Traunspurger, Walter, ed. Ecology of freshwater nematodes. Wallingford: CABI, 2021. http://dx.doi.org/10.1079/9781789243635.0000.

Full text
Abstract:
Abstract This book, with its 12 chapters, not only encourages all ecologists to consider free-living nematodes as a model organism in their investigations, but also shows how important it is to study the fundamentals of ecology, for example, the distribution and diversity of a group of organisms as well as the interactions of those organisms with others. Detailed studies of this type will ultimately provide a better understanding of food webs, their role in the respective habitat, and the changes therein caused by human activities. In this context, research during the past 20 years has determined that, in addition to aquatic environments, nematodes are good indicators of sediment and soil quality. This book takes into account much of the recent research on the ecology of freshwater nematodes. It contains many new chapters as well as revisions and updates of the chapters of the 2006 book. The objective was to write a comprehensive yet readable guide for interested biologists, from students to career scientists.

et, Mokal. Principles and Objectives Guiding the Modular Approach to MSME Insolvency. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198799931.003.0003.

Full text
Abstract:
This chapter identifies the fundamental principles that underpin the resolution of insolvency for smaller businesses, and considers how those principles can guide the development and implementation of an approach responsive to the particular challenges faced by MSMEs. Fairness is the foundation of the Modular Approach, which seeks to systemize and generalize its requirements across the entire range of responses to MSME distress. The Approach pursues this objective by ensuring that the principles enshrined in insolvency law accord equal concern to the interests of all those stakeholders affected by issues peculiar to insolvency. Such principles must guide the creation of insolvency law tools and processes while reflecting each society’s policy choices within the complex combination of corporate, employment, environmental, property, tax, tort, and welfare laws, within which insolvency law must find its place.

Abstract:
Chapter 12 proposes a comprehensive new Israeli national security strategy. The overall thrust is that Israel has become fundamentally secure and can adopt a long-term approach of greater “strategic patience,” with a heightened emphasis on defense, including building a national rocket and missile shield, and diplomacy. Separation from the Palestinians should be Israel’s foremost national objective. Israel should define relations with the United States as a fundamental national security pillar, adapt to the reality of dependence, and seek a defense treaty, but also aspire to independence where possible. Israel must maintain robust conventional and strategic capabilities, maintain nuclear ambiguity, ensure Iran never crosses the nuclear threshold, but prepare for an era in which the “Begin Doctrine” may no longer be feasible. The strategy further emphasizes the need to preserve and strengthen Israel’s domestic sources of power and thus the need for socioeconomic and electoral reform as primary national security objectives.

Russell, Paul. Hume’s Philosophy of Irreligion and the Myth of British Empiricism. Edited by Paul Russell. Oxford University Press, 2015. http://dx.doi.org/10.1093/oxfordhb/9780199742844.013.36.

Full text
Abstract:
This chapter outlines an alternative interpretation of Hume’s philosophy, one that aims, among other things, to explain some of the most perplexing puzzles concerning the relationship between Hume’s skepticism and his naturalism. The key to solving these puzzles, it is argued, rests with recognizing Hume’s fundamental irreligious aims and objectives, beginning with his first and greatest work, A Treatise of Human Nature. The irreligious interpretation not only reconfigures our understanding of the unity and structure of Hume’s thought, it also provides a radically different picture of the way in which Hume’s philosophy is rooted in its historical context. By altering our understanding of the fundamentals of Hume’s philosophy in this way, the irreligious interpretation also challenges the adequacy of the familiar and entrenched framework of “British Empiricism.”

Full text
Abstract:
Chapter 1 presents the “Ben-Gurion doctrine,” formulated in the 1950s, the closest Israel has to a formal defense doctrine, which still informs its strategic thinking today. The doctrine viewed the Arab-Israeli conflict as uniquely long, bitter, all-encompassing, and existential and considered Israel’s geography a strategic nightmare, making it a vulnerable state with indefensible borders. It stressed the fundamental strategic asymmetries with the Arabs, including territorial and population size, economic resources, staying power, military objectives and capabilities, and diplomatic support. The strategic response it proposed called for “a nation in arms” and was based on “three pillars,” deterrence, early warning, and military decision, and on a defensive strategy to be executed offensively, by transferring the battle to enemy territory. It further emphasized the pursuit of peace as a foremost strategic objective, the need for great power alliances but strategic autonomy, and the importance of nation-building.

Full text
Abstract:
Theories of contract law fall into three basic categories: formalist, interpretive, and normative. Formalist theories proceed by first purporting to identify a core set of rules that are justified on the ground that they are self-evident axioms, and then purporting to derive the remaining rules by logical deduction from the axioms. Interpretive theories proceed by describing areas of contract law and then determining the social propositions that are to be found in the most fundamental doctrines in the area or that meet some standard of fit with and best justify or rationalize doctrine in the area. Under normative theories the content of contract law depends on the rules that are generated by properly weighted and reconciled policy, moral, and empirical propositions. Unlike the objectives of formalist and interpretive theories, the objective of normative theories is to formulate the best possible rules of contract law.

Full text
Abstract:
This chapter offers an account of the truth conditions of sentences involving terms like ‘ought’. These truth conditions involve a function from worlds of evaluation to domains of worlds, and an ordering of the worlds in such domains. Every such ordering arises from a probability function and a value function—since it ranks worlds according to the expected value of certain propositions that are true at those worlds. With the objective ‘ought’, the probability function is the omniscient function, which assigns 1 to all truths and 0 to all falsehoods; with the subjective ‘ought’, the probability function captures the uncertainty of the relevant agent. The relevance of this account for understanding conditionals is explored, and this account is defended against objections. For present purposes, the crucial point is that any normative use of ‘ought’ is normative because of the value that is semantically involved. The fundamental normative concepts are evaluative.

Freilich, Charles D. Primary Conclusions. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780190602932.003.0012.

Full text
Abstract:
Chapter 11 presents the primary conclusions derived from the proceeding chapters, as a basis for the national security strategy proposed in chapter 12. The conclusions are divided into four categories, general, politico-military, military, and domestic policy. The chapter also discusses the pitfalls involved in recommending a national security strategy, such as physical and political feasibility; limitations stemming from the absence of classified information; and possible normative biases. The chapter begins by setting out Israel’s vital national security objectives, that is, a core set of fundamental, essentially immutable interests, and then a variety of lesser, though still highly important, ones, some relatively permanent, others that change with circumstances. It further presents a number of “policy instruments” of such importance, for example, preserving the strategic relationship with the United States, that they can be considered vital objectives in their own right and are thus part of the basis for the proposed strategy.

We provide the overall framework for the Physicianship Curriculum. It is based on common clinical presentations, as described in the medical literature. We develop the fundamental questions and issues that are likely to be in the minds of a patient and physician during a medical encounter. These issues frame clinical thinking with respect to assessment and treatment and inform the content of the educational program. The primary objectives of each curricular phase are outlined. We articulate the specific roles of teachers and mentors and propose a set of teaching methods, adopted, in part, from the broader literature in educational research.

Full text
Abstract:
The task that EU Translation needs to accomplish originates from the combined policy objectives of legal integration and language diversity, which in turn rest on two EU fundamental principles: the advancement of a European Internal Market and the respect and protection of Europe’s cultural diversity, respectively. However, a comparison of language versions of EU legislation in the field of consumer contract law illustrates the ways in which the multilingual character of EU legislation might hamper the uniform interpretation and application of EU law. It articulates why pursuing effective legal integration and protecting language diversity requires EU translators and lawyer–linguists to accomplish absolute concordance between language versions.

Abstract:
This chapter gives a short overview of the Pathways Project, its aims and objectives, and its media of choice. The major purpose of the Pathways Project is to illustrate and explain the fundamental similarities and correspondences between humankind's oldest and newest thought-technologies: oral tradition and the Internet. This chapter argues that both technologies are alike, and furthermore that they have an advantage over the traditional media of books in that they “mine the way we think” by processing along pathways within a network. Finally, the chapter maps out the structure of the Pathways Project, both in the form of its website, and in this book.

Full text
Abstract:
Chapter 3 develops four underlying principles of contract law and the foundational contract law standard. Under the most fundamental principle of contract law the aim of contract law should be to effectuate the objectives of parties to promissory transactions, provided that appropriate policy and moral conditions, such as freedom from duress and fraud, are satisfied, and subject to appropriate constraints, such as capacity and legality. The normative theory of contract law, taken together with the four underlying principles described in this chapter, comprise the foundational contract-law standard. Contract-law rules that are supported by the foundational standard are justified. Contract-law rules that are not so supported are unjustified.

Abstract:
This chapter examines Indian foreign policy under Prime Minister Rajiv Gandhi (1984–89). It argues that during these years, Indian foreign policy was significantly reoriented. Gandhi made important moves to recast India’s relations with the United States and China. Although no major breakthroughs were achieved, his engagement with them set the tone and pattern for the approach and policy of all subsequent governments. In India’s own neighbourhood, his policies had a more activist edge. But the outcomes were mixed. Perhaps the most fundamental shift in foreign policy was Gandhi’s recognition that India’s modernization and economic development required greater and more adroit engagement with the world and that foreign policy had to be geared towards securing these objectives.

Abstract:
This chapter examines the role of the International Labour Organization (ILO) in ocean governance. Established in 1919, ILO is the oldest agency of the United Nations. Today, its decent work agenda is articulated around four strategic objectives: promote fundamental principles and rights at work; create employment and income opportunities; enhance social protection and social security; and strengthen social dialogue and tripartism. The chapter discusses ILO’s standard-setting activities with respect to international protection of maritime labour as well as the Maritime Labour Convention of 2006, which gave rise to a new social charter for global seafaring. It also considers ILO’s standard-setting work relating to commercial fishing and to biometric seafarers’ identity documents (SIDs).

Full text
Abstract:
Constructivism and intuitionism are often seen as opposed methods of justification in political philosophy. An “ecumenical” view sees them as different but unopposed: each style of reasoning can yield fundamental principles, for different questions of distributive justice, and we can rightly take up different questions, with different, equally valid, theoretical objectives, in hopes of cultivating a thousand blooming flowers. This chapter develops this position with special interest in Rawls’s constructivism, his treatment of reflective equilibrium, self-evidence, and “moral geometry,” and his evolving dialogue with the intuitionist Henry Sidgwick. Rawls’s main difference from Sidgwick lies in the way he frames the question of right or justice in the first instance. This brings out both the possibility and the attractions of the ecumenist conception in political philosophy.

Abstract:
Quantum theory involves a novel, indirect use of models to further the aims of fundamental science. It is revolutionary because of the way it improves our use and understanding of representations of the universe we could offer without it. The so-called semantic approach takes a scientific theory to supply a collection of models to be used to represent phenomena: but models of quantum theory are applied more indirectly to provide good advice on the significance and credibility of claims about physical things whose existence is assumable here. Inferentialism takes these claims to derive their content through inferential links to others. They are objective, as are the probabilities they are assigned, and some are objectively true.

Abstract:
This chapter examines the interplay between the formal and informal rules relating to the adoption of legislative acts, and the effects that this interplay has on participation and transparency in EU law-making. It discusses the relationship between the claimed objectivity of the choices relating to legal basis and their institutional implications through the Court jurisprudence, with a focus on inter-institutional power relations. The current emphasis on efficiency, guaranteed through the flexibility built into the informal rules of law-making, brings to the fore many fundamental questions relating to participation, transparency, and power in the adoption of EU legal acts. In short, efficiency comes at a cost to many other objectives that the Treaty of Lisbon was believed to strengthen. The relevant political question is whether the balance created by today’s informal law-making framework is the right one.

Abstract:
This chapter juxtaposes praise of the city against critiques of it, and in doing so acknowledges the vast spectrum of urban experiences available. It demonstrates how counter-claims to the Good or Holy City were abundant. Fundamental criticism of urban living coexisted with endorsement of it, and understanding this divergence produces a more comprehensive perspective of urban praise. This chapter therefore offers a consideration of some of the more prominent critiques of the city, focused, for example, on ideas about the link between the city and avarice, deviancy, disorder, and violence. It also delves into some particular works of urban panegyric to identify elements of lamentation and critique, and what objectives these served, and concludes that, by the thirteenth century, those critiques were being absorbed into (and indeed were contributing to) an ideological framework which conversely valorized cities.
