Abstract:
Although political pluralism is crucial to a new democracy’s advancement, democracy is not just about competition for office. That competition must happen not through violence but through elections. Put differently, the democratic game must be played under stable conditions, and conflicts must be expressed and resolved through democratic means. Without stability, political pluralism will produce—not a well-functioning democracy—but a full-fledged civil war. In a chaotic political environment filled with uncertainty, what’s needed is an external referee with a steady hand. The referee must maintain a basic level of public tranquility, enforce the rules of the democratic game, arbitrate conflicts, and resolve disputes. Although other state institutions can also play referee, this chapter explains why the military enjoys a clear edge, at least in some cases, in serving as a stabilizing anchor.

Abstract:
The regulation of various markets has increased significantly in recent years. Although the lack of appropriate regulation can be very dangerous, it is nevertheless important to avoid overregulation in order to not jeopardise economic freedom as the basis of the socio-economic system in the Western world. This comparative study covers competition law as well as sectoral regulations of the telecommunications, energy and financial markets, and aims to examine common principles against which the actions of different regulators can be assessed. The authors’ second step is to establish common standards for the assessment of regulatory intervention in economic freedom. This book will be of importance not only to private sector practitioners, but also to regulators in EU Member States and national and EU legislators, and already takes into account the implementation of increased regulation in the coronavirus crisis. Abstract:
This chapter examines restrictions that professional sports leagues and governing bodies place on the freedom of movement of professional players—both negotiated and imposed—and how these restrictions fit within the antitrust/competition and labor law regimes. This chapter engages in a comparison of the North American and European “models” of restrictions and finds that the North American “model” is more likely to withstand antitrust/competition law scrutiny. The North American model falls under the protections offered to collectively bargained agreements, while the European model currently faces scrutiny for potential violations of European competition law. Nevertheless, this chapter suggests that these two models are likely to converge as the internationalization of sport continues. European governing bodies may be pushed to negotiate with players more in the future, while North American leagues are already adopting “European” practices in regard to facilitating player movement among other professional leagues.
