This article deals with the issues of criminal liability of persons (the subject of the crime) for committing crimes under the Criminal Code of France. It is noted that the French criminal law does not contain any special chapter devoted to the subject of the crime, but provides for important provisions on the responsibility of individuals and legal entities. Based on the analysis, it was concluded that it is necessary to apply the experience of France in terms of liberalizing the responsibility of minors and introducing the responsibility of legal entities.

Since the introduction of the offense of bribery of foreign public officials under French law in 2000, France has made undeniable progress in combating corruption. Numerous reforms have then been adopted (expansion of the scope of criminal prosecution, facilitation of the seizure and confiscation of assets in criminal matters, increasing of possible penalties, creation of the National Financial Prosecutor, . . .). French law criminalizes active and passive bribery, private and public bribery, domestic and foreign/international bribery as well as influence peddling. Nevertheless, the OECD was particularly critical of France over the last years. The French legislature recently took such criticism into account and strove to make further progress in preventing, detecting, and punishing corruption in order to reach the highest international standards. Law No. 2016-1691, known as “Sapin II law,” recently enhanced the French anti-bribery system by introducing a new duty for certain companies and their executives to prevent bribery and influence peddling by implementing a compliance program to prevent and detect such offenses. Sapin II law therefore testifies to France’s determination to effectively fight corruption.

This chapter considers the factors that justified kings' and administrators' resort to the exile of large numbers of the criminal population. The relationship between the medieval English law of exile and the laws addressing felons and felonies is a complicated and, by modern reckoning, an unusual one. This is especially the case because two groups of people suspected of, or implicated in, felonies in the High Middle Ages regularly avoided the punishments which would have been meted out to them if they had been convicted in a court of law. One group was composed of men and women who, though not convicted of the crimes of which they were suspected, were in such bad repute that they were obliged to abjure (foreswear) the realm. The other comprised felons who confessed their crimes in sanctuary (on which, more shortly) or in other special circumstances, who also were obliged to abjure.

This chapter discusses in detail the two major themes in the formation of criminological thinking. The tension between these two traditions has existed since the development of positivism in the nineteenth century, and is still of considerable importance in present-day debates about crime and ‘law and order’. It is common to single out France as typifying all that was bad with the administration of the criminal law in pre-eighteenth-century Europe. France provided an extreme example of what passed as criminal ‘justice’ throughout most of Europe. It was generally believed that crime was the consequence of evil. In some cases, it was assumed that the Devil or demons had taken over individuals and directed them to perform wicked acts. Alternatively, people whose faith in God was weak might have yielded to temptation and made a pact with the Devil.
