Abstract:

Abstract:

Abstract:
Jacques Cujas was a French humanist and one of the most distinguished 16th-century legal experts. This paper analyses the rules governing liability and the meaning of periculum (risk) in his commentaries to Roman law.
My study is focused on two examples which offer surprising interpretations of risk. The first case concerns a person who lost an object given for valuation. Here Cujas uses the term periculum in two different meanings. The first is general and covers all types of irresistible events. The second is limited to only one type of event – theft. This distinction is fundamental for the evaluation of the legal consequences arising from the loss of the object. Te inspector would have had to bear the risk of theft (periculum furti), but not other risks, especially not those related to force majeure.
The second case I discuss deals with the complexities of risk allocation in the contract of sale. In one of his earlier commentaries, Cujas accepted the Roman legal principle of periculum emptoris – that the risk of the loss of the object sold should be on the buyer. At the same time, in his discussion of particular cases Cujas was flexible in allocating various risks to either of the parties, thus paving the way for his future change of mind on periculum venditoris.

Abstract:
The offence of embezzlement of public funds – peculatus – is an interesting research subject due to the Roman legislator’s original approach to the issue of the classification of types of criminal offences (crimina). The paper aims to present Roman regulations concerning peculatus from the perspective of the methods of classifying its features as adopted by the compilers, taking into account both the normative contents of original laws (created by the original authors of these laws), as well as those added by later legislative factors: emperors, the senate and jurisprudence. The study of the Julian law on embezzlement of public funds may be conducted following the Justinian’s title Ad legem Iuliam peculatus et de sacrilegis et de residuis (Dig., 48, 13). Peculatus was the basic type of the offence of embezzlement of public funds. In the time of Augustus, two separate types of the offence isolated from peculatus, which were sacrilegium (probably within one law - lex Iulia peculatus) and embezzlement of a specific kind of money, i.e. pecunia residua (probably within a separate law - lex Iulia de residuis). Despite being quite precisely defined by the law, the type of the offence of embezzlement of public funds must have raised doubts when it came to applying the law, in cases where the act the offender was charged with came close to theft (crimen furti) or forgery (crimen falsi).

Abstract:
The Clause ex bona fide of the formula commodatiSummaryFrom the passages on a competition of complaints one may conclude that before introduction of actio commodati one secured a protection of facts of a case, acknowledged later as a commodatum by using actio furti, condictio ex causa furtiva or actio legis Aquiliae. Commodatum gained a separate legal protection only as a result of pretor’s activities. Pretor introduced to his edict legal form u la e serving to pursue claims arising from com m odatum (D. 13,6,1 pr. - Ulp. 28 ad ed.). In Gaius’ opinion (G. 4,47) they are similar to deposit form ulae whereby he seems to suggest that a fo rm u la in ius com m odati had an ex bona fid e clause. On the other hand, placing com m odatum in pretor’s edict in the title de rebus creditis (D. 12,1,1,1 - Ulp. 26 ad ed.), and also a lack of certainty - due to a distortion of a text - whether Gaius (G. 4,62) in his enumeration of actiones bonae fidei took into account also commodatum may raise a doubt whether actio com m odati actually had this clause. However there is an indirect evidence attesting to the fact that com m odatum contained a good faith clause namely the possibility of compensation (G. 4,61; D. 13,6,18,4 - Gaius 9 a d ed. p ro v ) and release from an obligation in case of joint and several debt from commodatum not in a moment of litis contestatio but not until a fulfilment of an obligation (D. 13,6,5,15 - Ulp. 28 a d ed.).

Abstract:
THE RANGE OF APPLICATION OF THE EDICT ‘NAUTAE, CAUPONES, STABULARII UT RECEPTA RESTITUANT’Summary This article focuses on the range of application of the edict ‘nautae, caupones, stabularii ut recepta restituant’. The regulation introduced no fault liability for things received for safekeeping by seaman and innkeepers (D. 4,9,3,1). Most scholars argue that the so called receptum nautarum was a separate guarantee contract. This interpretation limits the scope of the edict only to enforcing a contractual obligation. It seems also unfounded. The roman jurist never used the term receptum nautarum. Especially they never require entering into a separate guarantee contract as a basis for the liability of seaman and innkeepers. In their commentaries it is always recipere in the basic meaning of receiving something for safekeeping that triggers the liability. The questions discussed in the legal texts Focus only on following problems: the purpose of the edict and the necessity of entrusting the property to seamen and innkeepers (D. 4,9,1,1); who is entitled to receive the property for safekeeping (D. 4,9,1,2, D. 4,9,1,3); the question if the edict relates also to those things that are additional to the main merchandise received for safekeeping (D. 4,9,1,6); how should the property be entrusted and when the goods are seen as received for safekeeping by the seamen or innkeepers (D. 4,9,1,8); the question if the edict relates to property received only on the ship for transport or also to merchandise received on the shore (D. 4,9,3 pr). The idea of receptum nautarum being a guarantee contract is mainly based on one sentence form Ulpian commentary regarding the special actio furti adversus nautas caupones stabularios (D. 47,5,1,4). It is possible to interpret this text in a coherent way with all other fragments that connect the liability of the entrepreneurs with the mere fact of receiving something for safekeeping. As a result of this study it is plausible to assume that the praetor addressed in the new regulation the problem of merchandise entrusted to seamen and innkeepers without any legal guarantee. It is certain that from the first century A.D. the liability of discussed entrepreneurs was based only on the fact of receiving goods for safekeeping.

Abstract:
Abstract. The Wistar-Furth rat, an inbred strain resistant to actions of mineralocorticoids, was used to study the concept that mineralocorticoids contribute to progressive renal injury. It was postulated that if chronic nephropathy depends on aldosterone and if Wistar-Furth rats are resistant to aldosterone, remnant nephropathy would be attenuated in Wistar-Furth rats. Wistar-Furth rats and control Wistar rats were subjected to 5/6 nephrectomy or a sham procedure and then followed for 4 wk. Renal ablation resulted in hypertension at 4 wk in both strains (164 ± 5 [Wistar-Furth] versus 184 ± 7 [Wistar] mmHg mean arterial pressure), with sham animals remaining normotensive (134 ± 6 mmHg). Renal damage in response to 5/6 nephrectomy was greatly decreased in Wistar-Furth rats compared with Wistar rats. Albuminuria was markedly less in Wistar-Furth rats (12.7 ± 4.2 [Wistar-Furth] versus 97.4 ± 22.6 [Wistar] mg/d per 100 g body wt, P < 0.01). Glomerular damage, consisting of mesangial proliferation, mesangial lysis, and segmental necrosis, was observed in 42% of glomeruli from Wistar rats but in 0% of glomeruli from Wistar-Furth rats (P < 0.01). To address the possibility that higher BP in partially nephrectomized Wistar rats mediated the greater renal damage, the study was repeated, with Wistar rats (not Wistar-Furth rats) being treated with a hydralazine-reserpine-hydrochlorothiazide regimen. Although this antihypertensive regimen equalized BP (conscious systolic) (144 ± 8 mmHg [Wistar] versus 157 ± 7 mmHg [Wistar-Furth] at 4 wk), albuminuria remained more than 10-fold greater in Wistar rats. In summary, renal damage upon 5/6 nephrectomy was markedly reduced in Wistar-Furth rats, a finding not attributable to reduced systemic BP. Since Wistar-Furth rats have been shown previously to be resistant to the actions of mineralocorticoids, the data from the present study support the hypothesis that aldosterone mediates, at least in part, the renal injury attendant to renal mass reduction.

Abstract:
Feline upper respiratory tract disease (FURTD), often caused by infections etiologies, is a multifactorial syndrome affecting feline populations worldwide. Because of its highly transmissible nature, infectious FURTD is most prevalent anywhere cats are housed in groups such as animal shelters, and is associated with negative consequences such as decreasing adoption rates, intensifying care costs, and increasing euthanasia rates. Understanding the etiology and pathophysiology of FURTD is thus essential to best mitigate the negative consequences of this disease. Clinical signs of FURTD include acute respiratory disease, with a small fraction of cats developing chronic sequelae. It is thought that nasal mucosal microbiome changes play an active role in the development of acute clinical signs, but it remains unknown if the microbiome may play a role in the development and progression of chronic clinical disease. To address the knowledge gap surrounding how microbiomes link to chronic FURTD, we asked if microbial community structure of upper respiratory and gut microbiomes differed between cats with chronic FURTD signs and clinically normal cats. We selected 8 households with at least one cat exhibiting chronic clinical FURTD, and simultaneously collected samples from cohabitating clinically normal cats. Microbial community structure was assessed via 16S rDNA sequencing of both gut and nasal microbiome communities. Using a previously described ecophylogenetic method, we identified 136 and 89 microbial features within gut and nasal microbiomes respectively that significantly associated with presence of active FURTD clinical signs in cats with a history of chronic signs. Overall, we find that nasal and gut microbial community members associate with the presence of chronic clinical course, but more research is needed to confirm our observations.

Abstract:
Introduction: There is no study investigating the factors predicting postoperative febrile urinary tract infection (fUTI) in pediatric patients. We aimed to determine the factors predicting postoperative fUTI in pediatric patients who underwent ureterorenoscopic lithotripsy (URS-L). Methods: Pediatric patients who underwent URS-L due to ureter or kidney stones in our clinic between 2012 and 2019 were analyzed retrospectively. The demographic data, stone characteristics, intraoperative and postoperative data of those with and without postoperative fUTI were compared. Univariable and multivariable binary logistic regression analysis was performed to determine predictors of fUTI. Results: A total of 136 patients were included in the study. Postoperative fUTI developed in 17 patients (12.5%). History of stone surgery, history of UTI, presence of nephrostomy/D-J stent, type of surgery, operation time, length of stay, and presence of complication except fUTI were found to be significantly different in the fUTI group. In the univariate analysis, history of stone surgery, history of UTI, presence of nephrostomy/D-J stent, type of surgery, operation time, and presence of complication except fUTI were determined as factors predicting fUTI. In multivariate analysis, only the history of UTI was identified as an independent predictive factor. Conclusion: In pediatric patients, infectious complications constitute the majority of complications after URS-L. History of UTI is the only independent factor that predicts postoperative fUTI after URS-L.

Abstract:
Abstract A single immunization of Lewis rats with purified acetylcholine receptor (AChR) emulsified in adjuvant typically stimulates the production of oligoclonal AChR-reactive antibodies (as demonstrated by IEF) dominated by the IgG2a subclass, of moderate but clonotypically heterogeneous relative Ag-binding avidity, and capable of inducing symptoms of experimental autoimmune myasthenia gravis. Although similar immunization of Wistar Furth rats produces AChR-reactive antibodies with similar characteristics of clonotypic heterogeneity, avidity, and isotype expression, no detectable signs of AChR-dependent muscle impairment is observed. This contrasts the ability to induce impaired AChR function upon the passive transfer of pre-formed Lewis anti-AChR antibodies into naive Wistar Furth rats, suggesting that disease resistance in this model is not conferred at the level of the AChR itself. Moreover, if more aggressive immunization protocols are used (i.e., multiple injections of AChR), a transient breakthrough of AChR-dependent muscle dysfunction can be induced directly in the Wistar Furth strain indicating that the potential for the production of disease-causing antibodies does exist in the Wistar Furth repertoire. IEF analysis of Wistar Furth anti-AChR antibodies has revealed that hyperimmunization results in modified antibody clonotype expression that might explain changing expression of disease symptoms; however, explanations for the apparent "resistance" of Wistar Furth rats to disease induction are likely to be complex.

Abstract:
Febrile urinary tract infection (fUTI) is common in infants, but specific risk factors for developing it remain unclear. As most fUTIs are caused by ascending infections of intestinal bacteria, dysbiosis—an imbalance in gut microbial communities—may increase fUTI risk. This study was conducted to test the hypothesis that abnormal development of gut microbiota during infancy increases the risk of developing fUTI. Stool samples were collected from 28 infants aged 3–11 months with first-onset fUTI (fUTI group) and 51 healthy infants of the same age (HC group). After bacterial DNA extraction, 16S rRNA expression was measured and the diversity of gut microbiota and constituent bacteria were compared between the two groups. The alpha diversity of gut microbiota (median Shannon index and Chao index) was significantly lower in the fUTI group (3.0 and 42.5) than in the HC group (3.7 and 97.0; p &lt; 0.001). The beta diversity also formed different clusters between the two groups (p &lt; 0.001), suggesting differences in their microbial composition. The linear discriminant analysis effect size showed that the fUTI group proportionally featured significantly more Escherichia-Shigella in the gut microbiota (9.5%) than the HC group (3.1%; p &lt; 0.001). In summary, abnormal gut microbiota development during infancy may increase the risk of fUTI.

Abstract:
<strong>Background:&nbsp;</strong>Percutaneous nephrolithotomy (PCNL) is the preferred treatment for large renal calculi, but febrile urinary tract infections (fUTI) remain a common postoperative complication, leading to increased morbidity. Identifying reliable preoperative predictors such as the neutrophil&ndash;lymphocyte ratio (NLR) could improve patient outcomes by facilitating risk stratification.&nbsp;<strong>Aim:&nbsp;</strong>The purpose of this study was to assess the relationship between preoperative NLR and the prevalence of fUTI in PCNL patients.&nbsp;<strong>Methods:&nbsp;</strong>An observational study was done on 100 patients undergoing PCNL at GMERS Medical College, Junagadh, Gujarat. Demographics, clinical data, and preoperative NLR values were recorded. Patients were monitored for fUTI within 30 days postoperatively. Statistical analysis, including chi-square tests and logistic regression, was performed using SPSS version 23.0.&nbsp;<strong>Results:&nbsp;</strong>Participants had a mean stone size of 25.7 mm, were 45.3 years old on average, and were 60% male. Of the patients, 20% developed fUTI. The fUTI group had a substantially greater mean preoperative NLR (5.8 &plusmn; 1.2) than the non-fUTI group (3.1 &plusmn; 0.8) (p &lt; 0.001). The independent prediction of fUTI by NLR was validated using logistic regression.&nbsp;<strong>Conclusion:&nbsp;</strong>In PCNL patients, elevated preoperative NLR is highly correlated with an increased risk of fUTI., making it a valuable marker for risk stratification.&nbsp;<strong>Recommendations:&nbsp;</strong>Routine preoperative NLR assessment is recommended to identify high-risk patients and implement tailored perioperative interventions to reduce fUTI incidence. Standardized NLR levels and validation of these results require more investigation. &nbsp; &nbsp;

Abstract:

Abstract:

Abstract:
477 Background: Combination therapy using FGFR inhibitors and Immune checkpoint inhibitors (ICIs) are being explored as a novel strategy for esophageal cancer (EC) patients (pts). We reported the tolerability and encouraging antitumor activity of futibatinib (futi) plus pembrolizumab (pem) in cohort (CO) A (≥2nd line, ICIs naïve) and COB (≥2nd line, ICIs refractory) and futi plus pem with chemotherapy in COD (1st line, ICIs naïve) with EC pts at Ooki et al ASCO 2024. The purpose of this Cohort E (COE) was to evaluate the effects of futi as a single agent or futi in combination with pem on tumor immune microenvironment by detecting immune cells and immune-related gene expression. Methods: In COE of the study, advanced or metastatic EC pts with at least one prior therapy with a fluorouracil and platinum-based drug received a single agent of futi the first 7 days, followed by futi 20 mg once daily (continuous dosing) plus pem 200 mg/every 3 weeks (up to a maximum of 35 cycles). Regardless of FGFR overexpression level and ICIs naïve or refractory pts were include on the study. Tumor samples were collected by biopsy during the screening period, 7 days after the administration of futi, and 21 days after the combination administration of futi and pem. Expression of 18 biomarkers including CD3, CD4, CD8 were analyzed by multiplex IHC (NeoGenomics). Gene expression related to immunity in tumor microenvironment were evaluated by nCounter system (NanoString). Results: As of March 10, 2024, 18 pts (ICIs naïve, 3 pts; ICIs refractory, 15 pts) were enrolled. As a result of multiplex IHC, an increase of CD3 + CD8 + T cells was observed in the samples 7 days after a single treatment of futi comparing with baseline samples and a trend towards greater increased CD3 + CD8 + cells was observed 21 days after combination treatment. An increasing CD8A gene expression was observed by nCounter analysis after a single treatment of futi comparing with baseline and a trend towards greater increase in CD8A gene expression was observed after combination treatment. Confirmed partial responses were observed in 3 pts (2 pts were ICIs naïve and 2 pts were FGFR positive). ORR was 16.7% (3/18; 1 pt had no target lesion, 95% CI: 3.6, 41.4). Most common TRAEs were hyperphosphatemia (77.8%), diarrhea (33.3%), ALT increased, and AST increased (22.2%). Conclusions: The preliminary multiplex IHC and nCounter results suggest that futi promoted CD8 + T cells infiltration into EC tumor microenvironments by single treatment and following combination treatment with pem at tolerable dosage. Abstract:
Mesenteric artery rings from Wistar and Wistar-Furth rats subcutaneously treated with deoxycorticosterone acetate (DOCA) and 1% NaCl drinking water were used to measure endothelial modulation of contractile sensitivity and vasopressin receptor function and affinity. DOCA-salt hypertension reduced contractile sensitivity to arginine vasopressin (AVP) and did not affect contractile sensitivity to norepinephrine in arteries from Wistar rats. Endothelial removal caused a threefold increase in contractile sensitivity to AVP and norepinephrine in DOCA-salt hypertensive Wistar rats. In Wistar-Furth rats, DOCA-salt treatment did not affect contractile sensitivity to AVP, lysine vasopressin, oxytocin, and norepinephrine or the affinity of the vasopressin receptor for agonists or antagonists. Removal of endothelium did not affect vasopressin contractile sensitivity but caused a 15-fold increase in contractile sensitivity to norepinephrine in untreated or DOCA-salt-treated Wistar-Furth rats. These data show that reduced vasopressin receptor function and increased endothelial function that compensate for increased contractile sensitivity in arteries from DOCA-salt hypertensive Wistar rats are not the cause of resistance of DOCA-salt-treated Wistar-Furth rats to the development of enhanced contractile sensitivity and hypertension.

Abstract:

The letter 1 of Cyprian of Carthage, sent to the community of Furni, can be related to an inscription from Furnos Maius, which makes known — among the civic elite — the Geminii family. It confirms the identification of the bishopric seat suggested by Y. Duval : Furni doesn’t correspond to Furnos Minus. Other inscriptions show how the disciplinary issue mentioned by the bishop of Carthage could arise in the milieu of local notables, in which the clergymen were also chosen.

Abstract:

Abstract:
Background: Frequent asymptomatic involvement of the prostate has been demonstrated in men with febrile urinary tract infection (fUTI). In view of this, men with fUTI are often given a longer duration of antibiotic treatment; however, evidence to support this is limited. Methods: We prospectively studied adult men with fUTI admitted under the Department of Medicine in a tertiary care hospital in southern India. fUTI was defined as fever of ≥38°C with at least one symptom/sign of UTI and pyuria, requiring hospitalization. We estimated serum total prostate-specific antigen (PSA) levels at enrollment, one month and three months after treatment completion. We assessed prostatic volume by transrectal ultrasonography (TRUS) and estimated the serum high sensitivity C-reactive protein (hs-CRP) levels at baseline and after three months. Results: We enrolled 64 men (median [IQR] age 53 [45-60] years); 50 patients completed follow-up. At baseline, the median (IQR) serum PSA level was 2.15 (1.18-3.02) ng/mL and median (IQR) serum hs-CRP level was 2.43 (2.28-2.58) mg/L. At three months, serum PSA levels decreased by ≥25% in 47 (94%) of 50 patients. The median (IQR) of prostatic volume was 25.4 (18.9-34) mL at baseline, and ≥10% decrease in prostatic volume was observed in 24 (48%) of 50 patients at three months. The change in the serum PSA levels did not correlate with clinical findings like prostatic tenderness or with prostatic volume changes. Further, serum PSA levels did not correlate with hs-CRP levels. On follow-up, seven patients had lower urinary tract symptoms; only one of them had recurrent fUTI. Conclusions: Asymptomatic prostatic involvement, although common in men with fUTI, does not seem to influence the treatment outcomes.

Abstract:
ABSTRACT To ensure survival in the host, bacteria have evolved strategies to acquire the essential element iron. In Neisseria gonorrhoeae, the ferric uptake regulator Fur regulates metabolism through transcriptional control of iron-responsive genes by binding conserved Fur box (FB) sequences in promoters during iron-replete growth. Our previous studies showed that Fur also controls the transcription of secondary regulators that may, in turn, control pathways important to pathogenesis, indicating an indirect role for Fur in controlling these downstream genes. To better define the iron-regulated cascade of transcriptional control, we combined three global strategies—temporal transcriptome analysis, genomewide in silico FB prediction, and Fur titration assays (FURTA)—to detect genomic regions able to bind Fur in vivo. The majority of the 300 iron-repressed genes were predicted to be of unknown function, followed by genes involved in iron metabolism, cell communication, and intermediary metabolism. The 107 iron-induced genes encoded hypothetical proteins or energy metabolism functions. We found 28 predicted FBs in FURTA-positive clones in the promoters and within the open reading frames of iron-repressed genes. We found lower levels of conservation at critical thymidine residues involved in Fur binding in the FB sequence logos of FURTA-positive clones with intragenic FBs than in the sequence logos generated from FURTA-positive promoter regions. In electrophoretic mobility shift assay studies, intragenic FBs bound Fur with a lower affinity than intergenic FBs. Our findings further indicate that transcription under iron stress is indirectly controlled by Fur through 12 potential secondary regulators.
