Full textOur inquiry begins by shedding light on a contradiction within the flourishing state of Sino-French exchanges: on one hand, the many exchanges between the two cultures and the increasing importance of French, which are accompanied by the positive representations of France in China; on the other hand, the difficulty for the Chinese to integrate in France, whichcauses a less than positive image. Our doctoral research project focuses on the impact of China's social representations on the image of France among the Chinese. To do this, our study follows a qualitative approach, is based upon preliminary questionnaires and interviews with Chinese of varied profiles. This study has led us to analyze historical and social factors in China, which interfere with the representations of France among the Chinese, and which are a determining factor in theirchoice of France. It appears that some Chinese intermediaries convey embellished images of France; nonetheless, these images are simplified and static. Furthermore, in the process of choosing France among Chinese respondents, pragmatic motivations dominate. Moreover, there is a contradictory situation in the teaching and learning of French in China, which may explain the difference between the France of dreams and the France of everyday life. At the same time, a inferiority complex on the Sino-western relationship appears through our analysis. It boils down to a contradictory vision that encompasses a desire and a rejection of the West

Full textThe '30 glorious years' is a period of great development (i.e. economy, society, and politics), when France went through and completed the phase of rapid urbanization. During the period, a considerable number of regional planning with the aim of ‘balance' was established and implemented in France. In similar, after a long period of development, China met the period of rapid urbanization in the late 1990s and a series of regional planning with the ‘balance' feature begin to emerge almost at the same time. The experiences regarding regional planning in France are quite meaningful to do some further research, in order to draw some useful lessons for China nowadays and in the future, which is the main purpose of the thesis. For reaching the goal, the whole thesis could mainly be divided into two parts: 1. Summarize the evolution process of French regional planning during the '30 glorious years', and analyze the effect and development after implementation of regional planning during and after the important period; 2. Conclude the development of China after the open-up policy, the existing regional planning and certain related problems, and present several implication for China finally, based on the experiences of France. After summarizing, analyzing and evaluating French regional planning during the '30 glorious years', we find that the content of regional planning changed with the evolution of background (i.e. economy, society, and politics). And the regional planning with obvious, positive effect all belonged to these which follow and predict the process and the inherent law of development. Therefore, regional planning should catch and foresee the decisive factor and solve the major problems during different phases of development. In order to make China avoid of or solve some important problems during the period of rapid development (also a period of rapid urbanization), we propose some implications for China's regional planning in the end. It includes: 1. the major objective of regional planning; 2. the provision by government for migrants; 3. the method for big cities to keep their vitality; 4. the ‘balance' development of urban agglomeration; 5. the healthy development of rural area; 6. the creation of growth pole; 7. the choice of location for public housing

Full textZaji (杂技), which means « various competences » and is sometime translated in French "Acrobatie chinoise", is a form of art at least three thousand years old. To date, there is no French synthesis available to trace its origin, development and evolutions up to the present day.This thesis aims to fill this gap by documenting the subject from a corpus of Chinese and French publications and documentation. The author of the thesis, Chinese to French translator and teacher, has conducted an investigation through her access to documentary resources, exhibits of artifacts and live shows of Chinese acrobatic arts.The thesis provides a synthesis of the results obtained during this survey, presented chronologically in a broad panorama with bibliographical references (250) refrences and iconographical (128).The thesis is composed of three chapters. The first chapter proposes a chronology of the development of the forms of Chinese acrobatics in the context of each dynasty until the last dynasty in 1912, referring to archives and documents in China, including the published and unpublished, original and translations of ancient or contemporary texts. This chapter is completed with the assistance from historians of Zaji such as Professor Fu Quifeng, as well as the support of Nanjing Library. By confronting problems of translations, the thesis makes it accessible to French readers a major history of the world's oldest performing arts.The second chapter examines the integration and reception of Chinese acrobatics in France from senventeenth century to twentieth century and its influences on French theatre, particularly in the fashion of the "Chinoiserie", then go through reciprocal exchanges during the Republic of China until the rebound of Chinese acrobatics in the twentieth century after the founding of the People's Republic of China in 1949, specifically its new artistic forms and cultural codes, the political messages it conveys, the invitation of Chinese artists to circus festivals in France and Monaco.The third part briefly outlines the perspectives of Sino-French artistic collaboration in circus in the twenty-first century, observes the contribution of Chinese acrobats on the contemporary scene and the influences of the Western live show on contemporary Chinese acrobatics, to finally questions the future of Chinese acrobatics by applying the results of this documentary trip between two cultures, to open the conclusion of this thesis: a French-Chinese circus and acrobatic festival will be organized by the author to explore the artistic and innovating future of Zazi

Full textThe purpose of this thesis is to evaluate the conditions under which CSR definition, research or implementation are influenced and contextualized by local, especially institutional, factors or in the contrary can be integrated in a universal approach. Two different national context are explored, France and China. However, thesis analysis is more specifically focused on Chinese institutional environment and the first chapter deals with this topic. In the chapter 2, through an analysis within two disciplines, management and law (primarily French but also American and Chinese law), a CSR definition is proposed but results highlight the difficulty to reach a universal definition of CSR. In the chapter 3, a textual analysis was used on a 600 articles sample to investigate the structure of academic research in the field of CSR and related concepts in China from 1980 to 2011. In the chapters 4 and 5, a single case study concerning a French multinational corporation (MNC) operating in China since 1995 was conducted. Findings of the chapter 4 establish that a combination of different factors influence the CSR internationalization strategy of the said MNC. Factors that may drive variation in CSR practices across countries are studied in the chapter 5. Findings show that in the same institutional environment, depending on CSR issues and institutional norms, the implementation of CSR strategy by the said MNC subsidiary in China sometimes reflects and sometimes is a substitute to Chinese institutional and economic context while the impact remains unclear in certain cases

Full textThe revolutionary constitutionalism in France and in China is deeply rooted in the pre-modern history. The Revolution of 1789 and the three consecutive Constitutions in 1791, 1793 and 1795, combined the "Constitution" and the "revolution" an unprecedented way. The same logic is exposed in the historic journey in France and in China. The Declaration of 1789 and the Constitution of 1791 have paved the way toward an ideal future, which was soon disillusioned by the real conflicts, especially the struggle between the royal authority and the legislature. Similarly, after the end of the dynasty in China, we also saw the conflict between the executive and legislative branches, by which the "First Republic" has been led to an impasse. As the turbulence of the Revolution went on, several constitutions of both sides have been promulgated, which reflect the similarity not only between the Girondins and the Kuomintang, but also between the Montagnards and the Chinese Communist Party. Similarly resulted by a coup d’etat, the "Thermidorian" regime was established in France and China. The Constitution of 1795 sought to maintain the power in the hands of the Thermidorians to avoid new dictatorship, but without success. Instead, the Chinese Communist regime is also trying to control the power, successfully, by means of the constitution revised according to circumstances. Thus, given the role of the Party, the process of constitutionalism appears more dimensions in China. After all, for both countries, the revolutionary constitutionalism actually reveals the common destiny in the era of modernity

Full textChina and France have both adopted the International Standards on Auditing (ISA). Thelargest firms in auditing and accounting in the world, known as Big Four, are established inFrance as well as in China. Auditors from those firms apply procedures that have beenharmonized worldwide within Deloitte, PricewaterhouseCoopers, KPMG, and Ernst &Young. When it comes to audit, French auditor and Chinese auditor talk the same language,use the same software, boundaries seem to be knocked over. On the other hand, what BigFour firms are not able to standardize is the culture of their auditors. Does auditor’s culturemay shatter all efforts that have been put to deliver the same services throughout the world?Does auditor’s culture may call the work of the International Auditing and AssuranceStandards Board (IAASB) into question? Do either French or Chinese auditors enable ahigher audit risk to the audited client? Many other questions could be raised about the effectof cultures on the audit process.
The purpose of this research is to explore, measure and analyse the cultural impact on theaudit process. In order to highlight the difference(s) of the audit outcome due to culture,countries have to exemplify a certain numbers of cultural differences. China and France havebeen chosen because their belonging to the Eastern and Western clusters, and as we know,Eastern and Western countries have substantial cultural differences (Hofstede, 2001).According to Hofstede’s cultural dimensions, Individualism (versus Collectivism) andUncertainty Avoidance are the two dimensions that get the higher cultural differences whenhe compares Chinese and French Culture. We want to discover how Chinese and Frenchauditors rely on analytical procedures and assess audit evidence and internal controlenvironment. We want to study if their audit results reflect the cultural differences betweenChina and France based on the two cultural dimensions.
In order to manage our empirical research, we use a sample of 28 Chinese auditors and 14French auditors. We use primary data collection through our design questionnaire. Theauditors’ answers were analysed using a quantitative approach to reveal the eventual existenceof a connection between the auditor’s cultural background and how the audit process iscarried out.
Our findings about cultural differences within Big Four companies are not so categorical. We did not find significant differences regarding Chinese and French auditors’ culture. However,Chinese auditors appear to have a higher willingness to refuse a misstatement in the client’s financial statements, due to collectivism cultural dimension, than French auditors. Auditors from both countries assess in similar way audit evidence, but they do not consider of the same importance some components of the internal control environment. French auditors considerof greater importance components that can directly influenced the accuracy of the accountingreporting process, because an individualism society as France tends to “encourage”accounting and cut-off errors within organizations.

Through a comparative ethnographic study, this thesis offers to analyze how ecclesiastical institutions in Italy and France follow the structuring of Chinese faithful groups. During this research, we focused on churchgoers’ life stories and motivations behind their Catholic faith. In this context, we can observe the increase in bilateral trade between France and China in recent years. French firms are seeking to develop the Chinese market - a market of 1.375 billion consumers and considered to be promising. At the same time, Chinese firms are investing in France and establishing themselves on the European market.My thesis targeted a category of these companies - French transnational companies - to study their strategies for expansion towards China. Indeed, we can see in China the dynamism of a large number of French transnational companies which are present in various fields of activity.These expansion strategies developed by these transnational firms contribute significantly to the growth of an economy that has become globalized. In addition, they can serve as development models for large companies and SMEs that are willing to go international and who are looking for experienced means and methods to accelerate their internationalization.This thesis consists of documenting these strategies adopted by these French transnational companies from both a practical and a theoretical point of view, and identifying the way in which they are structured by adapting to the local environment which represents a large number of economic, societal, cultural and legislative specificities

Full textThe history of the spread of French in China finds itself at the intersection of multiple productive areas of research. To cite only the most important of them, consider the history of the opening-up of China, the overseas cultural action of France and the history of cultural relations. For some time now, these areas of research have been witnessing a true growth of strength within the field of international studies. As such, the francophony in China represents an area of inquiry which could contribute to enriching other branches of International Studies, which has traditionally been focused on the political and economic dimensions and on the nations in a position of power. The spread of French in China is the fruit of interaction between Chinese and French initiatives. Granted, the first French programs were created by French missionaries in the middle of the 19th century. Nevertheless, initiatives on the part of Chinese multiplied and soon made their importance felt. The French language had actually been bound up with the dream of Chinese of achieving national revival across the fields of military, economy, politics and culture. Indeed, highly noteworthy is the fact that thanks to the efforts of Chinese, higher education programs taught in French were made available as early as the beginning of the 20th century – the institution in question was Tongwen guan [Governmental School of Foreign Languages], which in its turn was merged into Jingshi Daxuetang [Imperial Capital University, predecessor of Peking University] in Beijing in 1902. Benefitting from a generally favorable environment in China, French cultural action kept renewing itself. Spanning 100 years without interruption over the period 1849-1949, it offered both religious and non-religious programs, restricted, however, almost entirely to primary and secondary education. After 1949 however, largely because of cold war and the Cultural Revolution gripping China in 1966-1975, such French initiatives were absent for several decades and did not make their come-back until the opening-up policy of China at the end of the 1970s. Henceforth, on the basis of reciprocity and leveraging the attractive force of France to Chinese college students, the French authorities have been deepening ties with China. At the same time, they rely heavily on l’Alliance Française, which has been expanding rapidly in China thanks to both its ability of adapting to local circumstances and the diversification of the overseas study destinations of Chinese college students

The main objective ofthis thesis is trying to offer some suggestions for cities in China by learning fromFrance, on the topic of planning and implementation of large-scale urbandevelopment projects. Understanding the background, mechanism and policy ofurban planning in developed countries may help to cope with problems in ourcountry and then to better construct Chinese cities. Firstly, the dissertation defines the basic concepts, contents and framework of large-scale urban development projects. The origin of problems and difficulties in large-scale urban development projects is then discussed. Based on empirical study, the dissertation analyzes some typical large-scale urban development projects in France and then evaluates them. In modern society, planners should consider many uncertain indicators in urban development. They should also be effective in regulation of space and coordinate conflict of interests in large-scale urban development. The dissertation raises a basic theoritical framework in those three aspects and explores how French largescale urban development projects cope with these challenges. By three optimizing routes which are reforming of land-use planning, strengthen regulation of urban space and improvement of coordination mechanism, the planning and implementation of large-scale urban development project in France have been optimized. By continuous reforming, adjustment and improvement, many French large-scale urban development projects successfully finished the planning objectives. The social, economic and environment effects have also been well embodied.PLU (Plans Locaux d’Urbanisme) has been studied for the reform of land-use planning. Le "cahier des charges "and the role of the "Architect Coordinateur" have been analyzed for the regulation of urban space. ZAC (Zone d’Aménagement Concerte), SEM (Société d’Ecoonomie Mixte) and public participation institution have been studied in aspect of coordination institution. Based on comparativestudy of situation in China and successful experience in France, suggestionshave been made for optimizing Chinese large-scale urban development projects.The three optimizing routes are connected tightly, which means they influencethe course of urban construction together. Isolated route could not solve theproblems. Therefore, the dissertation suggests an ensemble optimizing route inChinese large-scale urban development projects. The reform of urban planningand implementation institution should improve land-use planning, regulation ofurban space and coordination mechanism all together. The urban planning andmanagement system should be in a direction of integrative improvement

Full textIn a time of fast technology development and frequent curriculum reform, the abundance of instructional resources brings teachers both chances and new complexity. This study aims at exploring mathematics teachers’ expertise required for, and developed in, interacting collectively with resources. Since expertise is contextualized, this research is designed as case study in two contrasting contexts (China and France). Based on Documentational Approach to Didactics and Cultural-historical Activity Theory, the study proposes a framework of mathematics teachers’ expertise interacting with resources, which is named as Documentation Expertise (DE). Efforts are made in two steps: a first DE framework based on literature review and pilot study, a refined framework after two contrasting cases analysis. Three questions are explored: How to define DE? How is DE developed through collective work? What can be learnt for developing DE through the two cases? The study is based on a methodology of reflective investigation, and adapts tools of interviews, observation and video analysis.It proposes some main results: (1) DE is evidenced from (i) a static dimension on resource system’s structure and components, DE develops in deliberately keeping the resource system lived by bridging resource design with considerations on didactics, curriculum and students; (ii) a dynamic dimension on schemes in resource system maintenance and documentation work, DE develops in integrating the resources with a broad view in searching, critical attitude in selecting, flexible way in adapting, and automatically habit in accumulating. (2) Collective work benefits DE development, especially collective lesson design, where resources and the schemes of usage are discussed concerning specific situations. (3) Implications are drawn concerning institutional construction of teacher collective work (Chinese case), and high-quality online-resources (French case)
在科技迅速发展,课程改革频仍的时代,教学资源的极大丰富为教师的课程设计同时带来机遇和挑战。本研究围绕数学教师在文献纪录工作中的专长,旨在探索此种专长的成分构成及其集体工作环境下的发展路径。鉴于教师专长的情境性,本研究选择案例研究的方式对中法两组案例进行探索。基于教学的文献纪录法和文化历史活动两个理论框架,本研究提出了数学教师文献纪录专长的概念,意为数学教师在调用资源时所需要和发展而来的专长。研究工作分两步进行:通过文献梳理和预研究提出初步的文献纪录专长框架,再通过中法案例对初步框架进行修正补充,最终提出改进版的文献纪录专长框架。研究问题有三:何为文献纪录专长?文献纪录专长怎样在集体工作中得到发展?通过中法案例研究,在该专长的获得与发展方面可以为我们带来哪些启发?本研究采用反思性调查法,具体研究工具包括访谈法,自然观察法和视频分析法。研究结果如下:(1) 文献纪录专长可从静态和动态两个维度进行调查和表征:静态维度指资源系统的结构和成分,该专长主要体现在教师在教学资源的有意设计、组织、整理和积累中综合考量数学学科、教学法、课程和学生等要素;动态维度包括资源系统的管理维护,资源工作过程中对资源的开放式搜索、批判性选择、灵活修改与应用,以及自动化的资源归纳与积累习惯。(2) 集体工作有助于文献纪录专长的发展,尤其在集体备课活动中,针对具体情境下所需资源和应用图式的头脑风暴式讨论对参与教师获益均甚。(3) 中法案例对照下,也有一些针对制度环境的启发,例如中国案例中的教师集体工作制度系统,以及法国案例中的高质量网络资源建设。

The public opinion in China pierces in social aspects. To think better about the question, it is important to consider the conditions of the elaboration of the public opinion: the evolution of the Chinese context and its international image; the economic sphere of influence which makes the population oscillate between tradition and modernity … Divided between capitalism and communism, China is suffering from important disparities. The analysis examines the social and political life, and the opinion the Chinese have of themselves and of the world which surrounds them. Finally, the western glance on China leads to the question of the democracy. Is the recurring number of riots the indication of a will of democratization? China feeds western illusions which see in the democracy the universal solution. The Chinese government itself regularly uses the term of democracy, but "Chinese-style". From then a synthetic vision of the probability of evolution of the Chinese politics is discussed. Is it possible to conjugate socialism and democracy either does China move towards an acculturation of the current Regime? Besides, the study being based on articles of the French print media, it seems useful to ask the question of the partiality of this media. Qualitatively, quantitatively what are the themes of the Chinese opinion in the French print media? Are articles many? Who writes, with which frequency? Full textThrough the representations of China in the writings of French and English authors during the eighteenth century, this thesis aims to study how that Far Eastern country participated in the intellectual movements taking place on the other hemisphere. The topic being the representations of China, our study is focused less on which is represented (China) than on those which make the representations (France and Great Britain). China is often only a pretext in the writings of that period, allowing the authors to satisfy their exotic taste, or to defend their theses. Therefore, it is not our aim to approve of or to criticize the representations made by the French and British authors. We do not seek to oppose the “true” image of China found in Chinese sources of that period to the “false” or “distorted” image in the writings of Europeans authors, but to show how French and British authors represent themselves so as to build and rebuild their identity, which characterizes the intellectual trend of the Enlightenment. Having no intention to confront the “China in the representations” with the “real China”, we nevertheless make a comparative study of the different representations of China provided by French and British authors, which highlights the different approaches to the Enlightenment in France and Great Britain

Full textThrough studying the evolution of social protection mechanisms for the elderly in these three countries, this study finds that the stratification of welfare right and social protection law are decided by the inter acting four factors: political, economic, ideological and social factors. Each country has its own stipulation on the rights and duties of the five legal subjects: the state, the welfare administrative bodies, the market (employers), the family and the individual (elderly). The differences of the legal status, the financial resources, the redistribution functions and appealing mechanisms form three different legal models. The Chinese model is under rapid transition: "state/guojia-intermediate bodies-individual". The French model has two tiers: the first tier is the "public-private" division; the second tier is the socio-economic stratification. The British model constitutes a "government -market -individual" structure. Full textApplicable law to thermal power plants involves many environmental issues. If air pollution and climate change are the most well-known issues, water pollution is also one of them. Environmental protection, whether in French or Chinese law, is achieved in different ways depending on the stage of the plant’s life but also on the environment that seeks to be protected. If they are many similarities between French law and Chinese law, many differences also exist.In the case of the future construction of these plants in general, or of a specific plant project, the way of protecting the environment has undergone significant changes in recent years. If the level of protection is still largely local nowadays, it tends to become more and more global by taking increasing amount of elements when the power plant project is carried out. In the case of daily air and water emissions from thermal power plants in operation, some environmental protection is ensured by limiting them. The limitation mainly involves the setting of emission limits which try to be gradually lowered. These form the fundamental foundation of this daily protection and are complemented by other legal tools. Finally, this protection of the environment requires vigilance through the emissions monitoring system but also through anticipation linked to the possible malfunction of the power plant and the post-operation period of it

Full textIn the framework of French-Sino relations during the Maoist period (1949-1978), the industrial cooperation between the two countries can be considered as a remarkable success. From a steady beginning in the 1950s, their economic relations principally developed in the industrial domain in the following decade, so as to reach their peak in the 1970s because of three favorable factors. Above all, the establishment of their diplomatic relations in 1964 offered the opportunity to create stable indispensable connections of bilateral economic contacts in the future, then the two governments also played a role as coordinators of this industrial cooperation. Besides, the improvement of Sino-American relations and the political liberalization of East-West commerce promoted by Nixon, provided a propitious international environment for the Sino-Occidental commercial development. Last but not the least, economic the plan of the Chinese government, based on the importation of Western technologies and materials, particularly the “43 plan”, provided a financial basis for the industrial cooperation with France.The results of this cooperation are considerable: Sino-French commerce obtained a large scale of obvious development; French companies benefiting from the economic openness of the Chinese market during the period of the Cultural Revolution; thanks to the implementation of these cooperation projects, particularly the “key-in-hand factories”, China accelerated the modernization of diverse industries in electricity, fertilizers, chemical fibers, communication, etc., -- while maintaining the balance of its economic development

Full textFrom 1789 to 1905, China is one of the most exotic topics represented on the French theater stage. This China can evoke the imagination inherited from the eighteenth-century “chinoiseries” taste. And moreover, it witnesses the nineteenth-century Sino-French socio-political events, which are never detached from the rising colonialism or even the Orientalism.This work attempts to build up a repertoire of Chinese-subject plays, and to analyze the production and the reception of the Chinese image on the French theatre stage during the nineteenth century. The corpus of the entire repertoire can be divided into three categories: the French playwright’s creation, the plays translated or adapted from Chinese literary works, and the performances given by Chinese actors. Chronologically organized, each chapter in this work follows the decisive Sino-French bilateral events. The first three chapters examine the Chinese and Oriental elements which have been applied to the French theatre in the previous centuries, and which are reinvented and appropriated under the influence of Sinology, a new scientific discipline institutionalized in the first half of the nineteenth century. The last three chapters develop with the two Opium Wars, the Sino-French War in Vietnam, the Boxer’s rebellion, as well as the birth of the concept of the “yellow peril.”For the playwrights and the artists, this “China” is therefore familiar but strange, approachable but intangible, cliché but ever-changing, exhausted but exploitable. All these contradictions contribute to create a kaleidoscopic China on the French theatre stage

Full textWith the rise of China on the global stage over the past decade, the image of the country in the French media is constantly oscillating between tradition and modernity, threat and opportunity, partnership and rivalry. Media representations of China in France result from a combination of political, economic, cultural and communication factors. In this research, these representations are considered as a process of co-construction that involves multiple social actors, French as well as Chinese, and subject to socioeconomic constraints of the media as cultural industries. This study attempts to understand the operational logics of the content industries, against a backdrop of profound changes, and to apprehend how the functioning of media organizations is likely to affect the production of international news related to China. This research is based on the analysis of the construction of China's image in three French newspapers of the general and political information press, each representative of a type of newspaper, distinctive in terms of frequency, dissemination area and organization. The goal is to examine the economic, technological, managerial and editorial transformations of these media and their consequences on the conditions and their mode of production and to point out the convergences and divergences of media coverage of China between the different categories of press. Furthermore, as media representations of China in France extend far beyond the stakes related to the only media field and embrace geopolitical and, increasingly, economic interests, we also take into consideration all these parameters in order to understand the image of China in all its complexity

Full textIn the last years, the French and Chinese Bankruptcy law has been quite changed. So has the profession of « Judicial administrators » (administrateurs judiciaires), with more or less success. Both the successes and failures of these changements have drawn our attention. Our scope is to analyse the evolution of this profession in the perspective of its modernisation in the today's context of a global economy. There was no specific Chinese Bankruptcy law until the publication of the new law of August 27th 2006 on Enterprise Bankruptcy. The new law which has been prepared for 12 years has brought some remarkable improvements to the existing law of 1986 and has been a major effort to build up a complete legal system in line with the modern open market economy. One of the most remarkable features of the new 2006 law has been the implementation of the « Judicial administrators » profession. Nevertheless, the « Judicial administrators » profession, who was established within the Bankruptcy Law, which has itself been defined quite recently, must only be considered but as an initial framework for the profession. Yet, as the « Judicial administrators » plays an important role in the Bankruptcy Law, making research on this subject appears to be both necessary and urgent. Our hope is to help transforming the « Judicial administrators » profession into a « liberal profession », similarly to their equivalents in the French system. We therefore analyse successively the juridical nature of the profession, from an historical point of view and in the perspective of the « effective law » (droit positif), the access conditions to this profession, its remuneration, the involved functions and responsibilities in both the French and Chinese law

Full textAs the 2lst century world continues to evolve, globalisation continues to alter the nature of the relations between states and the balance of power amongst them. Both globalization and the dominance of liberal thought have created a global appeal for values, culture, inclusive policies and regional and international cooperation through institutions. Within this context, the dynamic of power has transformed. The legitimacy of hard power and coercion has been questioned and in its place, the importance of international relations built on soft power (especially through cultural cooperation) has emerged. The model of soft power that is centred on cultural diplomacy is now a priority for many states because it forges stringer bonds between them, thus softening the potential threat that is inherently present in hard power. Through cultural diplomacy, states can improve upon relationships that were once oppressive and hard-power based. Cultural diplomacy has provided states with a less-threatening way of exerting influence on each other.
This study examines aspects of the cultural diplomacy of France and China in order to investigate how and if cultural diplomacy constitutes a better national image as perceived by the publics and governments of the Mekong sub-region. By using Waltz's levels of analysis and empirical examples from the Mekong sub-region, the effects of France and China's cultural diplomacy are examined. Specific attention is paid to Viet Nam because of its distinctively temperamental relationships with France and China in the past.
The study concludes that although cultural diplomacy proves favourable for France's influence in the Viet Nam and the Mekong sub-region, China is not enjoying the same benefits, specifically in reference to Viet Nam. Cultural diplomacy is only a valuable tool when it is coupled with several mitigating factors like the legitimacy of France and China, the coherence of their foreign policy actions, and the willingness of Viet Nam to receive outside influence. Unfortunately for China, the tenacity and inflexibility that it has displayed towards regional states in territorial disputes has negated the potential benefits of its cultural diplomacy in Viet Nam.

Full textThis thesis builds a hospital benchmarking methodology and implements it in the Chinese and French cases in order to compare performances amongst hospitals and figure out the driving forces behind performance differentials. In a first step, stylized facts are used to analyze the evolution of Chinese people’s new health care needs and China’s health system. Then, after a review of the current theories and practices of hospital benchmarking, a methodology is proposed in order to calculate and compare average costs in cross-section and inter-temporal analyses. The further decomposition of average costs in case-mix effects and cost structure effects allows studying the determinants of hospital performance while taking into account supply and demand factors. We first apply our model to a French hospital. Five inputs and six disease related groups in the field of maternal service are selected to measure differences in average costs in spatial then longitudinal empirical settings. We find that the average cost of the hospital under assessment is higher than the national reference, which results from both case-mix effect and cost structure effect. By decomposing the cost structure, we find that the price effect and quantity effect have opposite impacts on the hospital under estimation. The results of the longitudinal comparison show that the performance becomes poorer at time t versus time t-1. The case-mix effect appears to be responsible for the rising average cost, while the hospital under assessment shows cost advantage at time t versus time t-1. The second application deals with the impacts of case-mix effect and cost structure effect on hospital average cost in the Chinese, from a policy perspective. The results show that the spatial difference in health care needs leads to the huge variety of performance between rural and urban hospital through the case-mix effect. The inter-temporal simulations also testify the existence of the epidemiological transition where non communicable diseases now dominate both in urban and rural areas (though at different rates). We also investigate a policy trend towards specialization of general hospitals and exemplify to extent to which it can lead to significant changes in the case-mix of the hospital, which eventually results in differentiated average costs. Then, we try to simulate and analyze the effectiveness and quality of reform policy by isolating the cost structure effect. At last, the interaction between case-mix effect and cost structure effect are verified and the policy implications are discussed accordingly

In China, the musical creation was affected by both the various cultures and political changes, thus bestowing a special charm on contemporary Chinese music. From the beginning of Western imitation and just before the founding of the new China, Chinese musicians succeeded in matching the Chinese musical elements with the new musical languages. Throughout specific periods, art had been bound to political power, and traditional style constituted the main identity of musical creation. The judge is not only charged with analyzing and determining the factual elements, but he also aims to exercise the qualification of the fact and apply the rules of law. This is why legal interpretation is generally divided into two aspects, i.e. the interpretation of the fact and that of the law. The interpretation of the contract, in principle, belongs to the first aspect. More precisely, the law, as general and abstract rule, is the expression of the general will, while the contract is only a translation of several individual wills. This dissertation analyzes the issues aroused by the theory and practice of the interpretation of the contract: In what condition can the judge exercise his capacity of interpretation of the contract? Should the interpretation of the contract aim exclusively at the common intention of the parties or aim not only at the will of the contracting parties but also the internal and external objective elements of the contract? Can the interpretation of the contract fill in the lacunas of the contract? Can the rules of public order become the foundation of the interpretation of the contract? Does the correction of the content of the contract need the participation of the interpretation of the contract? The research of the above mentioned issues determines, in fact, the interest of the plan of this dissertation. Theoretically, the work of this dissertation challenges the traditional definition of the interpretation of the contract, by annotating again the sense and the spirit of the classic rules of interpretation, and analyzing the role of the rules of public order in the interpretation of the contract. Full textIn the context of the debate on approach towards geographical indication protection (the choice between sui generis or trademark regime), this thesis aims to deepen the reflection on what approach is needed for China. It asks one question: if it is true that the concept of terroir underpins the French and European sui generis regime of GIs, why does the sui generis regime, when transplanted in China, gets only a cold reception, despite of the fact that China is endowed with a large number of products with a strong tradition and anchored in the terroir of their place of origin? This question leads us to: retrace the history of how the notion of GIs, along with the sui generis laws governing them, emerged in Europe and was transplanted to China; demonstrate the extent to which the European approach is adopted in China, through conducting a comparative study of the laws in France, the EU and China; show the setback that the transplanted sui generis regime has suffered; analyze the reasons leading to this setback; and finally, loot at the option of the future of China’s sui generis regime. Our suggestion is that the status quo of the sui generis regime needs changing. China should give clear preference to the sui generis regime, as opposed to the regime of collective and certification marks

We propose to describe and analyze the spatial and economic dynamics of a singular type of aquaculture: seaweed farming. Seaweed farming is a significant research area in coastal geography as well as in the geography of food and energy. We sought to identify the different scales of territories organized for the production of both macro- and microalgae. To conduct this research, we chose three study countries : China, the largest producer of macroalgae, France, where traditional production is being adapted to a new commercial and industrial demand, and finally the United States, where most innovations in the field of microalgae are made. This thesis has a cross- and forward-looking approach and is based on different research methods: field surveys on production sites, interviews with stakeholders, researchers, and distributors, bibliographic research at the intersection of the biological and social sciences. The study of crops, territories and issues of seaweed farming progresses along a three-step analysis: first, the presentation of algae farming (macro and microalgae) in its global and regional production with the production methods, second the analysis of the algae value chains, showing the development of local equipment and installations, and the investment of authorities in the territories of reference. Full textIn recent decades (1970-2010) have emerged Chinese French Literature, particularly dominated by fiction. The context of globalization justifies this field of investigation. The novels are written in French by authors of Chinese origin who are looking for an identity that would finally give them legitimacy. This emerging literature has not been studied in France yet. In a comparative perspective, the choice of the other cultural area is the American Born Chinese Literature, or what is known widely in the United States as the Asian American Literature. These novels seem to have common characteristics which allow us to postulate the existence of an emerging literature. Full textThe concept of “Family” as an integral unit of the society has evolved over the years due to several reasons. This changing and complex face of “family” has had many implications on the laws both in China and in France. Hence, we conduct a comparative study to analyze the system of family laws in both these countries. The various questions we address in order to deepen our understanding of family laws can be broadly classified into: the couple and the filiation. As for the couple, we address many questions related not only to the formation of the various modalities of the union but also about their dissolution. We find that the diverse articles on each union brought a system which is more complete in France than in China. With respect to filiation, we distinguish in particular between the filiation bound by blood and that bound by adoption. The ignorance of the mode of establishment of the filiation results in a big gap in the Chinese law. Besides, the basic question of how to adopt a child, the conditions to be respected and the procedures to be finished, the effects stemming from the adoption are also the questions we explore, compare and attempt to solve in this thesis. Besides the several principal points on the family law, we also try to compare and understand the different views/perspectives of these two countries by looking into some other related issues such as the maternity for others, the fictive marriages, etc., as well as how the two countries deal with such matters. Finally, we try to explain why the legal system differs in France and in China and discuss the directions for future research
