A key argument in institutional theories of organization is that organizational forms are strongly influenced by widely held norms and ideas about the kind of organizational forms that are natural, correct, or desirable. Norms and ideas held in common constitute a major impetus to standardization; they promote similarities in many organizations, even those which conduct quite different types of production but which operate within the same culture or the same field. This chapter presents a ‘cropping-up’ model of standardization. It discusses the basic concepts underlying a ‘cropping-up’ model: forms, reforms, and organizational discourse. It describes how organizational forms are determined by the interaction between general discourse and local reform cycles. Finally, it the way in which local reforms may affect the norms expressed in the general discourse.

This article discusses written communications by international migrants across time, from immigrant letters to instant messaging. Chronologically, it ranges from the nineteenth century to the end of the twentieth century, and spatially, the focus is on the United States and those who migrated to or from the country. It covers the definition of an immigrant letter, particularly as it relates to systematic study of the genre, and some of the cultural associations bound to the term. It relates issues of literacy—who could write and how well—and the status of postal connections, how they influenced the production and distribution of correspondence by migrants. Other sections explore how scholars have used epistolary records by migrants as sources for various topics and in several disciplines, and types of analysis they use for both written and electronic communications, including e-mail. Finally, there are suggestions for further study of correspondence related to immigration.

Forms and methods of constitutional interpretation are less divisive in Italy than in the United States. In this chapter the interpretive style of the ItCC is described as “syncretistic” or “integrated” because the Court uses a combination of many different approaches to constitutional interpretation. The ItCC interprets the Constitution as a whole, as an integrated system, avoiding the fragmented interpretation of a single provision detached from the context and relationship with other principles, rules, and rights inscribed in the Constitution. This chapter also focuses on the concepts of reasonableness and proportionality, which are used synonymously in a way that is ancillary to many other constitutional principles, making them pervasive in constitutional adjudication. This chapter also studies the types of decisions of the constitutional court and their overall effects.

This chapter examines individuals’ career-making in professional service firms. Using Kanter’s (1989) typology of bureaucratic, professional, and entrepreneurial career forms, it argues that within PSFs are elements of all three, sometimes working in parallel and sometimes in competition. After a broad overview of Kanter’s ideal types as manifest within the PSF, the chapter considers how these are institutionalized through particular career practices. It highlights the importance of the client in professional career-making, working either as a mechanism of social closure, or of transformation. The chapter then turns to career enactment: the ways in which individuals engage with professional, bureaucratic, and entrepreneurial practices on a daily basis and over time. Central to this analysis is the tension between the professional career as a vehicle for the exercise of personal agency, or as a disciplinary mechanism of management control. The concluding discussion proposes some fruitful for further research.

When the term ‘confabulation’ entered the medical literature, it referred to the emergence of memories of events and experiences that never happened. However, its Latin root—meaning ‘to gossip, to chat’—allowed for a broader use of the term. This chapter gives the classic and the present-day definitions of confabulations and proposes a distinction between memory-related (mnestic) and non-memory-related (non-mnestic) confabulations. Early clinical observations already suggested the distinction between different forms of mnestic confabulations. Based on the literature and our own studies, I propose to distinguish four forms of confabulations, which partially or completely dissociate, and suggest ways to explore them.

Chapter 6 lays groundwork for explaining what a constitutive rule is and how they underwrite certain important forms of constitutive agency by giving an analysis of the concept of a certain category of essentially intentional action type, and locating it in a taxonomy of essentially intentional action types. It begins with an overview of essentially intentional action types. Next it analyzes one sort of essentially intentional action type as involving two components, a requirement that a certain activity pattern be instantiated and a requirement that it be instantiated intentionally, focusing on tic-tac-toe as an example. It distinguishes these sorts of essentially intentional action types from those defined by an intentionally pursued goal. It discusses briefly essentially intentional primitive action types, and then takes up a puzzle about intending to perform essentially intentional action types. It concludes with a taxonomy of essentially intentional action types by way of summary.

This chapter comments on Article 49 of the Rome Statute of the International Criminal Court. Article 49 establishes two principles: remuneration is set by the Assembly of States Parties; it may not be reduced during the term of office. It is intimately connected to issues of independence and impartiality. Secure salaries and other forms of remuneration are important for the judges and other officials of the Court, as they have been in national justice systems. With respect to the judge, the relevant related provisions in the Rome Statute are article 35, which requires all judges to be able to serve as full-time members of the Court, and article 40, providing that full-time judges ‘shall not engage in any other occupation of a professional nature’ and excluding all judges from engaging in any activity ‘which is likely to interfere with their judicial functions or to affect confidence in their independence’.

This chapter summarizes current interpretations of all forms of confabulations discussed in the book and reviews the relationship between the four forms of memory-related confabulations. Experimental investigation has confirmed the dissociation between various types of false memories and considerably advanced the understanding of the mechanisms of some forms of confabulation, in particular behaviourally spontaneous confabulation and false statements in anosognosia. Overall, experimental evidence is scarce; many models have no controlled experimental basis or extend their proposed range of application well beyond the empirical evidence. The chapter concludes with a call for heightened respect of basic scientific standards in the research on confabulation.

The generative factors behind the transformation of late medieval forms of government to new types of authority are discussed in the first section. This transformation was conducted through the selection and convergence among these distinct types of authority. The article moves on to a discussion of the process of state formation and its effects on the type of regime that emerged in different states. It determines how state formation implicated the rise of constitutionalist or absolutist forms of rule and highlights how the accounts of state formation in Europe currently inform the study of state development in newly emerging countries. This chapter examines two foundational questions relating to foreign investment: why firms engage in foreign investment, and how inward foreign investment affects host states. It then examines the scope of the investment treaty regime’s coverage of different types of ‘investors’ and ‘investments’. The chapter makes a simple yet often overlooked point: whereas different types of foreign investment have different drivers and effects, investment treaties cover practically all forms of investment and all types of foreign investors. This has important implications when considering the effects of the investment treaty regime.

Understanding comes in a variety of forms. This essay argues for the unity of these forms, against the common tendency to view them as fundamentally heteronomous, or disunified. After identifying ten core features of genuine understanding, which enable an argument for the existence of two distinct types of understanding, theoretical and practical, the essay poses a dilemma for theories that view them as disunified. Subsequently, it develops and defends a general account of understanding in terms of conceptions. What unifies diverse forms of understanding, on this account, is a generic cognitive structure—given by the notion of a noetic conception—that is realized in different ways in various cases.

Abstract:
This article revisits the 1874 controversy between Camille Jordan and Leopold Kronecker over two theorems, namely Jordan’s canonical forms and Karl Weierstrass’s elementary divisors theorem. In particular, it compares the perspectives of Jordan and Kronecker on generality and how their debate turned into an opposition over the algebraic or arithmetic nature of the ‘theory of forms’. It also examines the ways in which the various actors used the the categories of algebraic generality and arithmetic generality. After providing a background on the Jordan-Kronecker controversy, the article explains Jordan’s canonical reduction and Kronecker’s invariant computations in greater detail. It argues that Jordan and Kronecker aimed to ground the ‘theory of forms’ on new forms of generality, but could not agree on the types of generality and on the treatments of the general they were advocating.

This chapter discusses the three main types of financing for mining projects and their respective potential for international disputes. These main forms of financing are: equity financing, debt financing, and alternative forms of financing such as royalty financing and stream financing. Equity financing is the most widespread form of financing. It is particularly popular with junior mining companies that do not have the possibility to tap debt markets. Debt financing is often used by mid-tier and major mining companies seeking to develop new projects or expand their operations. Amongst the different forms of debt financing available to mining companies, project finance is the most widely-used for international mining projects. Alternative forms of financing (including royalty financing and stream financing) have emerged over the past thirty years as a viable alternative to equity and debt.

This chapter considers different types and forms of interviewing, including focus groups, and how they should be conducted. Interviews are a popular method of data collection in political research. They share similarities with surveys, but these similarities relate mostly to structured interviews. The chapter focuses on semi-structured interviews, including focus groups, the emphasis of which is to get the interviewee to open up and discuss something of relevance to the research question. After describing the different types and forms of interview, the chapter explains how interview data can be used to confirm or disconfirm a hypothesis or argument. It also shows how to plan and carry out an interview and how the type and wording of questions, as well as the order in which they are asked, affect the responses you get. Finally, it examines the interviewing skills that will ensure a more successful outcome to an interview.
