В даній магістерській кваліфікаційній роботі обґрунтовано актуальність теми, її значущість, визначено об’єкт та предмет дослідження, перелік використаних методів дослідження, а також розкрито теоретичні, методичні та фінансові основи державного регулювання фінансових аспектів зовнішньоекономічної діяльності на прикладі ТОВ «ХЕКСА». Актуальність теми роботи зумовлена потребою удосконалення аспектів зовнішньоекономічної збутової діяльності як одного із найважливіших напрямків покращення фінансового стану підприємства та економічного зростання загалом. Метою написання магістерської кваліфікаційної дипломної роботи є дослідження теоретико-методичних положень та розроблення практичних рекомендацій з удосконалення аспектів зовнішньоекономічної збутової діяльності на прикладі ТОВ «ХЕКСА». Для дослідження цієї мети в роботі вирішено такі основні завдання: - узагальнено теоретичні підходи до визначення сутності зовнішньоекономічної діяльності, згрупровано фактори впливу на ефективність зовнішньоекономічної збутової діяльності; - представлено характеристику особливостей діяльності ТОВ «ХЕКСА» та здійснено аналіз його фінансового стану; - досліджено сильні і слабкі сторони, а також можливості і загрози щодо розвитку зовнішньекономічної збутової діяльності ТОВ «ХЕКСА»; - розроблено пропозиції щодо управління ціновою пропозицією ТОВ «ХЕКСА» на основі точки беззбитковості для освновних експортних позицій ТОВ «ХЕКСА»; - сформовано складові алгоритму хеджування валютного ризику для ТОВ «ХЕКСА» в процесі здійснення зовнішньоекономічної діяльнсоті; - визначено вплив реалізації запропонованих заходів на результати фінансово-економічної діяльності ТОВ «ХЕКСА».
In this master's qualification work, the relevance of the topic, its significance, the object and subject of the research, the list of research methods used, as well as theoretical, methodical and financial bases of state regulation of financial aspects of foreign economic activity on the example of Hexa LLC are substantiated. The relevance of the topic of work is due to the need to improve aspects of foreign economic activity as one of the most important areas for improving the financial condition of the enterprise and economic growth in general. The purpose of writing a master's qualification diploma thesis is to study theoretical and methodological provisions and to develop practical recommendations for improving aspects of foreign trade marketing activity on the example of Hexa LLC. In order to investigate this goal, the following main tasks are solved in the work: - generalized theoretical approaches to determining the nature of foreign economic activity, grouped the factors of influence on the effectiveness of foreign economic sales activity; - the characteristics of the activities of Hexa LLC are presented and its financial status is analyzed; - Strengths, weaknesses, opportunities and threats to the development of foreign economic activity of Hexa LLC were investigated; - proposals for managing the price offer of Hexa LLC based on the break-even point for the main export positions of Hexa LLC were developed; - the components of the currency risk hedging algorithm for Hexa LLC in the process of foreign economic activity are formed; - the impact of the implementation of the proposed measures on the results of financial and economic activities of Hexa LLC has been determined.

Abstract:
Germany’s economic dominance in Europe, generous investment incentives, and technical manufacturing prowess has encouraged an influx of Chinese-led inbound activity, concentrated in high-tech sector mergers and acquisitions. A close examination of these M&As yields evidence of systemic Chinese state-financing through both state-owned and private vehicles that likely stems from China’s “Made in China 2025” policy, which hopes to stem capital outflow and to indigenize technological innovation. As Germany braces for what it sees to be continuous attempts by China to take patented German technology through M&As, it worries that Chinese patent law will allow for rampant patent infringement by copycat Chinese entities. This paper presents an overview of the root causes of China’s heavy economic activity in Germany, as well as an analysis of the legal concerns held by German firms based on a close reading of the Patent Law of the People’s Republic of China and strategic recommendations for German companies hoping to work with or in China.

Офшорна фінансова діяльність посідає значне місце у глобальній фінансовій системі, спостерігається суттєве зростання обсягів офшорних операцій та зростання кількості офшорних фінансових установ. Зважаючи на широке використання офшорів вітчизняними підприємцями та значні масштаби відтоку капіталу з економіки України в офшорні зони, дослідження негативного впливу офшорів на національну економіку та знаходження шляхів вирішення даної проблеми на сьогоднішній день є особливо актуальними. У роботі надана характеристика теоретичних засад офшорних зон, розглянуті принципи, покладені в його основу, даються різні класифікації офшорних зон, їх функціональне призначення. Описані цілі створення офшорних зон його переваги та недоліки. Розглянуті особливості функціонування офшорних юрисдикцій в сучасних умовах. Надані основні напрямки протидії негативним наслідкам діяльності офшорних юрисдикцій, наведені проблеми функціонування офшорного бізнесу і можливі шляхи їх вирішення.
The object of study of the master's thesis is the mechanism of functioning of offshore zones, the subject - financial relations that arise in the process of financial and economic activities of offshore zones and their impact on the economy. The methodological basis of the work is a systematic approach and a dialectical method. In addition, the methods of unity of historical and logical, comparative analysis, induction and deduction, as well as positive and normative approaches were used in the work. Results: the essence of the concept and history of offshore zones development is considered, the specifics of separate offshore zones and their characteristics and specialization are studied, advantages of doing business in offshore zones are allocated, the problems connected with capital migration to offshore zones are opened, problems of offshorization and deoffshorization of domestic business. The theoretical significance of the master's thesis is to justify the need to regulate national legislation on the deoffshorization of business in the country. The practical significance of the work lies in the generalization and systematization of a large array of statistical data, recommendations and proposals of scientists, specialists dealing with the problem of offshorization and deoffshorization in modern conditions. In the near future, the role of offshore zones in the world economy will weaken as more countries join the organization to combat further offshorization of business through various agreements.

Проведений аналіз відмітних рис ринкової координації. У дисертації вводиться новий методологічний принцип індивідуалістичного релятивізму. Досліджена роль суб’єктних та позасуб’єктних оцінок у процесі діадичної міжсуб’єктної взаємодії. Проаналізовані два підходи до інтерпретації мети та припустимих меж конкуренції. Досліджені особливості суб’єктного оцінювання на ринку кінцевих благ. Розроблена модель ринку кінцевих благ, розділеного на цінові категорії. Розглянуті передумови стійкості цінових категорій. Досліджений механізм впливу продавця на свідомість покупця за рахунок зміни референтної точки та поля вибору. Розглянутий процес розподілу спільно створеного продукту між учасниками виробництва. Проаналізована роль суб’єктних та позасуб’єктних оцінок у розподілі спільно створеного продукту. Досліджений процес інституціоналізації оцінок. Запропонована модель ринку праці, яка включає суб’єктне оцінювання. Аналізуються проблеми відтворювально-ефективного розподілу спільно створеного продукту. Встановлені принципи ефективного комбінування ринкового саморегулювання та державної політики з метою забезпечення сталого розвитку. Розроблені концептуальні моделі реформи пенсійного забезпечення та реформи регулювання зовнішньоекономічної діяльності
Проведен анализ отличительных черт рыночной координации. Исследована терминологическая нестрогость содержания категорий “рынок” и “рыночное”. Выявлена возможность исследования рыночной координации на уровне диадического межсубъектного взаимодействия. В диссертации вводится новый методологический принцип индивидуалистического релятивизма, включающий внутренне-компаративное и внешне-компаративное субъектное оценивание. Исследована роль субъектных и внесубъектних оценок в процессе диадического межсубъектного взаимодействия. Проанализированы эгоистический и интегративный подходы к интерпретации целей и допустимых пределов конкуренции. Исследованы особенности субъектного оценивания на рынке конечных благ. Разработана модель рынка конечных благ, разделенного на ценовые категории, включающая субъектные оценки покупателей и продавцов. Рассмотрены предпосылки устойчивости ценовых категорий с учетом различной ценовой эластичности спроса для разных ценовых категорий. Исследован механизм влияния продавца на сознание покупателя за счет изменения точки сравнения и поля выбора. Выявлено, что в условиях среды, контролируемой продавцом, покупатель утрачивает суверенитет при совершении покупок. Рассмотрен процесс распределения совместно созданного продукта между участниками производства. Проанализирована роль субъектных и внесубъектных оценок в распределении совместно созданного продукта. Выявлены угрозы нарушения паритета в отношениях между участниками совместного производственного процесса и появления перераспределительной власти за счёт манипулирования субъектными оценками контрагента. Исследован процесс институционализации оценок, предполагающий игнорирование промежуточных причинно-следственных связей при оценивании предметов или явлений. Предложена модель рынка труда, которая включает субъектное оценивание работником возможных последствий прекращения контракта с работодателем. Выявлены объективные предпосылки смещения экономической власти во взаимодействиях типа “работник – работодатель” в пользу работодателя с последующей гиперэксплуатацией наиболее квалифицированной части рабочей силы. Анализируются проблемы воспроизводственно-эффективного распределения совместно созданного продукта применительно к воспроизводству рабочей силы. Изложена концепция пенсионной реформы, учитывающая участие пенсионера в воспроизводстве будущих поколений и учитывающая специфику субъектного оценивания. Выявлена специфика концентрации политической власти в условиях манипулирования субъектными оценками участников политического процесса. Установлены принципы эффективного комбинирования рыночного саморегулирования и государственной политики с целью обеспечения устойчивого развития. Разработана концептуальная модель реформы регулирования внешнеэкономической деятельности, включающей аукционную продажу квот на вывод иностранной валюты за пределы Украины. Проанализированы возможности этой реформы по регулированию платёжного баланса и предотвращению кризисов, вызванных валютными шоками
The analysis of the characteristic features of market coordination is carried out. A new methodological principle of individualistic relativism is introduced in the paper. The role of subject and out-of-subject estimations in the process of dyadic interaction between subjects is studied. Two approaches to the interpretation of the purpose and permissible levels of competition are distinguished. Peculiarities of subject estimations on the market of final goods are investigated. The model of market divided into price categories is suggested. Preconditions of price categories sustainability are reviewed. The mechanism of sellers’ impact on the minds of customer by changing the reference point and field of selection is investigated. The process of sharing of common product between participants of production is considered. The role of subject and out-of subject estimations in product distribution is examined. The process of estimations’ institutionalization is reviewed. The model of labour market regarding subject estimations is suggested. Problems of reproductive efficiency of common product distribution are analyzed. Principles of effective combining of market self-regulation and public policy to ensure sustainable development are discussed. Conceptual models of pension reform and foreign economic activity regulation reform are worked out.

This work presents a fully operational interstate CGE model implemented for the Brazilian economy that tries to quantify both the role of barriers to trade on economic growth and foreign trade performance and how the distribution of the economic activity may change as the country opens up to foreign trade. Among the distinctive features embedded in the model, modeling of external scale economies, port efficiency and land-maritime transport costs provides an innovative way of dealing explicitly with theoretical issues related to integrated regional systems. In order to illustrate the role played by the quality of infrastructure and geography on the country‟s foreign and interregional trade performance, a set of simulations is presented where barriers to trade are significantly reduced. The relative importance of trade policy, port efficiency and land-maritime transport costs for the country trade relations and regional growth is then detailed and quantified, considering both short run as well as long run scenarios. A final set of simulations shed some light on the effects of liberal trade policies on regional inequality, where the manufacturing sector in the state of São Paulo, taken as the core of industrial activity in the country, is subjected to different levels of external economies of scale. Short-run core-periphery effects are then traced out suggesting the prevalence of agglomeration forces over diversion forces could rather exacerbate regional inequality as import barriers are removed up to a certain level. Further removals can reverse this balance in favor of diversion forces, implying de-concentration of economic activity. In the long run, factor mobility allows a better characterization of the balance between agglomeration and diversion forces among regions. Regional dispersion effects are then clearly traced-out, suggesting horizontal liberal trade policies to benefit both the poorest regions in the country as well as the state of São Paulo. This long run dispersion pattern, on one hand seems to unravel the fragility of simple theoretical results from recent New Economic Geography models, once they get confronted with more complex spatially heterogeneous (real) systems. On the other hand, it seems to capture the literature‟s main insight: the possible role of horizontal liberal trade policies as diversion forces leading to a more homogeneous pattern of interregional economic growth.

Abstract:
This thesis examines the regulation of parallel imports of trade marked goods in the European Community (EC), demonstrates its deficiencies and advocates its amendment by the Community legislator. The thesis identifies as a primary characteristic of the regulation the bifurcation of intra-EC and extra-EC parallel importation, that is to say, the fundamental divergence of the regimes of parallel imports coming from another EC Member State and imports coming from third countries.  The split as to the rationale, justification and outcome of the two regimes is so substantial that it is viewed as the existence of ‘parallel regulations on parallel trade’ in the Community. The study establishes four different manifestations of this bifurcation, the most evident one concerning the fact that while internal imports are lawful under EC law, external ones could be repelled by the mark owner as trade mark infringement.  It is submitted that this variable legal tolerance to parallel trade has been legitimised through the Community rule of limited, regional exhaustion of trade mark rights and the manner in which the European Court of Justice has interpreted its application. Against this background, the thesis raises three groups of legal arguments for reviewing the current Community exhaustion policy and implementing a rule of international trade mark exhaustion.  They relate to trade mark law, competition law and certain proclamations of the importance of free unrestricted global trade, made by the Community on international level and in the EC context as well. Finally, the study complements the above legal arguments with socio-economic justifications in support of international exhaustion.  The research suggests that the Community should consider the implementation of international trade mark exhaustion and carry out the necessary preparatory steps outlined by the study in this regard.

Abstract:
The relationship between law, foreign direct investment (FDI) and development is a neglected area of investigation, and this study seeks to contribute to the understanding of that relationship through an analysis of the legal regulation of FDI in Kuwait. As well as offering a general theoretical appraisal of the role of FDI in development, it puts forward some practical proposals for legislative innovation and administrative reform in Kuwait with the intention of showing how greater encouragement can be given to the expansion of FDI with a view to promoting the country's future economic and social well-being. The approach in this thesis stresses the importance of considering the effectiveness of Kuwait's FDI regulations against the background of the country's historical evolution and in relation to the distinctive patterns of political economy which have emerged in Kuwait's twentieth-century transformation from a traditional to a more modern society with an impressive level of welfare provision. In this respect, considerable attention is given to the significance of the various oil concession agreements between Kuwait and foreign investors for the exploration and marketing of oil. It is these agreements which have led directly to the growth and development of the country's current FDI regulations, and which have gradually enabled Kuwait to determine its own foreign investment policies as British influence has declined and national independence has been gained. Criticisms are offered, however, of the failure of Kuwait to pay sufficient attention to the role of FDI in the non-oil sectors of the economy. The close examination of the law and administrative practice of FDI in Kuwait reveals a range of failings and inadequacies which have tended to have a negative effect on the attraction of FDI. This particular area of policy in Kuwait has developed in a somewhat piecemeal fashion without sufficient coherence and co-ordination.

Abstract:
This study examined the impact of trade liberalisation on Kenya. It analysed the influence of trade liberalisation on trade creation, trade diversion, exports, imports, revenue effects and welfare effects. The developments in trade liberalisation and free-trade economic arrangements were introduced in Kenya and many developing countries in the early 1980s and strengthened from 1990s onward. The short term effects of the structural-adjustment programs were characterised by poor balance of payment conditions, high levels of unemployment, contraction of the imports from other countries, and government revenue losses, among other social problems. Notwithstanding the dismal performance of the Kenyan Economy after liberalisation, the Kenyan government continued to liberalise its trade under various frameworks such as the Economic Partnership agreements (EPAs) with the European Union, the World Trade Organization (WTO) and various bilateral free-trade agreements (BFTA) with its largest trading partners. This study used the World Integrated Trade Solutions-Software for Market Analysis and Restrictions on Trade (WITS/SMART) using 2008 as the base year. This method was used mainly because of its strengths to analyse the tariff effects of a sole market on disaggregate product lines. In addition the WITS/SMART model is able to analyse the impact of trade liberalisation in scenarios of imperfect substitutes. Hence, this study used the WITS/SMART Model to examine the trade liberalisation framework for Kenya under comprehensive implementation of COMESA customs Union, COMESA FTA, WTOFTA and the EPAs. The comparative valuation of the trade-creation effects reveals that the WTOFTA expected the highest trade-creation effects of US$995.16 million. This was followed by the various bilateral free-trade agreements which had a trade-creation effect of US$333.04 million, then COMESACU which had a trade-creation effect of US$310.50 million followed by the EPAs with a value of US$129.45 million. COMESA FTA was expecting trade-creation effects valued at US$15.51 million. These trade-creation effects are expected to cause unemployment through de-industrialisation. This study has also noted that WTO FTA and COMESA CU had no evidence of trade diversion. However, BFTA, EPAs and COMESA FTA showed evidence of trade diversion of US$134.88 million, US$89.28 million and US$2.61 million respectively. This study also examined the possible revenue effect from the free-trade agreements and customs union. It was noted that most losses emanated from the WTOFTA, which was valued at US$817.15 million. This was followed by the COMESACU protocol, which is expected to register a loss amounting to US$327 million. The third free-trade agreement with the highest losses comprised the various BFTAs amounting to US$304 million. The forth probable losses were anticipated from EPAs amounting to US$142 million. The free-trade agreement with the least losses is COMESA FTA with an expected loss of US$7.88 million. The consumer welfare effect was done to assess if consumers benefitted from trade agreements. This study observed that the WTOFTA expected the highest consumer welfare effect of US$103.98 million. This was followed by the various COMESACU with an expected consumer welfare effect of US$56.27 million. The BFTA were the third with a consumer welfare effect of US$ 41.82 million. This was followed by the EPAs with a consumer welfare value of US$ 17.56 million. The trade protocol with the least-expected consumer-welfare effect was the COMESA FTA valued at US$ 1.60 million. Although welfare gains resulting from the anticipated trade agreements were an indication of potential benefits to Kenyans, they were insignificant. This study also analysed the export performance from five different trade agreements and their impact on Kenya. The BFTA expected an export value US$4.63 billion, followed by the EPAs with an expected export value of US$2.18 billion. The third largest export values was WTOFTA with an export value of US$12.12 billion, the fourth being COMESAFTA having an export value of US$ 434.28 million and finally COMESACU with an expected export value of US$394.14 million. The study showed that major exports were composed of minerals, tobacco and agricultural products dominating the export basket. The export destinations were expected to be the WTO members, which include Uganda, Congo, Egypt, Rwanda, Sudan and Zambia. Kenya expected an increase in imports mainly from the WTO amounting to 8.95 per cent. This was followed by the BFTA rated with an expected 3.2 per cent growth in imports. The third protocol expecting import growth was the COMESACU of 2.8 per cent import growth and the EPA with 1.16 per cent import growth, and finally, 0.07 per cent import growth from the COMESA FTA. The expected increase in imports is anticipated to create balance of payment problems for Kenya. The results of the study show that the welfare gains from trade liberalisation were not able to compensate for the revenue losses. The study also showed that Kenya was not able to make optimal use of trade liberalisation to expand its export destinations; as the COMESACU was expected to reduce exports. In light of these findings, the study recommends that measures aimed at boosting exports like strengthening of the Export Processing Zones, export subsidies, the establishing of supply-side facilities, trade financing plus strengthening of the export-supporting institutions. It is important to note that the findings of this study provide an opportunity for Kenya, and other developing countries, to implement measures to ensure that they achieve optimal benefits from the various regional trade agreements.

Основной целью этого исследования является разработка рекомендаций по повышению конкурентоспособности предприятия на международной арене и улучшению финансовых результатов путем внедрения правовых инструментов налоговой оптимизации ВЭД и оценки эффективности расчетов по внешнеэкономическим договорам.

This study unveiled the trade-environment debate which has been revolving in the World Trade Organization for quite a long time now. While economic integration and trade liberalization offer the promise of growth and prosperity, environmentalists fear that free trade will lead to increased pollution and resource depletion. On the other hand, free traders worry that over-reaching environmental policies will obstruct efforts to open markets and integrate economies around the world. Trade liberalization has the potential to affect the environment both positively and negatively. Trade and environment tensions have therefore emerged as a major issue in the debate over globalisation. This paper examined the contours of these tensions and argued that trade policy and environmental programs can be better integrated and made more mutually supportive.

Преступная деятельность в сфере экономики представляет большую опасность для государства. Борьба с этим общественно опасным явлением составляет одно из первоочередных задач. Среди насущных проблем современности одним из важнейших и сложных для общества вопросы противодействия преступности в сфере экономики. Анализ криминогенной ситуации в Украине свидетельствует, что преступления в сфере экономики, распространенность которых достаточно велика, становятся препятствием социально-экономическим реформам, повышению благосостояния населения, стабильности, развития государства и его национальной безопасности.
Criminal activity in the field of economics represents a great danger to the state. The fight against this socially dangerous phenomenon is one of the priorities. Among the pressing problems of our time one of the most important and difficult issues for society is combating crime in the economic sphere. Analysis of the crime situation in Ukraine shows that crimes in the economic sphere, the prevalence of which is quite large, become an obstacle to socio-economic reforms, improving the welfare of the population, stability, development of the state and its national security.

Resumo: Este estudo analisa a regulação dos regimes de investimento direito estrangeiro (IDE) no Brasil e o papel exercido pela política externa nacional. Objetiva-se verificar que espécies de medidas de tomada de decisão são capazes de garantir a potencialidade produtiva do investimento direto. A necessidade de atração do capital estrangeiro é surpreendida por conflitos próprios da política econômica adotada pelo Estado Brasileiro, bem como pela distribuição das relações de poder e riqueza no contexto do sistema internacional. A tese também questiona a amplitude da aplicação do Princípio da Não Discriminação, com o intuito de reavaliar o tratamento conferido ao capital estrangeiro ao longo de cada regime de investimento.
Abstract: This thesis analyses the rule of foreign direct investment (FDI) regimes in Brazil and the impact of the national foreign policy. Its purpose is to verify which choice processes are able to achieve the direct investment's productivity potential. The need to attract foreign capital can be surprise by inherent conflicts of national economic policies and by distribution of power and fortune relations under the international system's juncture. This paper also questions the width of Non Discrimination Principle's applicability in order to revalue the foreign capital's treatment during each FDI's regime.

У роботі досліджено вплив управління фінансовими потоками на розвиток та функціонування українського підприємства з іноземними інвестиціями. Аналіз управління фінансовими потоками та капіталом здійснювався на базі підприємства АТ "Технологія". Проведений аналіз сучасного фінансового стану підприємства, та методи управління фінансами, капіталом та ризиками у проведенні господарської діяльності підприємства. Основною метою цього дослідження є розробка рекомендацій щодо поліпшення системи управління фінансами та залучення додаткового інвестиційного капіталу.
The paper examines the impact of financial flow management on the development and operation of Ukrainian enterprises with foreign investment. The analysis of financial flows and capital management was carried out on the basis of JSC "Technology". The analysis of a modern financial condition of the enterprise, and methods of management of finances, the capital and risks in carrying out economic activity of the enterprise is carried out. The main purpose of this study is to develop recommendations for improving the financial management system and attracting additional investment capital.
