El libro se abre con una introducción general al seminario por parte de Luis Ortega («La ponderación en el marco del pluralismo») y con una presentación de la teoría de la ponderación desde el Derecho Administrativo a cargo de Luis Arroyo Jiménez («Ponderación, proporcionalidad y Derecho Administrativo»). Después se sitúan las intervenciones de dos filósofos del Derecho en torno a la teoría general de la ponderación en el contexto del llamado neoconstitucionalismo: «Diez argumentos sobre neoconstitucionalismo, juicio de ponderación y derechos fundamentales», de Luis Prieto Sanchís; y «Neoconstitucionalismo y ponderación», de Alfonso García Figueroa. La segunda parte de la jornada estuvo protagonizada, previa presentación de Susana de la Sierra («La ponderación y su contexto. Una reflexión a título introductorio»), por administrativistas. En ella debatieron algunas aplicaciones concretas de la ponderación en el Derecho administrativo José María Rodríguez de Santiago («Ponderación y actividad planificadora de la Administración»), Francisco Velasco Caballero («Método de la ponderación y sistema competencial») y Gabriel Doménech Pascual («Principios jurídicos, proporcionalidad y análisis económico»).

This thesis examines the work of Mexican cinematographer Gabriel Figueroa (1907-1997) and suggests new critical perspectives on his films and the contexts within which they were made. Despite intense debate over a number of years, auteurist notions in film studies persist and critical attention continues to centre on the director as the sole giver of meaning to a film. Consequently, scholars and critics have overlooked the cinematographer's contribution. The small amount of work that exists on Figueroa, in keeping with studies on other cinematographers, is biographical and anecdotal, concentrating on his personal life rather than his contribution to Mexican cinema. Therefore, this thesis proposes a critical evaluation of Figueroa's cinematography and advocates new analytical paradigms to examine his work. The study constructs its arguments from close visual analysis of Figueroa’s films, his unpublished autobiographical writings, letters and related documents within the theoretical and critical contexts of film and Mexican cultural studies. From an overview of how scholars have neglected cinematography in the past, the thesis deconstructs widespread assumptions that relate Figueroa to notions of the national and focuses attention on the inherent transnational economic, political and ideological relationships that informed his images. Through close analysis of eight films I will examine how Figueroa expressed such transnational contexts in relation to: sound in the nascent Mexican industry, race and class in the rural space, urban modernity and the role of the mother and Figueroa's visual critique of the Mexican bourgeoisie. To pull focus shifts attention from one object in the frame to another. This study shifts critical focus onto Figueroa's contribution to the Mexican and international film industries. In so doing, it offers new analytical standpoints from which to evaluate not only Figueroa as a giver of meaning within Mexican cinema, but to also suggest alternative critical positions from which to view cinematography and its complex ties to, and expression of, a film’s political, economic and ideological contexts.

As one of the major directors of Mexico's Golden Age of Cinema (1936-1956), Emilio “El Indio” Fernández (1904-1986) created films which for many came to express the official vision of Mexican identity. Part of this identity was based on the ideology of indigenismo, which posited that the pre-Columbian past held the basic kernel of Mexico's national essence while advocating the incorporation of modern Indian groups into mainstream society. El Indio's films reflect the paradox of indigenismo: praise for indigenous cultures and a simultaneous effort to make them disappear. The following study examines three of his indigenista films, Marí­a Candelaria, Rí­o Escondido, and Maclovia, to see how Fernández created representations of Mexico's indigenous populations that contributed to and deviated from indigenista policies in post-Revolutionary Mexico. This representation relies on the formation of a national myth based on a static, aestheticized Indian which incorporates all Mexicans into official state history.

This chapter looks at an especially interesting articulation of the posthuman within the indigenista films of Emilio “El Indio” Fernández. It identifies an attempt to modernize indigenous peasants by exposing their bodies to modern medicine. The chapter views these films in the context of Roberto Esposito’s “immunization paradigm,” a biopolitical theory that compares the medical process of immunization to the state’s role of subject creation. When a people lacks a natural immunity to a vice (improper performativity of race and gender in the case of these films), a new actor, such as the state, must step in and provide an artificial immunity. Using this theoretical framework, the chapter analyzes the films Río Escondido (1947), María Candelaria (1944), Enamorada (1946), and The Torch (1950). The readings suggest that we approach these films as allegories for a postrevolutionary society where immunological discourses prescribe appropriate gender and racial performativity for the nation.
