Full textThe history of the spread of French in China finds itself at the intersection of multiple productive areas of research. To cite only the most important of them, consider the history of the opening-up of China, the overseas cultural action of France and the history of cultural relations. For some time now, these areas of research have been witnessing a true growth of strength within the field of international studies. As such, the francophony in China represents an area of inquiry which could contribute to enriching other branches of International Studies, which has traditionally been focused on the political and economic dimensions and on the nations in a position of power. The spread of French in China is the fruit of interaction between Chinese and French initiatives. Granted, the first French programs were created by French missionaries in the middle of the 19th century. Nevertheless, initiatives on the part of Chinese multiplied and soon made their importance felt. The French language had actually been bound up with the dream of Chinese of achieving national revival across the fields of military, economy, politics and culture. Indeed, highly noteworthy is the fact that thanks to the efforts of Chinese, higher education programs taught in French were made available as early as the beginning of the 20th century – the institution in question was Tongwen guan [Governmental School of Foreign Languages], which in its turn was merged into Jingshi Daxuetang [Imperial Capital University, predecessor of Peking University] in Beijing in 1902. Benefitting from a generally favorable environment in China, French cultural action kept renewing itself. Spanning 100 years without interruption over the period 1849-1949, it offered both religious and non-religious programs, restricted, however, almost entirely to primary and secondary education. After 1949 however, largely because of cold war and the Cultural Revolution gripping China in 1966-1975, such French initiatives were absent for several decades and did not make their come-back until the opening-up policy of China at the end of the 1970s. Henceforth, on the basis of reciprocity and leveraging the attractive force of France to Chinese college students, the French authorities have been deepening ties with China. At the same time, they rely heavily on l’Alliance Française, which has been expanding rapidly in China thanks to both its ability of adapting to local circumstances and the diversification of the overseas study destinations of Chinese college students

Full textIn the context of the debate on approach towards geographical indication protection (the choice between sui generis or trademark regime), this thesis aims to deepen the reflection on what approach is needed for China. It asks one question: if it is true that the concept of terroir underpins the French and European sui generis regime of GIs, why does the sui generis regime, when transplanted in China, gets only a cold reception, despite of the fact that China is endowed with a large number of products with a strong tradition and anchored in the terroir of their place of origin? This question leads us to: retrace the history of how the notion of GIs, along with the sui generis laws governing them, emerged in Europe and was transplanted to China; demonstrate the extent to which the European approach is adopted in China, through conducting a comparative study of the laws in France, the EU and China; show the setback that the transplanted sui generis regime has suffered; analyze the reasons leading to this setback; and finally, loot at the option of the future of China’s sui generis regime. Our suggestion is that the status quo of the sui generis regime needs changing. China should give clear preference to the sui generis regime, as opposed to the regime of collective and certification marks

Full textFrom the July monarchy to the turning point of the 20th century, the representations of China experience a radical change in the French literature. They oscillate between a decadent empire and a wonderful universe. On the one hand, the Middle Kingdom is suddenly closer to French opinion by the Warrior news. China has gradually lost his political power. On the other hand, in the cultural and artistic field, the representations are like a spiral wall: from the omnipresence of its precious and luxurious objects, to the notices of the well-known places of China, to the zest for classical Chinese literature both in literary writers and in academic Sinologists. What are the reasons for such contradiction in the representations of the same country? How has the French men of letters based their views?

Full textWhile the international development of certain French SMEs in the Chinese market has been the subject of numerous reports and has attracted more and more attention from the public in recent years, the overall situation of the presence of this group of small and medium enterprises in China remains unrecognized. The aim of this study is therefore to try to clarify the situation of their presence in China and to propose a global approach to understand the internationalization of French SMEs in the Chinese market. Particular attention is paid to theories in SMEs, through reflections during this research, this study tries to propose a new approach to the understanding of SME and its procedures of internationalization

Full textThe eighteenth century opens a new era in the history of Franco-Chinese cultural exchanges. China appears not only as a mysterious country, which inspired the authors of fiction, but also, in the eyes of the philosophers, as a nation deserves to be studied. This study focuses on a field so far little discovered in the works on cultural exchanges between France and China, namely the press. Our investigation intends to consider the representations of the Chinese art of governing in French-language periodicals in the second half of the 18th century and the role played by them in the dissemination of representations of China in French society

Full textKung Shang University of Tianjin, founded in 1923 and directed by the Jesuits, was meant for Chinese youth: provide them with a vocational training of high level like in the educational establishments in Europe and through them gain some favour for the Catholic Mission in China; French authorities, hoping an expansion of the French influence, support this enterprise from the beginning and support it again whenever needed. The Institute was officially recognized by the Chinese Government as “Gongshang College” in 1933, and “Jingu University” in 1948. It was later nationalized by the Communist Regime in 1951. This thesis questions the foundation of this school, its evolution and developments in the context of the socio-political changes of Modern China. It analyses its interactions between the Catholic world and the political authorities, Chinese and Foreign. Within a short period of existence, how did the school write its pages of history? Which pages did it write? Has it reached out the purpose of its foundation? Lastly, its closure. A Hero’s story?

Full textThe People’s Republic of China was established on 1 October 1949, which ended the regime of Chiang Kaï-shek in Chinese mainland. At that time, the French government began to negotiate officially la recoginization of the People's Republic of China. Living in two hostile camps, why France had the plan to recognize the regime of Mao Tse-tung in 1949? On January 27, 1964, People’s Republic of China and France simultaneously issued a diplomatic announcement in Beijing and Paris. France became the first major western country to establish diplomatic relations at ambassadorial level with the People’s Republic of China in 1964. Why France waited 15 years for recognizing PRC? What had happened during this 15 years? During this period, the United States played a very important role in the Indochina War, the Korean War, the Geneva Conference, the Taiwan question and the representation of China in the United Nations with launching the policy Marshall Plan. After the return of De Gaulle in 1958, he resolved to safeguard national sovereignty, national interests, and embarked on a road to decolonization. From 1962, French foreign policy became more active in China, and the two countries began to negotiate on the establishment of diplomatic relations after reaching a consensus on Taiwan, Algeria and the United States. The establishment of Sino-French diplomatic relations is not accidental, which responds to political and diplomatic needs, and to the inevitable trend of historical development in the Cold War

Full textOur research investigates the transfer of HRM practices from parent companies to their overseas subsidiaries. We seek to figure out how three levels of factors (country, organization and individual) from host country affect the international transfer process. We identify the effects of cultures, institutional interactions, entry modes and expatriates on this transfer. Based on detailed case studies of the eight French MNCs in China, we explain how transfer of HRM practices is realized. Our empirical findings indicate that French subsidiaries tend to adopt home-country HRM practices to a considerable extent. More than cultural differences, institutional interactions and entry modes are the main restraints for the transfer of HRM practices. Meanwhile, we identify the role of expatriates in the transfer process

Full textLiterary texts in teaching French as a foreign language show us the use of an authentic lexicon and morphosyntax, in a linguistic, socio-cultural and communicative context. In addition, they motivate students through « reading pleasure ». Illustrated texts or comics reinforce these objectives, and they facilitate further access of reading by combining text and image. Astérix will be the main corpus, as it combines text and image, language, culture and diverse knowledge. By comparing the various interpretations of Chinese and French readers of Astérix in Great Britain, we bring to the fore Franco-Chinese interculturality, which will facilitate understanding of French language and culture. Chinese students in the third year of university curriculum are our targeted public. We will thus take advantage of the educational value of Astérix, while contributing to research on the use of illustrated texts and comics in teaching French as a foreign language in China
Gomis, François. "Les nouveaux défis et enjeux de la politique étrangère de la France en Afrique francophone subsaharienne." Thesis, Paris 5, 2014. http://www.theses.fr/2014PA05D020.
Full textFrom 1960s to the end of the cold war, even beyond, the influence even the supremacy of France in the French-speaking territories in Sub-Saharan Africa is almost total. However, in this 21st century, the world competition in the research of new markets and the security of the energy supply leads inexorably the great powers to enter in “conflict of interests” by the mutual penetration of the “back-yards”. This is particularly true for France which has countries such as the United States, China, India, Brazil, Turkey, the Gulf Arab States, etc., to make a dramatic entrance in a geographical area where she judged it for a long time as her “exclusive domain” considering the historical, linguistic and political links. These new challenges and issues for the African policy of France are measured from now on, in the light of the transformations at work in the world with the globalization and the emergence of new powers of the South. The challenges and the issues are important for the external action of France and its place in the World, considering the fierce competition between new stakeholders and the ongoing African society changes. Nevertheless it still has economic, diplomatic and strategic assets which enable him to elaborate, thanks to the francophone cultural center, an original project, ambitious and promising. With this aim in mind, it will be necessary to answer to the two following questions: How to reform this traditional policy based on close and privileged relationships with African leaders without compromising, however, the comparative advantages of France on the spot? Which political strategy has to be implemented in order to identify the real common interests of the French and the French-speaking Africans, by taking into account the opportunities and threats, and to develop them in a mutually beneficial partnership?
Xu-Priour, Dong Ling. "Multichannel shopping behavior : a comparison between chinese and french consumers in the cosmetics market." Rennes 1, 2009. http://www.theses.fr/2009REN1G005.
Full textUnderstanding the cross-national differences in consumer multi-channel choice behavior is becoming increasingly important for international firms and marketers, especially for French companies and retailers in China. Unlike other studies that compare these differences in one or two dimensions and their links. The purpose of this study is therefore twofold. First, it aims to explore and compare the differences and similarities in four predictors and attitude towards and the use of channels between the French and Chinese cosmetic markets. Second, based on these differences, it shows furthermore the different effects of cultural factors on the determinants of attitudes toward multichannel to better understand these differences. The findings showed that there are remarkable differences and similarities in the above research concepts and their links across both cultures: the predictors of attitude towards in-store shopping channels (i. E. Enjoyment, trust in the store, less acceptance of new things, attitudes towards in-store channels) are more important to the Chinese than to the French. By contrast, the predictors of attitude towards in-home shopping channels (i. E. Convenience, time pressure, risk perception, and attitudes towards in-home channels) are more important to the French than to the Chinese. The different effects of cultural factors on predictors were also found differ with cultures: In general, past time orientation has a higher effect on enjoyment than future time orientation, individualists also have a stronger effect on convenience and risk perception than collectivists, and “monochron” is related more to time pressure than “polychrons”. As the first study of such a comparative research term across two dissimilar cultures-Western France and Eastern China, this study provide both theoretical and managerial evidences for the managers of Western and Eastern retailers and firms. In particular, for those managers of French and Chinese: for their marketing long-term decisions about market entry or exit one part, and for their marking short-term decisions about marketing effort on competition advantages on the other part. Finally, the research limitations and suggestions for future researches are also provided
Hou, Qibin. "Quarante ans de dialogue : évolution des relations politico-diplomatiques entre la France et la Chine (1964-2007)." Thesis, Montpellier 3, 2014. http://www.theses.fr/2014MON30009/document.
Full textThe purpose of this thesis is to investigate which factors, internal and external, influence the evolution of Sino-French relations since 1964. France being the first occidental country that recognized the new China in 1964, the Sino-French relationship is considered a priority of French government’s Asian policies. And it’s the same situation for the Chinese government. As the international situation is always changing, this relationship is not the same as forty odd years ago. The main purpose of this research is to understand such questions as: How did these two governments decide to establish this relationship in 1964? What are the changes of this bilateral relationship during the last four decades? Which factors are the reasons of those changes? How the international society influences this relationship, and in contrast? Etc.The data used for this study have been collected through published official documents, interviews, and academic works. I chose the period from 1964 to 2007 in order to limit the field of my work. And I divide the thesis into five parts in chronological sequence. The conclusion will be drawn that the development of the relationship between China and France depends not only on the national interests of the two countries but also on the historical context of the international society. Internal factors like government alternation, political reform, external factors like the cold war, the regional interests of the United-States and the European integration, all of them influence the Sino-French relations, both positively and negatively

Full textThis study is about a comparison of vicarious liability in French juridical system and in Chinese juridical system. In first part of this article, a more micro-vision, it is analyzed case by case of specific vicarious liability in two judicial systems. It is precisely about the acts of minors (the liability of parents in French law and liability of guardians in Chinese law, also the liability of teachers in French law and liability of school in Chinese law), the liability of employers and masters in two juridical systems and the general vicarious liability that is accepted particularly in French law, while the latter is different in Chinese law.The second part of this article concerns a whole vision and proposes a study of internal relations of two systems between different hypotheses of vicarious liability, and also an investigation of external relations of this system with the personal responsibility of “common law” and the mechanisms of collective compensation. However, of this mechanism applied at two systems, analysis reveals a common disadvantage: a lack of harmonization. In this aspect, considering the precondition of avoiding doing harm to particularity of each case of figure, the study tries to restore coherence both “internal” relations in systems of vicarious liability and “external” relations with other systems

Full textThis book focuses on the silk trade between China and France in the 19th century, with the aim of clarifying certain specific Euro-Asian trade in the course of globalization in the 19th century. We chose the Franco-Chinese silk trade as the objective of research, because, first, the use of historical records and documents, we find that the Franco-Chinese trade in the 19th century and grew up mainly from the augmentation of the import of Chinese silk in France. The exchange of the silk is one of the most important and the most typical trade between the two countries in the 19th century. Secondly, the exchange of the Franco-Chinese silk plays a very important role in the trade in raw materials of the world in the 19th century. Precisely, this book is intended to address the issues and further discuss on the Franco-Chinese silk trade itself and the Eurasian business long distance, specifically on their evolutions, their impulses, their commercial intermediation and their industrial impacts. In the first step, we will show the development of Franco-Chinese silk trade of the 19th century, and analyze the causes of its prosperity, at the level of supply and demand. On the demand side, we will examine the impacts of changes in the French industry on imports from china. In particular, it relate to the decrease and the limited increase of the French silk production. On the supply side, the question is to understand what makes it possible for the growth of the production of raw silk in china, but also the reasons for the limited development of domestic demand. In a second step, we discuss the roles of the various silk trade corporations connecting two side of the Eurasian continent. First, the Great Britain is the most important country of distribution of raw materials and semi-finished products of the world during the period of the industrial revolution. We will observe the roles of the London market and English merchants in the indirect silk trade between France and china. Then, we show the roles of the French companies and foreign firms in the direct trade of silk between France and china, the prosperous of which starts from the 1850s and 1860s. In this part, we will discuss the influence of the growth of the direct import of Chinese silk in France to the installation and the development of French companies in china, and the relationship of these French companies with other intermediaries, especially the silks firms of England, Germany and Switzerland. Finally, we analyze the roles of different groups of Chinese merchants in the foreign trade of silk of china, the relationship between these groups and the relations between the Chinese traders and foreign firms. In the end, as the raw silk is a raw material for the production of silk, this book will also discuss the impact of the silk trade to the silk industry in the two countries. In this part, we will select a new angle – interaction of the industrializations in the two countries -- to analyze the relationship between foreign trade and industrialization in the 19th century. Firstly, there will be the discussions about the influence of the industrialization of western countries in the industrialization of the Asian countries. Secondly, we will also search for the effects of the dynamics of the silk trade between the two countries to their reactions of industrializations. In all these issues, we will try to link the eastern and western industrial revolutions to international trade together
Chen, Tianhao. "Le droit des marchés publics en France et en Chine dans le contexte de la globalisation : entre libéralisation et utilisation stratégique des marchés publics." Thesis, Bordeaux, 2017. http://www.theses.fr/2017BORD0698/document.
Full textIn the contemporary era, whether in China or in France, government procurement isincreasingly employed in strategic use in order to pursue numerous policy-based objectives. However, this mode of policy-based utilization would be inevitably in conflict with the liberal logic inherent tothe system of government procurement which is not only present in the financial logic of traditionalliberal systems but also used to establish a government procurement system open to globalcompetition. Thus, how to balance the conflict between liberalization and policy orientation in thefield of government procurement is a crucial problem which should be solved in global governmentprocurement norms. However, on the one hand, with the process of legal globalization, Chinese andFrench government procurement systems are largely homogeneous in terms of liberalization andpolicy orientation. On the other hand, the methods they use to balance the conflict betweenliberalization and policy orientation remain different. At the same time, because of the specificity ofthe Chinese judicial system, the Chinese equilibrium methods have their own legitimacy. In the currentcircumstance, it is impossible for the Chinese public authorities to abandon their own equilibriummethods to seek convergence with the French equilibrium methods

Full textThis thesis aims at investigating the strategies of literary translation applied to the style of Proust's work, as well as at analyzing the potential reasons for the translation choices and their respective consequences. Through reviewing the translation and reception of Proust's literature in China, we are able to uncover the reciprocal interactions between the translation of Proust's work and the dynamic and multidimensional Chinese environment. It further reveals the interactive impact among the translation of Proust's literature, the studies of Proust’s literary concept and the Chinese literary creations. Systematically comparing the French original text of “In Search of Lost Time” with two Chinese translations, this thesis highlights the distinctive translation choices for the literary style and offers an original methodology to investigate the notion of style in translation. Taking advantage of multiple recently developed statistical methods and corpus-based translation approaches, we are capable to qualitatively and quantitatively investigate the structure of the vocabulary and the syntax in the two Chinese versions. In terms of cross-cultural studies in sociology and linguistics, we are able to detect various attitudes achieved through different translation styles, especially as regards Proust’s so-called “untranslatable” work. The cultural and linguistic values described here can probably enrich the studies and methodologies used to translate literary style

Full textIn practice several obstacles may prevent the natural progress of the contract. When those obstacles are not permanent in nature, modern law offers the contracting party a temporary solution : suspension of the contract. However, up until now, that legal solution has not been subject to a unitary legal system. Suspension is concealed by a range of traditional and modern legal techniques. Sino-French comparative law in relation to suspension makes it possible to clearly identify all these techniques, to envisage a new understanding and to offer a systematization of the complex phenomenon of suspension. Our study has revealed several important findings. For a contracting party, suspension is not merely a way to enable the sanctioning of temporary breach by the other contracting party; it can also be used to prove his legitimate breach. In addition, suspension can be used, not only in the event of breach of contract, but also in the event of the risk of breach. Lastly, the object affected by the suspension may not only be the contractual arrangement, but also the work leading up to it

Full textContemporary Chinese theater has a close connection with Western theater. For one century, Chinese theater, and especially spoken theater, has analyzed and appropriated Western cultures by filtering and summing up characteristics according to its own interests and presuppositions. This appropriation is accompanied by a series of theatrical operations. In this perspective, we have presented in detail, analyzing specific and varied cases, the reception of French theater in China of the last forty years in two stages: from 1978 to 1992 and from 1993 to 2014. We have emphasized the historical characteristics of each period, which clearly influence the general environment of Chinese theater and its relation to Western theater, by highlighting the influence and the major role played by French theater in the landscape of modern Chinese culture and especially his theatrical creations. The rich exchanges with Frenchtheater allow the Chinese theater to dialogue, to question, to evolve and to rebuild its ownidentity

Full textThis thesis reports on research conducted between 2015 and 2019 at the Southwest Jiaotong University in China and in the Group of French Central Schools, on the preparation of Chinese engineering students for academic mobility in France. Based on empirically identified needs, the decision was made to focus on work meetings, which play a major role in engineeringschools but are still absent from the educational materials published in FOU.Within the framework of French for University Objectives (FUO), this research is comprised of two inseparable stages. The first is fieldwork conducted during one year, which allowed us to analyze the issues, communicative situations, and discourses within the curriculum of a Central School in Lyon, and to collect large amounts of video data related to work meetings. The data analysis was held up to the theoretical framework of FUO, which was partly put into question regarding the possibility of using existing data collected in the field as training materials for FUO.The second stage is the elaboration of a FUO program aimed at meeting the linguistic training needs of Chinese engineering students in relation to group work and work meetings in the Central School. This program was created from the data collected during the first stage. This thesis includes a reflection on a key aspect of French for Specific Objectives (FSO) and FUO, namely the feasibility and the study of the institutional roadblocks to the effective implementation of innovative programs aimed at improving the mobility of certain students

Full textThe objective of this intercultural communication research is to know how stereotypes evolve among Chinese students towards the French before and during their stay in France. What processes of intercultural communication contribute to the evolution of the content of Chinese students' stereotypes about the French and what effects do intercultural communication have on Chinese students ? To answer these questions, the research relies on an intercultural and systemic approach under constructivist epistemology. After a quantitative and qualitative analysis, the evolution of stereotypes towards the French people on behalf of Chinese students are discussed under three aspects and factors: spatial, temporal and communicational. The communication factor is considered as the most determinant factor in the evolution of stereotypes. Thus, the intercultural communication of Chinese students with French is analyzed with the aim of knowing what are the elements that influence the quality of the communication and how to apprehend the dynamic of the process of the intercultural communication. According to this research, the evolution of stereotypes can lead among the Chinese students to an evolution of their own representations (to Chinese students' evolution of their own representations) in a general way. This evolution of representations is also the consequence of the change in the socio-cultural context and the communication system. The intercultural communication between Chinese students and the French can favor a construction of the consciousness of otherness and a reconstruction of identity based on an open and critical spirit. But on the other hand, this communication with the absence of the consciousness of otherness can also damage the reconstruction of oneself and, at the same time, strengthen the stereotypes towards the Others and towards him-self

Full textSince relations between China and France are forever growing, the issue of intercultural communication between the two countries is becoming an increasingly important art. In this context, the objective of this thesis is to put in place an intercultural approach of teaching French in Chinese Universities, to sensitize students to cultural diversity and prepare them for intercultural contacts. With a methodological reference framework developed essentially under the pragmatic and ethnographic aspects, we have tried to identify the origins of communication and relational difficulties between Chinese and French people by identifying the main cultural variables expressed by allusions in language, in sociolinguistic and sociocultural uses that govern verbal interactions and behaviour inherent to non-verbal language, etc. The Sino-French cultural differences revealed by our comparative and descriptive analysis helps on one hand to explain eventual problems/obstacles to understanding linked to implicit cultural meanings of two communities, and on the other hand, they can be used as an important mark to propose pedagogic clues aiming to the better teaching of culture and training of an intercultural communication competence

Full textThis doctoral thesis focuses on a question that has been little studied by the historiography of modern China but that is nevertheless fundamental to the understanding of imperialism in the modern history of this nation. By positioning itself at the intersection of three historiographical camps that are connected and yet distinct—urban history, the history of empires, and the history of the forces of law and order—this thesis will seek to emphasise the idea that the circulation of the skills and knowledge-base of a modern state were an example of “statecraft” within the city of Shanghai, which occupied an intermediary position between the European empires and the Chinese state. The primary focus of the thesis is the issue of defence and the maintenance of public order in the French Concession of Shanghai as being indicative of the relations that existed between the French and local authorities, the possible tensions between the empires, the administrative hierarchy of the French Empire on the ground, and the distribution of the power of military command between the civil and military authorities. The objective is to shed light on the shaping of the municipal administration of Shanghai before the establishment of the Kuomintang municipal authority in 1927 on three levels: what form did relations between the three municipalities within the city take? How did the French authorities build a security administration on the ground? Lastly, how did this security administration respond to the challenges of war and military conflict?

Full textThis dissertation is devoted to reconstructing the dynamics of foreign language teachers’ thinking by a multimodal and longitudinal approach. Focused on the field of Applied Linguistics and teacher cognition in particular, the present work is part of a multidisciplinary theoretical framework co-constructed of Social constructivism and Emergentism. This study involved six teachers of French as a foreign language (FFL) and Chinese as a foreign language (CFL) working in China and in France, each being followed up for one semester, through classroom observation and different kinds of interviews (semi-directive interviews and stimulated recall). Their verbalization was then analyzed by a mixed approach combining content analysis and discourse analysis. Besides an instable self-image characterized by multi-identity, emerge from each teacher’s discourse a knowledge and belief system and its historicity, subjectivity, contextuality and contradiction. The validity of Activity Theory is confirmed by a division of labour based on learners’ profiles that the teacher typifies. The importance of embodied action is dependent on the expected outcome. Teachers wish to not only complete their teaching activity but also reach an effect which is an integrated part of their thinking patterns. The non-linearity of context changing explains the updating of teacher’s thinking and practice. Teacher cognition’s complexity is structured around a dynamic between intentionality, embodied action and situational constraints. The break of reflexivity during action, discovered in neurosciences and validated here in a human and social sciences’ methodology, constitutes the key contribution of this work

Full textWhen determining the law applicable to international contracts in the French, American and Chinese legal systems, legal practitioners undeniably encounter legal uncertainty at several stages. With regards to conflict-of-law rules, the determination of legal certainty is primarily undermined by the considerations of : - legal predictability and - the protection of weaker contracting parties. Legal predictability is particularly considered when dealing with contracts underpinned by relationships of relatively equal bargaining power whereas the protection of weaker contracting parties is considered exclusively when dealing with unfair contracts. Nevertheless, despite considerable efforts made by these three countries, legal uncertainty still persists, especially in three separate areas. First, conflict-of-law rules are scattered across several legal instruments in the French and Chinese jurisdictions. In the United States, the subject matter being largely uncodified judges apply their own rules when deciding on conflict-of-law. Second, the substance of conflict-of-law rules in these three countries is incomplete, obsolete and complex. American judges who have been applying the same conflict rules for over 50 years are now faced with rules which, in addition to their complexity, no longer meet the needs of the current international market. Notwithstanding new reforms in Chinese private international law, attention to the contractual matters is albeit brief, with only a few articles devoted to that particular topic. In contrast, French private international law is currently seen as one of the most complete and modern existing laws on the subject matter. However, some rules are very complex, if not unnecessary. And third, the implementation of these same rules can also result in enigmatic conundrums. The enforcement of a rule can point to different laws. Besides, the discretion conferred to some judges bestows upon the latter a significant degree of freedom. Consequently, these judges have the power to dismiss the law of autonomy in several cases. Furthermore, in the absence of choice, the scope of interpretation is much greater to enable them to designate a law of their choice to reach a judicial decision. This element of legal uncertainty can be removed, if not reduced, in two ways, namely: - by providing for an electio juris clause as well as an electio fori clause in the international contract or - by the adoption of an international convention unifying the conflict-of-laws rules of these three countries, in the hope that the same convention could eventually be extended to all other countries
