Full textDeposit insurance (DI) is intended to prevent bank runs and to reduce systemic risk. It makes the value of deposits independent from the behavior of other depositors or from the value of bank assets. Its existence induces a moral hazard which might threaten the stability of the bank system. On one hand, the depositors are no more incited to monitor their banks. On the other hand the banks have an interest to adopt more risky strategies while the di premia are imperfectly linked to the risk. The efficiency of the di depends on the control of moral hazard, which means the agents' responsabilisation, depositors included. There is a conflict between the di principles and the present propositions of improvement of this mechanism. The possible solutions in order to solve this paradox are the restriction of the insurance coverage only for the demand deposits and the implementation of the double liability for the bank shareholders. The sight deposits insurance eliminates the incentive to bank runs caused by the fear of lack of liquidity, whereas the term deposits are exposed to losses which reduce the moral hazard induced by the sight deposit insurance. .

Full textIf the concept of guarantee primarily reflects the parties’ distrust of one another, it also conveys their need for trust, which is necessary to facilitate transactions, comfort the creditor’s position and the debtor’s financial situation and more generally to secure the market. In the context of financing transactions (credit and refinancing operations, bond loans and structured financing operations), the importance of guarantees and counter-guarantees is bound to the will and function of the parties to trade and influenced by the environment that the market and associated regulation have set. A financing transaction is especially defined by a contractual structure involving a financing package along with guarantee and counter-guarantee mechanisms. This contractual structure establishes the {original contract – guarantee – counter-guarantee} complex, core of this thesis.The purpose of this thesis is to study the relationships between the original contract and the guarantee, the guarantee and the counter-guarantee, the counter-guarantee and the original contract within financing transactions, with regard to civil law as well as banking and financial law. The analysis will focus on the nature of these contractual relationships when implementing and executing the guarantees and counter-guarantees, the force of which will then be assessed in respect to insolvency proceedings and the banking resolution regime. The effectiveness of the guarantees and counter-guarantees within the financing transactions is thus at stake and must serve the transaction’s efficiency

Full textThis dissertation seeks to address whether the detrimental incentives of deposit guarantee could be weakened by capital-adequacy regulation. The deposit guarantee have to reduce bank panics and runs in insuring the repayment of the deposits, in case of failing bank. However, the insurance premiums paid by banks to regularors, in return for the guarantee of their deposits, are fixed and entirely independent of their asset risk. As a result, the depository institutions are induced to adopt detrimental behaviour in investing in rikier assets, in order to increase the shareholders' wealth. This distortion in behaviour, called the "moral hazard", can be limited by capitaladequacy regulation. A theoretical and practical analysis of these regulation's effects on the banks' investment decisions will be proposed. Two models of bank equity, using the option pricing theory, will be the support of this theoretical study. The one-periot model is inspired with the marcus's (1984) model and the multi-period is a modified version of the merton's (1978) model. The value of bank equity is viewed as a call option and the value of a deposit guarantee as a piut option. The asset to deposit ratio, the regulation costs, the periodicity of deposit guarantee contract, the random character of regulation audit and the bank charter value will be take into account. A practical analysis of these models, using simulations, allowed to confirm the effectiveness of capitaladequacy regulation. This one eliminate the "moral hazard" problem of the great majority of banks, except for precarious banks

Full textInformation asymmetry and lack of collateral are two major reasons that prevent SMEs to access credit markets. Therefore, banks ration credit to SMEs. Given that the contribution of SMEs to economic growth, job creation and innovation, we try to prove the need of public intervention in favor of SMEs' access to bank credit. We analyze the market failure and the benefits of credit guarantee agency for resolution of information asymmetry and lack of collateral. The results show that the credit guarantee system, which is at the centre of the policy of intervention, is an effective way that can solve both problems encountered by SMEs. Thus, in the context of the difficult access of Chinese SMEs to bank credit, the intervention policy in favor of their financing is implemented in China since 1999. The Chinese credit guarantee system is compared with those of other countries to assess the Chinese system. We also carry out the comparison between the performance of the public credit guarantee agency and the commercial credit guarantee agency on taking the establishment of the credit guarantee system in Chengdu as an example

Full textThe independence of an autonomous guarantee being linked to the will of the parties may bring about unexpected results. But this autonomy what it is in harmony with the interests of the beneficiary of the guarantee facilitates international transactions without causing thereby any negative consequences on the transaction taking place. As such, it becomes a necessary aim that any mistrust relating to the effectiveness of the kind of surety is lifted. But this is so to be undertaken without any possibility of abuse. In France and in other developed countries, the legal implementation and regulation of autonomous guarantees are stable and coherent. Autonomy and "Defence owing to underlying contract" yield coherent results. The situation is different in Iranian law where the terms "autonomy" and "defence owing to underlying contract" are quite foreign to the legal vocabulary. Nevertheless, a study of known case-law, shows that a certain level of independence can be achieved owing to the fact that some courts, relying on the text of the guarantee, order immediate payment, on a first request, without that the account party or the guarantor may oppose payment owing to exceptions drawn from an underlying contract. Academics are mostly in favor of considering a bank guarantee as independent from its underlying contract. A request for stopping payment is refused under French law with the exception of an obviously abusive request. The French solution must be applied in Iranian law, although within the current legal climate, Iranian case-law is marked by a large number of summary injunctions on the application of the account party

Full textAssign a bank account as security for a debt is a common pratice in banking circles of the ODAHA law. This raises the question of in what capacity the bank account is charged. The study should be conducted in two directions : first, the legal nature of this mechanism, then its legal regime. The legal nature is diverse, which leads to the selection of the escrow account as an alternative to unification. The pledge of security interest is necessarily the bank account, it comes as a pledge of assets (in case the account is not blocked) and a pledge of escrow account (if the account is held). This distinction controls the legal regime of the pledge of bank accounts. On the system of pledge of receivables, the analysis reveals that some of his solutions are inadequate bank account and proposes reforms. On the system of guarantee of a blocked account, the author of the thesis in its calls for urgent statutory recognition in the OHADA law

Full textThe arbitrage between financial stability and the efficiency of banking systems has always been a key issue indefining the prudential regulation. This thesis analyses how this arbitrage is conceived and the extent to which itallows to reconcile the two objectives, namely the cost and the benefits of the new regulatory framework. We firstfocus on the impact of the new capital and liquidity requirements on the cost of capital and on banking activities. Ourfindings indicate that, globally, the cost of the recent reform is relatively low and does not have a significant impacton lending. We also emphasize a differentiated effect according to banks’ size, systemic importance and businessmodel. The existence of various distortions, affecting the pricing of risk, motivates the second part of the thesis, whichis dedicated to the analysis of implicit guarantees. We also assess the impact of resolution regimes and practices inending the too big to fail anomaly. Although ambitious measures have been undertaken, there is still a way to go toeliminate these distortions. In the third part, we examine the contribution of solvency and liquidity requirements tostrengthen the resilience of banks. The results indicate that setting up good incentives, through adequate prudentialstandards, could efficiently reduce financial risks (default probability, systemic risk, capital shortfall in case of adversescenario). The approach adopted in this thesis focuses on microeconomic aspects and is based on empirical studiesapplied to a sample of European banks

Generalmente las entidades bancarias cuentan con un sistema especializado en Banca que administra las principales áreas y requerimientos que toda entidad de esa naturaleza debe poseer, incluyendo un alto grado de seguridad. Sin embargo, como en muchos casos hay nuevos procesos y funcionalidades requeridas por las organizaciones que actualmente no pueden ser cubiertas por dichos sistemas, y desarrollarlos sobre la misma plataforma supondrían una gran inversión en costos y tiempo. Tal es el caso de la gestión de cartera que tratamos en el presente trabajo, donde nos orientaremos a gestionar los créditos a largo plazo de la cartera bancaria proponiendo un sistema web especializado, basándose para ello de tecnologías más difundidas en el mercado de desarrollo de software que permiten realizar una menor inversión, asimismo valiéndose de una arquitectura web que facilite la integración de sistemas y propicie la consistencia de información.

Full textThe need to provide collateral securities to cover risks of unpaid debts implies that some financial costs will be incurred by companies and particularly, small and medium-sized firms. The total cost linked to any guarantee comprises two aspects : direct costs involving the immediate and futur cost and, induced costs involving the permanent and potential cost. The nature of these two types of costs has been emphasized here empirically. Direct costs and, to a certain extent, be quantified. The result of their analysis shows that the direct cost of personal securities takes precedence over that of real securities. But mortgage gives rise to the highest level of direct costs when compared to all other real securities. On the other hand, induced costs can not be quantified in all possible cases. A survey involving 50 managers of small and medium-sized companies shows that induced costs are highlighted through the entrepreneur's awareness of the risks generating them. These costs may also be just as important as direct costs. Incidentally, in the case of those companies comprising the above sample, the manager's conception of risks generating induced costs is a function of certain structural characteristics of his firm rather than its other features. However, the total cost of the different types of guarantees studied remains only partially measurable. The measurement problem is linked to the difficulty in controlling the uncertain nature of some sources of this cost because the latter are subject to numerous conditions. Nevertheless, it has been suggested that a formal approach can be taken in order to determine the real cost of guarantees involved in corporate financial policies. Full textJudicial cooperation no longer seems to be the preferred mean of extraterritorial access to bank data in criminal matters. While in the area of access to telecommunications data, the decline of judicial cooperation is taking place in favor of direct access to data held by transnational companies, such direct access does not seem to be developing with banks, even if it exists in practice. It is rather the development of the role of financial intelligence units that seems to be emerging. Leaving the framework of judicial cooperation without departing from the principle of cooperation between States, extraterritorial access is also detached from the guarantees traditionally attached to judicial cooperation, which are supposed to guarantee both the respect of States' sovereign interests and the protection of individuals' rights. While the attributes of States' sovereignty tend to fade away in financial investigations, the emergence of the interests of individuals to maintain control over their data tends to increase.In this context, it is not the multiplicity of forms of extraterritorial access that is problematic in itself, but the fact that the coexistence of these different forms tends to multiply the possibilities of conflicts between national visions of the legitimacy of access to bank data. Because these conflicts create risks to both the individuals' rights and the effectiveness of access, one solution would be to find an agreement to end them. However, this would only be possible under two conditions: mutual recognition by the States involved of equivalence between their investigative authorities and the investigative authorities of their partners, and an agreement on the conditions regulating this access to take into account data subjects' and banks' rights

Devido à baixa rentabilidade das operações bancárias e à dificuldade quanto ao oferecimento de garantias reais para a obtenção de crédito pelas micro e pequenas empresas, inclusive pelo seu pequeno porte e mínima solidez, torna-se necessário que haja uma interatividade entre as mesmas, com relação às questões vivenciadas em seu dia-a-dia, fazendo com que isto seja objeto de estímulo ao desenvolvimento, a título regional, na busca de sua autonomia, isto baseado em estatuto próprio, do qual consta a Sociedade de Garantia Solidária (SGS), de acordo com a Lei no 9.841, artigos de 25 a 31, regulamentada pelo decreto 3.474, de 19/05/2.000, cuja proposta faz parte deste trabalho. Objetivou-se desenvolver, teoricamente, através do Sistema FAMPESC, critérios para a constituição e dissolução da Sociedade, e estimativa de alavancagem para sua operação, além de uma proposta de convênio com bancos. A referência analítica para o presente estudo foi a Sociedade de Garantia Recíproca da Espanha (SGR), pois a legislação da SGS é derivada da original espanhola (SGR). Como ocorre geralmente nas pesquisas, a abordagem qualitativa busca descrever situações envolvendo pessoas e seu comportamento, bem como citações literárias. A posteriori, procura-se relatar na visão de cada AMPE e mediante entrevistas, quais as medidas que devam ser tomadas, a médio prazo, para que o acesso ao crédito possa ser garantido. Conclui-se, que há uma possibilidade de se implantar a SGS em Santa Catarina, ela passará a depender também das autoridades públicas e regionais, devendo elas exercerem o papel de indutoras ou promotoras, ao conceber maneiras diversas de participação, com regras de saída progressivas, não deixando de responsabilizar as empresas e também não as impedindo de conseguir melhores condições financeiras em suas atividades.

Apparently unlimited today, this freedom would have even undeniableconsequences on the safety of the financial system by facilitating the phenomenon of “speculative bubbles”. Thecontract, situated in the heart of the banking and financial activity, would be thus the cause of this reality. Therecent shocks, such as financial crises, require the detailed examination of the national but also internationalbank transactions, especially the most dangerous. Still ignored, the measurement of the contractual freedom ofthe banker proves to be necessary to propose a review. The aim is not thus to rule any banker’s freedom out butto define the degree of contractual freedom to grant to him for each transaction. The idea being to grant him asatisfactory level of freedom while ensuring the safety of financial system. The stake rests finally on theconciliation of the contractual requirement, resulting from the contractual freedom of the banker, with the safetyrequirement of the financial system, necessary for the sustainability of banks and worldwide economy
