This research examines two landmark negotiations between the United States and Mexico. The first involves the conflict over the shared hydrocarbon reservoirs in the Gulf of Mexico. The second analyzes the dispute over the shared waters of the Colorado River. For over seventy years, pursuing unilateral development, the U.S. and Mexico alternated between deadlock and confrontation in both cases. However, they were able to buck this trend in 2012, reaching two agreements. For the first time, the two sides have established a binational framework through which to co-develop and jointly manage these transboundary natural resources, as partners. This research explores how the negotiators shaped these agreements, and in what ways they contributed to the resolution of these long-standing disputes. With interviews with over 70 negotiators in the U.S. and Mexico, including every one of the chief negotiators who had decision-making authority at the negotiating table, the dissertation argues that a critical factor in breaking the cycle of disputes to reach agreement was that both sides were able to shift from solely allocating costs to also allocating benefits. The two countries reinterpreted the broader political and economic circumstances surrounding the shared water and energy resources, influenced in part by drastic natural disasters and resource shortages. These events, in turn, modified the countries' alternatives, drew stakeholders to the negotiations with revised mandates, fostered new back table coalitions, and led to a reframing of beneficial trades that had not been obvious earlier. Changes in political leadership, especially in regard to the interpretation of and response to transboundary challenges, were additional enabling factors making this shift possible. By focusing on the negotiation process and the tension between creating and claiming value, the dissertation attempts to draw prescriptive negotiation and leadership advice that may be useful in other international resource management disputes, particularly between developing and developed countries. As such, it aims to highlight how stakeholders can move beyond hard-bargaining tactics and avoid the ultimatums that accompany the presumption that there are not enough resources to go around, and that one side must win and the other must inevitably lose.

Full textThe main subject of this study is the consensus analysis of negotiations of Regional Trade Agreements (RTAs). Generally speaking, delays and interruptions caused by controversies and impasses end up becoming strong efficiency problems which jeopardize the consensus building during any negotiation. As a justification, the target of this study is to identify processes to help obtain, efficiently, agreements in the RTAs negotiations. Its final objective was to search for theoretical tools and techniques to be applied in situations of stoppage in a sense of eliminating the difficulties or making them at least easier to deal with. Secondarily other theoretical points of view were considered with the intention of understanding how strategies and theoretical tools can contribute in each/or different scenario of the negotiation. Through the different ways of looking at it for the conduction of the negotiations, for evaluating the dimensions of the negotiations and in order to build up the consensus, the researcher was able to understand the perception and the interpretation of the subject in view. At last the conclusion was that the applicability of the chosen framework is positive in helping solve problems and controversies as well as building up the consensus during the negotiations.
Esse trabalho aborda como tema principal o estudo da construção de consenso em negociações de Acordos Regionais de Comércio (ARCs). Nas negociações em geral, atrasos e paralisações, ocasionados por controvérsias e impasses, podem constituir um forte problema de eficiência na construção de consenso. Como justificativa, diante da problemática, esse trabalho visa identificar processos que auxiliem a obter, eficientemente, acordos nas negociações. Seu objetivo final foi a busca por instrumentos teóricos e técnicas que pudessem ser aplicados em situações de paralisações, no sentido de eliminá-las ou amenizá-las. Como objetivo secundário, foram estudadas outras abordagens teóricas no intuito de entender, sob diversas óticas, como estratégias e instrumentos teóricos contribuem mais eficientemente em certas situações e/ou negociações. Através das diferentes abordagens escolhidas para avaliação das dimensões presentes nas negociações e para construção de consenso, ficou possível ao pesquisador a percepção e interpretação do fenômeno estudado. Ao final, concluiu-se positivamente sobre a aplicabilidade do arcabouço teórico escolhido, no auxílio na solução problemas de controvérsias e impasses, bem como, na construção de consenso nas negociações.

Full textBackground: In Sweden 76 % of the population has savings in mutual funds, with a combined wealth of 1 925 billion SEK. The tax on capital gains is 30 % and is activated when the profit is realized. Many Swedes avoid triggering this tax effect and is therefore locked-in in their mutual funds. Purpose The purpose of this study is, from interviews with private fund investors and industry players, to explain how the capital gains tax affects individuals’ reasoning and actions. This behavior will then be analyzed in terms of existing theories in the field. Method: We have used an abductive method to achieve the purpose of this study. The empirical material has been collected through semi-structured interviews. We have conducted 10 interviews with private fund investors and 6 people in the fund industry. The material from the interviews was then explained by means of the theories we have selected. Conclusion: In our study we came to the conclusion that the lock-in effect varies depending on the fund savers age. The younger group was more indifferent to the capital gains tax, due to a shorter investment horizon. The older group had a more unspecified investment horizon and based their investment decisions along the tax consequence. Capital gains tax then had a braking effect, as it would reduce the total wealth.

Full textENGLISH ABSTRACT: One of the first labour reforms introduced by the then newly elected democratic government of South Africa was the introduction of statutory workplace forums. This ground-breaking chapter in the 1995 Labour Relations Act outlined the first legally mandated form of workplace participation, beyond the sphere of the collective bargaining arena. To date, however, the provisions of the Act which govern workplace forums have been subjected to criticism by both labour and business alike, as well as from academics. The sad reality is that there has been a minimal uptake in the establishment of these forums in the 13 years since the provisions of the Act came into force. This research report has delved into the reasons for this resistance, from the side of both labour and business. The multitude of reasons that exist have been grouped under a series of headings that have then allowed the writer to focus on finding factors that would facilitate the establishment of statutory workplace forums. In considering the factors that would facilitate the enhanced uptake and establishment of workplace forums, the research has guided the writer towards the implementation process per se, in particular the attitudinal and mind-set factors that are required as pre-requisites before the more legislatively focussed aspects of the implementation cycle should be undertaken. While there are no doubt valid concerns with several of the clauses in the legislative provisions, in the opinion of the writer these are not the predominant reasons for the failure of the workplace forum vehicle. The adversarial mindset that still exists between business and labour, as well as the worldviews and consequences that stem from such a mindset, has been the largest obstacle in the establishment of workplace forums. Until both parties, and the broader South African society within which all businesses exist, are able to make the fundamental shift from “win or lose” to “mutual gains through co-operation” the workplace forum vehicle will not be implemented, and the drive to further workplace participation will not be successful. The writer has suggested various changes that should be made to the legislation, and processes that should be put in place to start to lay the foundations upon which the workplace forum model can later be built up on. AFRIKAANSE OPSOMMING: Statutêre werkplekforums was een van die eerste arbeidshervormings wat deur die destyds nuut verkose demokratiese regering van Suid-Afrika bekend gestel is. Hierdie baanbrekershoofstuk in die Wet op Arbeidsverhoudinge van 1995 het die eerste vorm van werkplekdeelname met ’n regsmandaat buite die sfeer van die kollektiewe bedingingsarena uiteengesit. Die bepalings van die Wet wat op werkplekforums gerig is, is egter tot dusver aan kritiek deur arbeid, die sakesektor en akademici blootgestel. Die hartseer werklikheid is dat daar in die 13 jaar sedert die bepalings van die Wet in werking getree het ’n minimale opname in die vestiging van hierdie forums was. Hierdie navorsingsverslag verken die redes vir hierdie weerstand uit die oogpunt van arbeid sowel as besigheid. Die talle redes wat bestaan is saamgegroepeer onder verskillende opskrifte wat die skrywer in staat gestel het om faktore te vind wat die vestiging van statutêre werkplekforums fasiliteer. Wanneer daar gekyk word na die faktore wat die sterker opname en vestiging van werkplekforums kan fasiliteer, lei die navorsing die skrywer na die implementeringsproses op sigself. By die implementeringsproses is dit veral faktore soos houding en ingesteldheid wat as voorvereistes nodig is voordat daar aandag geskenk kan word aan aspekte van die implementeringsiklus wat meer op wetgewing gerig is. Hoewel daar ongetwyfeld geldige kommer oor verskeie van die klousules in die wetgewende bepalings is, is dit volgens die skrywer se mening nie die vernaamste redes vir die mislukking van die werkplekforummedium nie. Die antagonistiese ingesteldheid wat steeds tussen besigheid en arbeid bestaan sowel as die wêreldbeskouings en gevolge wat uit sodanige ingesteldheid spruit, is die grootste struikelblok in die vestiging van werkplekforums. Die werkplekforummedium kan slegs geïmplementeer word en die veldtog om werkplekdeelname te versterk kan net slaag indien albei partye, en die groter Suid-Afrikaanse samelewing waarin alle besighede bedryf word, ’n wesenlike skuif kan maak van “wen of verloor” na “gesamentlike voordele deur samewerking”. Die skrywer stel voor dat wetgewing verander word en dat prosesse geïmplementeer word om te begin om die grondslag te lê vir die bou van die werkplekforummodel.

Negotiation is the most efficient tool to achieve something you want, it occurs when there are conflicts and alternatives to be selected that can involve the whole company. The various alternatives have common and conflicting interests, expressing the complexity of relationships. With the increasing demand for agility in responding to the new profiles to search, organizations need to be more versatile in the process and faster to react to market changes, and the Negotiation of Mutual Gains (NMG) are a current driving value-creation. This dissertation aims to propose the use of tools of the theory of the NMG for the managers as a tool supporter of public purchases purchasers of products and services at IT to achieve the expected results. For this, we performed a search of a descriptive and exploratory using qualitative approach. To achieve this objective, theoretical studies were made of themes: Organizational Flexibility, Management of Public Procurement, Information Systems, Strategic Alignment and theory of negotiation in order to get a better understanding of the research. It was not drawn up a structured questionnaire, the research instrument used in this study. Applied the questionnaire directly to participants, it was obtained a participation of 10 respondents, all of participating in public bidding processes Delta. Once performed the data collection, the responses were analyzed using a form of the technique of content analysis, called pattern-matching in order to compare the results with the theoretical framework used in the study. As a result of the study, it was identified using the distributive approach in bidding processes.
A negociação é a ferramenta mais eficiente de conseguir algo que se deseja, ela ocorre quando existem conflitos e alternativas a serem selecionadas que podem envolver toda a empresa. As diversas alternativas apresentam interesses comuns e conflitantes, expressando a complexidade das relações. Com a crescente demanda por agilidade na resposta aos novos perfis de procura, as organizações precisam ser mais versáteis nos processos e mais rápidas para reagir às mudanças do mercado, e as Negociações de Ganhos Mútuos (NGM) são uma forma atual de condução de criação de valor. Esta dissertação tem como objetivo propor a utilização das ferramentas da teoria de NGM como instrumento apoiador aos gestores de compras públicas adquirentes de produtos e serviços de TI a atingir os resultados esperados. Para isso, foi realizada uma pesquisa de natureza descritiva-exploratória por meio de abordagem qualitativa. Para atingir este objetivo, foram feitos estudos teóricos das temáticas: Flexibilidade Organizacional, Gestão de Compras Públicas, Sistemas de Informação, Alinhamento Estratégico e Teoria da Negociação, de forma a se obter um melhor entendimento da pesquisa. Foi elaborado um questionário não estruturado, sendo este o instrumento de pesquisa que foi utilizado neste estudo. Aplicado o questionário diretamente aos participantes, obteve-se uma participação de 10 respondentes, sendo todos participantes dos processos licitatórios na empresa pública Delta. Uma vez efetuada a coleta de dados, foram analisadas as respostas utilizando uma modalidade da técnica de análise de conteúdo, chamada pattern-matching, com o propósito de comparar os resultados com o referencial teórico utilizado no estudo. Como resultado do estudo, identificou-se a utilização da abordagem distributiva nos processos licitatórios.
