Full textIn 2006 a new law governing insurance contracts went into force. The new law brought among other things a few changes regarding what the insurance takers has to inform the insurance companies about when they want to buy insurance. This essay clarifies the current legal situation regarding this duty. The essay analysis both the extent of the duty as well as the legal consequences one might face if the duty is not fulfilled. The information an insurance taker is forced to give to the insurance company can be divided into two separate groups. The first group contains the kind of information that has been requested by the insurance company. In this case the insurance taker has to give the information to the company if the information is important for the company while calculating the risk. The second group contains the information the insurance taker has to give to the insurance company even if it does not request it. In this case the insurance taker has to inform the insurance company of circumstances that for an ordinary insurance taker are of obvious importance for the risk calculation. In order for there to be any consequences for the insurance taker when this duty is not fulfilled there has to have been some kind of carelessness from the insurance taker. In effect this means that the insurance taker is only obliged to inform the insurance company about circumstances it should have known. There are four possible consequences for the insurance taker when this duty is not fulfilled. If it would be in conflict with belief an honor to invoke the contract or if there has been actions equivalent to fraud the contract is deemed void. In other cases the insurance payment is reduced in accordance to the pro rata principle or by the principle of causality. The insurance company also has the right to give notice of dismissal of the contract.

Full textEtt av de flygplan som flögs in i World Trade Center i New York, USA, den 11 september 2001 lyfte från Bostons flygplats. Säkerheten på flygplatsen var Globe, ett bolag i Securitaskoncernen, ansvarigt för. Securitaskoncernen, däribland Globe, ville med anledning av att ett antal skadeståndsanspråk, som följde efter attacken den 11 september 2001, ha försäkringsskydd ur det globala försäkringsprogram som Securitaskoncernen tecknat hos If Skadeförsäkring AB. Ett skiljeförfarande inleddes mellan If och Securitas på grund av att If ansåg att försäkringen inte gällde Globe, medan Securitaskoncernen ansåg att den gjorde det. I uppsatsen granskas tvisten och skiljedomen mellan If och Securitas kritiskt. Uppsatsens fokus ligger på de yrkanden i tvisten som gällde försäkringsavtalstecknande och jämkning av försäkringsersättningen. Även tillämpligheten av krigsundantaget i försäkringsvillkoren behandlas. Försäkringsmäklarens roll och premie-pro-ratas storlek skulle ha kunnat leda till en annan utgång i målet varför även dessa aspekter tas upp i uppsatsen i samband att talans upplägg behandlas. Hur premie-pro-rata kan beräknas i globala ansvarsförsäkringsprogram tas upp liksom förslag lämnas på hur pro-ratans storlek i det aktuella målet skulle ha kunnat fastställas. I uppsatsen lämnas vissa förslag på vad underwriters bör beakta i sitt arbete. Förslagen har arbetats fram utifrån den skiljedom som fastslogs mellan parterna, exempelvis vad gäller försäkringsvillkor.

Full textToday, the manufacturing companies are facing high demands as new strategies towards resource efficiency are continuously being developed. Customers expect quick deliveries of unique and highquality products. The meaning of resource efficiency is that the company reduces unnecessary use of resources. There is an increased focus on risk management and risk exposures. Risks cannot be eliminated, but they may be reduced through efficient risk management and extensive insurance programs. The aim of this bachelor thesis is to examine how corporate insurances contributes to resource efficiency for manufacturing companies. After Toyota’s Production Systems was developed in the 1950s, the industry has undergone extensive reorganizations from mass-producing to flow-efficient business strategies. The flow-efficient business strategy includes, for instance, complex international supply chains. Commonly, companies only consider the short-term effects of resource efficiency strategies, but they often overlook the longterm outcome of the different strategies. The aim of risk management is to reduce the company’s risk exposures – both regarding the likelihood of an accident, and also the magnitude of the consequences. The cost of risk reducing activities should not exceed the entailed profit from it. The balance between resource efficient production and risk reducing activities is essential for manufacturing companies. Measuring the safety level of a company is difficult, since it cannot be based solely on claims statistics. Instead the safety level should largely be based on the analysis of the efficiency of the company’s loss prevention work. Corporate insurance reduces the financial risk in the event of a loss. Insurances are based on the fact that a collective share the risks by paying a premium that is less than the possible cost of a potential loss. An insurable risk is a sudden and unforeseen event, which results in financial loss for the policyholder. The pricing of risks – the premium – is based on the estimated probability and the magnitude of the consequences of a loss event. The pricing also includesthe expenses of the insurance company such as administration costs, claims handling, etc. Insurances enable the policyholder to use their capital to value-creating activities. Common industrial risks can be categorized within, for example property-, business interruption-, liability- and personnel risks. Business Interruption risks often result in enormous costs and may cause the company to lose customers during the interruption period – or even go bankrupt. For this thesis, representatives for three multinational companies were interviewed. Two of them works within Risk Management at two of the largest global manufacturing companies in Sweden, and the third person works as a fire-/risk engineer at one of the largest northern insurance companies. The purpose of the interviews at the manufacturing companies was to find out how they think about risk management, their captives and external insurances. The purpose of the interview at the insurance company was to get an overall picture of how they think the insurance company contributes to resource efficiency. The conclusion of the thesis is that corporate insurance contributes to resource efficiency at manufacturing companies, the extensiveness of the contribution remains unclear – further studies on the subject are encouraged. However, the fact that insurance policies contributes to resource efficiency for assets, personnel, competence, time and attitude towards growth and innovation can be concluded.

Full textUppsatsen presenterar moralklausulen, som återfinns i företagsförsäkringsvillkor, vars syfte är attförhindra försäkringstagarens spekulation i sitt försäkringsskydd. Olika utformningar av klausulenjämförs och jag utreder dess förenlighet med lagtext för framkallande av försäkringsfall i 8 kap 11 och14 §§ NFAL, där slutsatsen är att förenlighet med lag avgörs i varje enskilt fall. Jag utreder även omskyldigheten att inte framkalla försäkringsfall är att se som en biförpliktelse, vilket den ses som iNFAL, men kommer fram till att den inte är att se som en sådan. I uppsatsen klargörs dessutom attmoralklausulen kan tillämpas gentemot andra försäkrade än den som har visat dålig moral. Härtillstuderas hur klausulen har tillämpats historiskt enligt GFAL och hur den tillämpas i enlighet medNFAL idag, varvid jag har funnit att tillämpningen är restriktiv och inte har ändrats i någon störreomfattning. Villkor som tar sikte på skador som sannolikt kommer att inträffa visar sig vidtillämpningen vara hårdare mot den försäkrade, än villkor som tar sikte på skador som oundvikligenkommer att inträffa. Slutligen utreds förhållandet mellan moralklausulen och begreppet oförutseddskada, eftersom det kan ifrågasättas varför ordet förutse används i två olika meningar i villkoren.Slutsatsen är att moralklausulen återfinns i villkorens undantagsbestämmelser, medan begreppetoförutsedd skada återfinns i omfattningsbestämmelserna och vi har att göra med två olika situationer.Vid tillämpning av moralklausulen tillmäts omständigheterna i det enskilda fallet större betydelse.
This thesis presents the 'moral clause', which appears in business insurance terms, with the purpose toprevent policy-holders from speculating in the insurance coverage. Different formulations of the'moral clause' are compared to one another and I investigate its consistence with the regulation ofcausing insurance claims, chapter 8, 11 and 14 §§ NFAL, where the conclusion is that consistencewith law has to be determined in each case. Furthermore, I investigate if the insured's obligation not tocause insurance claims is to be seen as an accessory obligation, which it is according to NFAL. Theconclusion is that it is not to be regarded as an accessory obligation. The thesis makes it clear that the'moral clause' can be applied towards other policy-holders than the insured who has acted immorally.It is analysed how the clause has been applied historically in accordance with GFAL, and how it isapplied in accordance with NFAL. I have found the application to be restrictive, and it has not changedsignificantly. Terms applicable to damages that are likely to occur has in practice shown to be tougheragainst the policy-holder, other than terms which applies to damages that will occur unavoidably.Finally the relationship between the 'moral clause' and the conception of unforeseen damage isexplained, since it has been questioned why the word foresee is used in two different sentences in theterms. The conclusion is that the 'moral clause' is found in the exclusion directions, while the conceptof unforeseen damage is found in the extent directions and we are dealing with two differentsituations. By the application of the 'moral clause', the circumstances of the individual situation are ofgreater importance.

Full textThis thesis combines mathematical statistics and industrial economics and management to investigate renewal rate and price sensitivity within commercial insurance. It is carried out through a case study at the insurance company If Skadeförsäkringar based on their Norwegian customers who received a renewal offer in 2014. The first part of this paper covers renewal rate whilst the second part covers price sensitivity related to price optimisation. The method used to examine renewal rate is logistic regression analysis. At a 95% significance level the prediction variables Commitment diversification, Duration, Price change, Premium volume, Size, Industry and Claim history are proven to be significant. Together these variables have a predictive power of 63.5%. Several qualitative variables, which are likely to explain the lack of complete predictive power, are discussed in this paper. A measure of price sensitivity is thereafter generated from the final regression model. Furthermore this measure of price sensitivity is connected to theories of price optimisation in insurance. These theories are based on a literature review and an interview with salesmen at If. The conclusion can be drawn that price optimisation in insurance is controversial and currently a matter in debate.
