Abstract:
Amid the debates as to whether India practises democracy in the true fashion, the stupendous role of the Election Commission of India (ECI) clearly exhibits that India adopts at least a robust electoral democracy. Stringent election codes of conduct are imposed on political parties. The ECI ensures that all Indian citizens eligible for political rights exercise their franchise independently. They are sufficiently empowered to choose their representatives. Since the responsibilities of ensuring free and fair elections are shouldered by the Election Commission, there is no doubt that it holds one of the worthiest roles in shaping Indian democracy. This article seeks to examine the changing role of the ECI in building electoral democracy in the country. Most importantly, the present article attempts to examine the noteworthy measures undertaken by the ECI to bolster the electoral democracy in India in the 21st century.

Party system is the important factor in the working of representative form of Government. India is a democratic state. In the democratic state, political parties are said to be the life – blood of democracies. Modern democracies are indirect in character. They can function with the help of political parties. In the absence of political parties democracy cannot deliver the goods. Well organized political parties constitute the best form of democracy. India has the largest democracy in the world. It introduced universal adult franchise as the basis of voting right in the country. Now the voting age has been lowered down to 18. Most of the Indian voters are not politically matured and they do not have the political education in the proper sense. Political parties in India are classified by the Election Commission of India. It was classified for the allocation of symbol. The Election Commission of India classified parties into three main heads: National parties, State parties and registered (unrecognized) parties.

BO is regulated in the Business Opportunity Sales Law of 1995 by the Federal Trade Commission of the United States. Different forms of business certainly require different arrangements. Dans la foulée des recommandations énoncées dans le rapport de la Commission royale d'enquête sur la fiscalité en 1966, la législation fiscale canadienne inclut dans le revenu, depuis 1972, une portion du profit généré à titre de gain en capital afin de respecter notamment les principes d'équité verticale et horizontale. La portion reçue en franchise d'impôt constitue un manque à gagner important pour l'État. Qui profite donc de cet allégement ? En 1985, le gouvernement conservateur a introduit des mesures fiscales particulièrement alléchantes visant à permettre qu'un gain en capital maximal de 500 000$ gagné par un particulier puisse être reçu libre d'impôt. Le présent article a pour objet de démontrer que les milliards de dollars qu'ont coûté ces programmes ont profité à une poignée de contribuables dont la très grande majorité ont des revenus annuels excédant 150 000$, et ce, sans que des retombées économiques favorisant la masse ne puissent être démontrées. L'État se rend ainsi complice de l'élargissement du fossé entre les classes.

The Assam has also not lagging behind this context. Although the state has produces some small political parties before 1985, but formation of the AGP, BPPF, BPF and the AIUDF playing a very significant role in the politics of Assam. The AGP and the AIUDF not only emerge as an alternative of the Congress party at the state politics but also could able to participate in the national politics. Democracy is a gift from the golden throne; from 2008, Bhutanese people started to choose their leader by casting a vote. The right to vote and more importantly the exercise of franchise by the eligible citizens is the heart of every democracy [1]. Through this exercise of their right to vote have the ultimate power to shape the destiny of country by electing representatives who run the government and make decisions for the growth, development, and benefit of all the citizens. However, the voter turnout seems to be decreasing at an alarming rate based on the Election Commission of Bhutan [5]. This paper proposes an electoral process aiming at better voter turnout. It replaces whole electoral system using Biometric Fingerprint scanner for the voter authentication and a display unit connected to a central database which helps a voter to cast their vote from nearest polling station instead of having to go to his/her polling station to cast vote. It is a hybrid of internet voting and a traditional electronic voting method where the system uses electronic equipment at the nearest polling station to cast vote instead of using a personal laptop or mobile phone to cast vote using an app. The hybrid system is adopted with the major findings shown in “Internet Voting in Estonia” [13] which is a small country and suitable to adopt internet voting.

RÉSUMÉ. Vingt ans après la signature du protocole de Kyoto de 1997, le 4ème congrès régional de la Commission Asie-Pacifique de la Fédération Internationale des Professeurs de Français s’est tenu à Kyoto même, afin de promouvoir le français dans un souci de préserver l’environnement linguistique, voire de faire de celui-ci, via la francophonie, un garant de la protection de la diversité des langues et des cultures. Bien que l’intention soit louable et sa franchise indiscutable, il est difficile de cerner concrètement les pourtours de cette démarche. Nous présentons dans cet article une recherche basée sur une enquête post-congrès et sur l’analyse du programme dudit congrès pour saisir des représentations que les enseignants-chercheurs en didactique du français se font de cette diversité. Les résultats de ces analyses font comprendre que si la francophonie est réellement vécue, elle et la diversité des langues sont insuffisamment exprimées. Mots-clés : didactique des langues, diversité des langues et des cultures, francophone, francophonophile, langues francophones ABSTRACT. Twenty years after Kyoto Protocol was adopted in 1997, the 4th regional convention of the Asia-Pacific Committee belonging to the International Federation of the French Language Teachers took place in Kyoto to promote the French language in the current climate of language preservation. The tendency is to make the French language a protector of linguistic and cultural diversity. However, this approach is hard to define, regardless the genuine intentions. Based on a post-convention survey of the attendees and on an analysis of the convention’s programme, this research helps to understand some representations that university lecturers and researchers of the French language education have about this diversity. The results of those analysis show that francophonie (the French-speaking world) and linguistic diversity are not much expressed, even though francophonie is well experienced. Abstract:
Les distributeurs sont des intermédiaires économiques car ils offrent sur le marché des produits ou services conçus, fabriqués ou exécutés par d’autres (les fournisseurs). Cette recherche démontre que le degré de protection accordé par le droit positif aux différents distributeurs n’est pas corrélé à leur degré de dépendance aux fournisseurs. Les qualifications de la dépendance sont multiples, incertaines, incohérentes et parfois artificiellement restrictives ou extensives, en droit du travail comme en droit économique. Des distributeurs connaissant un même degré de dépendance à leur fournisseur peuvent être traités de façon différente sans justification au regard des fondements des règles considérées. Il existe ainsi des inégalités de traitement. Il est donc proposé un nouveau droit de la dépendance des distributeurs, plus cohérent et égalitaire. Celui-ci se traduirait par un statut légal des distributeurs remplaçant les multiples statuts spéciaux existants, traçant une frontière plus nette avec le droit du travail et conciliant les intérêts des distributeurs avec la liberté des fournisseurs d’organiser la distribution de leurs produits et services. Dépassant la notion trop restrictive de contrat et les conflits de qualification, ce statut viserait la relation de distribution et prévoirait un régime appréhendant la complexité et l’évolutivité de la dépendance des distributeurs grâce à l’information, à une garantie de revenus et différentes indemnités de fin de relation
Distributors are economic intermediaries because they offer on the market goods and services produced or served by others (the suppliers). This research demonstrates that the degree of protection offered by the Law to the various distributors isn’t correlated with their degree of dependence towards suppliers. The qualifications of dependence are numerous, incoherent and sometimes artificially restrictive or extensive, in labour law as in business law. Distributors experiencing a same degree of dependence towards their supplier can be treated differently without any justification regarding the grounds of the rules in question. Hence, appear inequalities towards the Law. Therefore, new legal rules are suggested. They would take the form of a statute ruling distributors and replacing the numerous statutes in force at the present time. It would draw a clearer line between labour law and business law and conciliate the distributors’ interests with the freedom of suppliers to organize the distribution of their goods and services. Going other the too restrictive notion of contact and the conflicts between qualifications, this statute would rule the relation of distribution and contain rules comprehending the complex and changing nature of dependence. It would ensure sufficient information of distributors and offer them an income guarantee and various compensations when the relation is terminated

This study investigates two penal cases which Franchisee violate the Fair Trade Law. In order to improve the franchisee’s strategy of marketing and franchise, protect franchisee’s interests, the study summarize various violations for references, examples of information outflow and joint actions to avoid losses caused lack of knowledge. The main research methods include litherature reveiew, comparative analysis and case analysis. The results show that most franchisees are penalized by Fair Trade Commission because they don’t understand the significance of misconduct, the fines are not high, or weak law-abiding behavior. Even have continuously penalty by the same cause and matter, and this situation may cause by the small amount of fines. Compared with the enormous benefits, those franchisees don’t even think about improve their misconducts. But those penalties still damage to corporate image and increased overhead. Futhermore, they may affect the business management and result in management crisis. In our country regulations relating franchising owners are only limited by civil law, unfair competition law, consumer protection law and the Fair Trade Commission. There has no specific laws required for franching and it is really inadequate. It is better increase relevant regulations in civil law. Association of franchisee also can publish some penalty cases for vigilance, and provide relevant methods and channels for help to avoid or mitigate losses.

When the framers of the Indian Constitution provided for an institution to ‘superintend, direct and control’ the conduct of elections, they had envisaged a body that would be sufficiently empowered to discharge the responsibility of making the exercise of franchise free and fair. The Election Commission of India (ECI) is not a statutory body. Provided for by the Constitution of India (Article 324), the ECI has a different pedigree, which generates a different set of rules of recognition and source of validation of its authority. The pedigree of the ECI’s powers, which can be traced to Article 324 in the constitutional architecture, has paved the way for the Article becoming, through authoritative judicial interpretations, a repository of the ECI’s powers. These powers buttress the autonomy of the ECI, making it also a site of contestation between itself and the different political regimes.

Abstract:
The first general election in India (1951–52), according to Chief Election Commissioner Sukumar Sen, was an ‘act of faith’, referring to the formidable task of holding the first general elections in a country that had moved into universal adult franchise immediately upon its liberation from colonial rule. The narrative reports of the ECI, prepared after every general election, and innumerable other documents of the ECI constitute a record of the development of bureaucratic practices specific to electoral governance. They also express the ways by which the ECI acquired an identity within the state apparatus commensurate with the constitutional responsibility of performing a political function, while remaining outside the political domain. Contestations over some of the core components of integrity in electoral governance, including questions of adequate representation, inclusive electoral rolls, and a code of conduct for political parties, among others, became crucial in the quest for procedural certainty. The resolution of these contests had ramifications within the political domain.

ZeroPay is a “zero-fee payment service,” which is designed to help small businesses. It is a QR code-based mobile secure payment service that the government, Seoul Metropolitan Government (SMG), bank, and private settlement providers cooperate to reduce small business owners' commission burden. When a consumer recognizes a QR code as a smartphone app, the fees charged by the merchant's franchisee will either be lost or significantly lowered as money transfers from the consumer account to the merchant account. SMG started to ease commissions' burden on small businesses suffering from recession, rising rents, and card fees. However, because of this service started with government policy, ZeroPay started with many controversies, and these issues need to be addressed for the service to settle down stably. The main discussion of this paper is that this service will be applied successfully to the market. The author discusses how the SMG efforts settle successfully with strategically initiated services.
