Abstract:
Cultural competence is an essential skill for the geriatric forensic psychiatrist. Much of psychiatry and the law is “culture-bound,” favoring individual-centered analyses over consideration of social and cultural context. While this has worked reasonably well for relatively homogeneous, dominant cultures within Western (i.e., North American or European) societies, it is growing less viable as populations grow more pluralistic with widely variable means of organizing the world and their place in it. Furthermore, not only does culture shape meaning and significance for the individual, it determines the causes, manifestations, and final course of many major psychiatric disorders. Therefore, in order properly to assess a person’s state of mind in competency or criminal responsibility cases, to evaluate the likelihood of restorability, to explain mitigating factors, or to gauge the appropriateness of treatment programs, cultural considerations must come into play. This chapter discusses the elements of cultural competence and its practice, through case vignettes, and how this can translate into choice and resilience for the client, especially the elderly individual.

Abstract:
Social Work, Criminal Justice, and the Death Penalty aims to prepare undergraduate and graduate students to take an active role in the contemporary death penalty discourse in the United States by providing key insights from professionals who are engaged as legal, forensic, academic, and social work experts. In this textbook, contributing authors write accessibly from their own experiences and expertise in death penalty cases and related social issues from a critical, social justice, and human rights perspective—all intended to better inform the burgeoning social work and criminal justice professional. To this end, the present textbook is comprised of three sections: Criminal Justice Considerations, Sociopolitical Considerations, and Applied Social Work Considerations. Across the three sections, each chapter provides explicit implications for the social work profession in the criminal justice setting. Examples of the various roles that social work professionals can and do take up related to the death penalty, including working directly with death sentenced persons and their families; participating in mitigation work; contributing to the field of research devoted to the intersections of mental health and the criminal justice system; as clinically licensed social workers, by engaging in the critical discourse that is being had between the psychiatric and psychological professions and the legal profession when death eligibility hinges on a clinical determination; and, finally, using social advocacy and policy practice to take up the death penalty from a social justice framework.

Abstract:
Mental health professionals frequently participate in the disability application process. Standards and requirements for a finding of disability may vary considerably from one context to another. A disability carrier may request that a mental health professional perform an independent medical examination. This chapter discusses the concepts of work capacity, functional impairment, and disability as they apply to disability evaluations performed for the most common types of disability insurers (Social Security, workers’ compensation, and private insurers), as well as work-related evaluations involving the Americans with Disabilities Act, fitness for duty and return to work, and disability in the context of litigation. Ethical issues in performing disability evaluations are addressed, including differences in the roles of the treating clinician and the independent forensic evaluator and management of situations where the evaluator’s opinion differs from that of the claimant and the claimant’s attorney.

Abstract:
This book presents the definition of legal psychology as an area of specialization within general psychology and some of the applied fields that constitute the work of the professional who is concentrating on this area of expertise. Its objective is to present, indirectly, a different approach to the forensic one, which seeks to clarify, both to the expert and to the layman, that judicial court is not the only scene in which legal psychologists can work. The chapters correspond to academic products that illustrate the lines of research that have been developing in parallel with the exercise of the law and the function of justice management, related to intervention or approaching victims, criminals, witnesses and people in judicial conciliation processes, as well as intervention with children and adolescents in vulnerable social and family conditions to contribute to the restoration of their rights.

This introductory chapter begins with a background on the television series Prime Suspect, which chronicles the life and career of Jane Tennison (Helen Mirren), a detective chief inspector and later a detective superintendent for the London Metropolitan Police. Beyond its worldwide popularity, Prime Suspect is a pathbreaking series because it centers a strong woman lead in a gritty portrayal within what had been an otherwise overwhelmingly male-dominated police procedural subgenre. The series has shaped also the police procedural subgenre by setting higher standards for conveying a sense of social realism in the coverage of police work and, more specifically, what media analysts call “forensic realism.” The remainder of the chapter presents a brief history of the crime genre and women's place as well as a brief history of how television has portrayed women more generally. It concludes with an overview of the subsequent chapters is also presented.
