Kennington, Mathis Alan Vila. "Ambiguous Freedom: A Grounded Theoretical Analysis of Life Outside Prison." Diss., Virginia Tech, 2013. http://hdl.handle.net/10919/24194.

Full text
Abstract:
Prisonization refers to the idea that prisoners assimilate to prison society, import criminogenic characteristics, and are deprived by prison culture. Post-carceral prisonization is the process by which excarcerated prisoners (EXP) are socialized by features of prisonization that persist after release, and which manifest under probation and parole. Post-carceral prisonization occurs as a result of stigma and discrimination and a lack of access to crucial resources like employment, housing, and prosocial ties. EXPs make a decision to change their lives during or immediately following release from prison or jail, usually accompanied by a spiritual or religious change. EXPs seek to reform identities constructed both by years of incarceration and by their experiences with "prison satellites" which are prisonization agents that emerge after release. Hindered by a loss of social, economic, and material assets, the threat of sudden and unexplainable incarceration, and lifelong criminal stigma, EXPs endeavor to positively reform their identities and their lives.

Full text
Abstract:
This study models roll motion response of a barge subjected to beam sea conditions as a single degree of freedom system. The measured wave, either regular or random, is input into a computer program which uses a fourth order Runge Kutta integration method to numerically predict roll motion response. The simulated results are compared to measured data to determine the best system damping parameters. Four different forms of the damping moment of the SDOF model are analyzed. In each form all coefficients are known except for the linear and nonlinear damping parameters. Each form uses a combination of relative motion Morison' damping and/or linear structural damping. Predicted results of the four forms of the damping moment are examined to determine the most suitable model. A sensitivity study on the response to various system parameters is then conducted on the selected form. Each form of the model uses a thirteenth order polynomial restoring moment. An analysis is also conducted to determine the effects of using lower order terms to represent the restoring moment. Finally, results of the SDOF model from this report are compared with a 3DOF and a 2DOF model subjected to the same wave environment to determine which model more accurately predicts roll response

Abstract:
During strong ground shaking structures often become inelastic and respond hysteretically. Therefore, in this study some hysteretic models commonly used in seismic structural analysis are studied. In particular the characteristics of a popular endochronic model proposed by Bouc and Wen are examined in detail. In addition, analytical expressions have also been developed for most commonly used bilinear model as well as another model, herein called as the hyperbolic model.

Full text
Abstract:
The single-degree-of-freedom (SDOF) transformation factors as tabulated in John Biggs’ textbook (Biggs 1964) are accepted as the equivalent factors for simplifying and analyzing a component's response to blast. The study validates the stiffness and mass transformation factors through multi-degree-of-freedom (MDOF) numerical methods. After validating the transformation factors, the MDOF numerical method is used to create new stiffness and mass transformation factors for loading cases not already included in Biggs’ textbook. The validated factors, as well as the newly developed factors are used in SDOF analyses. The deflections from the SDOF responses accurately predict the MDOF responses as long as the component behaves elastically; however, the deflections diverge when inelastic behavior is involved. The diverged deflections indicate that the SDOF inelastic response analysis method can be improved.

There is a conflict of rights between homosexuals and individuals who follow religions that preach that homosexuality is contrary to the laws of God and marriage is a sacred union between one man and one woman. This conflict was intensified after the legalization of same-sex marriage. On the one hand, homosexual individuals have the right to equality, which means they must not be discriminated on basis of sexual orientation; on the other hand, religious individuals have the right to believe in a religion and act according to their beliefs. This paper will examine three situations that might cause conflict: the refusal to celebrate or contribute to a same-sex wedding, because of one s religious views on marriage; the refusal to assist a homosexual patient or a same-sex couple, by a psychologist or counselor whose religious beliefs prevent them from affirming homosexuality or assisting a same-sex union; the religiously motivated refusal to print materials that promote same-sex marriage or other LGBT interests. This dissertation will look at foreign studies on the matter, and will examine ten judicial decisions on cases that occurred in the United States, United Kingdom and Canada, in order to help create clear parameters to resolve the controversy, which is likely to soon arise in Brazil.

Abstract:
The value of liberty is one of our most fundamental commitments. Given this commitment, judgments concerning coercion are of profound moral significance. The concept of liberty is usually defined as the absence of coercion; so defined, the very important moral and political value of liberty is safeguarded only when coercion is excluded. Presently, the concept of coercion is inadequately defined, and in drastic need of clear analysis. An important area in which individuals express their liberty is through voluntary agreements made under the law of contracts. The moral defense of the law of contracts rests on the belief that contracts facilitate individuals' opportunities for self-determination; liberty being a necessary condition for self-determination necessitates the exclusion of all forms of coercion in contracts. Market interactions have a particular character and occur within a specific institutional framework. Using economic models, I argue that other accounts of coercion have failed to capture the unique character of coercion in market interactions. The "normalcy" criterion, which is the most prevalent approach to distinguishing coercive proposals from noncoercive ones, assumes that a person's status quo is an appropriate point from which to distinguish coercive proposals from noncoercive proposals. I argue that under certain ideal conditions in the market, a perfectly competitive market, this assumption might be legitimate. I utilize game-theoretic models to analyze the nature of coercive proposals in an imperfectly competitive market. The bargaining advantages that agents have, which are a function of certain background conditions, give them bargaining power over others with whom they negotiate. I argue that when the following conditions are present coercion can arise in the market: the status quo of an agent (or his "threat-advantage") is stronger in relation to the agent with whom he is dealing and he takes advantage of his stronger bargaining position, exploiting the deprivation that the weaker agent will face if he does not comply. I apply this analysis of coercion to the law of contracts, specifically, to the doctrines of duress and unconscionability.

Abstract:
This research represents a comparative analysis of the Bulgarian and Romanian European Integration in terms of corruption and media freedom. I argue that, however, both states have multiple common grounds to be analyzed together, as is done in the previous academic research, they take rather different paths after their accession in the European Union regarding their progress in fighting corruption and ensuring free media. I analyze why and how this happens through the theoretical lenses of Constructivism on the matters of identity formation, integration, and spread of values. I will present an overview of the IR academic discourse on the topic, then attempting to fill its lapses in the Analysis section. There, I utilize qualitative content analysis on official reports, issued by the European Commission within these 10 years framework of EU membership in order to investigate the research question. I am to interpret the information from these sources and present the four major aspects of the case, leading to the current situation.

s motion trajectory in the laboratory environment. After explaining the need for such platforms for the military industry, the existing devices will be presented and discussed. Then the design period will be explained while pointing out the key performance criteria. The gathered performance values of the first design iteration will be presented and the modifications done in order to get to the expected performance will be given. Finally an investigation, in order to find the maximum payload that the platform can handle, is performed and presented. It is too hard to get to the desired performance values in mechanical design and manufacturing without using the CAD (Computer Aided Design) and CAM (Computer Aided Manufacturing) programs. In this thesis ProEngineer Wildfire®
is used for solid modeling the components, the sub-assemblies and the final assembly, ANSYS Workbench®
is used for investigating the modal behavior of the components, ADAMS®
2003 is used for the dynamic simulation of the mechanism, ADAMS/Flex®
, ADAMS/AutoFlex®
and ADAMS/Durability®
are used to analyze the results when flexibility is embedded into the system. At the end of the thesis in Appendix section five technical drawings with the nominal dimensions are given in order to clarify the construction period. By the regulations that must be obeyed in ASELSAN only the nominal dimensions are given in the technical drawings. All the dimensional and geometrical tolerances are given in the approved technical drawings that are proprietary of ASELSAN. Abstract:
This student thesis aims to analyze the unbalance on rotating machinery by simulation and experimental. The machinery flywheel rotation is modelled as a Single Degree of Freedom (SDOF) and Multi Degree of Freedom (MDOF) system. The model rotation unbalance is simulated by MATLAB. Then the vibration measurement is taken by experimental. In addition, the tachometer is used to determine the flywheel speed calibration. Finally, the rotating unbalance reduction simulation is performed with different parameter value to determine an optimum level of machinery rotation vibration. Unbalance on rotating machinery causes a harmful influence on the environment and machinery. The root cause of rotating unbalance is determined by the simulation and experimental analysis. The analysis result is used as an indicator for predicting machinery breakdown and estimating the correct predictive maintenance action for the machinery. In this project, the simulation and experimental analysis were carried out on a rotating component of the KICKR Snap Bike Trainer. The simulation and numerical analysis are performed by MATLAB programme. On the experimental part, the vibration measurement method and results were discussed. The suggestion of unbalance reduction were recommended base on measurement and vibration analysis results.

Full text
Abstract:
The aim of this dissertation is to explore and understand three important social contexts for the becoming of an artistic subjectivity: education, work and family life. The empirical data consist of interview material with alumni from the Royal Institute of Art in Stockholm, staff of the institute, and a survey material from the Swedish National Artists Organization (KRO/KIF). Generally, the thesis employs a theory of conflicting understandings of labour as well as the importance of discourses and narratives for the formation of subjects. The contribution of the thesis is the analysis of a continuing conflict between being and working as an artist actualized in the social contexts explored. The arts education encouraged a romanticized understanding of art as unrelated to market value, which clashed against societal norms of career progression, survival and supporting a family. This conflict informed the subjective way in which the respondents related to their activities as artists, workers and relatives. The concept of freedom can be understood as mediating this conflict in the sense of forming the basis of attraction to the arts but also a burden as it relates to insecurity. The analysis found several subjective representations of the artist that indicate strong norms of individuality and self-direction, understood as the outcome of a working life fraught with personal responsibility for coping with insecurity. As such, the thesis is part of ongoing research on changes in working life towards non-standard and sometimes precarious working conditions.

This thesis presents the kinematic behavior of a motion simulator with six degrees of freedom, using a new computational analysis approach. A well-known simulation software with proven performance, Matlab, is used to validate another software environment, Working Model 3D, which is used to develop and study kinematic models of parallel mechanisms.Planar mechanism using three rotational joints, 3RRR, are studied through kinematic analysis and some singularity studies are developed, which resulted in some suggestions for future analysis and studies. Also, an introductory study of spatial-parallel mechanisms is presented regarding motion simulators with six degrees of freedom through simulation studies of Stewart-Gough platform. The feasibility of this new kinematic analysis was proven by means of several simulations, including the coupling of a vehicular chassis in the platform modeling.

Abstract:
One of the key causes of disharmony on a global scale, throughout human history, has been the disregard for the protection of religious expression. This goes some way to explaining why the international community in the post-war era, particularly after World War II, have enacted legal instruments and implemented policies aimed at promoting religious freedoms at global and regional levels. Regionally, the ECHR with implementation mechanisms has led the way in terms of upholding the protection of religious rights and freedoms. Having progressive and effective mechanisms to protect human rights does not mean that decisions of the ECtHR as a judicial body are free of criticism. For example, the ECtHR has ruled in the number of cases against the practice of religious expression, particularly in cases relating to the wearing of the headscarf. These decisions, the ECtHR argues, were taken on the grounds of secularism and prevention of fundamentalism and intolerance. This research, unlike others written on the subject, examines the concepts of fundamentalism and tolerance through a historical and philosophical approach, which will be used to argue that a restriction on the headscarf cannot legally or logically be justified as the bases used by the court to provide a rationale for the rulings are undefined, ambiguous and often in conflict with the principle of religious expression. The ECtHR often prioritises national policies and political considerations such as secularism over the personal right to freedom of religious expression. Notably, recent polices in Turkey which now allow and encourage the wearing of headscarf in public places call into question the validity of previous judgments of the ECtHR supporting the ban on wearing of the headscarf. As a part of the qualitative methodology the researcher has chosen three methods to conduct this research including black-letter, historical and comparative themes. This thesis is critically analysis ECtHR cases relating to freedom of religious expression in the context of the wearing of the headscarf. In doing this thesis further explores the relationship between Article 9 ECHR, the wearing of the headscarf, and the concepts of fundamentalism and intolerance. The researcher argues that the link between the wearing of the headscarf and intolerant or fundamentalist behaviour is a difficult one to prove, and that by supporting the ban on wearing of the headscarf on grounds including intolerance, the ECtHR’s decisions are in effect validating intolerance of religious expression.

Abstract:
The aim of this thesis is to analyze how the film Freedom Writers, released in 2007 anddirected by Richard LaGravenese, reflects on the topic of racism. The analysis is based on twoof the key tenets of Critical Race Theory, “Whiteness as Property” and “Commitment to SocialJustice”, which are used as analytical tools. Furthermore, the analysis also includes RacialIdentity Development Theory, which represents different stages of development as people beginto define themselves in relation to others. This thesis further evaluates pedagogical implicationsin connection to the analysis of Freedom Writers and Critical Race Theory. The results showthat racism is depicted in Freedom Writers through the concept of Whiteness as Property, andthe differences between white characters and characters of color are significant due to theirdifferent views on social justice. In addition, the results show that Freedom Writers may serveas a thought-provoking resource to use in the Swedish EFL classroom to create awareness aboutand discuss the importance of aspects such as racism, empowerment, and social justice in theworld and with regard to the students’ own knowledge.

Oxford, John Taylor Jr. "Analysis of multiple flight control architectures on a six degree of freedom general aviation aircraft." Thesis, Wichita State University, 2012. http://hdl.handle.net/10057/5418.

Full text
Abstract:
The thesis documents the expansion of model reference adaptive control (MRAC) research previously developed at Wichita State University. This research was conducted in response to the National Aeronautics and Space Administration’s Integrated Resilient Aircraft Control project. The project seeks to develop new types of flight control systems that have the ability to react to unforeseen changes in the aircraft or its environment. Desktop simulations conducted have shown the ability to meet the results desired from the project. A desktop simulation for a six degree of freedom model of a Hawker Beechcraft Bonanza is modified with multiple MRAC architectures. These architectures include a model follower and proportional derivative and proportional integral controllers. In addition, an artificial neural network is used to compensate for modeling error and changes in the aircraft or the environment. The adaptive elements within each artificial neural network range from simplified bias only neural networks to linear basis vectors with additional modification terms. Each architecture was simulated to determine the error between the desired and actual aircraft state. Further analysis was conducted to determine time delay margin within each control loop. Finally, a comparison of architectures was conducted to determine which controller would be suited for flight testing on the Hawker Beechcraft Bonanza testbed.

Aykota, Cansu. "Painting the steps : a socio-legal analysis of the freedom of the press in Turkey." Thesis, Brunel University, 2016. http://bura.brunel.ac.uk/handle/2438/13657.

Full text
Abstract:
Over recent years, censorship of the press in Turkey has been under international scrutiny, having been examined on the basis of recent political developments such as the Justice and Development Party’s democratisation promises with the incentive of the EU accession process and the role of the press in Turkey’s democratisation. This research aims to widen the terms of reference by providing a unifying framework for the problems posed by political, historical, and legal agents to press freedom, and analysing their interrelation throughout the history of modern Turkey. It seeks to identify the hindrances encountered by the press, which has its roots in the deep-seated State ideology and institutional framework that prioritises state security over individual rights and freedoms. This thesis therefore sets forth the inextricable link between the political history of Turkey and the current application of the law, and presents an in-depth analysis of Turkish political history in relation to press freedom, legal scholarship, and case-law as evidence to demonstrate this. The analysis of the obstacles to establishing stronger legal protection for the press that would not be affected by political change, is based on doctrinal and socio-legal analysis that investigates the flaws in the Turkish Constitution, Turkish Penal Code and Turkish Anti-Terror Law and questions the judicial approach to the implementation of the right to free expression of the press. The thesis specifies the loopholes in Turkish legislation that allow insufficient legal protection for freedom of the press and the inefficiency of the judiciary to realise the press’s right to free expression. The thesis recommends practical amendments to clarify broadly drawn legal provisions. A reduction in judicial bureaucracy to eliminate political influences on the judiciary. Judicial training for the internalisation of the right to free expression of the press as a human right . All of which would help overcome institutional hindrances based on the perception of a critical press as a threat to state security and national interest.

Gorlach, Vsevolod Igorevich. "An econometric analysis of the impact of economic freedom on economic growth in the SADC." Thesis, Nelson Mandela Metropolitan University, 2011. http://hdl.handle.net/10948/1539.

Full text
Abstract:
The conventional approach to increasing economic growth - increasing inputs, such as labour and capital, is not always possible. The wider, fundamental sources of economic growth need to be considered too. Foreign aid is a temporary lifeline and does not spur economic growth. Conversely, financial assistance negatively affects growth and can hamper development prospects. Economic freedom and economically freer countries have been associated with higher growth rates, higher per capita incomes, greater volumes of trade, prosperity and overall wellbeing. By improving their economic freedom, deregulating the economy and allowing economic freedom to prosper, countries can experience sustained GDP growth. Previous studies have shown that economic freedom and economic growth are exponentially related - and that by initially becoming freer, countires can increase their growth rates at higher rates. The main objective of the SADC is to achieve development and economic growth, to alleviate poverty and enhance the standard and quality of life for the peoples of Southern Africa. The SADC is attempting to achieve economic integration through macroeconomic convergence. A number of macroeconomic variables have been set to act as primary indicators. These include inflation, fiscal balance, public debt and the current account balance. By introducing the concept that economic freedom can lead to higher growth rates and being able to identify economic freedom, it makes it possible to investigate how the SADC can achieve its set goals by becoming freer. By investigating individual components that constitute the overall freedom index, it becomes possible to establish the relationship that exists between this viriable and economic growth. This will illustrate where deregulation and freedom are most effective and where policy decisions need to be highlighted. The 2008 economic crisis revealed that countries that decreased their economic freedom have fared worse than countries allowing freedom to prosper. Government fiscal stimulus has had no positive impact on growth rates; the negative effects of reducing economic freedom will onlky be fully seen in future years. However, the majority of the SADC countries showed a relatively strong fiscal stance during the recession. This study established whether that a positive relationship between economic freedom and economic growth in the SADC. Secondly, the direction of causality that economic freedom leads to economic growth. The findings reveal that economic freedom fosters economic growth in general, and for the SADC in particular. Empirical evidence has been found for the SADC; and the implications of becoming freer are more fully explained.

Abstract:
The objective of this research was to contribute to the discussion about LGBT-rights in Swedish politics. Some previous findings suggested that one political party in particular, the Swedish Democrats, had an opposing stance towards LGBT-persons. To investigate this, the first research question aimed to find out if there are in fact any notable differences between the different parties in the Swedish parliament in this regard. The second research question was designed in order to examine all related opinions of the parties in the light of positive and negative freedom. The third research question aimed to find out how the attitudes from the political parties could be understood within a perspective of tolerance. The analytical framework is based on the concept of tolerance, and the concepts of positive and negative freedom which were originally developed by Isiah Berlin. The study is a qualitative text-analysis with an abductive approach. Argumentation analysis has been applied when suitable. The study found that the Swedish Democrats was the most restrictive party in this context. Moreover, the studied policies were found to have characteristics of both negative and positive freedom, and they were generally approved upon by the political parties. Lastly, the Swedish Democrats and the Christian Democrats were argued to be tolerant towards these LGBT-policies, even though the policies were mostly disliked due to moral clashes against their core family values.

Xiao, W. "Freedom of information reform in China : information flow analysis." Thesis, 2010. https://eprints.utas.edu.au/22348/1/whole_XiaoWeibing2010_thesis.pdf.

Full text
Abstract:
Most non-Chinese scholars have approached Freedom of Information (FOI) in China as a recent, strange and intriguing phenomenon. This thesis uses an array of Chinese sources, interviews with Chinese officials and citizens and information flow analysis to propose a more complex and detailed understanding of the evolution of FOI in China. The thesis argues that information flow, a theme to explore the gradual development of government receptivity to FOI in an information environment through time, can be used as a new explanatory model for FOI reform in a jurisdiction. China serves as an example to substantiate this argument. The origins of China's FOI legislation need to be understood within the context of improved information flow conditions resulting from multifaceted factors, including social, political, legal and economic ones. This improved information flow has constituted an enabling environment for the adoption of FOI legislation. This thesis also argues that it is necessary to reassess the widely divergent origins of FOI reform in China. By applying information flow analysis, the thesis asserts that social, political and legal factors should be accorded central roles in understanding the development of FOI in China. Economic growth and anti-corruption efforts in the process should be allocated important but secondary roles. This thesis uses information flow analysis to find that FOI reform in China formed part of a much longer process of increased transparency in the Chinese information environment, which gradually shifted from the acceptance of proactive disclosure to that of reactive disclosure. FOI thus has become a beneficiary of this gradual transformation of the Chinese information environment. This is the reason China has adopted a push model of FOI legislation stressing proactive disclosure of government information, which differs from many countries that have introduced a pull version of FOI legislation emphasising reactive disclosure through responses to access requests. The thesis maintains that existing compliance analysis focuses heavily on reactive disclosure, and thus is restricted in its application to China. It therefore utilises a revised compliance analysis model that focuses on both proactive and reactive disclosure. The revised model incorporates findings from empirical research conducted in China, allowing a more effective and dynamic analysis of compliance issues in China. Whilst information flow analysis in this thesis is limited in its application to an explanation of China's FOI phenomenon, it may have wider applicability as it is a dynamic and systematic explanatory framework for FOI.

Manley-Casimir, Michael E. "The meaning of ’freedom of conscience’ in the Canadian Charter of Rights and Freedoms : a polyvocal cultural analysis." Thesis, 2004. http://hdl.handle.net/2429/15327.

Full text
Abstract:
This thesis examines the meaning of freedom of conscience and religion in s. 2 (a) of the "Canadian Charter of Rights and Freedoms". Set within a polyvocal cultural heuristic, the thesis uses the voices of dramatists, historians, judges, legal theorists and ordinary people to illustrate and document the development and evolution of the meaning of conscience. In particular, the thesis focuses on whether 'freedom of conscience and religion' is one integrated right or whether the notions of 'conscience' and 'religion' are separable, such that it is possible to argue a non-religious, secular claim to conscience on constitutional grounds. Claims of conscience typically arise when the action of the state, for example through legislation, places an individual in the position where his/her unconditionally important beliefs or principles are threatened or offended. Under these circumstances state action may be perceived by individuals as coercive and may create a personal dilemma of significant gravity. The right to freedom of conscience confers upon the individual not to be coerced by state action. Since the "Charter of Rights and Freedoms" confers the right to freedom of conscience and religion upon 'everyone', this language must by definition extend to those whose conscience is religiously informed as well as to those whose conscience is secular and ethically grounded. Hence both religiously informed claims and secular, ethical claims must be eligible to receive constitutional recognition. The thesis concludes by articulating the elements of a test to enable judicial recognition of a valid claim to conscience on secular, ethical grounds within the framework of a pluralist and multicultural society.

Through theoretical and empirical study, this research focused primarily on the construct model of Economic Freedom indicators. The analytical results have indicated that Economic Freedom construct model consisted of two parts: 1. Economic Incentive and Institutional regime: property right, freedom from corruption, business freedom, investment freedom, financial freedom, monetary freedom, trade freedom, and labor freedom. 2. Government Size: the size of government expenditure and taxes. Finally, this study concluded that, in order to construct the model of Economic Freedom, one needed to look into the essentiality of property right, freedom from corruption, business freedom, investment freedom, and financial freedom factors all together.
