Abstract:
Law enforcement, lawmakers, and the public are increasingly concerned about how people with mental illness are treated within the criminal justice system. This chapter focuses on the role of public psychiatrists in the provision of timely evaluation, expertise, and care for individuals in custody—particularly for individuals with serious mental illnesses. A case-based discussion illuminates important aspects of the legal and health care challenges facing individuals at the time of arrest, arraignment, incarceration, trial, and community re-entry. The chapter discusses mental hygiene law, criminal procedure law, advocacy, and the formation of policy with an emphasis on fitness to stand trial. Appropriate diversion of individuals with mental illness from incarceration, and its role in helping these individuals to achieve recovery, is explored in detail.

Abstract:
This chapter represents a first effort at exploring ethics concerns at the intersections of forensic psychiatry and religion. It surveys several areas where this convergence occurs: criminal cases in which religious delusions of the defendant figured prominently in the defense; civil cases involving the right to refuse treatment secondary to religious beliefs; the complexities of applying empathy to forensic evaluations where the physician’s task is not focused on healing the individual; the challenges of permitting certain forms of religious practice in maximum security forensic hospitals; and the interplay of constructs of forgiveness, reconciliation, remorse, and insight in treating persons found not guilty by reason of mental illness of serious, violent crimes. The choice of these particular topics is not meant to exhaust the conjunction of these interdisciplinary interests but hopefully provides a place to begin their consideration.

Abstract:
As people live longer and the aging population increases, the volume of court cases involving elderly persons has increased. For elderly persons in court proceedings, determinations of decision-making capacity predominate, owing to the high incidence of cognitive loss with aging. Another frequent issue is whether a decision is the result of influence from others. Specific matters at issue may include disputes about testamentary acts, need for conservatorship (guardianship), capacity to manage one’s affairs, as well as the full range of other civil and criminal actions. Elder abuse, including financial elder abuse and victimization by scams, continues to mushroom to epidemic proportions. Courts, therefore, increasingly require expert assistance for forensic matters involving the elderly. Existing training programs in geriatric psychiatry and forensic psychiatry, however, rarely provide adequate training in this crossover field. This chapter reviews the current status of such training programs, including fellowships, and discusses approaches to address this critical and growing need for professionals with both geriatric and forensic psychiatry expertise.
