Full textThe Swedish government has submitted a proposal, in the so-called January agreement, to modernize Swedish labor law by, among other things, expanding the rules of turnover and making it cheaper for smaller companies to terminate staff. This is not an unproblematic proposal because the Swedish model is based on tripartism where the state is supposed to establish laws and make sure that the system works - but must then stay in the background and let trade union and employer organizations negotiate terms and agreements.The purpose of the study is to analyze, from an HR perspective, companies' attitudes to the rules on termination in the Employment Protection Act (LAS) and how they view a possible future change of the law and to explore the possibilities for flexicurity in the Swedish model. As there are many different aspects, the empirical material has been drawn from seven interviews with employers, one questionnaire for employees to answer, and another questionnaire about employers' interest in a form of collaboration.The authors' proposal is to develop employer rings as a form of collaboration to achieve local flexicurity, where both employers' need for flexibility and employees' need for job security are met.It is more advantageous for the employee to be laid off due to a lack of work since it then gets the right to support from the community. The problem with dismissing someone due to a lack of work is the turnaround rules which say that the person who was last hired is the one who is laid off first, which means that the period of employment plays a big role and gives employees security in their employment. Most of the study participants believe that the right competence should be given priority over the period of employment. This highlights skills development as an important factor that can play an increasingly important role for employee safety.The authors' suggestion is that companies merge into partnerships that are partially funded by the state so that educational efforts can be put in at an earlier stage, which benefits all three parties.

Full textThe present work aims to analyze the European dialogue regarding the concept of flexicurity. I will study the various steps that led to the birth of the term itself and to its diffusion and, especially, the political debate that the European Commission wanted to open with the drafting of the Green Paper entitled "Modernising Labour Law to meet the challenges of the twenty-first century ". I will, therefore, examine the virtuous systems of flexicurity, trying to answer the question whether such systems are easily exportable to the other nations or not and if there is a universal concept of flexicurity, regardless of the peculiarities of each national situation. Finally, I will analyze the relationship between Employment Protection Legislation, defined as the set of rules and procedures governing the termination of employment, and the various indicators of labor market. Then the attention will be focused on the concept of “contratto unico”.

Full textTraditional Labor Law, based on the protection of the classic employee, is in crisis. Among the factors responsible for the crisis it is worth to single out the labor market and production system transformations caused by the globalization. In this scenario, the universe of workers who are in need of legal protection is becoming wider. Labor Law cannot ignore the existence of self-employment, flexible atypical work contracts and other forms of work distinct of the traditional employment relationship. Currently, most workers, even when self-employed, are dependent on capitalists. Legal protection of all work forms is a fundamental right of every worker. Labor Law is essential for human dignity and a minimum set of core work rights must be ensured in all forms of labor contracts and arrangements. The modern labor market demands flexible forms of work to enable a dynamic supply to the production needs. On the other hand, work flexibility cannot worsen the work conditions. Even in flexible markets, workers need a minimum of safety and security. European Law, concerned with the search for a balance between flexibility and security developed the flexicurity theory that tries to overcome such tensions between these antagonistic perspectives, with labor market flexibility on the one hand and social security on the other hand even if these concepts seems contradictory. This thesis presents a national model of flexicurity able to modernize the country`s Labor Law expanding its applicability to all workers and not only formal employees. The model offers a legal regulation to flexible work forms, with security measures for all workers ensuring a minimum set of fundamental work rights and assistance on the periods between jobs.

Full textSammanfattningUppsatsens syfte är att jämföra svensk och dansk arbetsrätt på olika områden för att urskilja likheter och skillnader mellan dessa. De metoder som används för att uppnå syftet är en rättsdogmatisk metod och en komparativ metod. Den danska arbetsmarknadsmodellen, s.k. flexicurity, har av EU föreslagits som modell till övriga medlemsländer för att uppnå Lissabonstrategins sysselsättningsmål. Lissabonstrategin lades fram av Kommissionen år 2000 och förnyades år 2005. Strategin ställer bl.a. krav på medlemsländerna att öka sysselsättningen, minska arbetslösheten och lägga mer resurser på utbildning för att skapa lika förutsättningar för kompetensutveckling bland arbetstagare. Sverige har, liksom Danmark, uppfyllt målen för sysselsättning och arbetslöshet. Dock uppvisade Danmark såväl en högre sysselsättningssiffra som en lägre arbetslöshetssiffra vid en mätning som gjordes år 2006, där jämförelsen i arbetslöshet uppmättes till 3.9 procent jämfört med 7 procent och sysselsättningsgraden uppmätte 77,4 procent i jämförelse med 73,1 procent. Danmark och Sverige har en gemensam utveckling på arbetsmarknaden, historiskt såväl som arbetsrättsligt. De har haft en hög facklig reglering av arbetsmarknaden genom kollektivavtal. I uppsatsen dras slutsatsen att Danmarks arbetsmarknad idag styrs av kollektivavtal i högre grad i jämförelse med Sverige vars lagstiftning sedan 1970-talet anger övergripande lagregler som ramar för kollektivavtalens innehåll i större utsträckning. Den svenska modellen kännetecknas av ett starkt anställningsskydd för arbetstagare och detta regleras främst i medbestämmandelagen (1976:580;MBL) och lag (1982:80) om anställningsskydd (LAS). Dansk flexicurity består av tre grunder; flexibel arbetsrätt, ett generöst arbetslöshetsförsäkringssystem och en aktiv arbetsmarknadspolitik. Den flexibla uppsägningsrätten ger möjlighet att anpassa arbetsstyrkan i förhållande till produktion och ersättningssystemet minskar risken för inkomstminskning för den enskilde vid arbetslöshet. Den aktiva arbetsmarknadspolitikens syfte är att förse arbetstagarna med kompetens för att snabbt kunna återgå i arbete samt att säkerställa att de arbetslösa står till arbetsmarknadens förfogande. Även Sverige har utvecklat åtgärder för att hjälpa arbetstagare tillbaka i arbete och har såsom Danmark ett generöst arbetslöshetsförsäkringssystem. Dock skiljer sig villkor och tidsomfattning åt. Reglerna om sjuk- och föräldraförsäkring är relativt lika mellan länderna. En slutsats i uppsatsen är att arbetstagare i Sverige och Danmark omfattas av olika former av trygghet och uppvisar anställningstrygghet kontra arbetstrygghet. Ett införande av flexicurity enligt EU:s förslag skulle för Sveriges del innebära en nödvändighet av att sänka anställningsskyddet genom att ändra delar i LAS, t.ex. om uppsägningsregler. En sänkning av kraven på uppsägningsreglerna kan leda till att arbetsgivare på den svenska arbetsmarknaden i högre grad vågar nyanställa då risktagandet från arbetsgivarnas sida upplevs som mindre. Detta eftersom en felaktig anställning inte behöver innebära lika stora kostnader som i nuläget och detta skulle kunna påverka Sveriges arbetslöshetsstatistik positivt. Däremot är det ej säkert att en sådan förändring skulle utjämna förekommande skillnader mellan Sveriges och Danmarks sysselsättningsstatistik. Ett ifrågasättande kan göras då flexicurity som arbetsmarknadsmodell även har genomgått perioder av sämre sysselsättningsgrad och högre arbetslöshetsgrad i Danmark.

Full textFlexicurity is a concept that attempts to join two objectives. It combines a flexible labor market characterized by the relatively labor law protection against dismissal and a strong social protection against unemployment with generous unemployment benefits. At the same time, flexicurity promotes an employment policy that aims to shorten the time between jobs. This concept derived from the northern Europe countries and was presented by the European Union as a social reference model. In France this concept was not really adopted due to the failure of First Employment Contract. But since 2008, the construction of this concept is becoming increasingly important. In this field, France has innovated by introducing a new process of out of the contractual relationship whose interesting example is the contractual termination. The 14th 2013 Act is a continuation of this approach to reduce the time of the procedure to the breach or execution of contract.However the impact of these measures on the rate of unemployment is not convincing. It would therefore be interesting to assess in the case of further studies the impact of this concept in the French context

Full textPurpose: The purpose of this study was to identify theoretical concept to better understand customer companies* consumption like behavior of temporary workers. Further on the study wished to describe the seemingly changed employee’s ethics for temporary workers, which seems to be the basis for employers handling. Theory: Initial the premise for temporary work is introduced. To understand the customer companies this study took on three perspectives trying to understand the problem question. These perspectives were HRM, Flexibility and Economics. Method: The empirical material was gathered through semi structured interviews. In total three customer companies were represented and nine interviews conducted. The informants were told to freely talk about a few selected topics with the help of catchwords. Further on, the informants were asked to associate some concept in relation to temporary workers. Findings: This study conducts that the view of customer companies are in line with what can be called employers politic ethics. Thus, the temporary workers management includes several dimensions in which use transform in to exploit. That in which this study conducts can resemble consumption. *Costumer company/user company; referring to an organization using temporary workers.

Full textNesta dissertação propomo-nos efectuar um estudo no âmbito da Sociologia Económica, com grande componente de Economia da Educação que permita proceder à comparação de três países relativamente à estratégia de flexigurança. Os países objecto de estudo e de comparação com Portugal face àquela estratégia são a Dinamarca e a Espanha por razões que indicaremos ao longo do trabalho. Para tal, dividimos este trabalho em duas partes. Na primeira procuramos desenvolver conceitos teórico-conceptuais que estabeleçam uma ligação entre a problemática da educação e a flexigurança servindo-nos da teoria do capital humano e do ciclo de vida como base de suporte. Na segunda parte, a da investigação empírica, desenvolvemos uma abordagem sistemática em três vertentes: educação/formação, emprego/desemprego e politicas do mercado de trabalho, à luz da qual procuramos comparar, para os três países, o estado dos pré-requisitos fundamentais para a implementação da flexigurança.
This dissertation proposes to undertake a study in Economic Sociology, with a large component of the field of Economics of education which would allow the comparison among three countries on the flexicurity strategy. The countries under study and comparison with Portugal against this strategy are Denmark and Spain for reasons we will indicate throughout the dissertation. To this end, we divide this work into two parts: in the first one we develop a systematic approach in three areas: education / training, employment / unemployment and policies of the labor market. We seek to develop theoretical and conceptual concepts that establish a link between the problems of education, training and flexicurity in the framework of human capital and life cycle theories. In the second part we carry em pirical research throughout comparisons between the three countries, reported to the data of the implementation of flexicurity (Denmark) and to the more recent ones in which debate on flexicurity and policy making proposals seemed to be at the outmost (Portugal and Spain). Likewise we use key indicators on education and training, on employment and unemployment and we also review some of the labour market policies that are most requested by flexicurity.

Full textA number of factors influence employment and make employers and employees adapt to rapidly changing market conditions. This has recently been particularly pertinent to countries seeking to address the consequences of the world economic crisis. Sweden, which is one of the most powerful economic players in the EU, has also failed to avert the crisis. It is important to determine whether in Sweden there is flexicurity, which helps to ensure higher employment rates. The aim of the thesis is to analyse the Swedish labour market policy and the labour market situation and provide possible solutions to problems. The paper provides the concept, components and principles of flexicurity and the Danish “golden triangle” model, which is considered to be an example by the EU. The paper also examines the mobility of workers within the country and employment protection. Further, it discusses termination of employment contracts in respect of the notice period, which has influence over the mobility of workers and the flexibility of labour relations, and the regulation thereof. The thesis analyses flexible forms of work organisation prevalent in Sweden, i.e. fixed-term employment contracts, temporary employment, part-time employment, on-call work, flexible organization of working time and telework. Full textWith recurrent economic crises that plagued the twentieth century and early twentyfirst century there was a large impact on the global labor market, with high levels of unemployment and informal working proliferation. Thus, the European Union, in order to minimize the impacts and increase the competitiveness of European countries, adopted the concept of flexicurity, originally from Denmark and the Netherlands. At the same time, the ILO launched the concept of Decent Work, which seeks the convergence of the strategic objectives of the institution, proposing the creation of an agenda by the countries where it promotes social dialogue, social protection and job creation that effectively consolidate the social value of work. Thus, this study aims to discuss what are the limits of flexible working rights in Brazil offsetting up the two concepts, as well as verifying the possibility of implementing a flexicurity model in Brazil.

Full textResumo: Com o advento da globalização, foram removidas as barreiras comerciais e o mundo assumiu características de uma aldeia global de negócios e oportunidades, com a consequente aceleração da economia, avanços de cunho tecnológico e científico e a automação da produção. A possibilidade de se reduzir encargos de produção por meio da busca de insumos e mão de obra a custos menores promoveu o acirramento da concorrência e a necessidade cada vez maior de se apresentar no mercado produtos com boa qualidade a preços competitivos. Surge, então, a ideia da flexibilização como proposta de ferramenta a possibilitar maiores chances de concorrência mercadológica com alterações no sistema de regulamentação do Direito do Trabalho. Para alguns, a flexibilização enseja a possibilidade da geração de novas vagas de trabalho; para outros, não se pode associar dinamização da economia a regulamentação do trabalho, tampouco pode o Poder Público se curvar à competição mercadológica internacional. Diante disso, o objetivo do presente estudo é analisar as transformações sofridas pelo Direito do Trabalho pátrio no decorrer de sua história, sob o viés dos fenômenos da flexibilização, flexissegurança e desregulamentação dos direitos trabalhistas, bem como seus impactos jurídicos e sociais nas garantias e nos direitos fundamentais do trabalhador. Abstract: With the advent of globalization, trade barriers have been removed and the world has assumed the characteristics of a global village of business and opportunity, with a consequent acceleration of the economy, technological and scientific advances, and production automation. The chance of making production burdens by finding the lowest and most competitive hand and labor is by increasing demand for competitive prices. An idea of flexibility of a proposal of possibilities of market competition appears with changes in the system of freedom of access to work. For some, a flexibilization can make it possible to generate new jobs; for others, cannot be able to dinamization of the economizing the duty free, nor the Power Public bow to the international market fatigue. Thus, the present study is analyzed as the transformations suffered by the right to work and the deregulation of labor rights, as well as their own rights and flexibility in the guarantees of labor rights fundamental rights of the worker. It includes an analysis of the main transformations of Brazilian Law, from its currents to the present times, of the Labor Reform, from the point of view of the different forms of flexibilization, flexibilization and deregulation. As a method of procedure, we adopt a survey through the technique of bibliographical research in published materials and, as a method of approach, the deductive. Full textThis PhD dissertation provides useful empirical contributions for two research topics about flexicurity: the use of the short-time compensation (STC) program by French establishments and the role of the three “bases” of flexicurity – employment contract, skills and territory (Freyssinet, 2006) – in making professional career paths secure. About the first topic, we develop a methodology to analyse the efficiency of STC and to verify if it could be considered as a flexicurity tool. According to two efficiency criteria (avoiding redundancies and establishment exit), STC does not protect employment and so it is inefficient: Between 1995 and 2005, it represents mainly a flexibility tool. It can not been seen as a tool responding to the principles of flexicurity. In the line of the second topic, we analyse how the “bases” of flexicurity make professional career paths secure, by focusing on three professional mobilities: first employment-employment, employment-employment and unemployment-employment. We show the importance of temporary contracts, firm networks and individual’s place of residence in the process of making professional career paths secure. We show that: (i) fixed-term contracts secure professional trajectories if the link between individuals and firms is long enough; (ii) firm networks support the acquisition of skills, making easier professional mobilities; (iii) a “disadvantaged” place of residence seems to be an obstacle in making professional career paths secure

Full textEl artículo aborda una de las más recientes y novedosas propuestas de flexibilización relacionada, básicamente, con la extinción de la relación laboral, propuesta que es conocida como «flexiseguridad» o «flexiguridad». Para ello, el autor comenta el modelo de Dinamarca —país en el que se origina la «flexiseguridad»— destacando la configuración de un «triángulo dorado», integrado por: i) la flexibilidad en la relación de trabajo, destinado a facilitar el despido; ii) un sistema generoso de prestaciones por desempleo, financiado fundamentalmente por el Estado; y iii) una nueva política de «activación» del mercado de trabajo que busca mantener a grandes sectores de la población permanentemente capacitados para afrontar nuevos retos laborales. El autor recalca la diferencia entre nuestro país y Dinamarca, pues se trata de un Estado de Bienestar, con un elevado nivel de protección social financiado gracias a una presión fiscal y tasas impositivas altas. Finalmente, el artículo señala que para el estudio de la «flexiseguridad» no se debe omitir el marco normativo derivado de los derechos fundamentales del trabajador establecidos en la Constitución y los tratados internacionales que implica: el derecho al trabajo, la dignidad y ciudadanía del trabajador y la Libertad Sindical y los Derechos Colectivos.

Full textWhen the European social dialogue is celebrating the twentieth anniversary of its institutional recognition in the Maastricht Treaty, analysing the role of the European social partners in the employment regulation which now facing significant changes within the EU is of peculiar relevance. Our study establishes that the making of the European labour market differs from an addition of national scales. We demonstrate that this construction is not mechanically induced by the goods market integration but partly results from the European social partners’ involvement in the Community employment regulation and from their interactions with the other stakeholders, mainly the European commission. Experimenting new forms of regulation reinforces the European social partners’ legitimacy. It widens their scope of intervention and maintains them in the Community regulation process whereas other players (civil society, groups of experts) could have drawn them aside. In However, because of the evolution of the employment paradigm on behalf of the “modernization of the labour market”, the European social partners now deliberate on more general terms (“more and better jobs”, “inclusive labour markets”) at the expense of operability. This limited operability is all the more problematic as the lack of deepening in the regulation of the employment relationship opens the door to cases of social dumping. Therefore, the impact of European social dialogue is more tested by the evolutions of the subject of regulation than by the new forms of regulation

Full textUnlike her European counterparts, Britain did not sign the Social Charter in 1989 and benefited from an opt out of the social rights included in this Charter until 1997. When the first New Labour government came into office, Tony Blair put an end to this British opt out. The Labour Party, which had been against the British entry into the EEC in the seventies, managed to convince its members to change their views on the European Union two decades later thanks to this Charter. By signing the Treaty of Amsterdam in 1997, the UK adopted the Social Charter and accepted the changes brought by the “Social Chapter” included in the Treaty. The Treaty of Amsterdam also introduced the European Employment Strategy. Since then, the UK has endorsed the Social Charter and implemented a range of UE social measures. Despite social policies, the UK compared to its European partners is considered as “the Anglo-Saxon model” available in the US because Margaret Thacher's economic policies have not been deeply modified and at the European level, there are British particularities as far as labour law and industrial relations are concerned. Yet despite such disparities, the European Council considered in 2002 that the employment policies carried out in the UK were in accordance with the European Employment Strategy. This thesis examines how the European Employment Strategy is operating in the UK. The analysis focuses on how the European guidelines are implemented in the UK labour market regulation. The aim is to shed light on a paradox: on the one hand, the UK labour market has its own specificities which are not similar to other European countries; and on the other, the employment policies pursued in the UK comply with the European guidelines within the European Employment Strategy
