Abstract:
This chapter forwards a theory of the strength of legal reasons under which how much say a person has over the law matters to how strong his legal reasons are. Three measures of strength are discussed: (1) a statutory measure, set by the severity of a statutorily specified penalty, (2) an institutional measure, set by the amount of force employed by legal institutions, and (3) an expressive measure, set by the amount of disapproval expressed by the law. The strength of a legal reason provided by a fact for a particular person, in any of these three senses, is a function of the person’s complic

Abstract:
A legal system is understood to be a social artifact in the sense that it is constituted by certain social facts. As such, a legal system has a characteristic use (or purpose) that determines what in this chapter is called its conceptual function. The chapter goes on to argue that the conceptual function of a legal system is to keep the peace by regulating behavior through legal norms. Further, insofar as a legal system is an institution that is created to solve problems of beings like us in a world like ours, the chapter posits that the manner in which legal systems, as a conceptual matter, a

Abstract:
Due diligence is a prominent concept in international law. Still, for long, its role seemed to be that of a familiar stranger. Frequent referrals to the concept in arbitral awards, court decisions, and in scholarly discussions mostly on state responsibility hide the fact that the specific normative content and systemic relation of due diligence to rules and principles of international law has largely remained unexplored. The present book provides the first comprehensive analysis of the content, scope, and function of due diligence across various areas of international law, including internatio

Abstract:
This Chapter provides a comprehensive critique of Regulation 55 at the ICC which regulates the legal characterization of facts in the ICC context. Regulation 55 has been applied in multiple cases at the ICC, including pre-trial and trial (e.g. Katanga and Ngudjolo Chui). This contribution argues that the adoption of Regulation 55 was ultra vires, because the Regulation does not involve a ‘routine function’ of the Court and is inconsistent with the Rome Statute’s procedures for amending charges. It explains why, contrary to the practice of the Pre-Trial Chamber and Trial Chamber, Regulation 55

Abstract:
This chapter examines the European Union (EU) from the perspective of public international law. Financial crime, this chapter argues, is an international phenomenon that requires international solutions. This recognition has resulted in states cooperating on a number of different levels in order to streamline their responses to international financial crime. This chapter deals with the EU in two guises: as an independent source of international obligation for its member states, imposing discreet international obligations on them, which may even function so as to turn non-binding recommendation
