Abstract:
The First Amendment was brought to life in a period, the twentieth century, when the political speech environment was markedly different than today’s. With respect to any given issue, speech was scarce and limited to a few newspapers, pamphlets or magazines. The law was embedded, therefore, with the presumption that the greatest threat to free speech was direct punishment of speakers by government. Today, in the internet and social media age, it is no longer speech that is scarce—rather, it is the attention of listeners. And those who seek to control speech use new methods that rely on the wea

In BC, many proposed mines undergo provincial environmental assessment (EA), which predicts a mine’s risks and involves government oversight and public engagement. We examined all amendment documents for mines undergoing provincial EA in BC from 2002 to 2020. Of the 23 approved mines, 15 (65%) requested a total of 49 amendments, of which 98% were approv

Abstract The first amendment does not protect all speech. Should it protect lies? Some argue that the state should intervene to prevent and punish lying because the people are insufficiently rational (they are too emotional, and, therefore vulnerable) or excessively rational (they find it too costly to investigate claims and are, therefore, vulnerable). Others retort that state officials are not neutral or objective, but have their own interests to advance and protect, and, therefore, cannot be trusted. This note places the recent 103rd Amendment of the Constitution for introducing 10 per cent reservation for ‘economically weaker’ sections of the upper castes in the larger context of the ongoing effort to redress caste inequalities in law. It compares this amendment to the First Amendment to the Constitution of 1951 and argues that these two amendments describe a full circle. The law seems to have moved from a stance where castelessness was the explicit norm and caste the exception to one where caste identities are now treated as the implicit norm.
