Abstract:
The paper assesses the widespread use of the test of proportionality in fundamental rights adjudication. While constitutional and human rights courts all over the world appear to be consistently engaged in deploying the test of proportionality in order to assess the permissibility of a given rights limitation, this approach is under severe criticism insofar as it is considered an attack to the very idea of fundamental rights. The paper will discuss this criticism of the use of proportionality, and will provide a defense of its use by courts in light of some basic features of the contemporary discourse of fundamental rights.<br>El artículo evalúa el uso generalizado de la prueba de proporcionalidad en la adjudicación de derechos fundamentales. Mientras que los tribunales constitucionales y de derechos humanos de todo el mundo parecen estar constantemente involucrados en el despliegue de la prueba de proporcionalidad para evaluar la permisibilidad de una determinada limitación de derechos, este enfoque está sometido a severas críticas en tanto que se considera un ataque a la idea misma de Derechos fundamentales. El artículo discutirá esta crítica al uso del principio de proporcionalidad y ofrecerá una defensa de su uso por los tribunales a la luz de algunas características básicas del discurso contemporáneo de los derechos fundamentales.

El A. examina la lectura heideggeriana de Husserl y el rol atribuido a las Investigaciones 5gicas en El ser y el tiempo y en algunas de las lecciones de la época de Marburgo, a la luz de la lectura derridiana, en La voix et le hénomine de la teoría husserliana del signo del significado en la primera de las investgiaciones Lógicas. Según Derrida, ésta resultaría portadora de ciertos ejes claves de la metafísica como la doctrina de la idealidad la que, en tanto repetibilidad indefinida, privilegia el instante indivisible (Augenblick, ·guiño de ojo), el que a su vez se halla sostenido por la forma última de la vida trascendental: la presencia a sí del Presente Viviente. Siendo las referencias de SZ al texto de Husserl no sólo escasas sino discretas, el A., para aclararlas, se apoya en ciertas lecciones claves de Heidegger de Marburgo (GA 20, 24 y 26). esto le permite sostener que Heidegger, aún cuando las desplaza y metamorfosea, aprueba y suscribe tanto la teoría del significado y del signo, como ciertas doctrinas fundamentales de la fenomenología de Husserl encadenándolas según un motivo intuicionista. El A. argumentará no solamente que el privilegio de la voz que da a ver y a escuchar se hallará en el corazón de la Bedeutung heideggeriana cuya forma suprema es el Ser, sino que el privilegio del instante prevalecerá sobre el movimiento diferenciado de la temporalización extática constituyendo así no sólo el suelo de la ontología fundamental sino la llave de toda la historia de-construida de la metafísica

Abstract:
This study analyzes the guardianship role on entrepreneurial freedom fundamental rights, non- discrimination in economic and property aspects exerted by the Elimination of Bureaucratic Barriers Commission from the National Institute for the Defense of Competition and IntellectualProperty (Indecopi) developed throughout resolutions and administrative cases set up by the Defense of Competition Chamber #1. This role is particularly relevant in our legal system, due to their special functions the Elimination of Bureaucratic Barriers Commission is entitled by legal mandate to establish the non- application of rules in specific cases exercising legal control. This administrative function- initially misunderstood-has proved to be an efficient tool for the guardianship of economic rights due to our judicial system ineffectiveness in contentious administrative matters. The author considers the possibility of making a constitutional reform in order to provide specialized administrative bodies, such as INDECOPI, with the quality of “primary administrative jurisdiction” whose resolutions will only be reviewed by the State Council jurisdiction.<br>En el presente estudio se analiza el rol de tutela de los derechos fundamentales de libertad de empresa, no discriminación económica y de propiedad ejercido por la Comisión de Eliminación de Barreras Burocráticas del Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual —Indecopi—, que se ha desarrollado a través de sus resoluciones y de los precedentes administrativos establecidos por la Sala de Defensa de la Competencia 1. Este rol de tutela es muy relevante en nuestro sistema jurídico, en el cual,por su especialidad funcional, la Comisión de Eliminación de Barreras Burocráticas está habilitada por mandato legal para la inaplicación de normas en casos concretos en ejercicio del control de legalidad. Esta función administrativa —que en sus inicios fue incomprendida— ha resultado una herramienta eficaz para la tutela de los derechos económicos del administrado en razón de la inoperancia del sistema judicialista en locontencioso administrativo en el Perú. El autor considera que debe estudiarse la posibilidad de reformar la Constitución para atribuir a ciertos órganos administrativos especializados, como los del Indecopi, la calidad de jurisdicción administrativa primaria, cuyas resoluciones solo serán revisables por la jurisdicción de un Consejo deEstado.

Abstract:
This article focuses on the analysis of the literature produced by Robert Alexy, a renowned German jurist, focusing on the concept of fundamental rights, which are, in a constitutional state of law, the ultimate goal of the legal system. Thus, for Alexy the rights of people are not moral, but rather legal. It is in this sense and taking as a starting point the conception of fundamental rights that the author proposes a tentative reading from a moderate realistic perspective of some aspects of the theoretical position of Alexy.<br>El presente artículo se centra en el análisis de la literatura producida por Robert Alexy, reconocido jurista alemán, centrada en el concepto de los derechos fundamentales los cuales son, en un estado constitucional de derecho, el fin último del ordenamiento jurídico. Así, para Alexy los derechos de las personas no son de tipo moral, sino más bien, jurídico. Es en ese sentido y tomando como premisa de partida la concepción de los derechos fundamentales que la autora propone una lectura tentativa desde una perspectiva realista moderada de algunos aspectos de la posición teórica de Alexy.

The paper deals with stock market indices. It reveals the flaws inherent in traditional market capitalization weighted indices, that causes a return drag. At the same time it shows how you can get rid of these flaws by using fundamental indices, and gives proofs about their superiority. The practical part focuses on building fundamental indices of czech stocks traded on the Prague Stock Exchange, dealing with historical data. It empirically demonstrates their outperformance of a benchmark market capitalization weighted index.

Abstract:
The thesis investigates the impact of the fundamental news announcements on the movements of the VIX volatility index and the VIX Futures prices. The theoretical part of the thesis explains the construction of the VIX Index and the VIX Futures, describes the most important fundamental news for the US economy and presents a methodology for the modelling of the relationship between the news announcements and the VIX index movements with a simple linear regression model. In the empirical part of the thesis, we analyze the impact of 105 US fundamental news, from the Reuters Eikon database, on the VIX Index movements on theday of the news announcements as well as on the subsequent day. We find a strong relationship between the surprise component of the news and the VIX Index movements on the day of the news announcement, with the statistically significant news explaining 5-10% of the total return variance (for news with small number of observations up to 30-50%) on the announcement day. In the second part of the empirical study, simple trading system is proposed in order to utilize the possible impact of the economic news on the next-day (after announcement) returns of VIX futures in order to achieve speculative profits. Although the models seem to possess some limited out-sample profitability for some of the news, the results are for most of the cases statistically insignificant and the potential profits from the news trading seem to be relatively low.

Abstract:
This study is a thesis ending a 120 credit masters program in Mathematics with specialization Financial Mathematics and Mathematical Statistics at the Royal Institute of Technology (KTH). The subject of Smart beta is defined and studied in an index fund context. The portfolio weighting schemes tested are: equally weighting, maximum Sharpe ratio, maximum diversification, and fundamental weighting using P/E-ratios. The outcome of the strategies is measured in performance (accumulated return), risk, and cost of trading, along with measures of the proportions of different assets in the portfolio. The thesis goes through the steps of collecting, ordering, and ”cleaning” the data used in the process. A brief explanation of historical simulation used in estimation of stochastic variables such as expected return and covariance matrices is included, as well as analysis on the data’s distribution. The process of optimization and how rules for being UCITS compliant forms optimization programs with constraints is described. The results indicate that all, but the most diversified, portfolios tested outperform the market cap weighted portfolio. In all cases, the trading volumes and the market impact is increased, in comparison with the cap weighted portfolio. The Sharpe ratio maximizer yields a high level of return, while keeping the risk low. The fundamentally weighted portfolio performs best, but with higher risk. A combination of the two finds the portfolio with highest return and lowest risk.<br>Denna studie är ett examensarbete som avslutar ett 120 poängs mastersprogram i Matematik med inriktning mot Finansiell Matematik och Matematisk Statistik på Kungliga Tekniska Högskolan (KTH). Ämnet Smart beta studeras i kontexten av en indexfond, där de olika testade principerna för viktning i portföljerna är: likaviktad, maximerad Sharpe-kvot, maximerad diversifiering, och fundamental viktning användandes av P/E-tal. Utfallet i testerna utvärderas i ackumulerad avkastning, portföljrisk, kostnad att handla i portföljen, och ett antal mått på fördelningen av tillgångarna. Studien går stegvis igenom processen för att samla in, ordna, och ”tvätta” data. En kort förklaring av historisk simulering, metoden för att estimera stokastiska variabler såsom kovariansmatriser, är inkluderad, såväl som en analys av distributionen av data. Processen för att optimera portföljerna och hur regler för att vara en UCITS-fond kan omformas till optimeringsvillkor beskrivs. Resultaten indikerar att alla utom den mest diversifierade portföljen har högre ackumulerad avkastning än den marknadsviktade portföljen under testperioden. I alla testade fall ökar handelsvolymen liksom marknadspåverkan när en annan strategi än marknadsviktad används. Portföljen med maximerad Sharpe-kvot ger en hög avkastning med bibehållen låg risk. Den fundamentalt viktade portföljen ger bäst avkastning, men med en litet förhöjd risk. Kombinationen av de båda metoderna ger den portföljen med högst ackumulerad avkastning och samtidigt lägst risk under testperioden.

This article point out the progressive enrichment by which fundamental rights concept have gone through, providing to holders—government and individuals— not only rights, liberties, powers and immunity but also the obligation to respect, defend, guarantee and promote all them regardless the conduct displayed by the holder in this field. With this in mind, the author examines arbitration definition and main characteristics, highlighting its constitutional dimension proposing a systematic reading in accordance with fundamental rights.<br>El artículo toma como punto de partida el enriquecimiento progresivo por el que ha transitado la concepción de derechos fundamentales, que actualmente no solo implican el otorgamiento a sus titulares derechos, libertades, competencias e inmunidades sino que todos —Estado y particulares— estamos obligados a respetarlos, defenderlos, garantizarlos y promoverlos, independientemente de que su titular haya desplegado o no una conducta con ese propósito. A partir de ello, el autor analiza la definición y principales características del arbitraje, destacando su dimensión constitucional y proponiendo una lectura sistemática y en armonía con los derechos fundamentales.

The mean scores of vocal disadvantage in the group of teachers with indications of mental disorder would be significantly higher than the mean scores of vocal disadvantage in the group of teachers with no indicative of mental disorder, either in the total score as in emotional, functional and organic subscales. Design: An observational cross-sectional analytical, quantitative, study, conducted in the public schools of urban and rural areas of the city of Pelotas. Method: A total of 633 teachers of 31 schools were invited, 575 participated and 58 were considered lost. Vocal disadvantage was measured by the Protocol of the Voice Disadvantage Index (VHI), producing four scores, a total and three subscales - emotional, functional and organic. As for the symptoms of mental disorders, it was evaluated by the SRQ-20 scale (Self-Reporting Questionnaire 20 items). Mann- Whitney and Wilcoxon tests were used to compare the medians of vocal disadvantage with the variables of interest. To approach the normal distribution, a log transformation was used. After that, a linear regression was performed to evaluate the relationship of independent variables and the outcomes.Results: Teachers with an indication of common mental disorders , and who also reported having taken license due to problems with the voice, had a worse overall vocal disadvantage (p <0,050). Emotional, functional and organic vocal disadvantage were significantly highest in teachers with indications of common mental disorder (p < 0,001). The emotional subscale was also associated with the number of students in the classroom and license taken due to problems with the voice. Functional subscale showed significance with presence of self-reported disease, not taking vocal rest, have taken leave due to problems with the voice and high workload. Finally, organic 41 subscale showed significant association with the age of 41 years or more, in addition to having an indication of common mental disorder. Conclusions: There is a close relation of vocal problems and mental disorders, showing significant numbers of association between high levels of vocal disadvantage and mental dysfunction<br>Objetivo / Hipótese: Verificar a relação dos transtornos mentais comuns com a desvantagem vocal dos professores do ensino fundamental de escolas municipais. As médias dos escores de desvantagem vocal do grupo de professores com indicativo de transtorno mental seriam significativamente maiores do que as médias dos escores de desvantagem vocal do grupo de professores sem indicativo de transtorno mental seja no escore total como nas subescalas, emocional, funcional e orgânica. Delineamento: Estudo observacional transversal analítico, quantitativo, realizado nas escolas municipais da zona urbana e rural da cidade de Pelotas. Método: No total, 633 professores de 31 escolas foram convidados, 575 participaram e 58 foram considerados perda ou recusa. A desvantagem vocal foi mensurada pelo Protocolo do Índice de Desvantagem Vocal (IDV) produzindo quatro escores, um total e três subescalas-emocional, funcional e orgânica. Já a sintomatologia de transtornos mentais foi avaliada pela escala SRQ-20 (Self- Reporting Questionnarie 20 itens). Mann-Whitney e Wilcoxon foram utilizados na comparação das medianas de desvantagem vocal com as variáveis de interesse. Para aproximação da distribuição normal a log transformação foi utilizada. Após, a regressão linear foi realizada para avaliar a relação das variáveis independentes com os desfechos. Resultados: Os professores com indicativo de transtorno mental comum e que relataram ter tirado licença em virtude de problemas com a voz apresentaram pior desvantagem vocal total (p < 0,050). A desvantagem vocal emocional, funcional e orgânica estava significativamente mais alta nos professores com indicativo de transtorno mental comum (p<0,001). A subescala emocional também esteve associada positivamente a quantidade de alunos em sala de aula e a licença tirada em função da voz. Já a subescala funcional mostrou significância com presença de doença auto referida, não fazer repouso vocal, licença por causa da voz e carga 40 horária elevada. Por fim, a subescala orgânica mostrou associação significativa com a idade de 41 anos ou mais, além de ter indicativo de transtorno mental comum. Conclusões: Existe uma estreita relação dos problemas vocais e os transtornos mentais, indicando números bastante expressivos de associação entre alto índice de desvantagem vocal e disfuncionalidade mental

Experiencia típica en el Perú es el problema de la denominada “Jurisdicción Especial Indígena” o simplemente “Justicia Comunal”, en este sentido, desarrollaremos esta Justica Comunal a la luz de la experiencia de los Aymaras de Huancané en Puno.

In many countries, citizens have the power to propose new laws oramendments to their constitutions by popular initiatives. Provided that they have a special legitimacy, they are often regulated by different procedures to the legislation enacted by the legislature and may be used by their proponents to avoid the restrictions that the “ordinary” legislation is subject to. Recently, this has led that several popular initiatives which have come into conflict with the rights of minorities, fundamental rights of other affected groups, and other constitutional guarantees have been submitted. From the perspective of a comparative analysis, this article explores whether the laws in Switzerland and California set the procedural and substantive restrictions to this mechanism of direct democracy and to what extent. In this context, the author questionswhether the scope and enjoyment of fundamental rights may be subject to popular initiatives. Finally, several recommendations are made to improve the legal limits of popular initiatives and their control mechanisms to ensure that the scope and enjoyment of fundamental rights are not subject to the contentof popular initiatives.<br>En muchos países, los ciudadanos tienen la facultad de proponer nuevas leyes o modificaciones a la Constitución mediante iniciativas populares. Dado que las mismas gozan de una legitimación especial muchas veces se regulan por procedimientos diferentes a la legislación promulgada por la legislatura y pueden ser usados por sus proponentes para esquivar las restricciones a las que la legislación «ordinaria» está sujeta. Eso ha llevado a que, recientemente, se han presentado varias iniciativas populares que han entrado en conflicto con los derechos de las minorías, derechos fundamentales de otros grupos afectados, y otras garantías constitucionales. Desde una perspectiva de análisis comparativo, este artículo explora si las legislaciones en Suiza y California establecen restricciones procedimentales y sustantivas a este mecanismo de democracia directa y en qué medida. En este contexto, cuestiona si el alcance y el disfrute de los derechos fundamentales pueden estar sujetos a iniciativas populares. Finalmente, este artículo hace ciertas recomendaciones destinadas a mejorar los límites legales de las iniciativas populares y de sus mecanismos de control para garantizar que el alcance y el disfrute de los derechos fundamentales no estén sujetos al contenido de iniciativas populares.

The culture of presenteeism is deeply rooted in our labor practice and looks bad (or very bad) that an employee cease its work on time, calling uncommitted or “bureaucrat”, which is paradoxical because there are thousands of public servers that do not have a maximum working time. What is not assimilated is that working time is the opposite of free time, which all the hours you’re at work are hours when you do not have freedom to do other things (studying, going to the movies, spending time with family, etc.). And that can cause illness or even kill the employee. This paper seeks to reflect on this important subject in the lives of individuals.<br>La cultura del presentismo se encuentra muy arraigada en nuestra práctica laboral y se ve mal (o muy mal) que un trabajador cese sus labores a su hora, calificándolo de poco comprometido o de “burócrata”, lo cual es paradójico porque son miles los servidores públicos que no cuentan con una jornada máxima de trabajo. Lo que no se asimila es que el tiempo de trabajo es lo contrario del tiempo libre, con lo cual todas las horas que uno está en el trabajo son horas en las que no cuenta con libertad para hacer otras cosas (estudiar, ir al cine, pasar tiempo con la familia, etc.). Y eso puede causar enfermedades o hasta la muerte al trabajador. El presente trabajo busca reflexionar sobre este tema tan importante en la vida de las personas.

I denna uppsats undersöks hur alternativa viktningsmetoder av OMXS30 har presterat mellan 2004-2010. Studien har sin utgångspunkt i teorierna kring Capital Asset Pricing Model och Effektiva Marknadshypotesen. Syftet med studien är att undersöka huruvida ett kapitalviktat index är effektivt i enlighet med dessa teorier. I studien konstrueras fem stycken index, ett kapitalviktat, två fundamentalviktade, ett riskviktat och ett kombinationsviktat index. För att avgöra indexens historiska prestation analyseras de utifrån utvärderingsmått som mäter riskjusterad avkastning. Vi finner att de fundamental- och kombinationsviktade indexen genererar en högre riskjusterad avkastning än det kapitalviktade jämförelseindexet. Studiens resultat visar på att det riksviktade indexet inte lyckas generera en högre riskjusterad avkastning än det kapitalviktade. Vidare finner vi att det kapitalviktade indexet inte är fullt effektiv under vår tidsperiod. Vi finner istället tendenser på att det kapitalviktade indexet är svagt effektivt i enlighet med EMH. Detta innebär att CAPM inte är optimal eftersom dess grundantagande om en fullt effektiv marknad inte uppfylls.

Neste universo da inclusão escolar, será necessário um novo olhar pedagógico de todos os envolvidos para o contexto escolar, não na busca de culpados pelas mazelas da educação mas na corresponsabilização pelo ensino e aprendizagem de todos. Assim, este estudo teve como principal objetivo analisar a concepção da equipe escolar, alunos e pais/responsáveis de uma escola de Ensino Fundamental sobre as práticas, políticas e culturas inclusivas, antes e depois de um programa de formação continuada, tendo como subsídio o "Index para inclusão". O estudo foi realizado em uma escola estadual de Ensino Fundamental-Ciclo I de uma cidade do interior do estado de São Paulo, tendo como participantes 16 professores e gestores da equipe escolar, 204 alunos divididos em 11 turmas e 179 pais. Tratou-se de um estudo quase-experimental, em que o procedimento de coleta de dados envolveu o desenvolvimento de um Programa de Formação Continuada, assim como a aplicação dos questionários do Index para todos os participantes envolvidos na pesquisa. Os dados quantitativos dos questionários foram tratados estatisticamente e demonstrados em tabelas, sendo que a análise das questões abertas dos questionários foi feita a partir da análise de conteúdo. Os resultados do estudo revelam significativas mudanças na forma de avaliar culturas, práticas e políticas inclusivas da primeira para a segunda aplicação do Index para Inclusão. Na análise da dimensão A – "Criando culturas inclusivas", a equipe escolar demonstra mudanças positivas em relação ao que estabelecem sobre valores inclusivos, ainda que não tenha apresentado diferenças estatisticamente significativas. Para a dimensão B – "Produzindo políticas inclusivas" que estabelece o desenvolvimento de uma escola para todos e o apoio à diversidade, os dados demonstram diferenças estatisticamente significativas de forma positiva da primeira para a segunda aplicação, do mesmo modo, a dimensão C – "Desenvolvendo praticas inclusivas" que estabelece os eixos construindo currículos para todos e orquestrando a aprendizagem, os resultados foram satisfatórios, demonstrando diferenças estatisticamente significativas. No tangente aos pais, os resultados apontaram um decréscimo nos valores da primeira para a segunda aplicação, demonstrando diferenças estatisticamente significativas. Acreditamos que tal decréscimo tenha ocorrido pelo fato de os pais não terem tempo hábil de perceber melhoras na escola e por responderam aos questionários baseados em concepções preestabelecidas anteriormente ao programa de formação com os professores. Quanto aos alunos, os resultados, em sua maioria, mostraram-se satisfatórios, com diferenças estatisticamente significativas; no entanto, a solicitação dos alunos em serem mais ouvidos apresentou-se como insatisfatória. Em relação à equipe escolar, os professores passaram a ter maior consciência da necessidade de mudanças na escola, olhando para todos os alunos com maior sensibilidade em uma reflexão de autoavaliação e de uma gestão democrática e participativa. Deste modo, este estudo apresentou limitações quanto ao desenvolvimento de um trabalho mais efetivo junto aos alunos e aos pais/responsáveis, assim como nos encontros com a equipe escolar. Assim, entendemos a necessidade de novos estudos e pesquisas voltados para o uso do documento Index para Inclusão como forma de apoiar o processo para a educação inclusiva.<br>Inclusive Education, as a new proposal of school culture that aims to develop a school "for all", is one of the greatest challenges in the educational setting. In everyday school life, the culture of homogenization requires that each school team places itself as a participant of the process by evaluating the school aiming to overcome the culture of exclusion. In this universe of school inclusion, a new pedagogical look at everyone involved in the school context, not in search of culprits for the ills of education but in co-responsibility for teaching and learning of all, will be needed. Thus, this study aimed to analyze the conception of school staff, students and parents/guardians on practices, policies and inclusive cultures at an elementary school, before and after a continuing education program, based on "Index for Inclusion" (“Index para inclusão”). The study was conducted in Cycle I of a public school in a city in the state of São Paulo and had 16 teachers and managers of the school staff, 204 students divided into 11 groups and 179 parents as participants. It was a quasi-experimental study in which the data collection procedure involved the development of a Continuing Education Program, as well as the application of the Index questionnaires to all participants involved in the research. Quantitative data from the questionnaires were statistically analyzed and presented in tables, and the analysis of the open questions of the questionnaire was carried out from the content analysis. The study results show significant changes in the way of evaluating cultures, inclusive practices and policies from the first to the second application of the “Index for Inclusion”. In the analysis of Dimension A – "Creating inclusive cultures", the school team demonstrates positive changes in relation to that set on inclusive values, although it has not shown statistically significant differences. For Dimension B – "Producing inclusive policies", that establishes the development of a school for all and support for diversity, the data show statistically significant differences in a positive way from the first to the second application. Similarly, Dimension C – "Developing inclusive practices", laying the axes for all building resumes and orchestrating learning, obtained satisfactory results, presenting statistically significant differences. In regard to parents, the results indicate a decrease in the values of the first to the second application with statistically significant differences. It is believed that this decrease has occurred because the parents had no time to realize improvements in school and answered the questionnaire based on pre-established concepts prior to the teachers training program. As for students, the results, in most cases, were satisfactory with statistically significant differences, however, the request of students in being more heard was still unsatisfactory. Regarding school staff, teachers have greater awareness of the need for changes in school now, looking at all students with greater sensitivity as a reflection of self-assessment and a democratic and participative management. Therefore, this study presents limitations on the development of a more effective work with students and parents / guardians, as well as in meetings with school staff. As a result, the need of further studies and research focused on the use of the “Index for Inclusion” document is understood as a way to support the process for inclusive education.

El presente texto busca desarrollar y explicitar el concepto de filosofía que Martin Heidegger tenía desde la segunda mitad de la década de 1920, es decir, en los años que giran en torno a Ser y tiempo. Se toman como ejes los cursos dictados en esos años en la Universidad de Marburgo. La distinción entre ciencias positivas y ciencia crítica, así como la distinción entre filosofía científica y filosofía como concepción del mundo, tendrán por objetivo precisar qué es lo propio del quehacer filosófico: la diferencia ontológica. Tematizar el ser es lo propio de la filosofía para Heidegger, lo cual implica considerar que la filosofía en sentido pleno y eminente es ontología. Su relación con el ente no es positiva, pues se da en función al problema del sentido del ser. Todo ello nos permitirá tener una mejor comprensión de lo que Heidegger entendía por quehacer filosófico (ontología fenomenológica) y poder, así, estar en una mejor posición para comprender aspectos fundamentales del proyecto de la ontología fundamental desarrollado por Heidegger en Ser y tiempo.

The article analyses the theoretical debates on equality and justice that represent the structural and institutional dimension of politics within the framework of a rigid constitutionality of fundamental rights as well as the changes in process to which law and politics are subject in Spain as a consequence of the globalization of economic production and of culture. The actions carried out by the Spanish government in recent years justify us in speaking about the return of the old socio-economic hierarchies and of the clear obstacles to the development of alternative legal-political thinking. For these reasons, the article defends the need to redefine the collective political subject (to construct a new us) and to develop a new model of the state which gives priority to solidarity against fear and security.<br>En el artículo se analizan los debates teóricos sobre la igualdad y la justicia que representa la dimensión estructural e institucional de la política en el marco de una constitucionalidad rígida de los derechos fundamentales, así como los cambios en proceso a los que están sometidos el derecho y la política en España como consecuencia de la globalización de la producción económica y de la cultura. Las actuaciones realizadas por el ejecutivo español en los últimos años permiten hablar del retorno de las viejas jerarquías socio-económicas y de claros obstáculos al desarrollo de un pensamiento jurídico-político alternativo. Por estas razones se defiende la necesidad de redefinir el sujeto político colectivo (construir un nuevo nosotros) y de desarrollar un nuevo modelo de Estado en el que prime la solidaridad frente al miedo y la seguridad.

In the last years, we are witnessing an increasingly intense process of creating instruments on labor management in the transnational scope by the multinational companies, aimed at confronting from its autonomy to the very diverse needs generated by its integrated functioning at the global scale. Currently, the physiognomy of these instruments is not yet sufficiently defined; there are notable differences between one another, depending on the company that promotes them and function that assigns them. The present paper carries out a systematization of the criteria that have been presiding its construction, as well as the lines of evolution that are drawn through them.<br>En los últimos años asistimos a un proceso cada vez más intenso de creación de instrumentos de gestión laboral de ámbito transnacional por parte de las empresas multinacionales, dirigido a hacer frente desde su autonomía a las muy diversas necesidades generadas por su funcionamiento integrado a escala global. El derecho al juez predeterminado por ley es uno de los principios básicos sobre el que debe edificarse el derecho fundamental al debido proceso y es parte esencial de su contenido. Por esta razón, el autor hace una exhaustiva evaluación de los fundamentos de este derecho; partiendo del análisis del derecho debido proceso, desde sus antecedentes históricos hasta sus ámbitos de aplicación.Una vez desarrollados los fundamentos del debido proceso, el autor entra al estudio del contenido del derecho al juez predeterminado por ley de manera específica, estableciendo las diferencias conceptuales entre el juez predeterminado por ley y el juez natural, conceptos vinculados, pero no iguales. Al mismo tiempo, examina la forma como este derecho es recogido por el ordenamiento internacional y la eficacia de los mecanismos de protección de este derecho a nivel internacional. El uso de jurisprudencia del Tribunal Constitucional Peruano y de jurisprudencia internacional es frecuente en este artículo, enfocándose en la interpretación que se le da a este derecho y los alcances en la aplicación del mismo.

A weighted view of labor law: commentaries on the MSE regime and the proposal «Law of New Enterprise»The present article evaluates constitutional character of the regime of Micro and Small Enterprises (MSE) and the legislative proposal of «Law of New Enterprise» from the jurisprudence of the Constitutional Court. With this purpose it starts with analyzing own characters of the right to equality as a classical liberal right that is based on social rights as the right to work. Finally, the article seeks to dispel doubt of whether those regimes, MSE and the Law of New Enterprise, they obey to a policy of promotion of employment or rather they introduce a differentiated treatment without objective basis and therefore unconstitutional.<br>El presente artículo evalúa el carácter constitucional del Régimen de la Micro y Pequeña Empresa (MYPE) y de la propuesta legislativa de la «Ley de la Nueva Empresa» a partir de la jurisprudencia del Tribunal Constitucional. Con dicho propósito parte de analizar los caracteres propios del derecho a la igualdad, que como derecho liberal clásico es base de derechos sociales como el derecho al trabajo. Finalmente, el artículo busca despejar la duda de si los referidos regímenes, MYPE y Ley de la Nueva Empresa, obedecen a una política de promoción del empleo o más bien introducen un trato diferenciadosin sustento objetivo y, en consecuencia, inconstitucional.

Health conscientious objection in Spain: nature and exerciseConscientious objection is conceived as the infringement of a legal duty, peacefully and morally motivated, which aims to safeguard the own moral integrity against a heteronomous imperative judged as unfair. Generally, there is social agreement concerning some justice principles that generate group-shared laws. However, there can be disagreement among some of the members of the group, which can lead them to decide to break the law. The aim of this paper is to reflect on the social and juridical legitimacy of an individual’s moral obligation to disobey a rule that is incompatible with his or her personal options, in order to assert that faculty and base it on the existence of a conscientious objection right. Also, it seeks to point out the existing difficulties in Spain to exercise the conscientious objection within the healthcare sector.<br>La objeción de conciencia se concibe como el incumplimiento de un deber jurídico, pacífica y moralmente motivado, que procura salvaguardar la propia integridad moral frente a un imperativo heterónomo que se juzga injusto. En general, existe acuerdo social en torno a unos principios de justicia que generan normas compartidas por el grupo. Sin embargo, pueden existir discrepancias entre algunos de los miembros del mismo, que los lleven a optar por la desobediencia a la norma. En este trabajo se pretende reflexionar acerca de la legitimidad social y jurídica de la obligación moral de un individuo de desobedecer o incumplir una norma jurídica incompatible con sus opciones personales, con el objetivo de afirmar dicha facultad y fundamentarla en la existencia de un derecho a la objeción de conciencia. También se quiere poner de manifiesto las dificultades que encuentra en España el ejercicio de la objeción de conciencia en el contexto sanitario.

No cotidiano escolar, a cultura da homogeneização requer que cada equipe escolar se coloque como partícipe do processo, avaliando a escola que se tem com vista à superação da cultura da exclusão. Neste universo da inclusão, será necessário um novo olhar pedagógico de todos os envolvidos para o contexto escolar, não na busca de culpados pelas mazelas da educação mas na corresponsabilização pelo ensino e aprendizagem de todos. Assim, este estudo teve como principal objetivo analisar a concepção da equipe escolar, alunos e pais/responsáveis de uma escola de Ensino Fundamental sobre as práticas, políticas e culturas inclusivas, antes e depois de um programa de formação continuada, tendo como subsídio o "Index para inclusão". O estudo foi realizado em uma escola de Ensino Fundamental-Ciclo I de uma cidade do interior do estado de São Paulo, tendo como participantes 16 professores e gestores da equipe escolar, 204 alunos divididos em 11 turmas e 179 pais. Tratou-se de um estudo quase-experimental, em que o procedimento de coleta de dados envolveu o desenvolvimento de um Programa de Formação Continuada, assim como a aplicação dos questionários do Index para todos os participantes envolvidos na pesquisa. Os dados quantitativos dos questionários foram tratados estatisticamente e demonstrados em tabelas, sendo que a análise das questões abertas dos questionários foi feita a partir da análise de conteúdo. Os resultados do estudo revelam significativas mudanças na forma de avaliar culturas, práticas e políticas inclusivas da primeira para a segunda aplicação do Index para Inclusão. Na análise da dimensão A - "Criando culturas inclusivas", a equipe escolar demonstra mudanças positivas em relação ao que estabelecem sobre valores inclusivos...<br>Abstract: Inclusive Education, as a new proposal of school culture that aims to develop a school "for all", is one of the greatest challenges in the educational setting . In everyday school life, the culture of homogenization requires that each school team places itself as a participant of the process by evaluating the school aiming to overcome the culture of exclusivon. In this universe of school inclusion, a new pedagogical look at everyone involved in the school context, not in search of culprits for the ills of education but in co-responsability for teaching and learning of all, will be needed. Thus, this study aimed to analyze the conception of school staff, students and parents/guardians on practices, policies and inclusive cultures at an elementary school, before and after a continuing education program, based on "Index for Inclusion" ("Index para inclusão"). The study was conducted in Cycle I of a public school in a city in the state of São Paulo and had 16 teachers and managers of the school staff, 204 students divided into 11 groups and 179 parents as participants. It was a quasi-experimental study in which the data collection procedure involved the development of a Continuing Education Program, as well as the application of the Index questionnaires to all participants involved in the research. Quantitative data from the questionnaires were statistically analyzed and presented in tables, and the analysis of the open questions of the questionnaire was carried out from the content analysis. The study results show significant changes in the way of evaluating cultures, inclusive practices and policies from the first to the second application of the "Index for Inclusion". In the analysis of Dimension A - "Creating Inclusive cultures", the school team demonstrates positive changes in relation to that set on inclusive values, although it has not shown statistically significant differences. The labor guardianship of worker’s fundamental rights: A pending subject in times of reformThe articlestarts with the penetration of Constitutional Law in labor relations mainly promoted by the Constitutional Court, which with its repeated statements have specified the normative content of workers’ constitutional rights. From this, it maintains that in protection matters of fundamental rights we are in the middle of an insufficientordinary route and another extraordinary route, legal protection, also unable to assume adequate protection of workers. The article analyzes particularities that should have a claim of violation of the fundamental rights of any other in alabor site to pick up characteristics such as:  accentuated swiftness, priority and preventing inadmissibility “in limine”. Finally, the text concludes regretting that New Procedural Labor Lawhasn’t created an ad hoc process for the protection of fundamental rights and that, on the contrary, it has opted for a disperse and chaotic system to protect them.<br>El artículo tiene como punto de partida la penetración del Derecho Constitucional en las relaciones de trabajo impulsada principalmente por el Tribunal Constitucional, el cual, con sus reiteradas sentencias, ha precisado el contenido normativo de los derechos constitucionales de los trabajadores. A partir de ello, se sostiene que en materia de protección de los derechos fundamentales nos encontramos en medio de una vía ordinaria insuficiente y otra vía extraordinaria, la del amparo, también incapaz de asumir la protección adecuada del trabajador. El artículo analiza las particularidades que debe tener una demanda de violación de derechos fundamentales y que la diferencian de cualquier otra en sede laboral para recoger características como: celeridad acentuada, prioridad e impedir la improcedencia in limine. Finalmente, el texto concluye lamentando que la Nueva Ley Procesal del Trabajo no haya creado un proceso ad hoc para la protección de derechos fundamentales y que, por el contrario, se haya optado por un sistema disperso y caótico para la protección de los mismos.

However, this scenario may become problematic from the perspective of protecting the freedom of the media and journalistic privilege. The author of this article offers an overview of the scope of the protection of the journalistic privilege pursuant to the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as its management in Poland from the developments prepared by its Constitutional Court.<br>La era digital ha reconfigurado los servicios de seguridad, sobre todo las formas de vigilancia masiva que buscan prevenir distintas amenazas para la sociedad. No obstante, este escenario puede convertirse en problemático desde la perspectiva de la protección de la libertad de los medios de comunicación y del privilegio periodístico. What is the element in which human rights arebased? What is it that holds the set of rights that belong  to  every human being for the only fact of being such? Confronted with this questions, several different answers have been formulated. In the present, the position in doctrine that statesthat dignity should be the foundation of humanrights is the preferred.In this article, the author presents an alternative answer to these questions. He proposes the “basic human necessities” as the element in which human rights are founded. In order  to  achieve this, he criticizes the aforementioned position, and introduces arguments in favor of the one he defends.<br>¿Cuál es el fundamento de los derechos huma-nos? ¿Qué es aquello que sostiene al conjunto de derechos inherentes a todo ser humano por susola condición de tal? Frente a estas preguntas sehan sostenido distintas respuestas. En la actua-lidad, prima en la doctrina la posición de que la dignidad debe ser el fundamento de los derechoshumanos.En el presente artículo, el autor nos plantea una respuesta alternativa a estas preguntas. Propone a las “necesidades humanas básicas” como fundamento de los derechos humanos. Para ello, critica a la posición anteriormente mencionada y plantea argumentos a favor de aquella que él sostiene.

Utiliza-se o método de decomposições do índice Theil-L para encontrar determinantes da desigualdade de desempenho escolar das crianças da 4ª série do ensino fundamental do estado de São Paulo. Os dados de proficiência dos alunos em português e matemática são extraídos da Prova Brasil 2005 e combinados com os dados do Censo Escolar 2005. A análise das contribuições brutas e marginais geradas por meio do índice Theil L mostra que variáveis comumente utilizadas como medidas de background sócioeconômico dos alunos explicam pouco da desigualdade das notas, menos de 2%. Ao mesmo tempo, as contribuições brutas e marginais apontam para a importância significativa das escolas, que explicam 14,58% da desigualdade de desempenho dos alunos em matemática e 13,27% do desempenho dos alunos em português. A única variável que explica significativamente a desigualdade entre as escolas é o município, 14,56% da desigualdade em matemática e 13,98% em português. As demais variáveis quando consideradas isoladamente, respondem por menos de 2,5% da desigualdade. Quando tomadas em grupos, seu poder explicativo aumenta. As variáveis de infraestrutura escolar explicam 18,68% da desigualdade entre as escolas em português e 20% da desigualdade em matemática. As variáveis referentes ao background dos colegas respondem respectivamente por 8,79 e 9,40%. Conclui-se que o impacto das diferentes variáveis no desempenho dos alunos se dá por meio de sua interação mais do que pelo efeito de variáveis específicas. Reitera-se também a importância de se entender o impacto dos insumos escolares para compreender a proficiência dos alunos. O trabalho aponta ainda o efeito que os municípios têm sobre as escolas e oferece base para uma melhor compreensão posterior desse fenômeno.<br>This research uses the method of Theil-L decomposition to find determinants of the inequality among students scores of the 4th grade of the fundamental school in the state of São Paulo. The data is provided by a combination of Prova Brasil 2005 standardized tests and the Censo Escolar 2005. The analysis of the gross and marginal contributions measured by the Theil-L indez indicates that the variables normally used for students social and economic background give few explanation about the total inequality measured. The analysis of the decompositions also shows that schools play a main role in the inequalities among students, explaining 14,58% of the students inequality in math and 13,27% in Portuguese. The only single variable that shows an important impact in the score inequalities among schools is the municipality, 14,56% for math and 13,98% for Portuguese. The other variables have no impact over 2,5% when considered solely. By the other side, when these variables are considered in groups, there is a gain in explanation. The school infra-structure explain 18,68% of the inequality among schools in Portuguese and 20% of the inequality in math. The variables about the peers background are responsible for 8,79 and 9,40% respectively. It is concluded that the impact of differents variables in students learning are more due to their interaction, than by their direct effects. It is reinforced the importance of a better understanding of school variables to understand children apprenticeship as shown by part of the literature. This research points to the importance of municipalities for schools and gives a basis for further discussion on this matter.

Foram estudados 375 meninos e 369 meninas, nas faixas etárias dos 7 aos 10 anos de idade, matriculados nas escolas públicas municipais de ensino fundamental. Para tal, foram mensuradas as variáveis antropométricas de peso, estatura e as de composição corporal ¿ massa livre de gordura, massa gorda e porcentagem de gordura corporal ¿ através da bioimpedância. As medidas foram padronizadas pela estatura2 para a obtenção do índice de massa corporal (massa corporal/estatura2), índice de massa gorda (massa gorda/estatura2) e índice de massa livre de gordura (massa livre de gordura/estatura2). Os critérios de classificação utilizados foram os estabelecidos pelo Centers for Disease Control and Prevention (CDC) e pela International Obesity Task Force (IOTF). Foram aplicados os testes t-Student e o não-paramétrico Mann Whitney para a verificação das diferenças estatísticas entre as faixas etárias e sexos, o método de correlação de Pearson e o de análise de variância General Linear Models (GLM). Como resultados foram observados prevalências de baixo peso de 8,4% e sobrepeso de 13,55% entre as meninas, e entre os meninos se observou uma prevalência de obesidade de 12,8%, valores estes acima dos esperados. Foram encontrados altos níveis de adiposidade, estes superiores a 30% de gordura corporal, para ambos os sexos, entre os escolares classificados como obesos. Ambos os critérios apresentaram boa capacidade de discriminação entre suas faixas de classificação utilizando como indicador o índice de massa corporal/idade, conforme os resultados obtidos pela análise de variância segundo o modelo General Linear Models (GLM). O índice de massa corporal apresentou bons níveis de correlação com o índice de massa gorda, índice de massa livre de gordura e a porcentagem de gordura corporal, por faixa etária e sexo segundo o método de correlação de Pearson. Estes resultados identificam uma situação de transição nutricional, uma vez que foram encontradas prevalências consideráveis de baixo peso e obesidade, indicando a necessidade de adoção de ações em promoção da saúde no ambiente escolar para a prevenção e correção deste quadro<br>Abstract: The aim of this study was to investigate the nutritional status and the body composition of schoolchildren from Vinhedo ¿ S.P. elementary school. It was studied 375 boys and 369 girls between 7 to 10 years registered on elementary public school district. Stature and weight were measured in the standard fashion and fat-free mass, fat mass and percentage of body fat mass (%BFM) using bioelectrical impedance analysis (BIA). It was calculated from these values the body mass index (BMI), fat-free mass index (FFMI) and fat mass index (FMI). It was used reference criteria from U.S. Centers for Disease Control and Prevention (CDC) and International Obesity Task Force (IOTF). T-Student and Mann Whitney tests were done to verify statistics differences between ages and both sexes, and also Pearson correlation and General Linear Models (GLM) variance analysis. As results were observed underweight prevalence 8,4% and overweight 13,55% to the girls and obesity¿s prevalence 12,8% to the boys. These values were over expected. The body fatness among children with obesity was higher than 30% body fat mass. Both BMI criteria, CDC and IOTF, presented a good capacity to identify overweight among schoolchildren. BMI for age was well correlated with FMI, FFMI and % BMF among boys and girls in all age groups. These results identify a nutritional transition since that were found considerable underweight prevalence and obesity indicating that must be adopted actions to improve school health promotion to prevent and correct this situation<br>Mestrado<br>Mestre em Educação Física

Bakgrund: Aktieindex används världen över som placeringsalternativ, jämförelsemått inom portföljförvaltning och som underlag för portföljoptimering. Forskare har under senare tid ifrågasatt index viktade efter börsvärdet och alternativa viktningsmetoder för index har framtagits som substitut till det kapitalviktade indexet och prestationsjämförelser har gjorts. Studier har främst gjorts i USA och denna studie ämnar göra en liknande undersökning på den svenska marknaden.  Syfte: Syftet med vår studie är att undersöka alternativa viktningsmetoder på det svenska aktieindexet OMXS30 och dess historiska prestation under åren 1995-2011 i förhållande till det traditionellt kapitalviktade OMXS30. Syftet är vidare att analysera de alternativt viktade indexen som grund för portföljoptimering enligt Single-Index Model.  Genomförande: Fem alternativt viktade index konstrueras i studien där viktningen grundas på fundamentala värden, Sharpekvoter, standardavvikelse, likaviktning och handelsvolym och jämförs prestationsmässigt mot OMXS30. Indexen används sedan vid portföljoptimering enligt SIM där aktiers och portföljers karakteristika analyseras. Indexens prognostisering av betavärden utvärderas i studien för att urskilja om något index är mer träffsäkert gällande aktiens beta för nästkommande period.  Slutsats: Ett flertal av de konstruerade alternativa indexen genererar signifikant högre avkastning till lägre risk i den nedgångsperiod som analyserats varför dessa kan ses som en mer lönsam investering. Tendenser till högre avkastning för den totala perioden finns även om signifikanta skillnader inte föreligger. De alternativa indexen har föranlett skilda allokeringsbeslut vid portföljoptimeringen vilket har gett stora utslag i portföljernas förväntade prestation såväl som faktisk prestation efter optimeringen genomförts.<br>Background: Stock market indexes are widely used as investment strategies and as a benchmark when portfolios are being constructed and evaluated. Researchers have recently questioned the capital weighted index in favor of other available weighting schemes. By comparing alternative weighted indexes to the traditionally capital weighted index one has been made aware of the significantly lower risk adjusted performance for the capital weighted index.  Aim: Our aim is to investigate in alternative weighting schemes used on the Swedish index OMXS30 and evaluate the historical performance of these alternative indexes in comparison to the traditionally capital weighted index during the period 1995-2011. Furthermore, our objective is to analyze the effects alternative weighting schemes have on portfolio optimization through Single-Index Model.  Completion: To fulfill the purpose of this thesis, five alternative weighting schemes have been applied on the Swedish index OMXS30. The weights have been calculated on fundamental measures, Sharpe ratios, standard deviation, equally weighted and trade volume and they have been compared to the traditionally cap-weighted index. Furthermore, the constructed indexes will be used to optimize portfolios with Single Index Model to compare the portfolios characteristics when different indexes have been used.  Results/Findings: The majority of the alternative weighted indexes generate significantly higher returns in one of our analyzed periods and this was during a market recession. For the total analyzed period no statistical differences among the indexes could be determined even though differences in total return are made clear. The indexes had a big effect on the portfolio optimization in terms of different share allocation.
