementing the principle of decentralization in realizing public welfare in terms of constitutional law and Fiqh Siyasah. This study uses a qualitative method with a normative and doctrinal juridical approach. Research data obtained from books, journals, and legislation. The results of the study stated that the implementation of the principle of decentralization was very necessary in realizing the welfare of the community accompanied by paying attention to the signs of fiqh siyasah. Fiqh siyasa and decentralization cannot be separated. To realize the welfare of the community, new innovations are needed, namely incorporating siyasa fiqh into the implementation of the principle of decentralization.Keywords: Community Welfare; Decentralization; Fiqh Siyasah AbstrakKesejahteraan merupakan jaminan asasi dalam konstitusi, oleh sebab itu Negara wajib merealisasikannya. Dalam hal tersebut, Indonesia melakukan segenap daya dan upaya dengan menerapkan asas desentralisasi agar masing-masing daerah dikelola oleh Pemerintah Daerah. Hal ini ditujukan untuk pemerataan ekonomi, sehingga terealisasi sebuah kesejahteraan bagi masyarakat. Tujuan penelitian ini untuk mengetahui bagaimana konsepsi sejahtera dalam teori Tata Negara dan Fiqih Siyasah, serta untuk mengetahui bagaimana urgensi pelaksanaan asas desentralisasi dalam mewujudkan kesejahteraan masyarakat ditinjau dari hukum Tata Negara dan Fiqih Siyasah. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif dan doktrinal. Data penelitian diperoleh dari buku, jurnal, maupun perundang-undangan. Hasil penelitian menyatakan bahwa pelaksanaan asas desentralisasi sangat diperlukan dalam mewujudkan kesejahteraan masyarakat yang disertai dengan memperhatikan rambu-rambu fiqih siyasah. Fiqih siyasah dan desentralisasi tidak dapat dipisahkan. Untuk mewujudkan kesejahteraan masyarakat diperlukan inovasi baru, yaitu menggabungkan fiqih siyasah ke dalam pelaksanaan asas desentralisasi.Kata Kunci: Kesejahteraan Masyarakat, Desentralisasi, Fiqih Siyasah.

This is an attempt to investigate the linguistic question ofderivation in usul ahfiqh (legal theory). Being treated in various linguistic disciplines, especially grammar, the subject matter is studied in light of these disciplines in order to expound the unique contribution of usulists to it. The present study explores the chronological evolution of the subject and presents "derivation" as one example of the methodology applied by usulists to linguistic issues.

Abstract:
This is a study about the early history of usal al-fiqh as a literary genre. An attempt is made to make a comparative analysis of five texts of uscil al-fiqh, all belonging to the Hanafi school. These five texts are: al-Fusfil fi- al-Usul by Jassas (d. 370/98 1), Taqwim al-adilla by Ab-a Zayd al-Dabusi (430/1039), Kitab al-Usul by Shams al-a'imma al-Sarakhsi (483/1090). Kanz al-wusul ila ma'rifat al-usul by Fakhr al-Islam al-Pazdawl (482/1089) and Usfil al-Shdshi, whose author is unknown. In this study, I endeavoured to show that the first four texts of usul display a methodological continuity which is characterised by a juristic outlook. This continuity is bolstered by the fact that one can also trace a terminological and structural development of these texts in conjunction with their chronology. In addition, I argued that the so-called Usull al-Shashi cannot be dated prior to the final text above, i.e. Pazdawi's Kanz, as some have believed, on the basis of my analysis of the language and structure of this text in comparison with the former four.

Abstract:
The aim of this thesis is to study the various fundamental rights that the wife enjoys in accordance with the teachings of Islam. In particular, the thesis focuses on those rights that affect the husband, including the right to choose a husband, the right to get a dower, the right to have nafaqah, the right to be treated equitably, and the right to have al-khul'. The thesis falls into nine chapters including the introduction (Chapter One) and the conclusion (Chapter Nine). It contains 70000 words, approximately. Chapters Two and Three are introductory chapters, as each one of them introduces a key aspect of the research. Chapter Two introduces the concept and significance of the Prophet's sunnah, the framework within which the research is conducted, while Chapter Three investigates the significance of marriage in Islam. Chapter Four centres on one of the most fundamental rights the woman, regardless whether she is a bikr or thayyib, should have. It is the right to choose a husband. This right is guaranteed by shari a through the different hadiths the prophet had said in this respect. The chapter also considers the vital role played by the guardian in guiding the woman under his guardianship into the right way so she can make a wise decision while making her choice. Chapter Five looks at another significant right the wife enjoys which is the right to get a dower. This right is the wife's own and no one else, whether the father or the guardian, should interfere or take anything of it without her permission to do so. Chapter Six explores another right the wife is entitled to have which is the right to have a maintenance or nafaqah. Different types of maintenance are identified such as food, clothing, housing, servant, medical, perfume, adornment nafaqahs. In addition, the nafaqah in the case of the working wife is also dealt with in this chapter. The calculation of nafaqah is estimated in accordance with the husband's income. Chapter Seven considers the wife's right to get fair treatment known in Arabic as al-`ishra bilma`rüf According to this right, the wife is entitled to be treated by her husband with respect and trust. Therefore, he should refrain from ignoring, humiliating or ridiculing her or her opinions. Furthermore, he should teach her useful things about life and religion so that she will be a good companion to him. Finally Chapter Eight looks at al-khul' as one of the wife's important rights in Islam, according to which she has to return the dower she had from her husband, or give him something of the same value,, for the sake of ending the marriage without the need to provide any reasons for the desire to do so. These five rights that the wife exercises play a significant role in stabilising the family and bringing about happiness. It has been stated in the Qur'an that marriage is a way of "dwelling in tranquillity". In fact, this ultimate goal of the legitimisation of marriage can be achieved nowadays only' through adhering to the rights that Islam has granted to the Muslim wife

Abstract:
En présentant ce travail on peut dire qu'il s'agit d'une étude à double facette : juridique et sociale. L'aspect juridique a constitué l'ossature du travail. Il traite des questions vitales aussi bien pour l'individu que pour la collectivité. Il s'intéresse plus particulièrement aux accommodements et aux modifications auxquels a été assujetti le fiqh par les juristes maures dans le cadre de l'adaptation de celui-ci aux conditions particulières du pays. Il faut noter à cet égard le paradoxe de base que constitue d'une part, la vigueur de l'interprétation "ijtihād" chez les fuqahā maures et son efficacité dans la constitution de leur jurisprudence et d'autre part leur opiniâtreté à s'opposer à toute velléité d'innovation en dehors du cercle du mimétisme (taqlīd) et du plagiat (ittibā'). De ce fait les fuqahā ont joué un rôle primordial dans l'expression des soucis de la société et dans l'orientation des comportements de la collectivité. L'aspect social des textes juridiques analysés illustre la dimension proprement anthropologique du travail ici entrepris. L'analyse des fatāwā du corpus, nous amène à penser que les fuqahā ont trouvé le cadre tribal à leur convenance. Il nous semble que la permanence et la prégnance du lien tribal dans la société maure ont été une constante de l'histoire. Les théologiens actuels, n'ont pas remis en cause cet état de fait. Ils paraissent d'ailleurs privilégier le rattachement tribal à l'allégeance à l'Etat autant par conformité à la tradition, que par crainte de se rendre complice de toute "innovation blâmable" (bidʿa). D'autant plus que la tribu continue à remplir des rôles dévolus théoriquement à l'Etat moderne qui fait cependant preuve de démission et d'incapacité.

This thesis studies the proposal for an Indonesian fiqh, articulated by Muhammad Hasbi Ash Shiddieqy (1904-1975) as an effort to bridge the tension in Islamic law between revelation and reality (c-ada) in Indonesian society. While such an indigenous fiqh can only be created through ijtihad, most Indonesian Muslims believed the gate of ijtihad to have been irrevocably closed and thus they vehemently opposed any suggestion toward creating an Indonesian fiqh. To make itjihad possible once again, Hasbi worked hand in hand with the reformists with the call of "Back to the Qur'ân and the Sunna." Abstract:
The thesis examines the development of the concept of Ijmāʻ, consensus, in Imāmī-Shīʻī principles of jurisprudence (uṣūl al-fiqh). In the introduction to the thesis there is an analysis of the concept of Ijmāʻ as generally understood in Islamic jurisprudence and a discussion of the approach adopted in the thesis as well as a general outline of the literature involved. The introduction also outlines the background to Imāmī Shīʻī jurisprudence during the time of the presence of the Imāms and the period immediately after the greater occultation of the Twelfth Imām. The main body of the thesis analyses the available major texts written by Imāmī-Shīʻī Uṣūli scholars from the time of al-Shaykh al-Mufid (413/1022) to the end of the nineteenth century with a brief discussion of the views of some recent Imāmī Shīʻī scholars. From the outset a difference of emphasis can be observed between scholars who argue in favour of a major role for reason, such as al-Sharīf al-Murtaḍā (436/1044) and those in favour of a greater reliance on Traditions from the Prophet and the Imāms, which is moderately represented by al-Shaykh al-Ṭūsī (459/1067). The subsequent generations of scholars refined and further defined these concepts. In particular, in opposition to the movement in favour of general adherence to the Traditions, there arose from the proponents of the use of uṣūl al-fiqh a definition which gave much greater scope to the use of reason and the continuing guidance of the Twelfth Imām. The latter proposition reached its final form in Imām-Shīʻī uṣūl al-fiqh at the end of the nineteenth century in Kifayat al-uṣūl by Muḥammad Kāẓim al-Khurāsānī. Finally, there is a brief examination of the work of some recent scholars and a conclusion to the thesis.

Abstract:
Статья посвящена правовой характеристике фикха и ответственности в мусульманской системе права. Перечислены этапы возникновения и развития фикха. В статье выявляется трехуровневая система наказаний по мусульманскому праву, элементами которой являются такие виды наказаний как: «худуд», «кисас» и «тазир». В заключении работы формулируется вывод о том, что фикх представляет из себя совокупность теоретических знаний об исламской вере и ее практических положений правоприменения (Шариат) на основе норм главных источников мусульманской системы права - Священного Корана и Сунны Пророка Мухаммада (да благословит его Аллах и приветствует). The article is devoted to the legal characteristics of fiqh and responsibility in the Muslim legal system. The stages of the origin and development of fiqh are listed. The article reveals a three-level system of punishments under Muslim law, the elements of which are such types of punishments as: "Hudud", "qisas" and "tazir". In conclusion, the article concludes that fiqh is characterized as a set of theoretical knowledge about the Islamic faith and its practical provisions of law enforcement (Sharia) based on the norms of the main sources of the Muslim legal system - the Holy Qur'an and the Sunnah of the Prophet Muhammad (peace and blessings of Allaah be upon him).

Abstract:
The overall goal of this research work was to identify the main proteolytic activities which take place in the digestive tracts of young bass fish, and use the knowledge acquired in order to improve feed protein utilization in juvenile fish based on their digestive capacity. The results of the work clearly showed that the young fish possess the entire profile of proteolytic enzymes which is found in adult fish. Yet, in the young fish the level of activity is substantially lower per gram tissue (or gram protein) as compared with the activity found in the digestive tracts of the same fish at an older (larger) age. In addition it was found that the main proteolytic enzyme in these fish is chymotrypsin which accounts for almost 80% of the proteolytic activity. An effort aimed at enhancing this activity has lead to the interesting finding that alcohol substantially enhances the proteolytic activity of fish intestines. Fish intestinal homogenates were used in order to evaluate the suitability of various feeds for the fish. Potential feed proteins were subjected to the proteolytic activity of the fish enzymes in vitro, in a manner simulating the natural process. The proteolytic activity was monitored by the valuation of the products, i.e. amino acid released. This method has proven to be a powerful tool which enables us to predict with a very high degree of accuracy the potential of a feed to promote growth. Selection of feed based on the proteolytic capacity of the fish degestive tracts can now be implemented in feed formulation, as anticipated in the original research proposal.
