Abstract:
The ArgumentCarl Gottfried Neumann was born in Königsberg, Prussia, in 1832 and died in Leipzig in 1925. His father was the physicist Franz Neumann (1798–1895), notable for his contributions not only to the study of electricity and magnetism but also to the development of physics education in nineteenth-century Germany. Carl Neumann studied at the University of Königsberg and received his doctorate in 1855 with a work on the application of elliptic integrals to mechanics (Neumann 1856). In 1858 he became Privatdozent, and in 1863 Professor of Mathematics at Halle. Later that same year he moved to Basel, and in 1865 he became Ordinary Professor of Mathematics at Tübingen. Finally in 1868 he was appointed Professor of Mathematics at Leipzig, a post he held until he retired in 1911; of the two mathematics professorships at Leipzig, this was the one formerly held by F. A. Möbius, and it was officially devoted to “the higher mathematics, especially physics” (quoted in Jungnickel and McCormmach 1986, 1:181). So Neumann's academic career, along with his role as one of the founding editors of the Mathematische Annalen beginning in 1869, can be seen as reflecting the enormous advance in mathematical sophistication that German physics underwent in the latter part of the nineteenth century.

Este artigo discute a visão de poder constituinte de Antonio Negri à luz da teoria do direito de Franz Neumann. O texto apresenta as características essenciais do constitucionalismo e a sua crítica por Negri (2015) no livro O Poder Constituinte. Para Negri (2015), o constitucionalismo tem como função central impedir a transformação social radical por meio da con- tenção do poder constituinte. A seguir, o texto discute essa crítica à luz de Franz Neumann (2009; 2013) procurando mostrar que nem toda transformação radical é necessariamente progressista, especialmente se deixar de lado algumas garantias presentes na tradição do constitucionalismo.

Este artigo apresenta a construção conceitual de Franz Neumann elaborada no texto “O conceito de liberdade política”, cuja finalidade principal é diferenciar poder e dominação. Para Neumann, a teoria política deve consistir em uma reflexão sobre a efetivação da liberdade em formas legítimas de poder, as quais se caracterizam por garantir a efetivação da liberdade humana. A liberdade, na visão do autor, é composta de três elementos historicamente construídos, o jurídico, o cognitivo e o volitivo, os quais permitem identificar seis patologias da liberdade que resultam da valorização excessiva ou da desvalorização de cada um de seus elementos; respectivamente, autarquia e legalismo, medo e naturalização, alienação e voluntarismo. Com a utilização deste aparelho conceitual Neumann analisa problemas políticos concretos como o Macartismo que marcou os Estados Unidos dos anos 1950.

En el presente artículo nos proponemos explicitar cuáles son las principales características que Franz Neumann –autor del círculo “externo” de la primera Teoría Crítica– le atribuye a la dominación socio-política. Para abordar esta cuestión es necesario reseñar algunas de las principales tesis de su clásico libro sobre el nacional-socialismo titulado Behemoth, prestando especial atención a su análisis relativo a la destrucción de la racionalidad jurídica. Nos interesa, puntualmente, responder a la siguiente pregunta: ¿hay en su propuesta una concepción de dominación que presuponga, además de coerción, consentimiento y participación de los grupos dominados? Para poder dar cuenta de las distintas aristas que detenta este interrogante, consideramos necesario retomar los aportes que hace Axel Honneth –uno de los tantos teóricos contemporáneos que instan a recuperar los estudios de Neumann– en su libro Crítica del poder, donde hace mención a la existencia de “relaciones bilaterales de dominio”. Aquí veremos que Neumann ofrece precisiones para responder al problema de la “dominación bilateral” –así lo llamaremos–, pero con limitaciones nada desdeñables. Limitaciones que, y ésta es una sugerencia que haremos al final del artículo, podrían sortearse a partir de un diálogo más abarcador que involucre a otros miembros del círculo “externo”

The English version of this article was first published in 1957. The journal tripleC: Communication, Capitalism & Critique republished it 60 years later in 2017. In this essay, Franz L. Neumann discusses the role of anxiety in politics. The article asks: How does it happen that the masses sell their souls to leaders and follow them blindly? On what does the power of attraction of leaders over masses rest? What are the historical situations in which this identification of leader and masses is successful, and what view of history do the men have who accept leaders? For answering these questions, the author suggests a combination of political economy, Freudian political psychology, and ideology critique. He sees anxiety in the context of alienation. Alienation is analysed as a multidimensional phenomenon consisting of economic, political, social and psychological alienation. Neumann introduces the notions of Caesaristic identification, institutionalised anxiety and persecutory anxiety. He obtained a doctoral degree in legal studies at the University of Frankfurt with the dissertation „Rechtsphilosophische Einleitung zu einer Abhandlung über das Verhältnis von Staat und Strafe“ (A Legal-Philosophical Introduction to A Treatise on the Relationship between the State and Punishment). Neumann became the German Social Democratic Party’s (SPD) main legal advisor at a time when the Nazis and Hitler gained strength in Germany. At the time when Hitler came to power in 1933, the legal office had to be closed and Neumann had to flee from Germany. In London, he in 1936 obtained his second doctoral degree from the London School of Economics with the work “The Governance of the Rule of Law” under the supervision of Harold Laski and Karl Mannheim. Neumann moved to New York in 1936, where he became a member of the Institute of Social Research (also known as the “Frankfurt School”) that was then in exile in the USA. In 1942, he started working for the Office of Strategic Service (OSS), where he together with Herbert Marcuse and Otto Kirchheimer analysed Nazi Germany. In 1942, Neumann published his main book is Behemoth: The Structure and Practice of National Socialism, 1933–1944 (2nd, updated edition published in 1944), one of the most profound analyses of Nazi Germany’s political economy and ideology. Franz L. Neumann died in 1954 in a car accident.

<p><strong>RESUMO:</strong></p><p>Este trabalho tem por objetivo trazer as contribuições teóricas de Franz Neumann e Boaventura de Sousa Santos no que tange ao direito e à emancipação. Primeiro são resgatados aspectos históricos das relações entre Estado, Direito e capitalismo. Em seguida são traçadas algumas características das perspectivas dos pensadores, que são posteriormente analisadas em conjunto. Com formações e vivências diversas, os dois autores contribuem para se pensar formas de emancipação social a partir do Direito, ambos polissêmicos. Constata-se semelhanças e divergências entre suas propostas, as últimas notadamente na visão a respeito do direito, que enriquecem o debate atual. Enquanto aquele trabalha primordialmente numa concepção estatal, este transita do local ao global. Ambos enxergam no capitalismo uma barreira para a emancipação e consideram imprescindível transformar os campos estatais, sociais e jurídicos nas páginas da história humana. As próximas, em branco, estão em disputa. A pesquisa é de cunho bibliográfico.</p><p> <strong>ABSTRACT:</strong></p><p>This paper aims to bring theoretical contributions from Franz Neumann and Boaventura de Sousa Santos regarding to law and emancipation. Firstly, historical aspects of relations between State, Law and capitalism are retrieved. Hereupon, some characteristics concerning the two thinkers’ perspectives are outlined and then analyzed en bloc. Having distinct formations and experiences, the two authors contribute to think forms of social emancipation through law, both polissemic terms. Similarities and divergences between their propositions are evidenced, namely in their visions concerning law, which enriches the current debate. While Neumann works mainly in a stateview, Santos transits from local to global. Both see in capitalism a hurdle to emancipation and consider vital to transform state, social and juridical fields in the pages of human history. The next ones, in blank, are in dispute. The research is bibliographical.</p>

By revisiting late-Weimar debates between Carl Schmitt and two left-wing critics, Otto Kirchheimer and Franz L Neumann, we can shed light on the surprising alliance of populist politics with key tenets of economic liberalism, an alliance that vividly manifests itself in the political figure and retrograde policies of Donald Trump. In the process, we can begin to fill a striking lacuna in recent scholarly literature on populism, namely its failure to pay proper attention to matters of political economy. We can also perhaps begin to make sense of the roots of Trump’s assault on the US federal state: formal law and its organizational basis, modern bureaucracy, represent potential restraints on the alliance of populism with neoliberalism.

Resumo O artigo examina os efeitos da ideia de pessoa no direito a partir de um diálogo entre a visão crítica de Evguiéni Pachukanis, para quem o sujeito de direitos é tão somente uma forma de viabilizar a dominação do capital, e as contribuições críticas de Franz Neumann, Michel Foucault e Judith Butler. Neumann centraliza a pessoa como princípio fundamental do Estado de Direito, em razão da possibilidade de responsabilização sobre a dominação. O sujeito de direitos é compreendido então como centro de imputação de direitos e deveres e autor das normas que regulam sua vida. Foucault analisa o poder como forma dinâmica e circular nas relações sociais. Judith Butler contribui com seu conceito de resistência e analisa a prática da crítica como uma relação social do sujeito com as normas. No interior do direito, podemos compreende-la como uma reivindicação das normas com o objetivo de transforma-las, a fim de possibilitar a expressão de diferentes formas de vida. Sugerimos analisar, em suma, a possibilidade de uma gramática da regulação social e a ideia de pessoa no direito como propulsora de um processo de construção autônoma e constante de critérios normativos, com base na formulação de igualdade dos sujeitos perante o direito.

Gdy zwrócono się do mnie, bym omówił kwestię „aktualności Behemota”, od razu pomyślałem, że w tytule brak jednego słowa: „dzisiaj”. Szczególnie dzisiaj, gdy ponownie analizujemy reżim narodowosocjalistyczny – nie tylko w Niemczech, lecz na wszystkich kontynentach – warto zadać sobie pytanie, dlaczego Franz Neumann nie jest częściej cytowany w publikowanych obecnie książkach. To zrozumiałe w czasach, gdy ukazuje się tak wiele książek, że fundamentalne idee, od których zależy tak wiele badań i tekstów, nareszcie stają się częścią książek, bez przywoływania ich autorów. Długość jednego pokolenia – gdy mowa o ludziach – wynosi zapewne 25 lat, a przy małym przyroście naturalnym być może 30 lat, natomiast w działalności wydawniczej możemy mówić nawet o dziesięciu latach; w tym czasie pojawia się nowa generacja autorów, których książki mają nową formę i pisane są z nowego punktu widzenia. W tym sensie od wydania Behemota minęło kilka pokoleń.

Paolo Gerbaudo’s book The Mask and the Flag: Populism, Citizenism and Global Protest, whose approach is reflected in his Crosscurrents piece in the issue of Media, Culture & Society at hand, is a response to these societal, political and academic challenges. This CrossCurrents comment asks, I ask, the following: Why is it that right-wing authoritarian populism in recent times has become much more popular than left-wing movements? How do right-wing authoritarian movements communicate? Why is it that right-wing political communication strategies seem to garner and result in mass support? The critical theory of authoritarianism advanced by the Frankfurt School and related authors on fascism, Nazism, and the authoritarian personality help us to critically analyse the communication of authoritarianism. In this context, particularly the works by Franz Leopold Neumann, Erich Fromm, Theodor W. Adorno, Herbert Marcuse, Leo Löwenthal, and Willhelm Reich are relevant.

AbstractThis article focuses on the joint campaign of “remigrés” and American authorities to “westernize” the local Social Democratic Party (SPD) in Berlin during the early Cold War. The years 1948 to 1958 witnessed one of postwar Germany's most bitter intraparty struggles for leadership within the Berlin SPD, where a faction of remigrés led by Ernst Reuter and Willy Brandt wrestled for control with the so-calledKeulenriegearound Franz Neumann. Examining clandestine American support for the remigré faction, which included favorable media coverage and considerable financial contributions, this article focuses in particular on the political maneuvering of a German-American network around Shepard Stone, political advisor to U.S. Commissioner John McCloy. An investigation of the postwar power struggle within the Berlin SPD offers fresh perspectives on three related subjects: the role of remigrés in postwar Germany history; the political clout of informal German-American networks; and West Berlin as an alternative laboratory of German democratization.

This article considers the July 2014 decision of the European Court of Human Rights in SAS v France in which the court upheld the legality of a ban on the wearing of the burqa and niqab in public places. Exploring the connection between SAS and a related trend of deference to the will of the national community in the court’s jurisprudence, it relies on Joseph Slaughter’s work to argue that the decision is best explained on the basis of what Theodor Adorno termed ‘identity thinking’ which, in a human rights context, involves the conceptualisation of human identity as something existing in and defined by the community rather than the individual. Drawing on the work of Franz Neumann, Otto Kirchheimer and Peter Mair, the article reflects on the social and political function of the ECtHR in the light of SAS and argues for an alignment between international human rights practice and the ‘non-identity thinking’ that Adorno advocated.

This article is based on the novel “The Kindly Ones”, by Jonathan Littell, and its main objective is to explore the experiences of its main character, Maximilien Aue, a Nazi officer, an SS member, a jurist, and a juris doctor, who on several occasions assumed the condition of executioner in one of the Einsatzgruppen that acted in the rear of the German front during the War against the Soviet Union. This study seeks to explore the relationship of this character with a political regime marked by authoritarianism and the erosion of the legal forms that characterize a Rechtsstaat – metaphorized in the figure of the Behemoth, in the interpretation given by Franz Neumann. The methodological structure is guided by strategies of approximation between law and literature, in order to allow, from the construction of a common hermeneutic situation, different ways of relating to the truth established in these two fields of knowledge to access new interpretations in order to analyze the intricate relationship between law and authoritarianism. The outcome, starting from Max Aue’s tragic experience, illuminated the fate reserved for those who, as people or individuals, had awakened the Erinyes from their benevolent sleep.

Almanya’da Weimar Cumhuriyeti ve ardından gelen Üçüncü Reich’taki siyasal problemler üzerinden Alman devlet kuramı bu iki tartışmada merkezi konumda olmuştur. Nazi hukukçularının Üçüncü Reich’a hukuksal temellerini kazandırmak için verdiği uğraş, sosyal demokrat hukukçular tarafından savaş sonrası dönemde çokça eleştirilmiştir. Bu çalışmada Nazi hükümetinin başhukukçusu olarak bilinen Carl Schmitt ile Frankfurt Okulu düşünürlerinden Franz L. Neumann’ın hukuk devleti eleştirileri üzerinden hukuk ve devleti nasıl tanımladıkları ve bu iki kavramı birbiriyle nasıl ilişkilendirdikleri ele alınacaktır. Abstract:What, if anything, can constitutions do to resist democratic backsliding? The collapse of the Weimar Republic has led scholars of comparative politics to conclude that constitutional forms and institutions can do little to resist the breakdown of democracy and the rise of autocracy. This paper offers a constitutionalist response. The outlines of that answer can be found in decades-old policy documents produced by a set of German émigré scholars during and in the immediate aftermath of the Second World War: Franz Neumann, Herbert Marcuse, and Otto Kirchheimer. The secret reports root constitutional stability in the creation of a framework for bounded partisan pluralist contestation among political parties that track the principal social and economic cleavages, and that is rooted within, and does not seek to overthrow, the underlying political economy. Second, the secret reports highlight the importance of constitutional design in creating a constitutional infrastructure for bounded pluralistic political contestation, especially with respect to the role of political parties. Third, the secret reports suggest a counter-narrative of the German Basic Law as creating a framework for political contestation that reinforces constitutional stability instead of undermining it.

Este artigo tem por objetivo analisar comparativamente as semelhanças contidas nas críticas à democracia liberal presentes em alguns trabalhos selecionados de Carl Schmitt (1888-1985) e Robert Kurz (1943-2012). A despeito da estreita associação do primeiro autor com o regime nazista após 1933 e do segundo ser normalmente caracterizado como um pensador marxista (embora bastante crítico ao marxismo “ortodoxo”), são verificáveis inúmeras similitudes entre ambos quando se propõem a analisar as características do liberalismo parlamentar das democracias do século XX. Uma hipótese que pode explicar tais semelhanças seria a influência exercida por Schmitt sobre diversos teóricos da escola de Frankfurt, com os quais Kurz frequentemente dialoga em seus escritos e que foram inspiradores de algumas de suas reflexões – em especial, Walter Benjamin, Theodor Adorno e Max Horkheimer, embora Schmitt também tenha influenciado Franz Neumann, Otto Kirchheimer, Karl Korsch e Herbert Marcuse. Outra via de interpretação abordada aqui se refere à possibilidade de Schmitt ter encontrado, em suas teorias sobre o Estado e sobre o direito, os limites epistemológicos do liberalismo moderno, o que constitui o principal objeto de pesquisa de Kurz e foi tema recorrente nos escritos dos teóricos de Frankfurt.

<p>El texto propone categorías metodológicas que asuman una postura crítica, las cuales se pueden emplear en el diseño de proyectos de investigación empírica en derecho. Proyectos cuyo interés sea describir y exigir la racionalidad de las instituciones del Estado de derecho. Esta forma de legitimación del poder supone la necesidad de decidir conforme la voluntad de las leyes y no conforme la de los hombres. Para alcanzar su objetivo el documento propone las categorías “fuga del derecho”, “falsa legalidad” y “zona de autoridad”, desarrolladas a partir de la obra de Franz. L. Neumann, cuyo propósito es evidenciar y criticar los criterios utilizados por el poder para justificar jurídicamente sus actos y, eventualmente, reflexionar sobre el significado de su ausencia. El uso de dichas categorías procura posibilitar la identificación de los problemas de investigación que relacionen las categorías de racionalidad interna del derecho con los conflictos en la sociedad civil, revelando los momentos en los que el poder decide la forma autárquica, pervirtiendo el derecho para imponer una decisión de forma unilateral, es decir, sin una justificación que cumpla con las exigencias de la promesa de legitimidad contenida en la idea del Estado de derecho.</p>

AbstractThe article explores the key components of the political project of West Germany and the role of the Rechtsstaat within it. It shows how the German Federal Republic developed a specific reading of the rule of law as an order founded on basic rights as supra-legal values and judicial authority, which had to be defended even against democratic government. This did not signify a departure from the constitutional theory of the Weimar period, as constitutional lawyers such as Gustav Radbruch and Carlo Schmid claimed at the time. Instead, the decisive innovations in constitutional thought stemmed from the Weimar era. Judicial review and basic rights had been instruments in a political and legal struggle over the social question and the boundaries of democratic decision-making in the 1920s. They had been invoked by conservative lawyers such as Carl Schmitt and been the subject of a substantial critique mounted by social democrat interpreters of the Weimar Constitution such as Hermann Heller and Franz Neumann. As such the Rechtsstaat, which is so strongly associated with the renewal of German democracy, carries with it a tradition of legal thought which systematically and successfully expanded judicial power to the detriment of the legislature and democratic action.
