Abstract:
Som så mange andre parlamenter har Folketinget gjort sig bemærket som en aktiv international aktør. Selvom udenrigspolitik formelt er et regeringsanliggende, er kontakten til udlandet en fast del af arbejdet i Folketingets udvalg, delegationer, partier og Præsidium. Dette “parlamentariske diplomati” opererer til tider uafhængigt af, men oftest i koordination med Udenrigsministeriet, der bl.a. bistår i planlægningen af udvalgsrejser. I denne kronik diskuteres, hvorvidt et mere strategisk samarbejde kan føre til en bedre udnyttelse af den diplomatiske kapacitet. Historien viser, at samarbejde mellem det ministerielle og det parlamentariske diplomati kan fungere godt, men at en balancegang kræves for at sikre, at hverken Folketingets autonomi eller regeringens udenrigspolitiske prærogativ sættes over styr. Tilrettelægges det ordentligt, kan et samarbejde dog være fordelagtigt for såvel Folketinget som for regeringen og Udenrigsministeriet.

En ekspertgruppe nedsat af Folketinget afgav i januar 2021 en rapport om regeringens covid-19 indsats i den første periode indtil nedlukningen af landet i marts 2020.i Rapporten er baseret på skriftlige kilder, som gruppen har fået stillet til rådighed af administrationen, idet man kun i ringe udstrækning har foretaget egne undersøgelser herudover og kun rent undtagelsesvist hørt eventuelle vidner om de sagsforhold, der er undersøgt. Ekspertgruppen konstaterer, at der var modstand mod beslutningen i dele af embedsværket og konkluderer bl.a., at regeringen førte Folketinget og offentligheden bag lyset ved – uden forbehold – at foregive, at beslutningen om en nedlukning af landet havde støtte i ”myndighedernes anbefaling”. I artiklen foretages en gennemgang af de fore- liggende oplysninger om indsatsen, og det konkluderes – modsat – at regeringen faktisk havde belæg for sin påstand, selv om det ikke var hele sandheden om den sag. Folketinget blev endvidere rent faktisk underrettet om sagens rette sammenhæng, og regeringen var ikke herudover forpligtet til at delagtiggøre offentligheden i interne faglige uoverensstemmelser myndighederne imellem.

Magistro darbas tema „Seimo struktūros ir darbo tvarkos (procedūrų) pagrindai ir lyginamieji aspektai“ susideda iš 4 dalių. Pirmoje dalyje atskleidžiama Lietuvos Respublikos Seimo, kaip Tautos atstovybės, samprata. Tik Seimas yra Tautos atstovybė, nes tik Seimo nariai yra tiesiogiai išrinki Tautos atstovai. Jokia kita valstybės institucija ar joks kitas valstybės pareigūnas nėra Tautos atstovais. Tauta jai priklausančią suverenią galią vykdo per jos išrinktus Tautos atstovus ir tai reiškia, kad Seimo nariai priimdami įvairius sprendimus bei įstatymus išreiškia pačios Tautos, o ne niekieno kito, valią. Antroje magistro darbo dalyje aptariama Lietuvos Respublikos Seimo struktūros ir darbo tvarkos konstitucingumo ir įstatyminio reglamentavimo raida. Ši raida atskleidžiama aptariant 1990 – 2008 metų Aukščiausiosios Tarybos ir seimų struktūrą bei darbo tvarko pagrindus. Kiekviename šios darbo dalies skyriuje pateikiamos Konstitucijos ir Seimo statuto normos, kurios reglamentavo ar reglamentuoja parlamento struktūrą ir veiklos pagrindus. Aptariami aukščiau paminėtų teisės aktų pakeitimai, kurie nuolat tobulino ir darė Seimo darbą vis efektyvesniu. Trečioje magistro darbo dalyje nagrinėjami diskutuotini klausimai, susiję su Lietuvos Respublikos Seimo struktūros ir darbo tvarkos pagrindais. Pirmame šios darbo dalies skyriuje diskutuojama dėl tam tikrų frakcijų statuso klausimų. Išaiškinama, kas yra frakcija ir ar pasikeitė frakcijos samprata nuo 1990 metų. Be to, nagrinėjama kas gali... Master work „Structure‘s and working procedure‘s grounds of the Seimas and comparative aspects“ consists of four parts. In first part is presenting conception of Seimas of the Republic of Lithuania, like Nation’s institution. Only Seimas is Nation’s institution, because only members of Seimas are directly elected Nation’s representatives. Neither other state’s institution or state’s officer are not Nation’s representatives. Nation its sovereign power executes though directly elected Nation’s representatives. That means that members of Seimas, accepting various decisions, express Nation’s will. In second part of master work is discussing development of structure’s and working procedure’s grounds of Seimas of the Republic of Lithuania. This development includes structure’s and working procedure’s grounds of Supreme Council and seimas of the period of 1990 – 2008. In every chapter of this part are presented regulations of Constitution and Statute of Seimas, which regulated or regulate structure’s and working grounds. In this part of the master work also are discussed Constitution’s and Statute’s of the Seimas regulations’ changes, which constantly improved and made the work of the Seimas more effective. In third part of master work are presented discussed problems, which are related with structure’s and working procedure’s grounds of Seimas of the Republic of Lithuania. "stagnation, and they used the carrot of the advantages of a single market to try to convince the sceptics. As the next chapter will show, the SEA foreshadowed virtually the entire contents of the later Maastricht Treaty on European Union, but ratification of the latter was much more difficult once the detail was spelled out. Any notion that Maastricht could somehow have been brought forward by five years is quite unreal. Whilst ratification by all members, including Portugal and Spain who joined the Community on 1 January 1986, was never in any real doubt, the Danish Parliament or Folketing actually rejected the Treaty – a decision overturned by a subsequent referendum. With the ratification of the SEA, Community developments become part of contemporary history. As our own perspectives shift, analysis of cause and effect becomes that much more difficult. In the period between the SEA and the Treaty on European Union, the major internal factor affecting the Community was the commitment to implement the single market. The way in which the idea of the single market captured public imagination is unrivalled by any other Community initiative since its beginning in the fifties. Some excitement was even generated by the notion of implementation by a particular year. Back in Chapter 2 reference was made to functionalism, and also to some of the early academics who wrote about the integration process. According to Ernst Haas, the functional approach to integration was all about the transfer of loyalties and expectations from the nation states to the new supra-national institutions. Some thirty years later, the single market initiative is almost a classic of functionalist strategy. In the immediate aftermath of the signature and ratification of the SEA, the major task was to bring about implementation of the single market by the end of 1992. The single market programme involved a vast amount of technical work leading to a plethora of legislative measures. This in turn brought the Commission back to centre stage perhaps for the first time since the crises of the mid 1960s. At the time of the Milan European Council, the Commission had presented a white paper on the implementation of a single market. With the signature of the new treaty, it fell to the Commission to draft some 300 legislative measures and to seek to steer them through the Council. This process was to mark the emergence of Delors as a major ‘player’ in the Community and as perhaps the most significant President of the Commission: certainly the first to become almost a ‘household name’. A major obstacle to implementation of the single market was posed by the economic gap between richer and poorer states.
